the entire text - Full Text of Regulation 22962 Declares a National Wildlife Refuge the border corridor comprised of the lands along the border with Nicaragua from Punta Castilla on the Caribbean Sea to Bahía Salinas on the Pacific Ocean Full Text of Record: 14CA2C N° 22962-MIRENEM N° 22962-MIRENEM THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF NATURAL RESOURCES, ENERGY AND MINES, In exercise of the powers conferred upon them by Article 140, subsections 3) and 18) of the Political Constitution and Articles 82 and 84 of the Wildlife Conservation Law N° 7317 of October 30, 1992.

1That it is the State's obligation to ensure the protection of the country's natural resources.
2That by Law N° 13, the General Law on Vacant Lands (Ley General sobre Terrenos Baldíos), issued on January 6, 1939, Article 10, and Law N° 2825 and its amendments, Article 7, subsection f), an inalienable public zone of 2,000 meters in width was created along the border with Nicaragua; this area, by virtue of the provisions in pronouncements issued by the Procuraduría General de la República N° C107-85 and N° C272-85 of May 20, 1985 and October 29, 1985, respectively, is granted in administration, insofar as the lands are suitable for agriculture, to the Instituto de Desarrollo Rural(*) and, insofar as they are suitable for forestry, to the Ministry of Natural Resources, Energy and Mines.

3That the area in question constitutes a highly important biological corridor (corredor biológico) between the Tortuguero Conservation Area (Area de Conservación Tortuguero), the Tamborcito and Maquenque Wetlands (Humedales de Tamborcito y Maquenque), the Caño Negro National Wildlife Refuge (Refugio Nacional de Vida Silvestre Caño Negro), and the El Jardín Forest Reserve (Reserva Forestal El Jardín).
4That in accordance with the agreement on Border Areas (Áreas Fronterizas) signed by the Governments of the Republics of Costa Rica and Nicaragua in Puntarenas on the fifteenth day of December 1990, the International System of Protected Areas for Peace (SI-A-PAZ) is declared the highest priority conservation project in both countries.
5That the SI-A-PAZ aims to protect the largest and most representative sample of tropical moist forest (bosque húmedo tropical) found on the Caribbean Slope (Vertiente Caribe) of Central America.
6That the advance of commercial monocultures and illegal logging have reduced the forested area (área boscosa) of the northern slope to critical levels, with the consequent detriment of the habitat for wildlife (vida silvestre), the loss of biodiversity (biodiversidad), the sedimentation of watercourses (cauces pluviales), and the progression of the erosion process. Therefore,

Considering:

DECREES:

(Note from Sinalevi: By Article 1 of Law N° 10127 of February 9, 2022, a total area of ninety-four thousand thirty-two square meters (94,032 m2) was segregated from the Corredor Fronterizo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Corredor Fronterizo), created by Executive Decree 22962-MIRENEM of February 15, 1994, amended by Executive Decree 23248-MIRENEM of April 20 of the same year, and located on the dividing line between the Republics of Costa Rica and Nicaragua, according to the topographic survey mentioned below.

The total area to be segregated is divided into two sub-areas located between points one and ten and one and twenty-eight, respectively, of the tables detailed below:

Lot 1, property located in district one, Los Chiles, canton fourteen, Los Chiles, Alajuela province; borders to the north with the Republic of Nicaragua; to the south with Corredor Fronterizo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Corredor Fronterizo); to the east with public road national route number thirty-five and, to the west, with Corredor Fronterizo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Corredor Fronterizo), property located at the following CRTM-05 coordinates, as follows:

AREA OF LOT 1: 1 hectare 551 square meters (ten thousand five hundred fifty-one square meters), according to cadastral plan 2-1792702-2015, registered with the Catastro Nacional (National Cadastre) on January 6, 2015.

AREA OF LOT 2: 8 hectares 3,481 square meters (eighty-three thousand four hundred eighty-one square meters), according to cadastral plan 2-1792432-2014, registered with the Catastro Nacional (National Cadastre) on December 19, 2014.

The coordinates indicated in the plans and in the foregoing tables were defined in accordance with the Technical Report of the Instituto Geográfico Nacional, IGN-RN- 0432-2014, of November 17, 2014.

