A REQUEST FOR JUDICIAL APPROVAL (homologación) OF A PARTIAL SETTLEMENT AGREEMENT (acuerdo conciliatorio parcial) IS HEREBY DECIDED WITHIN AN EXPEDITED FULL-TRIAL PROCEEDING (proceso de conocimiento de trámite preferente) FILED BY CONTRALORÍA GENERAL DE LA REPÚBLICA AGAINST MUNICIPALIDAD DE AGUIRRE AND OTHERS.

FINDINGS OF FACT (RESULTANDOS) PROCEDURAL BACKGROUND FIRST.- SUBJECT MATTER OF THE DISPUTE. On 13 de octubre de 2009, Contraloría General de la República (C.G.R.) filed this action, seeking a declaration that the existence of the mangrove wetland (Humedal de Manglar) known as Estero Hatillo Viejo N° 549 would consequently result in its designation as a public zone (zona pública), thereby rendering absolutely null and void the related actions approving and expanding the PLAN REGULADOR DE PLAYA GUAPIL in the Cantón de Aguirre; it also challenges the validity of the establishment of a public road, the granting of concessions, related and associated approval acts, sales, transfers, and registry entries, among other matters also related to the properties at that location, as well as strict financial liability (responsabilidad patrimonial objetiva) for the alleged harm to the wetland. (See folios 1 through 121 of Court Case File N° 09-002554-1027-CA, hereinafter the court case file).

SECOND.- PARTICIPATING PARTIES.- The acts initially challenged in the judicial action and the subject matter of the judicial proceeding required the participation as respondents of Municipalidad de Aguirre, Instituto Nacional de Vivienda y Urbanismo (I.N.V.U.), Instituto Costarricense de Turismo (I.C.T.), and Playa Matapalo S.A.; El Estado, Sistema Nacional de Áreas de Conservación (SINAC), and Junta Administradora del Registro Nacional also participated. (See complaint at folios 1 through 121 of the court case file).

THIRD.- DETERMINATION THAT EXPEDITED PROCESSING WAS WARRANTED. By order issued at seven hours and thirty-five minutes on catorce de octubre del dos mil nueve, Judge Baltodano Gómez, who initially heard the case, determined that it qualified for expedited processing (Trámite Preferente), pursuant to Article 60 of Código Procesal Contencioso Administrativo (CPCA), upon finding “that this matter is of great significance to the public interest, not only because, in principle, the environment is being affected, but also because the affected area is an ecosystem vital not only to the country but also to the planet.” (See folios 122 et seq. of the Court Case File).

FOURTH.- ORDER FOR EXPEDITED PROCESSING. Upon its immediate referral to the Sixth Section of this Court, the matter was assigned to Judge Álvarez Molina, together with Judges Garita Navarro and González Vílchez, who, by order issued at ten hours on veintinueve de octubre del año dos mil nueve, and “...considering the allegations of encroachment upon the State’s natural heritage, purportedly resulting from the construction of a roadway through a wetland that was later declared a public road, require prompt attention because this is a matter in which a marked public interest is present...,” ordered that this judicial proceeding be handled on an expedited basis, pursuant to article 60.1 CPCA. (See folios 124 et seq. of the Court Case File).

CONCILIATION PHASE FIFTH.- NOTICE TO APPEAR FOR CONCILIATION AND CONDUCT OF THE HEARING. During expedited processing, after determining that referral to the conciliation phase was appropriate, the Sixth Section, following prior coordination, issued an order at eight hours and thirty minutes on diecisiete de agosto del dos mil once, summoning all parties to the first conciliation hearing, scheduled for treinta de agosto del dos mil once. (Articles 59 and 70 of Código Procesal Contencioso Administrativo). Administrative Litigation Conciliation Judge Alexander Castillo Aguilar has heard the request for judicial approval and presided over the conciliation in all its hearings, acting under the authority and legal standing conferred by Competitive Appointment Agreement N° 54-08 of Consejo Superior del Poder Judicial, dated veinticuatro de junio del año dos mil ocho, with the dos mil doce professional liability policy duly paid and his professional bar membership in good standing. (Arts 7, 11, and 12 Ley 7727 and Arts 59, 80.2, and 102 of the CPCA).

