For these purposes, the offender must be notified immediately and granted a period of fifteen business days to proceed with the payment of the fine. The fines do not exclude the corresponding civil and criminal liabilities. SINAC shall have a digitalized system that allows registering and consulting the individuals cautioned in order to apply their due sanction.
- a)If the offender enters sites where the protected wilderness area (área silvestre protegida) does not permit it, according to the technical planning instrument, or at authorized sites without complying with current regulations, they shall be fined three base salaries; furthermore, if the act constitutes a crime, the corresponding law shall be applied.
- b)If the offender carries out or promotes, on digital media, unauthorized activities in the protected wilderness area (área silvestre protegida), according to the technical planning instrument, they shall be fined three base salaries; furthermore, if the act constitutes a crime, the corresponding law shall be applied.
- c)The tour operator that promotes and/or sells tours, through any medium, to sites where the protected wilderness area (área silvestre protegida) does not permit it according to the technical planning instrument, or at authorized sites without complying with current regulations, shall be fined seven base salaries; furthermore, if the act constitutes a crime or contravention, the corresponding law shall be applied.
- d)If the offender is a tour operator and/or their guides enter with tourists sites that are classified as high risk in the protected wilderness areas (áreas silvestres protegidas), they shall be fined ten base salaries and the confiscation of the equipment they carry. For those who have a tourism declaration, the Costa Rican Tourism Institute shall be notified so that it may proceed according to its regulations. e) If any of the offenders indicated in the previous points is a repeat offender regarding unauthorized entry into the country's protected wilderness areas (áreas silvestres protegidas), the fine shall be increased by fifty percent (50%) over that defined in the previous points.
- f)If the fines from the previous subsections (a, b, c, d, and e) have been applied to the offender and they are once again a repeat offender, they shall be prohibited from entering the protected wilderness areas (áreas silvestres protegidas) for a period of one year.
- g)In the event that addressing any of the previous infractions requires carrying out a specialized rescue, an additional fine equivalent to five base salaries shall be applied for each rescued person who has committed the infraction, and ten base salaries to the responsible guide or tour operator. The funds collected from these fines shall be distributed as sixty percent (60%) to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and forty percent (40%) to the Costa Rican Red Cross Association.
All fines stipulated in this article must be paid into the bank account that the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) arranges for this purpose, authorized by the Ministry of Finance. The fines originating from the infractions stipulated in subsections a), b), c), d), and e) must be reimbursed in full to SINAC. The fines originating from the infractions stipulated in subsection g) must be transferred by the Ministry of Finance, in the percentages indicated in said subsection, to the respective beneficiaries.
All funds that enter SINAC as fines shall be allocated to the National Parks Fund, which shall be used to strengthen the prevention, protection, and control and sustainable tourism programs of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación).