These values are tied to the CRTM05 coordinate system, referenced to the WGS-84 reference ellipsoid, of the Instituto Geográfico Nacional of Costa Rica." In accordance with Article 2 of the aforementioned law, the segregated area shall be destined for the operation and functioning of a land border post (puesto fronterizo terrestre), in facilities duly equipped to provide services related to the entry, exit, and transit of persons, vehicles, and goods.

The administration and ownership of the segregated land shall correspond to the Ministry of Foreign Trade (Ministerio de Comercio Exterior), an entity that, within the framework of the Border Integration Program (Programa de Integración Fronteriza), shall build the new facilities and, via an interinstitutional agreement (convenio interinstitucional), assign their use to the institutions and agencies that provide services related to the entry, exit, and transit of persons, vehicles, and goods.

The management and operation of the facilities located in the segregated area shall be in charge of an administrative management, composed of the Ministry of Foreign Trade (Ministerio de Comercio Exterior), the entity in charge of the sustainability of the border post, and the Ministry of Finance (Ministerio de Hacienda), regarding interinstitutional coordination.

Sustainability shall be understood as the construction, commissioning, operation, expansion, remodeling, and preventive and corrective maintenance of the facilities, the payment of indivisible services associated with the facilities, and the implementation of trade facilitation measures. To fulfill these purposes, the Ministry of Foreign Trade (Ministerio de Comercio Exterior) shall have:

a)the human resources required, for which it is guaranteed that it will have the necessary positions, including the creation of new positions and the ability to also use positions created for such purposes that become vacant; and b) the resources received by the Ministry of Finance (Ministerio de Hacienda) under Article 4 of Law 9154, as established in the law, and transfers from other institutions or public entities and those resources resulting from national or international financial collaboration.

Furthermore, the institution holding title to the land is empowered to cede the rights of use and usufruct to securitization trusts (fideicomisos de titularización), investment funds (fondos de inversión), or similar figures; the foregoing, should it be deemed necessary or convenient for the construction, remodeling, expansion, maintenance, and/or operation of the infrastructure works required for the functioning of the border post.)

1Que es obligación del Estado velar por la protección de los recursos naturales del país.
2Que mediante la Ley N° 13, Ley General sobre Terrenos Baldíos, emitida el 6 de enero de 1939, artículo 10 y la ley N° 2825 Y sus reformas, artículo 7, inciso f) se creó una zona pública inalienable de 2 000 metros de ancho a lo largo de la frontera con Nicaragua; esta área en virtud de lo dispuesto en los pronunciamientos emitidos por la Procuraduría General de la República N° C107-85 y N° C272-85 del 20 de mayo de 1985 y 29 de octubre de 1985 respectivamente, se concede que la administración de la zona en tanto los terrenos sean de aptitud agrícola al Instituto de Desarrollo Rural(*) y en tanto lo sean de aptitud forestal al Ministerio de Recursos Naturales, Energía y Minas.

(*) (Modificada su denominación por el artículo 14° de la Ley N° 9036 del 11 de mayo de 2012, "Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural")

3Que la zona en mención se constituye en un importantísimo corredor biológico entre el Area de Conservación Tortuguero, los Humedales de Tamborcito y Maquenque, el Refugio Nacional de Vida Silvestre Caño Negro y la Reserva Forestal El Jardín.
4Que de conformidad con el acuerdo sobre Áreas Fronterizas suscrito por los Gobiernos de las Repúblicas de Costa Rica y Nicaragua en Puntarenas a los quince días del mes de diciembre de 1990, se declara el Sistema Internacional de Áreas Protegidas para la Paz (SI-A-PAZ) como el proyecto de conservación de más alta prioridad en ambos países.
5Que el SI-A-PAZ pretende proteger la muestra más grande y representativa de bosque húmedo tropical que se encuentra en la Vertiente Caribe de Centroamérica.
6Que el avance de los monocultivos comerciales y la tala ilegal han reducido el área boscosa de la vertiente norte a niveles críticos, con el consecuente detrimento del hábitat para la vida silvestre, la pérdida de la biodiversidad, la sedimentación de los cauces pluviales y el avance del proceso de erosión. Por tanto,

Considerando:

DECRETAN:

(Nota de Sinalevi: Mediante el artículo 1° de la ley N° 10127 del 9 de febrero de 2022, se segregó del Refugio Nacional de Vida Silvestre Corredor Fronterizo, creado mediante Decreto Ejecutivo 22962-MIRENEM, de 15 de febrero de 1994, modificado por Decreto Ejecutivo 23248-MIRENEM de 20 de abril del mismo año y ubicado en la línea divisoria entre las Repúblicas de Costa Rica y Nicaragua, un área total de noventa y cuatro mil treinta y dos metros cuadrados (94 032 m2), según el levantamiento topográfico mencionado más adelante.

