SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At ten hours and twenty-nine minutes on veinticuatro de enero de dos mil dieciocho.- ORDINARY PROCEEDING (PROCESO ORDINARIO) brought by [Nombre1], of legal age, married, farmer, resident of Manzanillo, Limón, residence identification card number CED1 - - ; [Nombre2], of legal age, married, resident of Manzanillo, Limón, identity card CED2 - - ; against SYNAPSIS SOCIEDAD ANÓNIMA, represented by [Nombre3], of legal age, divorced, businessperson, resident of San José, of Italian nationality, residence identification card number CED3, in his capacity as holder of a general power of attorney without limitation as to amount (apoderado generalísimo sin límite de suma); CORPORACIÓN VIDA VERDE Y MARINA, represented by its court-appointed representative (curadora), [Nombre4], whose particulars are unknown in the record; and THE STATE, represented by the PROCURADURÍA GENERAL DE LA REPÚBLICA, through attorney Gloria Solano Martínez, whose particulars are unknown in the record.

Heard before the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, Limón.

BACKGROUND:

  1. 1The plaintiffs instituted ordinary proceedings (proceso ordinario), seeking a judgment declaring: “That this action for recovery of property (demanda de reivindicación de propiedad) be granted; that the plaintiffs’ lawful possessory right (derecho de posesión) be declared, both with respect to the land located within the maritime-terrestrial zone (zona marítimo terrestre) and the private area delineated in cadastral plan (plano catastrado) L-10985-74; that restitution be ordered of the land identified in the factual allegations of the complaint, with its corresponding area and boundaries, and that the defendants be evicted from the portion of the land corresponding to them; likewise, that MINAE be ordered to record in favor of the plaintiffs the rights and the granting of permits to which they are legally entitled pursuant to the MANAGEMENT PLAN and the legislation governing the matter. SECOND.THAT PLANS L-94656-93 and L-94613-93 BE DECLARED NULL AND VOID because their contents do not reflect the actual topographic or legal-title circumstances and violate the undersigned parties’ rights of possession and ownership, as established in these proceedings; consequently, that the absolute nullity (nulidad absoluta) declared be extended to DEEDS NUMBER THIRTEEN EXECUTED BEFORE NOTARY FERNANDO TREJOS ZÚÑIGA and [Nombre5], through which SYNAPSIS SA acquired title, in the first eleventh volume of said notary’s protocol, appearing on the front of folio twelve, the grounds for ABSOLUTE NULLITY being the defendants’ bad-faith acquisition, alteration of information and adjoining boundaries, as well as payment of the damages and losses caused to the defendant and both categories of costs in this action.” AGAINST CORPORACIÓN VIDA VERDE: “1-To declare possessory rights in favor of the undersigned parties over the area and within the boundaries reliably specified in this complaint, including both the land located within the maritime-terrestrial zone and the private area shown on plan L-10985-74. 2- That restitution be ordered of the land identified in the factual allegations of the complaint and that, as a logical consequence thereof, the occupants of this land be evicted. 3- That MINAE, through the division having jurisdiction to determine the administration of the land, be ordered to grant final administrative permits and all other authorizations pursuant to the MANAGEMENT PLAN governing this matter. 4- THAT PLANS L-94656-93 and L-94613-93 BE DECLARED NULL AND VOID because their contents do not reflect the actual topographic or legal-title circumstances and violate the undersigned parties’ rights of possession and ownership, and that the ABSOLUTE NULLITY therefore be legally extended to deeds number 13 executed before NOTARY FERNANDO TREJOS ZÚÑIGA and MINOR GÓMEZ CALVO, the public instrument through which SYNAPSIS SA acquired title, contained in the first eleventh volume of said NOTARY’S protocol and appearing on the front of folio twelve, the grounds for ABSOLUTE NULLITY being acquisition through what civil-law doctrine and case law call PROCEDURAL FRAUD (FRAUDE PROCESAL) and LATENT DEFECTS (VICIOS OCULTOS); that is, from its inception through the conclusion of these proceedings, the legal transaction was and has been devised with the intent of dispossessing us of the land at issue in these judicial proceedings, because the alteration of information concerning the names of adjoining landowners, areas, and other technical registry matters demonstrates the bad faith and the presence of willful misconduct (dolo), which it is essential for the ADMINISTRATION OF JUSTICE to determine at the appropriate procedural stage. 5- That both companies, SYNAPSIS AND CORPORACIÓN VIDA VERDE MARINASA, be ordered to pay DAMAGES AND LOSSES (DAÑOS Y PERJUICIOS), to be quantified in the judgment according to the merits of the record, including interest to be calculated from the commencement of the events giving rise to this complaint until actual payment, at the interest rate established by BANCO NACIONAL for time deposits, which is the rate applied in judicial and administrative-litigation proceedings.This claim must apply to both defendant companies and is made so that they may be duly notified, all in accordance with THE AMENDMENT required by section 106 and because the court ruled that the issues in dispute have not yet been joined. 6. Likewise, THAT THEY BE ORDERED TO PAY BOTH CATEGORIES OF COSTS IN THIS ACTION.” AGAINST PROCURADURÍA GENERAL DE LA REPÚBLICA: “1. I request that this complaint be granted and that, once the overlap has been determined by expert evidence, recovery of the dispossessed land be ordered. 2. That the undersigned parties be declared the SOLE AND TRUE OWNERS, in accordance not only with the topographic circumstances but also with the substantive truth reflected in cadastral plan number L-10985-74, and that restitution by the third parties who dispossessed them be ordered. 3. That the defendants be ordered immediately to evict the third parties occupying the invaded land, as required by the legally appropriate judgment. 4.That the STATE, represented by PROCURADURÍA GENERAL DE LA REPÚBLICA, be ordered to record in favor of the undersigned parties all rights, permits, and other constitutional and environmental guarantees under the law currently governing this matter, and likewise that a record of title be ordered for inclusion in the MANAGEMENT PLAN.5. That cadastral plan number L- 94656-93 and 94 613, corresponding to the property recorded in the public registry, Limón DISTRICT, REAL PROPERTY FOLIO SYSTEM REGISTRATION NUMBER 57226 000, in the name of SYNAPSIS SA AND CORPORACIÓN VIDA VERDE MARINA SA, be declared ABSOLUTELY NULL AND VOID because it does not reflect the actual topographic or legal-title circumstances, either in part or to the extent determined by expert evidence. 6. That deed number 13 executed before NOTARY FERNANDO TREJOS ZÚÑIGA AND MINOR GÓMEZ CALVO, through which SYNAPSIS SA acquired title, contained in the first eleventh volume of said notary’s protocol and appearing on the front of folio twelve, be declared ABSOLUTELY NULL AND VOID, the grounds for absolute nullity being the defendants’ bad-faith acquisition and alteration of information, such as false adjoining landowners and areas that do not correspond to those held by the prior transferor.That, pursuant to the registry rules in force, the area, boundaries, and location shown on the undersigned parties’ plan be duly corrected so as to comply with the law before REGISTRO PUBLICO DE LA PROPIEDAD, and that the corresponding writ be issued.7. That they be ordered to pay damages and losses, as well as interest at the deposit rate of the national banking system until actual payment. 8. That they be ordered to pay both categories of costs in this action. The plaintiffs itemized the damages and losses as follows: DAMAGES AND LOSSES. THIS ITEM, we reiterate, arises from and consists of the inception of a contractual relationship that was unlawful and contrary to law, through which both defendant companies caused the undersigned parties serious and profound harm that has led to substantial expenditures, where the DAMAGES consist of the fact that, in the matter at hand, we are faced with a property dispute in which the defendants have willfully “constructed an entire systematic, legally unsuitable infrastructure by falsifying the historical truth,” and with the unlawful invasion or appropriation of a section of the property that forms part of the undersigned parties’ assets in the private area.DAMAGES. The damages therefore consist of the fact that these willful acts have logically resulted in our being deprived of the rights inherent in the beneficial use (usufructo) of the property, causing an administrative breakdown before MINAE, since the overlap in areas and boundaries, as stated in the initial pleading instituting the action, affects the preparation of plans and historical registry information before CATASTRO, which was misled by the defendants. ADMINISTRATIVE DEFENSE BEFORE COMITÉ ZONAL AND MINISTERIO DE ENERGÍA Y MINAS. It must be explained to the JUDGE that these expenditures consist of MANZANILLO-SANJOSÉ transportation expenses during the more than ten years that we have been litigating, meals, lodging in both the city of LIMON AND SAN JOSÉ, conferences and hearings before COMITÉ ZONAL AND AT THE CENTRAL OFFICES IN SAN JOSÉ, payment of travel allowances, attorney’s fees for that defense, and those to be quantified in these proceedings according to the merits of the record.DISBURSEMENTS AND LEGAL EXPENSES FROM PRIOR PROCEEDINGS. We can establish in the record that the damages and losses arose both from the original act of invasion and from the legal actions and the filing of two summary possessory proceedings (juicios interdictales) documented in the evidence submitted in the corresponding case file; they must therefore be classified as damage caused by the defendant companies and must form part of the compensation sought at this stage. The adjudicator may use those documents as grounds for the corresponding quantification of damages and losses, because we have been compelled to resort to the ADMINISTRATION OF JUSTICE to prevent the abuses of the companies identified above; the damages are also quantified on the basis that access to the property at issue in these judicial proceedings has been obstructed and that it has been impossible to install signs or fences or to perform clearing work.ESTIMATED DAMAGES. Based on the considerations and evidence, these are estimated at ONE HUNDRED THOUSAND DOLLARS. LOSSES. In view of the actions described in the statement of facts, legal grounds, and the specifications and calculations now provided, we consider the LOSSES to be clearly substantial and to consist of the immobilization of the property, because these ordinary proceedings have caused lost profits (lucro cesante), as we cannot submit petitions to MINAE AND COMITÉ ZONAL to regularize the processing of the deed for the private area, and those lost profits clearly mean that the property’s unrestricted availability is frozen with respect to any potential exercise of commercial or civil rights involving transactions with third parties. That, with respect to this claim, the judgment award interest at the DEPOSIT RATE established by BANCO CENTRAL DE COSTA RICA FOR TIME DEPOSITS, accruing from the date on which the defendants’ disturbance and invasion began until the judgment becomes final, which we estimate at ONE HUNDRED FIFTY THOUSAND DOLLARS.NON-PECUNIARY DAMAGE (DAÑO MORAL). We rely upon what civil case law and doctrine have determined regarding NON-PECUNIARY DAMAGE, under the strict concept that it entails harm to the psyche of the injured person because there is a traumatic event that produces an emotional injury arising from the fear of the potential loss of a tangible or intangible asset, the amount of which may feasibly be established by expert evidence and at the JUDGE’S discretion, supported by scientific criteria when he decides this issue. However, as a prudent estimate, we assess it at cincuenta mil dólares” (folios 40 a 53, 174 a 175 , 189 A 192, 541 A 543).-
  2. 2Synapsis Sociedad Anónima answered the complaint and raised the defenses (excepciones) of failure to establish a legal right, lack of cause, lack of passive and active standing on the merits (legitimación ad causam pasiva y activa), and the general defense of sine actione agit, appearing at folio 135 a 147. Corporación Vida Verde Marina Sociedad Anónima denied the complaint filed against it and raised the defenses of failure to establish a legal right, lack of cause, lack of standing, the general defense of sine actione agit, expiration (caducidad), and statute of limitations (prescripción), appearing at folios 370 a 379.- Procuraduría General de la República answered at folios 1100 a 1104 and raised the defenses of failure to establish a legal right, failure to exhaust administrative remedies (falta de agotamiento de la vía administrativa), and lack of subject-matter jurisdiction (incompetencia en razón de la materia).
  3. 3Edgar Calvo Solano, Attorney-at-Law and trial judge, in judgment 42-2012, issued at trece horas y catorce minutos del veintitrés de julio del año dos mil doce, ruled: "THEREFORE (POR TANTO): With respect to the complaint against Synapsis and Corporación Vida Verde Marina: The statute-of-limitations defense (excepción de prescripción) asserted is denied. The defenses of lack of a legal right (falta de derecho), lack of cause of action (falta de causa), lack of passive and active standing ad causam (falta de legitimación ad causam pasiva y activa), and the general defense of sine actione agit asserted by both co-defendant companies are denied. The statute-of-repose defense (excepción de caducidad) asserted by Corporación Vida Verde Marina is denied. Consequently, the complaint filed by [Nombre1] and [Nombre2] against Synapsis and Corporación Vida Verde Marina is partially granted. It is granted as follows, and deemed denied as to all matters not specified: 1./ It is declared that plaintiffs [Nombre2] and [Nombre1] have a superior possessory right (mejor derecho de posesión) both to the land located within the maritime-terrestrial zone (zona marítimo terrestre) and to the land within the area delineated in cadastral plan (plano catastrado) L-10985-74; 2./ Once this judgment becomes final, the land identified in the allegations of the complaint, with its corresponding dimensions and boundaries, shall be restored to the plaintiffs, who shall be placed in actual and effective possession thereof; 3./ Synapsis is ordered to vacate the land area that forms part of cadastral plan L-10985-1974, according to the location assigned to it in the expert report (informe pericial) at folios 480 to 490.It is likewise ordered to vacate the disputed area (área en litis) delineated as section A in the expert report at folios 480 to 490, which lies outside the area described in plan L-10985-1974. It shall vacate the area within fifteen days after this judgment becomes final, with the warning that failure to do so may result in eviction by law enforcement and prosecution for contempt of authority; 4./ Cadastral plan L-94656-93 is declared void. The necessary official communication or communications shall be sent to Catastro Nacional so that the specified cadastral plan may be canceled; 5./ The companies are held jointly and severally liable for the damages and losses caused, which shall be quantified during enforcement of the judgment (ejecución de sentencia), and they are likewise ordered to pay both categories of costs in this action. The claim seeking an order that the Ministerio del Ambiente Energía y Comunicaciones grant them permits for exploitation (permisos de aprovechamiento) in the maritime-terrestrial zone is denied, because such permits must be requested through the appropriate channels.The request to nullify deed number trece, executed before co-notary Fernando Trejos Zúñiga on 9 de agosto de 1993, by which co-defendant Corporación Vida Verde sold Synapsis Sociedad Anónima the property located in the Partido de Limón and recorded in the Registro Nacional under number CED6, is denied. As stated above, all other relief sought against Synapsis and Corporación Vida Verde Marina is denied. With respect to the complaint filed against the State: The defense of lack of a legal right asserted by the Procuraduría General de la República on behalf of the State is granted. Because the plaintiffs failed to establish either their active standing (legitimación activa) or the State’s passive standing (legitimación pasiva) to be sued, the complaint filed by [Nombre1] and [Nombre2] against the State is denied in all respects. This complaint against the State is adjudicated without a special award of costs against the plaintiffs (folio 1678 to 1679).
  4. 4Sonia María Saborío, Attorney-at-Law, acting as special judicial attorney-in-fact (apoderada especial judicial) for Synapsis S.A, filed an appeal (recurso de apelación), expressly stating the grounds on which she relied to challenge the trial court’s position (folio 1695 to 1699). Gloria Solano, Attorney-at-Law, acting as representative, filed an appeal expressly stating the grounds on which she relied to challenge the trial court’s position (folio 1708 to 1715).
  5. 5This Court, by Voto N° 989-F-13, issued at catorce horas y treinta y cuatro minutos del veintiuno de octubre de dos mil trece, ruled: "

THEREFORE (POR TANTO): The motion for nullity (nulidad) is denied. Judgment cuarenta y dos-dos mil doce of trece horas y catorce minutos del veintitrés de julio del dos mil doce is partially reversed insofar as it denied the defense of lack of a legal right asserted by the defendants and partially granted the complaint filed by [Nombre1] and [Nombre2] against Synapsis and Corporación Vida Verde Marina, granting claims uno, dos, tres, cuatro y cinco. In its place, the defense of lack of a legal right asserted by the defendants is granted, and the complaint is denied. On the Court’s own motion, cadastral plans numbers L-10985-1974 and L-94656-1993 are declared void. Once this ruling becomes final, the court below shall send the appropriate official communications to the Subdirección Catastral del Registro Nacional Inmobiliario so that the registrations of the cited plans may be canceled. Consequently, both plaintiffs [Nombre1] and [Nombre2] and co-defendant Synapsis Sociedad Anónima are ordered to vacate immediately the disputed area comprising the area described in cadastral plan L-10985-1974 and the adjoining eastern sector and [Dirección1] of the cited plan, described as section A in the expert report appearing at folios 480 to 490.

In addition, within fifteen business days after this ruling becomes final, co-defendant Synapsis Sociedad Anónima shall remove the existing fence from the disputed property, after which the State may dispose of the disputed area in accordance with its nature and legal status. The appealed ruling is affirmed as to all other matters raised on appeal."

I. PROVEN FACTS (HECHOS PROBADOS)

This Court adopts the findings regarding the proven facts because they are well supported by the record, except for those numbered 6, 14, 15 and 20, because they are not relevant to resolving the proceeding, and numbers 12 and 16, because they are facts inconsistent with the evidence in the record. In addition, the following facts are established for purposes of deciding this appeal: 21.- The disputed area extends from the road facing the beach to the east, along the road and the wire fence with concrete posts to a point seven meters beyond the Higuerón tree, and from there, following the sole caña india plant northward, crossing the two trees with pieces of old wire embedded in them, until reaching the edge of the estuary (estero) (see expert report at folios 467 to 479, judicial inspection (reconocimiento judicial) at folios 1369 to 1374, and see judicial inspection in the audio recording in this Court’s virtual filing, associated-documents folder, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporated on 07 de octubre del 2013). 22.- The plaintiffs’ possession of the property described in cadastral plan L-10985-1974 consisted solely of gathering coconuts and clearing the land (see ruling at folios 16 to 24, statements made in examination of the parties (declaraciones confesionales) by [Nombre1] and [Nombre2] at folios 1356, 1358 and 1359, and witness testimony (declaraciones testimoniales) by [Nombre6] and [Nombre7] at folios 1383 to 1387). 23.- Cadastral plans numbers L-10985-1974 and L-94656-1993 contain surveying and graphical errors (see expert reports at folios 467 to 479, 504 to 506, 587 to 591, 1246 to 1252 and 1300 to 1302). 24.- Plan L-10985-1974, which depicts the land claimed by the plaintiffs as their own, lies entirely within the area comprising the Zona Marítimo Terrestre (see expert reports at folios 467 to 479, 1246 to 1252, 1300 to 1302, Dirección Catastro report at folios 1410 to 1414, judicial inspection at folios 1369 to 1374, and see judicial inspection in the audio recording in this Court’s virtual filing, associated-documents folder, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporated on 07 de octubre del 2013, claim in the complaint at folio 52). 25.- Several boundary markers (mojones) demarcating the public zone (zona pública) of the maritime-terrestrial zone are located within the areas described in plans L-10985-1974 and L94656-1993 (see expert report at folios 1300 to 1302, examination of the parties (prueba confesional) of [Nombre1] and [Nombre2] at folios 1359 and 1366, judicial inspection at folios 1369 to 1374, and see judicial inspection in the audio recording in this Court’s virtual filing, associated-documents folder, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporated on 07 de octubre del 2013). 26.- Plan L-10985-1974 encompasses an area of 900 square meters within the public zone, and the remainder lies within the restricted zone (zona restringida) forming part of the maritime-terrestrial zone.

(see expert reports at folios 1300 to 1315, 1315 to 11318, judicial inspection at folios 1369 to 1374, and see judicial inspection in the audio recording in this Court’s virtual filing, associated-documents folder, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporated on 07 de octubre del 2013). 27.- The area identified during the judicial inspections as a stream and adjoining the disputed area has been classified as an estuary by the Instituto Geográfico Nacional (see expert report at folios 1315). 28.- Plaintiffs [Nombre1] and [Nombre2] were fully aware that the land areas at issue in this proceeding were located within the maritime-terrestrial zone and form part of the Refugio de Vida Silvestre Gandoca-Manzanillo (see complaint at folio 52, examination of the parties of [Nombre1] and [Nombre2] at folios 1359 and 1366, and relief sought in the complaint at folio 52). 29.- The land claimed is naturally characterized by forest cover (cobertura boscosa), with very dense vegetation, moist and sandy soils, and various yolillo and sangrillo plants (see judicial inspections at folios 1369 to 1374, and see judicial inspection in the audio recording in this Court’s virtual filing, associated-documents folder, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporated on 07 de octubre del 2013).

II. UNPROVEN FACTS (HECHOS NO PROBADOS)

Likewise, the findings regarding the unproven facts are adopted because they concern matters that were not established in the record. In addition, the following facts are established for purposes of deciding this appeal: 5.- Plaintiffs [Nombre1] and [Nombre2] did not establish the chain of transfers of possession exercised over the land areas at issue in this proceeding or the exact date on which such possession began. 6.- The plaintiffs did not establish that they exercised possession in a manner consistent with the nature of the land.

III. Edgar Calvo Solano, Attorney-at-Law, judge of the Juzgado Agrario del Primer Circuito

Judicial de la Zona Atlántica, Limón, in judgment number 42-2012, issued at thirteen hours and fourteen minutes on veintitrés de julio del dos mil doce, with respect to the claim against Synapsis and Corporación Vida Verde Marina, rejected the defenses of statute of limitations (prescripción), lack of a legal right (falta de derecho), lack of cause of action (falta de causa), lack of active and passive standing (falta de legitimación activa y pasiva), and the general defense of sine actione agit raised by the co-defendant companies. The defense of expiration (caducidad) raised by Corporación Vida Verde Marina was rejected. Consequently, the claim was partially granted; and with respect to the claim filed against the State, the defense of lack of a legal right raised by the Procuraduría General de la República on behalf of the State was upheld, and because the plaintiffs failed to establish either their active standing or the State’s passive standing to be sued, the claim against the State was dismissed in its entirety. This claim brought against the State was decided without a special award of costs (condenatoria en costas) against the plaintiffs.

IV. APPEAL BY THE STATE (RECURSO DE APELACIÓN DEL ESTADO)

Gloria Solano Martínez, Attorney-at-Law, in her capacity as representative of the State, filed an appeal, stating as follows: GROUND FOR NULLITY (MOTIVO DE NULIDAD): In the eighth recital (considerando octavo), addressing the merits of the case and the defenses, the judgment does not analyze any of the defenses raised, making it impossible to ascertain the reasons and grounds underlying the ruling in the operative portion (parte dispositiva) of the judgment. In that regard, the judgment is contradictory because, on the one hand, it upholds our defense of lack of a legal right, but at the same time recognizes rights of the plaintiffs over State-owned public property, which in principle would be recognized and protected by dismissing the claim against the State. Nevertheless, because the decision does not analyze the State’s substantive defense (excepción de fondo), it is difficult to properly challenge the judge’s reasoning, precisely because the arguments serving as the basis for the ruling are unknown.

With respect to the substantive grounds of appeal (agravios de fondo), it was argued as follows: The State’s interest in appealing is based on the fact that the claim was partially granted and, to that extent, confers rights upon the plaintiffs over land constituting State-owned public property, which harms the interests of the party she represents and contravenes statutes and binding judgments that expressly prohibit it. This is so even though the operative portion of the judgment upholds the defense of lack of a legal right raised in the answer to the complaint. The judgment violates substantive law because it declares rights over land owned by the State and forming part of a national wildlife refuge. The judgment directly violates the law by failing to apply Articles 261, 262 and 285 of the Código Civil; Articles 13 and 14 of the Ley Forestal; Articles 32 and 40 of the Ley Orgánica del Ambiente; Article 58 of the Ley de Biodiversidad; and the laws that, since 1828, have afforded public-domain protection (protección demanial) to the strip located along the coasts.

This is because it confers rights upon the plaintiffs in contravention of statutory provisions expressly prohibiting public-domain property (bienes de dominio público) and property forming part of the State Natural Heritage (Patrimonio Natural del Estado) from being possessed by private parties. In this regard, it must be clearly understood that what occurred with respect to the public-domain strip within the maritime-terrestrial zone (zona marítimo terrestre) at issue here was an administrative change in the designation of the area, subjecting it to new public purposes, but its public-domain status (naturaleza demanial) remains unchanged. She further states that, pursuant to Article 73 of Ley 6043, equivalent reserves are excluded from its application; this concept encompasses all State protected wilderness areas (áreas silvestres protegidas estatales), which are subject to management plans (planes de manejo) ensuring the proper protection, conservation, and rational use of natural resources for sustainable development.

