in the entirety of the text - Complete Text of Norm 37223 Declaration of public interest of the visit to Costa Rica of the Ramsar Technical Mission to evaluate the infrastructure works in the northeast Caribbean wetland and the 1856 Juan Rafael Mora Porras Route Complete Text file: E6BBB Nº 37223-2012 RE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FOREIGN AFFAIRS AND WORSHIP Exercising the powers conferred by articles 140 and 146 of the Political Constitution and articles 27, subsection 1) and 28 subsections 1 and 2.b of the General Law of Public Administration.
1. That Executive Decree Nº 36440-MP dated February 21, 2012, by which the "situation and process triggered by the violation of Costa Rican sovereignty by Nicaragua is declared a State of Emergency," establishes in its article 3 the possibility of carrying out all actions and works necessary for the protection of life, physical integrity, property, and the environment located within the coverage area (cantons bordering Nicaragua: La Cruz, Upala, Los Chiles, Sarapiquí, San Carlos, and Pococí).
2. That Executive Decree Nº 36427-MINAET dated January 25, 2011, by which the "National Wetlands Program and National Wetlands Committee are created as the Implementing Body of the Ramsar Convention within the National System of Conservation Areas and Executive Decrees Nº 22839 of 01/22/1994 and Nº 28058 of 07/23/1999 are repealed," first establishes in its article 4 that the National Wetlands Committee has the functions of supporting SINAC in the inclusion and exclusion of Wetlands on the list of the Ramsar Convention, where their resources are in danger of change or disappearance, for application of the Montreux Record and the Management Guidance Procedure, as established in the Ramsar Convention, as well as monitoring the application of Resolutions and Recommendations adopted by the Conference of the Contracting Parties of the Ramsar Convention. Furthermore, its provision 5 establishes that the Ministries and State Institutions, with authority to do so, are authorized to collaborate with technical, administrative, and financial resources with the National Wetlands Program.
3. That Costa Rica has carried out some infrastructure works in the Northeast Caribbean Wetland in application of the provisional measures indicated by the International Court of Justice, including the construction of posts for personnel of the Ministry of Public Security and the Ministry of Environment, Energy, and Telecommunications, as well as the construction of watchtowers. These works were duly reported to the Secretariat of the Convention, and it was invited to visit the site to verify them.
4. That the Minister of Foreign Affairs and Worship received a note from the Secretary General of the Ramsar Convention, dated December 19, 2011, indicating that he had received a complaint from Nicaragua to the effect that the construction of the 1856 Juan Rafael Mora Porras Route was causing damage to the Northeast Caribbean Wetland and its biodiversity. Costa Rica responded to this note in January 2012, rejecting the Nicaraguan accusation and, as a gesture of transparency, inviting the Secretariat to designate a technical team that could come to Costa Rica to verify the situation of the wetland. This invitation was reiterated through another subsequent note in February 2012.
5. That in mid-June 2012, the Foreign Ministry received a note from the Ramsar Secretariat indicating its interest in visiting Costa Rica to verify both the construction of the 1856 Juan Rafael Mora Porras Route and the works being carried out in the Northeast Caribbean Wetland. However, the Secretariat points out that given that "we are closing the triennium, on this occasion the costs of the mission would have to be borne by the Government of Costa Rica." 6. That the Ministry of Foreign Affairs and Worship considers that the visit of the technical team of the Ramsar Secretariat is of the greatest national interest, both because there is an obligation under the Ramsar Convention to report changes that may occur to internationally protected wetlands and in this sense it is appropriate for the Secretariat to verify and advise on those changes that may occur in the Northeast Caribbean Wetland, and because of the Nicaraguan accusation regarding the construction of the 1856 Juan Rafael Mora Porras Route.
THEY DECREE:

1. Que el Decreto Ejecutivo Nº 36440-MP de fecha 21 de febrero del 2012, mediante el cual se "Declara Estado de Emergencia la situación y el proceso desencadenado ante la violación de la soberanía costarricense por parte de Nicaragua", establece en su artículo 3 la posibilidad de llevar a cabo todas las acciones y obras necesarias para la protección de la vida, la integridad física, los bienes y el ambiente que se ubiquen dentro de la zona de cobertura (cantones, limítrofes con Nicaragua, de la Cruz, Upala, Los Chiles, Sarapiquí, San Carlos y Pococí) 2. Que el Decreto Ejecutivo Nº 36427-MINAET de fecha 25 de enero del 2011, mediante el cual se "Crea el Programa Nacional de Humedales y Comité Nacional de Humedales como Órgano Implementador de la Convención de Ramsar dentro del Sistema Nacional de Áreas de Conservación y deroga Decretos Ejecutivos Nº 22839 del 22/01/1994 y Nº 28058 del 23/07/1999", primeramente establece en su artículo 4 que el Comité Nacional sobre Humedales, tiene como funciones apoyar al SINAC en la inclusión y exclusión de Humedales en la lista de la Convención de Ramsar, donde sus recursos corran peligro de cambio o desaparición, para aplicación del Registro de Montreux y el Procedimiento de Orientación para la Gestión, según lo establecido en la Convención de Ramsar, así como dar seguimiento a la aplicación de las Resoluciones y Recomendaciones adoptadas por la Conferencia de las Partes Contratantes de la Convención de Ramsar. Por otra parte su numeral 5 establece que quedan autorizados los Ministerios e Instituciones del Estado, con facultades para ello, a colaborar con recursos técnicos, administrativos y financieros con el Programa Nacional de Humedales.
3. Que Costa Rica ha realizado algunas obras de infraestructura en el Humedal Caribe Noreste en aplicación de las medidas provisionales indicadas por la Corte Internacional, entre ellas la construcción de puestos para el personal del Ministerio de Seguridad Pública y del Ministerio de Ambiente, Energía y Telecomunicaciones, así como la construcción de torres de vigilancia. Estas obras fueron oportunamente informadas a la Secretaría de la Convención, y se le invitó a visitar el sitio para que las verificaran.
4. Que el Ministro de Relaciones Exteriores y Culto recibió una nota del Secretario General de la Convención de Ramsar, con fecha de 19 de diciembre de 2011, indicando que había recibido una denuncia de parte de Nicaragua en el sentido de que la construcción de la Ruta 1856 Juan Rafael Mora Porras estaba causando daño al Humedal Caribe Noreste y a su biodiversidad. Costa Rica respondió a esta nota en enero de 2012, rechazando la acusación nicaragüense y, como gesto de transparencia, invita a que la Secretaría designe un equipo técnico que pueda venir a Costa Rica para verificar la situación del humedal. Esta invitación se reiteró mediante otra nota posterior de febrero de 2012.
5. Que a mediados de junio de 2012 la Cancillería recibió una nota de la Secretaría de Ramsar indicando su interés en visitar Costa Rica para verificar tanto la construcción de la Ruta 1856 Juan Rafael Mora Porras, como las obras que se realizan en el Humedal Caribe Noreste. No obstante, la Secretaría hace ver que dado que "estamos cerrando el trienio, en esta oportunidad los costos de la misión tendrían que ser asumidos por el Gobierno de Costa Rica".
6. Que el Ministerio de Relaciones Exteriores y Culto considera que la visita del equipo técnico de la Secretaría de Ramsar es del mayor interés nacional, tanto porque existe una obligación bajo la Convención de Ramsar de informar cambios que se pueden producir a humedales internacionalmente protegidos y en este sentido es apropiado que la Secretaría verifique y asesore sobre esos cambios que se puedan producir en el Humedal Caribe Noreste, como por la acusación nicaragüense en relación con la construcción de la Ruta 1856 Juan Rafael Mora Porras.