SIXTH.- INFORMATION REGARDING THE DUTIES, RIGHTS, AND PRINCIPLES APPLICABLE TO ALL JUDICIAL CONCILIATION. From the commencement of the first notice to appear for conciliation, with their application reiterated at all subsequent separate and joint hearings, all participating parties have been informed of the purpose and nature of conciliation and of their applicable rights and duties, grounded in the principles governing the institution of conciliation and its application in judicial proceedings, in accordance with the principles contained in Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social, including, specifically, the Principles of Freedom, Confidentiality, Information and Education, Nonviolence and Equality, Party-Driven Participation, Contextuality, Impartiality, Anticipation of Conflicts of Interest, and Orality, among others. They have also been informed of the special judicial guarantee concerning the protection of and respect for those rights and principles, through the intervention and role that the Conciliation Judge must assume in guiding the parties through the proceeding and agreement with complete Independence and Impartiality.

The parties have been informed of the rights at stake and advised that a settlement agreement might not satisfy every interest, as well as of their right to consult an attorney regarding the agreement’s contents before signing it. They have also been informed that the technical documentation, the agreement, and the judgment will become public documents once the agreement has been judicially approved. (Ley de Resolución Alterna de Conflictos, Articles 11 and 15).

SEVENTH.- IMPLICATIONS OF THE LEGAL SYSTEM AND APPLICABLE RULES AND PRINCIPLES. Specifically with respect to conciliation within this Administrative Litigation Jurisdiction, from the commencement of the first notice to appear, with the participation of all respondent parties and the reiteration of its application at all subsequent separate and joint hearings, all participating parties have been informed of the implications of respecting the Legal System and of the special obligation arising from article 129 of Constitución Política, which expressly establishes the nullity of acts and agreements contrary to law (including both potential settlement agreements and acts of general application such as regulatory plans). It is understood that the foregoing also entails, pursuant to constitutional article 7, that the judge’s obligation and oversight to ensure respect for the legal system and its hierarchy operate first by guaranteeing constitutional principles and rights, as well as those human rights recognized and incorporated in duly ratified international instruments; thereafter, by ensuring the rights recognized in statutes and international treaties having the force of law; and finally, those contained and developed in executive acts, whether general or individual in nature.

In this particular case, given the subject matter of the proceeding, the cross-cutting nature of the rights recognized in both the Constitution and international treaties concerning Environmental Protection and Citizen Participation (Principle 10 of the Rio Declaration), as incorporated for Municipalities and Regulatory Plans in article 17 of Ley de Planificación Urbana, is relevant in determining the limits of any potential agreement.

EIGHTH.- PHYSICAL INCORPORATION. On treinta de noviembre del dos mil doce, the physical incorporation into the case file and pagination of all documents whose confidentiality had been preserved and which had been kept in the court office’s files was ordered. (All documentation is public and has already been added to the case file).

NINTH.- SUBJECT MATTER OF THE SETTLEMENT AGREEMENT TO BE EVALUATED FOR JUDICIAL APPROVAL. Contained in the hearing record and settlement agreement executed at Tribunal Contencioso Administrativo y Civil de Hacienda, Segundo Circuito Judicial de San José, Anexo Contencioso.

Contraloría General de la República, Municipalidad de Aguirre, Instituto Nacional de Vivienda y Urbanismo, and Instituto Costarricense de Turismo have agreed as follows:

“RECITALS (CONSIDERANDO) 1. The ordinary complaint filed by Contraloría General de la República against Municipalidad de Aguirre and others before that Court on 13 de octubre de 2009 (folio 1 of the court case file).

2. The order issued at 10:00 hours on 19 de octubre de 2009, in which the Sixth Section of that Court, under expedited processing, admitted the complaint and served the parties with process to answer it (folio 125 of the court case file).

