7575, Executive Decree No. 25721-MINAE, published in La Gaceta No. 16 of Thursday, January 23, 1997, is hereby modified to henceforth read as follows:
"For the purposes of the application of the Forest Law No. 7575 and its regulation, the terms mentioned shall have the following meanings:
- a)Accreditation (Acreditación): Authorization granted by the A.F.E. or the Forest Certifiers.
- b)Forest Tree (Árbol Forestal): Perennial plant (one that lives more than two years), with a woody and elevated trunk (referring to the different heights that trees reach depending on the species and site), that branches at a greater or lesser height from the ground, which is a source of raw material for different types of forest industry such as sawmills, board factories, veneer factories, match factories, cellulose factories, essential oil factories, resin, and tannin factories.
- c)Aquifer Recharge Area (Área de recarga acuífera): Those land surfaces in which the main infiltration that feeds a specific aquifer occurs, according to the delimitation established by MINAET through an administrative resolution, after consultation with the Costa Rican Institute of Aqueducts and Sewers, the National Irrigation and Drainage Service, or another technically competent entity in water matters.
- d)Protected Wild Area (Área Silvestre Protegida): Space, whatever its management category, structured by the Executive Branch to conserve and protect it, taking into consideration its geographical, biotic, social, and economic parameters that justify the public interest, as defined in accordance with Article 3 of the Forest Law No. 7575.
- e)Forest (Bosque): Land that jointly presents the following three elements: 1.- A native or autochthonous ecosystem, intervened or not, regenerated by natural succession or other forest techniques, that occupies an area of two or more hectares; 2.- The presence of mature trees of different ages, species, and varied size, with one or more canopies that cover more than seventy percent (70%) of that area; 3.- The existence of more than sixty trees per hectare of fifteen or more centimeters in diameter measured at breast height (DBH), as defined in accordance with Article 3, subsection d), of the Forest Law No. 7575.
- f)Fee (Canon): Pecuniary consideration paid by the user for the special use and enjoyment of a public domain asset and the differential advantage obtained. Periodic payment to which one who makes use of a real estate property owned by the State obliges themselves during the term of a permit or contract.
- g)Training (Capacitación): An organized and planned activity aimed at improving the knowledge and skills of human resources in specific topics.
- h)Forest Certification (Certificación Forestal): Document issued by a duly accredited and qualified private entity which states that a forest management plan (plan de manejo) has been planned and executed in accordance with the principles, criteria, and indicators of sustainability established by the C.N.C.F. (By Article 5 of Executive Decree No. 33815 of February 15, 2007, it is established that where it refers to the acronym CNCF (National Commission for Forest Certification), hereinafter it shall be read as CNSF (National Commission for Forest Sustainability).
- i)Certificate of Origin (Certificado de Origen): Official form designed by the A.FE., in which the regent (regente), the responsible Municipal official or the Regional Environmental Council official, as appropriate, certifies once and for all that on a specific farm there is a plantation or an agroforestry system, which may be freely harvested.
- j)Forest Certifier (Certificador Forestal): Natural or legal person who has been accredited by the A.F.E. to audit the sustainability in the planning and execution of a forest management plan and to issue certification that it is so.
- k)Combination of Forest Species (Combinación de Especies Forestales): Combination in time and space of trees with annual crops, permanent crops, forage species, fruit trees, or others. This definition does not include shaded forests (bosques socolados), or heavily intervened forests where a space is opened that allows the establishment of forage or agronomic species. Among others, the following are considered agroforestry systems: windbreaks, pastures with planted trees or of natural regeneration provided the latter have been established after the cultivation, shade trees of permanent crops, and trees on fences.
- l)National Commission for Forest Sustainability (Comisión Nacional para la Sostenibilidad Forestal): Commission composed of representatives of scientific and economic promotion institutions, whose function is to recommend to the A.F.E. the sustainability guidelines for forest activity that guarantee a viable socioeconomic use of the forest resource, with minimal impact and within an institutional governance framework. Furthermore, another of its functions is to advise on the promotion, regulation, and control mechanisms inherent to sustainable forest management, including forest certification, according to the provisions of Article 6, subsection o) of the Forest Law No. 7575. (The previous term was reformed by Article 2 of Executive Decree No. 33815 of February 15, 2007).
- m)National Convenience (Conveniencia Nacional): Activities carried out by the centralized dependencies of the State, the autonomous institutions, or private enterprise, whose social benefits are greater than the socio-environmental costs. The balance must be made through the appropriate instruments. (The previous term was reformed by Article 114 of the Biodiversity Law No. 7788, of April 30, 1998).
- n)Ecotourism (Ecoturismo): A set of actions oriented toward maintaining a natural environment, with emphasis on its biological, physical, and cultural features; through a controlled process that guarantees minimum environmental impact, is ecologically sustainable; involves low-impact tourism activities; is locally beneficial and satisfactory for visitors.
- o)Primary Forest Industrialization (Industrialización primaria forestal): That activity which transforms forest products through the use of machinery, in a stationary, transitory, or portable form.
- p)Scientific Research (Investigación Científica): Any action, systematized or not and preferably with statistical significance, that generates biological, physical, geological, chemical, social, or human information about the environment, its ecosystems, and organisms, facilitating their conservation, management, and rational use by human beings.
- q)Squared Timber (Madera escuadrada): Dimensioned piece of wood, the result of subjecting a log to a mechanical transformation process, in which its rounded shape is modified, simulating four faces without notably altering its physiognomy.
- r)Use Permits (Permisos de Uso): Authorizations for the use of parts of State-owned land, for purposes that do not entail forest use (aprovechamiento forestal).
- s)Management Plan (Plan de Manejo): The planning instrument that allows guiding the management of a protected wild area toward the fulfillment of its long-term conservation objectives. It is based on medium-term strategic action lines and on management objectives for the natural and cultural elements included within the area, as well as on the relationship of the latter with their socio-environmental surroundings. It is the basis for the development of other planning and regulatory instruments for Protected Wild Areas.
- t)Forest Product (Producto forestal): Any log, block wood, veneers, agglomerates, matches, pulp, pallets, toothpicks, chips, furniture, doors, window frames, and moldings.
- u)Regent (Regente): Forest Professional authorized by the Association (Colegio), who in accordance with the laws and regulations assumes the supervision and control of the execution of the Forest Management Plans approved by the A.FE.
- v)Steep Land (Terrenos quebrados): Those having an average slope greater than forty percent (40%).
- w)Agricultural Land without Forest (Terrenos de uso agropecuario sin bosque): Those private farms with the presence of trees not established under an agroforestry system, or farms that have areas with forest cover (cobertura boscosa) smaller than two hectares, or those trees located in urban areas.
- x)Transfer Value of Log Timber (Valor de transferencia de madera en troza): The taxable base for the purposes of calculating the forest tax.
