No. 79 - 2017-II ADMINISTRATIVE AND CIVIL TAX COURT. SECOND SECTION. Second Judicial Circuit of San José. Goicoechea. At ten thirty a.m. on November thirtieth, two thousand seventeen.- Ordinary proceeding—action for annulment of an administrative act harmful to the public interest (lesividad)—declared a pure question of law, brought before this Court by the INSTITUTO DE DESARROLLO RURAL -INDER- (formerly IDA), against GANADERA LOMA LINDA, S.A., corporate identification number CED60333. Represented by Mr. Gerardo E. Ugalde Ávila. Attorneys Rodrigo Cervantes Barrantes and Eric Jiménez Trejos appear as counsel with power of attorney (mandatarios judiciales) for the plaintiff. Attorneys Ernesto Jiménez Mora, Ademar A. Zúñiga Quirós, and Marcos Jiménez Mora appear as counsel of record (abogados directores) for the defendant.
BACKGROUND
"Based on the facts and legal grounds set forth, we request that the judgment declare:
1. That this complaint be deemed duly filed.
2. That, because it is harmful to the public interest, the resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 41 of session 031-04, dated 26 de agosto del año 2004, be annulled solely insofar as it concerns the granting of title (titulación) to the property in the Puntarenas Registry District, Real Property Folio registration number Placa12930, in favor of Nombre81222, corresponding to Cadastral Plan P-0912593-2004.
3. By reason of relatedness (conexidad), that deed number 102, recorded on 28 de febrero del año 2005, executed before Notary Luis Enrique Wong Sanchez and issued by the Instituto de Desarrollo Agrario, be annulled solely insofar as it concerns the granting of title to the property in the Puntarenas Registry District, Real Property Folio registration number Placa12930, in favor of Nombre81222, corresponding to Cadastral Plan P-0912593-2004.
4. By reason of relatedness, that the registration entry (asiento registral) for the property recorded by the Registro Nacional under the Real Property Folio system, Puntarenas Registry District, Real Property Folio number Placa12930, be annulled.
5. By reason of relatedness, that any registration derived from the registration of the property recorded in the Registro Nacional, Puntarenas Registry District, Real Property Folio registration number Placa12930, be annulled.
6. That the defendant be ordered to pay both categories of costs (ambas costas) of this proceeding.".

CONSIDERATIONS
Without prejudice to their subsequent assessment, the following relevant facts are deemed proven:

Compliance with all regulatory requirements established in the Reglamento para la Titulación de Tierras en Reservas Nacionales published in La Gaceta 173 of 10 de septiembre del 2002, in conjunction with Ley Forestal No. 7575 of 5 de febrero de 1996 and Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, necessary for the titling to be legally permissible (the record).
In summary, it alleges:
1. I.D.A., now I.N.D.E.R., promoted a series of Titling Programs in National Reserves, pursuant to Ley de Titulación de Tierras ubicadas en Reservas Nacionales No. 7599 of 9 de agosto de 1996, Articles 11 and 12 of Ley de Tierras y Colonización No. 2825 of 14 de octubre de 1961, and Article 32(a) of Ley de Creación del Instituto de Desarrollo Agrario No. 6735.
2. Those programs were established in response to a national need, because there were large areas of the national territory in which farmers lacked title to the land. The Instituto’s work focused on declaring Titling Zones (Zonas de Titulación) in areas where persons possessed the land but lacked title, and then surveying and recording in the cadastre (catastro) those properties that were not registered in the Registro Público and registering the respective title. The beneficiaries were required to pay the costs of titling and land surveying (agrimensura); those costs were far below the average market cost for titling land and had to be paid within a maximum period of one year.
3. Those Programs included the program known as “Programa de Titulación Cuenca del Río Aranjuez,” created by Decreto Ejecutivo No. 28745-MINAE-MAG, of 12 de junio del año 2000 (published in La Gaceta No. 133 of 11 de julio del 2000), which gave rise to the property in the Puntarenas Registry District, Real Property Folio number 115788-000.
4. Within the framework of this program, by means of a written filing submitted to the Instituto, the defendant filed an application for the titling of parcel 26, Block 2, OF THE PROYECTO DE TITULACIÓN CUENCA DEL RÍO ARANJUEZ, described in Cadastral Plan P-0912593-2004, according to which it has an area of 409.663 square meters and 30 square decimeters and consists of mountain land and scrubland (tacotal) (see folio 4 of the land-titling file offered as evidence #3).
5. The land-titling file shows that MINAE certification No. SINAC-DS-OFAU-C-1445-2004, dated 21 de abril del año 2004, was submitted before parcel 26 of Block 2 was registered in favor of the defendant. It established that the property IS LOCATED OUTSIDE ANY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE MINISTERIO DE AMBIENTE Y ENERGÍA. HOWEVER, IT PARTIALLY CONSTITUTES STATE NATURAL HERITAGE PURSUANT TO ARTICLES 13, 14, AND 15 OF LEY FORESTAL Placa12929 16 DE ABRIL DE 1996 (see folio 8 of the Land-Titling File offered as evidence #3).
6. The file contains no study whatsoever by the Instituto Geográfico Nacional.
7. During the parcel-titling proceeding, the defendant did not submit the INTA land-use suitability study or one prepared by a duly accredited private professional qualified to conduct such a study.
8. The Board of Directors of the Instituto accepted the technical recommendation and resolved to convey parcel 26, Block 2, of the Proyecto de Titulación Cuenca del Río Aranjuez through resolution number 41 adopted at Ordinary Session 031-04 held on 26 de agosto del año 2004.
9. The deed of conveyance was executed at 09:00 on 9 de setiembre del año 2004 before Notary Luis Enrique Wong Sánchez, identified as deed number 102, appearing on the front of folio 96 of volume 29 of that notary’s records; and was registered on 28 de febrero del año 2005 under the Real Property Folio of the Puntarenas Registry District, registration number Placa12930, and described in plan P-0912593-2004, according to which it has an area of 40 hectares, 9663 square meters and 30 square decimeters and consists of pastureland and mountain land.
10. In the titling process for parcel number 26, Block 2, of the Proyecto de Titulación Cuenca del Río Aranjuez, described in cadastral plan P-0912593-2004, the requirements underlying its registration in favor of the defendant were not satisfied.
11. Report No. DFOE-PGAA-20-2008 dated 27 de agosto del 2008, issued by the Contraloría General de la República, entitled “Results of Studies on Land Titling in National Reserves on Lands Belonging to the State Natural Heritage,” and addressed to the Instituto, states that the study established that, within the framework of the various titling projects and in violation of Articles 13,14,15, and 33 of Ley Forestal No. 7575 of 5 de febrero de 1996, IDA titled properties with partial or complete forest cover, or properties whose land-use (sic) and topographical characteristics placed them in the category of lands suitable for forestry and protection areas; therefore, they could neither be removed from State administration nor be eligible for titling in favor of the applicants because they formed part of the State Natural Heritage and because each and every requirement necessary for proceeding in accordance with the legality framework in force at that time, so that the titling at issue would be legally permissible, was neither satisfied nor submitted.
12. As part of its review of the aforementioned actions, the Comptroller Body notes, among the cases examined in report DFOE.PGAA- 20-2008, that there are fifteen cases evidencing the titling of lands forming part of the State Natural Heritage.
13. Among the provisions of Report No DFOE-PGAA-20-2008, the Comptroller General orders IDA as follows: “a) Carry out the administrative proceedings and such legal actions as may be appropriate before the corresponding authorities, so that a process may be initiated to recover the lands titled by IDA that belong to the State Natural Heritage (Patrimonio Natural del Estado) and correspond to the 15 cases detailed in this document. b) Order that a complete analysis be conducted of the titling procedures (titulaciones) carried out by IDA that were not part of the sample analyzed by this Office of the Comptroller General in this study, in order to identify any cases involving the titling of lands belonging to the State Natural Heritage and, where appropriate, carry out the procedures to recover the lands.” 14. By resolution adopted by the Board of Directors of I.N.D.E.R. in Article 48 of Ordinary Session 36-2015 of October 5, 2015, the administrative act issued through Resolution No. 41 of Ordinary Session 031-04, held on August 26, 2004, by the Board of Directors of this Institution was declared injurious to the public interest (lesivo a los intereses públicos); that act (sic) gave rise to a property title recorded in the Property Registry, Puntarenas Section, Real Property Folio Registration number Placa12930, in favor of GANADERA LOMA LINDA S.A., because it had been granted to the detriment of the State Natural Heritage.
ARGUMENTS ON THE MERITS. From the account of facts and background set forth above, and from the examination of the documentation contained in the titling file corresponding to parcel 58 of Block 10 (sic) of the Proyecto de Titulación Cuenca del Río Aranjuez, which is submitted as evidence, as well as all the documentation offered generally, it is established that, during the titling process for the indicated parcel, the necessary regulatory requirements prescribed by Ley de Titulación de Tierras en Reservas Nacionales number 7599 of April 29, 1996, or, as applicable, Reglamento para la Titulación de Tierras en Reservas Nacionales, published in La Gaceta 173 of September 10, 2002, were not met, in conjunction with Ley Forestal No. 7575 of February 5, 1996, and Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, which established the requirements for IDA to title parcels; that noncompliance gives rise to defects in the administrative act (vicios del acto administrativo).
The ground for nullity (causal de nulidad) in the cases (sic) at issue in these proceedings affects the public interest because, as a result of the failures to comply with the aforementioned regulations, IDA authorized the conveyance (traspaso) of said parcel (sic), which forms part of the State Natural Heritage. NULLITY OF THE ADMINISTRATIVE ACTS THAT AUTHORIZED THE TITLING AND CONVEYANCE OF PARCEL 26 OF BLOCK 2 IN FAVOR OF GANADERA LOMA LINDA S.A., AND HOW THAT GROUND FOR NULLITY AFFECTS THE PUBLIC INTEREST: I. TITLING PROGRAMS: The lands forming part of the titling projects were transferred to IDA by decree (in the specific case of Programa Cuenca del Río Aranjuez, Decreto Ejecutivo No 28745-MINAE-MAG, dated July 11, 2000), for the purpose of carrying out the respective titling projects (Article 7 of Reglamento para la Titulación de Tierras en Reservas Nacionales). These transfers of the areas to be titled were justified by the possession of unregistered properties by possessors (Articles 2 and 4 of Reglamento para la titulación) and constituted a legal fiction (ficción legal) whereby a large geographic area was transferred to IDA that indiscriminately encompassed registered and unregistered lands, lands owned by the State and by private parties, and lands with or without possessors.
Accordingly, the transfers were made without prejudice to rights already registered over specific portions within the general perimeter of the respective area, to possessory-information proceedings (información posesoria) pending when the decree referred to in Article 7 of Reglamento para la Titulación de Tierras en Reservas Nacionales was published in La Gaceta, to rights registered in the future, or to portions designated for public use. The purpose of these transfers was to provide IDA with a mechanism enabling it to subdivide and convey the lands, also under a legal fiction, and thus register parcels in favor of possessors who had possessed those lands under the conditions established by the legal system, for the purpose of facilitating access to credit (Article 10 of Reglamento para la Titulación de Tierras en Reservas Nacionales). In the case of the parcel at issue, registered in favor of the defendant, the administrative file documents the fact that the lands had been possessed, which demonstrates the preexistence of possessory tenure (tenencia posesoria) of the parcel (sic) before the Board of Directors adopted the resolution authorizing its conveyance (adopted in Article 41 of Ordinary Session 031-04, held on August 26, 2004).
In this regard, the basis on which the possessors acquired those lands is deemed to have been their exercise of possession, rather than the transfers or sales made by IDA, because the only consideration received by the Institute was the cost of preparing the corresponding surveys, rather than the actual price of the parcels. Thus, there was no agreement as to the property and its price; the Institute could not convey the lands to the highest bidder, but was required to convey them to the possessor who demonstrated compliance with the legal requirements, and its role was limited to verifying those requirements (Article 10 of Reglamento para la Titulación de Tierras en Reservas Nacionales). In decision 04587-97 of 15:45 hours on August 5, 1997, the Constitutional Chamber, referring insofar as relevant to possessory-information proceedings, states: “the time at which ownership is acquired through adverse possession (usucapión) is distinguished from the time at which that circumstance is asserted in possessory-information proceedings in order to obtain a title eligible for registration in the Public Registry.
