in the entirety of the text - Complete Text of Regulation 28869 Regulation to control the entry of Foreign Vessels into National Territory Complete Text of act: 9573A No 28869-MOPT No 28869-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT In exercise of the powers and prerogatives conferred by article 140, subsections 3 and 18 of the Political Constitution, and on the basis of the provisions of the Law for the Creation of the Ministry of Public Works and Transport No 4786 of July 5, 1971 and its amendments, the General Public Administration Law No 6227 of May 2, 1978, article 28, subparagraph 1) and article 28, subparagraph 2), subsection b), and subsequent and concordant provisions:
1st—That the opening of international trade and tourism activity demand the facilitation and improvement of competitiveness on a global scale, therefore services must be offered that allow for the increase, diversification, and streamlining of international trade and tourism, for which it is necessary to regulate the arrival of foreign vessels at authorized ports (puertos habilitados) within the national territory.
2nd—That foreign vessels arrive within the national territory at locations that are difficult to access and that do not meet the qualification of "authorized ports" for the entry of vessels, and that given the arrival of this type of vessel at such inaccessible and remote locations, the rigorous controls are not being reliably and safely exercised by the competent authorities.
3rd—That vessels entering the national territory from foreign ports must be received by our authorities for their stay in the country; consequently, the vessels, cargo, and passengers must be attended to jointly by the corresponding Maritime, Customs, Immigration, Health, Agricultural Quarantine, and Port authorities, in order to comply with the current requirements in this regard and within the specific field of competence of each one.
4th—That it is essential, in order to exercise control activities by the national authorities, that foreign vessels arrive at "national ports" that have the necessary conditions to carry out this type of activity and that these become the official arrival points, therefore, it is imperative to delineate the official sites authorized for the reception and dispatch of cargo, persons, and vessels in our territory and that, upon their entry into the country, they become subject to the national legal system and the International Conventions on the matter.
5th—That the Law for the Creation of the Ministry of Public Works and Transport No 4786 of July 5, 1971 and its amendments, establishes in its article 2, and subsequent and concordant articles, the material competence vested in the Ministry, recording in its subsection c) the inescapable obligation to plan, construct, improve, and maintain deep-sea and cabotage ports, inland navigation waterways and terminals, ferry systems and the like, and to regulate and control international, cabotage, and inland waterway maritime transport.
6th—That taking into consideration everything stated above, it is reasonable and necessary to regulate the entry of vessels arriving from foreign ports to authorized ports within the national territory. Therefore,

By virtue of the foregoing, it is declared that the ports indicated in this article are the only ones officially authorized for the arrival of foreign vessels into the country.
Based on duly substantiated technical criteria of evident public interest, the Maritime and Port Safety Directorate may eventually declare the temporary or permanent disqualification of the ports cited above.
