Its purposes shall be: To unify criteria in registry matters, coordinate functions, facilitate procedures for users, streamline work, and improve registration techniques; for all of which the systems shall be modernized.

• a)The Real Property Registry, which includes: real estate property, mortgages, mortgage certificates, condominium property, maritime-terrestrial zone concessions, concessions of the Gulf of Papagayo, tourist marina registry, and national cadastre.
• b)The Legal Entities Registry, which includes: commercial, individuals, civil associations, media outlets and advertising agencies, and sports associations.
• c)The Movable Property Registry, which includes: motor vehicles, aircraft, vessels, space objects, and the Movable Guarantees System.

• d)The Intellectual Property Registry, which includes:
• i)The Industrial Property Registry: invention patents, utility models, industrial drawings and models, trademarks, livestock brands and distinctive signs, appellations of origin and geographical indications, layout-designs of integrated circuits, and livestock brands.
• ii)The Copyright and Related Rights Registry.
• e)The National Geographic Institute (Instituto Geográfico Nacional).

• a)To dictate the measures for the organization and operation of its dependencies; b) To protect, conserve its assets, and ensure their improvement; c) To formulate and execute improvement programs, in accordance with the needs of the dependencies under its charge; d) To administer the specific funds assigned to each of them, as well as other income it receives from other sources, through separate accounts, issuing budgets, agreeing on expenditures, making investments it deems appropriate, promoting and resolving tenders that may be necessary, subject to the provisions of the Financial Administration Law of the Republic and this law; and e) To prepare the necessary bills and regulations and to issue internal regulations for the better functioning of the various dependencies.

An alternate shall be designated for each member.

To designate the four representatives indicated in the preceding paragraph, the respective bodies shall send a list of three candidates to the Ministry of Justice and Grace so that it may designate from among them the principal and the alternate.

In very qualified cases and for just cause duly proven, these bodies may request the Minister to replace either of the two designated persons; for this purpose, a list of three shall be sent, from which the substitute shall be chosen.

The same procedure shall be followed in the case of eventual vacancies or resignations or when the designated member, without justification, misses three sessions of the Administrative Board.

Those designated to the Board of Directors (Junta Directiva) must render a monthly report to the body they represent or in qualified cases when that body so requests.

The members of the Administrative Board shall be designated for two years and may be reelected. However, both the Minister of Justice and Grace and the representative of the Office of the Attorney General of the Republic shall lose their status as members if they cease in their positions before the end of their appointment period. Likewise, the representatives of the aforementioned bodies shall cease in their status as members when they are suspended in the professional practice of the career they represent.

The Executive Branch, by means of an agreement, shall declare the Administrative Board constituted and the Minister shall swear in the members.

The legal representation of the Administrative Board corresponds to its President.

The amount of these per diems is set at four hundred colones, until a general law is enacted establishing the per diems for decentralized and deconcentrated entities. The maximum shall be four remunerated sessions per month. Public servants who are members of the Administrative Board shall only be entitled to receive per diems if there is no overlap in hours with their ordinary duties.

The General Director must be a law graduate (licenciado en Derecho) and a notary public, incorporated into the Costa Rican Bar Association, with at least five years of professional practice.

The General Director of the National Registry shall be appointed by the Executive Branch, chosen from a list of three that the Administrative Board shall prepare for this purpose.

It shall be the responsibility of the General Director to:

• 1)Exercise the function of executive officer of the Administrative Board, in whose sessions he/she shall have a voice but no vote.
• 2)Propose to the Administrative Board the projects for the fulfillment of the functions entrusted to it in Article Three.
• 3)Coordinate the functions of all the dependencies of the National Registry.
• 4)Unify the qualification criteria and issue, in a general manner, measures of a registry nature in the different registries, without being responsible for the analysis or qualification of specific cases, the ruling on which is the responsibility of the Director, person in charge, or head of each dependency.
• 5)Approve the draft budgets submitted to the Administrative Board.
• 6)Order the general administrative measures for all the bodies that comprise the National Registry.
• 7)Take all measures deemed convenient for the operation of the National Registry and its dependencies, in accordance with the rules issued by the Administrative Board.