Accordingly, adverse possession is regarded as a means of acquiring ownership and other possible rights in rem (derechos reales), whereas titling is the procedure through which, once the requirements for adverse possession have been established, a registrable property title is conferred.” By analogy, this distinction made by the Chamber is also valid in the titling proceedings carried out by IDA. Therefore, the legal nature of the acts in IDA’s titling projects was merely declaratory: they were limited to recognizing the ownership right acquired by a person through adverse possession so that it could be registered in the Public Registry, and were not acts creating an ownership right. II. ABSOLUTE NULLITY (NULIDAD ABSOLUTA): Instances of noncompliance committed by IDA during the parcel-titling procedure that are precisely what render the administrative conveyance act null. The IDA Board of Directors was advised to authorize the conveyance of the respective parcel, supposedly because the requirements established by Reglamento para la Titulación de Tierras en Reservas Nacionales had been met, and this was the basis for the administrative acts approving the conveyance of the property to the defendant.
Nevertheless, the documentation submitted shows that there was no such compliance, for the following reasons: Article 10 of Reglamento para la Titulación de Tierras en Reservas Nacionales provided that lands subject to administration by MINAE could not be titled. Given that Article 32 of Ley Orgánica del Ambiente establishes that Protected Wildlife Areas (Áreas Silvestres Protegidas) are administered by MINAE, and Article 13 of Ley Forestal establishes that the State Natural Heritage is administered by MINAE, it follows that a certification from that Ministry establishing that the land was not located within protected wildlife areas or the State Natural Heritage was an essential and indispensable requirement for the validity of the proceedings before IDA and the subsequent titling. Subsection b) of Article 10 of Reglamento para la Titulación de Tierras en Reservas Nacionales expressly provided that the applicant must submit an “original certification issued by MINAE stating that the land to be titled, as shown on the registered cadastral survey (plano catastrado), is not affected by or located within conservation areas or the State Natural Heritage.” In the case at issue, the titling file contains a certification issued by MINISTERIO DEL AMBIENTE Y ENERGÍA, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, OFICINA DE ATENCIÓN AL USUARIO, identified by reference number SINAC-DS-OFAU-C-1445-2004 and dated April 21, 2004, according to which the aforementioned property “…IS LOCATED OUTSIDE EVERY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY MINISTERIO DE AMBIENTE Y ENERGIA.
HOWEVER, IT PARTIALLY CONSTITUTES STATE NATURAL HERITAGE PURSUANT TO ARTICLES 13, 14 and 15 of LEY FORESTAL Placa12929 APRIL 16, 1996.” Despite the evidence that the parcel constitutes State Natural Heritage and notwithstanding the foregoing, the titling of the respective parcel was recommended in violation of Article 10 of the regulations cited above. As noted, that provision excludes from the titling process lands under the administration of MINAE, as is the case with the State Natural Heritage pursuant to Article 13 of Ley Forestal. Consequently, this case involved an evident and manifest defect of absolute nullity (vicio de nulidad absoluta evidente y manifiesta). Furthermore, there is no record that the compliant land-use study (estudio de uso conforme de suelos) required by Reglamento a la Ley de Uso de Suelos number 29375-MAG-MINAE-S- HACIENDA-MOPT was submitted. Article 58 of those regulations provides: “In every possessory-information proceeding filed with IDA or the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to satisfying the requirements imposed by generally applicable regulations, must demonstrate through an adequate soil study that possession has been exercised in compliance with the land’s appropriate use for the activity carried out, in accordance with the approved methodology and by implementing the best management practices under the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27,41,43 and 64 of ley 7779 and its regulations.” This article establishes that, in every possessory-information proceeding submitted to IDA, the person seeking title (titulante) must demonstrate through an adequate soil study that possession has been exercised in accordance with appropriate land use; IDA is mandatorily required to have that study.
With respect to these regulations, they entered into force on March 21, 2001, that is, before parcel 2-26 was titled in favor of the defendant. The study was therefore mandatory, and failure to provide it gives rise to another defect of absolute nullity. In view of the foregoing, it must be stated that the ground for nullity of the parcel’s titling lies in the failure to satisfy requirements established by law or regulation for the issuance of the administrative act and, additionally, in the failure to observe prohibitory rules.
A. FAILURE TO COMPLY WITH REQUIREMENTS FOR ISSUANCE OF THE ACT AS GROUNDS FOR ABSOLUTE NULLITY: Article 158 of the L.G.A.P. provides that the absence or defect of any requirement of an administrative act (acto administrativo) expressly or implicitly required by the legal system constitutes a defect therein; read in conjunction with Article 166 of the same law, which establishes that an act shall be absolutely null when one or more of its constituent elements are entirely absent in fact or in law, and Article 167, which provides that an act shall be relatively null when one of its constituent elements is defective, unless the defect prevents fulfillment of its purpose, in which case the nullity shall be absolute. Taken together, all these articles support the conclusion that the absence of essential requirements for the titling (titulación) of the parcel at issue renders that administrative act absolutely null.
Article 133 of the L.G.A.P., for its part, in referring to the grounds (motivo) as an element of the validity of an administrative act, provides that such grounds must be lawful and must exist as they were taken into account when the act was issued. In the case of land titling in national reserves, the grounds were regulated; therefore, failure to comply with the requirements established by the applicable law or regulations, as occurred in this case, itself constitutes defects rendering the act null because the grounds did not exist as they had been taken into account for its issuance.
B. VIOLATION OF PROHIBITORY RULES AS GROUNDS FOR ABSOLUTE NULLITY: Article 129 of the Political Constitution establishes that acts and agreements contrary to prohibitory laws shall be null and void unless those laws provide otherwise. Articles 13, 14, 15, 33, and 34 of the Ley Forestal are prohibitory rules, and the administrative act authorizing the transfer of the parcel to the defendant is contrary to those rules, because that act authorized the titling of land forming part of the State Natural Heritage (Patrimonio Natural del Estado). This unquestionably contravenes Article 13 of the Ley Forestal, which designates forest lands and forests in national reserves as State Natural Heritage and places them under the administration of MINAE; Article 14 ibidem, which establishes that lands within that natural heritage are immune from attachment and inalienable, that their possession by private parties gives rise to no rights, that they may not be registered through possessory-information proceedings (información posesoria), and that the State’s action for recovery of possession (acción reivindicatoria) is not subject to a statute of limitations; Article 15 of that law, which also addresses the prohibition against the Public Administration transferring, conveying, or leasing rural real property that it owns or administers unless it has first been classified by MINAG* (sic); and, finally, Articles 33 and 34 of the Ley Forestal, which designate protection areas (áreas de protección). The consequence of violating the aforementioned articles is absolute nullity.
how these grounds for nullity affect the public interest. The nullity of the administrative act (due to failure to comply with essential requirements and because it is contrary to prohibitory rules) through which the property was titled impairs the public interest because that absolutely null act titles land forming part of the State Natural Heritage. Under Article 28 of the Political Constitution, private actions that do not harm morality or public order or injure third parties are beyond the reach of the law. The titling of the State Natural Heritage harms public order by impeding the enjoyment of every person’s right to a healthy and ecologically balanced environment, as provided in Article 50 of the Constitution, which is itself a public-order rule. Moreover, the right to a healthy and ecologically balanced environment is a third-generation fundamental right that arose with the Universal Declaration of Human Rights in 1948.
The 1988 Lisbon Declaration, issued within the framework of the “International Conference on Guarantees of the Human Right to the Environment,” called for recognition of every person’s right to live in a healthy and ecologically balanced environment and, at the same time, urged states to create legal mechanisms enabling each individual to exercise and demand, without impediment, the right to inhabit an environment conducive to the healthy development of that person’s life.
1), 2, 3, 4, and 5: They are true. 6) It has no knowledge of, nor is it aware of, any administrative requirement for some type of study by the Instituto Geográfico Nacional, since that is presumed to be one of the administrative procedures that the titling entity should have carried out. Furthermore, it was never notified that such a study had to be obtained; it therefore considers that it fully complied with the requirements requested at the time by the I.D.A. 7) It submitted all requirements requested by the Instituto. It does not know whether the omission resulted from an administrative error. Nevertheless, if that was the case, it cannot be faulted because the Instituto verified at the time that all requirements necessary for titling had been met. This must have been so, because otherwise the property at issue in the litigation would not have been titled. 8 and 9: They are true. 10) The company complied with each and every requirement imposed on it in order to proceed with the titling.
However, because of the time that has elapsed, none of the documentation concerning the requirements submitted to the Instituto has been retained. Nor can it state whether documents from the administrative record were lost, since that record is maintained by INDER. 11) This is a report whose existence was unknown until it was disclosed to us through these proceedings. INDER had never previously made any type of approach. At all times, it complied with the requirements imposed on it for titling the property, and it has been established that those requirements must have been met. Otherwise, the titling would not have occurred. However, the administrative error apparent in these proceedings, the passage of more than ten years since the events occurred, and the fact that the property forms part of the assets of Ganadera Loma Linda S.A. would cause serious harm or loss, particularly if it is judicially determined that the administrative act identified by the plaintiff must be revoked. Nevertheless, it alleges that, pursuant to ARTICLE 85 of Ley 9036, the following is established:
“Validation of procedures for the award of public property, titling, and registration in the Public Property Registry. For the purpose of validating the administrative acts that gave rise to the titling of properties by the Instituto de Tierras y Colonización (ITCO) or the IDA before the Public Registry and the removal from the public domain (desafectación pública) carried out by the State, Inder is authorized to do the following: a) Survey, record in the cadastre, and register, by means of a judicial request, in the name of Inder before the Real Property Registry, land acquired by the IDA that, upon the entry into force of this law, is not registered in that Registry in the name of that institute. b) Survey, record in the cadastre, subdivide, and grant title to areas of properties acquired by the IDA with funds from the Fondo de Desarrollo Social y Asignaciones Familiares (Fodesaf), for conveyance to the current possessors of those lands who meet the requirements of Article 68 of Ley N.º 2825, Ley de Tierras y Colonización, and to public or private nonprofit entities serving the community, in accordance with the procedures established in this law and its regulations. c) Survey, record in the cadastre, subdivide, and grant title to a single parcel to Costa Rican or foreign occupants with residency who demonstrate possession understood as that exercised by a titleholder, personally, continuously, and as owner, for more than ten years as of the effective date of this law, within a settlement or property registered in the name of the IDA.
For these purposes, Inder shall prepare specific regulations within six months after this law takes effect. d) The resolution of unlawful-tenancy situations (situaciones de precario) in rural territories is declared to be in the public interest; for that purpose, Inder may carry out expropriation proceedings following a declaration by the Board of Directors regarding their necessity, utility, and reasonableness. The applicable procedure shall be that established in the Ley de Expropiaciones. The following are excluded from the application of this provision: 1.- Titles granted to persons who, at the time they obtained the benefit, did not meet the legal and technical requirements for obtaining it and who also served as public officials of the centralized or decentralized Public Administration, or as popularly elected representatives of municipalities, district municipal councils, or State-owned commercial enterprises, and who held that status at the time the benefit or title was registered in the Public Property Registry, without prejudice to good-faith third parties who acquired them after the validation period, calculated from the date of their registration in the Public Registry.
These provisions cover relatives of the official by consanguinity or affinity up to the third degree who did not meet the legal and technical requirements for obtaining the benefit, whether or not the official participated in granting the title. 2.- Property titles granted by the ITCO or the IDA that are within the validation period or the period of legal restrictions and that, as a result of an administrative investigation, are determined to contain a defect other than one in the registration procedure that cannot be cured administratively and is therefore capable of rendering them absolutely null. 3.- Property titles granted by the ITCO or the IDA that have not become final through prescription or expiration, that are within the validation period established by the law under which the benefit or title was acquired, and that are under judicial or administrative investigation. e) Inder is authorized to correct the area of its properties registered in the Public Registry without being subject to the procedures established in Article 14 of the Ley de Informaciones Posesorias.” (emphasis added).
Having analyzed the parties’ arguments and reviewed the evidentiary record in the case file, the Court determines—in accordance with the allegations and relief sought in the complaint—that the complaint has legal merit and must be granted for the following reasons: ASSESSMENT OF THE FACTUAL FRAMEWORK OF THE PRESENT CASE IN LIGHT OF THE BASIC LEGAL FRAMEWORK: Articles 11(a), 12(a), and 13 of the Land and Colonization Law (Ley de Tierras y Colonización) (ITCO INDER), No. 2825 of October 14, 1961, provide, insofar as relevant: “Article 11.-Unless proven otherwise, the following belong to the State as national reserves (reservas nacionales): a) All lands located within the boundaries of the Republic that are not registered as private property or as property of Municipalities or Autonomous Institutions; (...) Article 12.-The following are allocated to the purposes of this law: a) Lands regarded as national reserves; (...) Article 13.-The real property allocated pursuant to this Chapter shall be transferred free of charge to the Institute of Lands and Colonization (Instituto de Tierras y Colonización).
Both the Executive Branch and the Managers of Autonomous Institutions and Municipal Presidents are expressly authorized to execute these transfers. Except for the Institute of Lands and Colonization itself, the aforementioned entities may not convey, encumber, or lease the allocated lands. Notwithstanding the foregoing paragraphs, the Executive Branch may require the Institute to transfer to it ownership of any lands essential for the construction of public works or the installation of public services other than those contemplated in this law, as well as any lands covered by contracts executed by that Branch and ratified by the Legislative Assembly.” (emphasis added). Therefore, Articles 11, 12, and 13 of Law No. 2825, which created the then Institute of Lands and Colonization, established the concept of “national reserves” as encompassing all lands within the country’s boundaries that were not registered as private property or as property of municipalities or autonomous institutions, and provided that real property falling within the category of “national reserves” would be transferred free of charge to the Agrarian Development Institute (Instituto de Desarrollo Agrario) (now INDER).
Articles 32, 33, and 35 of Ley Forestal No. 4465 of November 25, 1969 (no longer in force, having been repealed by Article 73 of Ley Forestal, N° 7575 of February 13, 1996), provided, insofar as relevant: “Article 32.-The State Forest Estate (patrimonio forestal del Estado) consists of all forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies. (...) Article 33.-The forest lands and forests comprising the State Forest Estate, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall create no rights in their favor, and the State’s action to recover such lands shall not be subject to any statute of limitations. Consequently, they may not be registered in the Public Registry through possessory proceedings (información posesoria); their encroachment and occupation shall be punished in accordance with this law.
(...) Article 35.-The following shall be established within the State Forest Estate: a) Forest reserves: (...) b) Protected zones: (...) c) National parks: (...) ch) National wildlife refuges: (...) d) Biological reserves: (...).” (emphasis added). Consequently, Ley Forestal No. 4465 of November 25, 1969 created the concept of the “State Forest Estate,” defined as comprising Forest Reserves, Protected Zones, National Parks, National Wildlife Refuges, and Biological Reserves. Articles 13, 14, and 15 of Ley Forestal, No. 7575—currently in force—of February 5, 1996, provide, insofar as relevant: ARTICLE 13.-Establishment and administration. The State Natural Heritage (patrimonio natural del Estado) shall consist of the forests and forest lands within national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing lending transactions with the National Banking System and becoming part of its assets.
(...) ARTICLE 14.-Immunity from attachment and inalienability of the natural heritage. The forest lands and forests comprising the State Natural Heritage, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall create no rights in their favor, and the State’s action to recover such lands shall not be subject to any statute of limitations. Consequently, they may not be registered in the Public Registry through possessory proceedings, and both their encroachment and occupation shall be punished in accordance with this law. ARTICLE 15.-Restrictions. Public Administration bodies may not exchange, assign, convey in any manner, transfer, or lease rural lands owned or administered by them unless those lands have first been classified by the Ministry of Environment and Energy. If they are covered by forest, they shall automatically be incorporated into the State Natural Heritage, and a restriction shall be created that must be recorded in the Public Registry.
(...).” (emphasis added). Thus, the concept of the “State Forest Estate” currently remains unchanged in essence. Indeed, although Ley Forestal No. 4465 of November 25, 1969 was repealed by Law No. 7575 of February 5, 1996, only its designation changed, becoming the “State Natural Heritage.” In turn, pursuant to Article 14 of the Ley Forestal currently in force, that Heritage is subject to the public-domain regime (régimen de dominio público) and, consequently, to its protections of immunity from attachment, inalienability, and exemption from any statute of limitations. Furthermore, as a safeguard for the protection of that Heritage, Article 15 of the aforementioned Law No. 7575 established that Public Administration bodies may not convey rural lands owned or administered by them unless those lands have first been classified by MINAE, with the understanding that, if covered by forest, they would automatically be incorporated into the State Natural Heritage without any need for prior classification by MINAE.
Articles 3(b) and 18(m) of the Law Creating the Agrarian Development Institute (Ley de Creación del Instituto Desarrollo Agrario), Number 6735 of March 29, 1982 (currently INDER), provided: Article 3.-The Agrarian Development Institute shall have the following functions: (...) b) To administer, on behalf of the State, national reserves and lands transferred to it for the fulfillment of its purposes, and to carry out on them comprehensive development plans, peasant settlements, colonization, parceling (parcelación), and allocation (adjudicación), all in accordance with the provisions of this law; (...); Article 18.-The Institute’s Board of Directors shall have the following functions: (...) m) To approve land allocations and issue the respective titles, in accordance with the applicable statutory and regulatory provisions; (...)” (emphasis added). Therefore, although the Institute could approve land allocations and issue the respective titles, it plainly had to do so in accordance with the applicable statutory and regulatory provisions; accordingly, under Articles 13, 14, and 15 of Ley Forestal, No. 7575 of February 5, 1996, as already explained, it could not—and was not permitted to—convey, that is, dispose of the State Natural Heritage comprising the forests and forest lands within national reserves, much less do so unless those lands had first been classified by MINAE, with the understanding that, if covered by forest, they would automatically be incorporated into the State Natural Heritage without any need for prior classification by MINAE.
The Law on Titling Lands in National Reserves (Ley de Titulación de Tierras en Reservas Nacionales), number 7599 of April 29, 1996, was annulled by Constitutional Chamber decision No. 8560-2001 at 15:37 on August 28, 2001. The executive decrees by which areas of national reserves were transferred to the Rural Development Institute (*) (formerly ITCO) for the creation of the national-reserve titling programs known as Llanuras de San Carlos-Sarapiquí, Puerto Jiménez, Tierras Altas de Santa Cruz, Pascua, Cuenca río Aranjuez, and Los Santos—including Decreto Ejecutivo 28745-MINAE-MAG, published in La Gaceta Nº 133 of July 11, 2000, which gave rise to property folio real 115.788-000 in the Puntarenas Registry District—were declared unconstitutional by connection in Constitutional Chamber decision N° 8457-2007 of June 13, 2007, and subsequently repealed by Decreto Ejecutivo No. 34506 of February 14, 2008.

Now, Articles 10(b) and 11 of the Regulations for Titling Lands in National Reserves (Reglamento para la titulación de Tierras en Reservas Nacionales) #55 of 12/08/2002, La Gaceta # 173 of September 10, 2002, under which the possessory proceedings for titling in the present case were conducted (which, incidentally, were annulled by Constitutional Chamber decision N° 2063-07 of 14-2-07, clarified by decision N° 4517-07 at 18:19 on 28-3-07), provided, insofar as relevant: “Article 10.—The lands referred to in Articles 6, 7, 8, and 9 of these Regulations that are not subject to administration by MINAE shall be transferred and registered in the names of their respective possessors. For these purposes, a possessor shall mean the natural or legal person who has exercised quiet, public, peaceful, uninterrupted possession, under a claim of ownership, over the parcel to be titled for a period of no less than ten years.
Proof of possession shall be the applicant’s responsibility, subject to the responsibility of the institutional officials authorized for that purpose in the regional offices and the Agrarian Planning Department, and must necessarily include the following requirements: (...) b- The original cadastral plan (plano catastrado), or a certified copy issued by the Catastro Nacional, and an original certification issued by MINAE stating that, according to the cadastral plan, the land to be titled is not affected by or situated within conservation areas or the State Natural Heritage. (...) (emphasis and underlining added). Article 11.—Once the foregoing requirements have been submitted, the Institute, through its regional offices, shall open an individual case file, duly paginated, and shall conduct a field inspection to verify the information contained in the documentation submitted. The applicant’s representations shall constitute a sworn statement (declaración jurada).
If any falsehood is established, the applicant shall be subject to the penalties prescribed for such conduct by the criminal legislation in force.” (emphasis added). Thus, to prevent the titling of lands affected by or situated within that Heritage and thereby fulfill the statutory purpose of protecting and conserving it, a MINAE certification was required stating that, according to the cadastral plan, the land to be titled was not affected by or situated—wholly or partially—within conservation areas or the State Natural Heritage. A field inspection was also required to verify the information contained in the documentation submitted.
Consequently, the Institute could not grant title (titular) to lands affected by or located—whether wholly or partially, it makes no difference—within conservation areas (áreas de conservación) or the State Natural Heritage (patrimonio natural del Estado), consisting of the forests and forestlands (bosques y terrenos forestales) of the national reserves, under penalty of the land titling (titulación) being null and void otherwise, because this would prevent fulfillment of the purpose of the act. In the present case, however, contrary to the regulatory provisions discussed above, the record shows that the Institute disregarded the fact that, according to the inspection conducted by one of its officials, a technician from the Coyolar Regional Office, the nature of Dirección8720 consisted of 30 hectares of scrubland (Tacotal), but also 10. 9 hectares of forest (Bosque). It likewise ignored the fact that although the submitted cadastral plan (plano catastrado) No. P-912593-04 indicated pastureland (agricultural use), it also indicated mountain land.
It similarly disregarded the applicant’s notarized sworn statements that the land was pastureland but also mountain land. Moreover, the applicant did not submit a certification issued by MINAE stating—as she claimed—that her property did not affect the State Natural Heritage; although it certified that the “PROPERTY IS LOCATED OUTSIDE ANY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE MINISTRY OF ENVIRONMENT AND ENERGY,” it also certified: “HOWEVER, IT PARTIALLY CONSTITUTES STATE NATURAL HERITAGE PURSUANT TO ARTICLES 13, 14 and 15 OF LEY FORESTAL Placa12929 16 DE ABRIL DE 1996.” Contrary to what the defendant stated in its closing arguments, there is no doubt in this regard, since, even if only partially, the fact remains that the parcel in question was subject to Articles 13, 14 and 15 of Ley Forestal No. 7575. This was also completely disregarded by the Institute.
As a result, its Board of Directors authorized the subdivision (segregación), transfer (traspaso), and titling of the parcel in question in favor of Ganadera Loma Linda S.A., even though it had partial forest cover (cobertura boscosa), consisted of mountain land, and formed part of the State Natural Heritage. This was therefore contrary to the underlying regulation used by the Institute in this case, which expressly prohibited the titling of lands subject to administration by MINAE—that is, properties affected by or located within conservation areas or the State Natural Heritage. This alone constitutes grounds for absolute nullity (nulidad absoluta). In view of the foregoing, the fact that the MINAE Certification does not specify which part constitutes State Natural Heritage, as the defendant argues in its closing arguments, is neither an impediment nor a defect rendering these proceedings null and void.
ON THE OTHER HAND, Articles 26 and 27 of Ley de Uso, Manejo y Conservación de Suelos, No. 7779, del 30 de abril de 1998 - La Gaceta 97 del 21/05/1998- effective since 21 de mayo de 1998, provide: “ARTICLE 26.- The acquisition of land and its allocation (adjudicación) by the Instituto de Desarrollo Rural(*) in accordance with its legal authority shall take into account the guidelines established in the National Plan and the plans for soil-management and conservation areas. (*) (Its name was modified by Article 14° of Ley N° 9036 del 11 de mayo de 2012, ‘Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural’) ARTICLE 27.- The Instituto de Desarrollo Agrario shall be required to obtain land-use capability studies (estudios de capacidad de uso de la tierra) before acquiring land for titling purposes. Every allocation of land shall be subject to the restriction that the use of the allocated land may not be inconsistent with its land-use capability.
Failure to comply with this provision shall result in revocation of the allocation, in addition to any other penalties that may be imposed for attributable offenses.” Consistently with the foregoing, Articles 58 and 62 of “Reglamento a la Ley de Uso, Manejo y Conservación de Suelos -decreto 29375-MAG-MINAE-S HACIENDA-MOPT, del 8 de agosto del 2000, La Gaceta # 57 del 21/03/2001, effective since 21 de marzo del 2001-,” provide: “Article 58.—In any possessory-title proceeding (información posesoria) filed with the IDA or with the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to the requirements imposed by the general rules, must demonstrate, through an appropriate soil study, that possession has been exercised in compliance with the conforming use of the soil (uso conforme del suelo) for the activity performed, in accordance with the approved methodology, and that such activity has been carried out using best management practices and the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27 , 41, 43 and 64 of Ley Nº 7779 and this Regulation.
