1st-That in district 08 Cabo Velas, of the third canton Santa Cruz of the province of Guanacaste, there are State lands, with an area of 11.46 hectares, which include mangrove and estuary areas.
2nd-That adjacent to the mangrove, there is a forest area belonging to Reserva Conchal Sociedad Anónima, 3-101-124933, represented by Carlos Hernández Herrero, of legal age, married once, Civil Engineer, holder of identity card Nº 9-0015-0594, Director of Operations with powers of Generalísimo Attorney-in-Fact without limit of amount. The property is registered under the Real Folio number 5033737-000, located in district 08 Cabo Velas, canton 03 Santa Cruz of the province of Guanacaste, whose boundaries are to the north, with the inalienable zone and Manuel Sequeiro; to the south, with public road Matapalo; to the east, with José Joaquín Chaves and to the west, with public road.
3rd-That in August 2007, Reserva Conchal Sociedad Anónima, expressed its willingness to incorporate its property, described above, under the wildlife protection regime for a period of ten years; committing within this period of time, not to develop any activity that affects the fragility of the different ecosystems existing in said area, without having the corresponding authorization from the Tempisque Conservation Area of the National System of Conservation Areas (SINAC). Likewise, it will provide all necessary collaboration so that researchers, natural resource inspectors and other SINAC officials, may visit said area in performance of their duties.
4th-That the property corresponds to an area of 28.29 hectares that are located approximately at coordinate 337573 E / 264745 N, cartographic sheet Matapalo Nº 3047 III.
5th-That the area of interest is considered of great importance for the protection of biodiversity of the coastal zone, as it presents special characteristics for the conservation of significant species of flora and fauna associated with wetlands, among them: red mangrove (Rhizophora mangle), white mangrove (Laguncularia racemosa), black mangrove (Avicennia germinans) and buttonwood mangrove (Conocarpus erecta) and reptiles such as the crocodile (Crocodylus acutus). The ecosystems temporarily or permanently shelter species of aquatic birds among which stand out the jabiru (Jabiru mycteria), the black-bellied whistling duck (Dendrocygna autumnalis) and the roseate spoonbill (Ajai ajaja), among others. While crustaceans are represented by a great variety of species of crabs such as the fiddler crab (Uca sp), the land crab (Cardisoma crassun) and the blue crab (Gecarcinus sp). Among the mammals present, notable are the mantled howler monkeys (Alouatta palliata), white-tailed deer (Odocoileus virginianus) and white-nosed coati (Nasua narica).
6th-That the area of interest to be protected forms part of the Diriá Biological Corridor, allowing the protection and exchange of species between said places. Furthermore, it consolidates ecological connectivity and the viability of biodiversity.
7th-That the area of Playa Conchal, the estuary, the Puerto Viejo Mangrove and the forest that will be subjected to protection are within the El Capulín micro-watershed. This micro-watershed supplies water to the mangrove since the mouth of the estuary is separated from the mangrove by a section of beach and a dune that acts as a barrier or plug for its waters. During the rainy season, depending on the intensity of the precipitation, the barrier can break and communication with the sea is re-established, otherwise the micro-watershed would be the only source of freshwater to the mangrove.
8th-That part of the duties and functions of the State is to ensure and guarantee environmental protection, Costa Rica being one of the most prominent countries in this sphere of action, establishing a system of protected areas throughout its territory, putting into practice the constitutional mandate established in article 50.
9th-That the administration of wildlife and the recommendation of measures that ensure the perpetuity of species, are functions of the National System of Conservation Areas (SINAC), in accordance with article 22 of the Biodiversity Law, Nº 7788, through the Tempisque Conservation Area (ACT), an Area that forms part of the System in accordance with article 21 of the Regulation to the Biodiversity Law, Executive Decree Nº 34433-MINAE published in La Gaceta Nº 68 of April 8, 2008.
10.-That the Forest Law (Ley Forestal) provides that the administration of the forest resource shall be the competence of the Ministry of Environment and Energy (*), and must therefore ensure its conservation in areas that comprise the Natural Heritage of the State.
(*)(Thus modified its denomination by article 11 of the Law "Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, N° 9046 of June 25, 2012) 11.-That there is a Management Plan authorized by the Technical Committee and the Regional Council of the Tempisque Conservation Area since December 20, 2006, said plan was approved definitively and formally, by resolution ACT-OR-034-2007 of November 15, 2007 issued by the Technical Committee of the ACT.
12.-That in accordance with article 12 subsection d) of the Regulation to the Biodiversity Law, Executive Decree Nº 34433-MINAE published in La Gaceta Nº 68 of April 8, 2008, the National Council of Conservation Areas (CONAC), in Extraordinary Session Nº 003-2008 held on June 16, 2008, by Agreement Nº 15 approved the Management Plan and the creation of the Conchal National Wildlife Refuge, Mixed category.
13.-That having analyzed the objectives pursued by the declaration of the Conchal National Wildlife Refuge, in the Mixed Category, it has been determined that they are consistent with the requirements for creating new wild areas in accordance with the provisions of articles 35 and 36 of the Organic Environmental Law. Therefore,
CREATION OF THE CONCHAL NATIONAL WILDLIFE REFUGE, MIXED CATEGORY
Considering:
DECREE:

a. A sector of 11.46 hectares of mangrove lands that constitute Natural Heritage of the State, in a state area located on cartographic sheet Matapalo Nº 3047 III, with the following boundaries:
Starting from the left bank of the outlet of the Puerto Viejo estuary, from the point with Lambert Costa Rica Norte coordinates 337790 E / 264937 N, from which the boundary follows southward to the boundary marker of the Instituto Geográfico Nacional (IGN) number 262, from which the boundary continues along the markers and coordinates indicated below:
b. A private area of 28.29 hectares of the property identified with Real Folio Nº 5-33737-000, located in the Cabo Velas district, third canton Santa Cruz of the province of Guanacaste, whose owner is Reserva Conchal S. A. with legal entity ID Nº 3 - 101 - 124933 and which borders the mangrove.
It begins at marker number 310 of the Instituto Geográfico Nacional that delimits the Puerto Viejo Mangrove, which has coordinates 337573 E / 264745 N, from this point following a course to the southwest, one continues through the points:

Likewise, the owners voluntarily subject to the protection regime shall provide all necessary collaboration to researchers, natural resource inspectors and MINAE officials (*), when they need to visit said area in functions inherent to their position.

Should the encumbrance period be extended, the owner must request it in writing to the Tempisque Conservation Area three months in advance of the end of said period.

1Que en distrito 08 Cabo Velas, del cantón tercero Santa Cruz de la provincia de Guanacaste, se encuentran terrenos del Estado, con una extensión de 11,46 hectáreas, que incluyen, áreas de manglar y estero.
2Que contiguo al manglar, se encuentra ubicado un área de bosque perteneciente a Reserva Conchal Sociedad Anónima, 3-101- 124933, representada por Carlos Hernández Herrero, mayor, casado una vez, Ingeniero Civil, portador de la cédula de identidad Nº 9-0015-0594, Director de Operaciones con facultades de Apoderado Generalísimo sin límite de suma. La propiedad se encuentra inscrita bajo la matrícula de Folio Real 5033737-000, situada en el distrito 08 Cabo Velas, cantón 03 Santa Cruz de la provincia de Guanacaste, cuyos límites son al norte, con faja inalienable y Manuel Sequeiro; al sur, con calle pública Matapalo; al este, con José Joaquín Chaves y al oeste, con calle pública.
3Que en agosto del 2007, Reserva Conchal Sociedad Anónima, manifestó su voluntad de incorporar la finca de su propiedad, descrita anteriormente, bajo el régimen de protección de vida silvestre por un periodo de diez años; comprometiéndose dentro de este plazo de tiempo, a no desarrollar ninguna actividad que afecte la fragilidad de los diferentes ecosistemas existentes en dicha área, sin contar con la correspondiente autorización del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación (SINAC). Así mismo, dará toda la colaboración necesaria para que los investigadores, inspectores de recursos naturales y otros funcionarios del SINAC, visiten dicha área en cumplimiento de sus funciones.
4Que la finca corresponde a un área de 28,29 hectáreas que se ubican aproximadamente en la coordenada 337573 E / 264745 N, hoja cartográfica Matapalo Nº 3047 III.
5Que el área de interés es considerada de gran importancia para la protección de la biodiversidad de la zona costera, pues presenta características especiales para la conservación de significativas especies de flora y fauna asociada a humedales, entre ellas: mangle rojo (Rhizophora mangle), mangle mariquita (Laguncularia recemosa), palo de sal (Avicennia germinans) y mangle botón (Conocarpus erecta) y reptiles como el cocodrilo (Crocodylus acutus). En los ecosistemas albergan temporal o permanentemente especies de aves acuáticas entre las que sobresalen el galán sin ventura (Jabiru mycteria), el piche común (Dendrocygna autumnalis) y la espátula rosada (Ajai ajaja), entre otras. Mientras que los crustáceos están representados por gran variedad de especies de cangrejos como el cangrejo violinista (Uca sp), el cangrejo terrestre (Cardisoma crassun) y el cangrejo azul (Gecarcinus sp). Entre los mamíferos presentes sobresalen los monos congo (Alouatta palliata), Venado cola blanca (Odocoileus virginianus) y pizote (Nasua narica).
6Que el área de interés a proteger forma parte del Corredor Biológico Diriá, permitiendo la protección y el intercambio de especies entre dichos lugares. Además de que consolida la conectividad ecológica y la viabilidad de la biodiversidad.
7Que el área de Playa Conchal, el estero, Manglar de Puerto Viejo y el bosque que se someterá a protección se encuentran dentro de la microcuenca El Capulín. Esta microcuenca abastece de agua al manglar ya que la boca del estero está separada del manglar por una sección de playa y una duna que actúa como una barrera o tapón de sus aguas. Durante la época lluviosa, dependiendo de la intensidad de la precipitación, la barrera puede romperse y se restablece comunicación con el mar, de lo contrario la microcuenca sería la única que abastece de agua dulce al manglar.
8Que parte de los deberes y funciones del Estado es procurar y asegurar la protección ambiental, siendo Costa Rica uno de los países más destacados en este ámbito de acción, estableciendo un sistema de áreas protegidas en todo su territorio, poniendo en práctica el mandato constitucional establecido en el artículo 50.
9Que la administración de la vida silvestre y la recomendación de medidas que aseguren la perpetuidad de las especies, son funciones del Sistema Nacional de Áreas de Conservación (SINAC), de conformidad con el artículo 22 de La Ley de Biodiversidad, Nº 7788, a través del Área de Conservación Tempisque (ACT), Área que forma parte del Sistema de conformidad con el artículo 21 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68 del 08 de abril de 2008.
10.-Que la Ley Forestal dispone que la administración del recurso forestal será competencia del Ministerio de Ambiente y Energía (*), debiendo velar en consecuencia por su conservación en áreas que comprenden el Patrimonio Natural del Estado.

