throughout the entire text - Full Text of Norm 44788 Declaration of public interest to carry out all those activities necessary for conservation, improvement, and replacement, total or partial, of existing facilities, in the Parque Metropolitano la Sabana and the parque la No. 44788-MINAE THE PRESIDENT OF THE REPUBLIC, and THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers and authorities conferred by Articles 140, subsection 20, and 146 of the Political Constitution; sections 25, 27 subsection 1, 28, paragraph 2 subsection b), of the General Public Administration Law, Law 6227 of 2 May 1978; Articles 28 and 30 of the Organic Environmental Law, Law 7554 of 04 October 1995; Articles 8 and 9 of the Biodiversity Law, Law 7788 of 30 April 1998; Article 106 of the Law Creating the Instituto Costarricense del Deporte y la Recreación and the Legal Regime of Physical Education, Sport, and Recreation, Law 7800; Law 7555, the Costa Rican Historical-Architectural Heritage Law, of 4 October 1995.

1. The Parque Metropolitano La Sabana and the Parque Metropolitano La Paz constitute the largest urban green spaces in the Greater Metropolitan Area. According to data from the Instituto Costarricense del Deporte y la Recreación (ICODER), these parks are visited by more than 2.6 million people annually for recreational, commercial, sporting, and mass entertainment purposes; thus constituting fundamental public areas for equality of access for inhabitants of the Central Canton of San José and other neighboring cantons to opportunities for personal growth in its different dimensions, this being of great interest to the local government of San José and to the Central State.

2. Article 106 of Law 7800 establishes:

"ARTICLE 106.-Both the La Sabana plain and the constructions and other publicly owned facilities existing therein are designated for the direct or indirect service of the country's physical sports education, under the immediate administration of the Institute, with the exception of an area of 19,114. 7055 m2, with a frontage on the East along calle cuarenta y dos, of 149.10 m, measured towards the north from the point where the fence separating it from the establishment zone is located, and a depth on the South, of 128.75 m in which the Justo A. Facio and Luis Dobles Segreda schools are located, as well as the facilities found there.

The La Sabana plain and its constructions and facilities include the stadiums, gymnasiums, plazas, children's playgrounds, swimming pools, and other public sites for the practice and promotion, direct or indirect, of physical education and sports, whether national, municipal, of public educational institutions, or of any other state institution; they shall be considered of public utility and, consequently, their purpose may not be changed except by virtue of a law." 3. Article 1 of Decreto Ejecutivo 29305-C, which declares and incorporates into the Historical Architectural Heritage the Parque Metropolitano La Sabana, establishes:

WHEREAS:

340475, 340476, and 340477, located in the Mata Redonda District of the central canton of the province of San José, property of the State, legal ID No. 2-000-045522, under the administration of the Instituto Costarricense del Deporte y la Recreación.

4. For the lake of the Parque Metropolitano La Sabana, specific technical studies exist that indicate among its main problems: almost total loss of the lake's water mass, high sedimentation, water contamination from point and non-point sources (the lake exceeds, on average, more than 12 times the established limit for the presence of total coliforms), invasion of invasive species in the water surface, and loss of biodiversity. Additionally, the surrounding areas of the lake are devoid of plants that would permit the rehabilitation of the space.

5. Decreto 36416-MP-MD, of 14 February 2011, declared of Public Interest the "Proyecto de Recuperación del Parque Metropolitano La Sabana", which consists of the rehabilitation of its safety, sanitation, and ecological functionality through inter-institutional and gradual intervention with sanitation, tree-planting, maintenance, communication, monitoring, and evaluation actions; for which the necessary collaboration is required from institutions that can provide the resources, installed capacities, and knowledge necessary for such purposes; among these, the Municipalidad de San José, the Instituto Costarricense de Electricidad, the Instituto Nacional de Seguros, the Ministerio de Obras Públicas y Transportes, the Ministerio de Seguridad Pública, the Ministerio de Cultura y Juventud, and all other public institutions that can contribute elements for the ideal realization of the project. A norm that was supplemented by Decreto 38320-MINAE, of 13 February 2014, which declared the national convenience of the activities of said project related to sanitation and tree-planting, maintenance, monitoring, and evaluation, as indicated in Article 1 of Decreto No. 38320-MINAE.

6. The implementation of that project has focused on the tree-planting of the Parque Metropolitano La Sabana, but has not included the actions necessary for the restoration of the lake and its surroundings, as well as those spaces for the practice of sport and recreation, which entails a crucial aspect, which is the safety of the park, one of its priority elements being the total lighting of the area; due to the well-known danger that arises during nighttime hours, as it is worth highlighting the benefits of having a public space where sport can be practiced at night, after the workday, which will undoubtedly impact the health and well-being indices of society.

7. The repopulation of the surroundings of the Parque Metropolitano La Sabana promoted by the Municipalidad de San José (among other actors), has generated great interest in the restoration of the La Sabana lake and the entire park in general, in ecological, economic, cultural, social, sporting, recreational, public health, beautification, and many other aspects; insofar as, with its comprehensive renovation, the surrounding area will be of greater interest for investment and will consolidate as a hub of great economic, social, and cultural importance for the Canton of San José. While for its part, the Parque La Paz lacks interested actors for its restoration and reactivation. However, its environmental, social, and recreational value is also very high; therefore, there is equally an interest in undertaking a project similar to the one already described with said park.

8. The maintenance of the parks, and the lakes specifically, has been compromised for various reasons, mainly budgetary, making immediate intervention necessary to restore their ecological, recreational, cultural, and social functionality; and for such purposes, the intervention, support, and contribution are required, both from the Municipalidad de San José, as the entity directly benefited by the renovation of said spaces, insofar as they are located within its geographical jurisdiction and constitute a clear direct public interest of that municipal government, and from the other public institutions whose purposes and powers are related to the objectives pursued by the project; as well as from the private sector.

All within the context of the mandatory coordination that must exist between the municipality and the other public institutions, and among the latter, given the already described concurrence or coincidence of interests around the public interest, both local and national, entailed by the refurbishment of the aforementioned capital-city areas, converting the project into a comprehensive public plan.

9. Preliminary studies suggest that the costs to rehabilitate both lakes and their surroundings in all aspects that would provide visiting persons a space with ideal conditions for carrying out sporting and recreational activities while maintaining the ecological functionality of the space, amount to five million dollars.

10. ICODER is the Administrator of both parks, but achieving that objective requires the articulated work of public institutions and the private sector; for in the present matter, a coexistence of local interests and services with national or state public interests and services is clearly denoted, which obliges the concert of all actors, for the sake of a common good.

11. Subsection e) of Article 4 of the Organic Environmental Law, Law 7554, establishes that for the fulfillment of its purposes, cooperation and coordination mechanisms must be implemented among the institutions involved in the conservation and protection of the environment, seeking greater efficiency and effectiveness of the actions undertaken.

12. Article 83 of the Organic Environmental Law, Law 7554, establishes that the Secretaría Técnica Nacional Ambiental of the Ministerio de Ambiente y Energía is the maximum deconcentrated body in environmental matters; and to carry out all those activities necessary for conservation, improvement, and replacement, total or partial, of wetlands and existing facilities, for the attention and convenience of the public, as well as the installation of lighting systems, construction and/or rehabilitation of courts and other sporting or recreational facilities, in the Parque Metropolitano La Sabana and the Parque La Paz, their protection areas, their surroundings, and connected areas, it issued binding criteria under official communication SETENA-SG-1409-2024, dated 26 November 2024, and indicated that the different activities must comply with an environmental impact assessment (Evaluación de Impacto Ambiental), depending on the design and/or rehabilitation improvements.

13. The metropolitan parks La Sabana and La Paz are highly frequented parks and provide multiple urban and ecosystem services to the inhabitants of the GAM. Furthermore, these spaces are highly valued by the country's people and are vital for the sporting, recreational, and commercial activities of San José.

14. According to commitments 37 and 67 of the New Urban Agenda, issued by the Ministerio de Vivienda y Asentamientos Humanos and the Ministerio de Ambiente y Energía, the country committed to promoting the creation and maintenance of well- connected and distributed networks of quality public spaces that are open, safe, inclusive, accessible, green, and designated for multiple purposes; which are, on one hand, spaces for social interaction and inclusion, human health and well-being, economic exchange, and cultural expression, but also aimed at increasing the resilience of cities to climate change and disasters, reducing noise, and promoting cities and urban landscapes that are attractive and livable, and giving priority to the conservation of endemic species.

15. According to strategic actions 17.3 and 23.1 of the National Habitat Policy, Decreto Ejecutivo 43467 MP-MIVAH-MINAE-PLAN-MOPT, of 4 April 2022, the activity of the State must be oriented toward the "Promotion of the interconnectivity and biological diversity of the green network, through the consolidation of current CBIs" and "Improvement of green and recreational areas, through sustainable designs, with universal access and a gender perspective." 16. The rehabilitation of the Parque Metropolitano La Sabana and the Parque La Paz is an action that will improve the condition and dynamics of both parks, providing an ecologically safe and diverse space for recreation and entertainment, simultaneously benefiting urban biodiversity, in compliance with national legislation, as well as the political, national, and international commitments undertaken by the country.

Therefore; THEY DECREE:

DECLARATION OF PUBLIC INTEREST TO CARRY OUT ALL THOSE ACTIVITIES NECESSARY FOR CONSERVATION, IMPROVEMENT, AND REPLACEMENT, TOTAL OR PARTIAL, OF THE EXISTING FACILITIES, IN THE PARQUE METROPOLITANO LA SABANA AND THE PARQUE LA PAZ, THEIR SURROUNDINGS, AND CONNECTED AREAS.

a)Technical studies (hydrogeological, topographical, climatic, structural, architectural).
b)Project design for the rehabilitation of the lakes.
c)Earthworks (movimientos de tierra).
d)Construction works for the waterproofing of the lakes.
e)Improvement of pipes receiving stormwater.
f)Implementation of floating islands for microclimatic regulation and to promote greater diversity of aquatic birds.
g)Development of wastewater treatment systems, development of nature-based solutions, and sustainable urban drainage systems.
h)Reforestation and development of gardens and landscaping elements in the contour, with native and pollinator woody and herbaceous plants, for the rehabilitation of the landscape surrounding the lake and erosion control.
i)Installation of urban furniture.
j)Construction or maintenance of sporting and/or recreational infrastructure.
k)Any other activity that is technically necessary to achieve the rehabilitation of the water surfaces of both lakes, protection areas, and their surroundings.
l)Design and construction of sports and recreational lighting.
m)Design and construction of bicycle paths (ciclovías) or trails within the park.
n)Installation of kiosks and cafeterias within the existing footprint of the park without affecting the heritage conservation provisions.

1. Que el Parque Metropolitano La Sabana y el Parque Metropolitano La Paz constituyen los espacios verdes urbanos de mayor extensión de la Gran Área Metropolitana. Según datos del Instituto Costarricense del Deporte y la Recreación (ICODER), estos parques son visitados por más de 2.6 millones de personas al año con fines recreativos, comerciales, depo11ivos y de entretenimiento masivo; constituyendo así, áreas públicas fundamentales para la igualdad en el acceso de los habitantes del cantón Central de San José y de otros cantones aledaños, a las oportunidades de crecimiento personal en sus diferentes dimensiones, siendo esto de gran interés para el gobierno local de San José y para el Estado Central.

2. Que el artículo 106 de la Ley 7800 establece:

"ARTÍCULO 106.-Destínase al servicio directo o indirecto de la educación físico deportiva del país, bajo la inmediata administración del Instituto, tanto el llano de La Sabana como las construcciones y demás instalaciones de propiedad pública que en él existen, con excepción de un área de 19.114, 7055 m2, con un frente por el Este a la calle cuarenta y dos, de 149, 10 mts, contados hacia el norte desde el punto donde está situada la cerca que la separa de la zona de establecimiento y un fondo por el Sur, de 128, 75 mts en que se ubican los colegios Justo A. Facio y Luis Dobles Segreda, lo mismo que las instalaciones que ahí se encuentran.