The Director of the National Registry may not be the director of any of the particular registries.

The Director of the National Registry is prohibited from taking on matters that concern the individual resolution of each of the registries.

As well as issue rules for the better functioning of its dependencies.

4656 of October 31, 1970, is amended to read as follows:

"Article 2.- This stamp shall bear a special distinctive mark and the Central Bank of Costa Rica shall deposit the funds collected under this heading directly into the current account indicated by the Administrative Board of the National Registry, within the first five days of each month, and destined for the purposes of the creation of the Administrative Board"

”Article 2.- The Funds collected for the payment of the stamp tax on endorsements, modifications, and extensions for the total or balance, as the case may be, recorded in the General Pledge Registry, shall be deposited by the Central Bank of Costa Rica directly into the current account indicated by the Administrative Board of the National Registry, within the first five days of each month, and destined for the purposes of the creation of the Administrative Board. For control purposes, the stamps used in these cases shall bear a special distinctive mark”

59 of July 4, 1944 (Constitutive Law of the National Geographic Institute), is amended to read as follows:

"The preparation of cadastral maps throughout the national territory, following the norms that the regulation dictates on the matter"

4384 of August 25, 1969 (Basic Law of the National Registry) is repealed, as well as the second paragraph of Article 13 of Law No. 4564 of April 29, 1970, and all those insofar as they oppose this law. The Administrative Board may lease premises to the State banks for their functions, provided that the needs of the registries are not affected.

(Via Article 29 of Budget Law No. 6995 of July 22, 1985, this numeral was interpreted in the sense that: "...the graduates of the School of Registry Sciences and Techniques of the National University are included in the category of technicians. The benefits indicated in the cited Article 19 and 23 of the Law of the National Registry shall apply to the servants paid with funds from the National Budget, and to those paid with resources from the Budget of the Administrative Board of the National Registry.")

The contributions of the Registry and its servants shall be determined in the organization and operation regulations of the fund that its Administrative Board shall issue, which may not exceed two percent (2%) of its monthly payroll.

5 of September 16, 1939, is transformed into the Pension Regime of the National Registry, which shall retain all the provisions currently in force.

All servants of the National Registry who have worked more than five years for said Institution, and who are paid by the ordinary budget or by that of the Administrative Board of the National Registry, may avail themselves of this Regime.

The Administrative Board of the National Registry shall transfer monthly to the Pension Fund the sum corresponding to the deduction of those officials paid from its budget.

The Costa Rican Social Security Fund (Caja Costarricense de Seguro Social) shall transfer to the Pension Fund of the Registry the totality of the contributions paid by the servants of the National Registry to the Disability, Old Age, and Death Regime, who avail themselves of this law.

For this purpose, it shall carry out the pertinent procedures, in order to acquire a fidelity insurance policy, individual or collective, issued by an insurance institution authorized by law.

This personnel shall be paid with funds from the Administrative Board, for the term stipulated or for an indefinite period, and shall continue to enjoy the benefits and guarantees established in the Statute of the Civil Service Regime, its regulations, and related rules.

To be eligible for this salary regime, the officials must take and pass the tests defined by the Administrative Board of the National Registry, in addition to meeting the requirements established in the ordinary regulations regarding competitive evaluation of credentials.

By executive decree, the salary scale, job categories, and other requirements for the execution of this rule shall be determined."

(Sinalevi Note: Via opinion C-161-2021 of June 8, 2021, it was concluded that this numeral was not affected by the Law for the Strengthening of Public Finances. Said document indicates that: "Although Article 57, subsection o) of the Public Administration Salary Law, added by the Law for Strengthening Public Finances, ordered the amendment of Article 23 of Law No. 6934, that law does not have an Article 23, as it only consists of three ordinary articles and four transitory articles. And even though it is possible to assume that the legislator's intent was to modify Article 2 of Law No. 6934, which added Article 23 to the Law Creating the National Registry, that amendment would have no effect, having fallen upon a provision whose text had already been amended before the entry into force of Law No. 9635. Likewise, it was indicated that the legislator's intent with the addition of Article 57, subsection o) to the Public Administration Salary Law was that the Personnel paid from the budget of the Administrative Board of the National Registry would not receive a percentage of economic compensation for exclusivity different from that set forth in Article 36 of the Public Administration Salary Law.")

