2 ) On 13 de diciembre de 2021, the plaintiff filed this proceeding, seeking the following relief: “1. That the defendants be ordered to establish the true boundaries of the Laguna Pochotal ecosystem, in accordance with the actual biophysical, ecological, and legal characteristics of these ecosystems, correcting the boundaries indicated in Executive Decree No.34507, published in La Gaceta No. 104 on 30 de mayo de 2008. 2. That the immediate removal of all artificial channels draining the Laguna Pochotal wetlands and surrounding areas be ordered. 3. That the defendants be ordered to conduct modeling to guide the flow and drainage of the waters in a manner similar to that existing before the alteration caused by these anthropogenic actions. 4. That intervention in Laguna Pochotal be ordered to restore its open-water surface (espejo de agua). 5. That SINAC be ordered to exercise stricter and more regular monitoring to prevent the continued degradation of these wetlands. 6.
That the Dirección de Aguas be ordered to conduct a retrospective analysis of the fluvial dynamics of Playa Hermosa. 7. That the defendants be ordered to determine, through technical means, which properties encroach upon the protection area (área de protección) of the Laguna Pochotal wetland. 8. That the defendants be ordered to pay both categories of costs (ambas costas) of this judicial proceeding.” (images 23 to 24 of the judicial case file).
With respect to the disputed facts, the Court identified, as to SINAC, those numbered 1 through 4, 6, and 9 through 11, and, as to the State’s representation, those numbered 1 through 6 and 9 through 11. All documentary evidence offered by the plaintiff was admitted, as was the testimony of Juan José Sánchez Ramírez, Coordinator of the Technical Department of the Tribunal Ambiental Administrativo, and Paola Alvarado Lezama. Of the evidence submitted by SINAC, all documentary evidence was admitted, as was the testimony of officials Jacklyn Rivera Wong, Coordinator of the Wetlands Program, and Carlos Vinicio Cordero Valverde, an official of the Oficina Subregional de Orotina. All evidence submitted by the State was also admitted. (audio recording from minute 00:21:204 to 01:28:44). The hearing was concluded, and the matter was ordered transferred to the Oral and Public Trial Section. (minutes at images 400-404 of the judicial case file and audio recording of the preliminary hearing).
(images 448 to 583 of the judicial case file). After granting the respective hearings, the Court admitted the evidence, except for the ruling of the Constitutional Chamber. The claims for relief were reaffirmed, and the admitted testimonial evidence was heard. At 10:15 hours, the Court began receiving testimony from Biologist Juan José Sánchez and Ms. Paola Alvarado Lezama. (audio recording from minute 14:02 to 15:14 and from minute 14:05 to 14:44). The trial hearing continued on 28 de julio de dos mil veinticuatro, and at 08:40 hours the Panel of Judges convened in Courtroom N°2. After confirming the parties’ attendance, the testimony of Ms. Jacklin Rivera Wong began at 8:48 (audio recording from 8:48 to 11:24), and Mr. Carlos Vinicio Cordero Valverde began at 13:10. The plaintiff then requested that the testimony of Mr. Julio Solano be admitted as evidence for the Court’s better adjudication and that a judicial inspection (reconocimiento judicial) be conducted.
After the parties were granted a hearing on the motion filed, the Court denied the request and stated its reasons. (audio recording from minute 14:26 to 14:42 and from minute 14:46 to 14:48). In view of the length and technical nature of the evidence to be assessed, the Court asked the parties whether they agreed to submit their closing arguments in writing. The parties agreed. (audio recording from 14:42 to 14:45). The direction previously issued to the plaintiff concerning certification of his registration as an attorney was reiterated, and the plaintiff complied. Subsequently, biologist Sánchez Ramírez issued Inspection Report TAA-DT-002.2021 dated 7 de enero de 2021, in which he identified a series of problems affecting the Laguna Pochotal ecosystem and set forth a series of recommendations for the preservation and protection of that ecosystem. These included the following: “1. Urgently request that the DA conduct a retrospective analysis of the river dynamics of Playa Hermosa and consider correcting the opinion issued in official communication DA-UHTPCOSR-0363-2020. 2. Given that there was never a natural drainage channel discharging water from the Laguna Pochotal wetland at GPS point 417, that channel and water discharge must be eliminated because it is altering the dynamics of these wetlands. 3. Likewise, all artificial channels that drain the wetlands in the area must be eliminated. 4. Conduct modeling to redirect the flow and drainage of the water in a manner similar to, or as it occurred before, the modification caused by anthropogenic actions (acciones antrópicas). 5.
Intervene in Laguna Pochotal to restore its water surface (espejo de agua), bearing in mind that this lagoon has always been a seasonal wetland. 6. Verify whether the lagoon area has been duly recorded in the Property Registry (inscrita a derecho), because both the registered-cadastre information and the cadastral information of the Municipalidad de Garabito show that this land is unregistered. 7. A large number of properties along the wetland identified in the RNH and associated with the Laguna wetland are registered as private property and would be subject to restrictions against developments contrary to the nature of such lands. 8. ACOPAC must exercise stricter and more periodic monitoring to prevent the continued deterioration of these wetlands. 9. ACOPAC must advise both the Municipalidad de Garabito and SETENA of the necessary interinstitutional coordination that must exist in order to prevent the modification or elimination of the Playa Hermosa wetlands. 10.
ACOPAC must proceed to correct the scope of DE Nº34507, published in La Gaceta Nº104 of 30 de mayo de 2008, in accordance with the foregoing explanation.” On 5 de febrero de 2021, the claimant requested that the Dirección Ejecutiva del Sistema Nacional de Áreas de Conservación implement the recommendations of Inspection Report TAA-DR-002-2021 dated 7 de enero de 2021; on 14 de octubre de 2021, he initiated proceedings for application of article 35 subsection 1) of the Código Procesal Contencioso Administrativo, hereinafter CPCA, seeking performance of the omitted conduct (conducta omisiva) consisting of implementing the recommendations set forth in report TAA-DR-002-2021; and on 23 de noviembre de 2021, he requested that the Dirección General de Aguas del Ministerio de Ambiente y Energía conduct a retrospective analysis of the river dynamics of Playa Hermosa and consider correcting the opinion issued in official communication DA-UHTPCOR-0363-2020, both of which were recommendations contained in report TAA-DT-02-2021 prepared by biologist Juan José Sánchez.
He concludes that, as of the date the claim was filed, neither SINAC nor the State had implemented the report’s recommendations, thereby constituting an omission. In the section entitled “Legal Considerations,” he stated that national legislation requires the Costa Rican State to implement public policies aimed at protecting the environment. He asserted that article 1 and article 2 subsection c) of the Ley Orgánica del Ambiente provide the State and public institutions with instruments enabling them to enforce the constitutional right to a healthy and ecologically sustainable environment established in section 50 of the Constitución Política. Costa Rica ratified the Convention on Wetlands of International Importance Especially as Waterfowl Habitat, known as the Ramsar Convention, approved through ley 7224 of 7 de abril de 1991. Article 3.1 of that Convention establishes a legal commitment by the Contracting Parties to apply, wherever possible and in accordance with ecological characteristics, the wise use of wetlands (uso racional de los humedales); such wise use may be understood as the conservation and sustainable use of wetlands and the services they provide for the benefit of people and nature.
He stated that the Ley Orgánica del Ambiente constitutes the legal framework governing wetlands: article 40 defines them, while section 41 subsection d) declares them to be of public interest and section 32 subsection f) classifies them as protected wildlife areas (áreas silvestres protegidas). He transcribed the provisions of section 7 of the Ley de Conservación de Vida Silvestre and section 45 of the Ley de Biodiversidad, rules that clearly impose upon the Costa Rican State the duty to undertake the prevention and preservation of the environment and recognize the ecological value of wetlands as protected wildlife areas. He stated that the principle of lifetime tenure (irreductibilidad) is intended to prevent the reduction, diminishment, removal of protected status (desafectación), exclusion, segregation, and limitation of natural areas subject to a special legal protection regime because they contain ecosystems, including: forests located on private land, wetlands (mangroves), protected wildlife areas (ASP), indigenous territories, the containment ring of the Gran Área Metropolitana (GAM), and all lands forming part of the Patrimonio Natural de Estado (PNE).
He asserted that this principle seeks to maintain essential ecological processes and is grounded in the Convenio de Diversidad Biológica, the Ley de Biodiversidad, and its Reglamento, which embody the Malawi Principles for the Ecosystem Approach (Enfoque de Ecosistemas de Malawi). (He transcribed Artículo 3 subsection d) of the Reglamento de la Ley de Biodiversidad.) He considered that, in this case, the current conditions of the Laguna Pochotal wetland ecosystem are deteriorating, which constitutes a violation of the principle of lifetime tenure, because its territory is larger than that established in Decreto Ejecutivo Nº 34507; consequently, the State and SINAC must establish the true boundaries of this wetland in accordance with the actual biophysical, ecological, and legal characteristics of the ecosystem in order to provide adequate protection for the State’s natural heritage (patrimonio natural del Estado).
Regarding the omission, he asserted that, although Public Administration technical personnel have determined that human activity has altered the Laguna Pochotal wetland and its surroundings, as detailed in Inspection Report TAA-DT-002-2021 prepared by official Sánchez Ramírez, which set forth a series of recommendations, no concrete actions have been taken to prevent further alteration. He stated that, despite the existence of technical evidence, inspections, and official communications concerning the environmental danger affecting the area, SINAC and the State have not ordered concrete measures to protect this ecosystem or oversee urban development projects (proyectos urbanísticos) that could alter the area. He concluded that Decreto Ejecutivo Nº 34507 records an area smaller than the area actually covered by the Laguna Pochotal wetland ecosystem because it includes only the water surface, and that the respondents urgently need to establish the true boundaries of the area, which had not been done as of that date.
He requested compliance with the recommendations contained in report TAA-DT-002-2021, which had not occurred despite the passage of several months. For this reason, he initiated proceedings requesting the application of article 35 subsection 1) of the Código Procesal Contencioso Administrativo. (images 11 through 24 of the court record).
It went on to state that the mere publication of the ecosystems on the official SNIT platform makes the information concerning this and all wetlands official information. It also stated that Article 42 of the Ley Orgánica el Ambiente establishes the demarcation of protected areas (zonas protegidas) as a discretionary action of MINAE, and that SINAC has undertaken a series of actions to prepare a national wetlands inventory and use it to populate the information in SNIT, including information on the Laguna Pochotal wetland. Regarding SINAC’s fulfillment of its duty to protect (tutela) the Laguna Pochotal wetland, it stated that strict and periodic monitoring of the wetland has been conducted, as shown by official letter SINAC-ACOPAC-OSRO-204-2021, which describes actions to restore the palustrine area through environmental-damage reports filed with the Fiscalía Agrario Ambiental and complaints filed with the Tribunal Ambiental Administrativo.
That same official letter stated that report TAA-DT-002-2021 was prepared as a follow-up to other complaints filed in the area, for the purpose of presenting technical evidence for restoring the wetlands in the area. That official letter also clarified that the Programa de Humedales has designed an Institutional Roadmap to be led by the Oficina Subregional de Orotina in order to protect Laguna Pochotal and the adjacent wetlands. It argued that documentation dating from 2016 demonstrates that SINAC has taken action regarding the Laguna Pochotal wetland and that official letter SINAC-ACOPAC-OSRO-204-2021 attests to the oversight actions, specifically the complaints filed with the Fiscalía and the Tribunal Ambiental Administrativo. It stated that, in rulings 2020014031 of 24 de julio de 2020 and 2020016209 of 28 de agosto de 2020, the Sala Constitucional de la Corte Suprema de Justicia referred to official letters sent to the Municipalidad de Garabito for action within the scope of its local-government functions, as well as to the effects and scope of official letter SINAC-ACOPAC-CUSP-PMC-114-2016 in connection with SINAC-SE-IRT-130, which document the correction of the boundaries of Laguna Pochotal and have official effect because they were published in SNIT.
As may be seen from the foregoing points, the very evidence submitted by the plaintiff and the cited judgments of the high constitutional court attest to compliance with the required conduct: inter-institutional coordination to prevent works that place the Playa Hermosa wetlands at risk, as well as the strict and periodic monitoring conducted by ACOPAC at this wetland and the correction of the scope of Decreto Ejecutivo N°34507. As has already been demonstrated before the high constitutional court, the plaintiff is aware of these actions; nevertheless, for practical purposes, official letters SINAC-ACOPAC-CUSB-PMC-114-2016 and SINAC-SE-IRT-130 are attached as documentary evidence. Documents from judicial case file number 21-000042-0611-PE, duly certified under reference number SINAC-ACOPAC-OSRO-224-2022, are also attached, proving that the party represented by counsel has filed the relevant complaints with the Fiscalía concerning unauthorized interventions in the Laguna Pochotal wetland.
Official letter SINAC-ACOPAC-D-253-2022 is also attached, by which the Dirección del Instituto Geográfico Nacional was asked to provide a cartographic survey report for the follow-up of criminal cases 19-000056-611-PE and 21-000015-0611-PE concerning the filling, drainage, and drying of the Laguna Pochotal wetland ecosystem and adjacent wetlands located in Playa Hermosa, as well as to follow up on official letters DA-UHTPCOSJ-0413-2022 and TAA-DT-002-2021, which are part of the subject matter of this litigation. In view of the foregoing, dismissal of the complaint is requested, with the defense that the complaint is legally untenable (demanda improponible) being upheld pursuant to Article 220 of the CPCA, under which matters not provided for in that code are governed by the principles of public law and procedural law generally. Consequently, pursuant to Article 35.5 of the Código Procesal Civil, hereinafter CPC, it is requested that the complaint be dismissed as manifestly legally untenable.
No further reference is made to this defense because it was resolved by an interlocutory ruling. It raised the defense of lack of legal grounds (excepción de falta de derecho). (images 187 through 195 of the judicial case file).
B-2) THE STATE: With respect to the allegations in the complaint, it admitted the seventh and eighth and denied the first, second, third, fourth, fifth, sixth, ninth, tenth, and eleventh. Regarding the Administration’s liability, it stated that an erroneous causal link (nexo causal) was being drawn between the Administration’s inaction and the environmental damage alleged by the plaintiff. It considered that, in this case, it was erroneous to presume that the alleged damage to the lagoon was due to purported failures to act by the Administration without establishing any connection between the two, an assertion that was, moreover, false. It stated that the plaintiff neither specified nor proved the alleged failures to act that resulted in the claimed damage, but merely reproduced national environmental laws without conducting the factual and legal analysis necessary to support its claims.
It stated that this action is based on an alleged failure by the State and SINAC because the advisory opinion of Biologist Juan Sánchez Ramírez of the Departamento Técnico del Tribunal Ambiental Administrativo, contained in report TAA-DT-002-2021 of 7 de enero de 2021, was not implemented, and that those recommendations were an important input to be considered by the Administration but were not intended to constitute an exhaustive list of specific actions to be performed within the period deemed appropriate by the claimant. It stated that, following that report, SINAC carried out follow-up and study activities in the area; that the claimant’s own evidence demonstrates that the State made efforts to address the situation; and that evidence was submitted concerning those inspections, actions, and studies conducted in the Laguna Pochotal area. It stated that Article 190 of the Ley General de la Administración Pública (LGAP) does not establish strict liability (responsabilidad objetiva) for the public Administration, because there is no attribution of the act and no legal and financial imputation arising from the causal link between the subjectively liable agent and the objectively liable entity or party, circumstances that are not present in this proceeding. [Decisions of the Tribunal Contencioso Administrativo are reproduced: 69-2016, 102-2012, 18-2010, and 218-2008].
