1That with the ratification of the Convention on Wetlands of International Importance especially as Waterfowl Habitat by Law No. 7224 of April 9, 1991, Costa Rica acquired the commitment to effectively protect wetlands, promoting their conservation, adequate management, and care.
2That it is the policy of the Government of the Republic of Costa Rica to achieve the sustainable development of all areas declared as wetlands, both at the administrative level and among the general citizenry; conserving and protecting the country's natural resources and promoting economic and social development, through coordinated and uniform harmonious actions.
3That the Ramsar Convention urges the contracting parties to establish national wetlands committees under a governmental body.
4That Article 22 of the Biodiversity Law No. 7788 published in La Gaceta No. 101 of May 27, 1998, created the National System of Conservation Areas (SINAC), with instrumental legal personality, as a deconcentrated and participatory institutional management and coordination system, which integrates competencies in forestry, wildlife, and protected areas matters, in order to dictate policies, plan, and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
5That it is necessary to strengthen at the national level, the National Wetlands Program as a technical structure that specifically addresses issues related to wetland problems and facilitates planning processes for their management.
6That it is necessary to adapt and modernize the institutional structure regarding wetlands, in accordance with the implementation of the Ramsar Convention in Costa Rica. Therefore,

They decree:

"CREATION OF THE NATIONAL WETLANDS PROGRAM AND NATIONAL WETLANDS COMMITTEE AS THE IMPLEMENTING BODY OF THE RAMSAR CONVENTION WITHIN THE NATIONAL SYSTEM OF CONSERVATION AREAS AND REPEAL OF EXECUTIVE DECREES No. 22839-MIRENEM OF JANUARY 22, 1994 AND No. 28058-MINAE OF JULY 23, 1999"

Considering:

The National Wetlands Program shall be responsible for the execution of the agreements and guidelines emanating from the National Wetlands Committee, as well as other tasks assigned to it by said committee.

Other public entities, in the exercise of their competencies, must collaborate with the protection and management of wetlands.

a)The head of the Vice-Ministry of Waters, Seas, Coasts and Wetlands of the Ministry of Environment and Energy or their representative, who presides.
b)National Coordinator of the Administrative Authority of the Ramsar Convention hereinafter called the Convention.
c)Governmental National Coordinator of the Commission on Education and Public Awareness (CECOP) of the Convention.
d)Non-Governmental National Coordinator of the Commission on Education and Public Awareness (CECOP ONG) of the Convention.
e)National Coordinator of the Scientific and Technical Review Panel (GECT) of the Convention.
f)The Director of the National System of Conservation Areas or their representative.
g)The Director of the Environmental Management Center of the Costa Rican Electricity Institute or their representative.
h)The Executive President of the Costa Rican Institute of Fisheries and Aquaculture or their representative.
i)The Executive President of the National Institute of Innovation and Transfer in Agricultural Technology or their representative.
j)A representative of the Costa Rican Institute of Aqueducts and Sewers (AYA).
k)A representative of the Center for Research in Marine Sciences and Limnology of the University of Costa Rica (CIMAR).
l)The Director of Biological Sciences of the National University, or their representative.
m)A representative of the Indigenous peoples." (Previous subsection thus amended by Article 1 of Executive Decree No. 39700 of April 8, 2016) n) Two representatives of non-governmental organizations of the environmental sector, that develop projects related to wetlands.
o)The coordinator of the National Wetlands Program, who shall coordinate actions and ensure the execution of the agreements of the National Advisory Council on Wetlands. They shall also serve as the committee's Secretary.

The term of validity for designated members shall be for four years, except for the National Coordinators who shall be designated for the duration of their appointments to the representative posts before the Convention.

For the designation of the representatives of non-governmental organizations, the Minister of Environment and Energy shall issue a public call, by any written, radio, or digital means, to legally constituted non-governmental organizations that develop projects related to wetlands, so that they accredit a representative through a note from their respective legal representative. From those who apply, the Minister, based on accredited experience and developed projects related to the subject, shall elect the two representatives.

The National Advisory Council on Wetlands may include, in an advisory capacity, persons it deems convenient for its proper functioning. The Council shall decide, by unanimous agreement of its members, the designation and term of appointment of said advisors.

For the designation of the representative of the Indigenous peoples, the Minister of Environment and Energy shall issue a public call, by any written, radio, or digital means, to the Indigenous peoples of the country so that they accredit a representative, who demonstrates knowledge about wetlands, elected by them in accordance with their own procedures.

