6.1 The accumulation (acumulación) of hazardous waste (desechos peligrosos) is the process of filling the containers in which the waste is collected while it is generated. This action must be carried out as close as possible to the generation site. Likewise, this action is prior to storage (almacenamiento).
6.2 The accumulation (acumulación) of different hazardous waste (desechos peligrosos) together is not permitted, that is, each hazardous waste (desecho peligroso) must be accumulated for storage individually. This does not imply that the same type of waste cannot be mixed in a single container for its accumulation.
6.3 Accumulation (acumulación) points must be maintained and operated in such a way that the possibilities of fire, explosion or release of hazardous waste (desechos peligrosos) that could alter human health or the environment are minimized. For this, the following safety conditions must be followed:
6.3.1 Containers: Must be hermetically sealed, but with the possibility of opening and closing them.
Must be made of material that does not present incompatibility problems with the waste to be stored in it.
Must be in good condition and free of leaks.
The accumulated volumes must be such that they ensure adequate environmental storage.
6.3.2 In Annex 1 "Hazardous waste identification sheet" and on each container, the generator must clearly indicate the type of hazardous waste (residuo peligroso) it contains, its hazardous characteristics, the date on which accumulation (acumulación) in it began, and its coding number. Additionally, the applicable United Nations, Globally Harmonized System, European Union or NFPA symbol must be indicated and labeled on each container.
6.3.3 Location of accumulation (acumulación) points: The accumulation (acumulación) points must be areas near the generation point where the appropriate containers must be filled with the generated hazardous waste (desechos peligrosos). These areas must be supervised by the necessary operators of the waste-generating process, who will also carry out the container filling process and the inspection to detect leaks or spills, or anomalous situations that could endanger the workplace and the environment.
6.3.4 Safety equipment. The accumulation (acumulación) points must have the following safety equipment in the necessary quantities:
An internal communication or alarm system capable of providing immediate action by trained personnel in an emergency.
A device (telephone, or similar) that is easily accessible at the operations scene to call the police department, fire department, or the person responsible for a local or national emergency.
Water in an adequate volume and necessary pressure to supply it through hoses, foam-forming equipment, water spray systems or similar systems.
Portable fire extinguishers.
Leak control equipment.
Decontamination equipment.
Liquid absorbent material.
6.3.5 Identification of each accumulation (acumulación) site: In addition to the aforementioned equipment, each station or accumulation (acumulación) site must be identified as such with appropriate labeling and keep within reach a protocol indicating routine and emergency actions.
6.3.6 Employee safety and protection equipment: It is the obligation of each generator to maintain adequate safety equipment for its workers in this and all stages of hazardous waste (desechos peligrosos) management. Such equipment must be acquired based on an assessment of the hazardousness of the waste or wastes generated. Likewise, it must ensure that personnel in contact with the waste systematically use the protection prescribed in each case. All this must be included in the "Generator Information" Form shown in Annex 1.
6.4 The containers used for the accumulation (acumulación) of hazardous waste (desechos peligrosos) must always be kept closed during the accumulation (acumulación) stage, except when it is necessary to open them to add or remove waste.
6.5 The Hazardous Waste Accumulation or Storage Form (Annex 3 of this Decree) must be filled out and completed as the accumulation (acumulación) stage is carried out, so that it can be requested by the corresponding authorities at any time to know the amount of accumulated waste volume and the state of its storage." "Article 10.-On transport.
10.1 For the transport of hazardous waste (desechos peligrosos) within the country, whether for its storage (almacenamiento), treatment or final disposal (disposición final), the regulations to be followed shall be the same as those imposed for hazardous substances in Executive Decree No. 24715-MOPT-MEIC-S of October 6, 1995 "Regulation for the Land Transport of Hazardous Products." 10.2 The classification of hazardous waste (desechos peligrosos) for transport purposes is that indicated in Decree No. 27000-MINAE of April 29, 1998 "Regulation on the Characteristics and Classification of Hazardous Waste (Desechos Peligrosos)".
10.3 As indicated in Decree No. 24715-MOPT-MEIC-S of October 6, 1995, "Regulation for the Land Transport of Hazardous Products", any motor vehicle engaged in the transport of hazardous waste (desechos peligrosos) must carry, in addition to the documents required by the Law of Public Roads Traffic, those others established in:
a. Document called "Hazardous Waste Transport Manifest" (Annex 5 of this regulation); which must be previously notified, in coordination with the generator and manager, to the Environmental Comptroller's Office (Contraloría del Ambiente).
b. Emergency Documents or Sheet for the Transport of Hazardous Products, which must be signed by a regent professional (chemist or chemical engineer), incorporated into the respective professional association (Annex 5 of this regulation).
c. A certificate from the generator of the hazardous waste (desecho peligroso), which must include the information contained in Annex 1 of this regulation.
10.4 Transporters must clean any hazardous waste (desecho peligroso) that remains after unloading that occurs during the transport stage. All this hazardous waste (desechos peligrosos) and transport cleaning products must be treated as such, for which reason, if unloading is carried out at a treatment facility, there must be an area for cleaning it and the streams from that cleaning must be directed to the treatment plant streams.
10.5 In the loading, unloading and cleaning stage, the necessary personnel safety measures must always be followed to ensure the health of the operators involved in each of those stages. The necessary safety equipment will depend on the hazardous characteristic of each waste managed."