It further stated that the action does not meet the essential requirements for establishing liability because no inaction occurred and, additionally, there is no causal link connecting the State’s alleged failures to act; therefore, the environmental damage alleged by the plaintiff did not occur. It stated that it is unreasonable to accept the proposition that the State is liable for any damage caused to the environment, even under a theory of strict liability, because this type of liability is excepted in cases in which the Administration has taken steps to address the situation in the area. It stated that the action failed to establish that the Administration committed any omissions and that the alleged damage is not linked or connected to any inaction by the State, which is an essential requirement. It stated that, in any event, the strict liability of the public Administration under Article 190 of the Ley General de Administración Pública (LGAP), had it arisen through omission, provides for the relevant actions in cases falling outside the State’s control, since report TAA-DT-002-2021 of 7 de enero de 2021 itself sets forth a list of privately owned properties located within the area covered by the report. [Voto 099 of 16 horas del 30 de marzo de 2001 of this Tribunal is reproduced].
It concluded that, because the alleged facts were untrue, there was no infringement or inaction attributable to the State; it requested that the defense of lack of legal grounds be upheld and that the complaint be dismissed. (images 247 through 253 of the judicial case file).
At the supplemental hearing, SINAC’s representative requested the admission, as evidence to assist the Court in reaching a decision, of official letter SINAC-ACOPAC-CH-0010-2023 dated 09 de marzo del 2023, “Opinion on the Laguna Pochotal Wetland Located in the Playa Hermosa Sector, Garabito, Puntarenas”; official letter SINAC-ACOPAC-CH-0019-2023 of 05 de abril de 2023, “Variations in the Area of the Laguna Pochotal Wetland and Its Classification”; and SINAC-ACOCAP-CH-0062-2023 of 25 de setiembre del 2023, “Supplement to the Opinion on the Laguna Pochotal Wetland, Located in the Playa Hermosa Sector, Jacó, Garabito, Puntarenas.” Evidence to assist the Court in reaching a decision refers to a discretionary power that the judicial authority may exercise when an issue submitted for litigation requires further information or clarification. It must be noted that the parties may not use this type of evidentiary submission to remedy omissions concerning the offering of evidence, including when such evidence was not offered at the proper procedural stage.
In Voto 000655-F-S1-2021, issued at catorce horas treinta y cinco minutos del dieciocho de marzo del dos mil veintiuno, the Sala Primera de la Corte Suprema de Justicia stated in this regard: “(...) Accordingly, evidence to assist the Court in reaching a decision is a mechanism designed to allow the judge, once the ordinary evidence has been received, to request evidence that, although relevant to the proceeding, was not offered by the parties, or that, although offered, was declared incapable of being received, void, rejected as untimely or inadmissible, or even concerns facts deemed admitted due to the defendant’s default. This is a power of the Tribunal, not of the parties, and the parties may not use it to remedy their omissions regarding evidence that they could have offered at the proper procedural stage but did not.(...)” In the Tribunal’s view, the evidence offered is relevant and necessary because those technical reports were issued after the filing of the complaint and concern the Laguna Pochotal wetland and its current condition; they are therefore admitted as evidence to assist the Court in reaching a decision.
It is clarified that those official letters are admitted, but not judgment 2023028467 of the Sala Constitucional de la Corte Suprema de Justicia, issued at nueve horas cuarenta y cinco minutos del tres de noviembre de dos mil veintitrés. (images 449-550 of the judicial case file).
Based on the documentary evidence admitted in this proceeding and the testimonial evidence received, the following relevant facts applicable to the complaint are deemed proven.
To ensure the long-term permanence of this highly fragile ecosystem, constant monitoring of the area is necessary so as to prevent it from sustaining any type of damage, the drainage of its waters, which would further impact it, or other activities that could affect it. 4. Use this technical study as the basis for the complete delineation of the ecosystem. 5. The delineation of the wetland must take into account sampling during the rainy and dry seasons in order to observe its dynamics. This will make it possible to identify permanent and intermittent bodies of water and to categorize in greater detail the soil drainage and flood-risk parameters.(...)” (images 551 through 553 of the court record).
Establish a configuration that allows the flow and drainage of the waters to be redirected in a manner similar to that which existed before the alteration caused by anthropogenic actions (acciones antrópicas). 5. Intervene in Laguna Pochotal to restore its open-water surface (espejo de agua), bearing in mind that this lagoon has always been a seasonal wetland. 6. Verify whether the lagoon area has been lawfully recorded in the registry, because both the cadastral-zone information and the cadastral information of the Municipalidad de Garabito show this land as unregistered. 7. A large number of properties along the wetland identified in the RNH and associated with the lagoon wetland are registered as private property and would be subject to restrictions on developments contrary to the nature of such lands. 8. ACOPAC should exercise stricter and more periodic oversight in order to prevent the continued deterioration of these wetlands.
ACOPAC should advise both the Municipalidad de Garabito and SETENA of the proper inter-institutional coordination that must exist in order to prevent the alteration or elimination of the Playa Hermosa wetlands. 10. ACOPAC should proceed to correct the scope of DE.N°34507, published in la Gaceta No. 104 on 30 de mayo de 2008, in accordance with the foregoing explanation (...)”. (images 28 through 75 of the court record).
The Programa Nacional de Humedales shall update the new wetland area in the Registro Nacional de Humedales and incorporate the information into the SNIT platform so that users may consult and learn of the changes. This report shall be sent to the Municipalidad de Garabito so that it may be informed of the changes in the area of this wetland, as well as the scope of the Law, so that no type of construction or infrastructure detrimental to the health of the wetland ecosystem in the identified sectors is authorized. The SINAC/ACOPAC Laguna Pochotal Commission shall follow up on any other work required in this Wetland to ensure its permanence, health, and functioning. (...)” (images 449 through 514 of the court record).
The lagoon currently discharges into the sea because it has a channel that joins another channel, and they flow as drainage directly into the sea. (The foregoing is shown in the inserted Figure 4, distribution of the water network at the relevant site in Playa Hermosa, points 412 through 417, and the audio recording of the witness testimony dated 27 de junio de 2024, minuto 10:15 a 12:25) 16) Biologist Juan Sánchez Ramírez established that restoration of the open-water surface would occur by removing the drainage channel and vegetation through manual labor. (audio recording of the witness testimony dated 27 de junio de 2024 desde las 10:15 hasta las 12:25).

Of relevance to the resolution of this matter, because they were not established by the documentary evidence or the testimony given, the following are deemed unproven:
The plaintiff seeks to have the State and SINAC address the “Laguna Pochotal” wetland, thereby ceasing the omission complained of, and requests that this judgment order the following:
Among the constitutional principles governing State action regarding environmental protection, the Sala Constitucional de la Corte Suprema de Justicia has developed the following:
Preventive principle against the deterioration of natural resources (principio preventivo contra el deterioro de los recursos naturales): “(…) in protecting our natural resources, a preventive approach must be adopted; that is, if degradation and deterioration are to be minimized, precaution and prevention must be the governing principles (...) It must not be overlooked that this is an area of law in which the most important rules are those capable of preventing every type of environmental harm, because no rule can subsequently repair harm that has already occurred; this need for prevention is even more urgent in developing countries.” (Judgments numbers 5893-1995, 2988-1999, 5048-2001 and 2515-2002) Precautionary principle (principio precautorio): “(...) For this Tribunal, the precautionary principle applies when there is no scientific certainty regarding the environmental risks or impact of a measure, and the available studies or information give rise to doubts regarding the risks or their potential adverse impact.
By contrast, the principle of prevention, or preventive principle, applies in cases where scientific evidence establishes that the measure will cause environmental harm. In this second case, the available information may be sufficient or insufficient, but the existing information provides a degree of certainty regarding the adverse impacts that the measure will have on the environment. The difference between the two lies in whether scientific certainty exists regarding potential risks or harm to the environment. (…)” (Judgment number 2012-13367 at 11:33 hours on 21 de setiembre de 2012).
Principles of progressivity and non-regression in environmental protection (principios de progresividad y no regresión de la protección ambiental): “(…) The former has been recognized by International Human Rights Law; among other international instruments, it is set forth in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights. Under these provisions, the State assumes the obligation to progressively increase, to the extent permitted by its capabilities and development, the levels of human-rights protection, with special consideration for rights that, like the right to the environment (Art. 11 of the Protocol), require multiple affirmative actions by the State to ensure their protection and full enjoyment by all rights holders.
Likewise, the principle of non-regression, or irreversibility of the benefits or protection attained, derives from the principle of progressive realization of human rights and the principle that legal rules may not be applied retroactively to the detriment of acquired rights and consolidated legal situations, as set forth in Article 34 of the Constitution. This principle serves as a substantive guarantee of rights—in this case, the right to a healthy and ecologically balanced environment—by virtue of which the State is required not to adopt measures or policies, or approve legal rules, that worsen, without reasonable and proportionate justification, the level of rights attained up to that point. This principle does not entail absolute irreversibility, since all States experience national circumstances of an economic, political, or social nature, or arising from natural causes, that adversely affect the achievements attained up to that point and compel them to reconsider and lower the new level of protection.
In such cases, constitutional law and the principles under review require that the reduction in protection levels be justified in light of the constitutional standards of reasonableness and proportionality. (…)” (Judgment number 2012-13367 at 11:33 hours on 21 de setiembre de 2012).
Principle of adherence to science and technology (principio de la vinculación a la ciencia y a la técnica), developed in Judgment number 14293-2005 at 14:52 hours on 29 de octubre de 2005: “(...) the environmental ‘principle of adherence to science and technology,’ which governs environmental matters, insofar as administrative decisions that may affect the environment require technical support, and, as such, limit and constrain the Administration’s discretion in its actions. Accordingly, based on the results of those technical studies, if a ‘reasonable doubt’ arises as to a possible adverse effect on natural resources or human health, the proposed project, work, or activity must be rejected pursuant to the precautionary principle, which requires decisions favoring the environment (pro-nature principle [principio pro-natura]). (...)” In addition to the environmental principles cited above, environmental law is governed and protected by Article 50 of our Constitución Política, which provides: “(…) The State shall endeavor to achieve the greatest well-being for all inhabitants of the country by organizing and encouraging production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties. Every person has the basic and inalienable human right of access to drinking water as an asset essential to life. Water is an asset of the nation and is indispensable for protecting that human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law enacted for these purposes, and the supply of drinking water for consumption by persons and communities shall take priority.” The provision seeks to improve the surroundings in which human life and the lives of the species inhabiting them develop. It is important to recall that “environment” is defined by the Real Academia Española de la Lengua as “the set of physical conditions or circumstances surrounding living beings,” and therefore extends beyond the criteria for conserving the natural environment in general.
Responsibility for protecting the environment and caring for natural resources lies not only with the State and its public entities, but also with all inhabitants; therefore, all necessary preventive, conservation, and restorative measures must be adopted to ensure a healthy and ecologically balanced environment. In light of the cited legislation, this Chamber proceeds to review the relief sought.
The Convention on Wetlands of International Importance as Waterfowl Habitat, or Ramsar Convention, ratified by our country through law 7224, regulates matters concerning wetlands and constitutes an international legal instrument of reference for the analysis of this case. In addition to defining the concept of a wetland, this Convention imposes obligations on the States Parties for their protection. The legislation under discussion defines wetlands in Article 1 as: “(...) areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water the depth of which at low tide does not exceed six meters. (…)” It imposes the obligation to include in a “List” those wetlands within their territory, specifying the boundaries of each wetland and providing a precise description, with selection based on international significance from an ecological, botanical, zoological, limnological, or hydrological perspective, as defined in Article 2.
It imposes the obligation to prepare and implement management plans (planes de gestión) so as to promote the conservation of the wetlands included in the List and the wise use of wetlands within the territory. Articles 3 and 4 concern the promotion and conservation of wetlands and waterfowl through the establishment of nature reserves in wetlands, whether or not they are included in the List; and Article 5 establishes the obligation of the Contracting Parties to coordinate policies and regulations relating to the conservation of wetlands, flora, and fauna. Our legislation adopts the same definition of wetland provided by the Ramsar Convention and incorporates it into section 2 of the Ley de Conservación de la Vida Silvestre and Article 40 of the Ley Orgánica del Ambiente, which also regulates the classification, delimitation, and protection regime for wetlands regarded as ecosystems. Of relevance to the case before us, it is important to refer to the following provisions of this legal text:
Article 41—Public interest. Wetlands and their conservation are declared to be in the public interest because of their multiple uses, whether or not they are protected under the laws governing this subject.
Article 42—Delimitation of protected areas. The Ministerio del Ambiente y Energía, in coordination with the competent institutions, may delimit protection zones (zonas de protección) for certain marine, coastal, and wetland areas, which shall be subject to land-use planning and management plans (planes de ordenamiento y manejo) in order to prevent and combat pollution or degradation of these ecosystems.
Article 43—Works and infrastructure. Works or infrastructure shall be constructed in a manner that does not damage the ecosystems cited in Articles 51 and 52 of this law. Where potential damage exists, an environmental impact assessment (evaluación de impacto ambiental) must be conducted.
Article 44—Mandatory assessment. To carry out activities affecting any of the ecosystems cited in Articles 51 and 52 of this law or threatening life within a habitat of that nature, the Ministerio del Ambiente y Energía shall require the interested party to conduct an environmental impact assessment.
Article 45—Prohibition. Activities intended to disrupt the natural cycles of wetland ecosystems are prohibited, including the construction of dikes that prevent the flow of marine or inland waters, drainage, desiccation, filling, or any other alteration that causes the deterioration or elimination of such ecosystems.
Law 7317 assigns the Sistema Nacional de Área de Conservación (SINAC), an agency of the Ministerio de Ambiente y Energía, powers, functions, and duties concerning environmental protection. For example, Article 6 states that SINAC is the agency responsible for the planning, development, and oversight of wildlife. Section 7 establishes that SINAC has, among others, the following functions: “(...) a) To establish the technical measures to be followed for the proper management, conservation, and administration of wildlife covered by this law and by the respective international conventions and treaties ratified by Costa Rica. (...) h) To protect, supervise, and administer wetlands using an ecosystem-based approach, as well as to determine their classification as being of national or international importance (...).” Funding and technical support are regulated in section 13, which establishes: “(...) The decentralized and centralized agencies of the State, as well as municipal governments and any other national entity, are authorized to provide financial or technical assistance to the Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía, when requested by it or when they voluntarily wish to provide it, to the satisfaction of that Directorate, for the faithful fulfillment of the responsibilities entrusted under this Law.
(...).” To ensure compliance with the Ramsar Convention, Decreto Ejecutivo N°36427-MINAET (Published in La Gaceta N° 81 of April 28, 2011) was issued, providing that the Programa Nacional de Humedales shall be responsible for implementing the agreements and guidelines issued by the Comité Nacional de Humedales, as stated in Article 1. Article 2 regulates matters related to the administration, protection, and management of wetlands. For the resolution of this matter, it is also necessary to revisit Article 4, subsections d), e), h), i), and k), which regulate the functions of the Consejo Nacional Asesor de Humedales: “(...) d) To support actions for the national implementation of the Convention at Ramsar Sites and other wetland ecosystems and to coordinate wetland-related actions with the Secretariat of the Convention through the national coordinator and the Administrative Authority, as well as with other international entities. e) To promote the identification of wetlands and support their inclusion in the List of Wetlands of International Importance (Ramsar List), subject to prior designation by the Administrative Authority.