a)Advise and support the Minister of Environment and Energy and the other governmental entities responsible for its administration, in the promotion, education, planning, sustainable development, and rational use of wetlands.
b)Support the national CECOP coordinators to promote the development and execution of national and local communication, education, awareness, and participation programs and action plans directed at the rational and sustainable use of wetlands.
c)Collaborate with governmental bodies in the search for financial and logistical resources for the conservation and rational use of wetland areas.
d)Support actions for the national application of the Convention in Ramsar Sites and other wetland ecosystems and coordinate actions with the Secretariat of the Convention through the national coordinator and the Administrative Authority and other international entities, regarding wetlands matters.
e)Promote the identification of wetlands and support their inclusion in the list of Wetlands of International Importance (Ramsar List) with the prior designation of the Administrative Authority.
f)Manage technical assistance from experts for the preparation of National Reports before the Conference of the Contracting Parties so that the national coordinator performs the compilation.
g)Coordinate assistance from experts for advice on the subject of wetlands through the National GECT Coordinator, for the preparation of technical documents on various aspects related to the matter.
h)Collaborate with the National System of Conservation Areas and the National Wetlands Program through the justification mechanisms and the Management Guidance Procedure, in the case of inclusion in or removal from the Montreux Record of Ramsar sites, upon changes in ecological characteristics, which must be communicated to the Convention by the Administrative Authority.
i)Follow up on the application of the Resolutions and Recommendations adopted by the Conference of the Contracting Parties of Ramsar.
j)Any other functions on the matter assigned to it by the Minister of Environment and Energy.
k)Collaborate and advise on the implementation of the National Wetlands Policy.

Likewise, the Ministries and State Institutions, with the authority to do so, are authorized to collaborate with technical, administrative, and financial resources with the National Wetlands Program." (Thus amended by Article 1 of Executive Decree No. 39161 of April 29, 2015 )

1Que con la ratificación de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas mediante Ley Nº 7224 del 9 de abril de 1991, Costa Rica adquirió el compromiso de proteger efectivamente los humedales, fomentando su conservación, adecuado manejo y cuidado.
2Que es política del Gobierno de la República de Costa Rica lograr el desarrollo sostenible de todas las áreas declaradas como humedales, tanto a nivel de la administración como de la ciudadanía en general; conservando y protegiendo los recursos naturales del país y fomentando el desarrollo económico y social, mediante acciones armónicas coordinadas y uniformes.
3Que la Convención de Ramsar insta a las partes contratantes, al establecimiento de comités nacionales de humedales bajo un organismo gubernamental.
4Que el artículo 22 de la Ley de Biodiversidad Nº 7788 publicada en La Gaceta Nº 101 del 27 de mayo de 1998, creó el Sistema Nacional de Áreas de Conservación (SINAC), con personalidad jurídica instrumental, como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre y áreas protegidas, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
5Que se hace necesario fortalecer a nivel nacional, el Programa Nacional de Humedales como estructura técnica que atienda específicamente lo relacionado con la problemática de los humedales y que facilite los procesos de planificación para el manejo de los mismos.
6Que es necesario adaptar y modernizar la estructura institucional en materia de humedales, acorde a la implementación de la Convención de Ramsar en Costa Rica. Por tanto,

"CRÉASE EL PROGRAMA NACIONAL DE HUMEDALES Y COMITÉ NACIONAL DE HUMEDALES COMO ÓRGANO IMPLEMENTADOR DE LA CONVENCIÓN DE RAMSAR DENTRO DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y DEROGATORIA DE LOS DECRETOS EJECUTIVOS Nº 22839-MIRENEM DEL 22 ENERO DE 1994 Y Nº 28058-MINAE DEL 23 DEL JULIO DE 1999"

Considerando:

Decretan:

El Programa Nacional de Humedales tendrá a su cargo la ejecución de los acuerdos y lineamientos que emanen del Comité Nacional de Humedales, así como los demás cometidos que le encomiende dicho comité.

Los demás entes públicos, en el ejercicio de sus competencias, deberán colaborar con la protección y manejo de los humedales.

a)El (la) titular del Viceministerio de Aguas, Mares, Costas y Humedales del Ministerio del Ambiente y Energía o su representante, quien preside.
b)Coordinador Nacional de la Autoridad Administrativa de la Convención de Ramsar en adelante llamada Convención.
c)Coordinador Nacional Gubernamental de la Comisión de Educación y Concientización del Público (CECOP) de la Convención.
d)Coordinador Nacional No Gubernamental de la Comisión de Educación y Concientización del Público (CECOP ONG) de la Convención.
e)Coordinador Nacional del Grupo de Examen Científico Técnico (GECT) de la Convención.
f)El (la) Director(a) del Sistema Nacional de Áreas de Conservación o su representante.
g)El (la) Director(a) del Centro de Gestión Ambiental del Instituto Costarricense de Electricidad o su representante.
h)El (la) Presidente(a) Ejecutivo del Instituto Costarricense de Pesca y Acuicultura o su representante.
i)El (la) Presidente(a) Ejecutivo del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria o su representante.
j)Un representante del Instituto Costarricense de Acueductos y Alcantarillados (AYA).
k)Un representante del Centro de Investigación en Ciencias del Mar y Limnología de la Universidad de Costa Rica (CIMAR).
l)El Director de Ciencias Biológicas de la Universidad Nacional, o su representante.
m)Un representante de los pueblos Indígenas." (Así reformado el inciso anterior por el artículo 1° del decreto ejecutivo N° 39700 del 8 de abril de 2016) n) Dos representantes de las organizaciones no gubernamentales del Sector ambiental, que desarrollen proyectos que tengan relación con los humedales.
o)El (la) coordinador(a) del Programa Nacional de Humedales, quien coordinará las acciones y velará la ejecución de los acuerdos del Consejo Nacional Asesor sobre Humedales. Así mismo llevará la Secretaría del comité.