These are mutually exclusive regimes: the ordinary maritime-terrestrial zone governed by Ley 6043 and the categories comprising the State Natural Heritage, given the differing purposes to be achieved through the designation (afectación) of State wilderness areas and the criteria required for their administration. Even so, before its incorporation into the Refuge, the strip on which the disputed land is located was protected under the public-domain regime applicable to the coastal zone, dating back to Ley número 162 del 28 de junio de 1828, which afforded protection to the strip of [Dirección2] along the coasts, and whose protection was maintained and reaffirmed by the Código General de 1841, Article 296 of which stated that “the ebb and flow of the sea, its shores, ports, inlets, roadsteads, and generally all portions of State territory that are not susceptible to private ownership shall be deemed to belong to the public domain.” Ley número 39 del 31 de agosto de 1886 was subsequently enacted, prohibiting “claims to public wasteland (tierras baldías) located within a strip two thousand varas wide along the coasts of both seas,” as was Ley de Aguas número 11 del 26 de mayo de 1884, Article 20 of which declared that “the maritime-terrestrial zone, or the area along the coasts of the Republic washed by the sea during its ebb and flow, and the adjoining land up to a distance of one mile, belongs to the public domain.” Subsequently, leyes número 19 de 12 de noviembre de 1942 and número 201 de 26 de enero de 1943 were enacted and, although they reduced the zone to two hundred meters, preserved its public-domain status, a status maintained under the current Ley sobre la Zona Marítimo Terrestre.

In addition to the foregoing, the judgment directly violates the law through the improper application of decreto Nº 16614-MAG del 1º de julio de 1985, by which the Executive Branch, exercising the constitutional and statutory powers conferred by Ley Forestal N° 4465 del 25 de noviembre de 1969 and Article 18 of Ley de Conservación de la Fauna Silvestre, created Refugio Nacional de Vida Silvestre Gandoca Manzanillo. Through that act, it declared and included the State-owned land disputed here within that protected wilderness area, in view of its natural resources and the fact that it includes one of the world’s few nesting beaches for the leatherback sea turtle (tortuga Baula). The foregoing applies insofar as the judgment recognizes rights over the land described in survey plan (plano) L-10985-74, which bears the notation “for lease,” despite the compelling evidence in the judicial record concerning the public-domain status of the area at issue in this litigation.

On the one hand, the judicial inspection report (acta de reconocimiento judicial) (folios 1367 to 1372) states that the disputed land is located within the State-owned area subject to the public-domain regime, which also forms part of Refugio Nacional de Vida Silvestre Gandoca Manzanillo, and encompasses both part of the public zone (zona pública)—the strip fifty meters wide measured from the ordinary high-tide line, together with the areas exposed at low tide—and part of the restricted zone (zona restringida)—the remaining one hundred fifty meters. There is also the overlay (montaje) prepared by the Catastro Nacional, which reaffirms the status of the property as State land. Precisely because this land is owned by the State and forms part of the State Natural Heritage, no right may be recognized in favor of the parties participating in this proceeding: inalienability (inalienabilidad) and immunity from attachment (inembargabilidad) are essential, distinctive, and defining legal characteristics of the public domain, reinforced by the corresponding non-prescriptibility of recovery actions (acciones reivindicatorias), the ineffectiveness of possessory acts (actos posesorios) by private parties, and the prohibition against private parties obtaining title.

The public-domain regime precludes and excludes the private appropriation of property, removes it from legal commerce (tráfico jurídico), and prevents private persons subject to the Administration from possessing it for their own purposes; consequently, it is legally impossible to confer rights upon the plaintiffs as the judgment under appeal does.

V. APPEAL FILED BY SYNAPSIS SOCIEDAD ANÓNIMA

Attorney Sonia María Saborio Flores, special judicial representative (apoderada especial judicial) of Synapsis Sociedad Anónima, filed an appeal (recurso de apelación) against the challenged decision, alleging the following: GROUND FOR NULLITY (MOTIVO DE NULIDAD): The judgment is marred by defects of inconsistency, inadequate reasoning, and failure to consider the evidence. She argues that, when analyzing the procedural defects, the judgment states that her principal improperly responded to the amendment to the complaint, reasoning that the issues had already been joined at that procedural stage, and it adds the amendment and the response to the complaint to the case record. The amendment to the complaint shows that, therein, the plaintiff referred to damages (daños y perjuicios); the amendment should have met the same fate with respect to those claims. Nevertheless, without providing any grounds whatsoever, the trial judge ruled on them, leaving them defenseless and violating due process, because her principal was ordered to pay damages even though there was no clear and express prayer for such relief, and the ruling was based on a calculation contained in the amendment to the complaint, which was added to the case record.

As to the substantive grounds for appeal (agravios de fondo), she presented the following: 1.- The existence of an overlap (traslape) between plats L-10985-74 and L-94656-93 was declared based solely on the expert report submitted by engineer [Nombre8], which determined that the overlap covered an area of 1424.15 square meters, corresponding to section B. The report likewise states that plat L-94656-93 overlaps an unregistered area, which is confusing because neither plat corresponds to registered areas located outside plat L-10985-74 and corresponding to section A, for which no measurement is stated. Furthermore, it indicates that her principal has fenced an area of 1305.38 square meters, described as section C, which forms part of plat L-10985-74. Although the record contains other evidence, the judgment fails to assess that evidence and lacks any analysis supporting the facts deemed proven and unproven.

For example, she asserts that the report submitted by engineer Juan Araque Skinner, Deputy Director of the Catastro Nacional, was not assessed. The information contained in that report is valuable because it identified a clear contradiction with the information submitted by engineer Víctor Castro. Nor was the report by engineer Jorge Segura Aguilar, contained in expediente EXPN1 of the Juzgado Civil de Mayor Cuantía de Limón, assessed. That report concludes that it is impossible to determine whether plat L-10985-74 overlaps another area. Lastly, the report submitted by engineer [Nombre9] is not mentioned either; although it identifies an overlap, it determines that the overlap covers 3365.60 square meters, which is diametrically opposed to the area stated by engineer [Nombre8]. She states that all those differences are explained by the fact that the plaintiffs’ plat has serious problems concerning both its location and its metes-and-bounds description (derrotero), and therefore no expert report could clearly determine whether an overlap exists. 2.- The judge ordered that possession be restored over the land area forming part of plat L-10985-1974, based on the location assigned to it in the expert report, including the parcels identified in the allegations of the complaint with their respective measurements and boundaries; the court also ordered the eviction (desalojo) of section A identified in the report.

In that regard, the judgment is defective for granting relief beyond that requested (extra petita), because the plaintiff never defined the area extending beyond the plat’s physical boundaries or beyond its area as an inseparable antecedent of the plat, which the judge now identifies as section A. She adds that the measurement and boundaries of the claimed area were not clearly stated because the complaint refers only to plat L-10985-1974, which has been shown to contain serious technical defects; the judge therefore cannot cure the plaintiff’s omission. 3.- The court deemed it proven that the plaintiffs had performed actual acts of possession (actos posesorios) and held a superior right of possession (derecho de posesión) over the area described in plat L-10985-1974 and section A as defined in the expert report. In analyzing the acquisition, the judgment states that the right of possession acquired by the plaintiffs was transferred by Mr. [Nombre10], even though the plaintiffs stated in their complaint that the original possessors were [Nombre11] and [Nombre12], but failed to submit appropriate evidence that those persons transferred possession to Mr. [Nombre10].

Nor is the matter clear in that respect, since the plat mentions the name of a corporation, whereas the testimonial evidence refers to a natural person. Moreover, the court deemed it proven that the acquisition was made orally, even though, when giving her testimony under examination of a party (prueba confesional), plaintiff [Nombre2] stated that the right of possession was acquired from Brookd Bank Investment and that a document was executed, while Mr. [Nombre1], when giving his testimony under examination of a party, stated that no document existed and that he purchased it from Jim Brooks Bank. Furthermore, witness [Nombre6] stated that the right of possession was originally transferred by his grandfather, [Nombre13], and that he even saw a document recording the purchase of the property from Brooksbank. That testimony is confusing and accommodating, and it is unusual that he would recall the matter precisely when he was only a child at the time; moreover, he is the plaintiff’s son.

The only acts of possession observed were the commercial sale of coconuts, which does not constitute an organized agricultural activity. Witness [Nombre7] does not even know the current condition of the land and merely purchased coconuts from the plaintiffs. The plaintiffs’ testimonial evidence failed to demonstrate that they exercised a right of possession over the property they claim and is internally contradictory. Conversely, the evidence submitted by her principal was not properly assessed, even though it includes public instruments, registered cadastral plats (planos catastrados), and testimonial evidence proving that it acquired the properties it possesses and has performed actual agricultural acts of possession on them. The documentary evidence demonstrated that the right of possession over the property described in plat L-94656-1993 was acquired by public deed (escritura pública), and that the property described in plat L-94613-93, recorded under real property folio (folio real) 57226-000, was likewise acquired by public deed. 4.- The court diminished the evidentiary weight of the private document stating that Mr. [Nombre1] is the person who looks after Synapsis’s property, because it concluded that he cannot read Spanish.

In reaching that conclusion, it considered only that individual’s testimony under examination of a party and mere assumptions, which contradicts the fact that the plaintiff, who allegedly cannot read Spanish, signed the initial complaint and numerous other court filings. The court failed to consider that, in his testimony under examination of a party, Mr. [Nombre1] acknowledged signing that document; however, it cannot be deemed proven that he was unaware of its contents. 5.- The court failed to consider that the plaintiffs based their complaint on the allegation that they hold a right of possession over property that, according to their own assertions, lies within the maritime-terrestrial zone (zona marítima terrestre) and the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. As the Sala Constitucional has ruled, no such right of possession exists over public-domain property (bienes demaniales), which is outside the stream of commerce and cannot be possessed; accordingly, the plaintiffs cannot be granted such a right, as the judgment under appeal does.

VI. SUBJECT MATTER OF THE LITIGATION. SPECIFIC CASE

Based on the established facts, the property at issue, claimed herein as part of the plaintiffs’ requested relief, is subject to two separate public-domain designations because it forms part of the maritime-terrestrial zone (zona marítimo terrestre) and lies within the Refugio Nacional de Vida Silvestre Gandoca Manzanillo. Although the dispute is between private parties and the State as co-defendant, the claimed tract of land is subject to two separate designations as public-domain property (bienes de dominio público). On the one hand, it has formed part of the maritime-terrestrial zone since very early times and, subsequently, it was included within the boundaries of the Refugio Nacional de Vida Silvestre, which in turn forms part of the State Natural Heritage (Patrimonio Natural del Estado). In this case, there is no doubt as to the legislation applicable to the merits of the matter, since the entire historical review of the status of this area was undertaken to highlight its twofold subjection to the public-domain regime and the date on which that status began.

This was done in order to analyze the grounds for appeal raised by the appellants and the merits of the dispute. In the appeal filed by the representative of Synapsis Sociedad Anónima, the fifth ground for appeal alleges that the court failed to consider that the plaintiffs base their claim on a right of possession (derecho de posesión) concerning land located within the maritime-terrestrial zone and the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, asserting that such possession is not legally permissible because of those conditions, an issue that has been analyzed by the Sala Constitucional. The same point is disputed by the State, represented by the Procuraduría General de la República, which bases all of its claims on the violation of the environmental regulations governing the maritime-terrestrial zone, protected wilderness areas (áreas silvestres protegidas), and Patrimonio Natural del Estado, arguing that no right of possession may be recognized in that area because the property is public-domain property (bien demanial), lies outside private commerce, and therefore cannot be appropriated by private parties.

Because this claim is common to the appeals filed, the Court now rules on this first ground for appeal. This Court considers it important to note that the property over which the plaintiffs claim a superior right of possession (mejor derecho de posesión) lies entirely within the area comprising the Zona Marítimo Terrestre located inside the Área Silvestre Protegida REFUGIO DE VIDA [Nombre14]. This is clearly stated in the complaint filed by [Nombre1] and [Nombre2]. An analysis of the relief sought shows that the following is expressly requested: “... that the plaintiffs’ lawful right of possession be declared, both over the lands located within the maritime-terrestrial zone and over the private area encompassed by registered survey plan (plano catastrado) L-10985-74...” (see requested relief at folio 52). Plan L-10985-1974, which depicts the land claimed by the plaintiffs as their own, lies entirely within the area comprising the Zona Marítimo Terrestre, as demonstrated by the expert reports submitted by the experts Ing. [Nombre8] at folios 467 through 491, the supplemental report at folios 510 through 512,587 through 591, the Expert Report of Ing. [Nombre9] at folios 1300 through 1302, 1315 through 1316, and the Catastro Nacional Report prepared by engineer [Nombre15] at folios 1410 through 1414.

Nor is it disputed that the property claimed by the plaintiffs lies within the strip comprising the maritime-terrestrial zone, as acknowledged by the plaintiffs themselves, and that it forms part of the Refugio de Vida Silvestre Gandoca-Manzanillo (see complaint at folio 52, testimony under examination of [Nombre1] and [Nombre2] at folios 1359 and 1366, and requested relief in the complaint at folio 52). This circumstance forms part of the grounds for appeal asserted by the appellant co-defendants, because the judgment under appeal grants rights over public-domain property, which they contend violates the laws in force. Based on the foregoing, the claims made by the appellant co-defendants are well founded. At their core, their grounds for appeal seek to show that the Judge disregarded the public-domain nature of the disputed land over which the plaintiffs requested in their complaint that a superior right of possession be declared.

The plaintiffs’ own statements establish that the property is public-domain property because it entered the public domain (demanio público) through special laws that have regulated the maritime-terrestrial zone since the last century. The legal regime governing that zone will be discussed below, under which such property is characterized as removed from the rules of private law and therefore constitutes “Res Extra commercium,” meaning outside commerce. Thus, [Nombre16] defines PUBLIC PROPERTY (BIENES PUBLICOS) as: “Property that, with respect to ownership, belongs to a people, province, or Nation and, with respect to its use, to all individuals within its territory. It is also called public-domain and National property,” and then refers to the STATE’S PRIVATE PROPERTY (BIENES PRIVADOS DEL ESTADO) as property that: “This is the name given under Argentine legislation to property belonging to it as private property, that is, patrimonial property.” The regimes applicable to each category are different.

Public-domain property is indeed outside private commerce, as established by Article 262 of the Civil Code, which is worth reproducing: “Article 262: Public things are outside commerce and may not enter it unless legally so provided by removing them from the public use for which they were intended.” Meanwhile, Article 261 of the same Code distinguishes between State public-domain property and private-domain property, and it is worth reproducing here what that article expressly provides: Article 261: “Public things are those that, by law, are permanently devoted to any service of general utility and those that everyone may use because they have been made available for public use. All other things are private and may be privately owned, even if they belong to the State or to Municipalities, which, for these purposes and as civil persons, do not differ from any other person.” (emphasis added).

In the present matter, the property in question lies within the maritime-terrestrial zone, which was designated as public-domain property through various legal provisions beginning in the last century. In other words, the property claimed by the plaintiffs, over which they seek a declaration of a superior right of possession, is outside the commercial and ordinary dealings applicable to private property. Under those circumstances, as established in the first paragraph of Article 261 of the Civil Code, the ordinary regime governing private property does not apply to it. For that reason, such property cannot be subject to the legal doctrines of Civil Law and Agrarian Law, including acquisition through adverse possession (usucapión) or a declaration of a superior right of possession. HISTORICAL OVERVIEW OF REGULATION IN THE MARITIME-TERRESTRIAL ZONE: The account of the facts and the findings set out in the various expert reports prepared in these proceedings show that the subject matter of the dispute lies within the maritime-terrestrial zone and within the boundaries of the Refugio de Vida Silvestre Gandoca-Manzanillo.

Accordingly, in order to analyze the merits of the matter, it is appropriate to provide a brief historical overview of the legislation applicable to these lands, given the particular features of each of the designations noted above. With respect to the maritime-terrestrial zone, specific regulations exist, namely Law Nº 6043, Law on the Maritime-Terrestrial Zone, published in the Diario Oficial La Gaceta Nº 52, Alcance Nº 36, dated 16 de marzo de 1977, and its Regulations. The first article of that law establishes that the maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription. The public-domain status has been the subject of extensive rulings by the courts, and the Sala Constitucional has specifically stated: “... V. Constitutional protection of the maritime-terrestrial zone in general. On numerous occasions, this Constitutional Court has had the opportunity to address the legal nature of the maritime-terrestrial zone and its constitutional protection, as it forms part of the national patrimony as public-domain property.

  • A)Public-domain property in general: In this regard, constitutional scholarship and case law consistently consider public-domain property (public property or property in the public domain) to have a nature and legal regime distinct from private property—which is governed by property law under the terms of Article 45 of the Constitución Política—because, by the express will of the legislature, it is allocated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned. It is consequently outside private commerce and cannot belong individually either to private parties or, strictly speaking, to the State, since the latter is limited to administering and safeguarding it. Thus, what defines the legal nature of public-domain property is its purpose or intended use, insofar as it is allocated and devoted to public use, precisely because it is designated for a special public purpose involving the public interest, as defined by Article 261 of the Civil Code: ‘Public things are those that, by law, are permanently devoted to any service of general utility and those that everyone may use because they have been made available for public use.’ It should be noted that the distinction emphasizes the property’s intended purpose, that is, the fact that it is allocated to common use or to service of the common good.
  • B)Attributes of public-domain property: Title to public-domain property is held by the State in its capacity as administrator, which means that such property belongs to the ‘Nation’ and forms part of the public patrimony; and because of its special legal nature, it has the following attributes: it is not subject to prescription, which means that the passage of time cannot give rise to a right of ownership over it, or even to mere possession; in other words, it cannot be acquired through adverse possession, nor can it be lost through prescription. Accordingly, permits for use (permisos de uso) granted by the Administration over such property are always precarious in nature and may therefore be revoked by the Administration at any time for reasons of expediency or convenience—under the terms established in Articles 154 and 155 of the Ley General de la Administración Pública—and concessions granted for its use may likewise be canceled through the applicable procedure.

It is not subject to attachment, meaning that it cannot be subjected to any encumbrance or attachment, whether by private parties or by the Administration; and it is inalienable, meaning that it lies outside private commerce. It therefore cannot be transferred, sold, or acquired, whether gratuitously or for consideration, by private parties or by the State, and is consequently excluded from private commerce and subject to a special and heightened legal regime.

Furthermore, its use and enjoyment are subject to the police power (poder de policía), since, because these are assets that cannot be subject to possession, much less ownership, their use and enjoyment are possible only through duly authorized acts, whether by concession or permit for use, granted by the competent authority, and under the constant oversight of the Public Administration. Thus, it encompasses immovable property whose nature and legal regime are virtually the opposite of private property, as derived from Article 45 of the Constitution. C) On the public-domain status (demanialidad) of the maritime-terrestrial zone (zona marítimo terrestre): The public-domain status of the maritime-terrestrial zone is expressly established in Article 3.I. of the Ley de Aguas, number 276, of veintiséis de agosto de mil novecientos cuarenta y dos: “Article 3.- The following are likewise national property: I.- Beaches and maritime zones”; and in Article 1° of the Ley de la Zona marítimo terrestre, insofar as it states verbatim: “The maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription.” Accordingly, the maritime-terrestrial zone must be regarded as public-domain property (bien demanial) of the Nation, both by constitutional provision, based on Article 6, and by statutory mandate, in accordance with the provisions transcribed above...” (see resolution Sala ConstitucionalNº [Telf1] at 14:59 on 25 de febrero del 2009).

That same resolution expressly referred to the historical background that gave rise to regulation of the maritime-terrestrial zone, as well as the amendments it has undergone, matters that have also been analyzed in various decisions. In this regard, it stated: “E) On the public-domain status of the maritime-terrestrial zone throughout Costa Rican history: Throughout human history, the coast has been recognized as having great economic and commercial importance, as well as importance for security—for the defense of the national territory—for any country or state organization. Thus, with respect to our country, the coastline has remained devoted to public use since the colonial era. Initially, the reserved area was one mile wide, which is why it was known—and is still known today—as the ‘maritime mile’ (milla marítima). The most significant legislation regulating Costa Rica’s coastal zone began with Law number 162, of veintiocho de junio de mil ochocientos veintiocho, shortly after independence from the Spanish Crown was declared and during the formation of the Costa Rican State.

That law established a maritime-mile reserve along the coasts of both seas, thereby adopting an earlier rule from the colonial era (Real Cédula, of quince de octubre de mil setecientos cincuenta y cuatro). This provision was maintained throughout all legislation enacted in the nineteenth century. It is important to emphasize that some laws from this period expressly highlighted the public-domain nature of this zone, as in the case of the Código General of mil ochocientos cuarenta y uno, which deemed the ebb and flow of the sea and its shores to be in the public domain. Likewise, Law number 7, of treinta y uno de agosto de mil ochocientos sesenta y ocho, reaffirmed the ‘non-claimability’ (idenunciabilidad) of the lands of the maritime [Dirección3], that is, the impossibility of obtaining title to lands in this zone. The Ley de Aguas, number 8, of veintiséis de mayo de mil ochocientos ochenta y cuatro, designated this strip of land as the ‘maritime-terrestrial zone,’ expressly dedicated it to the public domain (afectación demanial)—as public-domain property—and consequently incorporated it into the national patrimony.

The Código Fiscal of mil ochocientos ochenta y cinco prohibited the conveyance of lands located within a [Dirección4] along the coasts of both seas. In the twentieth century, the first legislation referring to the maritime-terrestrial zone was Law number 75, of treinta de agosto de mil novecientos veinticuatro, which reaffirmed the public-domain status of these lands, as well as the prohibition against exploiting them and enjoying their fruits. For its part, Law number 11, of veintidós de octubre de mil novecientos veintidós, precisely defined its extent by setting it at mil setecientos sesenta y dos metros—a measurement corresponding to exactly one mile—from the ordinary high-water line (pleamar ordinaria), and quinientos metros along both banks of rivers. This measurement remained in effect until mil novecientos cuarenta y dos, when, pursuant to Law number 19, of doce de noviembre, and Law number 201, of veintiséis de enero de mil novecientos cuarenta y tres, its extent was reduced to doscientos metros along both coasts, thereby bringing about the first removals from the public domain (desafectaciones) of this property with respect to all lands beyond the established boundary and their consequent private appropriation.

In other words, pursuant to these two provisions, and except for the doscientos metros measured from the ordinary high-water line, the remaining mil seiscientos setenta y dos metros ceased to be in the public domain once they could be converted into private property. However, the lands within the doscientos metros excepted by the two aforementioned laws continued to be public-domain property and could not be converted into private property because they were inalienable and not subject to acquisitive prescription. It is therefore correct to maintain that, pursuant to the aforementioned laws, the maritime-terrestrial zone was established as extending doscientos metros from the high-water line, which remains its current extent, while retaining its status as public-domain property. This measurement, together with the public-domain status of the lands located therein, was reaffirmed in the then-effective Article 7 of the Ley de Tierras y Colonización No. 2825 of catorce de octubre de mil novecientos sesenta y uno, and was repeated in the Ley Forestal No. 4465, of veinticinco de noviembre de mil novecientos sesenta y nueve, and in the Ley de Urbanización Turística de la Zona Marítimo Terrestre No. 4558, of veintidós de abril de mil novecientos setenta.

Special mention must be made of Law number 4558, of veintidós de abril de mil novecientos setenta, because, pursuant to its Transitorio III., ciento cincuenta metros of the doscientos metros—following the first cincuenta metros measured from the high-water line—were removed from the public domain by authorizing private parties who had possessed lots or properties in that sector for more than treinta años, quietly, openly, peacefully, and without interruption, to register them through possessory title proceedings (informaciones posesorias) before the judicial—not administrative—authorities. Because of the large number of abuses committed while this provision was in effect, that is, from doce de mayo de mil novecientos setenta, it was repealed by Law number 5602, of cuatro de noviembre de mil novecientos setenta y cuatro, which took effect upon its publication in La Gaceta number 206, of catorce de octubre de mil novecientos setenta y uno; that is, it remained in effect for diecisiete meses y dos días.

In judgment number 007-93, at 15:05 on 20 de enero de 1993, the Sala Primera de la Corte Suprema de Justicia recounted this historical development as follows: ‘[...] numerous statutory provisions have, in one way or another, established regulations governing the maritime-terrestrial zone, formerly better known as the maritime mile. Some of them—the most important—are the following: Law No. 162 of 8 de junio de 1828, Decree No. 12 of 10 de diciembre de 1839, Law No. 14 of 26 de febrero de 1840, Law No. 128 of 19 de agosto de 1853, Decree No. 4 of 30 de julio de 1858, Law No. 7 of 31 de agosto de 1868, Law No. 42 of 13 de agosto de 1875, Law No. 22 of 7 de febrero de 1881, Ley de Aguas No. 8 of 26 de mayo de 1884 and its amendments, Código Fiscal of 1885 (Law No. 8 of 31 de octubre de 1885), Law No. 58 of 29 de julio de 1892, Law No. 7 of 4 de noviembre de 1892, Law No. 15 of 27 de marzo de 1896, Law No. 60 of 13 de agosto de 1914, Law No. 82 of 5 de abril de 1923, Law No. 75 of 30 de agosto de 1924, Law No. 11 of 22 de octubre de 1926, which amended the Código Fiscal of 1885, Law No. 29 of 3 de diciembre de 1934, Ley General de Terrenos Baldíos No. 13 of 10 de enero de 1939, Decree No. 6 of 2 de abril de 1940 (Reglamento a la Ley General de Terrenos Baldíos), Law No. 19 of 12 de noviembre de 1942, Law No. 201 of 26 de agosto de 1943, Decreto Ley No. 500 of 19 de abril de 1949, Ley de Tierras y Colonización No. 2825 of 14 de octubre de 1961, Law No. 2906 of 24 de noviembre de 1961, Law No. 4071 of 22 de enero de 1968, Ley Forestal No. 4465 of 25 de noviembre de 1969, Ley de Urbanización Turística de la Zona Marítimo Terrestre No. 4558 of 22 de abril de 1970, Law No. 4928 of 17 de diciembre de 1971, which amended the preceding law, and Law No. 5602 of 4 de noviembre de 1974, which suspended it.