The transfers shall be carried out as the different dependencies of the National Registry are organized and as requested by the Administrative Board, considering that it is capable of administering them. As long as this does not occur, they shall continue to be governed by the legal provisions currently applicable to them.

The Cadastre for Legal Applications (Catastro para Aplicaciones Jurídicas) and the other registries shall be attended to by it, in accordance with the needs of each dependency, provided they have been transferred to the Ministry of the Interior.

The officials who do not avail themselves of the salary regime established in this law shall continue under the regime set forth in Article 1 of Law No. 5867, of December 15, 1975, Article 41 of Law No. 7097, of August 18, 1988, and the Public Administration Salary Law, No. 2166, of October 9, 1957.

• a)El Registro Inmobiliario que comprende: propiedad inmueble, hipotecas, cédulas hipotecarias, propiedad en condominio, concesiones de zona marítimo-terrestre, concesiones del golfo de Papagayo, registro de marinas turísticas y catastro nacional.
• b)El Registro de Personas Jurídicas que comprende: mercantil, personas, asociaciones civiles, medios de difusión y agencias de publicidad y asociaciones deportivas.
• c)El Registro de Bienes Muebles que comprende: vehículos automotores, aeronaves, buques, objetos espaciales y el Sistema de Garantías Mobiliarias.

• d)El Registro de la Propiedad Intelectual que comprende:
• i)El Registro de la Propiedad Industrial: patentes de invención, modelos de utilidad, dibujos y modelos industriales, marcas, marcas de ganado y signos distintivos, denominaciones de origen e indicaciones geográficas, trazados de circuitos integrados y marcas de ganado.
• ii)El Registro de Derechos de Autor y Derechos Conexos.
• e)El Instituto Geográfico Nacional.

• a)Dictar las medidas de organización y funcionamiento de sus dependencias; b) Proteger, conservar sus bienes y velar por su mejoramiento; c) Formular y ejecutar los programas de mejoras, de acuerdo con las necesidades de las dependencias a su cargo; d) Administrar los fondos específicos asignados a cada una de ellas, así como los demás ingresos que por otros conceptos reciba, mediante cuentas separadas, dictando los presupuestos, acordando los gastos, haciendo las inversiones que estimare adecuadas, promoviendo y resolviendo las licitaciones que fueren del caso, con sujeción a lo dispuesto por la Ley de la Administración Financiera de la República y la presente ley; y e) Preparar los proyectos de ley y reglamentos necesarios y dictar los reglamentos internos para el mejor funcionamiento de las diversas dependencias.

Para cada miembro se designará a un suplente.

Para designar a los cuatro representantes señalados en el párrafo anterior, los organismos respectivos enviarán una nómina de tres candidatos al Ministerio de Justicia y Gracia para que designe de entre ellos al titular y al suplente.

En casos muy calificados y por justa causa debidamente comprobada, estos organismos podrán solicitar al Ministro, sustituir a cualquiera de las dos personas designadas; para tal efecto, se le enviará una terna, de la que escogerá al sustituto.

Igual procedimiento se seguirá en el caso de eventuales vacantes o renuncias o cuando el miembro designado falte, injustificadamente, a tres sesiones de la Junta.

Quienes resulten designados en la Junta Directiva, deberán rendir un informe mensual al organismo que representan o en casos calificados cuando aquel se lo solicite.

Los miembros de la Junta se designarán por dos años y podrán ser reelegidos. Sin embargo, tanto el Ministro de Justicia y Gracia como el representante de la Procuraduría General de la República perderán la calidad de miembros, si cesaren en sus cargos antes de vencer el período de su nombramiento. Igualmente, los representantes de los organismos referidos cesarán en su calidad de miembros, cuando sean suspendidos en el ejercicio profesional de la carrera que representan.

