in the full text - Full Text of Regulation 048 Establishes that public institutions and companies providing electricity, fuel, and water services take measures to improve their efficiency and show austerity in the controllable costs of each one Full Text of Record: EEB3A Nº 048-MP-H-MINAE THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF THE PRESIDENCY, THE MINISTER OF FINANCE, AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the powers conferred by Articles 9, 130, 140 subsections 7), 8), 18) and 20), 146, 176, 180, 188, 189, of the Political Constitution; Articles 1, 4, 21, 25, 26, 27, 113 subsections 2) and 3) of Law Nº 6227, General Law of Public Administration of May 2, 1978, and its amendments; 34 of Law Nº 8660, Law for the Strengthening and Modernization of Public Entities in the Telecommunications Sector, 57 of Law Nº 8131, Law of Financial Administration and Public Budgets, and 7, 8 and 24 subsection a) of the Organic Regulation of the Executive Branch, Decree 34582.

1That the National Institute of Statistics and Censuses (INEC) determined that year-on-year inflation as of February of this year was 6.52%, measured through the consumer price index (CPI).
2That the increase in rates for public services regulated by the Public Services Regulatory Authority was one of the main triggers in the cost of living because they grew by 15.8%, which is three times higher than the average CPI growth over the past year. Meanwhile, the prices of non-regulated goods, which are set by supply and demand, had a year-on-year variation of 4.1% last February.
3That the Executive Branch, in the exercise of its directive authority in government matters, is empowered to issue directives as general policy guidelines that establish purposes, objectives, and goals.
4That the Constitutional Chamber of the Supreme Court of Justice, in ruling 2006-17600, indicated that "(.) In turn, regarding the public-law entity subject to the directive, this Constitutional Court, since Vote Nº 3309-94 —reiterated in Nº 2276-96 of May 15, 1996— has stated that the Executive Branch may only issue general directives to all autonomous institutions, to groups thereof, or in general areas of action (.)."
5That the Law of the Public Services Regulatory Authority, Nº 7593, establishes the principle of service at cost to determine the method of setting rates for public services regulated by the Public Services Regulatory Authority, such that only the costs necessary to provide the service are considered, allowing a competitive return and guaranteeing the adequate development of the activity, in accordance with Article 31 of said law.
6That in order to reduce the country's year-on-year inflation, it is necessary that the public institutions and companies providing electricity, fuel, and water services regulated by the Public Services Regulatory Authority take the necessary measures to improve their efficiency and show austerity in the costs controllable by each company in order to: 1) Reduce total annual expenses and costs, upon which they can have an impact, so that they do not grow on average beyond the year-on-year CPI variation plus 25% thereof, in 2013, and the CPI variation plus 15% thereof in 2014; 2) Not increase salary expenses beyond what results from the adjustments decreed by the Executive Branch and the regulations in force; 3) Restructure their debt and other financing contracting mechanisms already acquired, so that they are more efficient and consistent with current market conditions and the characteristics of the financed assets; and 4) Seek financing contracting mechanisms for new projects that match the characteristics of the financed assets. Therefore,

They issue the following, DIRECTIVE:

1Que el Instituto Nacional de Estadística y Censos (INEC) determinó que la inflación interanual a febrero del presente año fue de un 6,52%, medida a través del índice de precios al consumidor (IPC).
2Que el incremento en las tarifas de los servicios públicos regulados por la Autoridad Reguladora de los Servicios Públicos, fue uno de los principales disparadores en el costo de vida porque crecieron en un 15,8% que es tres veces mayor al promedio de crecimiento del IPC en el último año. Mientras, los precios de los bienes no regulados, que son establecidos por la oferta y demanda, tuvieron una variación interanual de un 4,1% en febrero anterior.
3Que el Poder Ejecutivo en el ejercicio de su potestad de dirección en materia de gobierno, está facultado para emitir directrices como lineamientos de política general que establece fines, objetivos y metas.
4Que la Sala Constitucional de la Corte Suprema de Justicia en la resolución 2006-17600 señaló que "(.) Por su parte, en cuanto al sujeto jurídico-público destinatario de la directriz, este Tribunal Constitucional desde el Voto Nº 3309-94 -reiterado en el Nº 2276-96 del 15 de mayo de 1996- ha señalado que el Poder Ejecutivo solo puede dictar directrices generales a todas las instituciones autónomas, a conjuntos de éstas o en áreas de acción generales (.)".
5Que la Ley de la Autoridad Reguladora de los Servicios Públicos, Nº 7593, establece el principio de servicio al costo para determinar la forma de fijar las tarifas de los servicios públicos regulados por la Autoridad Reguladora de los Servicios Públicos, de manera que se contemplen únicamente los costos necesarios para prestar el servicio, que permitan una retribución competitiva y garantice el adecuado desarrollo de la actividad, de acuerdo con lo establecido en el artículo 31 de dicha ley.
6Que con el fin de disminuir la inflación interanual del país, es necesario que las instituciones y empresas públicas que prestan servicios de electricidad, combustibles y agua regulados por la Autoridad Reguladora de los Servicios Públicos tomen las medidas necesarias para mejorar su eficiencia y muestren austeridad en los costos controlables por cada empresa para: 1) Reducir los gastos y costos totales anuales, en los que puedan incidir, de manera que no crezcan en promedio más allá de la variación interanual del IPC más su 25%, en el 2013 y la variación del IPC más su 15% en el 2014; 2) No incrementar los gastos de salarios por encima de lo que resultara de los ajustes que sean decretados por el Poder Ejecutivo y las normativas vigentes; 3) Reestructurar su deuda y otros mecanismos de contratación de financiamiento ya adquiridos, de forma tal que sean más eficientes y acordes a las condiciones de mercado actual y a las características de los activos financiados; y 4) Procurar mecanismos de contratación de financiamiento de nuevos proyectos que se ajusten a las características de los activos financiados. Por tanto,

Emiten la siguiente, DIRECTRIZ:
