in the entirety of the text - Complete Text of Regulation 34678 Declaration of public interest and national convenience for the project regulatory dam-reservoir of the west canal of the arenal-tempisque irrigation district, also called piedras reservoir Complete Text record: BDDA9 Nº 34678-MP-MINAE-MAG Nº 34678-MP-MINAE-MAG THE PRESIDENT OF THE REPUBLIC THE MINISTER OF THE PRESIDENCY, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In the exercise of the powers conferred by articles 140 subsections 3) and 18) and 146 of the Political Constitution; article 28 paragraph 2 subsection b) of Law Nº 6227, which is the General Law of Public Administration of May 2, 1978; article 2 subsection c) Organic Law of the Environment Nº 7554, of October 4, 1995; Law 6877 of July 18, 1983, Law Creating the National Groundwater, Irrigation and Drainage Service, article 2 subsections a) and b); article 3 subsections a), c), ch) and d); article 3 subsection m) and article 19 subsection b) of the Forestry Law (Ley Forestal), Nº 7575 of February 13, 1996 and Decree Nº 15321-MAG of March 16, 1984 "Creates irrigation, drainage and flood control districts."

1. 1That among the goals of the 2006-2010 National Development Plan, Jorge Manuel Dengo Obregón, a strategic action for the Productive Sector is the "Plan to stimulate sustainable competitiveness and the generation of added value in the productive sector, as a key sector of the national economy," whose objective is "To foster the conditions that allow improving the competitiveness of companies, with a production chain vision, through the articulation of inter-institutional and inter-sectoral efforts."
2. 2That Guanacaste is one of the areas of the country with the least water wealth. Its average annual rainfall is close to 1,729 mm, in contrast to the rest of the country, where the average rainfall is 3,272 mm. On the other hand, although its entire territory is irrigated by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, such as El Bebedero, decreases notably during the dry season, which generally lasts for five or six months. The three most important water sources in the region are, in order: the Tempisque River Basin; groundwater and, since 1979, Arenal Reservoir.
3. 3That by reason of the natural water limitations that said province possesses, coupled with the need to satisfy the demand for said resource for domestic use of the existing communities, the growing housing development, the tourism boom and the needs that must be satisfied as a consequence thereof, the natural phenomena that promote climate changes, modifying the pattern of rains and consequently altering the recharge of aquifers, the need has been visualized to obtain the maximum possible utilization of the waters coming from Arenal Reservoir and the Arenal-Tempisque Irrigation District administered by SENARA, with the object of supplying the described need and promoting a boom in agricultural development, by allowing coverage of new irrigation areas, both in the western part of the project and on the right bank of the Tempisque River.
4. 4That Arenal Reservoir is the country's main water reserve, which by such nature operates according to the country's electrical consumption demand, which means that electrical generation is not constant, generating generation peaks and therefore water availability that is not utilized downstream, due to the lack of a reservoir or storage body with sufficient capacity to make maximum use of that resource.
5. 5That the construction of the work called Regulatory Reservoir of the West Canal of the Arenal Tempisque Irrigation District, also called Río Piedras Reservoir, which is located in Bagaces, Guanacaste, precisely at the crossing of the West Canal with the Río Piedras, is highly of national convenience and public interest.
6. 6That said project consists of the construction of a dam approximately 717 m in length and 40 m in height, and which will allow a flood area close to 800 hectares, with an estimated water storage capacity of 85 million cubic meters. The project also includes the works for the expansion and adaptation of SENARA's West Canal section III, which are necessary to transport water to the crossing of the Cabuyo River.
7. 7That in addition to the construction, the reservoir will allow expanding the available water supply in Guanacaste, with the object of expanding the irrigation areas in the subdistricts of Cabuyo, Tempisque and Zapandí and implementing a water distribution network through pipelines that would allow the supply of water for human consumption to the systems administered by the Costa Rican Institute of Aqueducts and Sewers and the Administrative Associations of Rural Aqueducts of the cantons of Santa Cruz, Nicoya, Hojancha and Nandayure; as well as supply to coastal tourism developments from Papagayo to Pinilla in Santa Cruz.
8. 8That in the pre-execution and design phase of the works as well as in the construction phase, it is required to extract and relocate fauna and minor plant species such as orchids, herbaceous plants, bromeliads, tree ferns, wild bamboos, for scientific research purposes, as well as the eventual focused felling of tree species.
9. 9That articles 19 subsection b) and 34 of the Forestry Law (Ley Forestal), prohibit land-use change (cambio de uso de los suelos) except in those state or private projects that the Executive Branch declares of national convenience, being those projects whose social benefits are greater than the socio-environmental costs.