El Poder Ejecutivo, mediante acuerdo, declarará integrada la Junta y el Ministro juramentará a los integrantes.

Corresponde al Presidente de la Junta su representación legal.

Se fija en cuatrocientos colones el monto de estas dietas, mientras no se dicte una ley general que establezca las dietas de los entes descentralizados y desconcentrados. El máximo será de cuatro sesiones remuneradas por mes. Los servidores públicos que integren la Junta solo tendrán derecho a devengar dieta si no se produce superposición horaria con sus labores ordinarias.

El Director General deberá ser licenciado en Derecho y notario público, incorporado al Colegio de Abogados de Costa Rica y por lo menos con cinco años de ejercicio profesional.

El Director General del Registro Nacional será nombrado por el Poder Ejecutivo, escogido de una terna que al efecto elaborará la Junta Administrativa.

Al Director General corresponderá:

• 1)Ejercer la labor de funcionarios ejecutivos de la Junta, en cuyas sesiones tendrá voz pero carecerá de voto.
• 2)Proponer a la Junta los proyectos para el cumplimiento de las funciones encomendadas a esta en el artículo tercero.
• 3)Coordinar las funciones de todas las dependencias del Registro Nacional.
• 4)Unificar los criterios de calificación y dictar, en forma general, las medidas del carácter registral en los distintos registros, sin que le corresponda el análisis o calificación de casos concretos cuyo pronunciamiento competa al Director, encargado o jefe de cada dependencia.
• 5)Aprobar los proyectos de presupuesto que se presenten a la Junta.
• 6)Disponer las medidas administrativas generales par todos los organismos que integran el Registro Nacional.
• 7)Tomar todas las medidas que estime convenientes para la marcha del Registro Nacional y sus dependencias, de acuerdo con las normas dictadas por la Junta.

El Director del Registro Nacional no podrá ser director de ninguno de los registros en particular.

Queda prohibido al Director del Registro Nacional abocar los asuntos que concierne resolver individualmente a cada uno de los registros.

"Artículo 2° - Este timbre llevará un distintivo especial y el Banco Central de Costa Rica depositará los fondos, que se recauden por este concepto, directamente en la cuenta corriente que indique la Junta Administrativa del Registro Nacional, dentro de los primeros cinco días de cada mes y destinada a los fines de la creación de la Junta"

”Artículo 2° Los Fondos que se recauden por concepto del pago del timbre en los endosos, modificaciones y prórrogas por el total o saldo, en su caso, que se practiquen en el Registro General de Prendas, serán depositados por el Banco Central de Costa Rica directamente en la cuenta corriente que indique la Junta Administrativa del Registro Nacional, dentro de los cinco primeros días de cada mes y destinados a los fines de creación de la Junta. Para efectos de control, los timbres que se usen en estos casos llevarán un distintivo especial”

"La confección de las cartas catastrales en todo el territorio nacional, siguiendo las normas que el reglamento dicte al respecto"

Podrá la Junta dar locales en arriendo a los bancos del Estado, para las funciones de éstos, siempre que no se afecten las necesidades de los registros.

(Mediante el artículo 29 de la Ley de Presupuesto N° 6995 del 22 de julio de 1985, se interpretó este numeral en el sentido de que: "...los diplomados de la Escuela de Ciencias y Técnicas Registrales de la Universidad Nacional, están comprendidos en la categoría de técnicos. Los beneficios que señalan los citados artículo 19 y 23 de la Ley del Registro Nacional, se aplicarán a los servidores pagados con fondos del Presupuesto Nacional, y a los pagados con recursos del Presupuesto de la Junta Administrativa del Registro Nacional.")

Los aportes del Registro y de sus servidores serán determinados en el reglamento de organización y funcionamiento del fondo que dictará su Junta Administrativa, los cuales no podrán ser superiores al dos por ciento (2%) de la planilla mensual de la misma.

Podrán acogerse a este Régimen todos los servidores del Registro Nacional que hayan laborado más de cinco años para dicha Institución, que sean pagados por el presupuesto ordinario o por el de la Junta Administrativa del Registro Nacional.

