in the entirety of the text - Complete Text of Regulation 36008 Creates High-Level Commission for the coordination and support in the execution of the Water for Guanacaste Program Complete Text of record: FEF8E Nº 36008-MP-MAG-MINAET (This executive decree was repealed by article 10 of executive decree N° 38665 of October 8, 2014, "Creates High-Level Commission for the execution of the Comprehensive Water Supply Program for Guanacaste (North Pacific)") THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF THE PRESIDENCY, OF AGRICULTURE AND LIVESTOCK AND OF THE ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the powers conferred upon them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; article 28, paragraph 2, subsection b) of Law Nº 6227, which is the General Law of Public Administration of May 2, 1978; article 2, subsection c) of the Organic Law of the Environment Nº 7554, of October 4, 1995; Law 6877 of July 18, 1983, Law Creating the National Service of Groundwater, Irrigation and Drainage, Title III of Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production FODEA and the Organic Law of MAG;

1. 1That adequate and mandatory coordination among state entities and institutions that have competence in the management and conservation of water resources is of vital importance, with coordination among public institutions being a means to preserve and guarantee the fundamental rights of individuals, through well-oriented, efficient, and effective administrative action.
2. 2That the Ministry of the Presidency has as its mission to provide permanent support to presidential management for decision-making, through the definition, evaluation, and follow-up of national policies, serving as a liaison among the Branches of State, autonomous institutions, private entities, organizations, and power groups of civil society and the Presidency of the Republic.
3. 3That through Executive Decrees Nº 34678-MP-MINAE-MAG and Nº 34679-MP-MINAE, the Projects denominated "Dam- Regulating Reservoir of the west canal of the Arenal-Tempisque Irrigation District, identified as "Piedras Reservoir" and the "Supply of Potable Water for the Western Bank of the Tempisque River from the Arenal System" were declared of Public Interest and National Convenience.
4. 4That there exists the will of the Government of Costa Rica to use the Piedras River reservoir to promote the management of water resources for agricultural production, the generation of energy, and water for human consumption, in the Arenal-Tempisque Irrigation District, integrated with environmental protection issues.
5. 5That it is fundamental for the Costa Rican State to organize the use of water resources in the Chorotega Region to ensure the sustainability of its economic, social, and environmental development.
6. 6That to coordinate and implement the projects of the state institutions competent in the matter of water resources, the Government of the Republic has implemented the Project called "Water for Guanacaste Program", with which it seeks to improve the living conditions of the inhabitants of the Province of Guanacaste, since this is one of the areas with the lowest water wealth in the country and despite the fact that all of its territory is irrigated by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, such as El Bebedero, decreases notably during the dry season, which generally extends for five or six months a year.
7. 7That due to the natural water limitations of said Province, together with the need to meet the demand for said resource for domestic use of existing communities, the growing housing development, the tourism boom, and the needs that must be satisfied as a consequence thereof, the natural phenomena that cause climatic changes, which modify the pattern of rainfall and consequently alter the recharge of aquifer layers, the need to obtain the maximum possible use of the waters coming from the Arenal Reservoir and the Arenal-Tempisque Irrigation District administered by SENARA has been visualized, with the purpose of supplying the described need and fostering a boom in agricultural development, by allowing new irrigation areas to be covered, both in the western part of the project and on the right bank of the Tempisque River.
8. 8That this Water for Guanacaste Program will allow for a secure source of water for a future population of 350,000 inhabitants and will reduce the use of groundwater, leaving this resource for future generations, also boosting new investments in the agro-industrial, housing, commercial, and tourism infrastructure fields, under a concept of sustainable development.
9. 9That the proposal set forth in this Program is consistent with the National Development Plan (PND 2006-2010), in its Strategic Action for the Productive Sector, which proposes a "Plan to stimulate sustainable competitiveness and the generation of added value in the productive sector, as a key sector of the national economy," and whose objective is "To foster the conditions to improve the competitiveness of companies, with a productive chain vision, through the articulation of inter-institutional and intersectoral efforts," and with the strategic guidelines of the Water Sub-Sector contained in the National Environmental Strategy, as it considers, among others: "Water and the forces derived from it are strategic goods of the country, which contribute to national development and to improving the quality of life of its inhabitants.", "To promote the efficient use of water, the use of the best infrastructure and technologies available and appropriate to the country's reality is required." and "The selection of development projects with relevance to water resources is based on a comprehensive analysis of economic, social, and environmental costs and benefits." Therefore,

THEY DECREE:

A HIGH-LEVEL COMMISSION IS CREATED FOR THE COORDINATION AND SUPPORT IN THE EXECUTION OF THE WATER FOR GUANACASTE PROGRAM

Considering:

en la totalidad del texto - Texto Completo Norma 36008 Crea Comisión de alto nivel para la coordinación y apoyo en la ejecución del Programa Agua para Guanacaste Texto Completo acta: FEF8E Nº 36008-MP-MAG-MINAET (Este decreto ejecutivo fue derogado por el artículo 10 del decreto ejecutivo N° 38665 del 8 de octubre del 2014, "Crea Comisión de alto nivel para la ejecución del Programa Integral de Abastecimiento de Agua para Guanacaste (Pacífico Norte)") EL PRESIDENTE DE LA REPÚBLICA Y LOS MINISTROS DE LA PRESIDENCIA, DE AGRICULTURA Y GANADERIA Y DEL AMBIENTE, ENERGIA Y TELECOMUNICACIONES En el ejercicio de las facultades que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; el artículo 28, párrafo 2 inciso b) de la ley Nº 6227, que es Ley General de la Administración Pública del 2 de mayo de 1978; el artículo 2º inciso c) Ley Orgánica del Ambiente Nº 7554, del 4 de octubre de 1995; Ley 6877 de 18 de julio de 1983, Ley de Creación del Servicio Nacional de Aguas Subterráneas Riego y Avenamiento, el Título III de la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria FODEA y Ley Orgánica del MAG;

1. 1Que es de vital importancia la adecuada y obligada coordinación entre las entidades e instituciones del Estado que tienen competencia en el manejo y conservación de los recursos hídricos, siendo la coordinación entre instituciones públicas un medio para preservar y garantizar los derechos fundamentales de las personas, a través de una acción administrativa bien orientada, eficiente y eficaz.
2. 2Que el Ministerio de la Presidencia tiene como misión brindar apoyo permanente a la gestión presidencial para la toma de decisiones, mediante la definición, evaluación y seguimiento de las políticas nacionales, sirviendo de enlace entre los Poderes del Estado, instituciones autónomas, entes privados, organizaciones y grupos de poder de la sociedad civil y la Presidencia de la República.
3. 3Que mediante los Decretos Ejecutivos Nº 34678-MP-MINAE-MAG y Nº 34679-MP-MINAE, fueron declarados de Interés Público y Conveniencia Nacional los Proyectos denominados "Presa- Embalse regulatorio del canal del oeste del Distrito de Riego Arenal-Tempisque, identificado como "Embalse Piedras" y el de "Abastecimiento de Agua Potable para la Margen Occidental del Río Tempisque a partir del Sistema Arenal".
4. 4Que existe la voluntad del Gobierno de Costa Rica de utilizar el embalse del Río Piedras para promover la gestión del recurso hídrico para la producción agropecuaria, la generación de energía y de agua para consumo humano, en el Distrito de Riego Arenal-Tempisque, integrada a los temas de protección ambiental.
5. 5Que es fundamental para el Estado costarricense ordenar el aprovechamiento de los recursos hídricos en la Región Chorotega para asegurar la sostenibilidad de su desarrollo económico, social y ambiental.
6. 6Que para coordinar y concretar los proyectos de las instituciones estatales competentes en la materia del recurso hídrico, el Gobierno de la República ha implementado el Proyecto denominado "Programa Agua para Guanacaste", con el cual se procura mejorar las condiciones de vida de los habitantes de la Provincia de Guanacaste, ya que ésta es una de las zonas de menor riqueza hídrica del país y pese a que todo su territorio está regado por ríos, el caudal de su red hidrográfica, dominada por el río Tempisque y sus afluentes, como El Bebedero, disminuye notablemente durante la estación seca, que se prolonga, en general, por cinco o seis meses al año.
7. 7Que en razón de las limitaciones hídricas naturales que posee dicha Provincia, aunado a la necesidad de satisfacer la demanda de dicho recurso para uso doméstico de las comunidades existentes, el creciente desarrollo habitacional, el auge turístico y las necesidades que deben ser satisfechas como consecuencia del mismo, los fenómenos naturales que propician cambios climáticos, que modifican el patrón de las lluvias y alteran por consiguiente la recarga de los mantos acuíferos, se ha visualizado la necesidad de obtener el máximo aprovechamiento posible de las aguas que provienen del Embalse Arenal y del Distrito de Riego Arenal-Tempisque que administra SENARA, con el objeto de suplir la necesidad descrita y propiciar un auge en el desarrollo agropecuario, al permitir cubrir nuevas áreas de riego, tanto en la parte occidental del proyecto como en la margen derecha del Río Tempisque.
8. 8Que este Programa Agua para Guanacaste permitirá contar con una fuente segura de agua para una población futura de 350.000 habitantes y disminuirá el uso de aguas subterráneas dejando este recurso para las próximas generaciones, potenciando además nuevas inversiones en los campos agroindustrial, habitacional, comercial y en la infraestructura turística, bajo un concepto de desarrollo sostenible.
9. 9Que la propuesta planteada en este Programa es coherente con el Plan Nacional de Desarrollo (PND 2006-2010), en su Acción Estratégica para el Sector Productivo, que plantea un "Plan de estímulo a la competitividad sostenible y la generación de valor agregado en el sector productivo, como sector clave de la economía nacional", y cuyo objetivo es "Propiciar las condiciones que permitan mejorar la competitividad de las empresas, con visión de cadena productiva, mediante la articulación de esfuerzos interinstitucionales e intersectoriales", y con los lineamientos estratégicos del Sub Sector Hídrico contenidos en la Estrategia Nacional Ambiental, por cuanto considera, entre otros: "El agua y las fuerzas que se derivan de ésta son bienes estratégicos del país, que contribuyen al desarrollo nacional y a mejorar la calidad de vida de sus habitantes.", "Para promover el uso eficiente del agua, se requiere la utilización de las mejores infraestructuras y tecnologías disponibles adecuadas a la realidad del país." y "La selección de proyectos de desarrollo con relevancia del recurso hídrico, se basa en un análisis integral de los costos y beneficios económicos, sociales y ambientales." Por tanto,