10. 10That by reason of the foregoing, it is required to declare the public convenience and national importance of the cited project, taking into account that the country requires increasing all necessary efforts for the optimal and sustainable utilization of water resources, so that it can adequately satisfy the basic needs of citizens, which show a growing trend, product of population increase, tourism impact, climate change, agro-productive competitiveness and food demand, among other reasons. Therefore:

1. 1Que entre las metas del Plan Nacional de Desarrollo 2006-2010, Jorge Manuel Dengo Obregón, se plantea como una acción estratégica para el Sector Productivo el "Plan de estímulo a la competitividad sostenible y la generación de valor agregado en el sector productivo, como sector clave de la economía nacional", cuyo objetivo es "Propiciar las condiciones que permitan mejorar la competitividad de las empresas, con visión de cadena productiva, mediante la articulación de esfuerzos interinstitucionales e intersectoriales".
2. 2Que Guanacaste es una de las zonas de menor riqueza hídrica del país. Su precipitación promedio anual es cercana a 1.729 mm, en contraste con el resto del país, donde la precipitación promedio es de 3.272 mm. Por otra parte, pese a que todo su territorio está regado por ríos, el caudal de su red hidrográfica, dominada por el río Tempisque y sus afluentes, como El Bebedero, disminuye notablemente durante la estación seca, que se prolonga, en general, por cinco o seis meses. Las tres fuentes de agua más importantes en la región son en su orden: la Cuenca del Río Tempisque; las aguas subterráneas y desde 1979 el Embalse Arenal.
3. 3Que en razón de las limitaciones hídricas naturales que posee dicha provincia, aunado a la necesidad de satisfacer la demanda de dicho recurso para uso doméstico de las comunidades existentes, el creciente desarrollo habitacional, el auge turístico y las necesidades que deben ser satisfechas como consecuencia del mismo, los fenómenos naturales que propician cambios climáticos, que modifican el patrón de las lluvias y alteran por consiguiente la recarga de los mantos acuíferos, se ha visualizado la necesidad de obtener el máximo aprovechamiento posible de las aguas que provienen del Embalse Arenal y del Distrito de Riego Arenal-Tempisque que administra SENARA, con el objeto de suplir la necesidad descrita y propiciar un auge en el desarrollo agropecuario, al permitir cubrir nuevas áreas de riego, tanto en la parte occidental del proyecto como en la margen derecha del Río Tempisque.
4. 4Que el Embalse Arenal es la principal reserva hídrica del país, que por tal naturaleza opera según la demanda de consumo eléctrico del país, lo que hace que la generación eléctrica no sea constante, generando picos de generación y por tanto de disposición hídrica que no es aprovechada aguas abajo, por la falta de embalse o reservorio con capacidad suficiente para hacer un máximo aprovechamiento de ese recurso.
5. 5Que resulta altamente de conveniencia nacional e interés público la construcción de la obra denominada Embalse Regulatorio del Canal del Oeste del Distrito de Riego Arenal Tempisque, denominado también Embalse Río Piedras, el cual se ubica en Bagaces, Guanacaste, propiamente en el cruce del Canal del Oeste con el Río Piedras.
6. 6Que dicho proyecto consiste en la construcción de una represa de aproximadamente 717 m de longitud y 40 m de altura, y que va a permitir un área de inundación cercana a las 800 hectáreas, con una capacidad de almacenamiento hídrico estimada de 85 millones de metros cúbicos. El proyecto incluye además las obras de ampliación y adecuación del Canal oeste tramo III de SENARA, que resultan necesarias para, transportar el agua hasta el cruce del Río Cabuyo.
7. 7Que adicionalmente a la construcción, el embalse permitirá ampliar la oferta hídrica disponible en Guanacaste, con el objeto de ampliar las áreas de irrigación en los subdistritos de Cabuyo, Tempisque y Zapandí e implementar una red de distribución de agua a través de tuberías que permitiría el suministro de agua para consumo humano a los sistemas administrados por el Instituto Costarricense de Acueductos y Alcantarillados y las Asociaciones Administradoras de Acueductos Rurales de los cantones de Santa Cruz, Nicoya, Hojancha y Nandayure; así como abastecimiento a los desarrollos turísticos costeros desde Papagayo hasta Pinilla en Santa Cruz.
8. 8Que en la fase de pre-ejecución y diseño de las obras así como en la fase constructiva, se requiere extraer y reubicar fauna y especies vegetales menores tales como orquídeas, herbáceas, bromelias, helechos arborescentes, bambúes silvestres, para fines de investigación científica, así como la eventual corta focalizada de especies arbóreas.
9. 9Que los artículos 19 inciso b) y 34 de la Ley Forestal, prohíben el cambio de uso de los suelos excepto en aquellos proyectos estatales o privados que el Poder Ejecutivo declare de conveniencia nacional, sean aquellos proyectos cuyos beneficios sociales sean mayores a los costos socio ambientales.
10. 10Que en razón de lo anterior, se requiere declarar la conveniencia pública e importancia nacional del citado proyecto, habida cuenta que el país requiere incrementar todos los esfuerzos necesarios para el aprovechamiento óptimo y sostenible de los recursos hídricos, de tal forma que pueda satisfacer adecuadamente las necesidades básicas de los ciudadanos, las cuales muestran una tendencia creciente, producto del aumento de población, impacto turístico, cambio climático, competitividad agroproductiva y demanda alimentaría, entre otras razones. Por tanto:
