They Decree:
THE CONSTITUTION OF THE HIGH-LEVEL COMMISSION FOR THE EXECUTION OF THE COMPREHENSIVE PROGRAM FOR WATER SUPPLY FOR GUANACASTE (NORTH PACIFIC)
Considering:
1. Minister of Environment and Energy, who shall act as coordinator; 2. Minister of National Planning and Economic Policy 3. Minister of Agriculture and Livestock; 4. Executive President of the Costa Rican Electricity Institute; 5. Executive President of the Costa Rican Institute of Aqueducts and Sewers; 6. General Manager of the National Service of Groundwater, Irrigation and Drainage.
To coordinate and support the execution of the "Comprehensive Program for Water Supply for Guanacaste (North Pacific)", which shall have a Technical Secretariat (Secretaría Técnica) to carry out all necessary actions for the fulfillment of its objective.
1. To articulate, integrate, and reconcile the policies and planning instruments issued in water matters; promoting their implementation through the institutions with competencies in water matters.
2. To make agreements and recommend to the President of the Republic the necessary guidelines that ensure compliance with the Program.
3. To approve the Program with its respective projects and budgets provided by the institutions responsible for execution.
4. To coordinate the process of permanent compliance and evaluation of the Program, allowing for the adjustment, if necessary, of the guidelines and the action plan to ensure the effective execution of the Program.
5. To hear and approve the progress reports of the Program that are submitted for its consideration by the Technical Secretariat.
6. To promote and approve the inter-institutional agreements required for the smooth running of the Program.
7. To periodically present to the President of the Republic reports on the progress of the Program’s execution.
The High-Level Commission, through its coordinator, may, when deemed pertinent, convene the technical support of the Public Universities according to the subject matter to be addressed.
1. A representative from the Water Directorate (Dirección de Agua) of MINAE; who shall coordinate the Technical Secretariat.
2. A representative from the Costa Rican Tourism Institute; (ICT).
3. A representative from the Ministry of National Planning and Economic Policy (MIDEPLAN).
4. A representative from the Costa Rican Electricity Institute; (ICE).
5. A representative from the Costa Rican Institute of Aqueducts and Sewers; (AYA).
6. A representative from the National Service of Groundwater, Irrigation and Drainage; (SENARA).
7. A representative from the National Meteorological Institute; (IMN).
8. A representative from the National Environmental Technical Secretariat, (SETENA).
9. A representative from the National System of Conservation Areas, (SINAC).
10. A representative from the National Commission for Risk Prevention and Emergency Response, (CNE).
11. A representative from the Institute for Municipal Development and Advisory (IFAM).
a. To elaborate and design the content of the Program with its respective projects, budgets, and responsible institutions for its effective implementation and submit it for approval to the High-Level Commission.
b. To elaborate the roadmap for the execution of the program.
c. To follow up on the execution of the Program approved by the High-Level Commission.
d. To coordinate with water users, municipalities and State institutions, as well as with communities in general, the actions related to the use and utilization of water, pursuant to the Program.
e. To guarantee adequate intersectoral and inter-institutional coordination, for the attention and follow-up of the Program and roadmap.
f. To coordinate the technical, administrative, and financial activities of the High-Level Commission.
g. To evaluate and report quarterly to the High-Level Commission on the progress of activities, works, and projects, contemplated in the Program.
h. To ensure that the projects comply with the regulations and guidelines issued on the matter.
i. To carry out periodic inspections, drawing up the respective record (acta), in order to verify the progress of the actions, works, and projects.
For the fulfillment of the foregoing, the High-Level Commission may assess the exceptional cases in which the provisions of Article 3 of Presidential Directive 9-H, of July 14, 2014, and its amendments may be waived, due to convenience and need, with prior justification that must be supported by the respective Ministers or Heads and submitted for consideration to the Minister of Finance and the President of the Republic.

LA CONSTITUCIÓN DE LA COMISIÓN DE ALTO NIVEL PARA LA EJECUCIÓN DEL PROGRAMA INTEGRAL DE ABASTECIMIENTO DE AGUA PARA GUANACASTE (PACÍFICO NORTE)
Considerando:
Decretan:
1. Ministro (a) de Ambiente y Energía, quien actuará como coordinador; 2. Ministro (a) de Planificación Nacional y Política Económica 3. Ministro (a) de Agricultura y Ganadería; 4. Presidente Ejecutivo del Instituto Costarricense de Electricidad; 5. Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados; 6. Gerente General del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.
