in the entirety of the text - Complete Text of Regulation 38718 Amendment to DE 37681 "Declares of National Convenience and Public Interest the construction of the 'Cariblanco–Trapiche 230 kv Transmission Line Project,' its associated works, and associated distribution works in the construction, operation, and maintenance phases" Complete Text of record: FF34E No. 38718-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers and authorities conferred upon them by Articles 50, 140 subsections 3), 8), and 18), and 146 of the Political Constitution; 6, 11, 16, and 27 of the General Law of Public Administration, No. 6227 of May 2, 1978; the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, No. 8220 of March 4, 2002, and its amendment in Law No. 8990 of September 27, 2011; Articles 3 subsection m), 19 subsection b), 27, 33, and 34 of the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996; the Law Creating the Costa Rican Institute of Electricity (ICE), No. 449 of April 8, 1949; the Executive Decree No. 26728-MP-MINAE of February 20, 1998, Declaration of public interest of electricity generation and distribution projects; the Executive Decree No. 37681 of February 25, 2013, which Declares of National Convenience and Public Interest the construction of the "Cariblanco-Trapiche 230 kv Transmission Line Project," its associated works, and associated distribution works in the construction, operation, and maintenance phases; the Executive Decree No. 35603 of October 6, 2009, Declaration of National Convenience and Public Interest of the works of the Reventazón Hydroelectric Project; Executive Decree No. 25700-MINAE of November 15, 1996, which Declares a total ban (veda total) on the harvesting (aprovechamiento) of endangered tree species indicated in this Decree; Executive Decree No. 35868-MINAET of March 24, 2010, Regulation of Article 18 of the Forestry Law No. 7575 and amendment of Articles 2 and 11 of the Regulation to the Forestry Law No. 7575, Executive Decree No. 25721-MINAE; Executive Decree No. 25167-MINAE of April 23, 1996, Restriction on the timber harvesting of almendro trees; and Executive Decree 25663-MINAE of October 8, 1996, Restriction on the cutting or harvesting of the almendro tree.

I.-That Law No. 449 provides that the Costa Rican Institute of Electricity has as its fundamental responsibility to channel the use of hydroelectric energy in order to strengthen the national economy and promote the greatest well-being for the people of Costa Rica, in addition to providing a prompt and effective solution to the scarcity of electric power in the country, when it exists, and to ensure that energy is available at all times to satisfy normal demand and to promote the development of new industries, the use of electricity in rural regions, and its greater domestic consumption.

II.-That in accordance with what is indicated in the National Development Plan 2011-2014, the strategic goals are to increase production and improve the country's competitiveness, as well as to consolidate environmental positioning with a sustainable energy matrix comprising 95% renewable electricity and optimal environmental performance.

III.-That the "Cariblanco-Trapiche Transmission Line Project (230 kV)", currently under construction, has the Declaration of National Convenience through Executive Decree No. 37681-MINAE of February 25, 2013, and will become the link for electric transmission between the Atlantic zone and the center of the country, and will interconnect the Cariblanco (230 kV), General (230 kV), Leesville (230 kV), and Trapiche (230 kV) substations, adding 155.45 km of transmission lines to the National Interconnected System.

IV.-That for the construction of the works of the "Cariblanco - Trapiche 230 kV Transmission Line Project" and associated works, the National Environmental Technical Secretariat (SETENA) granted the following environmental licenses (viabilidades ambientales):

• a)EsIA (Environmental Impact Study) Reconstrucción LT Trapiche-Leesville y Ampliación ST Trapiche Project. Administrative File No. 697-2010-SETENA. Resolution No. 888-2011-SETENA b) EsIA LT Cariblanco-Leesville Project. File No. 239-2005-SETENA. Resolution No. 1411-2006-SETENA and Resolution No. 2107-2008-SETENA (extension of the environmental viability (Viabilidad Ambiental)) known as LT Cariblanco-PI Sucio.
• c)EsIA LT PI Sucio-PH General Project. File No. D1- 1542-2008-SETENA. Resolution No. 872-2011-SETENA.

V.-That the Cariblanco-Trapiche Transmission Line Project (230 kV) is the main link for the transmission and operation of the Reventazón Hydroelectric Project (292 MW) and its integration with the National Electric System, which forms part of the National Electric Generation Expansion Plan.

VI.-That in the "Cariblanco-Trapiche 230 kV Transmission Line Project", there is a need to carry out the cutting, pruning, or elimination of trees of any species in a rational and proportionate manner, such as species declared under a ban (veda) or endangered according to Executive Decree No. 25700 and the species Almendro de montaña (Dipteryx panamensis), Executive Decree 25167-MINAE and Executive Decree 25663-MINAE.

VII.-The species Almendro de montaña (Dipteryx panamensis) previously identified within the area of direct influence by the environmental impact study (Estudio de Impacto Ambiental) for the Cariblanco-Trapiche Transmission Line, is a species that, due to its height, location, crown condition, and growth, presents risk conditions such as electrical discharges to ground and disconnection of the transmission line. The distance between the crown of the trees and the electrical cables to be energized must not be less than 5 meters; otherwise, risk situations arise for the health and life of people and the fauna associated with the site, caused by the entry into operation of the transmission project.

VIII.-That in relation to the compensation measures associated with the cutting of trees for the LT Cariblanco-Trapiche project, ICE established an agreement with the National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal) to allocate funds to the payment for environmental services (Pago de Servicios Ambientales) system for reforestation projects in the amount of thirty-eight million four hundred twelve thousand one hundred fifty-eight colones (₡38,412,158.00), which indicates that under said agreement, 69.3 ha have been reforested and 60,000 trees of native species have been planted. The ages of the species range between one and two years.

IX.-That Article 2 subsection c) of the Organic Law of the Environment No. 7554 establishes that the State shall ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it has the obligation to promote economically and environmentally sustainable development, understood as development that satisfies basic human needs without compromising the options of future generations. Therefore; They decree:

Considering:

en la totalidad del texto - Texto Completo Norma 38718 Reforma DE 37681 "Declara de Conveniencia Nacional e Interés Público la construcción del “Proyecto Línea de Transmisión Cariblanco–Trapiche 230 kv” sus obras asociadas y obras de distribución asociadas en fases de construcción, operación y mantenimiento" Texto Completo acta: FF34E N° 38718-MINAE EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA En el ejercicio de las atribuciones y facultades que les confieren los artículos 50, 140 incisos 3) 8) y 18) y 146 de la Constitución Política; 6, 11, 16 y 27 de la Ley General de la Administración Pública, N° 6227 del 2 de mayo de 1978; la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos N° 8220 de 4 de marzo de 2002 y su modificación en la Ley N° 8990 del 27 de setiembre de 2011; los artículos 3º inciso m), 19 inciso b), 27, 33 y 34 de la Ley Forestal Nº 7575 del 13 de febrero de 1996; la Ley de Creación del Instituto Costarricense de Electricidad, N° 449 del 8 de abril de 1949; el Decreto Ejecutivo N° 26728-MP-MINAE del 20 de febrero de 1998, Declaratoria de interés público de los proyectos generación y distribución eléctrica; el Decreto Ejecutivo N° 37681 del 25 de febrero de 2013 que Declara de Conveniencia Nacional e Interés Público la construcción del "Proyecto Línea de Transmisión Cariblanco-Trapiche 230 kv" sus obras asociadas y obras de distribución asociadas en fases de construcción, operación y mantenimiento; el Decreto Ejecutivo Nº 35603 del 6 de octubre de 2009, Declaratoria de Conveniencia Nacional e Interés Público de las obras del Proyecto Hidroeléctrico Reventazón; el Decreto Ejecutivo N° 25700-MINAE del 15 de noviembre de 1996, que Declara en veda total Aprovechamiento de Árboles en Peligro Extinción indicados en el presente Decreto; el Decreto Ejecutivo N° 35868-MINAET del 24 de marzo de 2010, Reglamentación del artículo 18 de la Ley Forestal N° 7575 y modificación de los artículos 2 y 11 del Reglamento de la Ley Forestal Nº 7575, Decreto Ejecutivo N° 25721-MINAE; el Decreto Ejecutivo N° 25167-MINAE del 23 de abril de 1996, Restricción para el aprovechamiento maderable de árboles de almendro y el Decreto Ejecutivo 25663-MINAE del 8 de octubre de 1996, Restricción a la corta o aprovechamiento del árbol de almendro.

I.-Que la Ley N° 449, dispone que el Instituto Costarricense de Electricidad, tiene como responsabilidad fundamental encauzar el aprovechamiento de la energía hidroeléctrica con el fin de fortalecer la economía nacional y promover el mayor bienestar para el pueblo de Costa Rica, además de dar solución pronta y eficaz a la escasez de fuerza eléctrica en el país, cuando ella exista, y procurar que haya en todo momento energía disponible para satisfacer la demanda normal y para impulsar el desarrollo de nuevas industrias, el uso de la electricidad en las regiones rurales y su mayor consumo doméstico.