El área total por segregar se divide en dos subáreas que se ubican entre los puntos uno y diez y uno y veintiocho, respectivamente, de los cuadros que se detallan a continuación:

Lote 1, inmueble situado en el distrito uno, Los Chiles, cantón catorce, Los Chiles, de la provincia de Alajuela; linda al norte con la República de Nicaragua; al sur con Refugio Nacional de Vida Silvestre Corredor Fronterizo; al este con calle pública ruta nacional número treinta y cinco y, al oeste, con Refugio Nacional de Vida Silvestre Corredor Fronterizo, inmueble ubicado en las siguientes coordenadas CRTM-05, así:

ÁREA DE LOTE 1: 1 hectárea 551 metros cuadrados (diez mil quinientos cincuenta y un metros cuadrados), según plano catastrado 2-1792702-2015, inscrito en Catastro Nacional el 6 de enero de 2015.

ÁREA DE LOTE 2: 8 hectáreas 3481 metros cuadrados (ochenta y tres mil cuatrocientos ochenta y un metros cuadrados), según plano catastrado 2-1792432-2014, inscrito en Catastro Nacional el 19 de diciembre de 2014.

Las coordenadas indicadas en los planos y en las tablas anteriores fueron definidas en conformidad con el Informe Técnico del Instituto Geográfico Nacional, IGN-RN- 0432-2014, de 17 de noviembre de 2014.

Estos valores son amarrados al sistema de coordenadas CRTM05, referido al elipsoide de referencia WGS-84, del Instituto Geográfico Nacional de Costa Rica." De conformidad con el artículo 2° de la ley antes referida el área segregada se destinará a la operación y el funcionamiento de un puesto fronterizo terrestre, en instalaciones debidamente habilitadas para brindar servicios relacionados con el ingreso, egreso y tránsito de personas, vehículos y mercancías.

La administración y titularidad del terreno segregado corresponderá al Ministerio de Comercio Exterior, instancia que en el marco del Programa de Integración Fronteriza construirá las nuevas instalaciones y, vía convenio interinstitucional, asignará su uso a las instituciones e instancias que brinden servicios vinculados con el ingreso, egreso y tránsito de personas, vehículos y mercancías.

La gestión y operación de las instalaciones ubicadas en el área segregada estará a cargo de una gerencia administrativa, integrada por el Ministerio de Comercio Exterior, instancia a cargo de la sostenibilidad del puesto fronterizo y, por el Ministerio de Hacienda, en lo referente a la coordinación interinstitucional.

Se entenderá por sostenibilidad la construcción, puesta en marcha, operación, ampliación, remodelación y mantenimiento preventivo y correctivo de las instalaciones, el pago de servicios indivisibles asociados a las instalaciones y la implementación de medidas de facilitación del comercio. Para el cumplimiento de estos fines el Ministerio de Comercio Exterior dispondrá:

a)de los recursos humanos requeridos, para lo cual se garantizará que disponga de las plazas que sean necesarias, incluyendo la creación de nuevas plazas y pudiendo utilizar también las plazas creadas para tales efectos y que queden vacantes; y b) de los recursos percibidos por el Ministerio de Hacienda en el artículo 4 de la Ley 9154, según como se establece en la ley, y de transferencias provenientes de otras instituciones o entidades públicas y de aquellos recursos producto de la colaboración financiera nacional o internacional.

Asimismo, la institución titular del terreno se encuentra facultada para ceder los derechos de uso y usufructo a fideicomisos de titularización, fondos de inversión o figuras similares; lo anterior en caso de considerarlo necesario o conveniente para la construcción, remodelación, ampliación, mantenimiento y/o funcionamiento de las obras de infraestructura requeridas para el funcionamiento del puesto fronterizo.)
