Strengthening Budgetary Control of Deconcentrated Organs of the Central GovernmentFortalecimiento del control presupuestario de los órganos desconcentrados del Gobierno Central

All budgets of the deconcentrated bodies of the Central Administration shall be incorporated into the national budget for their discussion and approval by the Legislative Assembly.

The Ministry of Finance shall define the budgetary form and technique to be applied to incorporate the aforementioned budgets and shall provide, at the request of the respective body, technical support to facilitate the analysis and decision-making in the process of discussion and legislative approval of the budget of the Republic.

The following laws are reformed:

• a)The third paragraph of Article 18 of Law No. 7428, Organic Law of the Comptroller General of the Republic, of September 7, 1994, is reformed. The text is as follows:

[...]

The bodies, executing units (unidades ejecutoras), funds, programs, and accounts that administer resources independently and are attached to an entity of the Decentralized Administration shall likewise comply with the provisions of this article. The Comptroller General of the Republic shall determine, by means of a reasoned resolution for these cases, the budgets that, due to their amount, are excluded from this procedure.

• b)Articles 24 and 34 of Law No. 8131, Law on Financial Administration of the Republic and Public Budgets, of September 18, 2001, are reformed. The texts are the following:

The subjects included in subsection c) of Article 1 of this law shall remit their budget documents to the Budgetary Authority, for the purpose of verifying compliance with the general and specific directives and guidelines of budgetary policy. The Budgetary Authority shall inform the Comptroller General of the Republic of the results of this verification.

The head of each ministry and of the subjects included in subsection b) of Article 1 shall be the person responsible for presenting the preliminary draft budget to the Ministry of Finance. In the case of the ministries, the preliminary draft must also incorporate, with their express consent, the preliminary draft budget of the deconcentrated bodies attached to them.

For this purpose, the deconcentrated bodies must remit their budget to the corresponding minister, with the prior approval of their highest ranking officials.

To comply with all of the foregoing, the provisions that the Ministry of Finance defines regarding the form and deadlines for this purpose must be observed.

• c)Article 8 of Law No. 5394, Law Creating the Administrative Board of the National Printing Office, of November 5, 1973, and its reforms, is reformed. The text is as follows:

• d)Article 7 of Law No. 5619, Creates the Juan Santamaría Historical Cultural Museum in Alajuela, of December 4, 1974, is reformed. The text is as follows:

The Comptroller General of the Republic is authorized to exercise controls of another nature that, in its judgment, are convenient for the interest of the Museum.

• e)Subsection i) of Article 8 of Law No. 7762, General Law on Concession of Public Works with Public Services, of April 14, 1998, and its reforms, is reformed. The text is as follows:

The Council, in the exercise of its competence, shall have the following powers:

[...]

• i)Approve the preliminary draft budget of the Council, which must be remitted to the minister of the corresponding branch, for matters within his purview.

• f)Article 10 of Law No. 5695, Law Creating the National Registry, of May 28, 1975, and its reforms, is reformed. The text is as follows:

• g)Subsection d) of Article 13 of Law No. 8261, General Law on Young People, of May 2, 2002, and its reforms, is reformed. The text is as follows:

The Board of Directors of the National Council for Public Policy on Young People shall have the following powers:

[...]

• d)Approve, modify, and reject its ordinary and extraordinary preliminary draft budgets, prior to sending them to the Ministry of Culture and Youth, for matters within its purview.

• h)The second paragraph of Article 21 of Law No. 7764, Notarial Code, of April 17, 1998 and its reforms, is reformed. The text is as follows:

[...]

The National Directorate of Notaries shall formulate and approve its preliminary draft budget. The budget shall be constituted by the resources provided in this law and shall not be subject to directives in economic or budgetary matters that limit, in any way, its execution and operation.

• i)The second paragraph of Article 19 of Law No. 8039, Law on Procedures for the Observance of Intellectual Property Rights, of October 12, 2000, is reformed. The text is as follows:

[...]

The Administrative Registry Tribunal shall formulate its preliminary draft budget before the Administrative Board of the National Registry, which shall approve it and send it to the Ministry of Justice and Peace for matters within its purview. Said budget shall be covered with the income received by the Administrative Board of the National Registry, a sum that may not be less than six percent (6%) of the ordinary income of the National Registry, calculated for the fiscal year, nor of the surplus of the National Registry. Such budget shall not be subject to directives in economic or budgetary matters that limit in any way its execution and operation. The personnel shall be paid with funds from the Administrative Board of the National Registry, for the stipulated term or for an indefinite period.

7758. Article 8 of Law No. 7758, Creation of the Museum of Contemporary Art and Design, of March 19, 1998, is repealed.

It shall enter into force upon its publication.

Todos los presupuestos de los órganos desconcentrados de la Administración Central serán incorporados al presupuesto nacional para su discusión y aprobación por parte de la Asamblea Legislativa.

El Ministerio de Hacienda definirá la forma y la técnica presupuestaria que se deberá aplicar para incorporar los presupuestos antes indicados y brindará, a solicitud del órgano respectivo, el apoyo técnico para facilitar el análisis y la toma de decisiones en el proceso de discusión y aprobación legislativa del presupuesto de la República.