Article 62.—If the soil study and land classification establish that titling for agricultural or urban purposes is not appropriate, the IDA shall, as applicable, designate the lands as a national reserve and, as applicable, transfer them to MINAE.” (emphasis added). Therefore, in order to grant title to land—and for the statutory purpose of preventing land-use change (cambio de uso de la tierra) when, for example, the property is predominantly suited to forestry and is unsuitable for agricultural or livestock activities—the Institute was required to request a study and/or certification of conforming soil use. This follows from those provisions insofar as they establish that, in every possessory-title proceeding filed with the IDA, the applicant for title must demonstrate, through an appropriate soil study, that possession has been exercised in compliance with the conforming use of the soil for the activity performed.
The Institute was required to have such a study in the present case, since the Law took effect on 21 de mayo de 1998, while the Regulation took effect on 21 de marzo de 2001—that is, before 26 de agosto del 2004, the date of Resolution No. 41 of Ordinary Session 031-04, in which the IDA Board of Directors authorized the subdivision, transfer—and titling—of parcel 26 of Block 2 in favor of Ganadera Loma Linda S.A. Consequently, the Institute could not grant title to land, under penalty of the titling being null and void otherwise, because this would prevent fulfillment of the purpose of the act. Nevertheless, the titling file for parcel 26, block 2, of Proyecto de Titulación Cuenca del Río Aranjuéz, in favor of Ganadera Loma Linda S. A., contains no record that a conforming-soil-use study prepared by a qualified professional was requested or, consequently, submitted, nor any certification in that regard from the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA).
This also constitutes grounds for absolute nullity. Consequently, it is established—contrario sensu—that the regulatory requirements provided for in Reglamento para la Titulación de Tierras en Reservas Nacionales published in La Gaceta 173 del 10 de septiembre del 2002, in conjunction with Ley Forestal No. 7575 del 5 de febrero de 1996 and Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, which were necessary for the titling to be permissible, were not satisfied. In view of the foregoing, the claims in the complaint concerning failure to comply with the requirements for issuance of the act as grounds for absolute nullity are essentially upheld, based on Article 158 of the L.G.A.P., insofar as it provides that the absence of or defect in any requirement of an administrative act (acto administrativo) expressly or implicitly required by the legal system shall constitute a defect in that act; in relation to Article 166 of the same law, insofar as it establishes that an act shall be absolutely null when one or more of its constitutive elements are entirely absent in fact or in law; and Article 167, insofar as it provides that an act shall be relatively null (nulidad relativa) when one of its constitutive elements is defective, unless the defect prevents fulfillment of its purpose, in which case the nullity shall be absolute.
That, in essence, as already explained, is the defect giving rise to absolute nullity in the present case. Taken together, all these articles support the conclusion that the absence of essential requirements for titling the parcel in question renders that administrative act absolutely null. Furthermore, Article 133 of the L.G.A.P., in referring to grounds (motivo) as an element of the validity of an administrative act, provides that those grounds must be lawful and must exist as they were taken into account when the act was issued. In the case of land titling in national reserves, the grounds were regulated; therefore, failure to comply with the established requirements, particularly those contained in the applicable underlying regulation, as occurred in this case, itself constitutes a defect rendering the act null and void because those grounds did not exist as they had been taken into account when the act was issued.
The claims in the complaint concerning noncompliance with prohibitory rules as grounds for absolute nullity are likewise essentially upheld, based on Article 129 of the Constitution, insofar as it establishes that acts and agreements contrary to prohibitory laws shall be null and void unless those laws provide otherwise, because the act authorizing the subdivision, transfer, and titling of the parcel in favor of Nombre81222 . S.A. disregarded the prohibition contained in Articles 13, 14, and 15 of Ley Forestal. Finally, in its defense, the defendant reproduces Article 85 of TITLE III, FINAL AND TRANSITIONAL PROVISIONS, of Ley 9036 del 11/05/2012, which Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural, under the heading: “Validation of procedures for the allocation of public property, titling, and registration in the Public Property Registry.” Apart from reproducing it, however, the defendant does not explain—and the Court therefore does not understand—in what sense or to what extent it applies to its case.
Accordingly, its mere invocation is rejected without need for further comment. REGARDING THE DEFENSE OF LIMITATION AND EXPIRATION (EXCEPCIÓN DE PRESCRIPCIÓN Y CADUCIDAD). The defendant’s arguments in this regard are brief, since its answer to the complaint merely states that the defense is based on Articles 298 and 433 of Código Procesal Civil. Those provisions are inapplicable because they are procedural rules. In its closing arguments, it merely contends, in essence, that years have elapsed since the titling or deed dated 28 de febrero del 2005; more than ten years, the limitation period for any action, including an administrative-litigation action. Consequently, these arguments must be rejected as generic and indeterminate, as well as for the reasons advanced by the Institute when responding to the defendant’s answer and defenses, and reiterated in its closing arguments, which this Court adopts and expands upon.
In summary, those reasons are as follows: Because cases of this type essentially concern public law and the titling, with defects giving rise to absolute nullity, of public-domain assets and State Natural Heritage that, by their very nature, are deemed public-domain property (bienes demaniales), they are, by special legal protection and statutory mandate, not subject to expiration or limitation periods. In this regard, it should be noted that Article 172 of Ley General de la Administración Pública establishes: “An absolutely null act may not be brought into conformity with the law through either cure (saneamiento) or validation (convalidación).” Article 14 of Ley Forestal establishes: “ARTICLE 14.- Nonattachable and inalienable status of the natural heritage. The forestlands and forests constituting the State Natural Heritage, described in the preceding article, shall be nonattachable and inalienable; possession thereof by private parties shall create no rights in their favor, and the State’s action to recover title (acción reivindicatoria) to such lands shall not be subject to limitation.
Consequently, they cannot be registered in the Public Registry through possessory title proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with the provisions of this law.” (emphasis added). Therefore, under that provision, the aforementioned Natural Heritage is subject to the public-domain regime (régimen de dominio público) and, consequently, to its protective effects, namely that it is exempt from attachment, inalienable, and not subject to acquisitive prescription (imprescriptible). For these purposes, it is immaterial that the parcel only partially constituted the State’s Natural Heritage—that is, that it had partial forest cover (cobertura boscosa)—since that fact alone is sufficient to establish its public-domain status (naturaleza demanial), and it cannot be severed, materially or legally, because it forms part of—that is, because it is subject to or encompassed within—the State’s Natural Heritage as such.
It is therefore subject to the provisions of Article 14 of Ley Forestal No. 7575. Furthermore, Article 34(2) of the Code of Administrative Litigation Procedure provides that: “An action for a declaration of injury to the public interest (lesividad) concerning the protection of public-domain property shall not be subject to any time limit.” Finally, relying on a judgment of the Sixth Section of this Court, which we summarize, we find that: “...Regarding the defense of prescription (prescripción), because the public-domain status of the property at issue has been established, that defense must necessarily be rejected. It must be borne in mind that, in matters involving the recovery and protection of public-domain property, neither prescription nor expiration periods (caducidad) run, and the actions available to the State for its effective recovery are not subject to prescription. This is due to the particular characteristics of this type of property.
This is expressly established by Article 14 of the Ley Forestal and Article 34(2) of the Code of Administrative Litigation Procedure. Likewise, insofar as the absolutely void act continues to produce effects, it may be annulled, as follows from Article 40 of the same Code of Procedure....” Judgment number 0038-2010, issued at 14: 45 hours on January 11, 2010, by the Sixth Section of the Tribunal Contencioso Administrativo y Civil de Hacienda. Consequently, the defenses of prescription and expiration are dismissed. For the reasons stated—which are deemed sufficient—the remaining assertions in the answer to the complaint are rejected as futile and immaterial.
In light of all the foregoing and in accordance with the considerations set forth above, the action seeking annulment of an administrative act as injurious to the public interest (demanda de lesividad) must be granted in all respects. Consequently, the following shall be annulled: The resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 41 of session 031-04, dated 26 de agosto del año 2004, solely insofar as it concerns the issuance of title (titulación) to the property in the Puntarenas Registry District, Real Folio registration number Placa12930, in favor of Nombre81222, corresponding to Cadastral Survey Plan (Plano Catastrado) P-0912593-2004. By operation of connection (por conexión): Deed number 102, registered on 28 de febrero del año 2005, executed before Notary Luis Enrique Wong Sanchez and issued by the Instituto de Desarrollo Agrario, solely insofar as it concerns the issuance of title to the property in the Puntarenas Registry District, Real Folio registration number Placa12930, in favor of GANADERA LOMA LINDA SOCIEDAD ANÓNIMA, corresponding to Cadastral Survey Plan P-0912593-2004.
Also annulled are the registration entry (asiento registral) for the property registered under the Real Folio system in the Puntarenas Registry District, Real Folio number Placa12930, issued by the Registro Nacional; and any registration arising from the registration of the property recorded in the Registro Nacional, Puntarenas Registry District, Real Folio registration number Placa12930.
The defenses based on the statute of limitations (prescripción) and expiration of the action (caducidad) must be rejected, and are hereby denied, for the reasons stated above. The defense of lack of legal entitlement (falta de derecho) must be rejected, and is hereby dismissed, because the action is supported by the legal system.
Pursuant to the express provisions of Article 193 of the Código Procesal Contencioso Administrativo, the defendant must be ordered to pay both categories of costs (ambas costas) of this action solely because it was the unsuccessful party in these proceedings, there being no reasons presented by the defendant or identified by this Court that would justify exempting it under subsections a) and b) of the aforementioned Article 193. Accordingly, both categories of costs of the proceedings are imposed upon the defendant.
POR TANTO
The defenses based on the statute of limitations, expiration of the action, and lack of legal entitlement are dismissed. The action seeking annulment of an administrative act as injurious to the public interest is granted in all respects. Consequently, the following are annulled: The resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 41 of session 031-04, dated 26 de agosto del año 2004, solely insofar as it concerns the issuance of title to the property in the Puntarenas Registry District, Real Folio registration number Placa12930, in favor of Nombre81222, corresponding to Cadastral Survey Plan P-0912593-2004. Deed number 102, registered on 28 de febrero del año 2005, executed before Notary Luis Enrique Wong Sanchez and issued by the Instituto de Desarrollo Agrario, solely insofar as it concerns the issuance of title to the property in the Puntarenas Registry District, Real Folio registration number Placa12930, in favor of Nombre81222, corresponding to Cadastral Survey Plan P-0912593-2004.

No. 79 - 2017-II TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCIÓN SEGUNDA. Segundo Circuito Judicial de San José. Goicoechea. A las diez horas, treinta minutos, del treinta de noviembre del dos mil diecisiete.- Proceso de conocimiento - lesividad-, declarado de puro derecho, seguido ante este Tribunal por el INSTITUTO DE DESARROLLO RURAL -INDER- (antes IDA), en contra de GANADERA LOMA LINDA, S.A. cédula jurídica CED60333. Representada por el señor Gerardo E. Ugalde Ávila. Los abogados, licenciados Rodrigo Cervantes Barrantes y Eric Jiménez Trejos figuran como mandatarios judiciales de la parte actora. Los licenciados Ernesto Jiménez Mora, Ademar A. Zúñiga Quirós y Marcos Jiménez Mora, como abogados directores de la parte demandada.
RESULTANDO
"Con base a los hechos y fundamentos de derecho expuestos, solicitamos que en sentencia se declare:
1. Que se tenga por interpuesta la presente demanda.
2. Que en razón de ser Lesivos a los intereses públicos se anule el acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 41, de la sesión 031-04, de fecha 26 de agosto del año 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de Nombre81222 correspondiente al Plano Catastrado P-0912593-2004.
3. Por conexidad, que se anule la escritura número 102 inscrita el 28 de febrero del año 2005, otorgada ante el Notario Luis Enrique Wong Sanchez, emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de Nombre81222 correspondiente al Plano Catastrado P-0912593-2004.
4. Por conexidad, que se anule el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, folio Real número Placa12930 emitido por el Registro Nacional.
5. Por conexidad, se anule cualquier inscripción que depare de la inscripción del inmueble inscrito en el Registro Nacional, Partido de Puntarenas Folio Real Matricula número Placa12930.
6. Que se condene al demandado al pago de ambas costas de este juicio.".
Redacta el juez Rodríguez Villalobos; y,
CONSIDERANDO
Como tales - sin perjuicio de su posterior valoración-, se tienen los siguientes de relevancia:

El cumplimiento de todos los requerimientos normativos previstos en el Reglamento para la Titulación de Tierras en Reservas Nacionales publicado en la Gaceta 173 del 10 de septiembre del 2002, en concordancia con la Ley Forestal No. 7575 del 5 de febrero de 1996 y el Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, necesarios para que fuera procedente la titulación (los autos).