II.-Que de acuerdo con lo indicado en el Plan Nacional de Desarrollo 2011-2014, se tienen como metas estratégicas aumentar la producción y mejorar la competitividad del país, así como consolidar el posicionamiento ambiental con una matriz energética sostenible con un 95% de energía eléctrica renovable y un desempeño ambiental óptimo.

III.-Que el "Proyecto Línea de Transmisión Cariblanco- Trapiche (230 kV)", actualmente en construcción, cuenta con la Declaratoria de Conveniencia Nacional mediante el Decreto Ejecutivo Nº 37681-MINAE del 25 de febrero de 2013, y se constituirá en el enlace para la transmisión eléctrica entre la zona atlántica y el centro del país, e interconectar la subestación de Cariblanco (230 kV), General (230 kV), Leesville (230 kV) y Trapiche (230 kV), adicionando 155,45 km de líneas de transmisión al Sistema Nacional Interconectado.

IV.-Que para la construcción de las obras del "Proyecto Línea de Transmisión Cariblanco - Trapiche 230 kV" y obras asociadas, la Secretaría Técnica Nacional Ambiental otorgó las siguientes licencias ambientales (viabilidades ambientales):

• a)EsIA Proyecto Reconstrucción LT Trapiche-Leesville y Ampliación ST Trapiche. Expediente Administrativo N° 697-2010-SETENA. Resolución N° 888-2011-SETENA b) EsIA Proyecto LT Cariblanco-Leesville. Expediente N° 239-2005-SETENA. Resolución N° 1411-2006-SETENA y Resolución N° 2107-2008-SETENA (prórroga de la Viabilidad Ambiental) conocido como LT Cariblanco-PI Sucio.
• c)EsIA Proyecto LT PI Sucio-PH General. Expediente N° D1- 1542-2008-SETENA. Resolución N° 872-2011-SETENA.

V.-Que el Proyecto Línea de Transmisión Cariblanco- Trapiche (230 kV), es el principal enlace para la transmisión y operación del Proyecto Hidroeléctrico Reventazón (292 MW) y su integración con el Sistema Eléctrico Nacional, que forma parte del Plan de VI.-Que en el "Proyecto Línea de Transmisión Cariblanco- Trapiche 230 kV", existe la necesidad de realizar la corta, poda o la eliminación de árboles de cualquier especie en forma racional y proporcionada, tales como especies declaradas en veda o en peligro de extinción según el Decreto Ejecutivo N° 25700 y la especie Almendro de montaña (Dipteryx panamensis), Decreto Ejecutivo 25167-MINAE y Decreto Ejecutivo 25663-MINAE.

VII.-La especie Almendro de montaña (Dipteryx panamensis) previamente identificada dentro del área de influencia directa por el Estudio de Impacto Ambiental de la Línea de Transmisión Cariblanco-Trapiche, es una especie que por su altura, ubicación, condición de copa y crecimiento, presenta condiciones de riesgos como descargas eléctricas a tierra y desconexión de la línea de transmisión. La distancia entre la copa de los árboles y los cables eléctricos a energizar no debe ser inferior a 5 metros, de lo contrario se producen situaciones de riesgo en la salud, la vida de las personas y de la fauna asociada al sitio, producida por la entrada en operación del proyecto de transmisión.

VIII.-Que en relación a las medidas de compensación asociada con la corta de árboles del proyecto LT Cariblanco-Trapiche, el ICE estableció un convenio con el Fondo Nacional de Financiamiento Forestal para asignar fondos al Sistema de Pago de Servicios Ambientales para proyectos de reforestación por un monto de treinta y ocho millones cuatrocientos doce mil ciento cincuenta y ocho colones (₡38.412.158,00), lo que indica que bajo dicho convenio se han reforestado 69,3 has y se han plantado 60.000 árboles de especies nativas. Las edades de las especies oscilan entre uno y dos años.

IX.-Que el artículo 2 inciso c) de la Ley Orgánica del Ambiente N° 7554 establece que el Estado velará por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo tiene la obligación de propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas sin comprometer las opciones de las generaciones futuras. Por tanto;

Adición y modificación al Decreto Ejecutivo N° 37681-MINAE del 25 de febrero de 2013 que Declara de Conveniencia Nacional e Interés Público la construcción del "Proyecto Línea de Transmisión Cariblanco- Trapiche 230 kv" sus obras asociadas y obras de distribución asociadas en fases de construcción, operación y mantenimiento

Considerando:

Decretan:
