The National Market Surveillance Authority (ANVM) that prepares to carry out an inspection or verification of compliance with technical regulations must draw up minutes at the place of the events. The minutes, according to the format that each National Market Surveillance Authority (ANVM) establishes, must contain at least the following:
a. Minutes number, place, date, and time.
b. Full name of the official, the capacity in which they act, identity document number or official identification document, authority responsible for the proceeding.
c. Name of the establishment in question, name of its owner, whether a natural person or legal entity, indicating the corresponding identity document numbers, as well as the location by province, canton, and district, exact address of the establishment, or location by geographic points geolocation where the minutes are being drawn up, and means of communication such as landline and mobile phone numbers, email address, among others.
d. Full name, qualifications, identity document number or official identification document, domicile, and means of communication, such as landline and mobile phone numbers, email address, of the manager, administrator, person in charge, or representative of the establishment.
e. Clear and specific specification of the event.
f. Observations made.
g. Sample collection.
h. Indication of the alleged infraction, as well as the legal basis, for example, related Law or technical regulation.
i. Signature at the foot of the minutes by the official who draws them up and at least one witness who may also be an official of the National Market Surveillance Authority (ANVM).
A copy of the minutes drawn up, which may be printed or electronic, shall be delivered to the owner, manager, administrator, person in charge, or representative of the establishment, who must sign the receipt of the minutes physically or by means of a digital certificate. If they refuse or are unable to do so, this condition shall be recorded in the same document.
In the event that the minutes are electronic, they shall be sent through any official telematic means of the National Market Surveillance Authority (ANVM).
The document thus completed, and any other corresponding document, image, or video, shall be transferred to the offices of the National Market Surveillance Authority (ANVM).
