1.- The position of Ombudsman of the Republic is incompatible with any other public or private position, which does not involve university teaching or research.
2.- The Ombudsman of the Republic must resign from any position incompatible with their function, within ten days following their appointment and before their swearing-in.
3.- No official of the Ombudsman's Office of the Republic may participate in partisan political activities.
4.- The Ombudsman of the Republic may not practice liberal professions outside of their position, except in strictly personal matters, those of their spouse, siblings, ascendants, and descendants up to the third degree of consanguinity or affinity, unless there is impediment due to the existence of a direct or indirect interest of the Ombudsman's Office of the Republic itself.
The prohibition in subsection 4) of this article extends only to the professional servants who hold professional positions in the Ombudsman's Office of the Republic. These officials shall be economically compensated on a percentage basis of their base salary. The percentages to be paid to compensate the prohibition are: thirty percent (30%) for those holding a bachelor's degree (licenciatura) or higher, and fifteen percent (15%) for university graduates (bachilleres universitarios).
(Thus reformed the previous paragraph by Article 3 of Title III of the Law for the Strengthening of Public Finances, No. 9635 of December 3, 2018, which added subsection 57 m) to the Public Administration Salary Law, No. 2166 of October 9, 1957) The violation of the preceding incompatibilities and prohibitions by the servants mentioned in this article shall constitute a serious fault of the servant and shall give rise to their dismissal for just cause.