This is not the occasion for an exhaustive analysis of the various statutory provisions governing the subject; however, it must be noted that the first legal provision issued during the republican era—Law No.162 of 28 de junio de 1828—established a maritime [Dirección2] reserve along the coasts of both seas, which, according to Law No. 128 of 19 de agosto de 1853, had existed since the colonial era pursuant to the Real Cédula of 15 de octubre de 1754. Throughout the nineteenth century, the various laws enacted reaffirmed this principle by establishing a maritime-mile reserve along both coastlines. The Reglamentos Generales de la Hacienda Pública of 1839, 1858, and 1868 maintained the reserve created in 1828; but, for present purposes, what is important is the clear designation, in legislation enacted during the previous century, of the so-called maritime mile as public-domain property, with its consequent inalienability and non-claimability.

Thus, for example, the Código General of 1841 deemed the ebb and flow of the sea and its shores to be in the public domain; the aforementioned Law No. 7 of 31 de agosto de 1868 reaffirmed that lands within the maritime mile could not be claimed; the Ley de Aguas No. 8 of 26 de mayo de 1884—the only nineteenth-century provision in which the term Maritime-Terrestrial Zone was used—classified that zone as being in the public domain; and the Código Fiscal of 1885 established that lands located within a zone of one [Dirección3] in width along the coasts of both seas could not be conveyed.’ It is therefore clear that, from the earliest provisions regulating this zone, it was always classified as public-domain property (dominical, demanio, or de dominio público), which gives it all the attributes of public-domain status: its inalienability, immunity from acquisitive prescription, immunity from attachment (inembargabilidad), and subjection to the police power with respect to its use and enjoyment. ‘It is therefore clear, without detracting from the aforementioned colonial-era precedent, that since Costa Rica came into existence as an independent State, the land reserve along both coastlines has not formed part of the unappropriated public lands (baldíos)—the Crown lands of the Colony—but has always been subject to a distinct legal regime, namely that governing public-domain property, and therefore cannot be converted into private property.

The legislation on this subject enacted throughout the twentieth century, culminating in the current Ley sobre la Zona Marítimo Terrestre No.6043 of 2 de marzo de 1977, obviously maintained the classification of the lands within that zone as public-domain property. As a result of the legislative development of the nineteenth century, the maritime-terrestrial zone encompassed the portion of the coasts of both seas washed by the ebb and flow of the tides, extending one mile inland.

It also encompassed riverbanks up to the point where the rivers were navigable or affected by the tides. Legislation enacted during this century progressively defined the extent of the zone, as well as the elements comprising it, but at no time denied its status as public-domain property (bien demanial) and, consequently, its immunity from acquisition by prescription (imprescriptibilidad) and its inalienability (inalienabilidad); [...] .

From this brief study of the legislation concerning the maritime-terrestrial zone (zona marítimo terrestre), it is easy to conclude that the 200-meter strip measured from the ordinary high-tide line along both coasts, defined as part of the maritime-terrestrial zone by article 9 of the current Ley sobre la Zona marítimo terrestre, has been part of the public domain (dominio público)—and the lands contained therein, public-domain property (bienes demaniales)—since at least 1828. The changes introduced in this area by the legislation of the last century and the present one have never generally removed these 200 meters from the public domain; rather, the legislation prior to 1942 and 1943 established a wider strip—the so-called maritime mile—but never a narrower one.” (Judgment number 007-93 of the Sala Primera de la Corte Suprema de Justicia, cited supra). As can be seen, the designation of the maritime-terrestrial zone as public domain and its exclusion from appropriation by private parties dates back a very long time, because the State has always maintained an interest in keeping these areas under its control, not only to make them available for public enjoyment but also because of their environmental significance.

With respect to the legislation currently in force, as correctly stated supra, the law that presently defines what is meant by the maritime-terrestrial zone is Ley 6043, section 9 of which provides: “The maritime-terrestrial zone is the two-hundred-meter-wide strip extending along the entire Atlantic and Pacific coastlines of the Republic, regardless of its nature, measured horizontally from the ordinary high-tide line, together with the lands and rocks exposed by the sea at low tide. For all legal purposes, the maritime-terrestrial zone includes islands, islets, and sea rocks, as well as any land or natural formation rising above ocean level within the territorial sea of the Republic....” In addition, the following articles 10 and 11 identify the areas comprising it and define each of them. In this regard, they provide: “Article 10.- The maritime-terrestrial zone consists of two sections: the PUBLIC ZONE, which is the fifty-meter-wide strip measured from the ordinary high-tide line, together with the areas exposed at low tide; and the RESTRICTED ZONE, consisting of the remaining one-hundred-and-fifty-meter strip, or the remaining lands in the case of islands.

Islets, sea rocks, and other small areas and natural formations rising above the sea belong to the public zone.” Section 11 provides: “The public zone also includes, regardless of its extent, the area occupied by all mangroves along the continental and island coastlines and all estuaries within the national territory.” This body of law clearly provides that lands located within the maritime-terrestrial zone may not be appropriated by private parties by any means and, specifically with regard to the public zone, reiterates that no person may claim any right over it under any title, because it is intended for public benefit and the free movement of persons; public institutions and the country’s authorities are obligated to guarantee such free movement to everyone (articles 7 and 20 of the Ley sobre Zona Marítimo Terrestre). For its part, Decreto Ejecutivo Nº 7841-P, “Reglamento a la Ley sobre la Zona Marítimo Terrestre,” contains in its second article several definitions relevant to determining more clearly how far the maritime-terrestrial zone extends.

The foregoing definition states that it comprises the two-hundred-meter-wide strip along the Atlantic and Pacific coastlines, with coastline being defined as: “The seashore or coast, extending through permanent tidal inlets and estuaries as far as they are appreciably affected by the tides and exhibit defined marine characteristics” (Reglamento a la Ley sobre la Zona Marítimo Terrestre, article 2, subsection h). Within the same provision, subsections e) and f) set forth what is meant by estuaries and tidal inlets, as follows: “e) Estuary (estero): Land immediately adjacent to the shore of a tidal inlet over which tidal waters extend; f) Tidal inlet (ría): The part of a river near its mouth at the sea and extending to the point reached by the tides....” It follows from the foregoing that both tidal inlets and estuaries are regarded as part of the maritime-terrestrial zone, regardless of their extent.

Accordingly, in the present case, the ground of appeal concerning this issue raised by the appellants Procuraduría General de la República and Synapsis Sociedad Anónima is well-founded, since the public-domain character of the property at issue in the litigation has been proven. To the same effect, see decision Nº 733-F-2000 of the Sala Primera de la Corte Suprema de Justicia, issued at 15:12 on 4 de octubre del 2000, which states in pertinent part: “...IV.- With regard to the ground of appeal concerning the legal nature of the property in dispute, the following must be noted. Article 121 subsection 14 of the Constitución Política provides, in pertinent part: ‘Article 121.- In addition to the other powers conferred upon it by this Constitution, the Asamblea Legislativa has exclusive authority to: 14) Decree the alienation or allocation to public uses of property belonging to the Nation. …’ (Underlining not in the original).

This provision is implemented legislatively in section 261 of the Código Civil, which provides: ‘Article 261.- Public things (cosas públicas) are those that, by law, are permanently allocated to any service of general utility, and those that may be used by everyone because they have been made available for public use. All other things are private and subject to private ownership, even if they belong to the State or the Municipalities, which, for such purposes and as legal persons under civil law, are no different from any other person.’ (Underlining not in the original). As is clear from these provisions, our legal system recognizes State ownership of both public-domain and private property. Legal doctrine is consistent with this. Public property consists of property designated by a specific law for public or general use. It is known as public-domain property. It is inalienable, not subject to acquisition by prescription, not subject to attachment, and not subject to private claims.

That is, it is devoted to public use and general utility. It is therefore outside private commerce—article 262 of the Código Civil. The Sala Constitucional de la Corte Suprema de Justicia has defined the public domain as ‘...the body of property subject to a special legal regime distinct from that governing private ownership, which, in addition to belonging to or being administered by public-law legal persons, is allocated or devoted to purposes of public utility, manifested in the direct or indirect use that every person may make of it.’ (judgment no. 3145, issued at 9 hours 27 minutes on 28 de junio de 1996). Likewise, in judgment no. 2408, issued at 16 hours 13 minutes on 21 de febrero de 2007, that Constitutional Court stated: ‘...Constitutional doctrine and case law consistently hold that public-domain property (or dominical property or property in the public domain) is property having a nature and legal regime different from those of private property—which is governed by the right of ownership under the terms of article 45 of the Constitución Política—because, by the legislature’s express intent, it is allocated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned; it is thus outside private commerce and cannot belong individually either to private parties or, strictly speaking, to the State, since the latter’s role is limited to its administration and protection.

Thus, what defines the legal nature of public-domain property is its purpose or intended function, insofar as it is allocated to and serves public use, precisely because it is designated for a special public purpose involving the public interest, as defined in article 261 of the Código Civil: “Public things are those that, by law, are permanently allocated to any service of general utility, and those that may be used by everyone because they have been made available for public use.” It should be noted that the distinction emphasizes the purpose of the property, namely, the fact that it is allocated to common use or to serving the common good, as the Sala Constitucional previously held in judgment number 2301-91, of seis de noviembre de mil novecientos noventa y uno: “The public domain consists of property that, by the legislature’s express intent, has the special purpose of serving the community and the public interest.

These are the so-called dominical property, public-domain property, public property or public things, which do not individually belong to private parties, are intended for public use, and are subject to a special regime outside private commerce. In other words, they are so designated by their very nature and intended function. Consequently, such property belongs to the State in the broadest sense of the term, is allocated to the service it provides, and that service is invariably essential pursuant to an express rule.” Thus, this is property held by the State in its capacity as administrator and must be understood as property belonging to the “Nation,” thereby forming part of the public patrimony (patrimonio público); because of its special legal nature, it has the following attributes: it is not subject to prescription, which means that the passage of time cannot give rise to ownership rights over it, or even mere possession—in other words, it cannot be acquired through adverse possession (usucapión), nor can it be lost by prescription.

For that reason, permits for use granted by the Administration with respect to such property are always precarious in nature, meaning that the Administration may revoke them at any time on grounds of expediency or convenience—under the terms provided in articles 154 and 155 of the Ley General de la Administración Pública—and concessions granted for its use may likewise be canceled through the applicable proceeding. It is not subject to attachment, meaning that it cannot be encumbered or attached by either private parties or the Administration; and it is inalenable [sic], meaning that it is outside private commerce and therefore cannot be alienated, sold, or acquired, whether gratuitously or for consideration, by private parties or by the State, so that it is excluded from private commerce and subject to a special and reinforced legal regime. Furthermore, its use and exploitation are subject to the police power (poder de policía), because, as property that cannot be possessed, much less owned, it may be used and exploited only pursuant to duly authorized acts, whether through a concession or a permit for use granted by the competent authority, and under the constant oversight of the Public Administration. It therefore comprises immovable property having a nature and legal regime virtually opposite to private property, which derives from the provisions of constitutional article 45. …’.”

VII.BACKGROUND TO THE CREATION OF THE Refugio de Vida Silvestre Gandoca-Manzanillo: As evidenced by the summary of the background to these proceedings, the property at issue is also located within the boundaries of the Refugio de Vida Silvestre Gandoca-Manzanillo, which is a management category (categoría de manejo) of protected wilderness areas (áreas silvestres protegidas), pursuant to section 32 of the Ley Orgánica del Ambiente. Accordingly, it is important to analyze the definition of that management category and the background to its creation. A wildlife refuge (Refugio de Vida Silvestre) is defined in article 82 of the Ley de Conservación de Vida Silvestre as follows: “National fauna and wildlife refuges are those that the Executive Branch declares or has declared as such for the protection and research of wild flora and fauna, particularly those that are endangered. For classification purposes, there are three types of national wildlife refuges: a) State-owned refuges, b) Mixed-ownership refuges; c) Privately owned refuges (...)�.” That same provision establishes that the natural resources located within wildlife refuges shall be administered by the Dirección General de Vida Silvestre del Ministerio de Ambiente y Energía, an agency whose powers were incorporated into those of the Sistema Nacional de Áreas de Conservación, as provided in the second paragraph of section 22 of the Ley de Biodiversidad.

Regarding the background to the creation of that protected wilderness area, the Refugio de Vida Silvestre Gandoca-Manzanillo was created by Decreto Ejecutivo N° 16614 del 01 de julio de 1985, published in the Diario Oficial La Gaceta N° 206 del 29 de octubre de 1985. The recitals (considerandos) of that executive decree justified its creation by citing the area’s environmental importance, including mangroves, swamps, forests, and reefs of unique value; a unique yolillo and orey plant association; populations of endangered species; the only natural mangrove oyster bed; tarpon breeding grounds; lobster populations; and the great tourism potential of its beaches. Subsequently, Decreto Ejecutivo N° 23069-MIRENEM del 21 de marzo de 1994 was issued and published in the Diario Oficial La Gaceta N° 65 del 05 de abril de 1994; article 16 thereof declared access to the Gandoca beach area restricted and repealed section 6 of the decree creating the aforementioned refuge.

However, in 2000, Decreto Ejecutivo N° 29019 del 19 de setiembre del 2000 was issued and published in the Diario Oficial La Gaceta N° 208 del 21 de octubre del 2000; it repealed Decreto Ejecutivo Nº 23069-MIRENEM in its entirety. Years later, Decreto Ejecutivo N° 32753 del 16 de mayo del 2005 was issued and published in the Diario Oficial La Gaceta N° 228 del 25 de noviembre del 2005, entitled “Ratifies the continued validity of articles 1, 2, 3, 4, 7, and 8 of the executive decree that created the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo.” In addition to ratifying the cited articles of the decree creating the refuge, this executive decree repealed sections 5 and 6 of that same legal instrument. However, this executive decree was repealed by article 7 of Decreto N° 34043 del 11 de setiembre del 2007, published in the Diario Oficial La GacetaN° 202 del 22 de octubre del 2007.

The last-mentioned executive decree ratified and amended the decree creating the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, expanding the boundaries established in the original decree. However, by resolution N° 1056 del 28 de enero del 2009, the Sala Constitucional annulled most of the provisions of that decree, leaving only articles 2, 6, and 8, which concern the expansion of the refuge’s original boundaries, the suspension of timber harvesting (aprovechamiento maderable) in the canton of Talamanca, and the entry into force of the regulation. As can be seen, the refuge has undergone several modifications since its creation. Nevertheless, as stated above, the purpose of that designation (afectación) has always been to conserve and protect the diversity of the natural resources existing in the area. Maintaining their protection is of great national importance, not only to prevent the extinction or loss of the species inhabiting the area, but also to comply with international legislation protecting such areas, including the Convenio para la Conservación de la Biodiversidad y Protección de Áreas Silvestres Prioritarias en América Central, approved by Ley Nº 7433, published in La Gaceta Nº 193 del 11 de octubre de 1994; the Convenio sobre el Comercio Internacional de Especies Amenazadas de Flora y Fauna Silvestre, ratified by Ley Nº 5605 del 30 de octubre de 1974; among others.

As part of the protected wilderness areas, these areas are considered an integral part of the State Natural Heritage (Patrimonio Natural del Estado), and the applicable legal regime is therefore the one established in the Ley Forestal, specifically sections 13, 14, and 15. This is even expressly provided in section 73 of the Ley sobre la Zona Marítimo Terrestre, which states: “Article 73.- This law does not apply to maritime-terrestrial zones (zonas marítimo terrestres) included within national parks and equivalent reserves, which shall be governed by the applicable legislation.” It follows that the provision excludes national parks and equivalent reserves from the regime established by the cited law. Although it does not expressly include wildlife refuges, they must be deemed included within the term “equivalent reserves,” as the Sala Constitucional has held: “... Indeed, the cited article states: ‘Article 73.- This law does not apply to maritime-terrestrial zones included within national parks and equivalent reserves, which shall be governed by the applicable legislation.’ Although the quoted text does not expressly include the term ‘wildlife refuges,’ they must be understood as included within the phrase ‘equivalent reserves,’ because, necessarily, in view of their underlying environmental-protection purposes, their management must take into account technical considerations in this field, which are more properly handled by the respective specialized agencies than by municipal corporations; hence, their administration is governed by specific regulations” (see resolución 1886-95 de las 09:12 horas del 07 de abril de 1995).

Likewise, in other disputes arising within the boundaries of the Refugio de Vida Silvestre Gandoca-Manzanillo, this Court has reiterated its position that such areas form part of the Patrimonio Natural de Estado, while also recognizing the environmental importance of that area, as clearly stated in Voto 721-F-03 de las 14:07 horas del 31 de octubre del 2003: “XXIII.- In this case, although it is true that we are dealing with a dispute between private parties, that dispute involves public-domain property (bien demanial) forming part of the Patrimonio Forestal del Estado (...). It is the Refugio de Vida Silvestre Gandoca-Manzanillo, created by Decreto N° 16614-MAG del 11 de octubre de 1985 (...). Because it is public-domain property, every private individual, as well as the community, has an interest in its protection, particularly given its ecological value to our country. The importance of this refuge was accorded even greater weight when Costa Rica, pursuant to the Convención relativa a los Humedales de Importancia Internacional, especialmente como Hábitat de Aves Acuáticas (Aprobado en Ramsar, Irán, el 2 de febrero de 1971, y modificada por el Protocolo de París del 3 de diciembre de 1982 y las Enmiendas de Regina del 28 de mayo de 1987), approved by Costa Rica through Ley N° 7224 del 2 de abril de 1991....” In the same case, the importance of these areas and their status as public-domain property were further emphasized as follows: “...

IV.- Furthermore, it should be noted that, because the matter concerns the State’s public domain (dominio público del Estado), the property cannot permanently leave the Nation’s ownership (article 121, subsection 14, of the Constitución Política), because it forms part of the State’s natural heritage (article 89 of the Constitution) and, in this case, is a Wetland of International Importance. Consequently, such property is not subject to acquisitive prescription, is inalienable and immune from seizure, and cannot be privately appropriated. It is governed by the principle of registration without prior recorded title (principio de inmatriculación), because it forms part of public property, and Constitutional Case Law must mandatorily be applied (Votos No. 1763-94 de las 16:45 horas del 13 de abril de 1994). Because it is public-domain property (articles 13 and 14 of the Ley Forestal), it is subject to a special legal regime, and its purpose is common use and enjoyment; its inability to be converted into private ownership is inherent in its legal nature, pursuant to article 261 of the Código Civil (Sala Constitucional, No 447 de las 15:30 horas del 21 de febrero de 1991).

In short, the legal nature and regime differ depending on whether the property is privately owned or is public or State property, because the former is governed pursuant to article 45 of the Constitution and the relevant provisions of the Código Civil, thereby protecting its inviolability while introducing the concept of social function. The regulation of public-domain property, in turn, is based on subsection 14 of article 121 of the Constitution.” (Emphasis not in the original; see Voto Nº 842-F-05 de las 15:00 horas del 27 de octubre del 2005). Those decisions were affirmed in all respects by the Sala Primera de la Corte Suprema de Justicia through resolution número 952-F-05 de las 16:20 horas del 07 de diciembre del 2005, upholding this Court’s decision and emphasizing the status of public-domain property, as well as the possibility of recovering such property, stating: “... Additionally, the same appellate court (ad quem) concluded that, regardless of whether the aforementioned notice was deemed given on the date alleged by the appellant (11 de mayo de 1993), the land at issue is public-domain property and, as such, title to it cannot be acquired by prescription.

This characteristic of the property in question renders irrelevant the notification date alleged by the appellant in cassation (casacionista), because, as clearly follows from the very concept of public-domain property (dominicales), such property is inalienable, not subject to prescription, immune from seizure, and incapable of being relinquished. Based on these principles, irrespective of the time elapsed, it remains possible to annul a title purporting to transfer to a private party’s estate ownership of property declared to be in the public domain, unless otherwise provided by law. (In this regard, see, among others, sentencia No. 733 de las 156 horas 12 minutos del 4 de octubre del 2002, issued by this Chamber). Concerning this status of the disputed land, proven fact No. 5 of the Trial Court, affirmed by the Court, clearly states that it ‘...is located within Reserva Nacional-Bosques, and was administered by the Instituto de Tierras y Colonización from the year one thousand nine hundred seventy-eight to the year one thousand nine hundred eighty-nine, and as of primero de julio de mil novecientos ochenta y cinco it became included within the Refugio nacional de Vida Silvestre Gandoca manzanillo, created by Decreto No.

16614-MAG, (folio 788) In this regard, the assessment of evidence (valoración probatoria) challenged by the appellant is closely linked to the merits analysis conducted by the lower courts, particularly by the court of first instance (a quo) beginning with recital IV (considerando IV), and by the appellate court (ad quem) in recitals XXIII and XXIV, an exercise of judicial judgment from which the public-law status of the property at issue is inferred and which presupposes that it is legally impossible for private parties to appropriate it for their exclusive benefit. This proven fact and analysis of the merits, which have not been challenged by the appellant, establish the aforementioned nature of the property in question, with the result that, as to the merits, the notification date disputed by the appellant is immaterial (for the reasons already stated), because regardless of whether notification occurred on the alleged date, the fact remains that the non-prescriptibility (imprescriptibilidad) of public-domain property permits the annulment of any title established in contravention of that legal status” (Emphasis not in the original).

It follows from the foregoing that Refugio de Vida Silvestre Gandoca-Manzanillo forms part of the Patrimonio Natural del Estado, which includes within its boundaries areas of great environmental importance whose protection and conservation have therefore been safeguarded and which, by virtue of their status, may not be appropriated by private parties, but rather must be allocated for the general enjoyment of the population. From the foregoing, it is clear that public-domain property (bienes de dominio público) consists of assets designated by a specific law, or by their very nature, for public or general use and subject to a special legal regime. They are known as “public-domain assets” (“demaniales”) and are inalienable, not subject to acquisitive prescription, exempt from attachment, and not subject to private claims, and they are outside private commerce (Article 262 of the Civil Code).

With respect to this type of property, it is impossible to declare a “SUPERIOR RIGHT OF POSSESSION” (“MEJOR DERECHO DE POSESIÓN”), as sought by the plaintiff in this case, because it did not even prove that it had exercised possession over the disputed land, as discussed supra, so as to establish a preferential right allowing it to use and benefit from public property pursuant to Article 263 of the Civil Code, given that the disputed property is a public-domain asset.

VIII. GROUNDS FOR NULLITY ALLEGED BY THE APPELLANTS

The first ground for nullity (motivo de nulidad) was alleged by counsel for Synapsis Sociedad Anónima. It claims that it was left without an adequate defense and that its right to due process was violated because only the second answer to the complaint filed by the company it represents, appearing at folios 209 through 219 and 232 through 242, was added to the case record; the supplemental complaint in which they addressed damages should also have been added to the case record. The appealed decision shows that, in its first recital (considerando), the court below (a quo) analyzes and corrects the error that arose regarding the supplemental complaint against Corporación Vida Verde Marina and Synapsis Sociedad Anónima. In that regard, it orders that the answer to the supplemental complaint filed by codefendant Synapsis Sociedad Anónima, as well as the supplemental complaint filed by the plaintiffs against that codefendant, be added to the case record; it makes clear that a ruling was issued only on the supplemental complaint against Corporación Vida Verde Marina, in order to guarantee the parties equal treatment and due process (see decision at folios 1664 through 1665).

However, it was clarified that a ruling was being issued regarding the damages claimed, which does not infringe the right of defense or due process because such relief was requested both in the initial complaint appearing at folio 53 and in the supplemental complaint appearing at folio 175; those claims were asserted generally against both codefendant companies, Corporación Vida Verde Marina and Synapsis, meaning that the appellant had the opportunity from the outset to address that relief. It should be noted that neither of the two answers to the complaint appearing at folios 105 through 117 and 209 through 219 addressed the damages alleged, which, as stated, had been claimed in the initial complaint. The second ground for nullity was asserted by counsel for the State. It argues that the judgment, in the eighth recital concerning the merits of the case and defenses, does not analyze any of the defenses raised, making it impossible to ascertain the reasons and legal grounds underlying the ruling in the judgment’s operative portion.