3. That in this proceeding, Municipalidad de Aguirre, ICT, and INVU appear as defendants against whom the complaint seeks the nullification of administrative conduct, the determination of liability, and the consequent recovery of damages.

4. The evidence submitted by CGR with the complaint filed on 13 de octubre del 2009 (see court folios 1, 113, 114, 115, and 116).

5. The evidence submitted by the parties in the proceeding (including, among other items, SINAC certifications and technical opinions at court folios 1092 through 1105, 1106, and 1117).

6. That, in response to the resolution adopted by Concejo Municipal de Aguirre at its session of 13 de noviembre del 2007, official letter ALCM-042-2007 was issued and signed by Lic. Randall Marín Orozco, Asesor Legal del Concejo Municipal de Aguirre, consisting of a proposed resolution for Concejo Municipal to declare the Plan Regulador de Playa Guapil, its zoning regulations and land-use and road plan, as well as the concessions granted to the concessionaire company under case files No. 3436-02, 3437-02, 3438-02, 3439-02, and 3440-02, injurious to the public interest (lesividad) (see resolution N° 4, fourth article, of ordinary session N° 145 of 20 de noviembre del 2007, which was attached to the action for a declaration of injury to the public interest filed by Municipalidad de Aguirre and processed under case file 07-001665-0163-CA).

7. That, through resolution N° 4, fourth article, of ordinary session N° 145 of 20 de noviembre del 2007, which was attached to the action for a declaration of injury to the public interest filed by Municipalidad de Aguirre and processed under case file 07-001665-0163-CA, Concejo Municipal de Aguirre declared the Plan Regulador de Playa Guapil, its zoning regulations and land-use and road plan, as well as the concessions granted to Playa Matapalo S.A. under case files No. 3436-02, 3437-02, 3438-02, 3439-02, and 3440-02, injurious to the public interest.

8. That in the proceedings conducted under expediente 07-001665-0163-CA, judgment No. 2868-2011 of 8:00 hours on 22 de setiembre del 2011 was issued by the Juzgado Contencioso Administrativo y Civil de Hacienda, granting in all respects the action seeking a declaration of injury to the public interest (demanda de lesividad) filed by the Municipalidad de Aguirre to annul the administrative act (acto administrativo) of the Concejo Municipal which, at ordinary session N° 310 of 25 de marzo de 2002, approved the Partial Coastal Regulatory Plan (Plan Regulador Costero Parcial) for Playa Guápil and its regulations; the administrative acts approving all concessions (concesiones) in favor of Playa Matapalo S.A., legal entity identification number (cédula de persona jurídica) No. CED31690, pursuant to the resolution of the Concejo Municipal adopted at Ordinary Session N° 127, Article V), of 13 de enero del 2004; and the administrative acts of the ICT approving the concessions granted to Playa Matapalo S.A. through resolutions N° G-319-2004, G-328-2004, G-372-2004, G-373-2004, of 26 y 27 de febrero, 4 de marzo, 4 de febrero, all from the year 2004, respectively, and official letter N° G-2078-2004 of 24 de noviembre de 2004, corresponding respectively to ICT administrative files No. 3436-02, 3437-02, 3438-02, 3439-02 and 3440-02.

9. That the Municipalidad de Aguirre did not challenge the aforementioned judgment.

10. That the signatory parties acknowledge the content and operative provisions (parte dispositiva) of judgment No. 2868-2011 of 8:00 hours on 22 de setiembre del 2011, issued by the Juzgado Contencioso Administrativo y Civil de Hacienda.

11. That through resolution N° 09, Article Seven, adopted by the Concejo Municipal de Aguirre at session N° 180-2012 of 13 de marzo del 2012, a settlement proposal (propuesta de conciliación) submitted by the Legal Department of the Corporation was considered. Among other matters, it concerned annulling the partial coastal regulatory plan and its expansion for Playa Guapil, all concessions granted to Playa Matapalo S.A., contracts, registry entries, and other related actions; annulling the deed under which two parcels of land were donated to the Municipalidad de Aguirre on the condition that it declare a public road over them, which would in turn serve as the sole access to the potentially concessionable areas of the maritime-terrestrial zone (zona marítimo terrestre) (which would, in turn, make possible the existence of a potential coastal regulatory plan at Playa Guapil); annulling the declaration of that road as a public street; and implementing a remediation plan (plan remedial) concerning the environmental damage caused by the construction and opening of that public road.