El llano de La Sabana y sus construcciones e instalaciones comprenden los estadios, gimnasios, plazas, campos infantiles de juego, piscinas y demás sitios públicos para la práctica y promoción, directa o indirecta, de la educación fisica y los deportes, ya sean nacionales, municipales, de planteles públicos de enseñanza o de cualquier otra institución estatal, se considerarán de utilidad pública y, en consecuencia, su destino no podrá ser variado sino en virtud de una ley." 3. Que el artículo 1 del Decreto Ejecutivo 29305-C que declara e incorpora al Patrimonio Histórico Arquitectónico, El Parque Metropolitano La Sabana, establece:

CONSIDERANDO:

4. Que para el lago del Parque Metropolitano La Sabana se cuenta con estudios técnicos específicos que señalan entre sus principales problemáticas: pérdida casi total de la masa de agua del lago, alta sedimentación, contaminación del agua fuentes puntuales y difusas (el lago sobrepasa, en promedio, más 12 veces el límite establecido de presencia de coliformes totales), invasión de especies invasoras en el espejo de agua y pérdida de biodiversidad. Adicionalmente, las zonas circundantes del lago se encuentran desprovistas de plantas que permitan la rehabilitación del espacio.

5. Que el Decreto 36416-MP-MD, del 14 de febrero del 2011, declaró de Interés Público del ''Proyecto de Recuperación del Parque Metropolitano La Sabana", el cual consiste en la rehabilitación de su seguridad, sanidad, y funcionalidad ecológica mediante la intervención interinstitucional y gradual con acciones de saneamiento, arborización, mantenimiento, comunicación, monitoreo y evaluación; para lo cual, se requiere de la necesaria coadyuvancia de las instituciones puedan aportar los recursos, capacidades instaladas y conocimientos necesarios para tales fines; entre estos la Municipalidad de San José, el Instituto Costarricense de Electricidad, el Instituto Nacional de Seguros, el Ministerio de Obras Públicas y Transportes, el Ministerio de Seguridad Pública, el Ministerio de Cultura y Juventud y todas las demás instituciones públicas que puedan ap011ar elementos para la ideal concreción del proyecto. Norma que fue complementada con del Decreto 38320-MINAE, del 13 de febrero del 2014, que declaró la conveniencia nacional de las actividades de dicho proyecto relacionadas con saneamiento y arborización, mantenimiento, monitoreo y evaluación, ya que así lo indica el artículo 1 del Decreto Nº 38320-MINAE.

6. Que la implementación de ese proyecto se ha enfocado en la arborización del Parque Metropolitano La Sabana, pero no ha incluido las acciones necesarias para la restauración el lago, y sus alrededores, así como aquellos espacios para la práctica del deporte y la recreación, lo que conlleva un aspecto crucial, cual es la seguridad del parque, siendo uno de sus elementos prioritarios el de la iluminación total del área; debido a la consabida peligrosidad que se presenta en horas nocturnas, pues cabe destacar los beneficios de contar con un espacio público donde se pueda practicar deporte en horario nocturno, después de la jornada laboral, lo que repercutirá sin duda alguna en los índices de salud y bienestar de la sociedad.

7. Que el repoblamiento de los alrededores del Parque Metropolitano La Sabana impulsado por la Municipalidad de San José (entre otros actores), ha generado gran interés en la restauración del lago de La Sabana y de todo el parque en general, en los aspectos ecológico, económico, cultural, social, deportivo, recreativo, de salud pública, de ornato y muchos otros; en el tanto que, con su renovación integral, el área circundante será de mayor interés para la inversión y se consolidará como un polo de gran importancia económica, social y cultural para el cantón de San José. Mientras que por su parte, el parque La Paz carece de actores interesados en su restauración y reactivación. Sin embargo, su valor ambiental, social y recreativo también es muy alto; por lo que igualmente, existe un interés en abordar un proyecto similar al ya descrito con dicho parque.