Se reforman las siguientes leyes:

• a)Se reforma el párrafo tercero del artículo 18 de la Ley N.° 7428, Ley Orgánica de la Contraloría General de la República, de 7 de setiembre de 1994. El texto es el siguiente:

Los órganos, las unidades ejecutoras, los fondos, los programas y las cuentas que administren recursos de manera independiente y se encuentren adscritos a un ente de la Administración descentralizada, igualmente deberán cumplir con lo dispuesto por este artículo. La Contraloría General de la República determinará, mediante resolución razonada para estos casos, los presupuestos que por su monto se excluyan de este trámite.

• b)Se reforman los artículos 24 y 34 de la Ley N.° 8131, Ley de Administración Financiera de la República y Presupuestos Públicos, de 18 de setiembre de 2001. Los textos son los siguientes:

Los sujetos incluidos en el inciso c) del artículo 1 de esta ley remitirán a la Autoridad Presupuestaria sus documentos presupuestarios, con el propósito de verificar el cumplimiento de las directrices y los lineamientos generales y específicos de política presupuestaria. La Autoridad Presupuestaria informará a la Contraloría General de la República sobre los resultados de esta verificación.

El titular de cada ministerio y el de los sujetos incluidos en el inciso b) del artículo 1 será el responsable de presentar el anteproyecto de presupuesto al Ministerio de Hacienda. En el caso de los ministerios, el anteproyecto deberá incorporar también, con su anuencia expresa, el anteproyecto de presupuesto de los órganos desconcentrados que tenga adscritos.

Para ello, los órganos desconcentrados deben remitir al ministro correspondiente su presupuesto, con la aprobación previa de sus máximos jerarcas.

Para el cumplimiento de todo lo anterior, deberán atenderse las disposiciones que el Ministerio de Hacienda defina en cuanto a la forma y los plazos para ese efecto.

• c)Se reforma el artículo 8 de la Ley N.° 5394, Ley de Creación de la Junta Administrativa de la Imprenta Nacional, de 5 de noviembre de 1973, y sus reformas. El texto es el siguiente:

• d)Se reforma el artículo 7 de la Ley N.° 5619, Crea Museo Histórico Cultural Juan Santamaría en Alajuela, de 4 de diciembre de 1974. El texto es el siguiente:

La Contraloría General de la República queda autorizada para ejercer los controles de otra naturaleza que, a su juicio, convengan al interés del Museo.

• e)Se reforma el inciso i) del artículo 8 de la Ley N.° 7762, Ley General de Concesión de Obras Públicas con Servicios Públicos, de 14 de abril de 1998, y sus reformas. El texto es el siguiente:

El Consejo, en el ejercicio de su competencia, tendrá las siguientes atribuciones:

[...]

• i)Aprobar el anteproyecto de presupuesto del Consejo, que deberá remitirse al ministro del ramo correspondiente, para lo que le compete.

• f)Se reforma el artículo 10 de la Ley N.° 5695, Ley de Creación del Registro Nacional, de 28 de mayo de 1975, y sus reformas. El texto es el siguiente:

• g)Se reforma el inciso d) del artículo 13 de la Ley N.° 8261, Ley General de la Persona Joven, de 2 mayo de 2002, y sus reformas. El texto es el siguiente:

La Junta Directiva del Consejo Nacional de la Política Pública de la Persona Joven tendrá las siguientes atribuciones:

[...]

• d)Aprobar, modificar e improbar sus anteproyectos de presupuestos ordinarios y extraordinarios, previo a enviarlos al Ministerio de Cultura y Juventud, para lo que le compete.

• h)Se reforma el segundo párrafo del artículo 21 de la Ley N.° 7764, Código Notarial, de 17 de abril de 1998 y sus reformas. El texto es el siguiente:

[...]

La Dirección Nacional de Notariado formulará y aprobará su anteproyecto de presupuesto. El presupuesto estará constituido por los recursos dispuestos en esta ley y no estará sujeto a las directrices en materia económica o presupuestaria que limiten, de alguna forma, su ejecución y funcionamiento.

• i)Se reforma el segundo párrafo del artículo 19 de la Ley N.° 8039, Ley de Procedimientos de Observancia de los Derechos de Propiedad Intelectual, de 12 de octubre de 2000. El texto es el siguiente:

[...]

El Tribunal Registral Administrativo formulará su anteproyecto de presupuesto ante la Junta Administrativa del Registro Nacional, que lo aprobará y enviará al Ministerio de Justicia y Paz para lo que le compete. Dicho presupuesto será cubierto con los ingresos que recibe la Junta Administrativa del Registro Nacional, suma que no podrá ser inferior al seis por ciento (6%) de los ingresos ordinarios del Registro Nacional, calculados para el año económico ni del superávit del Registro Nacional. Tal presupuesto no estará sujeto a las directrices en materia económica o presupuestaria que limiten de alguna forma su ejecución y funcionamiento. El personal será pagado con fondos de la Junta Administrativa del Registro Nacional, por el plazo que se estipule o por término indefinido.
