in the entirety of the text - Full Text of Regulation 34679 Declaration of Public Interest and National Convenience of the Potable Water Supply Project for the Western Bank of the Tempisque River from the Arenal System Full Text of record: BDDB7 Nº 34679-MP-MINAE Nº 34679-MP-MINAE THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF THE PRESIDENCY AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers conferred upon them by Articles 50, 140 subsections 3), 8), 18, and 20), and 146 of the Political Constitution, Article 28 paragraph 2 subsection b) of Law Nº 6227, General Law of Public Administration of May 2, 1978, Article 2 subsection c) of Law Nº 7554, Organic Law of the Environment of October 4, 1995, Articles 2 subsections a) and b) and 3 subsections a), c), ch), and d) of Law Nº 6877, Law Creating the National Groundwater, Irrigation, and Drainage Service (SENARA), of July 18, 1983, and Articles 1 and 2 of Law Nº 2726, Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers, of April 14, 1961.
Considering
Its average annual precipitation is close to 1,729 mm, in contrast to the rest of the country, where the average precipitation is 3,272 mm. On the other hand, despite all its territory being watered by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, such as the Bebedero, decreases notably during the dry season, which generally lasts for five or six months.
The transfer of the abundant surface waters from the Arenal River Basin and the Cote River Sub-basin, both from the Caribbean watershed, whose average annual precipitation is 3,820 and 4,711 mm respectively, to the Tempisque River Basin on the Pacific Watershed, which has less favorable water characteristics (1,545 mm of average annual precipitation), results in a comprehensive use of this resource in the Arenal - Dengo - Sandillal Complex (ARDESA) and in the Arenal - Tempisque Irrigation District (DRAT).
Furthermore, it is compatible with the DRAT system (Arenal Tempisque Irrigation District), because it allows the flow diverted for the indicated requirements to be replaced. Likewise, it would make it possible to address any contingency between the Miguel Pablo Dengo Diversion Dam and the Piedras River Crossing. Similarly, it articulates perfectly with the SENARA proposal to build the DRAT Dam-Reservoir (Arenal Tempisque Irrigation District), which allows users downstream of the Piedras River Crossing to increase the reliability of the water supply in the event of failures in the hydraulic system.
Since this period is one of low precipitation on the right bank of the Tempisque River, this project could consider artificial recharge in the aquifers during such periods.
Therefore, They Decree Declaration of public interest and national convenience (conveniencia nacional) of the potable water supply project for the western bank of the Tempisque River from the Arenal System
The same shall apply to the procedures and requests that SENARA must manage for the implementation of the Project and all works associated with it, before the different Public Entities and Bodies.

Considerando
Su precipitación promedio anual es cercana a 1.729 mm, en contraste con el resto del país, donde la precipitación promedio es de 3.272 mm. Por otra parte, pese a que todo su territorio está regado por ríos, el caudal de su red hidrográfica, dominada por el Río Tempisque y sus afluentes, como el Bebedero, disminuye notablemente durante la estación seca, que se prolonga, en general por cinco o seis meses.
El trasvase de las abundantes aguas superficiales de la cuenca del Río Arenal y la subcuenca del Río Cote, ambas de la vertiente del Caribe, cuya precipitación promedio anual es de 3.820 y 4.711 mm respectivamente a la cuenca del Río Tempisque en la Vertiente Pacífico, de características hídricas menos favorables (1.545 mm de precipitación promedio anual), da como resultado un aprovechamiento comprensivo de ese recurso en el Complejo Arenal - Dengo - Sandillal (ARDESA) y en el Distrito de Riego Arenal - Tempisque (DRAT).
Además, es compatible con el sistema DRAT (Distrito de Riego Arenal Tempisque), porque permite sustituir el caudal derivado para los requerimientos, señalados. Asimismo, permitiría atender alguna contingencia entre Presa Derivadora-Miguel Pablo Dengo y el Cruce del Río Piedras. De igual forma, articula perfectamente con la propuesta de SENARA de construir la Presa-Embalse DRAT (Distrito de Riego Arenal Tempisque), lo cual le permite a los usuarios aguas abajo del Cruce del Río Piedras, incrementar la confiabilidad del suministro de agua ante la eventualidad de fallas en el sistema hidráulico.
Siendo que esta época es de baja precipitación sobre la margen derecha del Río Tempisque, podría este proyecto considerar la recarga artificial en los acuíferos durante dichos períodos.
Asimismo, la propuesta guarda relación con los lineamientos estratégicos del Subsector Hídrico contenidos en la Estrategia Nacional Ambiental, por cuanto considera, entre otros: "El agua y las fuerzas que se derivan de ésta son bienes estratégicos del país, que contribuyen al desarrollo nacional y a mejorar la calidad de vida de sus habitantes", "Para promover el uso eficiente del agua, se requiere la utilización de las mejores infraestructuras y tecnologías disponibles adecuadas a la realidad del país" y "La selección de proyectos de desarrollo con relevancia del recurso hídrico, se basa en un análisis integral de los costos y beneficios económicos, sociales y ambientales."
Por tanto,

Decretan
Igual sucederá con los trámites y solicitudes que deba gestionar SENARA para la implementación del Proyecto y todas las obras asociadas al mismo, ante los diferentes Entes y Órganos Públicos.