8. Que el mantenimiento de los parques, y los lagos en específico, se han visto comprometidos por diversas razones, principalmente presupuestarios, por lo que se requiere de una intervención inmediata para devolver su funcionalidad ecológica, recreativa, cultural y social; y para tales fines, se requiere la intervención, el apoyo y el ap01ie, tanto de la Municipalidad de San José, como entidad directamente beneficiada con la renovación de dichos espacios, en el tanto se encuentran en su circunscripción geográfica y constituyen un claro interés público directo de ese ayuntamiento, como de las demás instituciones públicas cuyos fines y potestades están relacionadas con los fines que se persiguen con el proyecto; así como del sector privado.

Todo en el contexto de la obligada coordinación que debe existir entre la municipalidad y las demás instituciones públicas y de estas entre sí, dada la ya descrita concurrencia o coincidencia de intereses en torno al interés público, tanto local como nacional, que conlleva el remozamiento de las citadas áreas capitalinas, convirtiendo el proyecto en un plan público global.

9. Que estudios preliminares sugieren que los costos para rehabilitar ambos lagos y sus alrededores en todos los aspectos que permitan proporcionar a las personas visitantes, un espacio con las condiciones idóneas para la realizar actividades deportivas y recreativas manteniendo la funcionalidad ecológica del espacio, ascienden a los cinco millones de dólares.

10. Que el ICODER es el Administrador de ambos parques, pero para lograr ese objetivo requiere del trabajo articulado de la institucionalidad pública y el sector privado; pues en el presente asunto, se denota claramente una coexistencia de intereses y servicios locales, con intereses y servicios públicos nacionales o estatales, que obliga al concie1to de todos los actores, en aras de un bien común.

11. Que en el inciso e) del artículo 4 de la Ley Orgánica del Ambiente, Ley 7554 establece que para el cumplimiento de sus fines se deben implementar mecanismos de cooperación y coordinación entre las instituciones involucradas en la conservación y protección del medio ambiente, procurando una mayor eficiencia y eficacia de las acciones desarrolladas.

12. Que en el artículo 83 la Ley Orgánica del Ambiente, Ley 7554 establece que la Secretaría Técnica Nacional Ambiental del Ministerio de Ambiente y Energía es el órgano de desconcentración máxima en materia ambiental; y para llevar a cabo todas aquellas actividades necesarias para realizar obras de conservación, mejoramiento y sustitución, total o parcial de los humedales, de las instalaciones existentes, para atención y facilidad del público, así como la instalación de sistemas de iluminación, construcción y/o rehabilitación de canchas y de otras instalaciones deportivas o recreativas, en el Parque Metropolitano La Sabana y el Parque La Paz, sus áreas de protección, sus alrededores y áreas conexas, emitió criterio vinculante bajo el oficio SETENA-SG-1409-2024, de fecha 26 de noviembre de 2024, e indicó que, las diferentes actividades, deberán cumplir con Evaluación de Impacto Ambiental, dependiendo del diseño y/o mejoras de rehabilitación.

13. Que los parques metropolitanos La Sabana y La Paz son parques altamente concurridos y brindan múltiples servicios urbanos y ecosistémicos a las personas habitantes de la GAM. Además, estos espacios son altamente valorados por las personas del país y son vitales para las actividades deportivas, recreativas y comerciales de San José.

14. Que según los compromisos 3 7 y 67 de la Nueva Agenda Urbana, emitida por el Ministerio de Vivienda y Asentamientos Humanos y el Ministerio de Ambiente y Energía, el país se comprometió a promover la creación y el mantenimiento de redes bien conectadas y distribuidas de espacios públicos de calidad, abie11os, seguros, inclusivos, accesibles, verdes y destinados a fines múltiples; que por un lado sean espacios para la interacción social y la inclusión, la salud humana y el bienestar, el íntercan1bio económico y la expresión cultural, pero también orientados a incrementar la resiliencia de las ciudades frente al cambio climático y los desastres, a reducir el ruido y promover ciudades y paisajes urbanos que sean atractivos y habitables y a dar prioridad a la conservación de especies endémicas.

15. Que según las acciones estratégicas 17 .3 y 23 .1 de la Política Nacional del Hábitat, Decreto Ejecutivo 43467 MP-MIVAH-MINAE-PLAN-MOPT, del 4 de abril del 2022, la actividad del Estado debe orientarse al "Fomento de la interconectividad y la diversidad biológica de la trama verde, mediante la consolidación de los CBI actuales" y "Mejoramiento de las áreas verdes y recreativas, por medio de diseños sostenibles, de acceso universal y con enfoque de género".

