5695 of May 28, 1975, amended by Article 2 of Law No. 5950 of October 27, 1976, are hereby reformed. Their texts shall read as follows:
"Article 1.- The National Registry is hereby created, under the Ministry of Justice, which shall integrate under a single body the registries and offices indicated in the following article. Its purposes shall be: To unify criteria in matters of registration, coordinate functions, facilitate procedures for users, streamline tasks, and improve registration techniques; for all of which the systems shall be modernized." "Article 2.- The National Registry shall be composed of, in addition to those assigned by other laws, the following registries: the Public Registry, which includes the following: Real property, mortgages, mortgage certificates, condominium (propiedad horizontal), leases, persons, commercial matters, associations, media outlets, and advertising agencies; the Movable Property Registry, which includes matters relating to pledges and vehicles; the Industrial Property Registry, which also includes matters concerning invention patents and livestock brands; and the National Cadastre." "Article 4.- The Board shall be composed of five members, as follows: The Minister of Justice, who shall preside; a delegate from the Ministry of Justice; and one representative from each of the following bodies: Office of the Attorney General (Procuraduría General de la República), Bar Association (Colegio de Abogados), and Costa Rican Union of Lawyers (Unión Costarricense de Abogados). An alternate shall be designated for each member.
The delegate from the Ministry of Justice shall be freely appointed by the head of the Ministry, and for the designation of the three representatives indicated in the preceding paragraph, the respective bodies shall send a list of five candidates to the Minister of Justice, so that the latter may designate the principal member and the alternate from among them. These bodies may request the Minister, in highly qualified cases and for duly proven just cause, to replace either of the two designated persons. For such purposes, they shall send a shortlist of three, from which the Minister shall choose the substitute. The same procedure shall be followed in the case of eventual vacancies or resignations, or when the designated member is absent without justification from three sessions of the Board.
The members of the Board shall be designated for four years and may be reelected. However, both the Minister of Justice and the representative of the Office of the Attorney General shall lose their status as members if they cease in their positions before the expiration of the term of their appointment.
The Executive Branch, by means of an agreement, shall declare the Board constituted and the Minister shall administer the oath of office to its members.
Legal representation of the Board corresponds to its President." "Article 5.- The Board shall agree upon the days and hours of ordinary sessions, as well as the location thereof. The amount of these per diems is set at four hundred colones, until a general law is enacted establishing per diems for decentralized and deconcentrated entities. The maximum shall be four remunerated sessions per month. Public servants who are members of the Board shall only be entitled to receive a per diem if there is no time conflict with their ordinary duties." "Article 6.- There shall be a Director General, to whom the directors of the various integrated offices of the National Registry shall be hierarchically subordinate for administrative purposes.
The Director General must be a lawyer, duly admitted to the Bar Association, and a notary public with no less than five years of experience in notarial or registry matters and in public administration.
The Director General of the National Registry shall be appointed by the Executive Branch, chosen from a shortlist of three prepared for that purpose by the Administrative Board.
The Director General shall be responsible for:
- 1)Acting as the executive officer of the Board, in whose sessions he/she shall have a voice but no vote.
- 2)Proposing to the Board projects for the fulfillment of the functions entrusted to it in Article three.
- 3)Coordinating the functions of all offices of the National Registry.
- 4)Unifying qualification criteria and issuing, in a general manner, measures of a registry nature in the various registries, without being responsible for the analysis or qualification of specific cases, the ruling on which corresponds to the Director, manager, or head of each office.
- 5)Approving the budget projects submitted to the Board.
- 6)Ordering the general administrative measures for all bodies that make up the National Registry.
- 7)Taking all measures deemed appropriate for the operation of the National Registry and its offices, in accordance with the rules issued by the Board.
The Director of the National Registry may not be the director of any of the registries in particular.
The Director of the National Registry is prohibited from handling the matters that concern each of the registries to resolve individually."
