10.—That articles 19, subsection b), and 34 of the Forest Law No. 7575 prohibit the land-use change (cambio de uso del suelo) and the cutting of trees on lands covered with forest and in protection areas, excepting those state or private projects that the Executive Branch declares of National Convenience.
11.—That article 3, subsection m) of the Forest Law No. 7575 declares as activities of national convenience those carried out by centralized State agencies, autonomous institutions, or private companies, whose social benefits are greater than the socio-environmental costs, and the present Project is covered by the Electric Transmission Expansion Plans for 2012-2022 and the Electric Generation Plans 2012-2022, which leads to an improvement in the conditions and quality of life of citizens.
12.—That the "Cariblanco-Trapiche 230 kv Transmission Line Project" is one of the most important projects in the country. Its main objective is to reinforce the entire transmission network of the country's Atlantic zone with a new link of approximately 155.45 km at 230 kV by 2015. The document "Economic Valuation of Social Benefits" of the "Cariblanco - Trapiche 230 kv Transmission Line Project" shows the economic impact of the project considering the accumulated investment up to December 2011 and the investment projections for the years 2012, 2013, and 2014. The total investment amount to be evaluated is $48.81 million equivalent for the year 2011. Increases in operation and maintenance costs are also valued. Benefits quantified are the reduction of electrical losses and the improvement in the quality of electricity supply at the local level (Atlantic zone) and national level. The result of the cited study is that the Cariblanco-Trapiche 230 kV project is profitable, with an IRR of 16.5% and a net present value of $18.01 million.
13.—That article 2, subsection c) of the Organic Law of the Environment No. 7554 establishes that the State shall ensure the rational use of environmental elements, with the purpose of protecting and improving the quality of life of the inhabitants of the national territory. Likewise, it has the obligation to promote economic and environmentally sustainable development, understood as development that satisfies basic human needs without compromising the options of future generations.
14.—That the cited "Cariblanco-Trapiche 230 kv Transmission Line Project" has an "Economic Valuation of Social Benefits" study demonstrating that the social benefits are greater than the socio-environmental costs of the Project, which was submitted for assessment by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), by note SINAC-DE-479 of February 20, 2013. Therefore;

Said plans must be signed by an engineer or a professional responsible for their fulfillment, and it shall be mandatory for the developer to provide the budgetary resources for their execution.

Tree planting must be carried out preferably on the same farms affected by tree-cutting activities associated with the construction of the project or in the sub-basin of the main rivers crossed by the transmission line. Likewise, compensation measures may be executed, such as natural regeneration, for a period of two years from their approval, on farms managed by Associations Administering Communal Aqueduct and Sewer Systems (ASADAS) or the Ministry of Environment and Energy, which guarantee the incorporation into the ecosystem of areas with forest cover (cobertura forestal), either under the modality of reforestation or natural regeneration.

10.-Que los artículos 19, inciso b) y 34 de la Ley Forestal Nº 7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenos cubiertos de bosque y en áreas de protección, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional.
11.-Que el artículo 3, inciso m) de la Ley Forestal Nº 7575 declara como actividades de conveniencia nacional las realizadas por las dependencias centralizadas del Estado, instituciones autónomas o empresas privadas, cuyos beneficios sociales sean mayores a los costos socio-ambientales, siendo que el presente Proyecto se ampara a los Planes de la Transmisión Eléctrica de 2012-2022 y de la Generación Eléctrica 2012-2022, lo cual conlleva un mejoramiento de las condiciones y calidad de vida de los ciudadanos.
12.-Que el "Proyecto Línea de Transmisión Cariblanco-Trapiche 230 kv" es uno de los más importantes del país. Su objetivo principal es reforzar toda la red de transmisión de la zona atlántica del país con un nuevo enlace de alrededor de 155.45 km a 230 kV para el año 2015. El documento "Valoración Económica de los Beneficios Sociales" del "Proyecto Línea de Transmisión Cariblanco - Trapiche 230 kv" muestra el impacto económico del proyecto tomando en cuenta la inversión acumulada a diciembre de 2011 y las proyecciones de inversión para los años 2012, 2013 y 2014. El monto total de inversión a ser evaluado es de $48.81 millones equivalentes al año 2011. Se valora también los incrementos en costos de operación y mantenimiento. Como beneficios se cuantifican la reducción de pérdidas eléctricas y la mejora en la calidad del suministro de electricidad a nivel local (zona atlántica) y nacional. El resultado del citado estudio es que el proyecto Cariblanco-Trapiche 230 kV, resulta rentable con una TIR de 16.5% y un valor actual neto de $18.01 millones.
13.-Que el artículo 2 inciso c) de la Ley Orgánica del Ambiente Nº 7554 establece que El Estado velará por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo tiene la obligación de propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas sin comprometer las opciones de las generaciones futuras.
14.-Que el citado "Proyecto Línea de Transmisión Cariblanco-Trapiche 230 kv", cuenta con un estudio de "Valoración Económica de los Beneficios Sociales" que demuestra que los beneficios sociales son mayores a los costos socioambientales del Proyecto, el cual fue sometido a valoración por parte del Sistema Nacional de Áreas de Conservación, por nota SINAC-DE-479 del 20 de febrero del 2013. Por tanto;
DECLARATORIA DE CONVENIENCIA NACIONAL E INTERÉS PÚBLICO DE LAS OBRAS DEL "PROYECTO DE TRANSMISIÓN ELÉCTRICA CARIBLANCO TRAPICHE 230 KV, SUS OBRAS ASOCIADAS Y LAS OBRAS DE DISTRIBUCIÓN ASOCIADAS EN LAS FASES DE CONSTRUCCIÓN, OPERACIÓN Y MANTENIMIENTO."

Asimismo, son de conveniencia nacional las actividades de ejecución de medidas de control ambiental requeridas en el Plan de Gestión Ambiental aprobado por Secretaría Técnica Nacional Ambiental, las que serán ejecutadas por el Instituto Costarricense de Electricidad.

Se podrán eliminar todos aquellos individuos dentro de la servidumbre, y en las áreas contiguas a esta, de aquellas especies con riesgo comprobado, mediante medición de campo de caída hacia los conductores eléctricos, los cuales no se deben ubicar dentro del Patrimonio Natural del Estado.
Dichos planes deberán ser firmados por un ingeniero o profesional responsable de que los mismos se cumplan y será obligatorio para el desarrollador dotar de contenido presupuestario la ejecución de los mismos.
La plantación de árboles deberá ejecutarse preferiblemente en las mismas fincas afectadas por labores de corta de árboles asociadas con la construcción del proyecto o en la subcuenca de los principales ríos que son cruzados por la línea de transmisión. Asimismo se podrá ejecutar medidas de compensación, tales como regeneración natural, por un periodo de dos años a partir de su aprobación, en fincas manejadas por Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS) o el Ministerio de Ambiente y Energía, que garanticen la incorporación al ecosistema de áreas con cobertura forestal, ya sea bajo la modalidad de reforestación o regeneración natural.