16. Que la rehabilitación del Parque Metropolitano La Sabana y Parque La Paz, es una acción que mejorará el estado y dinámica de ambos parques, brindando espacio ecológicamente seguro y diverso para la recreación y el entretenimiento, simultáneamente beneficiando la biodiversidad urbana, en cumplimiento de la legislación nacional, así como de los compromisos políticos, nacionales e internacionales, asumidos por el país.

Por tanto;

DECLARATORIA DE INTERÉS PÚBLICO PARA LLEVAR A CABO TODAS AQUELLAS ACTIVIDADES NECESARIAS PARA REALIZAR OBRAS DE CONSERVACIÓN, MEJORAMIENTO Y SUSTITUCIÓN, TOTAL O PARCIAL DE LAS INSTALACIONES EXISTENTES, EN EL EL PARQUE METROPOLITANO LA SABANA Y EL PARQUE LA PAZ, SUS ALREDEDORES Y ÁREAS CONEXAS.

DECRETAN:

a)Estudios técnicos (hidrogeológico, topográfico, climático, estructural, arquitectónico.
b)Diseño del proyecto para la rehabilitación de los lagos.
c)Movimientos de tierra.
d)Obras constructivas para la impermeabilización de los lagos.
e)Mejora de tuberías receptoras de las aguas pluviales.
f)Implementación de islas flotantes para regulación micro climática y para promover mayor diversidad de aves acuáticas.
g)Desarrollo de sistemas de tratamiento de aguas residuales, desarrollo de soluciones basadas en la naturaleza y sistemas de drenaje urbano sostenible.
h)Reforestación y desarrollo de jardines y elementos paisajísticos en contorno, con plantas arbóreas y herbáceas nativas y polinizadoras, para la rehabilitación del paisaje de alrededores del lago y el control de la erosión.
i)Instalación de mobiliario urbano.
j)Construcción o mantenimiento de infraestructura dep01tiva y/o recreativa.
k)Cualquier otra que resulte técnicamente necesaria para lograr la rehabilitación de los espejos de agua de ambos lagos, áreas de protección y sus alrededores.
l)Diseño y construcción de iluminación deportiva y recreativa m) Diseño y construcción de ciclovías o senderos dentro del parque.
n)Instalación de quioscos y cafeterías dentro de la huella existente del parque sin afectar las disposiciones patrimoniales de conservación.

Artículo 1 — – To declare and incorporate into the historical-architectural heritage of Costa Rica, the property known as the Parque Metropolitano La Sabana, registered in the Registro Nacional, Property Section, district of San José, under Folio Real registration numbers No.

Artículo 2 — The interventions carried out in the Parque Metropolitano La Sabana must comply with Law 7555, the Costa Rican Historical-Architectural Heritage Law, of 04 October 1995, and its Regulation 32749, Decreto Ejecutivo No.

Artículo 4 — The rehabilitation or maintenance actions for sporting and recreational infrastructure, lagoons, and their surroundings may comprise the following activities:

Artículo 6 — The procedures and applications that must be processed for the implementation of said activities and their associated works, shall receive priority and expeditious treatment by public entities and bodies within the respective legal framework.

Artículo 7 — It shall be effective upon its publication.

Artículo 2 — Las intervenciones que se realicen en el Parque Metropolitano La Sabana deberán cumplir con la Ley 7555 de Patrimonio Histórico-Arquitectónico de Costa Rica, del 04 de octubre de 1995 su Reglamento 32749, Decreto Ejecutivo Nº32749-MCJD, del 14 de marzo del 2005.

Artículo 4 — Las acciones de rehabilitación o mantenimiento de infraestructura deportiva y recreativa, lagunas y sus alrededores podrán comprender lo siguiente actividades:

Artículo 6 — Los trámites y solicitudes que deban gestionar para la implementación de dichas actividades y sus obras asociadas, recibirán por parte de los entes y órganos públicos un trato prioritario y expedito dentro del marco jurídico respectivo.