En resumen alega:
1. El I.D.A. hoy I.N.D.E.R. impulsó una serie de Programas de Titulación en Reservas Nacionales, con fundamento en la Ley de Titulación de Tierras ubicadas en Reservas Nacionales No. 7599 del 9 de agosto de 1996, en los artículos 11 y 12 de la Ley de Tierras y Colonización No. 2825 del 14 de octubre de 1961 y el artículo 32 inciso a) de la Ley de Creación del Instituto de Desarrollo Agrario No. 6735.
2. Esos programas se establecieron como una necesidad nacional, ya que existían grandes extensiones del territorio nacional donde los campesinos carecían de título de propiedad. La labor del Instituto se orientó a declarar Zonas de Titulación en áreas donde las personas se encontraban en posesión de la tierra, pero carecían de título, procediéndose a realizar el levantamiento y catastro de las fincas que no se encontraban inscritas en el Registro Público y a inscribir el titulo respectivo, debiendo pagar los beneficiarios los costos por la titulación y agrimensura, dichos costos fueron muy inferiores al promedio del mercado para titular tierras, y debían ser cancelados como máximo en el plazo de un año.
3. Dentro de esos Programas se encontró el denominado: "Programa de Titulación Cuenca del Río Aranjuez" creado mediante Decreto Ejecutivo No. 28745-MINAE-MAG, del 12 de junio del año 2000 (publicado en La Gaceta No. 133 del 11 de julio del 2000), que generó la finca del Partido de Puntarenas, Folio Real número 115788-000.
4. Dentro del marco de este programa, mediante escrito presentado ante el Instituto, la demandada, presentó solicitud de titulación de la parcela 26 Bloque 2 DEL PROYECTO DE TITULACIÓN CUENCA DEL RÍO ARANJUEZ descrita en el Plano Catastrado P-0912593-2004, según el cual tiene un área de 409.663 metros con 30 decímetros cuadrados y es terreno de montaña y tacotal (ver folio 4 del expediente de titulación que se ofrece como prueba #3).
5. En el expediente de titulación consta que se presentó la certificación del MINAE, No. SINAC-DS-OFAU-C-1445-2004, de fecha 21 de abril del año 2004, antes de la inscripción registral de la parcela 26 del Bloque 2 a favor de la demandada, estableciendo que el inmueble SE UBICA FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRATIVA POR EL MINISTERIO DE AMBIENTE Y ENERGÍA. SIN EMBARGO CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO SEGÚN LOS ARTÍCULOS 13, 14 Y 15 DE LA LEY FORESTAL Placa12929 16 DE ABRIL DE 1996 (ver folio 8 del Expediente de Titulación que se ofrece como prueba #3).
6. En el expediente no consta estudio alguno del Instituto Geográfico Nacional.
7. La demandada no presenta dentro del trámite de titulación de la parcela el estudio de uso conforme de suelo del INTA o bien de algún profesional privado debidamente acreditado para realizar dicho estudio.
8. La Junta Directiva del Instituto acogió la recomendación técnica, y acordó hacer el traspaso de la parcela 26, Bloque 2, del Proyecto de Titulación Cuenca del Río Aranjuez a través del acuerdo número 41 de la Sesión Ordinaria 031-04 celebrada el 26 de agosto del año 2004.
9. La escritura de traspaso fue otorgada al ser las 09:00 horas del 9 de setiembre del año 2004 ante el Notario Luis Enrique Wong Sánchez, identificada como la escritura número 102, visible al folio 96 frente del tomo 29 de dicho notario; y fue inscrita el 28 de febrero del año 2005, bajo el Folio Real del Partido de Puntarenas Matricula número Placa12930 y descrita en el plano P-0912593-2004, según el cual tiene un área de 40 hectáreas 9663 metros con 30 decímetros cuadrados y es terreno de repastos y montaña.
10. En el proceso de titulación de la parcela número 26, Bloque 2, del Proyecto de Titulación Cuenca del Río Aranjuez descrita en el plano catastrado P-0912593-2004, no se cumplieron los requisitos que fundamentaron su inscripción a favor de la demandada 11. Mediante el Informe No. DFOE-PGAA-20-2008 de fecha 27 de agosto del 2008 de la Contraloría General de la República denominado "Resultado de estudios de titulación de tierras en reservas nacionales en terrenos pertenecientes al Patrimonio Natural del Estado" y dirigido al Instituto se indica que dicho estudio permitió determinar que en el marco de contenido de los diferentes proyectos de titulación y en contravención a lo señalado en los artículos 13,14,15 y 33 de la Ley Forestal No. 7575 del 5 de febrero de 1996 el IDA tituló propiedades con cobertura parcial o totalmente boscosa o que poseían características de uso (sic) suelo y topográficas que les otorgaban la categoría de terrenos de aptitud forestal y de áreas de protección, y por lo tanto, no podían salir de la Administración del Estado, ni ser susceptibles de titular a favor de los solicitantes por ser parte del Patrimonio Natural, y por no concurrir, ni haberse aportado todos y cada uno los requisitos necesarios para proceder de conformidad con el bloque de legalidad vigente en aquel momento para que fuera procedente la titulación de tratamiento.
12. Como parte de la verificación de las actuaciones comentadas, el Ente Contralor, entre los casos analizados destaca en el informe DFOE.PGAA- 20-2008, existen quince casos en los que se evidencia una titulación de tierras que forman parte del Patrimonio Natural del Estado.
13. Entre las disposiciones del Informe No DFOE-PGAA-20-2008, el Ente Contralor ordena al IDA lo siguiente: "a) Realizar los procedimientos administrativos y las acciones que en derecho procedan ante las instancias correspondientes, a efecto de que se inicie un proceso de recuperación de las tierras tituladas por el IDA que pertenecen al Patrimonio Natural del Estado y que corresponden a los 15 casos que se detallan en este documento. b) Ordenar que se realice un análisis completo a las titulaciones efectuadas por el IDA, que no formaron parte de la muestra analizada por esta Contraloría General en este estudio, con el fin de determinar aquellos casos de titulaciones en terrenos propiedad del Patrimonio Natural del Estado y, de proceder, se realicen los procedimientos para recuperar las tierras. ".
14. Por acuerdo tomado por la Junta Directiva del I.N.D.E.R., en artículo 48 Sesión Ordinaria 36-2015 del 5 de octubre del 2015 se declaró lesivo a los intereses públicos el acto administrativo dictado mediante el acuerdo No. 41 de la Sesión Ordinaria 031-04 celebrada el 26 de agosto del año 2004 de la Junta Directiva de ésta Institución, mismo (sic) dio origen a titulo de propiedad inscrito en el Registro de la Propiedad, Partido de Puntarenas, Matricula de Folio Real número Placa12930 a favor de GANADERA LOMA LINDA S.A. por haber sido otorgado en detrimento del Patrimonio Natural del Estado.
ARGUMENTOS DE FONDO. De la relación de hechos y antecedentes expuesta, y del examen de la documentación que consta en el expediente de titulación correspondiente a la parcela 58 del Bloque 10 (sic) del Proyecto de Titulación Cuenca del Río Aranjuez, que se aporta como prueba y en general de toda la documentación ofrecida, se constata que en el proceso de titulación de la indicada parcela, se incumplió con requerimientos normativos necesarios y previstos en la Ley de Titulación de Tierras en Reservas Nacionales número 7599 del 29 de abril de 1996, o en su caso el Reglamento para la Titulación de Tierras en Reservas Nacionales publicado en la Gaceta 173 del 10 de septiembre del 2002, en concordancia con la Ley Forestal No. 7575 del 5 de febrero de 1996 y el Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, los cuales establecían los requisitos para la titulación de las parcelas por parte del IDA, incumplimiento que genera vicios del acto administrativo.
La causal de nulidad en los casos (sic) objeto de este proceso, afecta el interés público, ya que con motivo de los incumplimientos de la normativa antes relacionada, el IDA autorizó el traspaso de la parcelas (sic) dicha, que es parte del Patrimonio Natural del Estado. NULIDAD DE LOS ACTOS ADMINISTRATIVOS QUE AUTORIZARON LA TITULACION Y EL TRASPASO DE LA PARCELA 26 DEL BLOQUE 2 A FAVOR DE GANADERA LOMA LINDA S.A., Y EL CÓMO DICHA CAUSAL DE NULIDAD AFECTA EL INTERÉS PÚBLICO: I. LOS PROGRAMAS DE TITULACIÓN: Los terrenos que formaban parte de los proyectos de titulación le eran traspasados al IDA a través de decreto (en el caso específico del Programa Cuenca del Río Aranjuez, el Decreto Ejecutivo No 28745-MINAE-MAG, de fecha 11 de julio del 2000), con el objeto de cumplir con los respectivos proyectos de titulación (artículo 7 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
Estos traspasos de las áreas a titular se justificaban en la tenencia de las fincas sin inscribir por parte de poseedores (artículos 2 y 4 del Reglamento para la titulación) y se trataba de una ficción legal, mediante la cual se le traspasaba al IDA una extensa área geográfica que abarcaba en forma indistinta terrenos inscritos, sin inscribir, propiedad del Estado y de particulares, con poseedores o sin estos, de ahí que los traspasos se hacían sin perjuicio de los derechos ya inscritos sobre porciones determinadas dentro del perímetro general de la zona respectiva, ni de los derechos de información posesoria en trámite en el momento de publicarse en la Gaceta el decreto al que se refiere el articulo 7 del Reglamento para la Titulación de Tierras en Reservas Nacionales, o los que se inscriban en el futuro ni de las porciones destinadas al uso público. Estos traspasos tenían por objetivo darle al IDA, un instrumento para que pudiera segregarlos y traspasarlos, también bajo una ficción legal, y así inscribir predios a favor de los poseedores que hayan poseído esos terrenos bajo las condiciones que establecía el ordenamiento jurídico con la finalidad de facilitar la obtención de crédito (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
En el caso de la parcela de marras, inscrita a favor de la demandada, consta en el expediente administrativo, el hecho de haber poseído los terrenos, lo cual evidencia la preexistencia de la tenencia posesoria de las (sic) parcela con anterioridad al acuerdo de Junta Directiva de su traspaso (tomado en artículo 41 de la Sesión Ordinaria 031-04 celebrada el 26 de agosto del año 2004). En tal sentido, se considera que la causa de adquisición de esos terrenos por parte de los poseedores era la posesión ejercida por éstos y no los traspasos o ventas hechos por el IDA, ya que el Instituto lo único que recibía a cambio era el costo de la confección de los planos correspondientes y no el precio en sí de los predios. En tal sentido, no se daba un acuerdo entre cosa y precio, el Instituto no podía traspasar los terrenos al mejor oferente sino que tenía que traspasarlos al poseedor que le demostrara haber cumplido con los requisitos legales, limitándose a constatar esos requisitos (artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales).
La Sala Constitucional mediante la resolución 04587-97 de 15:45 horas del 5 de agosto de 1997, al referirse a la información posesoria en lo que interesa indica: "se distingue el momento de adquisición de la propiedad por usucapión del momento que esa situación se hace valer en el procedimiento de información posesoria para obtener un titulo inscribible en el Registro Público. De ahí que se considere la usucapión como un modo de adquisición de la propiedad y de otros derechos reales posibles, y a la titulación como el procedimiento por medio del cual, comprobados los requisitos de la usucapión se confiere el titulo de propiedad inscribible". Analógicamente esta distinción que hace la Sala es válida también en los procesos de titulación realizados por el IDA, por lo que la naturaleza jurídica de los actos en los proyectos de titulación realizados por el IDA eran meramente declarativos, se limitaban a reconocer el derecho de propiedad adquirido por una persona por medio de la figura de la usucapión, para su inscripción en el Registro Público y no actos constitutivos del derecho de propiedad.
II. NULIDAD ABSOLUTA: Incumplimientos en que el IDA incurrió dentro del procedimiento de titulación del predio y que es el que precisamente produce la nulidad del acto administrativo de traspaso. A la Junta Directiva del IDA se le recomendó autorizar el traspaso de la respectiva parcela, supuestamente porque se había cumplido con los requisitos establecidos por el Reglamento para la Titulación de Tierras en Reservas Nacionales, siendo éste el motivo de los actos administrativos que acordaron el traspaso del inmueble a favor de la demandada. Pese a esto, de la documentación que se aporta se halló que tal cumplimiento no se dio por lo siguiente: El articulo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales, establecía que se titularán las tierras que no estén sujetas a la administración por parte del MINAE. Dado que el articulo 32 de la Ley Orgánica del Ambiente establece que las Áreas Silvestres Protegidas son administradas por el MINAE y el artículo 13 de la Ley Forestal establece que el Patrimonio Natural del Estado lo administra el MINAE se concluye que la certificación por parte de ese Ministerio determinando que el terreno no está dentro de áreas silvestres protegidas o del Patrimonio Natural del Estado era un requisito esencial e infranqueable para la validez del trámite ante el IDA, y la posterior titulación.