La Junta Administrativa del Registro Nacional girará mensualmente al Fondo de Pensiones, la suma correspondiente a la deducción de aquellos funcionarios pagados por su presupuesto.

La Caja Costarricense de Seguro Social girará al Fondo de Pensiones del Registro, la totalidad de las cuotas pagadas por los servidores del Registro Nacional al Régimen de Invalidez, Vejez y Muerte, que se acojan a esta ley.

Para ello, efectuará los trámites pertinentes, a fin de adquirir una póliza de fidelidad, individual o colectiva, expedida por una institución aseguradora autorizada por la ley.

Este personal será pagado con fondos de la Junta, por el plazo que estipule o por término indefinido, y continuará gozando de los beneficios y las garantías establecidos en el Estatuto de Régimen del Servicio Civil, sus reglamentos y las normas afines.

Para hacerse acreedores a este régimen de salarios, los funcionarios deberán realizar y aprobar las pruebas que definirá la Junta Administrativa del Registro Nacional, además de cumplir con los requisitos establecidos en la normativa ordinaria en materia de concursos de antecedentes.

Por decreto ejecutivo se determinarán la escala de salarios, las categorías de puestos y los demás requisitos para la ejecución de esta norma."

(Mediante el artículo 29 de la Ley de Presupuesto N° 6995 del 22 de julio de 1985, se interpretó este numeral en el sentido de que: "...los diplomados de la Escuela de Ciencias y Técnicas Registrales de la Universidad Nacional, están comprendidos en la categoría de técnicos. Los beneficios que señalan los citados artículo 19 y 23 de la Ley del Registro Nacional, se aplicarán a los servidores pagados con fondos del Presupuesto Nacional, y a los pagados con recursos del Presupuesto de la Junta Administrativa del Registro Nacional.")

(Nota de Sinalevi: Mediante dictamen C-161-2021 del 8 de junio de 2021, se concluyó que este numeral no fue afectado por la Ley de Fortalecimiento de las Finanzas Públicas. Dicho documento indica que: "Si bien el artículo 57 inciso o) de la Ley de Salarios de la Administración Pública, adicionado por la Ley de Fortalecimiento de las Finanzas Públicas, ordenó reformar el artículo 23 de la ley n.° 6934, esa ley no tiene un artículo 23, pues solo consta de tres artículos ordinarios y de cuatro transitorios. Y aun cuando es posible suponer que la intención del legislador era modificar el artículo 2 de la ley n.° 6934, que adicionó el artículo 23 a la Ley de Creación del Registro Nacional, esa reforma no tendría ningún efecto, por haberse hecho recaer sobre una disposición cuyo texto ya había sido reformado antes de la entrada en vigencia de la ley n.° 9635. Asimismo, se indicó que la intención del legislador con la adición del artículo 57 inciso o) a la Ley de Salarios de la Administración Pública, fue que el Personal pagado por el presupuesto de la Junta Administrativa del Registro Nacional no percibiera un porcentaje de compensación económica por prohibición distinto al dispuesto en el artículo 36 de la Ley de Salarios de la Administración Pública".)

Los traspasos se efectuarán conforme se vayan organizando las distintas dependencias del Registro Nacional y conforme lo solicite la Junta Administrativa, considerando que está en capacidad de administrarlas. Mientras esto no ocurra seguirán rigiéndose por las disposiciones legales, que actualmente les son aplicables.

El Catastro para Aplicaciones Jurídicas y los demás registros serán atendidos por ella, de acuerdo con las necesidades de cada dependencia, siempre que se hayan traspasado al Ministerio de Gobernación.

Los funcionarios que no se acojan al régimen salarial establecido en la presente ley, continuarán en el régimen estatuido en el artículo 1 de la Ley No. 5867, de 15 de diciembre de 1975, el artículo 41 de la Ley No. 7097, de 18 de agosto de 1988, y en la Ley de Salarios de la Administración Pública, No. 2166, de 9 de octubre de 1957.