Coordinar y apoyar la ejecución del "Programa Integral de Abastecimiento de Agua para Guanacaste (Pacífico Norte)", el cual contará con una Secretaría Técnica para realizar todas las acciones necesarias para el cumplimiento de su objetivo.
1. Articular, integrar y conciliar las políticas e instrumentos de planificación emitidos en materia hídrica; impulsando su implementación a través de las instituciones con las competencias en materia hídrica.
2. Tomar acuerdos y recomendar al Presidente de la República las directrices necesarias que aseguren el cumplimiento del Programa.
3. Aprobar el Programa con sus respectivos proyectos y presupuestos suministrados por las instituciones responsables de ejecución.
4. Coordinar el proceso de cumplimiento y evaluación permanente del Programa, que permita ajustar de ser necesario, los lineamientos y el plan de acción para asegurar la efectiva ejecución del Programa.
5. Conocer y aprobar los informes de avance del Programa que le sean elevados a su consideración por la Secretaría Técnica.
6. Promover y aprobar los convenios interinstitucionales que se requieran para la buena marcha del Programa.
7. Presentar periódicamente al Presidente de la República informes de avance de ejecución del Programa.
La Comisión de Alto Nivel, a través de su coordinador podrá cuando considere pertinente, convocar el apoyo técnico de las Universidades Públicas según sea la temática a tratar.
1. Un representante de la Dirección de Agua del MINAE; quien coordinará la Secretaría Técnica.
2. Un representante del Instituto Costarricense de Turismo; (ICT).
3. Un representante del Ministerio de Planificación Nacional y Política Económica (MIDEPLAN).
4. Un representante del Instituto Costarricense de Electricidad; (ICE).
5. Un representante del Instituto Costarricense de Acueductos y Alcantarillados;(AYA).
6. Un representante de Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento; (SENARA).
7. Un representante del Instituto Meteorológico Nacional; (IMN).
8. Un representante de la Secretaría Técnica Nacional Ambiental, (SETENA).
9. Un representante del Sistema Nacional de las Áreas de Conservación, (SINAC).
10. Un representante de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, (CNE).
11. Un representante del Instituto de Fomento y Asesoría Municipal (IFAM).
a. Elaborar y diseñar el contenido del Programa con sus respectivos proyectos, presupuestos e instituciones responsables para la implementación efectiva del mismo y someterlo a aprobación de la Comisión de Alto Nivel.
b. Elaborar la hoja de ruta para la ejecución del programa.
c. Dar seguimiento a la ejecución del Programa aprobado por la Comisión de Alto Nivel.
d. Coordinar con los usuarios de agua, municipalidades e instituciones del Estado, así como con las comunidades en general, las acciones relacionadas con el uso y aprovechamiento del agua, conforme el Programa.
e. Garantizar la adecuada coordinación intersectorial e interinstitucional, para la atención y seguimiento del Programa y hoja de ruta.
f. Coordinar las actividades técnicas, administrativas y financieras de la Comisión de Alto Nivel.
g. Evaluar e informar trimestralmente a la Comisión de Alto Nivel sobre el avance de las actividades, obras y proyectos, contemplados en el Programa.
h. Velar porque los proyectos cumplan con la normativa y directrices emitidas en la materia.
i. Realizar inspecciones periódicas debiendo levantar el acta respectiva, a fin de verificar el avance de las acciones, obras y proyectos.
Para el cumplimiento de lo anterior la Comisión de Alto Nivel podrá valorar los casos excepcionales en los que se pueda dejar de aplicar lo dispuesto en el artículo 3 de la Directriz Presidencial 9-H, del 14 de julio del 2014 y sus modificaciones, en razón de la conveniencia y necesidad, previa justificación que deberá venir sustentada por los respectivos Ministros o Jerarcas y sometida a consideración del Ministro de Hacienda y del Presidente de la República.
Dado en la Presidencia de la República, a los ocho días del mes de octubre del dos mil catorce.
