"Article 83.- A Civil Aviation Board (Junta de Aviación Civil, JAC) shall be constituted, composed of five members appointed by the Government Council, who may be removed from their positions only for ineptitude, negligence in the fulfillment of their duties, physical or legal incapacity, or for faults committed in the exercise of their functions, through information gathered and judged in accordance with the rules of the Civil Service, applicable to that effect. They must have experience in some civil aviation activity; they shall serve in their positions for four years and may be appointed for successive periods. Three of the members shall be chosen directly by the Government Council from representatives of the Ministries of Public Works and Transport, Interior and Police, and Foreign Affairs, one of whom must be a lawyer. The other two members shall be chosen from the shortlists submitted for this purpose by the majority of national operators of local and international transport, organized for the defense of their common interests and with due legal status.
In default thereof, those two members shall also be appointed by the Council, from among qualified officials in the field from national aviation companies." "Article 135.- Against the resolutions or agreements made by the Board, an appeal may be filed before the Minister of Public Works and Transport through the Civil Aviation Board, within the three business days following notification in "La Gaceta", as the case may be. The Minister shall resolve the appeal within thirty days following the date on which the respective file is complete in the judgment of the Minister. If no further proceedings have occurred, the term shall be counted from the day the file is received. The resolution issued by the Minister shall exhaust the administrative channel, shall be notified through "La Gaceta", and shall take all legal effects from the date of its publication."