El inciso b) de este artículo 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales, establecía expresamente que el solicitante tiene que presentar una "certificación original extendida por el MINAE en donde conste que el terreno a titular según plano catastrado no está afectado o inmerso dentro de áreas de conservación, Patrimonio Natural del Estado". En el caso en cuestión, en el expediente de titulación consta certificación emitida por el MINISTERIO DEL AMBIENTE Y ENERGÍA, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, OFICINA DE ATENCIÓN AL USUARIO, identificada con el consecutivo SINAC-DS-OFAU-C-1445-2004 y de fecha 21 de abril del 2004, según la cual el inmueble mencionado "...SE UBICA FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRATA POR EL MINISTERIO DE AMBIENTE Y ENERGIA. SIN EMBARGO CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO SEGÚN ARTÍCULOS 13, 14 y 15 de la LEY FORESTAL Placa12929 16 DE ABRIL DE 1996".
Pese a la evidencia de que la parcela constituye Patrimonio Natural del Estado y no obstante lo anterior, se recomendó la titulación de las respectiva parcela en violación a lo dispuesto por el citado articulo 10 del reglamento, que conforme se señaló excluye del trámite de titulación a los terrenos que se encuentran bajo la administración del MINAE, como es el caso del Patrimonio Natural del Estado conforme al articulo 13 de la Ley Forestal, por lo que en este caso se generó un vicio de nulidad absoluta evidente y manifiesta. Adicionalmente, no consta que se haya presentado el estudio de uso conforme de suelos el cual es requerido por el Reglamento a la Ley de Uso de Suelos número 29375-MAG-MINAE-S- HACIENDA-MOPT. Así, el articulo 58 de este reglamento dispone: "En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme de suelo para la actividad que realiza de acuerdo con la metodología aprobada y ejecutándolas con las mejores prácticas de manejo, según la mejor tecnología disponible en cumplimiento de lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27,41,43 y 64 de la ley 7779 y su reglamento".
Este artículo establece que en toda información posesoria que se presente ante el IDA el titulante deberá demostrar con un estudio adecuado de suelos que ha ejercido la posesión cumpliendo con el uso adecuado de suelos, estudio con el cual debe contar obligatoriamente el IDA. Respecto a esta normativa el reglamento entró en vigencia el 21 de marzo de 2001, es decir, con anterioridad a la titulación de la parcela 2-26 a favor de la demandada, de ahí que el estudio era obligatorio por lo que el incumplimiento de éste genera otro vicio de nulidad absoluta. En virtud de lo anterior, debe indicarse que la causal de nulidad de la titulación de la parcela reside en el incumplimiento de requisitos establecidos en la ley o en el reglamento para el dictado del acto administrativo, y por otro lado en la inobservancia de normas prohibitivas.
A. INCUMPLIMIENTO DE REQUISITOS PARA EL DICTADO DEL ACTO COMO CAUSAL DE NULIDAD ABSOLUTA: El artículo 158 de la L.G.A.P., dispone que la falta o defecto de algún requisito del acto administrativo expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste, que en relación con el 166 de la misma ley que establece que habrá nulidad absoluta del acto cuando falte totalmente uno o varios elementos constitutivos real o jurídicamente, y el 167 que dispone que habrá nulidad relativa del acto cuando sea imperfecto uno de sus elementos constitutivos, salvo que la imperfección impida la realización del fin en cuyo caso la nulidad será absoluta. Todos estos artículos relacionados permiten concluir que la falta de requisitos esenciales para la titulación de la parcela de referencia, produce la nulidad absoluta de dicho acto administrativo. Por su parte, el artículo 133 de la L.G.A.P., al referirse al motivo como elemento de validez del acto administrativo dispone que éste tiene que ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto.
En el caso de las titulaciones de tierras en reservas nacionales, el motivo se encontraba regulado, por lo que el incumplimiento de los requisitos establecidos en la ley o el reglamento respectivo como sucedió en el caso, constituyen en sí vicios de nulidad del acto por no existir tal y como habla sido tomado en cuenta para su dictado.
B. INCUMPLIMIENTO DE NORMAS PROHIBITIVAS COMO CAUSAL DE NULIDAD ABSOLUTA: El articulo 129 de la Constitución Política establece que los actos y convenios contra las leyes prohibitivas serán nulos, si las mismas leyes no disponen otra cosa. Los artículos 13, 14, 15, 33 y 34 de la Ley Forestal, corresponden a normas prohibitivas, y el acto administrativo que autorizó el traspaso de la parcela a favor de la demandada es contrario a tales normas, toda vez que mediante dicho acto se autorizó la titulación de terrenos que forman parte del Patrimonio Natural del Estado, lo cual contraviene sin lugar a dudas, el articulo 13 de la Ley Forestal, que declara Patrimonio Natural del Estado a los terrenos forestales y bosques en reservas nacionales y los somete a la administración del MINAE, el articulo 14 ibidem que establece la condición de inembargables e inalienables los terrenos de ese patrimonio natural, que la posesión de éstos por los particulares no genera derecho alguno y no se pueden inscribir por información posesoria, siendo imprescriptible la acción reivindicatoria del Estado, el articulo 15 también de esa ley que se refiere a los impedimentos de la Administración Pública de traspasar, entregar o dar en arrendamiento inmuebles rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el MINAG* (sic) y finalmente los artículos 33 y 34 de la Ley Forestal que declaran áreas de protección, siendo la consecuencia de la contravención de los artículos relacionados, la nulidad absoluta.
cómo dicha causal de nulidad afecta el interés público. La nulidad del acto administrativo (debido al incumplimiento de requisitos esenciales y por ser contrario a normas prohibitivas) por el que se produjo la titulación del inmueble lesiona el interés público pues a través de dicho acto nulo de forma absoluta, se titulan terrenos que forman parte del Patrimonio Natural del Estado. Según el artículo 28 de la Constitución Política, las acciones privadas que no dañen la moral o el orden público, o que no perjudiquen a tercero, están fuera de la acción de la ley, la titulación del Patrimonio Natural del Estado, daña el orden público, al impedir el disfrute del derecho que tiene toda persona a un ambiente sano y ecológicamente equilibrado, en los términos del articulo 50 constitucional, la cual es a su vez una norma de orden público. Además, el derecho a un ambiente sano y ecológicamente equilibrado es un derecho fundamental de tercera generación, que surge con la Declaración Universal de los Derechos Humanos en 1948.
Por su parte, la Declaración de Lisboa de 1988 emitida dentro del marco de la "Conferencia Internacional sobre garantías del Derecho Humano al Ambiente", exhortó a reconocer el derecho que tiene una persona a vivir en un ambiente sano y ecológicamente equilibrado, y a la vez sugirió a los estados crear mecanismos jurídicos que hagan posible que cada individuo pueda ejercer y exigir sin impedimentos, el derecho a habitar en un medio ambiente saludable para el desarrollo de su vida.
1), 2, 3, 4 y 5: Son ciertos. 6) No le consta ni conoce de la necesidad administrativa de que exista algún algún tipo de estudio de parte del Instituto Geográfico Nacional, ya que se supone debe de ser una de las gestiones administrativas que debió de realizar el ente titulante. Además, nunca se le previno la necesidad de su adquisición.por lo cual estima se cumplió a cabalidad con los requisitos solicitados en su momento por el I.D.A. 7) Presentó todos los requisitos que fueron requeridos por el Instituto. No conoce si fue que por un error administrativo no se le solicitó. Sin embargo - de ser así-, no se le puede reprochar, ya que el Instituto en su momento verifica que se cumplió con todos los requisitos necesarios para titular. Debió de ser así pues, de otro modo no hubieran titulado la finca objeto de litis. 8 y 9 : Son ciertos. 10) La sociedad cumplió con todos y cada uno de los requisitos que le solicitaron con el fin de proceder a realizar la titulación.
Sin embargo, debido al tiempo que ha pasado, no se guarda documentación alguna de los requisitos que se presentaron ante el Instituto. Tampoco puede indicar si fue que se perdieron documentos del expediente administrativo ya que es de uso del INDER. 11) Es un informe el cual no se tenía conocimiento de que existía sino hasta ahora que se nos hizo de conocimiento por medio de este proceso. Nunca antes había habido algún tipo de acercamiento de parte del INDER. En todo momento cumplió con los requisitos que le pidieron para titular el inmueble, quedando demostrado que se tuvieron que haber cumplido. De otra forma no se habría dado la titulación. Ahora bien por un error administrativo que es lo que se aprecia en este proceso y por haber transcurrido más de diez años de haber sucedido y de ser una propiedad que forma parte del haber patrimonial de Ganadera Loma Linda S.A., causando con esto un grave daño o perjuicio; máxime si se determina judicialmente, que se debe de revocar el acto administrativo indicado por la parte actora. Sin embargo - alega-, de conformidad con lo establecido en el ARTÍCULO 85 de la Ley 9036, se establece la:
"Convalidación de procedimientos de adjudicación de la propiedad pública, titulación e inscripción en el Registro Público de la Propiedad . Con el propósito de convalidar los actos administrativos que dieron origen a la titulación de propiedades por parte del Instituto de Tierras y Colonización (ITCO) o el IDA ante el Registro Público y la desafectación pública realizada por el Estado, se autoriza al Inder a lo siguiente: a) Medir, catastrar e inscribir mediante exhorto ante el Registro Inmobiliario a nombre del Inder las tierras adquiridas por el IDA que al entrar en vigencia esta ley no se encuentren inscritas a nombre de este instituto en dicho Registro. b) Medir, catastrar, segregar y otorgar título sobre áreas de fincas adquiridas por el IDA con fondos del Fondo de Desarrollo Social y Asignaciones Familiares (Fodesaf), para entregarlos a los poseedores actuales de esos terrenos que cumplan los requisitos del artículo 68 de la Ley N.º 2825, Ley de Tierras y Colonización, y a entidades públicas o privadas de beneficio comunitario que no tengan fines de lucro, y conforme a los procedimientos establecidos en esta ley y sus reglamentos. c) Medir, catastrar, segregar, otorgar título sobre un único predio a los ocupantes nacionales o extranjeros con residencia que demuestren una posesión entendida como la ejercida por un titular, de forma personal, ininterrumpida y a título de dueño, por más de diez años a la fecha de la vigencia de la presente ley, dentro de un asentamiento o finca inscrito a nombre del IDA.
Para estos efectos, el Inder elaborará un reglamento específico, en un plazo de seis meses después de la vigencia de esta ley. d) Se declara de interés público la resolución de las situaciones de precario en territorios rurales; para ello, el Inder podrá realizar los trámites de expropiación, previa declaratoria de la Junta Directiva sobre la necesidad, utilidad y razonabilidad de esta. El procedimiento aplicable será el establecido en la Ley de Expropiaciones. Se exceptúan de la aplicación de esta disposición: 1.- Los títulos que hayan sido otorgados a personas que en el momento de obtener el beneficio no cumplían los requisitos legales y técnicos para obtenerlo y además se desempeñaban en calidad de funcionario público, de la Administración Pública central y descentralizada, o en su calidad de representantes electos popularmente, de las municipalidades, de los concejos municipales de distrito y de las empresas mercantiles del Estado que tenían esta calidad en el momento de la inscripción del beneficio o el título en el Registro Público de la Propiedad, sin perjuicio de terceros de buena fe que los hayan adquirido posteriormente al plazo de convalidación, contado desde su inscripción en el Registro Público.
Estas disposiciones cubren a los parientes del funcionario por consanguinidad o afinidad hasta el tercer grado que no cumplían los requisitos legales y técnicos para obtener el beneficio, cuando este haya intervenido o no en el otorgamiento del título. 2.- Los títulos de propiedad otorgados por el ITCO o el IDA que se encuentren dentro del plazo de convalidación o del período de limitaciones legales y que como producto de una investigación administrativa se determine que ostentan un vicio diferente del procedimiento de inscripción insubsanable administrativamente, y por ende capaz de producir su nulidad absoluta. 3.- Los títulos de propiedad otorgados por el ITCO o el IDA que no se hayan consolidado por prescripción o caducidad, que se encuentren dentro del plazo de convalidación que indica la ley al amparo de la cual adquirió el beneficio o el título y que estén en investigación judicial o administrativa. e) Se autoriza al Inder para que rectifique la cabida de sus fincas inscritas en el Registro Público, sin sujeción a los procedimientos establecidos en el artículo 14 de la Ley de Informaciones Posesorias.". (subrayado suplido).