In that regard, the judgment is contradictory because, on the one hand, it upholds the State’s defense of lack of legal entitlement (falta de derecho), while, on the other hand, it recognizes rights of the plaintiffs in State-owned public property, which in principle would be recognized and protected by dismissing the complaint as to the State. Nevertheless, because the decision does not analyze the State’s merits-based defense (excepción de fondo), it is difficult to mount a proper challenge to the judge’s reasoning because the arguments underlying the ruling are unknown. It is not true that the appealed decision omitted a ruling on the defenses raised by counsel for the State, because those defenses were addressed in the eleventh recital, not the eighth. An analysis of that recital shows that each claim asserted against the State was evaluated and found to be without merit, with the reasons for its rejection stated; therefore, it is not true that the basis for the decision cannot be discerned.

Although no ruling was made on the nature and conditions of the claimed properties, this is not a ground for nullity but rather a merits-based contention, which will be analyzed and addressed in this decision when ruling on the appellants’ merits-based grounds of appeal. Based on the foregoing, the grounds for nullity alleged by both appellants must be rejected, and the remaining grounds of appeal will now be analyzed.

IX.In resolving the dispute, the challenged decision did in fact partially grant the claim in favor of the plaintiffs, recognizing that they held a better possessory right (mejor derecho de posesión) both to the lands located within the maritime-terrestrial zone (zona marítimo terrestre) and to the area delineated in cadastral plan (plano catastrado) L-10985-74 (see the operative portion of the judgment appearing at folios 1678 and 1679). In reaching that conclusion, the court below analyzed the situation in recitals (considerandos) nine and ten, from which it is apparent that the judge focused solely on resolving the parties’ arguments as to who might or might not hold the better possessory right. However, there is no discussion of the legal nature of the lands being claimed in the proceeding, despite the court’s clear awareness of that status, as acknowledged when describing the areas claimed by the parties and expressly referring to the expert reports (informes periciales) contained in the record.

Because this issue was raised in the appeals, it must be analyzed to determine whether the better possessory right declared in favor of the plaintiffs may properly be upheld. As correctly stated in the preceding recitals of this decision, the area of land claimed by the plaintiffs as their own and over which they seek a declaration of a better possessory right forms part not only of the maritime-terrestrial zone but also of the Refugio de Vida Silvestre Gandoca-Manzanillo; these designations date, respectively, from 1828 and 1985, and that status has not changed during the intervening period. As part of their arguments, the plaintiffs state in their complaint that they acquired possessory and ownership rights more than forty years ago; they subsequently state that possession (posesión) of the property described in plan L-10985-74 dates back more than 13 years, tracing a chain of records in the Departamento Agrario del Ministerio de Agricultura e Industrias beginning on 01 de junio de 1949 with the execution of lease agreements by the original owners, [Nombre11] and [Nombre12].

However, no evidence whatsoever was submitted to prove that alleged chain. They also claim possession by operation of law (posesión de puro derecho) over the [Dirección5] boundaries of plan L-10985-74, asserting that these form a single whole and that their possession therefore extends beyond the physical extent shown on the plan; however, no justification is apparent for the origin of possession in that second area. The record contains no documentary evidence supporting the origin of the possession claimed by the plaintiffs, and the testimonial evidence must therefore be assessed. With respect to that evidence, only three witnesses testified in this proceeding, namely [Nombre6], [Nombre17], and [Nombre7], whose testimony appears at folios 1381 through 1388. Those witness statements show that the latter two witnesses made no reference whatsoever to the origin of the plaintiffs’ possession; Mr. [Nombre17] even acknowledged that he did not know to whom the property belonged (see testimony at folio 1385).

The only person to address that matter was Mr. [Nombre6], who stated that the land had belonged to his paternal grandfather, named [Nombre13], who sold it to a man surnamed [Nombre10], from whom [Nombre1] and his mother later purchased it; he stated that this occurred more than thirty years before he gave his testimony in 2008. He added that he did not know exactly how long his grandfather had been there, but that it was since he himself was a child, around the seventies, after which his grandfather sold it to [Nombre10] (see testimony at folio 1382). The foregoing shows that there is insufficient clarity regarding the origin of the possession transferred to the plaintiffs by the prior possessors. The only support submitted was a cadastral plan from 1974, which by itself is insufficient to establish the actual exercise of possession, pursuant to article 301 of the Código Civil, applied supplementarily in this matter.

Moreover, that plan is not registered in the name of a private individual, but rather in the name of the Municipalidad de Talamanca, from which a lease had been requested. One fact admitted by both plaintiffs is that they purchased the land sometime between 1984 and 1986 and acquired the possession exercised for several years by the prior transferors. As a reference point, the Court may consider the testimony of the only witness who mentioned the timing and manner of acquisition: although he stated that he did not know exactly how long his grandfather had been there, he did state that it had been since the seventies, which is consistent with the date of cadastral plan L-10985-1974. Nevertheless, even if the exercise of possession is deemed to have begun in the seventies, it cannot be considered as a basis for claiming any right over the properties at issue (inmuebles en litis), because long before that date those areas already formed part of the public domain (bienes de dominio público).

The expert reports established that the claimed lands include areas within the maritime-terrestrial zone and even encompass a portion of the public zone (zona pública), as shown at folios 470, 483, 488, 1247, 1250, 1301, 1315, and 1410, and that despite the errors in the placement of plan L-10985-74, those areas remain subject to that designation. This is in addition to their subsequent designation as a Wildlife Refuge (Refugio de Vida Silvestre) beginning in 1985. The plaintiffs were fully aware of that status of the properties at issue, not only because it is apparent from the cadastral plan they submitted, but also because they have acknowledged it since the beginning of the proceeding. Indeed, their requested relief included a declaration of possessory rights both over the lands located within the maritime-terrestrial zone and over the area described in the aforementioned plan (see complaint at folio 52).

This was reaffirmed when both plaintiffs gave evidence on examination of a party (prueba confesional), as shown at folios 1359 and 1366, expressly acknowledging that part of the land lies within the fifty-meter zone and that several boundary markers (mojones) are located on the land. These facts were also verified during the judicial inspection (reconocimiento judicial) conducted by the trial judge, from which the following is particularly noteworthy: “... At this location one can see what the plaintiffs call the ‘Crique,’ an estuary or stream, and it is reported that the land in dispute begins at the right bank and extends toward [Dirección6]. We crossed the unnamed stream or crique and reached a road approximately three meters wide, where plaintiff [Nombre1] indicated what, in his opinion, constitutes the area in dispute, extending from the stream along a frontage of approximately one hundred twenty meters.

This point is identified first by a metal post bearing the English words ‘Old Bryground’... from this sign, continuing southwest along the road for approximately fifteen or twenty meters (...) I clarify that the eastern boundary consists of the frontage along the Caribbean Sea beach and, as a matter of interest, it is noted (sic) that the waves break approximately ten meters away in sections of the road facing the beach (...) toward [Dirección7], or toward the stream or crique sector, there are very tall weeds (sic), beginning at a height of one and a half meters, such that the area at issue is characterized as an undisturbed forest area (zona de bosque no intervenido) with dense vegetation (...) The area enclosed by the road facing the beach to the east, the road and the wire fence with concrete posts extending to seven meters beyond the Higuerón tree, and from there following the single caña india plant northward, crossing the two trees with pieces of old wire embedded in them and continuing to the bank of the crique or stream, constitutes the area that is the subject of the dispute and that the plaintiffs claim for themselves, as established at the site.

Between the first road and the second, along which the electrical utility poles are carried on ‘PVC’ pipes, a concrete boundary marker was located approximately twelve meters north of the estuary, stream, or crique, identified as No. ‘CED7.’ The plaintiff states that there are two others within the area in dispute, such that part of the land he claims lies within the fifty-meter protection zone (zona de los cincuenta metros de protección), but the other boundary markers could not be located because of the vegetation or weeds. It is also noted that there are no structures, livestock, or crops of any kind in the area at issue, and that the boundary encompassing the stream has no fence” (see the judicial-inspection record and sketch at folios 1369 through 1374). The description, as well as the conditions and nature of the areas at issue, is consistent with what this Court observed during the visual inspection (inspección ocular) conducted as evidence to assist in reaching a decision (prueba para mejor resolver) on 22 de febrero del año 2013, from which the following is particularly noteworthy: “The judicial inspection begins at the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo.

It begins by locating the first boundary marker, numbered 101, along the stream called ‘Simión,’ reportedly named after the first settler to arrive in that area. Several crab holes are observed in that sector, indicating the influence of the marine ecosystem, as well as plants characteristic of a mangrove. Boundary marker 101 is reached and, according to the GPS location, point 20 is identified, corresponding to position [Dirección8], and position [Dirección9], . Some coral reef is observed in that sector... We continue walking in the direction of the power line and parallel to the coast until reaching a relatively new fence with concrete posts and three strands of wire, which is identified as corresponding to the area in dispute; there is also a row of plants. That area is located south of the aforementioned boundary marker 101, approximately 10 or 12 meters away. The vegetation along the southern boundary is quite dense.

The area claimed by the plaintiff runs along the line of fence posts to the stream and from there toward boundary marker 101. In that area, the soil is quite wet and sandy, with abundant vegetation; several sangrillo trees and several yolillo plants are also observed. It could be described as a yolillo grove, and the vegetation-covered area continues; that sector is located at [Dirección10]. An attempt is made to clear a path along the southern boundary of the area in dispute, where the soil also appears clayey and sandy, with traces of coral and crab holes. Measurements are then begun from [Dirección11] at [Dirección12] of the area in dispute toward boundary marker 100, which, although not located, is said to be approximately where the electrical cables pass. From point 21, where the fence is located, to boundary marker 100, there are approximately 40 meters. Measurement begins again for an additional ten meters, for a total of 50 meters, and there is another 10 meters to the electrical wiring, for a total of 60 meters from point 21 to the power-line sector.

The distance from boundary marker 101 toward the sea is then measured, although it is stated that measurement may be taken from the power-line sector toward the sea, yielding a distance of 35 meters; accordingly, there is an approximate distance of 50 meters from the area in dispute to the sea. The inspection then proceeds toward boundary marker 98. Approximately 5 meters from that marker, another fence is observed, consisting of two strands of smooth wire and a concrete post, which the plaintiff states marks the boundary between his parcel and that of Mr. [Nombre18].”

Synapsis’s representative states that this fence corresponds to the eastern boundary of Synapsis’s survey plan and is the one they recognize as forming part of the disputed area, which had to be repaired. In that sector, an old strand of barbed wire can be seen, apparently from another fence that had stood there. Finally, measurements are taken from the point where the inspection began toward the area where the estuary rises. In that sector, the defendant states that when the tide rises, the entire area that now appears dry is flooded; this is the area where boundary marker 101 is located. At that location, the water is somewhat salty, and marine influence can be seen entering through this channel. From boundary marker 101 to the point where the estuary begins, there is a distance of 20 meters” (see judicial site inspection (reconocimiento judicial) in the audio recording contained in this Court’s electronic filing, associated documents folder, Oral Trial/Audio Judicial Site Inspection February 22, incorporated on October 07, 2013).

In light of the foregoing, it follows that the disputed area lies within the boundaries of the Refuge and the maritime-terrestrial zone (zona marítimo terrestre), and the claim even encompasses the area extending to the estuary, which was designated as such by the Instituto Geográfico Nacional, as the expert stated in his report appearing at folio 1315; therefore, the possession asserted by the plaintiffs cannot be considered a basis for claiming any possessory right (derecho de posesión) over property in the public domain (bienes de dominio público), whose inherent characteristics include immunity from acquisitive prescription (imprescriptibilidad), inalienability (inalienabilidad), and immunity from seizure (inembargabilidad); appropriation by private parties in any form is therefore impermissible, pursuant to sections 1, 7, and 20 of the Ley sobre la Zona Marítimo Terrestre and sections 13 and 14 of the Ley Forestal.

X.Another important point to highlight is the possession (posesión) exercised by the plaintiffs within the areas in dispute (áreas en litis). It should be clarified that, although the preceding recitals stated that, because of the nature of the properties in conflict, they are not susceptible to appropriation and that the possession exercised over them is not valid for claiming any right over those areas, the following analysis is undertaken to establish that, notwithstanding the foregoing, the plaintiffs also failed to prove during the proceedings continuous possession consistent with the inherent nature of the properties. In the complaint, they assert that they continuously performed acts of care and maintenance, clearing, fence construction, planting, and improvements in general, and that they complied with the legal regime governing a protection or restricted-use zone (see complaint at folio 41).

In her answers during the examination of a party (prueba confesional), Ms. [Nombre2] stated that she had walked that land with her husband, gathering coconuts to take home and subsequently sell. She added that her husband hired laborers to clear the land in conflict, from the “crique” to the end (see testimony at folios 1356, 1358 and 1359). For his part, Mr. [Nombre1] stated in his testimony that he had exercised acts of possession in the areas in dispute, but without specifying what those acts entailed (see testimony at folio 1361). The witness evidence (prueba testimonial) shows that two of the witnesses stated that the plaintiffs had made use of the land by gathering coconuts to sell them (see testimony of [Nombre6] and [Nombre7] at folios 1383 and 1387), without providing further details concerning that use. The latter witness added that, when he gave his testimony, in mayo del 2008, they were not selling him coconuts; he could not recall the exact date of the last sale and was currently unaware of the condition of the land (see testimony at folio 1387).

For his part, the third witness, [Nombre17], stated with respect to the land that it had boundaries marked by a hibiscus hedge and a barbed-wire fence along two of its sides, except along the Crique side; the front portion had a hibiscus hedge and two sides had barbed-wire fences, while the remainder of the property was not fenced; there were no structures, and the land was forested (see testimony at folio 1385). In addition, as properly stated in the background, in the summary possessory proceeding (proceso interdictal) brought by [Nombre1] and [Nombre2] against Synapsis SociedadAnónima, the first-instance judgment (sentencia de primera instancia) number 48-96 of dieciséis horas del veintiuno de mayo de 1996 found that the plaintiffs’ acts of possession consisted solely of clearing the land and harvesting the coconuts growing there and, on that basis, granted the complaint (see decision at folios 16 to 24).

Some time later, in the summary possessory proceeding brought by Sociedad Synapsis against [Nombre1] and [Nombre2], first-instance judgment number 03-99 of quince horas del catorce de enero de 1999 established that the defendants had erected a fence and dumped waste on the claimed land; the summary possessory complaint was therefore granted (see decision at folios 8 to 13). The foregoing demonstrates that the acts carried out on the property in dispute were inconsistent with the nature of the land, since the judicial inspections (reconocimientos judiciales) established that it is an area with abundant, extremely dense vegetation that even makes access to the land difficult, and that these are also extremely wet areas of land. It is therefore evident that, by its nature, the land is intended not for exploitation but for conservation, particularly since the existence of the coconuts was never verified, much less their existence in quantities sufficient for commercial sale.

As for the clearing of paths and construction of fences undertaken on the land, these activities not only run contrary to the purposes and nature of the properties, thereby impairing the free movement of the wildlife present there, but are also expressly prohibited by the legislation in force, namely Article 12 of the Ley sobre la Zona Marítimo Terrestre and Article 58 of the Ley Forestal.

XI.Upon analyzing the remaining grounds of appeal (agravios) raised by counsel for co-defendant Synapsis Sociedad Anónima, it is evident that they are unfounded for the reasons set out below. First, the appellants contend that the overlap (traslape) was based solely on an expert report (informe pericial), which is confusing because the areas were described by sections without reference to clear measurements, while other reports entered into the record, which show that the plaintiffs’ survey plan contains errors, were disregarded. The existence of the overlap was established not only by the expert report of engineer [Nombre8], but also by the remaining technical evidence entered into the proceedings, including the expert report prepared by engineer Ervin Adolfo Álvarez Fuentes in his capacity as an expert for the Poder Judicial, appearing at folios 1246 to 1252. That report not only confirms the overlap between the plaintiffs’ and defendants’ plans and likewise confirms the incorrect location reported in both plans, but also expressly states that engineer [Nombre8]’s report conforms to the actual conditions.

For its part, the report issued by the Dirección de Catastro Nacional also confirmed the existence of problems concerning both parties’ plans and even demonstrated additional overlap problems involving other registered survey plans (planos catastrados) (see report at folio 1410). It is therefore concluded that both plan L-10985-74 and plan L-94656-93 contain serious location and information errors; notwithstanding those errors, the existence of the overlap was established, and it coincides with the area claimed in these proceedings. The second contention is that the judgment orders the eviction (desalojo) of the area described in plan L-10985-1974, as well as section A identified in the expert report, thereby constituting an ultra petita defect (vicio de ultrapetita), because that area was never described or requested by the plaintiffs. Although this point is not material in light of the arguments set out in the preceding recitals and the manner in which the case is decided, it should be clarified that, from the outset of the proceedings, the plaintiffs clearly claimed not only the area described in plan L-10985-1974, but also the land adjoining that plan at [Dirección13], as shown both in the allegations of fact in the complaint and in the relief sought, appearing at folios 42 and 52.

The third ground of appeal was addressed in the analysis provided in the preceding recitals of this decision, which examined how the plaintiffs acquired the properties and the possession they exercised. The claims concerning the failure to assess the evidence submitted by co-defendant Synapsis to demonstrate its actual exercise of possession are immaterial in view of all the legal arguments set out in this decision and because that co-defendant did not file a counterclaim (contrademanda) upon which it could base any claim of its own. Analysis of the fourth ground of appeal is likewise immaterial given the manner in which the case is decided.

XII.In this case, it must be clear that none of the co-defendants filed any counterclaim against the plaintiffs herein: neither the Procuraduría General de la República nor Synapsis and Corporación Vida Verde Marina. This accounts for the annulment ordered by the Sala Primera with respect to decision N° 989-F-13 issued by this Tribunal at catorce horas y treinta y cuatro minutos del veintiuno de octubre de dos mil trece, which provided: “...On the Court’s own motion, registered survey plans numbers L-10985-1974 and L-94656-1993 are declared void. Once this decision becomes final, the court below (a quo) shall send the corresponding official communications to the Subdirección Catastral del Registro Nacional Inmobiliario so that the registrations of the cited plans may be canceled. Consequently, both the plaintiffs, [Nombre1] and [Nombre2], and co-defendant Synapsis Sociedad Anónima are ordered to proceed with the immediate eviction from the area in conflict, which comprises the area described in registered survey plan L-10985-1974 and the sector adjoining the cited plan to the east and south, described as section A in the expert report appearing at folios 480 to 490.

In addition, within quince días hábiles from the date this decision becomes final, co-defendant Synapsis Sociedad Anónima shall remove the existing fence from the property in dispute, after which the State may dispose of the area in conflict in accordance with its nature and condition....” In accordance with the foregoing, the motions for annulment (reclamos de nulidad) filed by both appellants are denied. As to the merits, because co-defendant Synapsis Sociedad Anónima and El Estado are correct in their grounds of appeal concerning the nature of the areas of land claimed, judgment 42-2012 of trece horas y catorce minutos del veintitrés de julio del dos mil doce is partially reversed insofar as it rejected the defense of lack of legal entitlement (excepción de falta de derecho) raised by the defendants and partially granted the complaint filed by [Nombre1] and [Nombre2] against Synapsis and Corporación Vida Verde Marina, granting claims one, two, three, four and five. Instead, the defense of lack of legal entitlement raised by the defendants is sustained, and the complaint is dismissed in its entirety. In all other respects, the judgment is affirmed.

POR TANTO:

The annulment sought in both appeals is denied. Judgment forty-two–two thousand twelve of trece horas y catorce minutos del veintitrés de julio del dos mil doce is partially reversed insofar as it rejected the defense of lack of legal entitlement raised by the co-defendants and partially granted the complaint filed by [Nombre1] and [Nombre2] against Synapsis and Corporación Vida Verde Marina, granting claims one, two, three, four and five. Instead, the defense of lack of legal entitlement raised by the co-defendants is sustained, and the complaint is dismissed in its entirety. As to all other matters challenged on appeal, the decision under review is affirmed.

VOTO N° 0017-F-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diez horas y veintinueve minutos del veinticuatro de enero de dos mil dieciocho.- PROCESO ORDINARIO establecido por [Nombre1] mayor, casado,agricultor, vecino de Manzanillo, Limón, cédula de residencia número CED1 - - ; [Nombre2] , mayor, casada, vecina de Manzanillo, Limón, cédula de identidad CED2 - - ; contra SYNAPSIS SOCIEDAD ANÓNIMA, representada por [Nombre3] , mayor, divorciado, empresario, vecino de San José de nacionalidad Italiana, cédula de residencia número CED3 , en su condición de apoderado generalísimo sin límite de suma; CORPORACIÓN VIDA VERDE Y MARINA, representada por su curadora [Nombre4] , de calidades desconocidas en autos; y EL ESTADO , representado por la PROCURADURÍA GENERAL DE LA REPÚBLICA, por medio de la licenciada Gloria Solano Martínez, de calidades desconocidas en autos. Intervienenel licenciado Carlos Rodríguez Rescia, mayor, abogado, vecino de Limón, con cédula CED4 - - , colegiado número dos mil seiscientos cuarenta y siete, en su condición de apoderado especial judicial de los actores; la licenciada Sonia Saborio Flores , mayor, casado una vez, vecina de San José, con cédula de identidad CED5 - - , colegiada número cinco mil, en su condición de apoderada especial judicial de la demandada Synapsis Sociedad Anónima. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, Limón.

RESULTANDO:

  1. 1La parte actora plantea proceso ordinario para que en sentencia se declare: "Con lugar la presente demanda de reivindicación de propiedad; que se declare legitimo derecho de posesión de los demandantes, tanto de los terrenos que se ubican dentro de la zona marítimo terrestre, como del área privada, circunscrita en el plano catastrado L-10985-74, que se ordene la restitución de los terrenos indicados en los hechos de la demanda con su correspondiente medida y linderos y que los demandados sean desalojados de la parte del terreno que les corresponde, así mismo que se ordena al MINAE que consigne a favor de los demandantes, los derechos y otorgamiento de permisos que en derecho corresponden conforme al PLAN DE MANEJO y la legislación que regula la materia. SEGUNDO. QUE SE DECRETE LA NULIDAD DE LOS PLANOS L-94656-93 y L-94613-93 por no corresponder a la realidad topográfica ni ideológica en su contenido y violatorios de los derechos de posesión y propiedad de los suscritos, tal y como se acredita en esta litis, por lo que en consecuencia, la nulidad absoluta decretada se extienda a las escrituras NUMEROS TRECE ANTE EL NOTARIO FERNANDO TREJOS ZÚÑIGA y [Nombre5] , donde adquiere SYNAPSIS SA, bajo el tomo undécimo primero del protocolo de dicho notario, visible a folio doce frente, cuya fundamentación de NULIDAD ABSOLUTA estriba en la adquisición de mala fe de los demandados, alteración de datos y colindancias, así como el pago de daños y perjuicios ocasionadas a la parte demandada y ambas costas de esta acción".CONTRA CORPORACIÓN VIDA VERDE: "1-Decretar los derechos de posesión a favor de los suscritos, bajo el área y linderos que fehacientemente se indicaron en esta demanda, tanto los terrenos que se ubican dentro de la zona marítimo terrestre como el área privada prevista en el plano L-10985-74. 2- Que se ordene la restitución de los terrenos indicados en los hechos de la demanda, que como lógica consecuencia de lo anterior, se ordene el desalojo de los ocupantes de estos terrenos. 3- Que se ordene al MINAE, la dependencia cuya competencia corresponden la definición de la administración de los terrenos, el otorgamiento definitivo de los permisos administrativos y demás autorizaciones conforme PLAN DE MANEJO que regula esta materia. 4- QUE SE DECRETE LA NULIDAD DE los planos L-94656-93 y L-94613-93 por no corresponder a la realidad topográfica ni ideológica en su contenido y violatorios de los derechos de posesión y propiedad de los suscritos, por lo que LA NULIDAD ABSOLUTA se extienda jurídicamente a las escrituras numeros 13 ante el NOTARIO FERNANDO TREJOS ZÚÑIGA y MINOR GÓMEZ CALVO, que es el instrumento público donde adquiere la empresa SYNAPSIS SA, bajo el undécimo primer tomo de dicho NOTARIO, visible a folio doce frente cuya fundamentación de NULIDAD ABSOLUTA estriba en la adquisición por medio de lo que en doctrina y jurisprudencia civil se denomina FRAUDE PROCESAL y VICIOS OCULTOS, esto es, que el negocio jurídico desde su génesis hasta el fenecimiento de esta litis, es y fue concebido con el ánimo de despojarnos de los terrenos contemplados en este proceso judicial, pues la alteración de datos en cuanto a nombres de colindantes, áreas y demás aspectos técnico-registrales, evidencian la mala fe y configuración del dolo que es vital que la ADMINISTRACIÓN DE JUSTICIA determine en el momento procesal que corresponde. 5- Que se condene a ambas empresas SYNAPSIS Y CORPORACIÓN VIDA VERDE MARINASA, al pago DE DAÑOS Y PERJUICIOS que se liquidarán en sentencia conforme al merito de los autos, comprendiendo el pago de intereses los cuales se liquidarán desde el inicio de los hechos que dieron origen a esta demanda hasta un efectivo pago, y cuya fijación será conforme la tasa de interés fijada en los depósitos a plazo por el BANCO NACIONALy que es la que se aplica en materia judicial y procesos contenciosos administrativos.Este extremo debe de ser de aplicación para ambas empresas demandadas y que se realiza para que sean debidamente notificadas toda de conformidad con LA AMPLIACIÓN que exige el numeral 106 y de que el despacho resolvió que aún no esta trabada la litis. 6. Asimismo, QUE SE CONDENE AL PAGO DE AMBAS COSTAS DE ESTA ACCIÓN". CONTRA PROCURADURÍA GENERAL DE LA REPÚBLICA: "1. Solicito que sea declarada con lugar la presente demanda, que una vez determinado pericialmente el traslape, se ordene la reivindicación del terreno despojado. 2. Que se declare, ÚNICO Y REAL PROPIETARIOS a los suscritos, conforme la realidad no sólo topográfica sino la verdad real contemplada en el plano catastrado número L-10985-74, ordenándose la restitución de los terceros despojados. 3. Que se ordene a los demandados el inmediato desalojo de los terceros invadidos conforme la sentencia que en derecho corresponde. 4. Que se ordene al ESTADO, representado por la PROCURADURÍA GENERAL DE LA REPÚBLICA, que consigne a favor de los suscritos todos los derechos, permisos y demás garantías constitucionales y ambientales conforme el derecho vigente en esta materia, que se ordene asimismo, un registro de titularidad para ser contemplado dentro del PLAN DE MANEJO.5.Que se decrete la NULIDAD ABSOLUTA del plano catastrado número L- 94656-93 y 94 613, que corresponde a la finca inscrita en el registro público, PARTIDO DE Limón, SISTEMA DE FOLIO REAL MATRICULA NUMERO 57226 000 a nombre de SYNAPSIS SA Y CORPORACIÓN VIDA VERDE MARINA SA, por no corresponder a la realidad topográfica ni ideológica, en parte o la que pericialmente sea determinada. 6. Que se decrete la NULIDAD ABSOLUTA de la escritura número 13 ante el NOTARIO FERNANDO TREJOS ZÚÑIGA Y MINOR GÓMEZ CALVO, que es donde adquiere SYNAPSIS SA, bajo el tomo undécimo primero del protocolo de dicho notario, visible a folio doce frente cuya fundamentación de nulidad absoluta estriba en la adquisición de mala fe de los demandados, alteración de datos como falsos colindantes, áreas que no corresponden al transmisor anterior. Que conforme las normas registrales vigentes, se proceda a la debida corrección de medida, linderos y situación del plano de lo suscritos para estar a derecho ante el REGISTRO PUBLICO DE LA PROPIEDAD ordenando el mandamiento correspondiente.7.Que se condene al pago de daños y perjuicios, e intereses de conformidad con el interés de la tasa pasiva del sistema bancario nacional hasta su efectiva cancelación. 8. Que se condenen al pago de ambas costas de esta acción. Los daños y perjuicios, los detalló la parte actora de la siguiente manera: DAÑOS Y PERJUICIOS. ESTE RUBRO, reiteramos, es producto y consisten de la génesis de una relación contractual, ilegal y contraria a derecho, en la cual ambas empresas demandadas hicieron incurrir a los suscritos en serios y profundos daños que han generado la erogación de gastos cuantiosos donde los DAÑOS consisten en que, en el sublitem, estamos en presencia de una discusión patrimonial que los demandados, en forma dolosa" han edificado toda forma sistemática infraestructura legal no idónea sino falseando la verdadhistórica" y con la invasión o apropiación irregular de un sector del inmueble el cual forma parte de la esfera patrimonial ,en la parte privada, de los suscritos.DAÑOS. Consisten, pues, los daños en que estas acciones dolosas han traído como lógica consecuencia al habernos desprovisto de los derechos inherentes al usufructo del inmueble, que han provocado un colapso a nivel administrativo ante el MINAE, toda vez que el traslape en las medidas y linderos como se indicó en el libelo de presentación de la demanda, incide en la confección de planos y datos histórico.-registrales ante el CATASTRO, el cual fue inducido a error por los demandados. DEFENSA ADMINISTRATIVA ANTE EL COMITÉ ZONAL Y MINISTERIO DE ENERGÍA Y MINAS. Hay que indicar al señor JUEZ que estas erogaciones consisten en los gastos de transporte MANZANILLO-SANJOSÉ, durante más de diez años que llevamos litigando,alimentación, pago de hospedaje tanto en la ciudad de LIMON COMO SAN JOSÉ, conferenciaS y audiencias en el COMITÉ ZONAL Y EN LAS OFICINAS CENTRALES EN SAN JOSÉ, pago de viáticos, honorarios de abogado en dicha defensa y los que se vayan a liquidar en este proceso conforme el mérito de los actos.EROGACIONES Y GASTOS JUDICIALES DE PROCESOS ANTERIORES. Podemos acreditar en autos, que los daños y perjuicios se han originado tanto por la acción de invasión original como por las acciones judiciales y la interposición de dos juicios interdictales que constan en la prueba documental ofrecida en el legajo respectivo, por ello, es menester circunscribirlos como daños ocasionados por las empresas demandadas y que deben ser parte de la indemnización que se presenta ante este estado. El juzgador podrá tener estas piezas como fundamento para la respectiva liquidación de daños y perjuicios pues nos hemos visto en la necesidad de recurrir a la ADMINISTRACIÓN DE JUSTICIA para evitar los atropellos de las empresas indicadas supra los daños se dimensionan también en el sentido que consisten en que hay obstrucción en el ingreso al inmueble objeto de cuestionamiento judicial hay imposibilidad de colocar rótulos o cercas, trabajos de limpieza.ESTIMACIÓN DE DAÑOS. Con las consideraciones y probanzas se estima en la suma de CIEN MIL DOLARES. PERJUICIOS. Con las acciones descritas en la relación de hechos, fundamento legal y ahora en las especificaciones y liquidaciones referidas, consideramos que los PERJUICiOS son a todas luces cuantiosos y consisten en la inmovilización del inmueble pues este ordinario ha provocado que se tenga la existencia de un lucro cesante pues no podemos presentar las peticiones ante el MINAE Y COMITÉ ZONAL para poner a derechos los aspectos de tramitación de escritura en la parte privada y evidentemente implica este lucro cesante que la la libre disponibilidad del inmueble está paralizada con respecto a eventual ejercicio del derecho comercial o civil en materia de transacciones con terceras personas. Que para este extremo se considere y condene en sentencia al pago de los intereses de la TASA PASIVA que fija el BANCO CENTRAL DE COSTA RICA PARA DEPÓSITOS A PLAZO que corren desde que dio inicio la perturbación e invasión de los demandados,hasta el día en que esté firme la sentencia, los cuales estimamos en la suma de CIENTO CINCUENTA MIL DÓLARES.DAÑO MORAL. Nos apegamos a lo que la jurisprudencia civil y doctrina han determinado en materia de DAÑO MORAL , bajo el concepto estricto que implica una afectación en la psiquis de la persona ofendida pues hay un evento traumático que emocionalmente produce una lesión en su temor de una eventual pérdida de un bien material o de orden moral cuya estimación es pericialmente viable mediante el criterio discrecional del señor JUEZ el cual será fundamentado con criterio científico cuando decida este aspecto. Pero en forma prudencial lo estimamos en cincuenta mil dólares " (folios 40 a 53, 174 a 175 , 189 A 192, 541 A 543).-
  2. 2La entidad Synapsis Sociedad Anónima contestó la demanda y opuso las excepciones de falta de derecho, falta de causa, falta de legitimación ad causam pasiva y activa, y la genérica de sine actione agit visible a folio 135 a 147. La Corporación Vida Verde Marina Sociedad Anónima, contestó negativamente la demanda incoada en su contra opuso las excepciones de falta de derecho, falta de causa, falta de legitimación, la genérica de sine actione agit, caducidad y prescripción visible a folios 370 a 379.- La Procuraduría General de la República contesto a folios 1100 a 1104 opuso las excepciones de falta de derecho, falta de agotamiento de la vía administrativa e incompetencia en razón de la materia.
  3. 3El licenciado Edgar Calvo Solano, juez de primera instancia, en sentencia 42-2012, de las trece horas y catorce minutos del veintitrés de julio del año dos mil doce, resolvió: "POR TANTO: En relación con la demanda contra Synapsis y Corporación Vida Verde Marina: Se rechaza la excepción de prescripción opuesta. Se rechazan las excepciones de falta de derecho, falta de causa, falta de legitimación ad causam pasiva y activa, y la genérica de sine actione agit opuestas por ambas sociedades codemandadas. Se rechaza la excepción de caducidad opuesta por Corporación Vida Verde Marina. En consecuencia se declara parcialmente con lugar la demanda incoada por [Nombre1] y [Nombre2] contra Synapsis y Corporación Vida Verde Marina. Se declara con lugar de la siguiente manera, entendiéndose denegada en todo aquello que no se indique : 1./ Se declara que los actores [Nombre2] y [Nombre1] tienen un mejor derecho de posesión tanto de los terrenos que se ubican dentro de la zona marítimo terrestre, como dentro del área circunscrita en el plano catastrado L-10985-74; 2./ Una vez firme esta sentencia se ordena restituir y poner en posesión real y efectiva de los terrenos indicados en los hechos de la demanda con su correspondiente medida y linderos; 3./ Se ordena a Synapsis el desajolo del área de terreno que sea parte del plano catastrado L-10985-1974,según la ubicación que se le dio en el informe pericial de folios 480 a 490.De igualmente se le ordena el desalojo del área en litis que en la pericial de folios 480 a 490, se demarca como sección A, y que se encuentra fuera del área descrita dentro del plano L-10985-1974.Deberá de desalojar en un plazo de quince días a partir de que la presente sentencia adquiera firmeza. Con la advertencia de que no hacerlo podrán ser desalojados por medio de la fuerza pública y acusados de desacato a la autoridad; 4./ Se declara nulo el plano catastrado L-94656-93. Envíese el o los oficios necesarios ante Catastro Nacional a efecto de que se anule el plano catastrado indicado; 5./ Se condena a las sociedades a pagar de manera solidaria los daños y perjuicios causados los cuales se liquidarán en ejecución de sentencia, de igual manera se les condena al pago de ambos costas de esta acción. Se rechaza la pretensión en cuanto a que el Ministerio del Ambiente Energía y Comunicaciones les otorgue los permisos de aprovechamiento en la zona marítimo terrestre pues dichos permisos deberán solicitarse por los medios correspondientes.Se rechaza la nulidad de la escritura número trece otorgada ante el co-notario Fernando Trejos Zúñiga, el 9 de agosto de 1993, y mediante la cual la codemandada Corporación Vida Verde vendió a Synapsis Sociedad Anónima, la finca del Partido de Limón, inscrita en el Registro Nacional número CED6. Tal y como se señaló anteriormente se rechazan todas las demás petitorias contra Synapsis y Corporación Vida Verde Marina. En relación contra la demanda planteada contra el Estado: Se acoge la excepción de falta de derecho opuesta por la Procuraduría General de la República en representación del Estado. No habiendo los actores demostrado su legitimación activa ni la pasiva del Estado para ser demandado se declara sin lugar en todos sus extremos petitorios la presente demanda incoada por [Nombre1] y [Nombre2] contra el Estado. Se falla esta demanda contra el Estado sin especial condenatoria en costas contra los actores (folio 1678 a 1679).
  4. 4La licenciada Sonia María Saborío en su condición de apoderada especial judicial del Synapsis S.A, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia (folio 1695 a 1699). La licenciada Gloria Solano, en su condición de representante, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia (folio 1708 a 1715).
  5. 5Este Tribunal mediante Voto N° 989-F-13, dictado a las catorce horas y treinta y cuatro minutos del veintiuno de octubre de dos mil trece, resolvió: "

POR TANTO: Se rechaza la nulidad. Se revoca parcialmente la sentencia cuarenta y dos-dos mil doce de las trece horas y catorce minutos del veintitrés de julio del dos mil doce, en cuanto rechazó la excepción de falta de derecho opuesta por la parte demandada y declaró parcialmente con lugar la demanda interpuesta por [Nombre1] y [Nombre2] contra Synapsis y Corporación Vida Verde Marina; acogiendo las pretensiones uno, dos, tres, cuatro y cinco. En su lugar; se acoge la excepción de falta de derecho opuesta por la parte demandada, declarando sin lugar la demanda. De oficio, se declara la nulidad de los planos catastrados números L-10985-1974 y L-94656-1993. Una vez firme la presente resolución, proceda el a quo a enviar los oficios correspondientes a la Subdirección Catastral del Registro Nacional Inmobiliario para que procedan a anular las inscripciones de los planos citados. En consecuencia, se ordena tanto a los actores [Nombre1] y [Nombre2] como a la codemandada Synapsis Sociedad Anónima proceder al desalojo inmediato del área en conflicto que comprende el área descrita en el plano catastrado L-10985-1974 y el sector colindante este y [Dirección1] del plano citado, descrita en el informe pericial visible a folios 480 al 490 como sección A y además, deberá la codemandada Synapsis Sociedad Anónima, en el plazo de quince días hábiles a partir de la firmeza de la presente resolución, realizar la remoción de la cerca existente en el inmueble en litis, para que posterior a ello, el Estado pueda disponer del área en conflicto, conforme a su naturaleza y condición. En los demás extremos objeto de apelación, se confirma la resolución recurrida".

  1. 6La Sala Primera de la Corte Suprema de Justicia mediante Voto N° 001217-F-Sl-2015 de las 14:05 horas del 21 de octubre de 2015, declaró con lugar un recurso de casación planteado contra el voto dictado por este Tribunal y resolvió: "Se declara con lugar el recurso. Se anula la resolución recurrida. Se ordena su reenvío al Tribunal para que proceda como corresponda, acorde a su derecho." (ver sentencia a folios 1764 a1774).
  2. 7En la substanciación del proceso se han observado las prescripciones legales y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.

Redacta el Juez Darcia Carranza, y,

CONSIDERANDO:

I. HECHOS PROBADOS

Este Tribunal comparte lo dispuesto en relación con los hechos probados por tener buen sustento en los autos; excepto por los numerados 6, 14, 15 y 20 por no ser relevantes para resolver el proceso y los números 12 y 16 por ser hechos que no se encuentran conformes con los elementos probatorios que constan en autos. Además, para resolver en esta instancia se tienen los siguientes: 21.- El área en conflicto comprende el camino frente a la playa al este, el camino y cerca con alambre de postes de concreto hacia siete metros después del árbol de Higuerón y de ahí siguiendo la única planta de caña india al norte atravesando los dos árboles con trozos de alambre viejo incrustados hacia salir a la orilla del estero (ver informe pericial a folios 467 al 479, reconocimiento judicial a folios 1369 al 1374 y ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013). 22.- La posesión de los actores en el inmueble descrito en el plano catastrado L-10985-1974 fue únicamente de recolección de cocos y limpieza terreno (ver resolución a folios 16 al 24, declaraciones confesionales de [Nombre1] y [Nombre2] a folios 1356, 1358 y 1359 y declaraciones testimoniales de [Nombre6] y [Nombre7] a folios 1383 a 1387). 23.- Los planos catastrados números L-10985-1974 y L-94656-1993 tienen errores de levantamiento y gráficos (ver informes periciales a folios 467 al 479, 504 al 506, 587 al 591, 1246 al 1252 y 1300 al 1302). 24.- El plano L-10985-1974, que grafica el terreno que reclaman los actores como suyo, se encuentra totalmente inmerso dentro del área que comprende la Zona Marítimo Terrestre (ver informes periciales a folios 467 al 479, 1246 al 1252, 1300 al 1302, informe Dirección Catastro a folios 1410 al 1414, reconocimiento judicial a folios 1369 al 1374 y ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013, pretensión de la demanda a folio 52). 25.- Dentro de las áreas descritas en los planos L-10985-1974 y L94656-1993 se ubican varios mojones que demarcan la zona pública de la zona marítimo terrestre (ver informe pericial a folios 1300 al 1302, prueba confesional de [Nombre1] y [Nombre2] a folios 1359 y 1366, reconocimiento judicial a folios 1369 al 1374 y ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013). 26.- El plano L-10985-1974 abarca un área de 900 metros cuadrados de zona pública y el resto se encuentra dentro de la zona restringida que conforman la zona marítimo terrestre.

(ver informes periciales a folios 1300 al 1315, 1315 al 11318, reconocimiento judicial a folios 1369 al 1374 y ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013). 27.- El área señalada en reconocimientos judiciales como quebrada y colindante con área conflicto está declarada como estero por el Instituto Geográfico Nacional (ver informe pericial a folios 1315). 28.- Los actores [Nombre1] y [Nombre2] tenían pleno conocimiento de que las áreas de terreno objeto de este proceso se encontraban dentro de la zona marítimo terrestre y son parte del Refugio de Vida Silvestre Gandoca-Manzanillo (ver escrito de demanda a folio 52, prueba confesional de [Nombre1] y [Nombre2] a folios 1359 y 1366, y pretensiones de la demanda a folio 52). 29.- La naturaleza de los terrenos reclamados es de cobertura boscosa, con vegetación muy densa, suelos húmedos y arenosos, con variedad de plantas de yolillo y sangrillo (ver reconocimientos judiciales a folios 1369 al 1374 y ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013).

II. HECHOS NO PROBADOS

De igual forma, se prohijan los hechos no probados, por ser aspectos que no fueron acreditados en autos. Además, para resolver en esta instancia se tienen los siguientes: 5.- Los actores [Nombre1] y [Nombre2] no demostraron el hilo conductor de traspaso de la posesión ejercida sobre las áreas de terreno objeto del presente proceso ni la fecha exacta de inicio de dicha posesión. 6.- Los actores no demostraron el ejercicio de una posesión conforme con la naturaleza de los terrenos.

III. El licenciado Edgar Calvo Solano, juez del Juzgado Agrario del Primer Circuito

Judicial de la Zona Atlántica, Limón en sentencia número 42-2012 dictada a las trece horas catorce minutos del veintitrés de julio del dos mil doce, en relación con la demanda contra Synapsis y Corporación Vida Verde Marina se rechaza la excepción de prescripción, falta de derecho, falta de causa, falta de legitimación activa y pasiva y la genérica sine actione agit opuestas por las sociedades codemandadas. Se rechaza la excepción de caducidad opuesta por Corporación Vida Verde Marina. En consecuencia, se declara parcialmente con lugar la demanda y en relación con la demanda planteada contra el Estado, se acoge la excepción de falta de derecho opuesta por la Procuraduría General de la República en representación del Estado y no habiendo los actores demostrado la legitimación activa ni la pasiva del Estado para ser demandado se declara sin lugar en todos sus extremos la demanda contra éste. Se falla esta demanda incoada contra el Estado sin especial condenatoria en costas contra los actores.

IV. RECURSO DE APELACIÓN DEL ESTADO

La licenciada Gloria Solano Martínez, en su condición de representante de la parte estatal presentó recurso de apelación exponiendo lo siguiente: MOTIVO DE NULIDAD: La sentencia en el considerando octavo sobre el fondo del asunto y excepciones no analiza ninguna de las excepciones opuestas, por lo que es imposible saber las razones y los fundamentos que motivan lo resuelto en la parte dispositiva de la sentencia. En ese sentido, existe una contradicción en la sentencia, pues por un lado acoge nuestra defensa de falta de derecho, pero a la vez le reconoce a los actores, derechos sobre un bien público estatal, que en principio estaría siendo reconocido y protegido al declarar sin lugar la demanda respecto al Estado. No obstante, como la resolución no analiza la excepción de fondo del Estado, hay dificultad para alzarse en forma adecuada contra los motivos del juzgador, porque precisamente, se desconoce cuáles son los argumentos que sirven de base al pronunciamiento.

En relación con los agravios de fondo, se expuso: El interés que tiene el Estado para apelar se fundamenta en que la demanda fue declarada parcialmente con lugar, y en ese tanto, otorga derechos a favor de los actores, sobre terrenos que son propiedad pública estatal, lo cual perjudica los intereses de su representado, y contraría leyes y sentencias vinculantes que expresamente lo prohíben. Esto es así, a pesar de que en la parte dispositiva de la sentencia, se acoge la excepción de falta de derecho opuesta al contestar la demanda. La sentencia vulnera normas sustantivas porque declara derechos sobre un terreno que es propiedad del Estado y que forma parte de un refugio nacional de vida silvestre. La sentencia dictada incurre en la violación directa de ley por falta de aplicación artículos 261, 262 y 285 del Código Civil, 13 y 14 de la Ley Forestal; 32 y 40 de la Ley Orgánica del Ambiente; 58 de la Ley de Biodiversidad y de las leyes que desde 1828 dotaron de protección demanial a la franja ubicada a lo largo de las costas.

Ello en cuanto otorga derechos a favor de los actores, contraviniendo normas legales que expresamente prohíben que los bienes de dominio público e integrantes del Patrimonio Natural del Estados, ean objeto de posesión por parte de particulares. Al respecto, hay que tener claro que lo que operó sobre la franja demanial de zona marítimo terrestre que aquí nos ocupa, fue un cambio administrativo del área, con sujeción a nuevos fines públicos, pero su naturaleza sigue siendo demanial. Continua manifestando, conforme al artículo 73 de la Ley 6043 están excluidas de su aplicación, las reservas equivalentes; noción que engloba todas las áreas silvestres protegidas estatales, supeditadas a planes de manejo que aseguren la adecuada protección, conservación y uso racional de los recursos naturales para un desarrollo sostenible. Se trata de regímenes excluyentes entre la zona marítimo terrestre ordinaria de la Ley 6043, y las categorías que conforman el Patrimonio Natural del Estado, en vista de las disímiles finalidades a alcanzar con la afectación de las áreas silvestres estatales y los criterios que requiere su administración.

Aún así, antes de su incorporación al Refugio, la franja en la que se ubican los terrenos en disputa estaban tutelados por el régimen demanial de la zona costera que se remonta a la Ley número 162 del 28 de junio de 1828 que dotó de protección a la franja de [Dirección2] a lo largo de las costas, y cuya tutela fue mantenida y reafirmada por el Código General de 1841, que en su artículo 296 indicó que ��el flujo y reflujo del mar, sus riveras, los puertos, las ensenadas, radas y generalmente todas las porciones del territorio del Estado, que no son susceptibles de una propiedad privada, se considerarán como pertenecientes al dominio público". Luego se promulgó la Ley número 39 del 31 de agosto de 1886, que prohibió ��denunciar tierras baldías comprendidas en una zona de dos mil varas de latitud, a lo largo de las costas de ambos mares��y la Ley de Aguas número 11 del 26 de mayo de 1884, que declaró en su artículo 20 que ��es del dominio público la zona marítimo-terrestre ó el espacio de las costas de la República que baña el mar en su flujo y reflujo y los terrenos inmediatos hasta la distancia de una milla".

Posteriormente se dictaron las leyes número 19 de 12 de noviembre de 1942 y número 201 de 26 de enero de 1943 (que a pesar de reducir la zona a doscientos metros) que preservaron su condición demanial, naturaleza que se mantiene en la actual Ley sobre la Zona Marítimo Terrestre. Aunado a lo expuesto, la sentencia incurre en la violación directa de ley por indebida aplicación del decreto Nº 16614-MAG del 1º de julio de 1985, en el que el poder ejecutivo en ejercicio de las potestades constitucionales y legales de la Ley Forestal N° 4465 del 25 de noviembre de 1969 y artículo 18 de la Ley de Conservación de la Fauna Silvestre creó el Refugio Nacional de Vida Silvestre Gandoca Manzanillo. Acto en el que dispuso la declaratoria e inclusión de los terrenos de propiedad estatal, que aquí se disputan, en dicha área silvestre protegida, en consideración a los recursos naturales y al hecho de incluir una de las pocas playas de anidación en el mundo de la tortuga Baula.

Lo anterior, en cuanto reconoce derechos sobre los terrenos descritos en el plano L-10985-74, el cual que tiene consignada la leyenda "para arriendo", a pesar de que hay en el expediente judicial, prueba contundente respecto a la naturaleza demanial del área objeto de este litigio. Por un lado, en el acta de reconocimiento judicial (folios 1367 al 1372), se indica que el terreno en disputa se encuentra ubicado dentro del espacio estatal afecto al régimen demanial, que además forma parte del Refugio Nacional de Vida Silvestre Gandoca Manzanillo, y abarca tanto parte de la zona pública (franja de cincuenta metros de ancho a contar de la pleamar ordinaria, y las áreas que quedan al descubierto durante la marea baja) como de la restringida (restantes ciento cincuenta metros). También está el montaje realizado por el Catastro Nacional que reafirma la condición de terreno. Precisamente por tratarse de terrenos propiedad del Estado e integrantes del Patrimonio Natural del Estado, ningún derecho puede ser reconocido a favor de las partes intervinientes en el presente proceso: la inalienabilidad e inembargabilidad son notas jurídicas esenciales, distintivas y definitorias del dominio público, avaladas por el correlativo carácter imprescriptible de las acciones reivindicatorias, la ineficacia de los actos posesorios de particulares y la prohibición de titulaciones por parte de particulares.