(...) h) To collaborate with the Sistema Nacional de Áreas de Conservación and the Programa Nacional de Humedales through the justification mechanisms and the Management Guidance Procedure (Procedimiento de Orientación para la Gestión) in cases involving the inclusion or removal of Ramsar Sites from the Montreux Record when changes occur in their ecological characteristics, which must be reported to the Convention by the Administrative Authority. i) To monitor implementation of the Resolutions and Recommendations adopted by the Conference of the Contracting Parties to Ramsar. (...) k) To collaborate in and provide advice on the implementation of the Política Nacional de Humedales.” The cited provisions also regulate the mandatory application of the principle of coordination (principio de coordinación) between SINAC and other public entities that, by virtue of their nature and powers, must collaborate with the Programa Nacional de Humedales.
In this regard, Article 5 of the legislation under discussion provides: “Article 5—SINAC and all other public agencies that, by virtue of their nature, are authorized to do so shall provide the ‘Programa Nacional de Humedales’ with the material and human resources necessary for its proper operation, with that Program being responsible for implementing the agreements and guidelines of the Consejo Nacional Asesor sobre Humedales within the scope of its powers. Likewise, the Ministries and State Institutions empowered to do so are authorized to collaborate with the Programa Nacional de Humedales by providing technical, administrative, and financial resources.” The witnesses heard at the supplementary hearing informed this Tribunal that, for purposes of complying with the List of Wetlands of International Importance and their registration, SNIT is used as the official platform specifically intended to publish fundamental geographic information in a standardized manner.
This program also has the following objectives: “a. To publish in an integrated manner the georeferenceable territorial information held by public entities and agencies, as well as information generated by private entities that the Registro Nacional considers to be of interest to SNIT. b. To promote the definition, operationalization, and use of a common geospatial data infrastructure. c. To strengthen and support territorial information management by those public entities or agencies having authority in that area. d. To promote the use of territorial information systems with platforms developed according to standards that ensure the interoperability of geospatial data. e. To provide all citizens, as well as public entities and agencies, whether or not they supply territorial information to the system, with free or paid access to the public territorial information contained in the system, thereby promoting the democratization of the use of territorial information at every level of society.
(…)” Based on the foregoing, this Tribunal concludes that the Ministerio de Ambiente y Energía, through SINAC and the Programa Nacional de Humedales, is responsible for the identification, classification, inclusion, management, conservation, and administration of these ecosystems known as wetlands.
The subject matter of these proceedings concerns claims of omissive conduct (conducta omisiva) and, as such, pursuant to Article 49 of the Political Constitution, the manifestations of administrative conduct in all its forms are subject to legality review (control de legalidad) by this Jurisdiction. These include omissive conduct or administrative dysfunction (disfunción administrativa); given the subject matter of these proceedings, a brief discussion thereof is necessary. First, there is formal inactivity (inactividad formal), or formal omissive conduct, which consists of the failure to issue a declaration of intent, judgment, or knowledge in response to a petition submitted by an individual subject to the Administration (administrado), when that petition is not addressed. There is also formal omission (omisión formal), which encompasses failure to fulfill an obligation imposed by the legal system (ordenamiento jurídico), whether by a constitutional or statutory provision, such as issuing regulatory provisions.
Another manifestation of omissive conduct is conventional formal inactivity (inactividad formal convencional), which consists of failure to execute contracts—whether bilateral or multilateral—thereby adversely affecting the public interest or the interests of concessionaires. Lastly, there is inactivity in the exercise of procedural actions vested in the Administration (acciones procesales de titularidad administrativa), which arises when the Administration fails to institute proceedings asserting claims to protect public assets and interests. This would occur, for example, where the Public Administration, in exercising its authority to administer a public-domain asset (bien de dominio público), fails to bring legal actions to defend that asset against threats or risks. There is also material inactivity (inactividad material), referring to the omission committed by the Public Administration when it fails to carry out a technical or material activity having external effects, including the exercise of public functions or powers, the enforcement of favorable administrative acts, or the provision of required public services.
Regarding legality review of this form in which the administrative function manifests itself—that is, omissive conduct—once the alleged omission has been established, meaning the failure to engage in the formal or material conduct required by the legal system, the immediate consequence is an order requiring the Administration to perform or comply with the omitted conduct, pursuant to paragraph (g) of Article 122 of the Código Procesal Contencioso Administrativo, which legal scholarship has termed a “claim for affirmative performance” (pretensión prestacional). In this case, based on the factual record underlying this judgment and the technical concept of the Administration’s omissive conduct, it is evident that a material omission (omisión material) has occurred, since the documentary evidence and the testimony given by the officials called to testify established that the recommendations for restoring the Wetland have not been implemented, put into operation, or effectively and promptly followed up on to safeguard and restore the “Laguna Pochotal” Wetland.
X.REGARDING THE OMISSION CHALLENGED IN THE COMPLAINT—Based on the statutory and doctrinal grounds set forth in the preceding recitals (considerandos), and following a review of the matters in dispute, the factual record described above, and the Court’s findings concerning those facts based on the documentary evidence and testimony received, this Panel shall review the alleged omissive conduct identified in the claims asserted in these proceedings.
“1. That the defendants be ordered to establish the true boundaries of the Laguna Pochotal ecosystem, in accordance with the actual biophysical, ecological, and legal conditions and characteristics of these ecosystems, correcting the boundaries identified in Decreto Ejecutivo N° 34507 published in La Gaceta N° 104 on 30 de mayo de 2008.” COURT’S DETERMINATION: It was established that the wetland boundary must be modified, in accordance with the recommendations contained in reports TAA-DT-002-2021 dated 7 de enero del 2021, SINAC-ACOPAC-CH-0010-2023 dated 9 de marzo de 2023, and SINAC-ACOPAC-CH-0062-2023 dated 25 de setiembre de 2023. The latter reports unquestionably contain a recommendation that the Programa Nacional de Humedales update the new area of the wetland in the Registro Nacional de Humedales and incorporate the information into the SNIT platform. Although this recommendation was submitted to the Coordinación del Programa Nacional de Humedales through official letter SINAC-ACOPAC-CH-0019-2023 dated 05 de abril de 2023, the contrary was nevertheless established by Ms. Jackelyn Rivera Wong, who stated that the process of updating the boundaries of the Laguna Pochotal wetland in the SNIT is currently underway but has not been completed because they lack the human resources necessary to complete it.
This Panel finds from the foregoing that unavoidable actions remain outstanding before the requested relief can be deemed implemented. It is therefore clear that, although the State and SINAC have issued reports establishing the need to expand the boundaries of the wetland registered in the SNIT, those actions are insufficient to implement the requested relief, thereby violating the environmental principles of prevention (principio preventivo), progressivity and non-regression (progresividad y no regresión), and adherence to science and technology (vinculación a la ciencia y a la técnica), as well as Article 2 of the Ramsar Convention, Articles 7 and 42 of the Ley Orgánica del Ambiente, and Article 4(h) of decreto ejecutivo 36427-MINAET. (Proven facts 4, 12, and 13). For this reason, the Court finds that the omission has been established and therefore grants the claim.
“2. That the immediate removal of all artificial channels draining the Laguna Pochotal wetlands and surrounding areas be ordered.” COURT’S DETERMINATION: As this Court noted beginning with the first proven fact, it was established that official letter ACOPAC-PZMT-003-2014 dated 2 de febrero de 2014 recommended using legal and administrative means to close the channels draining the Laguna Pochotal palustrine ecosystem (ecosistema palustrino), for the purpose of restoring it. Subsequently, as shown by proven fact four, Inspection Report TAA-DT-002-2021 dated 7 de enero de 2021 and the statements made by witness Juan Sánchez Ramírez at the supplementary hearing established the existence of artificial channels resulting from human activity (actividad antrópica), and their removal was recommended so that the Wetland could recover its natural watercourse (cauce natural).
“Figure 5. The location of the DA is shown on the 2017 orthophoto (…)” Report SINAC-ACOPAC-CH-0010-2023 dated 9 de marzo de 2023 was subsequently issued. As established in proven fact 12, it concluded: “(…) The water network (red hídrica) that naturally formed the wetlands at this site has clearly been modified. In addition, the construction of a network of drainage channels, walls, structures, and roads altered the water flows feeding Laguna Pochotal, drying it out and consequently affecting its ecology. To restore this ecosystem, it is urgent to eliminate all the channels currently draining it and directing the water toward the beach. (…)” In addition, these artificial channels were identified not only in the cited reports but also in the testimony of Juan José Sánchez, Jackelyn Rivera Wong, and Carlos Vinicio Cordero Valverde, who determined that the channels existed and agreed that they must be removed to restore the wetland’s watercourse and provide it with the water resources it requires (Laguna Pochotal Wetland).
This documentary evidence shows that SINAC had known of this problem since 2014, as well as of the need to close or eliminate these artificial channels to prevent further harm to the wetland ecosystem; nevertheless, it was established that the recommendation to close them has not been implemented. (Proven facts 15, 18, and 19); in order to put an end to that unnatural abnormality, It is evident to this Panel that this omissive conduct by the State and SINAC persists and that no decisive actions have been taken to restore the ecosystem, at least to a state of recovery. It is therefore concluded that this omissive conduct is contrary to Article 50 of the Political Constitution; the environmental principles of preventing the deterioration of natural resources, progressivity and non-regression, the precautionary principle (principio precautorio), and adherence to science and technology; and Articles 3 and 4 of the Ramsar Convention.
It is likewise contrary to Articles 7(h), 43, and 45 of the Ley Orgánica del Ambiente and Article 2 of decreto ejecutivo 36427-MINAET. Accordingly, the Court finds that there has been an omission in the required conduct and that the requested relief must be granted.
“3. That the defendants be ordered to perform modeling to guide the flow and drainage of the waters in a manner similar to how they occurred before the alteration caused by these human activities.” COURT’S DETERMINATION: The documentary evidence concerning proven facts four and twelve established that the water-flow modeling (modelaje de aguas), an issue addressed in reports TAAT-002-DT-2021 and SINAC-ACOPAC-CH-010- 2023, remains incomplete. Biologist Juan Sánchez Ramírez and Ms. Jackelyn Rivera Wong, according to their statements at the supplementary hearing, acknowledged that the water flow of the Pochotal wetland must be restored and recommended eliminating the artificial channels to restore that flow. They consider water resources essential to its restoration; nevertheless, they acknowledged that the channels have not been removed. (Proven facts 4, 12, 15, and 18). It is clear to this Court that the flow and drainage of the waters were unnaturally altered, disrupting the existing ecosystem and placing it at risk of possible future extinction.
This matter is of vital importance, and both the State and SINAC have failed to meet their environmental-protection obligations, thereby undermining the principle of conserving and safeguarding protected areas such as wetlands and failing to comply with the provisions governing this subject and the duties that the State, SINAC, and the Programa Nacional de Humedales are required to perform under the Political Constitution, the environmental principles identified in Considerando VII of this ruling, Articles 3 and 4 of the Ramsar Convention, and Articles 7(h), 43, and 45 of the Ley Orgánica del Ambiente; once again, omissive conduct is apparent with respect to addressing the cited problems. For the foregoing reasons, this Court grants the claim.
“4. That intervention in Laguna Pochotal be ordered to restore its open-water surface (espejo de agua).” COURT’S DETERMINATION: Inspection Report TAA-DT-002-2021 dated 7 de enero de 2021, as stated in proven fact four, recommended restoring the open-water surface, which has been invaded by herbaceous plants and German grass, as Mr. Sánchez Ramírez recounted. He further stated that it must be restored to avoid endangering the threatened birds that visit the Laguna Pochotal Wetland ecosystem. Ms. Jackelyn Rivera Wong, for her part, stated that restoring the open-water surface requires initiating a restoration protocol (protocolo de restauración) for the entire wetland, since it could not be addressed partially or by sector. She likewise acknowledged that no diagnostic or restoration protocol currently exists for the Laguna Pochotal Wetland. (Proven facts 4, 16, and 18) Based on the evidence, this Tribunal finds that the necessary effective measures to alleviate and mitigate the identified harm have not been implemented, revealing a serious omission by the State and SINAC with respect to the proper regeneration of that habitat (hábitat); accordingly, this Chamber considers that the resulting conduct is contrary to the provisions of Article 50 of the Political Constitution, the environmental principles (principios ambientales) of preventing deterioration of natural resources, progressivity and non-regression, precaution, and adherence to science and technology, as well as the provisions of Articles 3, 4, and 5 of the Ramsar Convention.
Likewise, it is contrary to Article 7 subsections a) and h), and Articles 40, 42, 44, and 45 of the Ley Orgánica del Ambiente, and to the provisions of decreto ejecutivo 36427-MINAET, Article 2. For the foregoing reasons, the claim is granted.
“5. Order SINAC to conduct stricter and periodic monitoring in order to prevent the continued deterioration of these wetlands (humedales).” TRIBUNAL’S ASSESSMENT: Although it is true that SINAC has issued a series of official communications and taken actions from 2014 to the present describing the condition of the wetland, these have not gone beyond the recommendations stated therein. Note the following official communications:
1- ACOPAC-PZMT-003-2014 dated February 2, 2014: it was determined that Humedal Laguna Pochotal had been affected by anthropogenic actions (acciones antrópicas). 2- SINAC-ACOPAC-CUSB-PMC-114-2016 dated August 24, 2016: it recommended the complete demarcation of the ecosystem. 3- Inspection Report TAA-DT-002-2021 dated January 7, 2021: it reports on the on-site inspection that determined the status or retrospective condition of the wetlands associated with Laguna Pochotal and set forth a series of recommendations. 4- SINAC-ACOPAC-OSRO-039-2021 dated January 27, 2021, addressed to the oficina Subregional Orotina, Área de Conservación Pacífico Central, requesting compliance with the recommendations of report TAA-DT-002-2021. 5- SINAC-ACOPAC-OSRO-040-2021 dated January 28, 2021, which determined that a retrospective analysis of the river dynamics (dinámica fluvial) of Humedal Laguna Pochotal must be conducted. 6- SINAC-ACOPAC-PPC-013-2021-DEN dated February 12, 2021, through which a complaint was filed with the Tribunal Ambiental Administrativo concerning the drainage and encroachment by infrastructure upon Humedal Laguna Pochotal and its surrounding areas. 6- Report DA-UHTPCOSJ-0413-2022 dated March 02, 2022, which determined that changes had occurred in the river dynamics of the wetland area due to channels draining the site’s natural water flow. 7- Report SINAC-ACOPAC-CH-0010-2023, dated March 09, 2023, setting forth a series of recommendations for registering and restoring the wetland. 8- SINAC-ACOPAC-CH-0019-2023 dated April 5, 2023, through which the Coordinadora del Programa Nacional de Humedales was asked to register a change in the area and classification of Humedal Laguna Pochotal.
