Amendment to the National Parks Service LawReforma Ley del Servicio de Parques Nacionales

• 16)Entering sites where the protected wilderness area (área silvestre protegida) does not permit it according to the technical planning instrument it has, or entering authorized sites without complying with current regulations. This prohibition applies to national parks and sites officially declared under any management category.
• 17)Carrying out unauthorized activities in the protected wilderness area, according to the technical planning instrument, whether it is a national park or any other officially declared management category.

The texts are as follows:

For these purposes, the offender shall be notified immediately and granted a period of fifteen business days to proceed with the payment of the fine. The fines do not exclude the corresponding civil and criminal liabilities. SINAC shall have a digitalized system to record and consult warned individuals in order to apply their due sanction.

• a)If the offender enters sites where the protected wilderness area does not permit it, according to the technical planning instrument, or enters authorized sites without complying with current regulations, they shall be fined three base salaries; in addition, if the act constitutes a crime, the corresponding law shall be applied.
• b)If the offender carries out or promotes, on digital media, unauthorized activities in the protected wilderness area, according to the technical planning instrument, they shall be fined three base salaries; in addition, if the act constitutes a crime, the corresponding law shall be applied.
• c)The tour operator who promotes and/or sells tours, through any means, to sites where the protected wilderness area does not permit it according to the technical planning instrument or to authorized sites without complying with current regulations, shall be fined seven base salaries; in addition, if the act constitutes a crime or infraction, the corresponding law shall be applied.
• d)If the offender is a tour operator and/or their guides enter with tourists into sites that are classified as high risk in the protected wilderness areas, they shall be fined ten base salaries and subject to seizure of the equipment they carry. For those who have a tourism declaration, the Instituto Costarricense de Turismo shall be notified, so that it may proceed according to its regulations.
• e)If any of the offenders indicated in the preceding points is a repeat offender regarding unauthorized entry into the country's protected wilderness areas, the fine shall be increased by fifty percent (50%) over the amount defined in the preceding points.
• f)If the offender has been fined under the preceding subsections (a, b, c, d, and e) and is again a repeat offender, they shall be prohibited from entering the protected wilderness areas for a period of one year.
• g)In the event that addressing any of the preceding infractions requires carrying out a specialized rescue, an additional fine shall be applied equivalent to five base salaries for each rescued person who committed the infraction and ten base salaries for the responsible guide or tour operator. The funds collected from these fines shall be distributed sixty percent (60%) to the Sistema Nacional de Áreas de Conservación (SINAC) and forty percent (40%) to the Asociación Cruz Roja Costarricense.

All fines stipulated in this article must be paid into the bank account designated for this purpose by the Sistema Nacional de Áreas de Conservación (SINAC), authorized by the Ministerio de Hacienda. The fines arising from the infractions stipulated in subsections a), b), c), d), and e) must be reimbursed in their entirety to SINAC. The fines arising from the infractions stipulated in subsection g) must be transferred by the Ministerio de Hacienda, in the percentages indicated in said subsection, to the respective beneficiaries.

All funds received by SINAC from fines shall be allocated to the Fondo de Parques Nacionales, which shall be used to strengthen the prevention, protection and control, and sustainable tourism programs of the Sistema Nacional de Áreas de Conservación.

The denomination of base salary corresponds to the provisions of Article 2 of Law 7337, of May 5, 1993, which creates the concept of base salary for special crimes of the Penal Code.

• 16)El ingreso a sitios, en que el área silvestre protegida no lo permita de acuerdo con el instrumento técnico de planificación con el que cuente o en sitios autorizados sin cumplir con la normativa vigente. Esta prohibición aplica para los parques nacionales y sitios declarados oficialmente bajo cualquier categoría de manejo.
• 17)Realizar actividades no autorizadas en el área silvestre protegida, de acuerdo con el instrumento técnico de planificación, ya sea parque nacional o cualquier otra categoría de manejo oficialmente declarada.

Para dichos efectos, deberá notificarse en el acto al infractor y se le otorgará un plazo de quince días hábiles para proceder al pago de la multa. Las multas no son excluyentes de las responsabilidades civiles y penales que correspondan. El Sinac contará con un sistema digitalizado que permita registrar y consultar a las personas prevenidas para aplicar su debida sanción.

• a)Si el infractor ingresa en sitios en que el área silvestre protegida no lo permita, de acuerdo con el instrumento técnico de planificación, o en sitios autorizados sin cumplir con la normativa vigente, se le multará con tres salarios base, además, si el hecho constituye un delito se le aplicará la ley correspondiente.
• b)Si el infractor realiza o promueve en medios digitales actividades no autorizadas en el área silvestre protegida, de acuerdo con el instrumento técnico de planificación, se le multará con tres salarios base; además, si el hecho constituye un delito se le aplicará la ley correspondiente.
• c)El operador turístico que promueva y/o venda tours, a través de cualquier medio, a sitios en que el área silvestre protegida no lo permita de acuerdo con el instrumento técnico de planificación o en sitios autorizados sin cumplir con la normativa vigente, se le multará con siete salarios base; además, si el hecho constituye un delito o contravención se le aplicará la ley correspondiente.
• d)Si el infractor es un operador turístico y/o sus guías ingresan con turistas a sitios que estén clasificados de alto riesgo en las áreas silvestres protegidas, se le multará con diez salarios base y el comiso del equipo que porta. Para aquellos que cuenten con declaratoria turística, se le notificará al Instituto Costarricense de Turismo, para que proceda de acuerdo con su normativa. e) Si cualquiera de los infractores indicados en los puntos anteriores es reincidente en el ingreso no autorizado a las áreas silvestres protegidas del país, la multa se incrementará en un cincuenta por ciento (50%), a la definida en los puntos anteriores.
• f)Si al infractor se le ha aplicado las multas de los incisos anteriores (a, b, c, d y e) y es nuevamente reincidente, se le prohibirá el ingreso a las áreas silvestres protegidas por un plazo de un año.
• g)En caso de que la atención de alguna de las infracciones anteriores requiera realizar un rescate especializado, se aplicará una multa adicional equivalente a cinco salarios base por cada persona rescatada que haya cometido la infracción y diez salarios base al guía u operador turístico responsable. Los fondos recaudados por estas multas se distribuirán en un sesenta por ciento (60%) para el Sistema Nacional de Áreas de Conservación (Sinac) y un cuarenta por ciento (40%) para la Asociación Cruz Roja Costarricense.

Todas las multas estipuladas en este artículo deberán cancelarse en la cuenta bancaria que para ello disponga el Sistema Nacional de Áreas de Conservación (Sinac), autorizada por el Ministerio de Hacienda. Las multas provenientes por concepto de las infracciones estipuladas en los incisos a), b), c), d) y e) deberán ser reintegradas en su totalidad al Sinac. Las multas provenientes por concepto de las infracciones estipuladas en el inciso g) deberán ser transferidas por el Ministerio de Hacienda, en los porcentajes indicados en dicho inciso a los respectivos beneficiarios.

Todos los fondos que por concepto de multas ingresen al Sinac serán destinados al Fondo de Parques Nacionales, los cuales serán utilizados para fortalecer los programas de prevención, protección y control y turismo sostenible del Sistema Nacional de Áreas de Conservación.

La denominación de salario base corresponde a lo dispuesto en el artículo 2 de la Ley 7337, del 5 de mayo de 1993, que crea el concepto salario base para delitos especiales del Código Penal.