12.-Que de conformidad al artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68 del 08 de abril de 2008, el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Extraordinaria Nº 003-2008 celebrada el día 16 de junio del 2008, mediante Acuerdo Nº 15 aprobó el Plan de Manejo y la creación del Refugio Nacional de Vida Silvestre Conchal, categoría Mixta.
13.-Que analizados los objetivos que persigue la declaratoria del Refugio Nacional de Vida Silvestre Conchal, en la Categoría Mixto, se ha determinado que los mismos son acordes con los requisitos para crear nuevas áreas silvestres de conformidad con lo dispuesto en los artículos 35 y 36 de la Ley Orgánica del Ambiente. Por tanto,

Considerando:

a. Un sector de 11,46 hectáreas de terrenos de manglar que constituyen Patrimonio Natural del Estado, en un área estatal ubicada en la hoja cartográfica Matapalo Nº 3047 III, con los siguientes límites:
Se parte del margen izquierdo de la salida del estero de Puerto Viejo, del punto con las coordenadas Lambert Costa Rica Norte 337790 E / 264937 N, del cual se sigue rumbo al sur hasta el mojón del Instituto Geográfico Nacional (IGN) número 262, a partir del cual el límite sigue por los mojones y coordenadas que se indican a continuación:
b. Un área privada de 28,29 hectáreas de la propiedad que se identifica con el Folio Real Nº 5-33737-000, ubicada en el distrito de Cabo Velas, cantón tercero Santa Cruz de la provincia de Guanacaste, cuyo propietario es Reserva Conchal S. A. con cédula de persona jurídica Nº 3 - 101 - 124933 y que delimita con el manglar.

Asimismo los propietarios sujetos voluntariamente al régimen de protección darán toda la colaboración necesaria a investigadores, inspectores de recursos naturales y funcionarios del MINAE (*), cuando requieran realizar visitas en dicha área en funciones propias de su cargo.

En caso de prorrogar el plazo de afectación, el propietario deberá solicitarlo por escrito al Área de Conservación Tempisque con tres meses de antelación a la finalización de dicho período.

a)Dos representantes del Área de Conservación Tempisque, quienes serán nombrados por el Director Regional de esa área.
b)Dos representantes de Reserva Conchal.
c)Un representante de la Fundación Legados de Guanacaste.