El régimen demanial obsta y excluye la apropiación privada de los bienes, los sustrae del tráfico jurídico e impide su posesión por los administrados para afectarlos a sus propios intereses, por lo que existe una imposibilidad jurídica para otorgar derechos a favor de los actores, tal y como lo resuelve la sentencia que se apela.

V. RECURSO DE APELACIÓN DE SYNAPSIS SOCIEDAD ANÓNIMA

La licenciada Sonia María Saborio Flores, apoderada especial judicial de Synapsis Sociedad Anónima presentó recurso de apelación contra la resolución recurrida aduciendo lo siguiente: MOTIVO DE NULIDAD: La sentencia incurre en vicios de incongruencia y de indebida fundamentación y omisión de la prueba; argumentando que al analizar los defectos procesales, señala que su representada indebidamente contestó la ampliación de la demanda argumentando que para ese momento procesal ya se había trabado la litis y agrega a sus antecedentes el escrito de ampliación y contestación de la demanda. Consta en el escrito de ampliación de demanda que la actora en ese acto se refiere a los daños y perjuicios, igual suerte debió correr la ampliación en relación con dichos extremos, pero ha pesar de eso sin fundamentación alguna, el juzgador de instancia se pronuncia dejándolos en un estado de indefensión y lesiona el debido proceso, en virtud de que condena a su representada al pago de daños y perjuicios cuando no existió una petitoria clara y expresa en ese sentido y se parte de una liquidación que consta en el escrito de ampliación de demanda, la cual, fue agregada a sus antecedentes.

En cuanto agravios de fondo expuso los siguientes: 1.- Se declaró la existencia de un traslape entre los planos L-10985-74 y L-94656-93 fundamentándose únicamente en el informe pericial rendido por el ingeniero [Nombre8] , en el que se determina que ese traslape es por un área de 1424.15 metros cuadrados que correspondería a la sección B. Igualmente, señala que el plano L-94656-93 traslapa con un área sin inscribir, lo cual, es confuso porque ninguno de los planos corresponden a áreas inscritas, que se encuentran fuera del plano L-10985-74 y que corresponde a la sección A de la cual no se señala medida. Por otra parte, se indica que su representada tiene cercada un área de 1305.38 metros cuadrados y que se describe como sección C que forma parte del plano L-10985-74; a pesar de que en los autos existen otros elementos probatorios, siendo la sentencia omisa en la valoración de dichas pruebas, careciendo de análisis que permita establecer los hechos tenidos por probados y no probados.

Como ejemplo de ello, afirma no se valora el informe rendido por el ingeniero Juan Araque Skinner, Subdirector del Catastro Nacional. La información contenida en dicho informe es valiosa debido a que determinó una contradicción evidente con la información rendida por el ingeniero Víctor Castro. Tampoco se valoró el informe del ingeniero Jorge Segura Aguilar, contenido en el expediente EXPN1 del Juzgado Civil de Mayor Cuantía de Limón. En ese informe se concluye que no es posible determinar un eventual traslape del plano L-10985-74. Finalmente, tampoco se menciona el informe rendido por el ingeniero [Nombre9] donde si bien menciona un traslape, determina que el mismo es de 3365.60 metros cuadrados, siendo diametralmente opuesto al área indicada por el ingeniero [Nombre8]. Señala, todas esas diferentes se justifican por el hecho de que el plano de los actores tienen severos problemas tanto en ubicación como derrotero, por lo cual, ningún informe pericial podría determinar con claridad sí existe traslape o no. 2.- El juzgador declara que se deberá restituir en la posesión en el área de terreno que sea parte del plano L-10985-1974, según la ubicación que se le dio en el informe pericial, los terrenos indicados en los hechos de la demanda con su respectiva medida y linderos, además se ordena el desalojo de la sección A que indica el informe.

En ese sentido, la sentencia incurre en un vicio de extra petita, debido a que la parte actora nunca definió cuál era esa área que va más allá de la realidad física del plano o de la extensión como antecedente inseparable del plano que ahora identifica el juzgador como sección A. Agrega, no son claros en indicar ni la medida ni los linderos del área que reclama, debido a que sólo se hace referencia al plano L-10985-1974, que ha quedado demostrado tiene defectos técnicos graves; por lo que el juzgador no puede definir la omisión de la parte actora. 3.- Se tuvo por probado el hecho de que los actores han ejercido actos posesorios efectivos y tiene un mejor derecho de posesión sobre el área descrita en el plano L-10985-1974 y la sección A definida en el informe pericial. Al analizarse la adquisición, se señala que el derecho de posesión adquirido por la parte actora fue transmitido por el señor [Nombre10] , ello a pesar de que en el escrito de demanda, los actores señalaron que los poseedores originales fueron los señores [Nombre11] y [Nombre12] , pero no aportaron la prueba idónea de que dichos señores transmitieron la posesión al señor [Nombre10] y en ese sentido, tampoco hay claridad, pues en el plano se menciona el nombre de una sociedad, pero según la prueba testimonial es una persona física.

Además, se tuvo por probado que la adquisición fue en forma verbal, a pesar de que al rendir la prueba confesional la actora [Nombre2] señala que el derecho de posesión se adquirió de la sociedad Brookd Bank Investment y se confeccionó un documento y por otra parte, el señor [Nombre1] al rendir su prueba confesional señala que no existió documento alguno y se lo compró a Jim Brooks Bank; ello sin mencionar que el testigo [Nombre6] manifiesta que el derecho de posesión lo transmitió originalmente su abuelo [Nombre13] y que incluso observó un documento donde se compró el inmueble a Brooksbank. Dicha declaración es confusa y complaciente, siendo extraño que se recuerde con precisión cuando apenas era un niño y además es hijo de la actora. Los únicos actos posesorios observados es la comercialización del coco, que no representa una actividad agraria organizada. Incluso, el testigo [Nombre7] ni siquiera conoce en que estado se encuentra el terreno y que le compraba cocos a los actores.

La prueba testimonial de los actores no logró demostrar que éstos ejercieran un derecho de posesión sobre el inmueble que reclaman, incurre en contradicciones. Por el contrario, no se valoró correctamente la prueba aportada por su representada, la cual, si presenta documentos públicos, planos catastrados y prueba testimonial que comprueban que adquirió los inmuebles que poseen y como si han ejercido actos posesorios agrarios efectivos en dichas propiedades. Se demostró con la prueba documental, que el derecho de posesión sobre el inmueble descrito en el plano L-94656-1993 fue adquirido por escritura pública, que el inmueble descrito en el plano L-94613-93 inscrito al folio real 57226-000 también lo adquirió por escritura pública. 4.- Se le restó valor probatorio al documento privado donde se señala que el señor [Nombre1] es la persona que cuida el inmueble de Synapsis, pues concluye que no sabe leer español.

Para arribar a esa conclusión, valora únicamente la prueba confesional de dicho señor y suposiciones, lo cual, contradice el hecho de que el actor que no sabe leer español aparece firmando el escrito inicial de la demanda y muchas otras gestiones judiciales. No se valora que el señor [Nombre1] en la confesional acepta que firmó ese documento pero no se puede tener por probado que no conociera el contenido del documento. 5.- No se valora que los actores fundamentan su demanda en el hecho de que alegan tener un derecho de posesión en una propiedad que según ellos mismos se encuentra en la zona marítima terrestre y en el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, ese derecho de posesión, según ha resuelto la Sala Constitucional, no existe en los bienes demaniales, los cuales, están fuera del comercio y no pueden ser objeto de posesión, por lo que no puede reconocerles un derecho como lo hace la sentencia apelada.

VI. OBJETO DEL LITIGIO. CASO CONCRETO

Conforme a los hechos probados tenemos que el bien en litigio aquí reclamado dentro de las pretensiones de la parte actora, tiene una afectación doble al dominio público por cuanto forma parte de la zona marítimo terrestre y está inmerso dentro del Refugio Nacional de Vida Silvestre Gandoca Manzanillo. Si bien es entre particulares y el Estado como codemandado; el área de terreno reclamada cuentan con doble afectación como bienes de dominio público. Por un lado, desde tiempos muy antiguos como parte de la zona marítimo terrestre y posteriormente, dentro de los límites del Refugio Nacional de Vida Silvestre, el cual, a su vez, forma parte del Patrimonio Natural del Estado. En este caso, no existe duda de la legislación aplicable para analizar el fondo del asunto, siendo que todo el recuento histórico de la condición de dicha área se realizó en función de resaltar la doble afectación al régimen de dominio público y la fecha de inicio de esa condición.

Lo anterior, con el fin de analizar los agravios expuestos por los recurrentes y el fondo del conflicto. Dentro de la apelación presentada por la representación de Synapsis Sociedad Anónima, como agravio quinto reclaman que no se valoró que los actores fundamentan su demanda en un derecho de posesión que se encuentra en la zona marítimo terrestre y Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, afirmando que no procede tal posesión por dichas condiciones, aspecto que ha sido analizado por la Sala Constitucional. Ese mismo punto es debatido por el Estado, representado por la Procuraduría General de la República, basando todos sus reclamos en la violación de la normativa ambiental que regula la zona marítimo terrestre, áreas silvestres protegidas y Patrimonio Natural del Estado, argumentando que no procede el reconocimiento de derecho de posesión alguno en esa área en razón de que se está en presencia de un bien demanial, que se encuentra fuera del comercio de los hombres y por ende, no procede apropiación por parte de particulares.

Al ser éste un reclamo coincidente dentro de las apelaciones interpuestas se entra a emitir pronunciamiento sobre este primer agravio. Considera importante este Tribunal indicar el bien sobre el cual la parte actora reclama un mejor derecho de posesión, se encuentra totalmente inmerso dentro del Área de que comprende la Zona Marítimo Terrestre ubicada dentro del Área Silvestre Protegida REFUGIO DE VIDA [Nombre14] . Ello se indica claramente en la demanda planteada por los señores [Nombre1] y [Nombre2] . Si analizamos lo pretendido es claro en solicitarse lo siguiente: "... que se declare el legítimo derecho de posesión de los demandantes, tanto en los terrenos que se ubican dentro de la zona marítimo terrestre, como en el área privada circunscrita en el plano catastrado L-10985-74..." (ver pretensión a folio 52). El plano L-10985-1974, que grafica el terreno que reclaman los actores como suyo, se encuentra totalmente inmerso dentro del área que comprende la Zona Marítimo Terrestre según se demuestra con los informes periciales rendidos por los peritos Ing. [Nombre8] a folios 467 al 491, ampliación de informe a folios 510 a 512,587 a 591, Informe Pericial de Ing. [Nombre9] a folios 1300 a 1302, 1315 a 1316, Informe del Catastro Nacional rendido por el ingeniero [Nombre15] de folios 1410 a 1414.

Resulta que tampoco es un hecho controvertido, el que el fundo reclamado por los actores está dentro de dicha franja que comprende la zona marítimo terrestre y así es reconocido por los propios actores y que forman parte del Refugio de Vida Silvestre Gandoca-Manzanillo (ver escrito de demanda a folio 52, prueba confesional de [Nombre1] y [Nombre2] a folios 1359 y 1366, y pretensiones de la demanda a folio 52). Dicha circunstancia es parte de lo argüido como agravio por los codemandados apelantes, pues se conceden derechos en el fallo recurrido sobre un bien demanial, lo cual dicen atenta contra las leyes vigentes. De lo expuesto, los reclamos que formulan los codemandados recurrentes llevan razón. En lo medular sus agravios tienden a hacer ver que el Juez ignoró el carácter demanial del terreno en conflicto pretendido se declare un mejor derecho de posesión según se solicita en la demanda por los demandantes.

De las propias manifestaciones de estos se tiene que se trata de bienes demaniales al haber ingresado al demanio público mediante leyes especiales que han venido regulando la zona marítimo terrestre desde el siglo pasado, lo cual se desarrollará a continuación en cuanto a al régimen jurídico de dicha zona, conceptualizándolos como bienes sustraídos a la disciplina privatística, lo cual los coloca como "Res Extra commercium" es decir fuera de comercio. Así [Nombre16] habla de los BIENES PUBLICOS como : " Los que en cuanto a la propiedad, pertenecen a un pueblo , provincia o Nación , y en cuanto al uso a todos los individuos de su territorio. Se denominan también bienes de dominio público y de la Nación" y luego habla de los BIENES PRIVADOS DEL ESTADO como aquellos que :" Así se denomina en la legislación arg. los que le corresponden como de propiedad privada, los patrimoniales.".El régimen aplicable a unos y otros es distinto.

En el caso de los bienes de dominio público están efectivamente fuera del comercio de los hombres tal y como lo establece el artículo 262 del Código Civil el cual vale la pena transcribir :" Artículo 262 : Las cosas públicas están fuera del comercio y no podrán entrar en él, mientras legalmente no sedisponga así, separándolas del uso público a que estaba destinadas." Mientras, el artículo 261 del mismo Código es el que hace la diferencia entre los bienes de dominio público del Estado y los bienes de dominio privado, para lo cual vale la pena transcribir acá lo que expresamente establece dicho artículo : Artículo 261: " Son cosas públicas las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular , aunque pertenezcan al Estado, a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona."( el subrayado es nuestro).

En el presente asunto, la propiedad de que se trata esta inmersa dentro de la zona marítimo terrestre, la cual fue introducida como un bien dominical a través de diferentes normas desde el siglo pasado. . Es decir, el bien reclamado por los actores sobre el cual piden se les declare un mejor derecho de posesión está fuera del trafico comercial y normal de los bienes privados. En esas circunstancias tal y como lo establece el artículo 261 del Código Civil en su párrafo primero no le es aplicable el régimen ordinario de los bienes privados. Por esa razón tales bienes no pueden ser objeto de los Institutos del Derecho Civil y del Derecho Agrario, entre los cuales se encuentra la posibilidad de adquirirlos en virtud de usucapión o declarar un mejor derecho de posesión. RESEÑA HISTÓRICA DE REGULACIÓN EN ZONA MARÍTIMO TERRESTRE: Del recuento de los hechos y de lo evidenciado en los diversos informes periciales llevados a cabo en este proceso, se desprende que el objeto de discusión se encuentra dentro de la zona marítimo terrestre y dentro de los límites del Refugio de Vida Silvestre Gandoca-Manzanillo.

Ante ello, y a fin de poder analizar el fondo del asunto, conviene exponer un breve recuento histórico de la legislación aplicable en esos terrenos en razón de las particularidades en cada una de las afectaciones indicadas. En lo que respecta a la zona marítimo terrestre existe regulación específica como lo es la Ley Nº 6043, Ley sobre la Zona Marítimo Terrestre, publicada en el Diario Oficial La Gaceta Nº 52, Alcance Nº 36, de fecha 16 de marzo de 1977 y su Reglamento. El numeral primero de la citada ley establece que la zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. El carácter demanial ha sido un tema de amplio pronunciamiento por parte de los tribunales y específicamente la Sala Constitucional se ha pronunciado indicando: "... V. En general sobre la protección constitucional de la zona marítimo terrestre. En múltiples ocasiones este Tribunal Constitucional ha tenido la oportunidad de referirse a la naturaleza jurídica de la zona marítimo terrestre y a su protección constitucional, al formar parte del patrimonio nacional como un bien de dominio público.

  • A)Sobre los bienes demaniales en general: Al respecto, la doctrina y jurisprudencia constitucional son consistentes en estimar que los bienes demaniales (bienes dominicales o de dominio público) son aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados ��los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política��, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. Así, lo que define la naturaleza jurídica de los bienes demaniales es su destino o vocación, en tanto se afectan y están al servicio del uso público, ya que, precisamente se afectan para darles un destino público especial en el que se encuentre comprometido el interés público, en la forma como lo define el artículo 261 del Código Civil: "Son cosas públicas, las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquéllas de que todos pueden aprovecharse por estar entregadas a uso público." Nótese que el énfasis de la diferenciación se da en relación al destino del bien, sea, al hecho de estar afectos a un uso común o al servicio del bien común.
  • B)Sobre los atributos de los bienes demaniales: La titularidad de los bienes de dominio público la ostenta el Estado en su condición de administrador, con lo cual debe entenderse que se trata de bienes que pertenecen la "Nación" y conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración ��en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública��; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalenables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.

Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. De manera que comprende bienes inmuebles que tienen una naturaleza y régimen jurídico virtualmente opuesto a la propiedad privada, que deriva de lo dispuesto en el artículo 45 constitucional. C) Sobre la demanialidad de la zona marítimo terrestre: La demanialidad de la zona marítimo terrestre queda dispuesta en forma expresa en el artículo 3.I. de la Ley de Aguas, número 276, de veintiséis de agosto de mil novecientos cuarenta y dos: "Artículo 3.- Son igualmente de propiedad nacional: I.- Las playas y zonas marítimas "; y en el artículo 1° de la Ley de la Zona marítimo terrestre, en tanto dispone textualmente: "La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible." De suerte que debe tenerse a la zona marítimo terrestre como un bien demanial de la Nación, tanto por disposición constitucional, con sustento en el artículo 6; como por mandato legal, de conformidad con las normas transcritas..." (ver resolución Sala ConstitucionalNº [Telf1] de las 14:59 horas del 25 de febrero del 2009).

En esa misma resolución se hizo referencia expresa a los antecedentes que originaron la regulación de la zona marítimo terrestre, así como las modificaciones que ha sufrido, aspectos que también han sido analizados en diversas resoluciones. Al respecto, señaló: "E) Sobre la demanialidad de la zona marítimo terrestre a lo largo de la historia costarricense: A lo largo de la historia de la humanidad, se ha denotado la gran importancia económica, comercial y también de seguridad ��para la defensa del territorio nacional��que tiene la costa para cualquier país u organización estatal. Así, en lo que respecta a nuestro país, desde la época colonial, el litoral ha permanecido destinado al uso público. En un principio, el área reservada era de una milla de ancho, por lo que se le conocía -y aún en nuestra época- como la "milla marítima". La normativa de mayor relevancia en la regulación de la zona litoral costarricense inicia con la Ley número 162, de veintiocho de junio de mil ochocientos veintiocho, recién declarada la independencia de la Corona Española, y en la etapa de formación del Estado costarricense.

En esta ley se estableció la reserva de una milla marítima en las costas de ambos mares, con lo que se recogió un precepto anterior, de la época colonial (Real Cédula, del quince de octubre de mil setecientos cincuenta y cuatro). Esta disposición se mantuvo a lo largo de toda la legislación emitida en el siglo XIX. Es importante resaltar que en algunas normas de ésta época, expresamente se resalta el carácter demanial de esta zona, como en el caso del Código General de mil ochocientos cuarenta y uno, que consideraba el flujo y reflujo del mar y sus riberas de dominio público. Asimismo, en la Ley número 7, de treinta y uno de agosto de mil ochocientos sesenta y ocho, se ratifica la "idenunciabilidad" de los terrenos de la [Dirección3] marítima, esto es, la imposibilidad de titular las tierras de esta zona. En la Ley de Aguas, número 8, de veintiséis de mayo de mil ochocientos ochenta y cuatro, se califica esta franja de tierra con la denominación de "zona marítimo terrestre", que expresamente se afecta como bien demanial ��como bien de dominio público��, y en consecuencia, se incorpora al patrimonio nacional.

En el Código Fiscal de mil ochocientos ochenta y cinco se dispuso la prohibición de enajenar los terrenos comprendidos en una [Dirección4] a lo largo de la costa de ambos mares. Ya en el siglo XX, la primera normativa a que hizo referencia la zona marítimo terrestre fue la Ley número 75, de treinta de agosto de mil novecientos veinticuatro, que reafirmó el carácter demanial de estas tierras, así como la imposibilidad de explotar y usufructar de ellos. Por su parte, la Ley número 11, de veintidós de octubre de mil novecientos veintidós, precisó, con exactitud, su extensión, al delimitarla en mil setecientos sesenta y dos metros ��medida que corresponde a una milla exacta��, a partir de la pleamar ordinaria, y de quinientos metros a lo largo de ambos márgenes de los ríos. Esta medida se mantuvo hasta mil novecientos cuarenta y dos, en que a partir de las Leyes número 19, de doce de noviembre, y la Ley número 201, de veintiséis de enero de mil novecientos cuarenta y tres, se redujo su extensión, a doscientos metros para ambas costas; provocando así, las primeras desafectaciones de este bien, en relación a todos aquellos terrenos más allá de la determinación hecha, y su consecuente apropiación particular.

Es decir, a partir de estas dos disposiciones y a excepción de los doscientos metros contados a partir de la pleamar ordinaria, el resto de los mil seiscientos setenta y dos metros dejaron de ser de dominio público desde el momento en que pudieron se reducidos a dominio privado. Sin embargo, los terrenos contenidos en los doscientos metros exceptuados por las dos leyes precitados, continuaron siendo bienes de dominio público, no reducibles a dominio privado por ser inalienables e imprescriptibles. Entonces, es correcto sostener que la zona marítimo terrestre quedó, a partir de las leyes mencionadas, con una extensión de doscientos metros contados a partir de la pleamar, que es la que actualmente tiene, manteniendo su carácter de bien demanial. Esta medida, junto con el carácter demanial de los terrenos allí comprendidos, se reafirmó en el entonces vigente artículo 7 de la Ley de Tierras y Colonización No. 2825 de catorce de octubre de mil novecientos sesenta y uno, y se repitió en la Ley Forestal No. 4465, de veinticinco de noviembre de mil novecientos sesenta y nueve y en la Ley de Urbanización Turística de la Zona Marítimo Terrestre No. 4558, de veintidós de abril de mil novecientos setenta.

Especial mención debe hacerse de la Ley número 4558, de veintidós de abril de mil novecientos setenta, en tanto al tenor de lo dispuesto en su Transitorio III., se desafectaron ciento cincuenta metros de los doscientos metros, después de los primeros cincuenta metros contados a partir de la pleamar, al autorizarse a los particulares que hubiesen poseído por más de treinta años, en forma quieta, pública, pacífica y sin interrupción, lotes o fincas en ese sector, a inscribirlos por medio del trámite de informaciones posesorias ante las autoridades jurisdiccionales (no administrativas). Ante la gran cantidad de abusos que se cometieron al tenor de la vigencia de esta disposición, sea, desde el doce de mayo de mil novecientos setenta, es que se deroga mediante Ley número 5602, de cuatro de noviembre de mil novecientos setenta y cuatro, la cual entra en vigencia a partir de su publicación en La Gaceta número 206, del catorce de octubre de mil novecientos setenta y uno; sea que tuvo una vigencia de diecisiete meses y dos días.

En sentencia número 007-93, de las 15:05 horas del 20 de enero de 1993, la Sala Primera de la Corte Suprema de Justicia hace un recuento de esta evolución histórica, de la siguiente manera: "[...] muchas han sido las disposiciones normativas que de alguna u otra forma han establecido regulaciones sobre la zona marítimo terrestre, antes más conocida como milla marítima. Algunas de ellas ��las más importantes�� son las siguientes: Ley No. 162 de 8 de junio de 1828, Decreto No. 12 de 10 de diciembre de 1839, Ley No. 14 de 26 de febrero de 1840, Ley No. 128 de 19 de agosto de 1853, Decreto No. 4 de 30 de julio de 1858, Ley No. 7 de 31 de agosto de 1868, Ley No. 42 de 13 de agosto de 1875, Ley No. 22 de 7 de febrero de 1881, Ley de Aguas No. 8 de 26 de mayo de 1884 y sus reformas, Código Fiscal de 1885 (Ley No. 8 de 31 de octubre de 1885), Ley No. 58 de 29 de julio de 1892, Ley No. 7 de 4 de noviembre de 1892, Ley No. 15 de 27 de marzo de 1896, Ley No. 60 de 13 de agosto de 1914, Ley No. 82 de 5 de abril de 1923, Ley No. 75 de 30 de agosto de 1924, Ley No. 11 de 22 de octubre de 1926, mediante la cual se reformó el Código Fiscal de 1885, Ley No. 29 de 3 de diciembre de 1934, Ley General de Terrenos Baldíos No. 13 de 10 de enero de 1939, Decreto No. 6 de 2 de abril de 1940 (Reglamento a la Ley General de Terrenos Baldíos), Ley No. 19 de 12 de noviembre de 1942, Ley No. 201 de 26 de agosto de 1943, Decreto Ley No. 500 de 19 de abril de 1949, Ley de Tierras y Colonización No. 2825 de 14 de octubre de 1961, Ley No. 2906 de 24 de noviembre de 1961, Ley No. 4071 de 22 de enero de 1968, Ley Forestal No. 4465 de 25 de noviembre de 1969, Ley de Urbanización Turística de la Zona Marítimo Terrestre No. 4558 de 22 de abril de 1970, Ley No. 4928 de 17 de diciembre de 1971 que reformó la anterior y Ley No. 5602 de 4 de noviembre de 1974, que la suspendió.