El periodo de vigencia de los miembros designados será por cuatro años, excepto de los Coordinadores Nacionales que serán designados por el periodo que duren sus nombramientos en los puestos representativos ante la Convención.

Para la designación de los representantes de las organizaciones no gubernamentales, el Ministro de Ambiente y Energía realizará una convocatoria pública, por cualquier medio escrito, radiofónico o digital, a las organizaciones no gubernamentales legalmente constituidas y que desarrollen proyectos que tengan relación con los humedales; para que acrediten un representante a través de una nota de su respectivo representante legal. De quienes postulen, el Ministro con base en la experiencia acreditada y proyectos desarrollados relacionados con el tema, elegirá a los dos representantes.

El Consejo Nacional Asesor sobre Humedales podrá integrar en carácter de asesores, a las personas que estime conveniente para el buen funcionamiento del mismo. El Consejo decidirá, mediante acuerdo unánime de sus miembros, la designación y periodo de nombramiento de dichos asesores.

Para la designación del representante de los pueblos indígenas, el Ministro de Ambiente y Energía realizará una convocatoria pública, por cualquier medio escrito, radiofónico o digital, a los pueblos indígenas del país para que acrediten un representante, que demuestre tener conocimiento sobre los humedales, elegidos por ellos de conformidad con sus propios procedimientos.

a)Asesorar y apoyar al Ministro(a) de Ambiente y Energía y los otros entes gubernamentales encargados de su administración, en la promoción, educación, planificación, desarrollo sostenible y uso racional de los humedales.
b)Apoyar a los coordinadores nacionales de CECOP para promover el desarrollo y la ejecución de los programas y planes de acción nacional y locales de comunicación, educación, concienciación y participación dirigidos al uso racional y sustentable de los humedales.
c)Colaborar con las instancias gubernamentales en la búsqueda de recursos financieros y logísticos para la conservación y el uso racional de las áreas de humedal.
d)Apoyar las acciones para la aplicación nacional de la Convención en Sitios Ramsar y demás ecosistemas de humedal y coordinar acciones con la Secretaría de la Convención a través del coordinador nacional y la Autoridad Administrativa y otros entes internacionales, en materia de humedales.
e)Promover la identificación de humedales y apoyar su inclusión en la lista de Humedales de Importancia Internacional (Lista de Ramsar) con la previa designación de la Autoridad Administrativa.
f)Gestionar la ayuda técnica de expertos para la preparación de los Informes Nacionales ante la Conferencia de las Partes Contratantes para que el coordinador nacional realice la compilación.
g)Coordinar la ayuda de expertos para el asesoramiento en el tema de humedales a través del Coordinador Nacional GECT, para la preparación de documentos técnicos sobre diversos aspectos relacionados con la materia.
h)Colaborar con el Sistema Nacional de Áreas de Conservación y el Programa Nacional de Humedales mediante los mecanismos de justificación y el Procedimiento de Orientación para la Gestión, en el caso de inclusión o exclusión de sitios Ramsar en el registro Montreux, al presentarse cambios en las características ecológicas, el cual debe ser comunicado a la Convención por la Autoridad Administrativa, i) Dar seguimiento a la aplicación de las Resoluciones y Recomendaciones adoptadas por la Conferencia de las Partes Contratantes de Ramsar.
j)Los demás que sobre la materia le señale el Ministro(a) de Ambiente y Energía.
k)Colaborar y asesorar en la implementación de la Política Nacional de Humedales.

Artículo 1 — The National Wetlands Program is created within the National System of Conservation Areas of the Ministry of Environment, Energy and Telecommunications, with the purpose of promoting, planning, and developing the Wetlands of Costa Rica.

Artículo 2 — The administration, protection, and management of wetlands shall be the responsibility of the National System of Conservation Areas through its eleven Conservation Areas.

Artículo 3 — The head of the Ministry of Environment and Energy shall have a National Advisory Council on Wetlands, which shall be composed of the following authorities:

Artículo 4 — The National Advisory Council on Wetlands shall have the following functions:

Artículo 6 — Repeal Executive Decree No.

Artículo 7 — It takes effect upon its publication in the Official Gazette La Gaceta.

Artículo 1 — Créase dentro del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente, Energía y Telecomunicaciones el Programa Nacional de Humedales, con la finalidad de promover, planificar y desarrollar los Humedales de Costa Rica.

Artículo 2 — La administración, protección y manejo de los humedales estará a cargo del Sistema Nacional de Áreas de Conservación a través de sus once Áreas de Conservación.

Artículo 3 — El (la) titular del Ministerio del Ambiente y Energía, contará con un Consejo Nacional Asesor sobre Humedales, que estará integrado por las siguientes autoridades:

Artículo 4 — El Consejo Nacional Asesor de Humedales, tendrá las siguientes funciones:

Artículo 6 — Deróguese el Decreto Ejecutivo Nº 22839-MIRENEM del 22 enero de 1994 y el Decreto Ejecutivo Nº 28058-MINAE del 23 del julio de 1999.

Artículo 7 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