Habiendo analizados los argumentos de las partes y revisado el contenido probatorio de los autos, el Tribunal determina- en armonía con lo planteado y solicitado en la demanda-, que la misma tiene asidero legal; y, debe ser acogida, por las siguiente razones: VALORACIÓN DEL MARCO FÁCTICO, DEL PRESENTE CASO, A LA LUZ DEL MARCO NORMATIVO BÁSICO: Los artículos 11 inciso a) , 12 inciso a) y 13 de la Ley de Tierras y Colonización (ITCO INDER), # 2825 del 14 de octubre de 1961, en lo de interés, establecen: "Artículo 11.-Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales : a) Todos los terrenos comprendidos dentro de los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; (...) Artículo 12.- Quedan afectados a los fines de la presente ley: a) Las tierras consideradas como reservas nacionales; (...) Artículo 13.- Los inmuebles afectados conforme al presente Capítulo serán transferidos gratuitamente al Instituto de Tierras y Colonización.
Quedan especialmente autorizados para hacer estos traspasos, tanto el Poder Ejecutivo como los Gerentes de las Instituciones Autónomas y los Presidentes Municipales. Las citadas entidades, con excepción del propio Instituto de Tierras y Colonización, no podrán enajenar, gravar ni arrendar las tierras afectadas. A pesar de lo dicho en los párrafos anteriores, el Poder Ejecutivo podrá requerir del Instituto que le traspase la propiedad de aquellas tierras que fueren indispensables para la construcción de obras o la instalación de servicios públicos distintos de los contemplados en esta ley, así como de aquellas que fueren comprendidas en contratos suscritos por dicho Poder y ratificados por la Asamblea Legislativa.". (negrita suplida). Ergo: En los artículos 11, 12 y 13 de la Ley No. 2825, que creó el entonces Instituto de Tierras y Colonización, se estableció el concepto de "reservas nacionales" como aquel que comprende todos aquellos terrenos dentro de los límites del país que no estén inscritos como propiedad particular, de las municipalidades o instituciones autónomas y que los inmuebles afectados a ese término de "reservas nacionales" serían traspasados de forma gratuita al Instituto de Desarrollo Agrario (hoy INDER).
Los artículos 32, 33 y 35 de la Ley Forestal No. 4465 del 25 de noviembre de 1969, (no vigente , derogada por el artículo 73 de la Ley Forestal, N° 7575 del 13 de febrero de 1996) en lo de interés, establecían: " Artículo 32.- El patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública. (...) Artículo 33.- Los terrenos forestales y bosques que constituyen el patrimonio forestal del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria; su invasión y ocupación serán sancionadas conforme con lo dispuesto en esta ley.
(...) Artículo 35.- Dentro del patrimonio forestal del Estado se constituirán: a) Reservas forestales:(...) b) Zonas protectoras: (...) c) Parques nacionales: (...) ch) Refugios nacionales de vida silvestre:(...) d) Reservas biológicas: (...)". (negrita suplida). Por consiguiente, con la Ley Forestal No. 4465 del 25 de noviembre de 1969, se creó el concepto de "Patrimonio Forestal del Estado", definido como el que está constituido por las Reservas forestales, las Zonas protectoras, los Parques nacionales, los Refugios nacionales de vida silvestre, y las Reservas biológicas. Los artículos 13, 14 y 15 de la Ley Forestal, No. 7575 - vigente-, del 5 de febrero de 1996, en lo de interés, establecen. ARTICULO 13.- Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
(...) ARTICULO 14.- Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley. ARTICULO 15.- Impedimentos. Los organismos de la Administración Pública no podrán permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía . Si están cubiertos de bosque, automáticamente quedarán incorporados al patrimonio natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público.
(...)". (negrita suplida). Así pues, actualmente el Concepto de "Patrimonio Forestal del Estado" se mantiene en su esencia. En efecto, aún cuando la Ley Forestal No. 4465 del 25 de noviembre de 1969, fue derogada por la Ley No. 7575 del 5 de febrero de 1996, lo que cambia es su denominación al de "Patrimonio Natural del Estado". A su vez, el citado Patrimonio, según lo establece el artículo 14 de la Ley Forestal vigente, está afecto al régimen de dominio público. Y por lo consiguiente, a sus efectos protectores de inembargable, inalienable e imprescriptible. Además, como una garantía para la protección del Patrimonio, el artículo 15 de la citada Ley No. 7575, estableció que los organismos de la administración pública no podrán enajenar terrenos rurales de su propiedad o administración, sin que antes hayan sido clasificados por el MINAE, en el entendido de que si estuviesen cubiertos de bosque, quedarían automáticamente incorporados al Patrimonio Natural del Estado, sin que sea preciso contar con la clasificación previa del MINAE.
Los artículos 3, inciso b) y 18 inciso m) de la Ley de Creación del Instituto Desarrollo Agrario, Número 6735 del 29 de marzo de 1982 (Actualmente INDER), establecían: Artículo 3º.- El Instituto de Desarrollo Agrario tendrá las siguientes funciones: (...) b) Administrar , en nombre del Estado, las reservas nacionales y las tierras que se traspasen para el cumplimiento de sus fines, y efectuar en ellas planes de desarrollo integral, asentamientos campesinos, colonización, parcelación y adjudicación; todo ello con arreglo a las normas de la presente ley; (...); Artículo 18.- La Junta Directiva del Instituto tendrá las siguientes funciones: (...) m) Aprobar la adjudicación de tierras y otorgar los respectivos títulos, de acuerdo con las disposiciones legales y reglamentarias sobre la materia; (...)" negrita suplida). Ergo, si bien el Instituto podía aprobar la adjudicación de tierras y otorgar los respectivos títulos, es evidente que debía hacerlo de acuerdo con las disposiciones legales y reglamentarias sobre la materia; de modo que, de acuerdo con los artículos 13, 14 y 15 de la Ley Forestal, No. 7575 del 5 de febrero de 1996, como ya explicamos, no podía - ni debía-, enajenar, vale decir, disponer del patrimonio natural del Estado constituido por los bosques y terrenos forestales de las reservas nacionales, menos, sin que antes hubiesen sido clasificados por el MINAE, en el entendido de que si estuviesen cubiertos de bosque, quedarían automáticamente incorporados al Patrimonio Natural del Estado, sin que fuera preciso contar con la clasificación previa del MINAE.
La Ley de Titulación de Tierras en Reservas Nacionales número 7599 del 29 de abril de 1996 fue anulada por resolución de la Sala Constitucional No. 8560-2001 de las 15:37 horas del 28 de agosto de 2001. Y los decretos ejecutivos mediante los cuales se traspasaron áreas de reservas nacionales al Instituto de Desarrollo Rural (*) (anteriormente ITCO) para la creación de los programas de titulación en reservas nacionales denominados, Llanuras de San Carlos-Sarapiquí, Puerto Jiménez, Tierras Altas de Santa Cruz, Pascua, Cuenca río Aranjuez y Los Santos, entre ellos el Decreto Ejecutivo 28745-MINAE-MAG, publicado en La Gaceta Nº 133 del 11 de julio del año 2000, que originó la finca del Partido de Puntarenas, folio real 115.788-000, fueron declarados inconstitucionales, por conexidad, según resolución N° 8457-2007 del 13 de junio de 2007, de la Sala Constitucional, y posteriormente derogados por el Decreto Ejecutivo No. 34506 del 14 de febrero de 2008.

Ahora bien, los artículos 10 inciso b), y 11 del Reglamento para la titulación de Tierras en Reservas Nacionales #55 del 12/08/2002, La Gaceta # 173, del 10 de setiembre del 2002, con base en el cual se levantó la información posesoria para la titulación, en el presente caso (el cual por cierto fue anulado por resolución de la Sala Constitucional N° 2063-07, del 14-2-07, aclarada por resolución N° 4517-07, de las 18:19 horas del 28-3-07), en lo de interés , establecían: " Artículo 10.—Las tierras mencionadas en los artículos 6º, 7º, 8º y 9º de este Reglamento y que no estén sujetas a la administración por parte del MINAE, serán traspasadas e inscritas a nombre de sus respectivos poseedores. Para tales efectos, se entenderá como poseedor a la persona física o jurídica quién haya ejercido posesión sobre el fundo a titular en forma quieta, pública, pacífica, ininterrumpida y a titulo de propietario durante un lapso no menor de diez años.
La prueba de la posesión correrá a cargo del solicitante, bajo responsabilidad de los funcionarios institucionales autorizados para tal fin, en las oficinas regionales y en el Departamento de Ordenamiento Agrario y deberá contener necesariamente los siguientes requisitos: (...) b- Plano catastrado original o copia certificada emitida por el Catastro Nacional y certificación original extendida por el MINAE en donde conste que el terreno a titular según el plano catastrado no está afectado o inmerso dentro de áreas de conservación, patrimonio natural del Estado. (...) (negrita y subrayado suplidos) . Artículo 11.—Aportados los requisitos anteriores, el Instituto, por medio de las oficinas regionales, procederá a abrir expediente individual, debidamente foliado y realizará la inspección de campo para verificar la información en la documentación aportada. Las manifestaciones del solicitante tendrán carácter de declaración jurada.
De comprobarse alguna falsedad se hará acreedor de las sanciones que la legislación penal vigente establece para ello". (negrita suplida). Entonces, para que no se titularan terrenos afectados o inmersos en dicho patrimonio, y así realizar el fin legal de su protección y conservación, es que se requería la aportación de una certificación del MINAE en donde constara que el terreno a titular según el plano catastrado no estaba afectado o inmerso - total o parcialmente-, dentro de áreas de conservación, patrimonio natural del Estado . Y la realización de una inspección de campo para verificar la información en la documentación aportada. Por consiguiente, el Instituto no podía titular terrenos afectados o inmersos - total o parcialmente, lo mismo da-, dentro de áreas de conservación, patrimonio natural del Estado, constituido por los bosques y terrenos forestales de las reservas nacionales, so pena de nulidad de la titulación, en caso contrario, por impedir la realización del fin del acto.
Pues bien, en contravención con las disposiciones normativas, comentadas, en el presente caso tenemos, en autos, que el Instituto desatendió que según la inspección practicada, por un técnico de la Oficina Regional de Coyolar, funcionario suyo, la naturaleza de la Dirección8720 , estaba constituida por 30 hectáreas de Tacotal, pero también, por 10. 9 hectáreas de Bosque. Igualmente ignoró que si bien el plano catastrado aportado No. P-912593-04 indicaba repasto (uso agrícola), también indicaba montaña. De igual manera desatendió las declaraciones juradas notariales, de la solicitante, de que era terreno de repasto pero también de montaña. Encima la solicitante no aportó certificación extendida por el MINAE donde - según afirmó-, constara que su propiedad no afectaba patrimonio natural del Estado; pues, si bien certificaba "inmueble que se ubica FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR EL MINISTERIO DE AMBIENTE Y ENERGÍA.", igualmente certificaba, " SIN EMBARGO CONSTITUYE PARCIALMENTE PATRIMONIO NATURAL DEL ESTADO SEGÚN LOS ARTÍCULOS 13, 14 y 15 DE LA LEY FORESTAL Placa12929 16 DE ABRIL DE 1996.".
Sobre lo cual - a diferencia de lo señalado por la demandada, en sus conclusiones, no existe duda, toda vez que, así fuera parcialmente, el caso es que la parcela en cuestión se encontraba afectada por los artículos 13, 14 y 15 de la Ley Forestal No. 7575. Siendo ignorado, también, por completo, por el Instituto. Con la consecuencia de que su Junta Directiva autorizó la segregación, traspaso y titulación de la parcela, en cuestión, a favor de Ganadera Loma Linda S.A. con cobertura parcialmente boscosa, de montaña, que formaba parte del patrimonio natural del Estado. A contrapelo, pues, del reglamento de base, utilizado en el caso por el Instituto, que expresamente prohibía la titulación de tierras sujetas a la administración por parte del MINAE, es decir, de predios afectados o inmersos dentro de áreas de conservación, patrimonio natural del Estado. Lo cual constituye, por sí solo, motivo de nulidad absoluta.