Also, official communication SINAC-ACOPAC-CH-0062-2023 dated September 25, 2023, which expands upon the assessment of the wetland in question and recommends incorporating the new wetland area into the SNIT (proven facts 1, 2, 4, 5, 6, 8, 9, 12, 13, 14). For their part, the witnesses Sánchez Ramírez, Jackyn Rivera Wong, and Carlos Vinicio Cordero Valverde described the actions taken by SINAC to protect Humedal Laguna Pochotal, as well as the reports and complaints filed with the Fiscalía and the Tribunal Ambiental. (proven facts 15, 16, 17, 18, and 19, as well as the testimony of the aforementioned witnesses). This Tribunal considers that, although it has been shown that actions, complaints, and monitoring of the wetland’s condition have been undertaken, the evidence establishes that its deterioration continues. This is contrary to the environmental principles described in Considerando VII of this decision and to the provisions of Articles 3, 4, and 5 of the Ramsar Convention; Article 7 subsections a) and h); and Articles 42, 43, 44, and 45 of the Ley Orgánica del Ambiente. Moreover, adequate assistance to the ecosystem in question remains lacking to this day; therefore, the claim is granted.
“6. Order the Dirección de Aguas to conduct a retrospective analysis of the river dynamics of Playa Hermosa.” TRIBUNAL’S ASSESSMENT: Regarding this matter, official communication SINAC-ACOPAC-OSRO-040-2021 dated January 28, 2021, determined that a retrospective analysis of the river dynamics was necessary. (proven fact 6 of this decision). Subsequently, the Dirección de Agua prepared report number DA-UHTPCOSJ-0413-2022 dated March 02, 2022, which contains the retrospective analysis of the river dynamics of Playa Hermosa and was based on report TAA-DT-002-2021 by biologist Juan Sánchez Ramírez. Accordingly, this Tribunal understands that the agency has already conducted the requested analysis and that there is therefore no omission in this respect; consequently, the claim must be denied. (proven facts 6 and 9 of this ruling).
“7. Order the defendants to determine technically which properties encroach upon the protection zone (área de protección) of Humedal Laguna Pochotal.” TRIBUNAL’S ASSESSMENT: Although it is understood that the private properties (fundos privados) and their respective owners have not been identified in this case, the evidence submitted nevertheless shows that SINAC and the State have failed to coordinate with the agencies responsible for urban-planning matters, specifically by failing to inform them of the boundaries and restrictions that these ecosystems naturally impose on urban development. Furthermore, there is no evidence that information concerning the registered owners (propietarios registrales) was requested, nor is there evidence that SINAC sought assistance from the Municipalidad de Garabito or other public institutions to identify those owners whose properties may encroach, either physically or legally, upon the area of Humedal Laguna Pochotal. (unproven fact 6). For the foregoing reasons, this Tribunal grants the claim.
The principle of coordination among public agencies (principio de coordinación entre dependencias públicas) has been developed by the Tribunal Constitucional and, with respect to the matter before us, guarantees environmental protection. It is undeniable that coordination among the various public entities is necessary where, by virtue of their assigned authority, they must intervene to guarantee the protection of the environment and, consequently, the public health of the population. In this regard, Article 13 of the Ley de Conservación de la Vida Silvestre authorizes SINAC to request decentralized and centralized State agencies, municipal governments, or any other entity or body of the Administración Pública to provide economic or technical assistance in the performance of its duties. The Sala Constitucional de la Corte Suprema de Justicia addressed this principle of coordination among public agencies in judgment 5445-99 at fourteen hours thirty minutes on the fourteenth of July, nineteen ninety-nine, stating, insofar as relevant: “Thus, coordination is the ordering of relationships among these various independent activities, taking into account their convergence upon the same object or entity so as to make that convergence useful to an overarching public plan, without eliminating the mutual independence of the participating entities.
Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, it is not possible to impose particular conduct upon them. This gives rise to the indispensable interinstitutional ‘concertation,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overarching framework, within which each fulfills a role with a view toward a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed-upon forms of coordination and excluding any compulsory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent. Nevertheless, the necessary subordination of these entities to the State and in the State’s interest is permissible (through the State’s ‘administrative oversight,’ and specifically through the function of reviewing legality incumbent upon it, with powers of general supervision over the entire sector).” Constitutional case law has held that environmental protection is a responsibility shared equally by all persons and is not solely an obligation of the State.
This entails the involvement of all State entities, bodies, and institutions, as well as private individuals. In this specific case, given the complexity of restoring Humedal Pochotal and because the reported problems involve complex situations affecting several sectors of society and the State, the restoration of that ecosystem will necessarily depend upon coordinated action by the State and the other institutions mentioned, in order to fulfill the requested relief.
Accordingly, in view of the foregoing, as was verified and established, the Laguna Pochotal Wetland has been affected by problems arising from omissions and human activities (acciones antrópicas), which have caused the deterioration exhibited by that ecosystem; compounded by the failure to follow up on the recommendations set forth in Inspection Report TAA-DT-002-2021 of January 7, 2021, which made the following recommendations: “1. Urgently request that the DA (Dirección de Aguas) conduct a retrospective analysis of the river dynamics of Playa Hermosa and consider revising the opinion issued in official letter DA-UHTPCOSR-0363-2020. 2. Given that there has never been a natural drainage channel discharging water from the Laguna Pochotal Wetland at GPS point 417, that channel and water outlet must be removed because they are altering the dynamics of these wetlands. 3. Likewise, all artificial channels draining the wetlands in the area must be removed. 4.
Construct a system that allows water flow and drainage to be redirected in a manner similar to how they occurred before the alteration caused by human activities. 5. Intervene in Laguna Pochotal to restore its open-water surface (espejo de agua), bearing in mind that this lagoon has always been a seasonal wetland. 6. Verify whether the lagoon area is duly registered, since both the information for the cadastral zone and the cadastral information of the Municipalidad de Garabito show that the land is unregistered. 7. A large number of properties along the wetland identified in the RNH, associated with the lagoon wetland, are registered as private property and would be subject to restrictions on developments inconsistent with the nature of such lands. 8. ACOPAC must exercise stricter and periodic oversight to prevent the continued deterioration of these wetlands. ACOPAC must advise both the Municipalidad de Garabito and SETENA of the necessary interinstitutional coordination to prevent the alteration or elimination of the Playa Hermosa wetlands. 10.
ACOPAC must correct the scope of DE.N°34507, published in La Gaceta No. 104 on May 30, 2008, in accordance with the foregoing explanation.” In report SINAC-ACOPAC-CH-0010-2023, dated March 09, 2023, the following was recommended: “(...) The ACOPAC Directorate shall appoint a representative of the Oficina Subregional Orotina (hereinafter OSRO) to serve on the Laguna Pochotal case commission. Because it has been demonstrated that the wetland ecosystem has been affected in clearly identified areas by the opening of drainage channels and alterations to stream channels, which remain visible to this day, the Oficina Subregional de Orotina is urged to use this report as supporting material to conduct and submit the necessary investigations requested by the Prosecutor’s Office regarding the various properties where environmental offenses have occurred, including the drainage and filling of wetlands through civil works that disrupt the natural flows of the bodies of water comprising the Laguna Pochotal Wetland.
The Programa Nacional de Humedales shall update the new wetland area in the Registro Nacional de Humedales and incorporate the information into the SNIT platform so that users may consult and learn of the changes. This report shall be sent to the Municipalidad de Garabito to inform it of the changes to the area of this wetland and of the scope of the law, so that no type of construction or infrastructure detrimental to the health of the wetland ecosystem in the identified sectors is authorized. The SINAC/ACOPAC Laguna Pochotal Commission shall follow up on any additional work required in this Wetland to ensure its permanence, health, and functioning. (...).” In view of the magnitude of the problem and the persistent failure to ensure timely and proper implementation of those recommendations, it is essential to order the State, through the Ministerio del Ambiente y Energía and SINAC, to adopt all necessary actions and management plans to prevent and combat pollution or degradation of the Laguna Pochotal ecosystem.
Such action must require appropriate coordination with the Municipalidad de Garabito and SETENA to prevent further damage, without neglecting an updated environmental impact assessment (evaluación del impacto ambiental) that will make it possible to propose the timely and necessary measures for implementing the environmental protection of the ecosystem in question. Accordingly, SINAC shall submit a work plan or environmental matrix reflecting the measures ordered and specifying the time frames within which the Laguna Pochotal Wetland will be effectively restored. This plan, roadmap, or matrix shall contain, at a minimum, the type of action or actions to be undertaken, the institution or institutions required to participate in carrying them out (in accordance with the principle of coordination discussed supra), the commencement and completion deadlines, and the units responsible for monitoring compliance.
The judge presiding over the judgment-enforcement stage before this Court shall ensure compliance with this order. Both the Ministerio de Ambiente y Energía and SINAC shall submit reports every six months demonstrating progress in and implementation of the measures established in the matrix until the assessment and restoration of the Laguna Pochotal Wetland have been completed.
Based on the considerations set forth in the preceding recitals, the defense of lack of legal entitlement (excepción de falta de derecho) raised by the State and SINAC is partially rejected.
Pursuant to section 193 of the Código Procesal Contencioso Administrativo, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this judicial panel finds grounds to apply the exceptions established by the applicable law and depart from the principle that costs are awarded against the losing party, insofar as the present proceeding concerns environmental protection and the respondent entities have demonstrated an interest in protecting and restoring the Laguna Pochotal Wetland. For the reason stated, this Court finds that, even though the complaint was granted, this matter must be resolved without a specific award of costs.

Official letters SINAC-ACOPAC-CH-0010-2023 of March 09, 2023, “Opinion on the Laguna Pochotal Wetland located in the Playa Hermosa sector, Garabito, Puntarenas,” SINAC-ACOPAC-CH-0019-2023 of April 05, 2023, “Variations in the area of the Laguna Pochotal Wetland and its classification,” and SINAC-ACOCAP-CH-0062-2023 of September 25, 2023, “Supplement to the Opinion on the Laguna Pochotal Wetland, located in the Playa Hermosa sector, Jacó, Garabito, Puntarenas,” are admitted as evidence to assist in adjudication (prueba para mejor resolver). For the reasons stated, the defense of lack of legal entitlement raised by the representatives of the State and SINAC is partially rejected. Consequently, the complaint filed by Lic. WALTER BRENES SOTO against the STATE and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN is partially granted. The respondents are ORDERED to proceed as specified in Considerando XII of this decision. EL ESTADO N° 2024004850 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las trece horas con treinta y nueve minutos del ventinueve de Julio del dos mil venticuatro.- Proceso de conocimiento, incoado por el Licenciado WALTER BRENES SOTO, mayor, soltero, abogado, vecino de Playa Hermosa, portador de la cédula 2-0645-0800, contra el ESTADO representado por la Procuradora General Adjunta Natalia Aguilar Porras, carné número 17419 y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), representada por Licda. Gidgett Ramírez Hernández, carné 17939. Se han observado las prescripciones legales en la substanciación del proceso y no se observan defectos u omisiones capaces de producir la nulidad de lo actuado y resuelto por lo que, previa deliberación de Ley, el Tribunal integrado por los jueces Ronaldo Hernández Hernández, Lourdes Vargas Castillo y Vera Mora Rojas -a quien le correspondió presidir- procede a dictar la sentencia con el voto unánime de sus integrantes.

CONSIDERANDO
Como parte del íter procesal se tiene lo siguiente:
2 ) En fecha 13 de diciembre de 2021, el actor interpone este proceso en el que peticiona: "1. Se ordene a los demandados a establecer los verdaderos límites del ecosistema de Laguna Pochotal, en apego a la realidad y características biofísicas, ecológicas y legales de estos ecosistemas, en corrección a los límites indicados en el Decreto Ejecutivo No.34507 publicado en la Gaceta No. 104 del día 30 de mayo de 2008. 2. Se ordene inmediatamente que se eliminen todos los canales artificiales que están drenado los humedales de Laguna Pochotal y en sus alrededores. 3. Se ordene a los demandados realizar un modelaje que permita orientar el flujo y drenaje de las aguas de forma similar a como ocurría antes de la modificación ocasionada por estas acciones antrópicas. 4. Se ordene a (sic) intervenir la Laguna Pochotal para recuperar su espejo de agua. 5. Se ordene al SINAC ejercer una vigilancia más estricta y periódica, a fin de evitar que continúe el deterioro de estos humedales. 6. Se ordene a la Dirección de Aguas realizar un análisis retrospectivo sobre la dinámica fluvial de Playa Hermosa. 7. Se ordene a los demandados a determinar técnicamente cuáles son las propiedades que invaden el área de protección del humedal Laguna Pochotal. 8. Se condene a los demandados al pago de ambas costas de este proceso judicial." (imágenes 23 a 24 del expediente judicial).

Se admitió la totalidad de la prueba documental ofrecida por la parte actora, así como la prueba testimonial de Juan José Sánchez Ramírez Coordinador del Departamento Técnico del Tribunal Ambiental Administrativoy Paola Alvarado Lezama. De la prueba aportada por el SINAC, se admitió la totalidad de prueba documental y la testimonial de los funcionarios Jacklyn Rivera Wong, Coordinadora del Programa de Humedales y Carlos Vinicio Cordero Valverde, funcionario de Oficina Subregional de Orotina. Además se admitió la totalidad de la prueba del Estado. (registro de audio a partir del minuto 00:21:204 al 01:28:44). Se dio por terminada la audiencia y se dispuso remitir el asunto a la Sección de Juicio Oral y Público. (minuta imágenes 400-404 del expediente judicial y registro de audio de la audiencia preliminar).
Otorgada las audiencias respectivas el Tribunal admitió la misma, exceptuando la resolución Sala Constitucional. Se ratificaron las pretensiones y se evacuó la prueba testimonial ofrecida. A las 10:15 horas, el Tribunal inicia la recepción de prueba testimonial del Biólogo Juan José Sánchez y la señora Paola Alvarado Lezama. (registro de audio del minuto 14:02 al 15:14 y del minuto 14:05 al 14:44). La continuación de la audiencia se juicio se da el 28 de julio de dos mil veinticuatro, y al ser las 08:40 horas el Colegio de Jueces se constituyó en la Sala de Juicio N°2, después de constatar la asistencia de las partes, a las 8:48 se inicia con la recepción de la prueba testimonial de la señora Jacklin Rivera Wong (registro de audio de las 8:48 al 11:24), y a las 13:10 inicia el señor Carlos Vinicio Cordero Valverde. (registro de audio del minuto 13:10 al 14:18). Posteriormente, la parte actora indica que solicita que se admita como prueba para mejor resolver el testimonio del señor Julio Solano y que se realice un reconocimiento judicial.
Otorgada la audiencia a las partes sobre la gestión presentada; el Tribunal resuelve denegar la solicitud justificando las razones. (registro de audio del minuto 14:26 al 14:42 y del minuto 14:46 al 14:48). El Tribunal preguntó a las partes su anuencia a rendir las conclusiones por escrito, lo anterior, en razón de la extensión y tecnicidad de la prueba a valorar. Las partes manifestaron su anuencia. (registro de audio del 14:42 al 14:45). Se reiteró la prevención realizada a la parte actora, sobre la certificación de registro como abogado, ésta fue cumplida. (imagen 601 del expediente judicial). (minutas de las audiencias del juicio oral, correspondiente a los días 27 y 28 de junio de 2024, visibles a imágenes 590 al 600 del expediente judicial).