No es del caso hacer una exhaustivo análisis de las diversas disposiciones normativas sobre la materia; sin embargo, es necesario señalar que desde la primera disposición jurídica emanada en la época republicana ��Ley No.162 de 28 de junio de 1828��se estableció la reserva de [Dirección2] marítima en las costas de ambos mares, que según lo consignado en el Ley No. 128 de 19 de agosto de 1853, era así desde la época colonial por disposición de la Real Cédula de 15 de octubre de 1754. A todo lo largo del siglo XIX, las diversas leyes emanadas reafirman este concepto disponiendo la reserva de una milla marítima a lo largo de ambos litorales. Los Reglamentos Generales de la Hacienda Pública de 1839, 1858 y 1868, mantuvieron la reserva creada en 1828; pero, para los efectos, lo importante a tomar en cuenta es la clara determinación, en la legislación promulgada en el siglo pasado, de la llamada milla marítima como un bien de dominio público, con su consiguiente carácter de inalienabilidade indenunciabilidad.Así, por ejemplo, el Código General de 1841 consideraba el flujo y reflujo del mar y sus riberas de dominio público; la precitada Ley No. 7 de 31 de agosto de 1868, reafirmó el carácter indenunciable de los terrenos de la milla marítima; en la Ley de Aguas No. 8 de 26 de mayo de 1884 -única disposición del siglo XIX en la cual se usó el término Zona Marítimo Terrestre- se calificó a dicha zona como de dominio público; y el Código Fiscal de 1885 estableció que no podían enajenarse los terrenos comprendidos en una zona de una [Dirección3] de latitud a lo largo de las costas de ambos mares." Con lo cual, es claro que desde las primeras normas que regulan esta zona, se le dio siempre el calificativo de bien demanial (dominical, demanio o de dominio público); lo cual le hace acreedora de todas las características de la demanialidad, sea, su inalienabilidad, imprescriptibilidad e inembargabilidady la sujeción al poder de policía en lo relativo a su uso y aprovechamiento.

"Resulta claro entonces, sin demérito del antecedente de la época colonial señalado, que desde el nacimiento de Costa Rica como Estado independiente, la reserva de terreno a los largo de ambos litorales no ha sido parte de los baldíos ��las tierras realengas de la Colonia��sino que siempre ha estado sometido a un régimen jurídico distinto, el propio de los bienes de dominio público y, por lo tanto, no reducibles a propiedad privada. En la legislación sobre la materia promulgada a lo largo del siglo XX hasta culminar con la actual Ley sobre la Zona Marítimo Terrestre No.6043 de 2 de marzo de 1977, se mantuvo, obviamente, el calificativo de bienes de dominio público de los terrenos comprendidos en dicha zona. Como resultado de la evolución legislativa del siglo XIX, la zona marítimo terrestre comprendía la parte de las costas de ambos mares bañadas por el flujo y reflujo, extendiéndose hasta la distancia de una milla tierra adentro.

Comprendía, además, las márgenes de los ríos hasta el sitio en que fueran navegables o fueran afectados por las mareas. La legislación de este siglo fue precisando la extensión de la zona así como los elementos que formaban parte de ella, pero en ningún momento negó su carácter de bien demanial y, en consecuencia, su imprescriptibilidad e inalienabilidad; [...] .

De este somero estudio sobre la legislación acerca de la zona marítimo terrestre, es fácil llegar a la conclusión de que la franja de 200 metros a partir de la pleamar ordinaria a lo largo de ambas costas definida como parte de la zona marítimo terrestre por el artículo 9 de la actual Ley sobre la Zona marítimo terrestre, ha sido de dominio público ��y los terrenos en ella comprendidos, bienes demaniales�� desde 1828, por lo menos. Las variaciones que la legislación del siglo pasado y del presente han introducido sobre la materia nunca han desafectado en forma generalizada estos 200 metros, siendo más bien que la legislación anterior a 1942 y 1943, establecía una franja mayor en extensión ��la llamada milla marítima�� pero nunca menor." (Sentencia número 007-93, de la Sala Primera de la Corte Suprema de Justicia, supra citada)". Como vemos, la afectación a dominio público de la zona marítimo terrestre y la exclusión de apropiación por parte de particulares es muy antigua, en virtud de que siempre se ha mantenido el interés del Estado de mantener esas áreas bajo su poder no sólo para destinarlas al disfrute público, sino también por su relevancia a nivel ambiental.

En lo que respecta a la legislación vigente, como bien se indicó supra, actualmente, la ley que define lo que debe entender por zona marítimo terrestre es la Ley 6043; la cual, en su numeral 9 dispone: "Zona marítimo terrestre es la franja de doscientos metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República, cualquiera que sea su naturaleza, medidos horizontalmente a partir de la línea de la pleamar ordinaria y los terrenos y rocas que deja el mar en descubierto en la marea baja. Para todos los efectos legales, la zona marítimo terrestre comprende las islas, islotes y peñascos marítimos, así como toda tierra o formación natural que sobresalga del nivel del océano dentro del mar territorial de la República...". Además de ello, en los artículos siguientes 10 y 11 menciona las áreas que la componen, así como lo que se debe entender por cada una. Al respecto, se establece: "Artículo 10.- La zona marítimo terrestre se compone de dos secciones: la ZONA PUBLICA, que es la faja de cincuenta metros de ancho a contar de la pleamar ordinaria, y las áreas que quedan al descubierto durante la marea baja; y la ZONA RESTRINGIDA, constituida por la franja de los ciento cincuenta metros restantes, o por los demás terrenos en caso de islas.

Los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar corresponden a la zona pública". El ordinal 11 dispone:"Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional".Dicho cuerpo normativo es claro en disponer que los terrenos comprendidos dentro de la zona marítimo terrestre no son objeto de apropiación por parte de particulares por ningún medio y específicamente, en relación con la zona pública se reitera que nadie podrá alegar derecho alguno sobre ella bajo ningún título, en razón de que su destino es la utilidad pública y el libre tránsito de las personas, siendo obligación de las instituciones públicas y las autoridades del país, el garantizar ese libre tránsito a todas las personas (artículos 7 y 20 de la Ley sobre Zona Marítimo Terrestre).

Por su parte, el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley sobre la Zona Marítimo Terrestre", en su artículo segundo contiene varias definiciones relevantes para comprender con mayor claridad hasta donde se extiende la zona marítimo terrestre. La definición anterior señala que comprende la franja de doscientos metros de ancho a lo largo de los litorales Atlántico y Pacífico, siendo definido el litoral como: "Orilla o costa del mar, que se extiende por las rías y esteros permanentes hasta donde éstas sean sensiblemente afectadas por las mareas y presenten características marinas y definidas" (Reglamento a la Ley sobre la Zona Marítimo Terrestre, artículo 2, inciso h). Dentro del mismo numeral citado, en los incisos e) y f) contemplan lo que se entiende por rías y esteros, a saber: "e) Estero: Terreno inmediato a la orilla de una ría por el cual se extienden las aguas de las mareas; f) Ría: Parte del río próxima a su entrada en el mar y hasta donde llegan las mareas...".

De lo expuesto, se observa que tanto las rías como los esteros son considerados como parte de la zona marítimo terrestre, a pesar de la extensión de los mismos. Por ello en el presente caso es atendible el agravio referido a dicho aspecto por los apelantes Procuraduría General de la República y Synapsis Sociedad Anónima, ya que se ha probado el carácter demanial del bien objeto del litigio. En este mismo sentido puede verse el voto de la Sala Primera de la Corte Suprema de Justicia Nº 733-F-2000 de las 15:12 horas del 4 de octubre del 2000, que en lo que interesa indica: "...IV.- Tocante al agravio atinente a la naturaleza jurídica de la finca litigiosa, precisa apuntar lo siguiente. El artículo 121 inciso 14 de la Constitución Política, en lo conducente, preceptúa: " Artículo 121.-Además de las otras atribuciones que le confiere esta Constitución, corresponde exclusivamente a la Asamblea Legislativa: 14) Decretar la enajenación o la aplicación a usos públicos de los bienes propios de la Nación. …"(Lo subrayado no es del original).

Esta disposición encuentra su desarrollo legislativo en el canon 261 del Código Civil, el cual dispone: "Artículo 261.- Son cosas públicas las que, por ley , están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular, aunque pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona."(Lo subrayado no es del original). Según se desprende claramente de dichos preceptos, nuestro ordenamiento jurídico reconoce la titularidad del Estado tanto sobre bienes de dominio público, cuanto privado. Con ello concuerda la doctrina. Los públicos son aquéllos afectados por una ley específica para el uso público o general. Se les denomina "demaniales". Son inalienables, imprescriptibles, inembargables e indenunciables.

Sea, están dedicados al uso público, a la utilidad general. Por ello, se encuentran fuera del comercio de los hombres -artículo 262 del Código Civil-. La Sala Constitucional de la Corte Suprema de Justicia ha definido el demanio público como “…el conjunto de bienes sujeto a un régimen jurídico especial y distinto al que rige el dominio privado, que además de pertenecer o estar bajo la administración de personas jurídicas públicas, están afectados o destinados a fines de utilidad pública y que se manifiesta en el uso directo o indirecto que toda persona puede hacer de ellos.” (sentencia no. 3145 de las 9 horas 27 minutos del 28 de junio de 1996). Asimismo, en sentencia no. 2408 de las 16 horas 13 minutos del 21 de febrero de 2007, ese Tribunal Constitucional, señaló: “...La doctrina y jurisprudencia constitucional son consistentes en estimar que los bienes demaniales (o bienes dominicales o de dominio público) son aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados –los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política–, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela.

Así, lo que define la naturaleza jurídica de los bienes demaniales es su destino o vocación, en tanto se afectan y están al servicio del uso público, ya que, precisamente se afectan para darles un destino público especial en el que se encuentre comprometido el interés público, en la forma como lo define el artículo 261 del Código Civil: " Son cosas públicas, las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquéllas de que todos pueden aprovecharse por estar entregadas a uso público. " Nótese que el énfasis de la diferenciación se da en relación al destino del bien, sea, al hecho de estar afectos a un uso común o al servicio del bien común; tal y como lo consideró con anterioridad la Sala Constitucional en sentencia número 2301-91, de seis de noviembre de mil novecientos noventa y uno: " El dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público.

Son los llamados bienes dominicales, bienes demaniales, bienes o cosas públicas o bienes públicos, que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera del comercio de los hombres. Es decir, afectados por su propia naturaleza y vocación. En consecuencia, esos bienes pertenecen al Estado en el sentido más amplio del concepto, están afectados al servicio que prestan y que invariablemente es esencial en virtud norma expresa.” Así, se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración –en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública–; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalenables(sic), lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.

Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. De manera que comprende bienes inmuebles que tienen una naturaleza y régimen jurídico virtualmente opuesto a la propiedad privada, que deriva de lo dispuesto en el artículo 45 constitucional. …”.

VII.ANTECEDENTES DE CREACIÓN DEL REFUGIO DE VIDA SILVESTRE GANDOCA-MANZANILLO:Conforme se evidenció del desglose de los antecedentes del presente proceso, la propiedad en discusión se encuentra también inmersa dentro de los límites del Refugio de Vida Silvestre Gandoca-Manzanillo, siendo éste una categoría de manejo de las áreas silvestres protegidas, de conformidad con lo establecido en el numeral 32 de la Ley Orgánica del Ambiente. Ante ello, se considera importante analizar la definición de dicha categoría de manejo y sus antecedentes de creación. El Refugio de Vida Silvestre; se encuentra definido en la Ley de Conservación de Vida Silvestre, artículo 82 como: "Son refugios nacionales de fauna y vida silvestre, los que el Poder Ejecutivo declare o haya declarado como tales, para la protección e investigación de la flora y la fauna silvestres, en especial de las que se encuentren en vías de extinción.

Para efecto de clasificarlos, existen tres clases de refugios nacionales de vida silvestre: a) Refugios de propiedad estatal, b) Refugios de propiedad mixta; c) Refugios de propiedad privada (...)�". Ese mismo numeral dispone que los recursos naturales comprendidos dentro de los refugios de vida silvestre serán administrados por la Dirección General de Vida Silvestre del Ministerio de Ambiente y Energía, dependencia que fue comprendida dentro de las competencias del Sistema Nacional de Áreas de Conservación, según lo dispuesto en el segundo párrafo del ordinal 22 de la Ley de Biodiversidad. En relación con los antecedentes de creación de dicha área silvestre protegida, se tiene que el Refugio de Vida Silvestre Gandoca-Manzanillo se creó mediante el Decreto Ejecutivo N° 16614 del 01 de julio de 1985, publicado en el Diario Oficial La Gaceta N° 206 del 29 de octubre de 1985. Dentro de los considerandos del citado decreto ejecutivo se utilizó como justificación de creación la importancia que tiene dicha zona en materia ambiental mencionando manglares, pantanos, bosques y arrecifes de valor único, única asociación de yolillo y orey, poblaciones de especies en vías de extinción y el único banco natural de ostión de mangle, criaderos de sábalo, poblaciones de langostas y un gran potencial turístico de sus playas.

Posteriormente, se emitió el Decreto Ejecutivo N° 23069-MIRENEM del 21 de marzo de 1994; publicado en el Diario Oficial La Gaceta N° 65 del 05 de abril de 1994; mediante el cual, en el artículo 16 declaró de acceso restringido la zona de playa Gandoca; derogando el numeral 6 del Decreto de creación del citado Refugio. Sin embargo; en el año 2000, se emitió el Decreto Ejecutivo N° 29019 del 19 de setiembre del 2000, publicado en el Diario Oficial La Gaceta N° 208 del 21 de octubre del 2000; en el que se derogó en su totalidad el Decreto Ejecutivo Nº 23069-MIRENEM.Años después; se emitió el Decreto Ejecutivo N° 32753 del 16 de mayo del 2005; publicado en el Diario Oficial La Gaceta N° 228 del 25 de noviembre del 2005; denominado ��Ratifica vigencia de los artículos 1, 2, 3, 4, 7 y 8 del decreto ejecutivo que creó el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. Este decreto ejecutivo además de ratificar los artículos citados del decreto de creación, derogó los numerales 5 y 6 del mismo cuerpo legal citado.

Sin embargo; este decreto ejecutivo fue derogado mediante el artículo 7 del Decreto N° 34043 del 11 de setiembre del 2007; publicado en el Diario Oficial La GacetaN° 202 del 22 de octubre del 2007. En el último decreto ejecutivo citado se ratificó y reformó el decreto de creación del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, ampliando los límites de creación del decreto original. Sin embargo; la Sala Constitucional mediante resolución N° 1056 del 28 de enero del 2009 anuló la mayoría de los numerales de ese decreto, dejando únicamente los artículos 2, 6 y 8; mismos que se refieren a la ampliación de los límites de creación del Refugio, la suspensión para aprovechamiento maderable en el cantón de Talamanca y la entrada en vigencia de la norma. Como vemos, el Refugio ha sufrido varias modificaciones desde su creación, sin embargo, como se indicó, desde su origen, los fines de esa afectación fue siempre la conservación y protección de la diversidad de los recursos naturales existentes en la zona, siendo de gran relevancia a nivel nacional mantener su tutela, no sólo para evitar la extinción o pérdida de las especies que habitan el lugar, sino también para cumplir con la legislación internacional que protege esas áreas, tales como Convenio para la Conservación de la Biodiversidad y Protección de Áreas Silvestres Prioritarias en América Central, aprobado mediante Ley Nº 7433, publicada en La Gaceta Nº 193 del 11 de octubre de 1994; Convenio sobre el Comercio Internacional de Especies Amenazadas de Flora y Fauna Silvestre, ratificado por Ley Nº 5605 del 30 de octubre de 1974, entre otros.

Esas áreas, al formar parte de las áreas silvestres protegidas son consideradas parte integrante del Patrimonio Natural del Estado y en función de ello, el régimen jurídico aplicable es el establecido en la Ley Forestal, específicamente numerales 13, 14 y 15. Ello incluso es dispuesto expresamente en el ordinal 73 de la Ley sobre la Zona Marítimo Terrestre al disponer: "Artículo 73.- La presente ley no se aplica a las zonas marítimo terrestres, incluidas en los parques nacionales y reservas equivalentes, las cuales se regirán por la legislación respectiva". De lo anterior, se desprende que la norma excluye los parques nacionales y las reservas equivalentes del régimen establecido en la ley citada. Si bien, no se incluye el Refugio, éstos deben ser considerados dentro del término de reservas equivalente; según lo ha interpretado la Sala Constitucional: "... En efecto, el citado artículo dice: "Artículo 73.- La presente ley no se aplica a las zonas marítimo terrestres, incluidas en los parques nacionales y reservas equivalentes, las cuales se regirán por la legislación respectiva.

" Aunque el texto transcrito no incluye expresamente la denominación "refugios de vida silvestre", deben entenderse éstos incluidos dentro de la frase "reservas equivalentes", ya que necesariamente, en atención a los fines de protección ambiental que los informan, su manejo debe considerar aspectos técnicos en la materia, que son más propios de los organismos especializados respectivos que de las corporaciones municipales: de allí que su administración se regule por normativa específica" (ver resolución 1886-95 de las 09:12 horas del 07 de abril de 1995). De igual forma, este Tribunal en otros conflictos generados dentro de los límites del Refugio de Vida Silvestre Gandoca-Manzanillo, ha reiterado la posición de que dichas áreas forman parte del Patrimonio Natural de Estado, además de reconocer la importancia ambiental de esa zona, como bien se expuso en el Voto 721-F-03 de las 14:07 horas del 31 de octubre del 2003, en el que se indicó: "XXIII.- En la especie, si bien es cierto estamos frente a un conflicto entre particulares, el referido conflicto involucra a un bien demanial, que es parte del Patrimonio Forestal del Estado (...).

Se trata del Refugio de Vida Silvestre Gandoca- Manzanillo, creado mediante el Decreto N° 16614-MAG del 11 de octubre de 1985 (...). Siendo un bien del dominio público, existe interés de cualquier particular en su protección, y también de la colectividad,máxime si se considera el valor ecológico que tiene para nuestro país. La importancia de dicho Refugio, fue valorada aún más cuando Costa Rica, en aplicación de la Convención relativa a los Humedales de Importancia Internacional, especialmente como Hábitat de Aves Acuáticas (Aprobado en Ramsar, Irán, el 2 de febrero de 1971, y modificada por el Protocolo de París del 3 de diciembre de 1982 y las Enmiendas de Regina del 28 de mayo de 1987) aprobado por Costa Rica mediante Ley N° 7224 del 2 de abril de 1991...". Dentro del mismo caso, se reforzó la importancia de esas áreas, así como su condición de bienes de dominio público señalando: "...

IV.- A mayor abundamiento, conviene señalar, que tratándose del dominio público del Estado, los bienes no pueden salir definitivamente del dominio de la Nación (artículo 121 inciso 14 de la Constitución Política), porque forman parte del patrimonio natural del Estado (artículo 89 Constitucional) y en este caso Humedal de Importancia Internacional. Se trata, en consecuencia, de bienes imprescriptibles, inalienables, inembargables, y no susceptibles de apropiación privada. Sobre ellos rige el principio de inmatriculación, al ser parte de la propiedad pública, debiendo aplicarse en forma obligatoria la Jurisprudencia Constitucional (Votos No. 1763-94 de las 16:45 horas del 13 de abril de 1994). Por ser bienes de dominio público (artículos 13 y 14 de la Ley Forestal), están sujetos a un régimen jurídico especial y su finalidad es el uso y aprovechamiento común, siendo consustancial su naturaleza jurídica su no reducción al dominio privado, conforme a lo dispuesto en el artículo 261 del Código Civil (Sala Constitucional, No 447 de las 15:30 horas del 21 de febrero de 1991).

En fin, la naturaleza y régimen jurídicos son diferentes tratándose de propiedad privada o de propiedad pública o del Estado, ello por cuanto la primera es regulada de conformidad con el artículo 45 constitucional y la normativa del Código Civil pertinente, de manera que se protege la inviolabilidad de la misma, introduciéndose el concepto de función social. Por su parte, la regulación de la propiedad demanial se fundamenta en el inciso 14 del artículo 121 Constitucional."(Lo resaltado no es del texto original, ver Voto Nº 842-F-05 de las 15:00 horas del 27 de octubre del 2005). Dichos votos fueron confirmados en todos sus extremos por la Sala Primera de la Corte Suprema de Justicia mediante resolución número 952-F-05 de las 16:20 horas del 07 de diciembre del 2005, avalando lo resuelto por este Tribunal y resaltando la condición de los bienes de dominio público, así como la posibilidad de recuperación de tales bienes, al señalar: "...

Adicionalmente, el mismo ad quem concluyó que al margen de que la comunicación aludida se tuviese por realizada en la fecha que alega el recurrente (11 de mayo de 1993), el terreno objeto de debate es uno de naturaleza demanial, que por tal, su propiedad es imprescriptible. Esta característica de los bienes en cuestión hace que sea irrelevante la fecha de notificación que alega el casacionista, pues como bien se desprende del concepto mismo de los bienes de dominio público (dominicales), ellos son inalienables, imprescriptibles, inembargables e irrenunciables, principios a partir de los cuales, al margen del plazo transcurrido, persiste la posibilidad de anular un título que pretende transferir al patrimonio de un particular la propiedad de bienes que han sido declarados como de dominio público, salvo ley que disponga lo contrario. (en relación ver entre otras sentencia No. 733 de las 156 horas 12 minutos del 4 de octubre del 2002, de esta Sala).

Sobre esta condición de los terrenos en conflicto, en el hecho probado No. 5 del Juzgado, ratificado por el Tribunal, se indica con claridad respecto del mismo, "...está comprendido dentro de Reserva Nacional-Bosques, y estuvo bajo administración del Instituto de Tierras y Colonización para el año de mil novecientos setenta y ocho al año de mil novecientos ochenta y nueve, y a partir del primero de julio de mil novecientos ochenta y cinco queda comprendido dentro del Refugio nacional de Vida Silvestre Gandoca manzanillo creado mediante Decreto No. 16614-MAG , (folio 788) En este sentido, la valoración probatoria que acusa el recurrente guarda un estrecho vínculo con el análisis de fondo que realizan las instancias previas, particularmente el a quo a partir del considerando IV, y el ad quem en los considerandos XXIII y XXIV, ejercicio volitivo del cual deriva la deducción de la condición jurídica pública del bien objeto de debate, y que presupone la imposibilidad jurídica de apropiación por parte de particulares en su beneficio exclusivo.

Este hecho probado y desarrollo de fondo, que no ha sido atacado por el recurrente, establecen la naturaleza indicada supra del inmueble referido, aspecto que conlleva a que en el fondo, carezca de preponderancia la fecha de notificación que discute el recurrente (por las razones ya indicadas), pues al margen de que la misma haya sido realizada en la fecha pretendida, lo cierto del caso es que la característica de imprescriptibilidad de los bienes de dominio público, permiten la anulación de cualquier título que se erija en perjuicio de esta naturaleza jurídica" (Lo destacado no es del texto original). De lo anterior, se concluye que el Refugio de Vida Silvestre Gandoca-Manzanillo es parte del Patrimonio Natural del Estado; el cual, comprende dentro de sus límites áreas muy importantes a nivel ambiental, mismas por las que se ha velado su protección y conservación y que por su condición, no pueden ser objeto de apropiación por parte de particulares, sino que

deben ser destinados para el disfrute general de la población. De lo anterior, queda claro que los bienes de dominio público son aquéllos afectados por una ley específica o por su propia naturaleza, para el uso público o general y sometidos a un régimen especial. Se les denomina “demaniales” y son inalienables, imprescriptibles, inembargables e indenunciables y se encuentran fuera del comercio de los hombres (artículo 262 del Código Civil). Sobre este Tipo de bienes se hace imposible declarar un "MEJOR DERECHO DE POSESIÓN", tal y como lo pretende la parte actora, en este caso por cuanto ni siquiera demostró el ejercicio de posesión sobre el terreno en conflicto según lo expuesto supra como para demostrar un derecho preferente que le permita el uso y aprovechamiento de las cosas públicas conforme al artículo 263 del Código Civil, dado el bien en disputa es un bien demanial.

VIII. MOTIVOS DE NULIDAD ALEGADOS POR LOS RECURRENTES

El primer motivo de nulidad fue alegado por la representación de Synapsis Sociedad Anónima. Reclama se les dejó en estado de indefensión y se le lesionó el debido proceso, al agregar a los antecedentes únicamente el segundo escrito de contestación de demanda realizado por su representada visible a folios 209 al 219 y 232 al 242; debiendo haberse también agregado a los antecedentes el escrito de ampliación de demanda en donde se refirieron a los daños y perjuicios. De la resolución recurrida se desprende que en el primer considerando, el a quo analiza y corrige el error que se generó respecto a la ampliación de la demanda contra Corporación Vida Verde Marina y Synapsis Sociedad Anónima. Al respecto, resuelve agregar a los antecedentes el escrito de contestación de ampliación de demanda interpuesto por la codemandada Synapsis Sociedad Anónima, así como el escrito de ampliación de demanda interpuesto por los actores a dicha codemandada; dejando claro que solamente se emitió pronunciamiento sobre la ampliación de demanda contra Corporación Vida Verde Marina; ello en aras de garantizar la igualdad de trato y el debido proceso a las partes (ver resolución a folios 1664 al 1665).