Sin que sea óbice, por lo expuesto - ni vicio de nulidad del presente proceso-, si la Certificación del MINAE no determina cuál es la parte de patrimonio natural del Estado, como arguye la demandada en sus conclusiones. POR OTRO LADO, los artículos 26 y 27 de la Ley de Uso, Manejo y Conservación de Suelos, No. 7779, del 30 de abril de 1998 - La Gaceta 97 del 21/05/1998- vigente desde el 21 de mayo de 1998, establecen: " ARTÍCULO 26.- La adquisición de terrenos y su adjudicación por parte del Instituto de Desarrollo Rural(*) de acuerdo con sus competencias legales, deberá tomar en cuenta las directrices definidas en el Plan nacional y los planes por áreas de manejo y conservación de suelos. (*) (Modificada su denominación por el artículo 14° de la Ley N° 9036 del 11 de mayo de 2012, "Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural") ARTÍCULO 27.- Será obligatorio para el Instituto de Desarrollo Agrario disponer de estudios de capacidad de uso de la tierra, antes de adquirir terrenos para fines de titulación.
Toda adjudicación de terrenos deberá tener como limitación que el uso del terreno adjudicado no pueda ir en contra de su capacidad de uso. El incumplimiento de esta disposición acarreará la revocatoria de la adjudicación, aparte de otras penas con que se pueda castigar por los delitos que le sean imputables.". En concordancia, los artículos 58 y 62 del " Reglamento a la Ley de Uso, Manejo y Conservación de Suelos -decreto 29375-MAG-MINAE-S HACIENDA-MOPT, del 8 de agosto del 2000, La Gaceta # 57 del 21/03/2001, Fecha de vigencia desde el 21 de marzo del 2001-, establecen: "Artículo 58.—En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar, con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada, y ejecutándolas con las mejores prácticas de su manejo, según la mejor tecnología disponible en cumplimiento con lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27 , 41, 43 y 64 de la Ley Nº 7779 y este Reglamento.
Artículo 62.—Si del estudio de suelos y la clasificación de las tierras, no sea procedente la titulación para fines agrarios o urbanos, el IDA las destinará en su caso a reserva nacional traspasándolas en su caso al MINAE.". (negrita suplida). Ergo, para poder titular terrenos - y con el fin legal de evitar el cambio de uso de la tierra cuando p.ej. el inmueble es de eminente vocación forestal y no apto para el desarrollo de actividades agropecuarias-, el Instituto debía solicitar un estudio y/o una certificación de uso conforme de suelos. Así se desprende de dicha normativa en cuanto establece que en toda información posesoria que se presente ante el IDA el titulante deberá demostrar, con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza. Estudio con el cual debía contar obligatoriamente el Instituto, en el presente caso, toda vez que la Ley entró en vigencia desde el 21 de mayo de 1998, mientras que el Reglamento entró en vigencia el 21 de marzo de 2001, es decir, con anterioridad al 26 de agosto del 2004, fecha del acuerdo No. 41 de la Sesión Ordinaria 031-04, en que la Junta Directiva del IDA autorizó la segregación, traspaso - y titulación-, de la parcela 26 del Bloque 2, a favor de Ganadera Loma Linda S.A. Por consiguiente, el Instituto no podía titular terrenos so pena de nulidad de la titulación, en caso contrario, por impedir la realización del fin del acto.
Pese a lo cual, en el expediente de titulación de la parcela 26, bloque 2, del Proyecto de Titulación Cuenca del Río Aranjuéz, a favor de Ganadera Loma Linda S. A., no consta se haya solicitado ni por ende aportado el estudio de uso conforme de suelos efectuado por un profesional competente, o bien, certificación al respecto del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA). Lo cual constituye, también, motivo de nulidad absoluta. Por consiguiente, se tiene por constatado - contrario sensu-, el incumplimiento de los requerimientos normativos previstos en el Reglamento para la Titulación de Tierras en Reservas Nacionales publicado en la Gaceta 173 del 10 de septiembre del 2002, en concordancia con la Ley Forestal No. 7575 del 5 de febrero de 1996 y el Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, necesarios para que fuera procedente la titulación.
En razón lo expuesto se acogen, en esencia, los alegatos de la demanda, sobre incumplimiento de requisitos para el dictado del acto como causal de nulidad absoluta, con base en el artículo 158 de la L.G.A.P., en cuanto dispone que la falta o defecto de algún requisito del acto administrativo expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste; en relación con el 166 de la misma ley en cuanto establece que habrá nulidad absoluta del acto cuando falte totalmente uno o varios elementos constitutivos real o jurídicamente, y el 167 en cuanto que dispone que habrá nulidad relativa del acto cuando sea imperfecto uno de sus elementos constitutivos, salvo que la imperfección impida la realización del fin en cuyo caso la nulidad será absoluta. Cual es, en esencia, como ya explicamos, el vicio de nulidad absoluta, en el presente caso. Todos estos artículos relacionados permiten concluir que la falta de requisitos esenciales para la titulación de la parcela de referencia, produce la nulidad absoluta de dicho acto administrativo.
Amén de que el artículo 133 de la L.G.A.P., al referirse al motivo como elemento de validez del acto administrativo dispone que éste tiene que ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto. Siendo que en el caso de las titulaciones de tierras en reservas nacionales, el motivo se encontraba regulado, por lo que el incumplimiento de los requisitos establecidos, particularmente en el reglamento respectivo de base, como sucedió en el caso, constituyen en sí vicios de nulidad del acto por no existir tal y como habla sido tomado en cuenta para su dictado. Igualmente se acogen, en esencia, los alegatos de la demanda, sobre incumplimiento de normas prohibitivas como causal de nulidad absoluta, con base en el articulo 129 constitucional, en cuanto establece que los actos y convenios contra las leyes prohibitivas serán nulos, si las mismas leyes no disponen otra cosa, en la medida en que el acto que autorizó la segregación, traspaso y titulación de la parcela a favor de Nombre81222 .
S.A. desatendió la prohibición contenida en los artículos 13, 14, y 15, de la Ley Forestal. Finalmente, la demandada transcribe en su defensa el artículo 85, del TÍTULO III, DISPOSICIONES FINALES Y TRANSITORIAS , de la Ley 9036 del 11/05/2012, que Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural, identificado con el epígrafe: "Convalidación de procedimientos de adjudicación de la propiedad pública, titulación e inscripción en el Registro Público de la Propiedad". Sin embargo, salvo su transcripción, la demandada no explica - ni el Tribunal entiende, entonces-, en qué sentido y medida resulta aplicable, a su caso. Razón por la cual se rechaza, su mera invocación, sin necesidad de mayores comentarios. EN CUANTO A LA EXCEPCIÓN DE PRESCRIPCIÓN Y CADUCIDAD. Los alegatos de la demandada al respecto, son escuetos, pues solo señala, en la contestación a la demanda, que lo hace con fundamento en lo establecido en los artículo 298 y 433 del Código Procesal Civil.
Que no vienen al caso por tratarse de normas adjetivas. En conclusiones arguye, tan solo, y en esencia, que pasaron años desde la titulación o escritura del 28 de febrero del 2005; más de diez años plazo para cualquier acción, incluida la contencioso-administrativa. Por consiguiente, los alegatos se deben rechazar, por genéricos e indeterminados, así también por las razones esgrimidas por el Instituto, al evacuar la audiencia sobre la contestación y excepciones opuestas por la demandada, reiteradas, en sus conclusiones, que este Tribunal, comparte, y amplía, como son, en resumen: Que este tipo de asuntos por ser básicamente materia de Derecho Público y referentes a titulación con vicios de nulidad absoluta de bienes de dominio público y Patrimonio Natural del Estado, que por su naturaleza misma son considerados bienes demaniales, carecen por fuero especial y mandato de ley de plazos de caducidad y prescripción.
En el anterior sentido obsérvese que: El artículo 172 de la Ley General de la Administración Pública establece que: "El acto absolutamente nulo no se podrá arreglar a derecho ni por saneamiento, ni por convalidación.". El artículo 14 de la Ley Forestal establece: "ARTICULO 14.- Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley". (negrita suplida). Ergo, el citado Patrimonio, según lo establece dicha norma, está afecto al régimen de dominio público.
Y por lo consiguiente, a sus efectos protectores de que es inembargable, inalienable e imprescriptible. Sin que sea óbice, a tales efectos, que la parcela constituyera parcialmente patrimonio natural del estado - esto es, con cobertura parcialmente boscosa-, siendo suficiente, por sí solo, para tener acreditada su naturaleza demanial, sin que se pueda escindir - material o jurídicamente-, por formar parte; esto es, por estar afectada o inmersa, como tal, dentro del patrimonio natural del Estado. Y afectada, por ende, por las disposiciones del artículo 14 de la Ley Forestal No. 7575. Por otra parte, el artículo 34 inciso 2 del Código Procesal Contencioso Administrativo establece que "La Iesividad referente a la tutela de bienes del dominio público no estará sujeta a plazo." . Finalmente, con apoyo en sentencia de la sección Sexta de este Tribunal, que reseñamos, tenemos que "...En relación con la defensa de prescripción, habiéndose acreditado la naturaleza demanial del inmueble objeto, se impone necesariamente su rechazo.
Debe tenerse presente que, tratándose de recuperación y tutela de bienes de dominio público, no corren plazos de prescripción ni caducidad, siendo que las acciones con las que cuenta el Estado para su efectiva recuperación son imprescriptibles. Ello es así por las características particulares de este tipo de bienes. Así lo establece expresamente el numeral 14 de la Ley Forestal y el articulo 34 inciso 2 del Código Procesal Contencioso Administrativo. Asimismo, en el tanto el acto absolutamente esté surtiendo efectos es posible su anulación, según se desprende del ordinal 40 del mismo Código Procesal...". Voto número 0038-2010 de las 14: 45 horas del 11 de enero del 2010, de la Sección Sexta, del Tribunal Contencioso Administrativo y Civil de Hacienda. Consecuentemente se desestiman las excepciones de prescripción y caducidad. En razón de lo señalado - lo cual se estima suficiente-, se desechan, por inútiles, por inconducentes, las restantes afirmaciones de la contestación de demanda.
Por todo lo dicho y de acuerdo con las consideraciones expuestas, se ha de declarar procedente, en todos sus extremos, la demanda de lesividad. Consecuentemente, se han de anular: El acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 41, de la sesión 031-04, de fecha 26 de agosto del año 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de Nombre81222 correspondiente al Plano Catastrado P-0912593-2004. Por conexión: La escritura número 102 inscrita el 28 de febrero del año 2005, otorgada ante el Notario Luis Enrique Wong Sanchez, emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de GANADERA LOMA LINDA SOCIEDAD ANÓNIMA correspondiente al Plano Catastrado P-0912593-2004. Así como el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, folio Real número Placa12930 emitido por el Registro Nacional; y cualquier inscripción que depare de la inscripción del inmueble inscrito en el Registro Nacional, Partido de Puntarenas Folio Real Matricula número Placa12930.
Las excepciones de prescripción y caducidad, se debe rechazar, como en efecto se deniegan, por las razones expuestas. La excepción de falta de derecho se debe rechazar, como en efecto se desestima, por cuanto la demanda sí encontró respaldo en el ordenamiento jurídico.
Por expresa disposición del artículo 193 del Código Procesal Contencioso Administrativo, procede condenar a la parte demandada al pago de ambas costas de esta acción por el solo hecho de haber resultado vencida en este proceso, sin que medien razones dadas por la accionada o determinadas por este Tribunal, que justifiquen su exoneración conforme los incisos a) y b) del numeral 193 citado. Por ello se imponen ambas costas del proceso a cargo de la parte demandada.
POR TANTO
Se desestiman las excepciones prescripción y caducidad y falta de derecho. Se declara procedente, en todos sus extremos, la demanda de lesividad. Consecuentemente, se anulan: El acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 41, de la sesión 031-04, de fecha 26 de agosto del año 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de Nombre81222 correspondiente al Plano Catastrado P-0912593-2004. La escritura número 102 inscrita el 28 de febrero del año 2005, otorgada ante el Notario Luis Enrique Wong Sanchez, emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas Folio Real Matrícula número Placa12930 a favor de Nombre81222 correspondiente al Plano Catastrado P-0912593-2004. El asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, folio Real número Placa12930 emitido por el Registro Nacional.
Cualquier inscripción que depare de la inscripción del inmueble inscrito en el Registro Nacional, Partido de Puntarenas Folio Real Matricula número Placa12930.