Posteriormente el biólogo Sánchez Ramírez emitió el Informe de Inspección TAA-DT-002.2021 del 7 de enero de 2021, donde dictaminó una serie de problemas del ecosistema de la Laguna Pochotal, y estableció una serie de recomendaciones para la preservación y protección del ese ecosistema. Entre estas estableció las siguientes: "1. Solicitar de forma urgente a la DA, que realice un análisis retrospectivo sobre la dinámica fluvial de Playa Hermosa y considere rectificar el criterio emitido según oficio DA-UHTPCOSR-0363-2020. 2. Dado que nunca existió un drenaje natural que drenaje natural que desfogue las aguas del humedal Laguna Pochotal bajo el punto GPS 417, debe eliminarse ese canal y desfogue de aguas, ya que está alterando la dinámica de estos humedales. 3. De igual forma, deben eliminarse todos los canales artificiales que drenan los humedales de la zona. 4. Realizar un modelaje que permita reorientar el flujo y drenaje de las aguas de forma similar o como ocurría antes de la modificación ocasionada por acciones antrópicas. 5.
Intervenir la Laguna Pochotal para recuperar su espejo de agua, recordando que esta laguna siempre ha sido un humedal estacional. 6. Verificar si el área de la laguna está inscrita a derecho, pues tanto en la información de zona catastrada como en la información catastral de la Municipalidad de Garabito, aparece dicho terreno sin inscribir. 7. Una gran cantidad de propiedades, a lo largo del humedal identificado en el RNH, relacionado al humedal de la Laguna, están inscritas en propiedad privada y estarían afectadas para llevar a cabo desarrollos contrarios a la naturaleza de dichos terrenos. 8. Que el ACOPAC ejerza una vigilancia más estricta y periódica, a fin de evitar que continúe el deterioro de estos humedales. 9. Que el ACOPAC advierta, tanto a la Municipalidad de Garabito como a la SETENA sobre la debida coordinación interinstitucional, que debe existir, con el objetivo de que se prevenga la modificación o eliminación de los humedales de Playa Hermosa. 10.
Que el ACOPAC proceda a corregir los alcances del DE Nº34507, publicado en la Gaceta Nº104 de 30 de mayo de 2008, de acuerdo a lo ya explicado." El actor el 5 de febrero de 2021, solicitó a la Dirección Ejecutiva del Sistema Nacional de Áreas de Conservación, implementara las recomendaciones del Informe de inspección TAA-DR-002-2021 del 7 de enero de 2021 y el 14 de octubre de 2021, presentó un proceso de aplicación del artículo 35 inciso 1) del Código Procesal Contencioso Administrativo en adelante CPCA, para que se cumpliera la conducta omisiva para implementar las recomendaciones indicadas en el informe TAA-DR-002-2021; y el 23 de noviembre de 2021 solicitó a la Dirección General de Aguas del Ministerio de Ambiente y Energía realizar un análisis retrospectivo sobre la dinámica fluvial de Playa Hermosa y se considere rectificar el criterio emitido según oficio DA-UHTPCOR-0363-2020, ambas recomendaciones dadas en el informe TAA-DT-02-2021 elaborado por el Biólogo Juan José Sánchez.
Concluye que a la fecha de interposición de la demanda, ni el SINAC ni el Estado han ejecutado las recomendaciones del informe por lo que se constituye una conducta omisiva. Estableció en el apartado denominado "Consideraciones de Derecho", que la legislación nacional obliga al Estado costarricense a implementar políticas públicas que persiguen y buscan para la protección del medio ambiente. Que el artículo 1 y 2 inciso c) de la Ley Orgánica del Ambiente, dota al Estado y las instituciones públicas con instrumentos para que puedan ejercer el derecho constitucional de un ambiente sano y ecológicamente sostenible regulado en el numeral 50 de la Constitución Política. En Costa Rica se ratificó la Convención Relativa a los humedales de importancia internacional, especialmente como Habitat de Aves Acuáticas, conocida como la Convención de Ramsar, aprobada mediante la ley 7224 del 7 de abril de 1991.
Dicha Convención en el artículo 3.1 establece un compromiso jurídico de las Partes Contratantes de aplicar, donde sea posible y según las características ecológicas el uso racional de los humedales, y que este uso racional, puede considerarse como la conservación y el uso sostenible de los humedales y los servicios que proporcionan, en beneficio de personas y la naturaleza. Estableció que Ley Orgánica del Ambiente constituye el marco jurídico que regula los humedales en su artículo 40 lo define, mientras que los numerales 41 inciso d ) los declara de interés público y 32 inciso f) los clasifica como áreas silvestres protegidas. Transcribe lo dispuesto en los numerales 7 de la Ley de Conservación de Vida Silvestre, 45 de la Ley de Biodiversidad, normas que claramente imponen el deber al Estado costarricense de avocarse la prevención y preservación del medio ambiente, así como un valor ecológico de los humedales como áreas silvestres protegidas.
Estableció que según el principio de irreductibilidad el cual tiene como finalidad impedir la reducción, disminución, desafectación, exclusión segregación y limitación de espacios naturales sometido a régimen especial de protección jurídico, debido a que albergan ecosistemas entre ellos es posibles reconocer: bosques ubicados en terrenos privados, humedales (manglares), áreas silvestres protegidas (ASP), territorios indígenas, anillo de contención del Gran Área Metropolitana (GAM), así como todos los terrenos que forman el Patrimonio Natural de Estado (PNE). Que este principio lo que busca es el mantenimiento de los procesos ecológicos esenciales y encuentra fundamento en el Convenio de Diversidad Biológica, la Ley de Biodiversidad y su Reglamento, que contienen el principio del Enfoque de Ecosistemas de Malawi. (transcribió Artículo 3 inciso d) Reglamento de la Ley de Biodiversidad) Consideró que en este caso las condiciones actuales del ecosistema del humedal Laguna Pochotal, están disminuyendo lo cual es una violación al principio de irreductibilidad, ya que el territorio más grande que el establecido en el Decreto Ejecutivo Nº 34507, por lo cual debe el Estado y el SINAC establecer los verdaderos límites de este humedal en apego de la realidad y características biofísicas, ecológicas y legales del ecosistema, para establecer una adecuada protección del patrimonio natural del Estado.
Sobre la conducta omisiva, aseveró que a pesar de que técnicos de la Administración Pública han determinado la existencia de una alteración del humedal Laguna Pochotal y sus alrededores por obra humana, según detalla el Informe de Inspección TAA-DT-002-2021, elaborado por el funcionario Sánchez Ramírez, el cual determinó una serie de recomendaciones pero que no se han realizado acciones materiales para prevenir mayor alteración. Indicó, que a pesar de que existe prueba técnica, inspecciones y oficios sobre el peligro ambiental que presenta la zona, el SINAC y el Estado, no han girado acciones concretas para el resguardo de este ecosistema y fiscalización de proyectos urbanísticos que puedan alterar esta zona. Concluyó, que existe un Decreto Ejecutivo Nº 34507, en el cual se registra una cabida menor a lo que en realidad cubre el área del ecosistema Humedal Laguna Pochotal, por cuanto se incluye únicamente el espejo de agua, y que existe una necesidad urgente por parte de los demandados de establecer los verdaderos límites de la zona, y que a la fecha no se ha realizado.
Solicitó, que se cumpliera con las recomendaciones incluidas en el informe TAA-DT-002-2021, sin que se hayan dado a pesar de haber transcurrido meses. Por esta razón interpuso un proceso en el cual solicitó la aplicación del artículo 35 inciso 1) del Código Procesal Contencioso Administrativo. (imágenes 11 al 24 expediente judicial).
Continúa señalando que la sola publicación de los ecosistemas en la plataforma oficial del SNIT define la información de este y todos los humedales como de uso oficial. Y que la Ley Orgánica el Ambiente en su artículo 42 establece como una acción potestativa del MINAE, la delimitación de las zonas protegidas, y que el SINAC ha dispuesto una serie de acciones para elaborar un inventario nacional de humedales y con ellos alimentar la información del SNIT incluyendo el humedal Laguna Pochotal. En relación con el cumplimiento de la tutela del Humedal Laguna Pochotal que tiene el SINAC, establece que se ha realizado una vigilancia estricta y periódica del humedal, tal y como se comprueba del oficio SINAC-ACOPAC-OSRO-204-2021, que muestra las acciones de recuperación de la zona de palustre, mediante informes por daños al ambiente interpuestos ante la Fiscalía Agrario Ambiental y denuncias ante el Tribunal Ambiental Administrativo.
Que el mismo oficio indicó que el informe TAA-DT-002-2021 se elaboró como seguimiento a otras denuncias interpuestas en la zona a fin de presentar prueba técnica para la restauración de los humedales en la zona. Además que este oficio aclaró que se ha diseñado desde el Programa de Humedales una Hoja de Ruta Institucional que será liderada por la Oficina Subregional de Orotina para cumplir con la protección de la Laguna Pochotal y los humedales adjuntos. Argumentó que desde el año 2016 existe documentación que demuestra que se han realizado actuaciones del SINAC con relación al humedal Laguna Pochotal y, que el oficio SINAC-ACOPAC-OSRO-204-2021 da fe de las actuaciones de fiscalización concretamente de las denuncias ante la fiscalía y el Tribunal Ambiental Administrativo. Manifestó que en los siguientes votos 2020014031 del 24 de julio de 2020 y 2020016209 del 28 de agosto de 2020 la Sala Constitucional de la Corte Suprema de Justicia, hizo refiere oficios remitidos a la Municipalidad de Garabito para lo que corresponda a su función de gobierno local; así como los efectos y alcances del oficio SINAC-ACOPAC-CUSP-PMC-114-2016 relacionado con el SINAC-SE-IRT-130 los cuales datan la corrección de los límites de la laguna Pochotal y tiene efectos oficiales al estar publicados en el SNIT.
Como puede apreciarse en los puntos señalados, la misma prueba aportada por la parte actora y las sentencias del alto Tribunal constitucional mencionadas, dan fe del cumplimiento de la conducta debida: la coordinación interinstitucional para la prevención de obras que pongan en riesgo los humedales de Playa Hermosa, así como la vigilancia estricta y periódica que tiene el ACOPAC en este humedal y la corrección de los alcances del Decreto Ejecutivo N°34507. Estas acciones son de conocimiento de la parte actora según ya se ha demostrado en el alto tribunal constitucional, no obstante, para efectos prácticos, se adjunta como prueba documental los oficios SINAC-ACOPAC-CUSB-PMC-114-2016 y SINAC-SE-IRT-130. Además, se adjuntan documentos correspondientes con el expediente judicial número 21-000042-0611-PE, el cual está debidamente certificado bajo consecutivo SINAC-ACOPAC-OSRO-224-2022, mediante el cual se prueba que mi representada ha llevado a cabo las denuncias que le competen ante la fiscalía por intervenciones no autorizadas en el humedal Laguna Pochotal.
También se adjunta el oficio SINAC-ACOPAC-D-253-2022, mediante el cual se le solicita a la Dirección del Instituto Geográfico Nacional informe de levantamiento cartográfico, para seguimiento de las causas penales 19-000056-611-PE y 21-000015-0611-PE referentes al relleno, drenaje y secado de ecosistema del Humedal Laguna Pochotal y Humedales anexos ubicado en Playa Hermosa, así como también a dar seguimiento a los oficios DA-UHTPCOSJ-0413-2022 y TAA-DT-002-2021, el cual es parte del objeto de este litigio. Por lo anterior, se solicita el rechazo de la demanda, acogiéndose la defensa de demanda improponible, en virtud del artículo 220 del CPCA, por el cual para lo no previsto en este código se aplicarán los principios de Derecho Público y procesal en general, por lo que, en consecuencia, se solicita de conformidad con el artículo 35.5 del Código Procesal Civil, en adelante CPC, que la demanda sea rechazada por ser manifiestamente improponible. Sobre esta defensa de demanda improponible se omite referencia por haber sido resuelta interlocutoriamente. Estableció la excepción de fatal de derecho. (imágenes 187 al 195 el expediente judicial).
B-2) El ESTADO: Respecto de los hechos de la demanda, aceptó el sétimo y octavo y rechazó el primero, segundo, tercero, cuarto, quinto, sexto, noveno, décimo y undécimo. Estableció que, con respecto a la responsabilidad de la administración, que se está estableciendo un erróneo nexo causal entre la inactividad de la administración y el daño ambiental que aduce la parte. Consideró que en este caso no solo es un juicio erróneo el presumir que el daño que se aduce sobre la laguna se debe a supuestas inacciones de la Administración sin establecer ningún vínculo entre una cosa y la otra que por demás es falso. Indicó que la parte actora no detallo ni probó las supuestas inacciones que repercuten el daño dicho, sino que únicamente se limita a transcribir las normas ambientales nacionales sin realizar un análisis fáctico jurídico que permita sustentar sus pretensiones. Que la presente acción se fundamenta en que ha existido un supuesto incumplimiento por parte del Estado y del SINAC, debido a que no se ha aplicado el criterio recomendativo del Biólogo Juan Sánchez Ramírez del Departamento Técnico del Tribunal Ambiental Administrativo en su informe TAA-DT-002-2021 del 7 de enero de 2021, y que dichas recomendaciones constituyeron un insumo importante a ser valorado por la Administración, pero no tiene la intención de ser lista taxativa de acciones puntales a realizar dentro del tiempo que considera apropiado el accionante.
Que después de dicho informe el SINAC ha realizado acciones de seguimiento y estudio en la zona, que el accionante prueba que se han realizado esfuerzos por el Estado para el abordaje de la situación y existe prueba que se aporta sobre estas inspecciones, acciones y estudios realizados en la zona laguna Pochotal. Estableció que no existe responsabilidad objetiva para la administración pública en la Ley General de la Administración Pública (LGAP) artículo 190, ya que no subsiste una atribución del hecho y un reproche jurídico-penal de índole patrimonial, derivado del nexo causal, entre el agente responsable subjetivamente y el ente o sujeto responsable objetivamente, lo que no acaece en el presente proceso. [Se transcriben resoluciones del Tribunal Contencioso Administrativo: 69-2016, 102-2012, 18-2010 y 218-2008]. Continuó manifestando, que la acción no cumple con los presupuestos esenciales para configurar responsabilidad por no haber ocurrido inactividad y aunado a que no existe un nexo causal que ligue las supuestas inacciones del Estado, por lo cual no ha existido el daño ambiental que refiere la parte.
Que no es razonable consentir la idea de que cualquier daño que se produzca al medio ambiente es responsabilidad del Estado, aún bajo la tesis de responsabilidad objetiva, debido a que este tipo de responsabilidad de excepciona, para casos donde la Administración sí ha procurado la atención en la zona. Estableció que la acción no acreditó que haya existido acciones omisivas por parte de la Administración, y que el daño que aduce no está ligado o asociado a alguna inactividad del Estado que es un requisito esencial. Que en todo caso la responsabilidad objetiva de la administración pública art.190 Ley General de Administración Pública (LGAP), si se hubiera dado por omisión, contempla las acciones respectivas para los casos que se encuentran fuera del alcance estatal, ya que el mismo informe TAA-DT-002-2021 del 7 de enero de 2021 se expone un lista de las propiedades de particulares que están ubicadas dentro del área de estudio del informe. [transcribe Voto 099 de 16 horas del 30 de marzo de 2001 de este Tribunal].
Concluyó, que al no ser cierto los hechos indicados, no existe infracción o inactividad achacable al Estado, solicitó que se acoja la excepción de falta de derecho y se declare sin lugar la demanda. (imágenes 247 al 253 del expediente judicial).
La representación del SINAC, solicitó en la audiencia complementaria se admita en calidad de prueba para mejor resolver los oficios SINAC-ACOPAC-CH-0010-2023 de fecha 09 de marzo del 2023 "Criterio sobre Humedal Laguna Pochotal ubicada en el sector de Playa Hermosa, Garabito, Puntarenas"; el oficio SINAC-ACOPAC-CH-0019-2023 del 05 de abril de 2023, "Variaciones en el área del humedal Laguna Pochotal y su clasificación”; y SINAC-ACOCAP-CH-0062-2023 del 25 de setiembre del 2023 "Ampliación de Criterio sobre Humedal Laguna Pochotal, ubicado en el sector de Playa Hermosa, Jacó, Garabito, Puntarenas". La prueba para mejor resolver que alude a una potestad discrecional de la que puede acudir la autoridad jurisdiccional cuando exista algún punto sometido a litigio y que se requiera mayor información o claridad. Es preciso señalar que este tipo de ofrecimiento no puede ser utilizado por las partes para subsanar omisiones en relación con el ofrecimiento de los elementos probatorios, ya sea porque no fueron ofrecidos en su momento procesal oportuno.
La Sala Primera de la Corte Suprema de Justicia, en el voto 000655-F-S1-2021, de las catorce horas treinta y cinco minutos del dieciocho de marzo del dos mil veintiuno, al respecto "(...)En esa línea, la prueba para mejor resolver es un instituto concebido para que el Juez, una vez evacuada la prueba ordinaria, solicite aquella que, aun siendo relevante para el proceso, no fue ofrecida por las partes, o bien que habiéndolo sido, fue declarada inevacuable, nula, rechazada por extemporánea o inadmisible, e incluso se refiera a hechos tenidos por ciertos en rebeldía del demandado. Se trata de una facultad del Tribunal y no de las partes, la cual no puede ser utilizada por éstas para subsanar sus omisiones respecto de la prueba que pudieron haber ofrecido en el momento procesal oportuno y no lo hicieron.(...)". A criterio del Tribunal la prueba ofrecida se considera pertinente y necesaria, ya que dichos informes técnicos son emitidos con posterioridad a la interposición de la demanda y los mismos refieren al Humedal Laguna Pochotal y su condición actual, por lo que se admiten como prueba para mejor resolver.
Se aclara que se admiten dichos oficios y no la sentencia de la Sala Constitucional de la Corte Suprema de Justicia, resolución 2023028467 de las nueve horas cuarenta y cinco minutos del tres de noviembre de dos mil veintitrés, (imágenes 449-550 del expediente judicial).
Conforme la prueba documental admitida en este proceso y la recepción de la prueba testimonial, se tienen como probados los siguientes hechos de interés y que son aplicables a la demanda.
A fin de garantizar la permanencia de este ecosistema tan frágil en el tiempo, es necesario realizar un monitoreo constante del área de manera que con esto se puede evitar que este sufra algún tipo de daño o drenaje de sus aguas, impactándolo aún más u otro tipo de actividades que pudieran afectarlo. 4. Utilizar este estudio técnico como base para la delimitación total del ecosistema. 5. La delimitación del humedal deberá tomar en cuenta muestreos en época lluviosa y seca, con el objetivo de poder observar la dinámica del mismo. De esta manera se podrá determinar los cuerpos de aguas permanentes e intermitentes y poder categorizar a mayor detalle el parámetro de drenaje y riesgo de inundación del suelo.(...)" (imágenes del 551 al 553 del expediente judicial).
Realizar un montaje que permita reorientar el flujo y drenaje de las aguas de forma similar a como ocurría antes de la modificación ocasionada por acciones antrópicas. 5. Intervenir la Laguna Pochotal para recuperar su espejo de agua, recordando que esta laguna siempre ha sido un humedal estacional. 6. Verificar si el área de la laguna está inscrita a derecho, pues tanto en la información de zona catastrada como en la información catastral de la Municipalidad de Garabito, aparece dicho terreno sin inscribir. 7. Una gran cantidad de propiedades, a lo largo del humedal identificados en el RNH, relacionado al humedal de la laguna, están inscritas en propiedad privada y estarían afectadas para llevar a cabo desarrollos contrarios a la naturaleza de dicho terrenos. 8. Que el ACOPAC ejerza una vigilancia más estricta y periódica, a fin de evitar que continúe el deterioro de estos humedales. Que el ACOPAC advierta, tanto a la Municipalidad de Garabito como a la SETENA sobre la debida coordinación interinstitucional, que debe existir, con el objetivo de que se prevenga la modificación o eliminación de los humedales de Playa Hermosa. 10.
Que el ACOPAC proceda a corregir los alcances del DE.N°34507, publicado en la Gaceta No. 104 del día 30 de mayo de 2008, de acuerdo a lo ya explicado (...)". (imágenes 28 al 75 del expediente judicial).
Al Programa Nacional de Humedales, actualizar en el Registro Nacional de Humedales la nueva área de humedal e incorporar la información en la plataforma del SNIT para que los usuarios puedan consultar y enterarse de los cambios. Enviar este informe a la Municipalidad de Garabito para que se conozca sobre los cambios en el área de este humedal, así como los alcances de Ley para que no se autorice ningún tipo de construcción o infraestructura que perjudique la salud del ecosistema de humedal en los sectores identificados. A la Comisión del SINAC/ACOPAC Laguna Pochotal darle seguimiento a los demás trabajos que se requieran en este Humedal para garantizar permanencia, salud y funcionamiento. (...)" (imágenes 449 al 514 del expediente judicial).
(Lo descrito se observa en la Figura 4 inserta, distribución de la red hídrica del lugar de interés en Playa Hermosa, puntos 412 al 417 y registro de audio de la declaración testigo del 27 de junio de 2024, minuto 10:15 a 12:25) 16) Que el biólogo Juan Sánchez Ramírez acreditó, que la recuperación del espejo de agua se daría al eliminar drenaje y la vegetación a través del trabajo de horas hombre. (registro de audio declaración testigo en fecha 27 de junio de 2024 desde las 10:15 hasta las 12:25).
(Figura 9 el polígono en sombreado celeste, representa el área del humedal lacustre (según el RNH).
De interés en la resolución de este asunto, por no acreditarse de la prueba documental ni de los testimonios rendidos, se tiene por no demostrado:
Pretende el actor, que el Estado y SINAC atiendan el Humedal “Laguna Pochotal”, cesando así la conducta omisiva que reprocha y que en esta sentencia se ordene:
Entre los principios constitucionales que condicionan la actuación del Estado en el tema de la protección al ambiente, la Sala Constitucional de la Corte Suprema de Justicia, ha desarrollado en los siguientes:
Principio preventivo contra el deterioro de los recursos naturales: “(…) en la protección de nuestros recursos naturales, debe existir una actitud preventiva, es decir, si la degradación y el deterioro deben ser minimizados, es necesario que la precaución y la prevención sean los principios dominantes (...) No se debe perder de vista el hecho de que estamos en un terreno del derecho, en el que las normas más importantes son las que puedan prevenir todo tipo de daño al medio ambiente , porque no hay norma alguna que repare, a posteriori, el daño ya hecho; necesidad de prevención que resulta más urgente cuando de países en vías de desarrollo se trata.” (Sentencias números 5893-1995, 2988-1999, 5048-2001 y 2515-2002) Principio precautorio : " (...) Para este Tribunal, el principio precautorio aplica cuando no existe certeza científica sobre los riesgos o impacto al ambiente de una medida, los estudios o información disponible generan dudas acerca de los riesgos o de su posible impacto negativo.
Por el contrario, el principio de prevención o preventivo aplica en aquellos casos en que existe evidencia científica de que la medida va a causar daños al ambiente. En este segundo caso, la información disponible puede ser suficiente o insuficiente, pero con la que existe, se alcanza un grado de certeza sobre los impactos negativos que la medida va a provocar sobre el ambiente. La diferencia entre uno y otro está en la existencia o no de certeza científica sobre los posibles riesgos o lesiones al ambiente. (…)” (Sentencia número 2012-13367 de las 11:33 horas del 21 de setiembre de 2012).
Principios de progresividad y no regresión de la protección ambiental: “(…) El primero ha sido reconocido por el Derecho Internacional de los Derechos Humanos; entre otros instrumentos internacionales, se encuentra recogido en los artículos 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales, artículo 1 y 26 de la Convención Americana sobre Derechos Humanos y artículo 1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales. Al amparo de estas normas, el Estado asume la obligación de ir aumentando, en la medida de sus posibilidades y desarrollo, los niveles de protección de los derechos humanos, de especial consideración aquellos, que como el derecho al ambiente (art. 11 del Protocolo), requieren de múltiples acciones positivas del Estado para su protección y pleno goce por todos sus titulares. Asimismo, del principio de progresividad de los derechos humanos y del principio de irretroactividad de las normas en perjuicio de derechos adquiridos y situaciones jurídicas consolidadas, recogido en el numeral 34 de la Carta Magna, se deriva el principio de no regresividad o de irreversibilidad de los beneficios o protección alcanzada.
Este principio se erige como garantía sustantiva de los derechos, en este caso, del derecho a un ambiente sano y ecológicamente equilibrado, en virtud del cual el Estado se ve obligado a no adoptar medidas, políticas, ni aprobar normas jurídicas que empeoren, sin justificación razonable y proporcionada, la situación de los derechos alcanzada hasta entonces. Este principio no supone una irreversibilidad absoluta pues todos los Estados viven situaciones nacionales, de naturaleza económica, política, social o por causa de la naturaleza, que impactan negativamente en los logros alcanzados hasta entonces y obliga a replantearse a la baja el nuevo nivel de protección. En esos casos, el Derecho a la Constitución y los principios bajo examen obligan a justificar, a la luz de los parámetros constitucionales de razonabilidad y proporcionalidad, la reducción de los niveles de protección.(…) (Sentencia número 2012-13367 de las 11:33 horas del 21 de setiembre de 2012).
Principios de la vinculación a la ciencia y a la técnica, desarrollado en la sentencia número 14293-2005 de las 14:52 horas del 29 de octubre de 2005: “(...) principio ambiental "de la vinculación a la ciencia y a la técnica" que rige la materia ambiental, en tanto las decisiones administrativas que pueden tener incidencia en el ambiente requieren de un sustento técnico que las respalde, y en tal condición, limitan y condicionan la discrecionalidad de la Administración en su actuación. De manera que en atención a los resultados que se deriven de esos estudios técnicos, es que, si se evidencia una "duda razonable" de una posible afectación a los recursos naturales o a la salud de las personas, es que resulta obligado desechar el proyecto, obra o actividad propuestas, en aplicación del principio precautorio, que obliga a tomar decisiones en pro del ambiente (principio pro-natura). (...)".
Aunado a los principios ambientales señalados, el derecho ambiental se regula y protege desde el artículo 50 de nuestra Constitución Política que indica: “(…) El Estado procurará el mayor bienestar a todos los habitantes del país, organizado y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causados. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes. Toda persona tiene derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones.” La norma aspira a la mejora el entorno donde se desarrolla la vida del ser humano y de las especies que habitan en él.
Es importante recordar que “Ambiente es definido por la Real Academia Española de la Lengua como: “el conjunto de condiciones o circunstancias físicas que rodean a los seres vivos”, de manera que desborda los criterios de conservación natural del ambiente en general. Corresponde no solo al Estado y sus entidades públicas proteger el ambiente y cuidar los recursos naturales, sino también a todos habitantes; por ello deben tomarse todas las medidas preventivas, conservativas y restaurativas necesarias para asegurar un ambiente sano y ecológicamente equilibrado. A la luz de la normativa señalada procede esta Cámara en la revisión de lo pretendido.
La Convención sobre los Humedales Internacionales como Habitat Aves Acuáticas o Convención de Ramsar, ratificado por nuestro país en la ley 7224, regula el tema de los humedales y constituye una instrumento jurídico internacional de referencia para el análisis de este caso. Este convenio, además de definir el concepto de humedal, impone a los Estados parte obligaciones para la protección de los mismos. La normativa de comentario, define en el artículo 1 que son humedales: "(...) son extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros.(…)". Impone la obligación de incluir en una "Lista" los humedales de su territorio en los que se incluya los límites de cada humedal, una descripción precisa, la selección de basarse en un interés internacional desde el punto de vista ecológico, botánico, zoológico, linológico o hidrológico, según se define en el artículo 2.
Impone la obligación de elaborar y aplicar planes de gestión de forma que favorezcan la conservación de las zonas húmedas inscrita en la Lista y la explotación racional de los humedales del territorio. Los artículos 3 y 4 refieren al fomento y conservación de las zonas húmedas y de las aves acuáticas creando reservas naturales de los humedales inscritos en la Lista o no; y el artículo 5 dispone la obligación de las partes contratantes a coordinar políticas y regulaciones relativas a la conservación de los humedales, flora y fauna. Nuestra legislación recoge la misma definición de humedal dada por la Convención Ramsar y la plasma en el numeral 2 de la Ley de Conservación de la Vida Silvestre y en el artículo 40 de la Ley Orgánica del Ambiente, que además regula el régimen de calificación, delimitación y protección de los humedales considerados ecosistemas. De interés para el caso que nos ocupa es importante referir a los siguiente numerales de este texto legal:
Artículo 41- Interés público. Se declaran de interés público los humedales y su conservación, por ser de uso múltiples, estén o no estén protegidos por las leyes que rijan esta materia.
Artículo 42- Delimitación de zonas protegidas. El Ministerio del Ambiente y Energía, en coordinación con las instituciones competentes, podrá delimitar zonas de protección de determinadas áreas marinas, costeras y humedales, las cuales se sujetarán a planes de ordenamiento y manejo, a fin de prevenir y combatir la contaminación o la degradación de estos ecosistemas.
Artículo 43-Obras e infraestructura. Las obras o la infraestructura se construirán de manera que no dañen los ecosistemas citados en los artículos 51 y 52 de esta ley. De existir posible daño, deberá realizarse una evaluación de impacto ambiental.
Artículo 44- Obligatoriedad de la evaluación. Para realizar actividades que afecten cualquiera de los ecosistemas citados en los artículos 51 y 52 de esta ley o amenacen la vida dentro de un hábitat de esa naturaleza, el Ministerio del Ambiente y Energía exigirá al interesado una evaluación de impacto ambiental.
Artículo 45- Prohibición. Se prohíben las actividades orientadas a interrumpir los ciclos naturales de los ecosistemas de humedal, como construcción de dique eviten el flujo de aguas marinas o continentales, drenajes, desecamiento, relleno o cualquier otra alteración que provoque el deterioro y la eliminación de tales ecosistemas.
La ley 7317 impone al Sistema Nacional de Área de Conservación (SINAC), órgano del Ministerio de Ambiente y Energía, las competencias, funciones y deberes en la protección del ambiente. Por ejemplo en el artículo 6 indica que el SINAC es el órgano competente en la planificación, desarrollo y control de la vida silvestre. El numeral 7, establece que el SINAC tiene entre otras funciones: " (...) a) Establecer las medidas técnicas por seguir para el buen manejo, conservación y administración de la vida silvestre, objeto de esta ley y de los respectivos convenios y tratados internacionales ratificados por Costa Rica. “(...) h) Proteger, supervisar, y administrar, con enfoque ecosistémico los humedales, así como determinar su calificación de importancia nacional o internacional (...)". El financiamiento y apoyo técnico se regula en el numeral 13 que establece: "(...) Los organismos descentralizados y centralizados del Estado, al igual que los gobiernos municipales y cualquier otro ente nacional, quedan facultados para prestar su colaboración económica o técnica al Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, cuando éste lo solicite o cuando voluntariamente quieran dárselo, a satisfacción de dicha Dirección, para el fiel cumplimiento de lo encomendado en esta Ley.(...)".
El cumplimiento del Convención Ramsar, se creó por medio del Decreto Ejecutivo N°36427-MINAET (Publicado en la Gaceta N° 81 del 28 de abril de 2011), que dispone que el Programa Nacional de Humedales tendrá a su cargo la ejecución de los acuerdos y lineamientos que emanen del Comité Nacional de Humedales, según reza el artículo 1. Regula el artículo 2 lo relacionado a la administración, protección y manejo de los humedales. Para la resolución de este asunto también es necesario retomar el artículo 4 incisos d), e), h), i) y k) que regulan las funciones del Consejo Nacional Asesor de Humedales : “(…) d) Apoyar las acciones para la aplicación nacional de la Convención en Sitios Ramsar y demás ecosistemas de humedal y coordinar acciones con la Secretaría de la Convención a través del coordinador nacional y la Autoridad Administrativa y otros entes internacionales, en materia de humedales. e) Promover la identificación de humedales y apoyar su inclusión en la lista de Humedales de Importancia Internacional (Lista de Ramsar) con la previa designación de la Autoridad Administrativa.
(…) h) Colaborar con el Sistema Nacional de Áreas de Conservación y el Programa Nacional de Humedales mediante los mecanismos de justificación y el Procedimiento de Orientación para la Gestión, en el caso de inclusión o exclusión de sitios Ramsar en el registro Montreux, al presentarse cambios en las características ecológicas, el cual debe ser comunicado a la Convención por la Autoridad Administrativa. i) Dar seguimiento a la aplicación de las Resoluciones y Recomendaciones adoptadas por la Conferencia de las Partes Contratantes de Ramsar. (…) k) Colaborar y asesorar en la implementación de la Política Nacional de Humedales.” Regula además el articulado de cita, la obligatoriedad del principio de coordinación del SINAC con otras entidades públicas que por su naturaleza y competencias deben colaborar con el Programa de Humedales. En ese sentido dispone artículo 5 de la norma de comentario: “Artículo 5-El SINAC y las demás dependencias públicas, que por su naturaleza estén autorizadas para ello, le proporcionarán al "Programa Nacional de Humedales" los recursos materiales y humanos que sean necesarios para su adecuado funcionamiento siendo este el responsable de la ejecución de los acuerdos y lineamientos del Consejo Nacional Asesor sobre Humedales en el ámbito de sus competencias.
Asimismo, quedan autorizados los Ministerios e Instituciones del Estado, con facultades para ello, a colaborar con recursos técnicos, administrativos y financieros con el Programa Nacional de Humedales.” Informaron a este Tribunal, los testigos recibidos en la audiencia complementaria que, para cumplir con la Lista de Humedales de importancia Internacional y su registro se utiliza el SNIT, plataforma oficial que persigue precisamente, publicar la información geográfica fundamental de forma estandarizada. Este programa tiene entre sus objetivos, además: “a. Publicitar en forma integrada la información territorial georeferenciable existente en entes y órganos públicos, así como la que generen entes privados y que a criterio del Registro Nacional resulten de interés para el SNIT. b. Propiciar la definición, operacionalización y uso de una misma infraestructura de datos geoespaciales. c. Fortalecer y apoyar la gestión de la información sobre el territorio de aquellos entes u órganos públicos con competencia en esa materia. d. Fomentar el uso de sistemas de información territorial con plataformas desarrolladas bajo estándares que aseguren la interoperabilidad de datos geoespaciales. e. Dar acceso, sea gratuito u oneroso, a la información territorial pública contenida en el sistema a todos los ciudadanos así como a los entes y órganos públicos, sean estos proveedores o no de información territorial para el sistema, fomentando con ello la democratización en el uso de la información del territorio a todos los niveles de la sociedad.
(…)” De lo expuesto, concluye este Tribunal que corresponde al Ministerio de Ambiente y Energía a través del SINAC y el Programa Nacional de Humedales, la identificación, clasificación, inclusión, manejo, conservación y la administración de estos ecosistemas denominados humedales.
El objeto del proceso se residencia en reclamaciones de conducta omisiva y como tal, conforme al artículo 49 de la Constitución Política, es objeto de control de legalidad de parte esta Jurisdicción las manifestaciones de la conducta administrativa en todas sus formas. Entre estas, se encuentran la conducta omisiva o disfunción administrativa; y es necesario, por el objeto de este proceso una breve referencia a la misma. Primero, existe la inactividad formal o conducta omisiva formal que constituye la falta de declaración de voluntad, juicio o conocimiento que con ocasión de una gestión que plantee un administrado, que no le es atendida. También existe la omisión formal que comprende la falta de cumplimiento a una obligación impuesta por el ordenamiento jurídico, ya sea por norma constitucional o legal; como por ejemplo emitir disposiciones de carácter reglamentario. Otra manifestación de conducta omisiva es la inactividad formal convencional, que constituye la no suscripción de contratos -ya sean bilaterales o plurilaterales- y con ello, se afecte el interese público o de los concesionaniso.
Por último la inactividad en el ejercicio de acciones procesales de titularidad administrativa, que se presenta cuando la Administración no interpone procesos donde se planteen pretensiones para tutelar bienes e intereses públicos esto sería, por ejemplo, en el supuesto de que la Administración Pública, en el ejercicio de sus competencia de Administración de un bien de dominio público, no interponga acciones judiciales en defensa de este bien frente a situaciones de amenaza o riesgo. Por otra parte, está la inactividad material referida a la omisión que comete la administración pública al no realizar alguna actividad, ya sea técnica o material con efectos externos, la cual comprende el ejercicio de funciones o potestades públicas, la ejecución de actos administrativos favorables o la prestación de servicios públicos debidos. Tratándose del control de legalidad de esta forma de manifestación de la función administrativa o sea la conducta omisiva, verificada la omisión acusada, esto es, la no realización de la conducta ya sea formal o material, impuesta por el ordenamiento jurídico, la consecuencia inmediata es la condena a la Administración de hacer o cumplir la conducta omitida, conforme a la previsión del inciso g) del artículo 122 del Código Procesal Contencioso Administrativo, lo que en doctrina se ha denominado como “pretensión prestacional”.
En este caso, conforme al cuadro fáctico que sustenta este fallo y el concepto técnico de conducta omisiva de la Administración, es evidente que se está frente a una omisión material, en tanto se ha constatado, a partir de la evidencia que arrojó la prueba documental y los testimonios evacuados de los funcionarios llamados a declarar, que las recomendaciones para la restauración del Humedal no se han materializado, instrumentado o dado seguimiento efectivo y oportuno para el resguardo y recuperación del Humedal “Laguna Pochotal”.
X.DE LA OMISIÓN REPROCHADA EN LA DEMANDA- A partir del sustento normativo y doctrinario expuesto en los considerandos previos y de una revisión de los extremos de lo controvertido, del cuadro fáctico que se expuso, de la constatación que de esos hechos hizo el Tribunal a partir de la prueba documental así como de los testimonios recibidos, procede esta Cámara a revisar la alegada conducta omisiva expuesta en las pretensiones del proceso.
“1. Se ordene a los demandados establecer los verdaderos límites del ecosistema de Laguna Pochotal, en apego a la realidad y características biofísicas, ecológicas y legales de estos ecosistemas, en corrección a los límites indicados en el Decreto Ejecutivo N° 34507 publicado en La Gaceta N° 104 del día 30 de mayo de 2008.” CRITERIO DEL TRIBUNAL: Se acreditó que el límite del humedal debe ser modificado, de acuerdo del recaudo de las recomendaciones de los informes TAA-DT-002-2021 del 7 de enero del 2021 y el informe SINAC-ACOPAC-CH-0010-2023 del 9 de marzo de 2023 y del SINAC-ACOPAC-CH-0062-2023 del 25 de setiembre de 2023. De estos últimos se desprende sin duda alguna, una recomendación al Programa Nacional de Humedales para actualizar en el Registro Nacional de Humedales la nueva área del mismo humedal e incorporar la información en la plataforma del SNIT. Si bien, esta recomendación fue dirigida a la Coordinación del Programa Nacional de Humedales a través del oficio SINAC-ACOPAC-CH-0019-2023 en fecha 05 de abril de 2023; no obstante, de manera contraria quedó demostrado según lo indicado por la señora Jackelyn Rivera Wong, señalando que actualmente el trámite de actualización de los límites del humedal Laguna Pochotal en el SNIT está en proceso, pero que no se ha finalizado en el tanto, no cuentan recurso humano necesario para finalizar dicho trámite.
Esta Cámara desprende de lo anterior omisiones inclaudicables pero faltantes para tener por materializada la pretensión pedida, por lo que es claro que el Estado y SINAC si bien han emitido informes que establecen la necesidad de ampliar los límites del humedal registrado en el SNIT, esas actuaciones son insuficientes para materializar lo pretendido, incumpliéndose así con los principios ambientales preventivo, progresividad y no regresión y vinculación a la ciencia y a la técnica, así como lo dispuesto en los artículos 2 de la Convención Ramsar. Y los numerales 7 y 42 de la Ley Orgánica del Ambiente y lo dispuesto en el decreto ejecutivo 36427-MINAET artículo 4 inciso h). (Hecho probados 4, 12, y 13). Por esta razón el Tribunal tiene por constatada la omisión y por ello la pretensión se acoge.
“2. Se ordene inmediatamente que se eliminen todos los canales artificiales que están drenando los humedales de Laguna Pochotal y en sus alrededores”. CRITERIO DEL TRIBUNAL: Quedó acreditad, como hace referencia este Tribunal desde el hecho probado primero, que desde la emisión del oficio fecha 2 de febrero de 2014 ACOPAC-PZMT-003-2014, se señaló como una recomendación realizar por los medios legales y administrativos el cierre de los canales que desaguan el ecosistema palustrino de la Laguna Pochotal, con el objetivo de recurarla. Posteriormente como se desprende del hecho demostrado cuatro, en el Informe de Inspección TAA-DT-002-2021 del 7 de enero de 2021 y lo manifestado por el testigo Juan Sánchez Ramírez en la audiencia complementaria, se comprueba la existencia de canales artificiales por actividad antrópica y se dio la recomendación de eliminar los mismos para que el Humedal recuperará su cauce natural.
“Figura 5. Sobre la ortofoto 2017 se representa la ubicación de la DA(…)” Posteriormente, se emitió el informe SINAC-ACOPAC-CH-0010-2023 del 9 de marzo de 2023, que se constata en el hecho probado 12 en el cual se concluyó “(…) Existe una clara modificación de la red hídrica que naturalmente conformaba los humedales en este sitio, aunada a esta, la construcción de una red de canales de drenaje, muros, construcciones y caminos, alteraron los flujos de agua que alimentaban la Laguna Pochotal, secándola y por tanto afectando su ecología. Para rescatar este ecosistema, es urgente eliminar todos los canales que actualmente lo drenan y están dirigiendo el agua hacia la playa. (…)” Suma a lo anterior que estos canales artificiales fueron identificados no solo en los informes citados, sino además en la prueba testimonial de los señores Juan José Sánchez, Jackelyn Rivera Wong, y Carlos Vinicio Cordero Valverde, quienes determinaron la existencia de los mismos y concuerdan en que deben eliminarse para restituir el cauce del humedal y darle el recurso hídrico que necesita el mismo (Humedal Laguna Pochotal).
Se desprende de esa documental que el SINAC desde el año 2014 conocía de esta problemática y de la necesidad de cerrar o eliminar estos canales artificiales para no seguir perjudicando el ecosistema del humedal; sin embargo, quedó evidenciado que no se ha materializado la recomendación de este cierre. (Hecho probados 15, 18 y 19); para darle termino a esa anormalidad antinatural, Es evidente para esta Cámara, que esta conducta omisiva por parte del Estado y el SINAC, se mantiene y no muestra conductas determinativas en orden a restaurar el ecosistema, al menos a una condición de recuperación, por lo que se concluye que esa conducta omisiva es contraria a lo dispuesto en el artículo 50 de la Constitución Política, a los principios ambientales de preventivo contra el deterioro del recurso natural, progresividad y no regresión, principio precautorio y vinculación a la ciencia y a la técnica, así como lo dispuesto en los artículos 3 y 4 de la Convención Ramsar.
De igual forma, es contrario en el nominal 7 inciso h) y 43 y 45 de la Ley Orgánica del Ambiente. y lo dispuesto en el decreto ejecutivo 36427-MINAET artículo 2. Por lo anterior, el Tribunal tiene por constatado que hay una omisión en las conductas debidas debiéndose estimar la pretensión pedida.
“3. Se ordene a los demandados realizar un modelaje que permita orientar el flujo y drenaje de las aguas en forma similar a como ocurría a antes de la modificación ocasionada por estas acciones antrópicas” CRITERIO DE TRIBUNAL: Quedó acreditado de la prueba documental en los hechos probados cuatro y doce, que el modelaje de aguas, que es un aspecto que desarrolla los informes TAAT-002-DT-2021 y SINAC-ACOPAC-CH-010- 2023, sigue sin completarse. El biólogo Juan Sánchez Ramírez y la señora Jackelyn Rivera Wong, según sus exposiciones en la audiencia complementaria, reconocen que debe restaurarse el flujo hídrico del humedal Pochotal, recomendando eliminar los canales artificiales, para con ello restaurar su flujo. Consideran que el recurso hídrico es fundamental para recuperarlo; sin embargo reconocen que la eliminación de los canales no se ha realizado. (hechos probados 4, 12, 15 y 18). Es claro para este Tribunal que el flujo y drenaje de las aguas fue modificado antinaturalmente perturbando el ecosistema existente, llevándolo a su posible y futura extinción.
Este aspecto es de vital importancia, que tanto el Estado y el SINAC han quedado en deuda con la protección ambiental desvirtuando el principio de conservación y resguardo de las áreas protegidas como lo son los humedales y una falta de cumplimiento de lo dispuesto en la normas que regulan la materia y las funciones que deben realizar tanto el Estado, el SINAC y el Programa Nacional de Humedales, desde lo dispuesto en la Constitución Política, los principios ambientales indicados en el Considerando VII de este pronunciamiento, lo dispuesto en los artículos 3 y 4 de la Convención Ramsar y la Ley Orgánica del artículo 7 inciso h) y 43 y 45 de la Ley Orgánica del Ambiente; apreciándose nuevamente una conducta omisiva al respecto para contener los problemas citado. Por lo expuesto, este Tribunal acoge la pretensión.
“4. Se ordene a intervenir la Laguna Pochotal para recuperar su espejo de agua.” CRITERIO DEL TRIBUNAL: En el informe Inspección TAA-DT-002-2021 del 7 de enero de 2021, según hecho probado cuatro, se recomendó recuperar el espejo de agua el cual se encuentra invadido por plantas herbáceas y pasto alemán, según relató el señor Sánchez Ramírez y que, éste debe recuperarse para no poner en peligro las aves en extinción que llegan al ecosistema del Humedal Laguna Pochotal. Por su parte la señora Jackelyn Rivera Wong indicó que para recuperar el espejo de agua se debe de iniciar un protocolo de restauración de todo el humedal, ya que no podría intervenirse en forma parcial o sectorial. Igualmente reconoció que en este momento no existe un protocolo de diagnóstico o recuperación para el Humedal Laguna Pochotal. (hechos probados 4, 16 y 18) De lo comprobado, este Tribunal aprecia rigores conducentes inmaterializados en orden para paliar y mitigar el menoscabo indicado, de lo cual cuenta y exhibe grave omisión por parte del Estado y el SINAC para la debida regeneración de ese hábitat; por lo que esta Cámara considera que la conducta generada es contraria a lo dispuesto en el artículo 50 de la Constitución Política, a los principios ambientales de prevención contra el deterioro del recurso natural, progresividad y no regresión, el precautorio y el de vinculación a la ciencia y a la técnica, así como lo dispuesto en los artículos 3, 4 y 5 de la Convención Ramsar.
De igual forma, es contrario en el nominal 7 incisos a) y h) y 40, 42, 44 y 45 de la Ley Orgánica del Ambiente y lo dispuesto en el decreto ejecutivo 36427-MINAET artículo 2. Por lo expuesto, se acoge la pretensión.
“5. Se ordene al SINAC ejercer una vigilancia más estricta y periódica, a fin de evitar que continúe el deterioro de estos humedales.” CRITERIO DEL TRIBUNAL: Si bien es cierto, quedó demostrado que el SINAC desde el año 2014 hasta la fecha ha emitido una serie de oficios y acciones que describen la situación del humedal, pero no han pasado o han ido más allá de las recomendaciones dichas. Nótese como, en los oficios:
1- ACOPAC-PZMT-003-2014 del 2 de febrero de 2014: se determinó que el Humedal Laguna Pochotal ha sido afectado por acciones antrópicas. 2- SINAC-ACOPAC-CUSB-PMC-114-2016 del 24 de agosto de 2016: recomendó la delimitación completa del ecosistema. 3- El Informe de Inspección TAA-DT-002-2021 del 7 de enero de 2021: da cuenta de la inspección realizada en sitio, que determinó el estado o situación retrospectiva de los humedales relacionados a la Laguna Pochotal y planteó un serie de recomendaciones. 4- SINAC-ACOPAC-OSRO-039-2021 del 27 de enero de 2021, dirigido a la oficina Subregional Orotina, Área de Conservación Pacífico Central el cual se solicitó seguir las recomendaciones del informe TAA-DT-002-2021. 5- SINAC-ACOPAC-OSRO-040-2021 del 28 de enero del 2021 el cual determinó que debe realizarse un análisis retrospectivo sobre la dinámica fluvial del Humedal Laguna Pochotal, 6- SINAC-ACOPAC-PPC-013-2021-DEN del 12 de febrero de 2021, mediante el cual se presentó una denuncia ante el Tribunal Ambiental Administrativo sobre el drenado e invasión con infraestructura del Humedal Laguna Pochotal y sus alrededores. 6- El informe DA-UHTPCOSJ-0413-2022 del 02 de marzo de 2022, en el que se determinó la existencia de cambios en la dinámica fluvial de la zona del humedal por canales que drenan la dinámica natural del agua del sitio. 7- El Informe SINAC-ACOPAC-CH-0010-2023, de 09 de marzo de 2023 en el que se plantean una serie de recomendaciones para registrar y restaurar el humedal. 8- SINAC-ACOPAC-CH-0019-2023 de 5 de abril de 2023, por el medio del cual se solicitó a la Coordinadora del Programa Nacional de Humedales, registrar una variación en el área del humedal laguna Pochotal y su calificación.
Y el oficio SINAC-ACOPAC-CH-0062-2023 del 25 de setiembre de 2023, en que se amplía el criterio sobre el humedal de referencia, recomendando incorporar la nueva área de humedal en el SNIT (hechos probados 1, 2, 4, 5, 6, 8, 9, 12, 13, 14 ). Por su parte, los testigos, Sánchez Ramírez, Jackyn Rivera Wong y Carlos Vinicio Cordero Valverde, describieron las actuaciones que ha realizado tanto el SINAC en aras de la protección del Humedal Laguna Pochotal así como los informes, denuncias ante la Fiscalía y el Tribunal Ambiental. (hechos probados 15, 16, 17, 18 y 19 así como la declaración de los testigos indicados). Considera este Tribunal, que si bien es cierto se ha demostrado que se han realizado acciones, denuncias y seguimientos al estado del humedal, se evidenció que continua el deterioro del mismo; siendo esto contrario a lo regulado en los principios ambientales descritos en el Considerando VII de esta resolución y de lo dispuesto en los artículos 3, 4 y 5 de la Convención Ramsar, ordinales 7 inciso a), h), 42, 43, 44 y 45 de la Ley Orgánica del Ambiente y que, al día de hoy persiste la inasistencia adecuada al ecosistema de marras, por lo que se acoge la pretensión.
“6. Se ordene a la Dirección de Aguas realizar un análisis retrospectivo sobre la dinámica fluvial de Playa Hermosa” CRITERIO DEL TRIBUNAL: Sobre este tema se emitió el oficio SINAC-ACOPAC-OSRO-040-2021 del 28 de enero del 2021 que determinó la necesidad de realizar un análisis retrospectivo sobre la dinámica del fluvial. (hecho probado 6 de esta resolución). Posteriormente, la Dirección de Agua elaboró el informe número DA-UHTPCOSJ-0413-2022 del 02 de marzo de 2022, el que hace el análisis retrospectivo de la dinámica fluvial del Playa Hermosa y tuvo como base el informe TAA-DT-002-2021 de biólogo Juan Sánchez Ramírez. Razón por la cual entiende este Tribunal, que dicho órgano ya hizo el análisis peticionado por lo que no hay conducta omisiva en este punto, consecuentemente se impone el rechazo de la pretensión. (hechos probados 6 y 9 de este pronunciamiento).
“7. Se ordene a los demandados a determinar técnicamente cuales son los propiedades que invaden el área de protección del humedal Laguna Pochotal.” CRITERIO DEL TRIBUNAL: Si bien se entiende que en este caso, no se han allegado los fundos privados y sus respectivos titulares, esto no obsta desprender de la prueba ofrecida, que el SINAC el Estado han sido instancias incoordinadas con aquellos órganos vinculados con la materia urbanística, en el sentido de informarles sobre los límites y limitaciones que naturalmente imponen estos ecosistemas al desarrollo urbano, máxime que no se comprueba que se haya solicitado información sobre los propietarios registrales, ni tampoco se comprueba que el SINAC haya solicitado colaboración a la Municipalidad de Garabito o a otras instituciones públicas, que permitan identificar a esos propietarios, sea que invadan de hecho o de derecho la zona del Humedal Laguna Pochotal. (hecho no probado 6). Este Tribunal por lo antes expuesto acoge la pretensión.
El principio de coordinación entre dependencias públicas ha sido desarrollado por el Tribunal Constitucional, y en el tema que nos ocupa garantiza la protección al ambiente. Es innegable que es necesario que exista dicha coordinación entre las diversas entidades públicas, que por su competencia asignada deban intervenir para poder garantizar la protección del medio ambiente y con ello, la salud pública de la población. En ese sentido el artículo 13 de la Ley de Conservación de la Vida Silvestre, faculta al SINAC para solicitar a los organismos descentralizados y centralizados del Estado, a los gobiernos municipales o a cualquier otro ente u órgano de la Administración Pública prestar la colaboración económica o técnica para el cumplimiento de su funciones. La Sala Constitucional de la Corte Suprema de Justicia en la sentencia 5445-99 de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve, se ha pronunciado sobre este principio de coordinación entre dependencias públicas y, en lo que interesa señaló: "De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.
Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” La jurisprudencia constitucional ha indicado que la protección del ambiente es una labor que corresponde a todas las personas por igual, no solo constituye una obligación del Estado, esto implica que debe existir un involucramiento de todos los entes, órganos e instituciones del Estado así como también de los particulares.
En el caso concreto, por la complejidad que reviste el tema de la recuperación del Humedal Pochotal y, por tratarse los problemas denunciados de situaciones complejas, que involucra a varios sectores de la sociedad y del Estado, la solución para la recuperación de ese ecosistema dependerá necesariamente de una acción de coordinación del Estado y las demás instituciones aludidas, para cumplir con lo peticionado.
Así las cosas, en mérito de lo dicho, como se comprobó y quedó acreditado, el Humedal Laguna Pochotal presenta problemas generados por omisiones y acciones antrópicas, las cuales han propiciado el deterioro que muestra ese ecosistema; aunado a las omisiones al seguimiento de las recomendaciones que se han visualizado en el Informe de Inspección TAA-DT-002-2021 del 7 de enero de 2021 en donde se dieron las siguientes recomendaciones: "1. Solicitar de forma urgente a la DA (Dirección de Aguas), que realice un análisis retrospectivo sobre la dinámica fluvial de Playa Hermosa y considere rectificar el criterio emitido según oficio DA-UHTPCOSR-0363-2020. 2 Dado que nunca existió un drenaje natural que desfogue las aguas del humedal Laguna Pochotal bajo el punto GPS 417, debe eliminarse ese canal y desfogue de aguas, ya que está alterando la dinámica de estos humedales. 3. De igual forma, deben eliminarse todos los canales artificiales que drenan los humedales de la zona. 4.
Realizar un montaje que permita reorientar el flujo y drenaje de las aguas de forma similar a como ocurría antes de la modificación ocasionada por acciones antrópicas. 5. Intervenir la Laguna Pochotal para recuperar su espejo de agua, recordando que esta laguna siempre ha sido un humedal estacional. 6. Verificar si el área de la laguna está inscrita a derecho, pues tanto en la información de zona catastrada como en la información catastral de la Municipalidad de Garabito, aparece dicho terreno sin inscribir. 7. Una gran cantidad de propiedades, a lo largo del humedal identificados en el RNH, relacionado al humedal de la laguna, están inscritas en propiedad privada y estarían afectadas para llevar a cabo desarrollos contrarios a la naturaleza de dicho terrenos. 8. Que el ACOPAC ejerza una vigilancia más estricta y periódica, a fin de evitar que continúe el deterioro de estos humedales. Que el ACOPAC advierta, tanto a la Municipalidad de Garabito como a la SETENA sobre la debida coordinación interinstitucional, que debe existir, con el objetivo de que se prevenga la modificación o eliminación de los humedales de Playa Hermosa. 10.
Que el ACOPAC proceda a corregir los alcances del DE.N°34507, publicado en la Gaceta No. 104 del día 30 de mayo de 2008, de acuerdo a lo ya explicado”. Y en el informe SINAC-ACOPAC-CH-0010-2023, de 09 de marzo de 2023 que recomendó: "(...) Que la Dirección de ACOPAC designe un representante de la Oficina Subregional Orotina, (en adelante OSRO) para que forme parte de la Comisión del caso de Laguna Pochotal. Por demostrarse que existe afectación al ecosistema de humedal en áreas bien identificadas desde la apertura de drenajes y modificaciones de cauces de quebradas, las cuales hasta el día de hoy son visibles, se insta a la Oficina Subregional de Orotina a utilizar este informe como insumo para realizar y aportar las pesquisas necesarias requeridas por la Fiscalía, sobre las distintas propiedades donde existen los delitos ambientales entre los que destacan drenajes y rellenos a humedales por obras civiles que interrumpen los flujos naturales de los cuerpos de agua que conforman el humedal Laguna Pochotal.
Al Programa Nacional de Humedales, actualizar en el Registro Nacional de Humedales la nueva área de humedal e incorporar la información en la plataforma del SNIT para que los usuarios puedan consultar y enterarse de los cambios. Enviar este informe a la Municipalidad de Garabito para que se conozca sobre los cambios en el área de este humedal, así como los alcances de Ley para que no se autorice ningún tipo de construcción o infraestructura que perjudique la salud del ecosistema de humedal en los sectores identificados. A la Comisión del SINAC/ACOPAC Laguna Pochotal darle seguimiento a los demás trabajos que se requieran en este Humedal para garantizar permanencia, salud y funcionamiento. (...)".
Ahora bien, dada la magnitud del problema, la persistencia de la inatención oportuna y debida al cumplimiento de la materialización de esas recomendaciones, se hace indispensable ordenar al Estado por medio del Ministerio del Ambiente y Energía y el SINAC que adopten todas aquellas acciones y planes de ordenamiento a fin de prevenir y combatir la contaminación o la degradación del ecosistema de la Laguna Pochotal, acción que debe imponer la adecuada coordinación con la Municipalidad de Garabito y el SETENA para evitar daños mayores, sin obviar la evaluación del impacto ambiental actualizado que permita proponer las medidas oportunas y necesarias para materializar el resguardo ambiental del ecosistema en cuestión. En orden a ello, deberá el SINAC presentar una ruta de trabajo o matriz ambiental que refleje lo ordenado, concretando los plazos en que se cumplirá de manera efectiva la recuperación del Humedal Laguna Pochotal.
Este plan, ruta o matriz, deberá contener al menos, el tipo de acción o acciones que deben realizarse, la institución o instituciones que deban intervenir para realizarla, (en atención al principio de coordinación desarrollado supra), plazo de inicio y plazo de finalización, así como las unidades responsables de darle seguimiento. Corresponderá al Juzgador de la etapa de ejecución de sentencia de este Tribunal, velará por el cumplimiento de esta ordenanza. Tanto el Ministerio de Ambiente y Energía como el SINAC, presentarán informes cada seis meses que demuestren el avance y ejecución de lo dispuesto en la matriz hasta finalizar con el diagnóstico y recuperación del Humedal Laguna Pochotal.
Con fundamento en las consideraciones expuestas en los considerandos previos, se rechaza parcialmente la excepción de falta de derecho, planteada por el Estado y el SINAC.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido, en el tanto, el proceso que nos ocupa refiere a la protección del ambiente, y las entidades accionadas han corroborado la existencia de un interés en la protección y restauración del Humedal Laguna Pochotal. Por la razón indicada, estima este Tribunal que aún y cuando se acogió la demanda, este asunto debe resolverse sin especial condenatoria en costas.
POR TANTO
Se admite como prueba para mejor resolver los oficios SINAC-ACOPAC-CH-0010-2023 del 09 de marzo del 2023 "Criterio sobre Humedal Laguna Pochotal ubicada en el sector de Playa Hermosa, Garabito, Puntarenas", SINAC-ACOPAC-CH-0019-2023 del 05 de abril de 2023 "Variaciones en el área del humedal Laguna Pochotal y su clasificación" y SINAC-ACOCAP-CH-0062-2023 del 25 de setiembre del 2023 "Ampliación de Criterio sobre Humedal Laguna Pochotal, ubicado en el sector de Playa Hermosa, Jacó, Garabito, Puntarenas". Por las razones dadas, se rechaza parcialmente la excepción de falta de derecho opuesta por la representación del Estado y de SINAC. En consecuencia, se acoge parcialmente la demanda incoada por el Lic. WALTER BRENES SOTO en contra del ESTADO y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN. Se ORDENA a las partes demandadas proceder conforme lo indicado en el Considerando XII de este pronunciamiento. Se resuelve sin especial condenatoria en costas. Notifíquese.