Sin embargo, si se aclaró que se emitía pronunciamiento respecto a los daños y perjuicios reclamados, lo cual, no causa lesión al derecho de defensa ni debido proceso, debido a que dichos extremos fueron solicitados tanto en el escrito de demanda inicial visible a folio 53 como en el escrito de ampliación de demanda visible a folio 175; siendo expuestos en forma general contra las dos sociedades codemandadas Corporación Vida Verde Marina y Synapsis, lo que significa que desde un inicio, la parte recurrente tuvo la oportunidad para referirse a esos extremos. Obsérvese, en ninguno de los dos escritos de contestación de demanda visibles a folios 105 al 117 y 209 al 219 se emitió pronunciamiento sobre los daños y perjuicios alegados, los cuales, como se indicó, fueron reclamados desde el escrito de demanda inicial. El segundo motivo de nulidad fue expuesto por la representación del Estado. Señala que la sentencia en el considerando octavo sobre el fondo del asunto y excepciones no analiza ninguna de las excepciones opuestas, por lo que es imposible saber las razones y los fundamentos que motivan lo resuelto en la parte dispositiva de la sentencia.

En ese sentido, existe una contradicción en la sentencia, pues por un lado acoge su defensa de falta de derecho, pero a la vez le reconoce a los actores, derechos sobre un bien público estatal, que en principio estaría siendo reconocido y protegido al declarar sin lugar la demanda respecto al Estado. No obstante, como la resolución no analiza la excepción de fondo del Estado, hay dificultad para alzarse en forma adecuada contra los motivos del juzgador, porque precisamente, se desconoce cuáles son los argumentos que sirven de base al pronunciamiento. No es cierto que la resolución recurrida omitiera pronunciamiento sobre las excepciones opuestas por la representación del Estado, debido a que ello fue abarcado en el considerando onceavo y no en el octavo. Del análisis de dicho considerando se desprende que si se realizó la valoración de cada una de las pretensiones de la demanda opuesta contra el Estado, concluyendo que las mismas no eran procedentes al exponer las razones de su rechazo; por lo que no es cierto no se pueda evidenciar el sustento de su decisión.

Si bien es cierto, no existió pronunciamiento sobre la naturaleza y condiciones de los inmuebles reclamados, ello no es motivo de nulidad, sino es un reclamo de fondo, mismo que será analizado y desarrollado en la presente resolución al resolver los agravios de fondo de los recurrentes. Con base en lo expuesto, procede rechazar los motivos de nulidad alegados por ambos recurrentes, entrándose a analizar los demás agravios expuestos.

IX.La resolución recurrida al resolver el conflicto, efectivamente declara parcialmente con lugar la demanda a favor de la parte actora, reconociéndoles un mejor derecho de posesión tanto de los terrenos que se ubican dentro de la zona marítimo terrestre como del área circunscrita en el plano catastrado L-10985-74 (ver parte dispositiva sentencia visible a folios 1678 y 1679). Para llegar a dicha conclusión, el a quo hace el análisis de la situación en los considerandos nueve y diez, los cuales, de la lectura de los mismos se desprende que el juzgador se enfocó únicamente a resolver los argumentos de las partes en cuanto a quién o quiénes podrían tener o no un mejor derecho de posesión. Sin embargo, no se evidencia algún desarrollo sobre la naturaleza jurídica de los terrenos que estaban siendo reclamados en el proceso, ello a pesar de tener claridad de esa condición, tal y como es reconocido al describir las áreas pretendidas por las partes y hacer referencia expresa a los informes periciales que constan en autos.

En razón de ello, al ser éste un punto reclamado en las apelaciones se entra a analizar para determinar la posible procedencia o no del mejor derecho de posesión declarado en favor de la parte actora. Como bien se indicó en los considerandos anteriores de la presente resolución, el área de terreno reclamada por la parte actora como suya y sobre la cual pretende se le declare un mejor derecho de posesión no sólo forman parte de la zona marítimo terrestre, sino también del Refugio de Vida Silvestre Gandoca-Manzanillo, afectaciones que datan en el primer caso desde 1828 y en el segundo desde 1985; sin que en el transcurso de ese tiempo se haya modificado esa condición. Como parte de sus argumentos, la parte actora en su escrito de demanda señala que han adquirido derechos de posesión y propiedad desde hace más de cuarenta años, posteriormente mencionan que la posesión sobre el inmueble descrito en el plano L-10985-74 data de hace más de 13 años, llevando un hilo conductor en los registros del Departamento Agrario del Ministerio de Agricultura e Industrias, desde el 01 de junio de 1949 con la suscripción de contratos de arrendamientos de los dueños originarios [Nombre11] y [Nombre12] ; sin embargo, sobre ese hilo conductor no se aportó prueba alguna que demostrara ese argumento.

También reclaman posesión de puro derecho sobre los linderos [Dirección5] del plano L-10985-74, afirmándose que forman un todo, por lo que su posesión va más allá de la realidad física del plano; pero no se desprende justificación alguna del origen de la posesión en esa segunda área. De los autos, no se desprende prueba documental alguna en donde se sustente el origen de la posesión reclamada por los actores, debiendo entrarse a valorar la prueba testimonial. En relación a esta prueba, dentro del presente proceso solamente declararon tres testigos, a saber [Nombre6] , [Nombre17] y [Nombre7] , declaraciones visibles a folios 1381 al 1388. De dichas declaraciones testimoniales, se desprende que los dos últimos testigos no hacen referencia alguna sobre el origen de la posesión de los actores, reconociendo incluso el señor [Nombre17] que no sabe a quién le pertenece esa propiedad (ver declaración a folio 1385).

El único que hace referencia a ese aspecto, es el señor [Nombre6] , el cual, indicó que ese terreno le perteneció al abuelo suyo de parte de su padre, llamado [Nombre13] y éste se lo vendió a un señor de apellido [Nombre10], luego [Nombre1] y su madre se lo compraron a ese último, señalando que eso fue hace más de treinta años, al momento de rendir su declaración en el año 2008. Agrega, no sabe el tiempo exacto que estuvo su abuelo ahí, pero fue desde que estaba pequeño como en los años setentas y luego se lo vendió a [Nombre10] (ver declaración a folio 1382). De lo anterior, se evidencia no existe suficiente claridad sobre el origen de la posesión transmitida a los actores por parte de los anteriores poseedores, aportando como sustento de ello únicamente un plano catastrado del año 1974, mismo que por sí solo no sirve de sustento para acreditar el ejercicio efectivo de posesión alguna, de conformidad con lo establecido en el artículo 301 del Código Civil aplicado en forma supletoria en esta materia, además de que dicho plano no se encuentra inscrito a nombre de una persona particular, sino a nombre de la Municipalidad de Talamanca, mismo que había sido solicitado en arriendo.

Un aspecto que si es admitido por ambos actores es que compraron el terreno entre el año 1984 o 1986 y que adquirieron la posesión ejercida por varios años de los anteriores transmitentes, pudiendo tomarse como punto de referencia el testimonio del único testigo que hizo mención al tiempo y la forma de adquisición, mismo que si bien manifestó no saber el tiempo exacto del tiempo que estuvo ahí su abuelo, si manifestó que estaba desde los años setentas, dato que coincide con la fecha del plano catastrado L-10985-1974. Sin embargo; aún cuando se tome como fecha de ejercicio de posesión a partir de los años setentas, ésta no puede ser consideraba para reclamar derecho alguno sobre los inmuebles en litis, en virtud de que mucho antes de esa fecha, esas áreas formaban parte de los bienes de dominio público, al haberse determinado mediante los informes periciales que los terrenos reclamados comprenden áreas dentro de la zona marítimo terrestre, incluso abarcan porción de la zona pública, según se desprende de los folios 470, 483, 488, 1247, 1250, 1301, 1315 y 1410 y que a pesar de los errores de ubicación del plano L-10985-74, siempre se mantiene la afectación de esas áreas.

Lo anterior, sumado a la posterior afectación como Refugio de Vida Silvestre a partir del año 1985. Esa condición de los inmuebles en litis, fue un aspecto de pleno conocimiento por parte de los actores, no sólo porque se desprende así del plano catastrado aportado, sino también porque ha sido reconocido por éstos desde el inicio del proceso, solicitando incluso dentro de su pretensión la declaratoria del derecho de posesión tanto de los terrenos que se ubican dentro de la zona marítimo terrestre, como del área descrita en el citado plano (ver escrito demanda a folio 52); aspecto reafirmado en la evacuación de la prueba confesional de ambos actores, según se desprende de los folios 1359 y 1366, reconociendo expresamente que una parte del terreno está dentro de los cincuenta metros y que existen varios mojones dentro del terreno. Esos aspectos, además fueron constatados con el reconocimiento judicial realizado por el juez de instancia, del que se considera importante resaltar lo siguiente: "...

En este sitio se observa lo que los actores denominan "Crique" estero o quebrada, informando el terreno en litigio se localiza a partir de la margen derecha hacia el [Dirección6]. Atravesamos la quebrada sin nombre o crique y nos ubicamos en un camino de unos tres metros de ancho mostrando el actor [Nombre1] lo que a su juicio es el área en litigio desde la Quebrada por un frente de unos ciento veinte metros, identificado este punto, primero por un poste metálico con una leyenda en inglés "Old Bryground"... de este rótulo siempre hacia el suroeste siguiendo el camino por un trayecto de unos quince o veinte metros (...) hago la aclaración de que el lindero Este lo constituye el frente a la playa del Mar Caribe y como dato de interés se anota (sic) el oleaje del mismo se desarrolla a unos diez metros de distancia en sectores del camino frente a la playa (...) se nota hacia el [Dirección7] o hacia el sector de la Quebrada o Crique es maleza muy altaa (sic) partir del metro y medio de altura, de modo que el área en litis se caracteriza por ser una zona de bosque no intervenido con vegetación densa (...) El área que encierra el camino frente a la playa al este, el camino y cerca con alambre de postes de concreto hacia siete metros después del árbol de Higuerón y de ahí siguiendo la única planta de caña india al norte atravesando los dos árboles con trozos de alambre viejo incrustados hacia salir a la orilla del Crique o Quebrada constituye el área objeto del conflicto y que reclaman para sí los actores según lo establece en el sitio.

Se localizó entre el primer camino y el segundo por el cual se traslada el posteado de energía eléctrica sobre tubos en "PVC", un mojón en concreto a unos doce metros de distancia al norte del Estero, Quebrada o Crique, identificado como el No. "CED7 ", el actor indica hay otros dos más dentro del área en litigio de modo que parte del terreno que reclama se encuentra dentro de la zona de los cincuenta metros de protección, pero los otros mojones debido a la vegetación o maleza no fueron ubicados. También se indica, no existen construcciones, semoviente, ni cultivos de ninguna especie sobre el área en litis, y el lindero que abarca a la Quebrada no mantiene cerca alguna" (ver acta reconocimiento judicial y croquis a folios 1369 al 1374). La descripción, así como las condiciones y naturaleza de las áreas en litis coincide con lo evidenciado por este Tribunal en la inspección ocular realizada como prueba para mejor resolver en fecha 22 de febrero del año 2013; en donde de interés se resalta: "Se inicia reconocimiento judicial en el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo.

Se comienza ubicando el primer mojón con el número 101 bordeando la quebrada llamada "Simión", ello según indican debido al primer poblador que llegó en esa zona. En ese sector se observan varios huecos de cangrejos, lo que implica influencia de ecosistema marino, así como plantas propias de manglar. Se llega hasta el mojón 101 y conforme a la ubicación del GPS se señala el punto 20, correspondiente a la posición [Dirección8] , y en posición [Dirección9] , . En ese sector, se observa un poco de arrecife de coral... Se continua caminando en dirección de la línea eléctrica y en forma paralela a la costa, se llega hasta una cerca con postes de cemento a tres hilos de alambre relativamente nueva en la que se indica corresponde al área en conflicto, también hay una hilera de plantas. Esa área se ubica del mojón 101 anterior hacia el sector sur, aproximadamente a una distancia de unos 10 o 12 metros.

La vegetación en el lindero sur es bastante espesa. El área reclamada por el actor está en línea con los postes de la cerca hasta la quebrada y de ahí hacia el mojón 101. En esa área, el tipo de suelo es bastante húmedo, arenoso y con abundante vegetación, se observan además varios árboles de la especie de sangrillo y varias plantas de yolillo, podría decirse que es un yolillal y continua el área cubierta de vegetación, ese sector se encuentra en el [Dirección10] . Se trata de abrir paso en la colindancia sur del área en conflicto, en el cual, el suelo de observa también arcilloso, arenoso y con rastros de coral, así como huecos de cangrejo. Posteriormente, se comienza a medir desde el [Dirección11] en la [Dirección12] del área en conflicto hacía el mojón 100, el cual, aunque no se ubicó, se indica que está más o menos por donde pasan los cables eléctricos. Del punto 21 donde se ubica la cerca hacía el mojón 100 existen aproximadamente 40 metros.

Se inicia nuevamente la medida con diez metros más para un total de 50 metros y hasta el cableado eléctrico existe una distancia de 10 metros más, para un total de 60 metros del punto 21 hasta el sector de la línea eléctrica. Posteriormente, se procede a medir del mojón 101 hacía el mar, pero según se indica se puede medir desde el sector de la línea eléctrica, hacia el mar, reflejando una distancia de 35 metros, por lo que el área en conflicto hasta el mar existe una distancia aproximada de 50 metros. Después se procede a desplazarse hacia el mojón 98. De ese mojón a unos 5 metros aproximadamente se observa otra cerca a dos hilos de alambre liso con un poste de cemento, en la que indica el actor es la colindancia de su parcela con el señor [Nombre18] . Indica la representación de Synapsis que esa cerca corresponde a la colindancia este del plano de Synapsis y es la que reconocen como parte del área en conflicto, la cual, se tuvo que reparar.

En ese sector se observa un alambre de púas viejo, aparentemente de otra cerca que había en ese lugar. Finalmente se mide por la parte donde se inició el recorrido hacia donde sube el estero. En ese sector, indica la parte demandada que cuando sube la marea toda esa área que ahora se ve seca, se inunda que es el área donde está el mojón 101. En ese lugar el agua es un poco salada y se observa el ingreso de la influencia marina por este canal. Del mojón 101 hacia la parte donde inicia el estero hay una distancia de 20 metros" (ver reconocimiento judicial en registro de audio en escrito virtual de este Tribunal, carpeta documentos asociados, Juicio Oral/ Audio Reconocimiento Judicial 22 Febrero, incorporado en fecha 07 de octubre del 2013). Conforme a lo expuesto, se desprende que el área en conflicto se encuentra dentro de los límites del Refugio y de la zona marítimo terrestre, reclamándose incluso el área que lleva hasta el estero, mismo que fue declarado con esa condición por el Instituto Geográfico Nacional, tal y como lo señaló el perito en su informe visible a folio 1315; por lo que la posesión alegada por los actores no puede ser considerada para reclamar derecho de posesión alguno sobre los bienes de dominio público, siendo características propias de éste tipo de bienes la imprescriptibilidad, inalienabilidad e inembargabilidad; resultando improcedente la apropiación de particulares bajo cualquier forma, ello conforme lo establece los numerales 1, 7 y 20 de la Ley sobre la Zona Marítimo Terrestre y ordinales 13 y 14 de la Ley Forestal.

X.Otro punto importante a resaltar es la posesión ejercida por los actores dentro de las áreas en litis. Se hace la aclaración, que si bien es cierto, en los considerandos anteriores se indicó que por la naturaleza de los inmuebles en conflicto no son suceptibles de apropiación y que la posesión ejercida sobre los mismos no es válida para el reclamo de ningún derecho sobre esas áreas; se procede a realizar el siguiente análisis para constatar que pese a ello, los actores tampoco lograron acreditar en el curso del proceso, una posesión continua y acorde con la naturaleza propia de los inmuebles. En el escrito de demanda, afirman haber realizado permanentemente actos de cuido, limpieza, construcción de cercas, siembras y mejoras en general y han respetado el orden jurídico de zona de protección o uso restringido (ver escrito de demanda a folio 41). Como respuestas de la prueba confesional, la señora [Nombre2] afirmó haber caminado con su esposo ese terreno recogiendo cocos para llevarlos a su casa y luego comercializarlos.

Agrega, su esposo contrataba peones para chapear el terreno en conflicto, desde el "crique" hasta el final (ver declaración a folios 1356, 1358 y 1359). Por su parte, el señor [Nombre1] en su declaración afirmó haber ejercido actos de posesión en las áreas en litis, pero sin especificar en qué consistían los mismos (ver declaración a folio 1361). De la prueba testimonial se desprende que dos de los testigos indicaron que los actores habían aprovechado el terreno juntando los cocos para comercializarlos (ver declaraciones de [Nombre6] y [Nombre7] a folios 1383 y 1387), sin que se precisaran mayores detalles de ese aprovechamiento, agregando el último testigo citado que al momento de rendir su declaración, siendo ésta en mayo del 2008, no le venden cocos, sin recordar fecha exacta de la última venta y que actualmente desconoce las condiciones del terreno (ver declaración a folio 1387). Por su parte, el tercer testigo, [Nombre17] en relación con el terreno señaló que tiene divisiones con una amapola y una cerca de alambre de púas en dos de los alrededores, excepto por el lado del Crique, la parte del frente es con amapola y dos lados con cercas de alambre de púas, sin que estuviera cercado el resto del inmueble, no existen construcciones y el terreno es de montaña (ver declaración a folio 1385).

Aunado a ello, como bien se indicó en los antecedentes, en el proceso interdictal interpuesto por [Nombre1] y [Nombre2] contra Synapsis SociedadAnónima, la sentencia de primera instancia número 48-96 de las dieciséis horas del veintiuno de mayo de 1996 tuvo acreditado que la posesión ejercida por la parte actora era únicamente limpiar terreno y aprovechar los cocos que habían; y con base en ello, declaró con lugar dicha demanda (ver resolución a folios 16 al 24). Tiempo después, dentro del proceso interdictal interpuesto por la Sociedad Synapsis contra [Nombre1] y [Nombre2] , en la sentencia de primera instancia número 03-99 de las quince horas del catorce de enero de 1999, se demostró que los demandados procedieron a poner una cerca y arrojar basura en el terreno reclamado; por ello se declaró con lugar la demanda interdictal (ver resolución a folios 8 al 13). De lo expuesto, se evidencia que los actos ejercidos en el inmueble en litis, no han sido acordes con la naturaleza del terreno, al haberse tenido por demostrado con los reconocimientos judiciales que es una zona con mucha vegetación, sumamente densa, dificultando incluso el acceso en el terreno, siendo además áreas de terreno sumamente húmedos; lo cual, es evidente que su naturaleza no es de aprovechamiento, sino de conservación, aunado a que en ningún momento se constató la existencia de los cocos y mucho menos en la cantidad necesaria para que pudieran ser comercializados.

En cuanto a los actos de limpieza de carriles y construcción de cercas que han sido realizados en el terreno, no sólo contrarian los fines y naturaleza de los inmuebles, perjudicando con ello el libre tránsito de la fauna existente en el lugar, sino que además dichas acciones se encuentran expresamente prohibidas en la legislación vigente como son el artículo 12 de la Ley sobre la Zona Marítimo Terrestre y 58 de la Ley Forestal.

XI.Al entrar a analizar los demás agravios expuestos por la representación de la codemandada Synapsis Sociedad Anónima, se evidencian que los mismos no son procedentes por las razones que a continuación se exponen. Como primer punto, reclaman los recurrentes que el traslape se fundamentó únicamente en un informe pericial, mismo que es confuso por las áreas que se describieron por secciones sin hacerse referencia a medidas claras y se dejó de lado otros informes aportados a los autos, los cuales, evidencian que existen errores en el plano de la parte actora. La existencia del traslape fue un aspecto demostrado no sólo por el informe pericial del ingeniero [Nombre8] , sino por el resto de prueba técnica aportada al proceso como el informe pericial rendido por el ingeniero Ervin Adolfo Álvarez Fuentes, en su calidad de perito del Poder Judicial, visible a folios 1246 al 1252, en donde no sólo constata la existencia del traslape entre los planos de la parte actora y demandada, reafirmando también la ubicación errónea reportada en los dos planos; sino también expresamente indicó que el informe del ingeniero [Nombre8] se apega a la realidad.

Por su parte, el informe rendido por la Dirección de Catastro Nacional también reafirmó la existencia de los problemas en relación con los planos de ambas partes, demostrándose incluso más problemas de traslape con otros planos catastrados (ver informe a folio 1410). Con ello se concluye que tanto el plano L-10985-74 como L-94656-93 presentan graves errores de ubicación y de información, pero a pesar de ello, se pudo constatar la existencia del traslape, coincidiendo ella con el área reclamada en el proceso. Como segundo reclamo se expone que la sentencia ordena el desalojo del área descrita en el plano L-10985-1974, así como de la sección A indicada en el informe pericial, incurriendo con ello en un vicio de ultrapetita, debido a que esa área nunca fue descrita ni solicitada por la parte actora. Si bien este punto no resulta relevante con base en los argumentos expuestos en los considerandos anteriores y por la forma en la que se resuelve; procede realizar la aclaración que desde el inicio del proceso, la parte actora es clara al reclamar no sólo el área descrita en el plano L-10985-1974, sino también el terreno colindante con dicho plano en los [Dirección13] , según se observa tanto en los hechos de la demanda como en la pretensión visible a folios 42 y 52.

El tercer agravio quedó abarcado con el desarrollo realizado en los considerandos anteriores de la presente resolución, al haberse analizado en ellos la forma de adquisición de los inmuebles por parte de los actores, así como la posesión ejercida. Los reclamos en relación con la falta de valoración de la prueba aportada por la codemandada Synapsis para demostrar el ejercicio efectivo de su posesión, no son relevantes por todos los argumentos de derecho expuestos en la presente resolución y debido a que la citada codemandada no presentó contrademanda en la que pueda sustentar reclamo alguno de su parte. El cuarto agravio, tampoco resulta relevante su análisis por la forma en la que se resuelve.

XII.En el presente caso, debe tenerse claro, que ninguna de las codemandadas presentó contrademanda alguna contra los aquí personas actoras, ni la Procuraduría General de la República, así como tampoco Synapsis y Corporación Vida Verde Marina, de ahí la nulidad decretada por la Sala Primera en cuanto al voto dictado por este Tribunal N° 989-F-13, dictado a las catorce horas y treinta y cuatro minutos del veintiuno de octubre de dos mil trece, que disponía: "...De oficio, se declara la nulidad de los planos catastrados números L-10985-1974 y L-94656-1993. Una vez firme la presente resolución, proceda el a quo a enviar los oficios correspondientes a la Subdirección Catastral del Registro Nacional Inmobiliario para que procedan a anular las inscripciones de los planos citados. En consecuencia, se ordena tanto a los actores [Nombre1] y [Nombre2] como a la codemandada Synapsis Sociedad Anónima proceder al desalojo inmediato del área en conflicto que comprende el área descrita en el plano catastrado L-10985-1974 y el sector colindante este y sur del plano citado, descrita en el informe pericial visible a folios 480 al 490 como sección A y además, deberá la codemandada Synapsis Sociedad Anónima, en el plazo de quince días hábiles a partir de la firmeza de la presente resolución, realizar la remoción de la cerca existente en el inmueble en litis, para que posterior a ello, el Estado pueda disponer del área en conflicto, conforme a su naturaleza y condición...".

De conformidad con lo expuesto, se rechazan los reclamos de nulidad interpuestos por ambos apelantes. En cuanto al fondo, al llevar razón la codemandada Synapsis Sociedad Anónima y El Estado en sus agravios en relación con la naturaleza de las áreas de terreno que se reclaman; procede revocar parcialmente la sentencia 42-2012 de las trece horas y catorce minutos del veintitrés de julio del dos mil doce, en cuanto rechazó la excepción de falta de derecho opuesta por la parte demandada y declaró parcialmente con lugar la demanda interpuesta por [Nombre1] y [Nombre2] contra Synapsis y Corporación Vida Verde Marina; acogiendo las pretensiones uno, dos, tres, cuatro y cinco. En su lugar; se acoge la excepción de falta de derecho opuesta por las partes demandadas y se declara sin lugar la demanda en todos sus extremos. En lo demás se confirma.

POR TANTO:

Se rechaza la nulidad alegada en ambas apelaciones. Se revoca parcialmente la sentencia cuarenta y dos-dos mil doce de las trece horas y catorce minutos del veintitrés de julio del dos mil doce, en cuanto rechazó la excepción de falta de derecho opuesta por las partes codemandadas y declaró parcialmente con lugar la demanda interpuesta por [Nombre1] y [Nombre2] contra Synapsis y Corporación Vida Verde Marina; acogiendo las pretensiones uno, dos, tres, cuatro y cinco. En su lugar; se acoge la excepción de falta de derecho opuesta por las partes codemandadas, declarando sin lugar la demanda en todos sus extremos. En los demás extremos objeto de apelación, se confirma la resolución recurrida.
