The term of Radiográfica Costarricense Sociedad Anónima and the Compañía Nacional de Fuerza y Luz is ninety-nine (99) years, starting from the entry into force of this Law; that of the Compañía Radiográfica Internacional Costarricense Sociedad Anónima and the companies they constitute shall be as indicated in their articles of incorporation.

The members of the ICE Board of Directors whose appointment period expires on June 30, 2010, shall be appointed or replaced as follows:
The current executive president's term shall run until May 8, 2010; on that date, they shall be replaced or appointed for another four (4)-year term by the incoming Government Council.
For the new members of the Board of Directors, the Government Council shall randomly select the person upon whom the appointment shall fall, in the following manner: one member for four (4) years, one for five (5) years, and another for six (6) years.
The members of the Board of Directors whose appointment period expires on June 30, 2014, shall be appointed or replaced as follows:

Subsequent appointments shall be made for the term established in this Law.

Without prejudice to the provisions of Article 39 of this Law, the powers of the Ministry of Governance and Police and the National Radio Control Department, assigned in the Radio Law, No. 1758, of June 19, 1954, and related to the control of the radioelectric spectrum, are transferred to SUTEL. Similarly, the functions assigned to the Dirección de Servicios de Telecomunicaciones of the Autoridad Reguladora de los Servicios Públicos are transferred to SUTEL.

Upon the entry into force of this Law, the personnel, budget, assets, liabilities, and net worth of the National Radio Control Department of the Ministry of Governance and Police assigned to radioelectric spectrum control tasks shall be transferred to SUTEL. Similarly, the budget, assets, liabilities, and net worth of the Autoridad Reguladora de los Servicios Públicos assigned to the Dirección de Servicios de Telecomunicaciones are transferred to SUTEL.

As of the date of entry into force of this Law, the officials of the National Radio Control Department of the Ministry of Governance and Police shall have the power to decide whether or not to transfer to the Superintendencia de Telecomunicaciones. If they transfer, they shall retain all their labor rights; in case they decide not to transfer, their employer must pay them the statutory labor entitlements due by law. Officials of this Department who are over fifty-five (55) years old and have more than thirty (30) annual contributions to the Caja Costarricense de Seguro Social may avail themselves of retirement, if they so request.
The officials of the Dirección de Servicios de Telecomunicaciones y Correos of the Autoridad Reguladora de los Servicios Públicos shall have the power to decide whether or not to transfer to the Superintendencia de Telecomunicaciones. If they transfer, they shall retain all their labor rights; if they decide not to transfer, the Autoridad Reguladora de los Servicios Públicos must pay them the statutory labor entitlements due by law.

As of the date of entry into force of this Law, the process of forming and integrating SUTEL shall begin; for this purpose, a maximum period of six (6) months shall be available.
The Board of Directors of ARESEP shall have ninety (90) calendar days, from the date of entry into force of this Law, to appoint the members of SUTEL. The procedure for said appointments shall be in accordance with this Law.
For the first appointment of the three (3) members of the SUTEL Council, the Board of Directors of ARESEP shall choose by raffle the term of the appointments, in the following manner: one member for three (3) years, one for four (4) years, and another for five (5) years. Subsequent appointments shall be made for the term established in this Law.

SUTEL is exempted, for a period of twelve (12) months, which shall begin to run from the day of its integration, from the obligation to apply the procedures established in the Administrative Procurement Law (Ley de Contratación Administrativa), to acquire the materials, goods, and services that, in SUTEL's judgment, are indispensable for fulfilling its functions. The Contraloría General de la República shall review, a posteriori, not only the legality, timeliness, convenience, and compliance with the procedures applied, but also shall verify compliance with the principles provided for in the administrative procurement system (ordenamiento de la contratación administrativa).

In 2010, when appointing the new proprietary and alternate members of the Board of Directors of ARESEP, the Government Council shall randomly select the person upon whom the appointment shall fall, in the following manner: one member for two (2) years, one for three (3) years, one for four (4) years, and another for five (5) years. Subsequent appointments shall be made for the term established in this Law. The procedure for the alternates shall be the same.
For this one time, the first appointment of the deputy general regulator to be designated upon the entry into force of this Law shall hold their position until the year 2011.
The alternate members of the Board of Directors of the Autoridad Reguladora to be designated upon the entry into force of this Law shall hold their positions until May 8, 2010.

Within three (3) months following the date of entry into force of this Law, ICE and RACSA must provide the overseeing minister with the information required for the formulation of policies and the preparation of the National Telecommunications Development Plan and shall provide all their cooperation in whatever is necessary for its achievement.
This Law comes into force upon its publication.