At that session, it was determined that settling the annulment of the regulatory plan, its expansion, all its concessions, and the declaration of the public street was feasible. It was considered that doubts existed regarding annulment through an administrative proceeding (procedimiento administrativo) (consultation), and that the administrative actions relating to the public road could be annulled provided that a technical opinion (criterio técnico) was available.

It was therefore agreed that, if the doubts regarding the two preceding points were resolved and if the CGR submitted a formal proposal to the Concejo, a settlement on the terms described would be considered feasible. This would occur at a special session or at the next ordinary session of the municipal collegiate body.

12. That the CGR analyzed the aforementioned resolution N° 09, Article Seven, adopted by the Concejo Municipal de Aguirre at session N° 180-2012 of 13 de marzo del 2012. On the basis thereof and of the terms outlined with the representatives of the Municipalidad de Aguirre, the ICT, and the INVU following several settlement sessions, the Contraloría General de la República prepared a settlement proposal that it considers reasonably and proportionately satisfies the requirements and interests of the Municipalidad de Aguirre, the ICT, the INVU, and the CGR. Among other matters, the proposal grounds the remediation plan not on an ordinary opinion of the Administration, but in strict adherence to the specialized technical opinion of Costa Rica’s competent body for issuing opinions concerning wetlands (humedales): SINAC (see the technical opinions cited in recital (considerando) 5 and contained in the judicial file).

SETTLEMENT AGREEMENT (ACUERDO CONCILIATORIO) FIRST. The ICT, the INVU, and the Municipalidad de Aguirre declare the absolute nullity (nulidad absoluta) of the Partial Coastal Regulatory Plan for Playa Guapil, cantón Aguirre, Distrito Savegre, which was published in the Diario Oficial La Gaceta N° 91 of 14 de mayo del 2002 (see folio 1 of the administrative file concerning the zoning regulations (reglamento de zonificación) for the Municipalidad’s Playa Guapil regulatory plan, submitted by the CGR with its complaint, and item of evidence 9 in legajo-pruebas-CGR); of the expansion of that regulatory plan, which was discussed and approved in resolution N° 2 of ordinary session N° 69 of 01 de abril del 2003, Article Five, specifically in the areas between Lambert coordinates 358.200 N-475.100 E,358.350 N-475.150 E, 388.350 N-475.250 E NIE146 E,358.210 N-475.350 E358.270 N-475-370 E (see folios 71 and 73 of the INVU administrative file concerning the Playa Guapil coastal regulatory plan); of its zoning regulations; of the corresponding drawings bearing their respective approvals (visados); of all concessions granted, approved, and recorded in the Registro Nacional in favor of Playa Matapalo S.A.; and of all related acts and actions occurring before and after the approval of that partial regulatory plan, its expansion, and all concessions granted to Playa Matapalo S.A.

For that purpose, by reason of relatedness (conexidad), at least the following administrative actions of the public entities that participated in issuing that regulatory plan and its expansion have been identified and are hereby annulled:

COASTAL REGULATORY PLAN AND ITS EXPANSION.

-The draft partial regulatory plans prepared by Deppat S.A. in junio de 1995 and the expansion thereof described in INVU official letter PU-C-D-1026-2006 of 7 de noviembre del 2006—specifically in the areas between southern Lambert coordinates 358-356N 475.062 E NIE125 E, comprising the sector bounded by Instituto Geográfico Nacional boundary markers (mojones) 37 through 32—and in the resolution adopted by the ICT at ordinary session N° 5310, Article 5, subsection XII, of 15 de junio del 2004—specifically in the areas between southern Lambert coordinates 358-356N 475.062 E NIE125 E, comprising the sector bounded consecutively by Instituto Geográfico Nacional boundary markers 37 through 32, the beachfront sector between boundary markers 131 and 128, and the sector between boundary markers consecutively delimiting the wetland from 294 through 300, in accordance with drawing 20 at a scale of 1:2000, prepared by Deppat and signed by the responsible professional, Arq. Alfredo Bermúdez, code A-4043-.

-The act of the ICT Junta Directiva approving the Partial Regulatory Plan for Playa Guapil de Aguirre at ordinary session No. 4652 of 24 de junio de 1996, Article 5, subsection 10 (fact 13 of the complaint. See folio 139 of volume I and folio 123 of volume II, both from the ICT administrative file concerning the partial regulatory plan submitted by the CGR).

-Act dated 14 de junio del 2001 through which the Dirección de Urbanismo of the INVU communicated the approval of the Partial Regulatory Plan (see folios 42 through 49 of the INVU administrative file concerning the Playa Guapil coastal regulatory plan and item of evidence 8 in legajo-pruebas-CGR)—see fact 33 of the complaint—.

-Act of 25 de marzo del 2002 through which the Concejo Municipal de Aguirre, at ordinary session N° 310, approved the Partial Regulatory Plan for Playa Guápil, which was published in the Diario Oficial La Gaceta N° 91 of 14 de mayo del 2002 (see folio 1 of the administrative file concerning the zoning regulations for the Municipalidad’s Playa Guapil regulatory plan, submitted by the CGR, and item of evidence 9 in legajo-pruebas-CGR)—see fact 35 of the complaint—.

-Act of ordinary session N° 69 of 01 de abril del 2003, Article Five, through which the Municipalidad de Aguirre adopted resolution N° 2 authorizing the preparation of a partial regulatory plan—an expansion—for a parcel located in Playa Guapil, specifically in the areas between Lambert coordinates 358.200 N-475.100 E,358.350 N-475.150 E, 388.350 N-475.250 E NIE146 E,358.210 N-475.350 E358.270 N-475-370 E (see folios 71 and 73 of the INVU administrative file concerning the Playa Guapil coastal regulatory plan submitted by the CGR)—see fact 47 of the complaint—.

-Act of ordinary session N° 5310, Article 5, subsection XII, of 15 de junio del 2004, through which the ICT approved the expansion of the Partial Regulatory Plan for Playa Guapil, specifically in the areas between southern Lambert coordinates 358-356N 475.062 E NIE125 E, comprising the sector consecutively bounded by Instituto Geográfico Nacional boundary markers 37 through 32, the beachfront sector between boundary markers 131 and 128, and the sector between boundary markers consecutively delimiting the wetland from 294 through 300, in accordance with drawing 20 at a scale of 1:2000, prepared by Deppat and signed by the responsible professional, Arq. Alfredo Bermúdez, code A-4043 (see folio 108 of the INVU administrative file concerning the Playa Guapil coastal regulatory plan submitted by the CGR)—see fact 57 of the complaint—.

-Official letter DPD-ZMT-215-2004 of 25 de junio del 2004 (see certification and folios 1 and 14 of the certified administrative file concerning the expansion of the Partial Regulatory Plan for Playa Guapil of the Municipalidad de Aguirre, submitted by the CGR), through which the ICT notified the Concejo Municipal de Aguirre of the authorization of this expansion of the Partial Regulatory Plan for Playa Guápil—see fact 49 of the complaint—.

-Official letter PU-C-D-1026-2006 of 7 de noviembre del 2006, through which the INVU approved the expansion of the Partial Regulatory Plan for Playa Guapil, specifically in the areas between southern Lambert coordinates 358-356N 475.062 E NIE125 E, comprising the sector bounded by Instituto Geográfico Nacional boundary markers 37 through 32 (see folios 109 through 141 and 71 through 108 of the INVU administrative file concerning the Playa Guapil coastal regulatory plan submitted by the CGR)—see fact 59 of the complaint—.

CONCESSIONS IN FAVOR OF PLAYA MATAPALO S.A.

-Act through which the Municipalidad de Aguirre approved the concession applications submitted by Playa Matapalo S.A., issued at ordinary session N° 127 of 13 de enero del 2004, at which the then Mayor, Mr. Nombre65363 , was also authorized to execute the corresponding contracts, which he did on 3 de febrero of that same year for four contracts, and on the following 9 de septiembre for the fifth (see the Municipalidad de Aguirre administrative concession files N° 3436-02, N° 3437-02, N° 3438-02, N° 3439-02 and N° 3440-02 submitted by the CGR)—see fact 55 of the complaint—.

-Resolutions numbered G-319-2004, G-328-2004, G-372-2004, G-373-2004, of 26 y 27 de febrero, 4 de marzo, 4 de febrero, all from the year 2004, respectively, and official letter N° G-2078-2004 of 24 de noviembre de 2004, through which the ICT approved those concessions (see the first page of the following ICT administrative concession files submitted by the CGR: N° 110-09, N° 111-09, N° 112-09, Placa33002° and Placa33003° )—see fact 56 of the complaint—.

PUBLIC ROAD.

SECOND. That the sale executed by deed (escritura) N° 15 at 08:40 hours on siete de mayo de 1999 in the protocol of notary public Randall Rubén Sánchez Mora, submitted to the Registro Nacional by means of filing slip 0540126, be annulled. Under that sale, one lot was segregated from each of the two parent properties (fincas madres) located in Puntarenas, Aguirre, Savegre—property Placa27356°, recorded in volume 2188, pages 147 and 148, entries 1 and 2; and the real-property folio bearing registration number Placa27359—namely, the lot registered with the Catastro Nacional under plan Placa27357° and the lot registered with the Catastro Nacional under plan Placa33004°, and those lots were sold to the Municipalidad de Aguirre. In view of the foregoing, the undersigned agree to annul that conveyance (traspaso), the corresponding registry record, and the registrations of those cadastral plans, so that the effects are restored to the time of the sale.

THIRD. That the Municipalidad de Aguirre and the INVU annul every administrative act intended to declare, open, permit, or issue any type of declaration of a public road providing access to this coastal regulatory plan and its Playa Guapil expansion—which is annulled in the first clause. That is, any act providing access through the place where this road is currently located, as established in the CGR’s complaint. Accordingly, by reason of relatedness (conexidad), the following administrative actions by the public entities that participated in issuing or authorizing that road have been identified and are annulled:

-Act adopted at ordinary session N° 74 of 10 de mayo de 1999, at which the Concejo Municipal de Aguirre declared public the road providing access to Playa Guapil from the Costanera Sur, with an area measuring 570 meters in length by 12 meters in width (see page 87 of volume II of the ICT administrative file concerning the regulatory plan submitted by the CGR. See pages 14 and 16 of the INVU administrative file concerning the Playa Guapil regulatory plan –see resolution N° 8 adopted at ordinary session N° 180 of 21 de agosto del 2000 of the Concejo Municipal de Aguirre, in which it was agreed to inspect the public road-) –see fact 23 of the complaint-.

-Act of 25 de mayo del 2001, whereby the INVU approved that public access to Playa Guapil from the Costanera Sur (see pages 36, 43 and 42 of the INVU administrative file concerning the regulatory plan submitted by the CGR) –see fact 32 of the complaint -.

-Act adopted at ordinary session N° 22 held on 20 de agosto del 2002, at which the Concejo Municipal de Aguirre agreed to authorize Playa Matapalo S.A. to construct the road running behind the concession areas (zonas concesionadas) -from boundary marker 37 to 51- and a temporary warehouse for storing materials for the duration of the work (see page 20 of the Municipality’s administrative file concerning the expansion of the regulatory plan submitted by the CGR) –see fact 38 of the complaint-.

ENVIRONMENTAL DAMAGE TO THE WETLAND ECOSYSTEM. CAUSED BY THE CONSTRUCTION OF THE ROAD.

FOURTH. In order to begin repairing the damage caused to the wetland ecosystem (ecosistema de humedal) by construction of the road—which runs from the Costanera Sur to the restricted zone (zona restringida) of the maritime-terrestrial zone (zona marítima terrestre)—as described in the certifications and technical opinions referenced in recitals (considerandos) 4 and 5 of this settlement agreement (acuerdo conciliatorio), the Municipalidad de Aguirre undertakes, within 3 calendar months counted from the business day following notification of the Tribunal’s decision approving this settlement agreement, to carry out—with the personnel, logistics, and machinery currently available to it—all work sufficient and necessary to close the relevant section of the road at the indicated location, remove the culvert piping, remove the curb-like infrastructure, and open a breach at the indicated location on this road.

All of the foregoing shall be performed in the exact dimensions, manner, and locations recommended in the SINAC technical opinion issued through Informe Playa Guapil N° ACOPAC-UV-016-2011, dated 27 de octubre del 2011, appearing at judicial file page 1106. That is, the Municipalidad de Aguirre undertakes to implement all recommendations, observations, and suggestions set forth by SINAC throughout the aforementioned report. The work must be formally accepted as compliant by the competent SINAC officials, for which purpose the corresponding record shall be drawn up and signed jointly by the special litigation representative (apoderado judicial especial) of the Municipalidad de Aguirre for proceeding 09-2554-1027-CA and the SINAC officials responsible for inspecting the work. The Municipalidad de Aguirre shall prepare a report on the foregoing—to which the aforementioned record shall be attached—demonstrating compliance with the agreement under the terms described.

This report shall be filed with the Tribunal Contencioso Administrativo y Civil de Hacienda, with an original delivered for inclusion in expediente N° 09-2554-1027-CA, and with the División Jurídica de la CGR. The report shall be filed within 3 business days following formal acceptance of the work as compliant. The signing of this agreement neither establishes nor implies that the Municipalidad de Aguirre is solely responsible for the environmental damage described in the CGR’s complaint.

FIFTH. The ICT undertakes to file a written notice withdrawing the appeal it lodged in the proceeding conducted under expediente N° 07-001665-0163-CA against judgment N° 2868-2011 at 8:00 hours on 22 de setiembre del 2011, issued by the Juzgado Contencioso Administrativo y Civil de Hacienda, which granted in full the action for annulment of an injurious administrative act (demanda de lesividad) filed by the Municipalidad de Aguirre to annul the administrative act of the Concejo Municipal which, at ordinary session N° 310 of 25 de marzo de 2002, approved the Partial Coastal Regulatory Plan for Playa Guápil and its regulations; the administrative acts approving all concessions in favor of Playa Matapalo S.A., legal-entity identification number No. CED31690, pursuant to the resolution of the Concejo Municipal adopted at Ordinary Session N° 127, article V) of 13 de enero del 2004; and the ICT administrative acts approving the concessions granted to Playa Matapalo S.A. through resolutions N° G-319-2004, G-328-2004, G-372-2004, G-373-2004, dated 26 y 27 de febrero, 4 de marzo, 4 de febrero, respectively, all in the year 2004, and official letter N° G-2078-2004 of 24 de noviembre de 2004, corresponding respectively to ICT administrative files No. 3436-02, 3437-02, 3438-02, 3439-02 and CED126545. The ICT undertakes to withdraw its appeal on the business day following notification of the approval decision issued as a consequence of this settlement agreement.

SIXTH. Based on the provisions of the preceding clauses and subject to effective fulfillment of the undertakings proposed by the Municipalidad de Aguirre, the ICT, and the INVU, the Contraloría General de la República agrees to settle and, consequently, withdraws its claim for damages against the Municipalidad de Aguirre, the ICT, and the INVU in the present proceeding N° 09-2554-1027-CA, on the understanding that each party shall bear its own costs, thereby terminating this proceeding with respect to the aforementioned parties.

SEVENTH. Until enforcement of the judgment in this proceeding has been finally concluded, the parties agree to maintain the judicial and administrative interim measures (medidas cautelares) adopted in relation to the subject matter and cause of this proceeding." Signing on behalf of the Contraloría General de la República are its attorney and Legal Representative, Licenciado Esteban Villalobos Fernández; on behalf of the Municipalidad de Aguirre, Mayor María Isabel León Mora and its attorney, Licenciado Josue Salas Montenegro; on behalf of the Instituto Nacional de Vivienda y Urbanismo, its attorney and General Legal Representative, Licenciada María Cecilia Robles Martínez; on behalf of the Instituto Costarricense de Turismo, its attorney and Legal Representative, Licenciado Jimy Álvarez García; and Alexander Castillo Aguilar, as Settlement Judge for Administrative Litigation." TENTH.- AUTHORIZATIONS UNDER ARTICLE 73.3 CPCA.

In the specific case of this agreement, the respective authorizations to settle issued by the corresponding highest-ranking superiors were incorporated into and made available in the judicial file: that of La Contraloría General de la República at page 1262; that of La Municipalidad de Aguirre from pages 1264 through 1270; that of El Instituto Costarricense de Turismo at pages 1272 through 1283; and the authorization of El Instituto Nacional de Vivienda y Urbanismo appears at pages 1285 through 1294 of the Judicial File.

ELEVENTH.- PUBLIC HEARING UNDER ARTICLE 17 OF THE URBAN PLANNING LAW. In response to a filing submitted by the Mayor, the Concejo Municipal de Aguirre agreed to convene the Public Hearing procedure prescribed for Regulatory Plans. That resolution is accompanied by the corresponding publication in La Gaceta and photographs of notices; this documentation was located in Volume I of the File and is therefore transferred to Volume II, as appropriate, where it appears at pages 1315 through 1319, front and back, of the Judicial File.

TWELFTH.- FORMALITIES OF THE SETTLEMENT PROCEEDING. This request for judicial approval (homologación) is resolved upon a finding that, during the settlement proceeding, all formalities, safeguards, requirements, and principles established both by Laws N° 7727 and N° 8508 and by the other applicable provisions of the national and international legal system currently in force have been satisfied, with no omissions, nullities, or errors capable of invalidating the proceedings being apparent.

RECITALS FIRST.- PROVEN FACTS (HECHOS PROBADOS). The following are relevant to resolving this application for judicial approval (solicitud de homologación): FIRST FACT.- SETTLEMENT AGREEMENT (ACUERDO CONCILIATORIO). On dieciocho de julio del dos mil doce, a settlement agreement (acuerdo conciliatorio) was entered into between the plaintiff, Contraloría General de la República, and three of the nine parties involved, specifically Municipalidad de Aguirre, Instituto Nacional de Vivienda y Urbanismo, and Instituto Costarricense de Turismo; the agreement is partial with respect to the parties involved in the dispute and comprehensive as to their intent to terminate the proceedings. (See the agreement signed at pages 1303 through 1314 of the case file). SECOND FACT.- C.G.R. AUTHORIZATION. On cuatro de junio del dos mil doce, the Comptroller General of the Republic, Nombre3879, in her capacity as the highest-ranking authority and pursuant to Article 73.3 CPCA, signed the authorization to settle (autorización para conciliar).

(See the authorization signed at page 1262 of the judicial case file). THIRD FACT.- AUTHORIZATION BY MUNICIPALIDAD DE AGUIRRE. Through Session N° 183-2012 of veintisiete de marzo del dos mil doce, Seventh Article, Resolution N°9, the Concejo Municipal authorized the settlement and delegated its execution to Mayor María Isabel León Mora. (See the certification issued by the Secretariat of that Concejo Municipal at pages 1264 through 1270 of the Judicial Case File). FOURTH FACT.- I.N.V.U. AUTHORIZATION. Through Session N° cinco mil novecientos treinta y nueve, dated tres de mayo del dos mil doce, Article II, subsection ocho punto a), the Board of Directors of Instituto Nacional de Vivienda y Urbanismo, acting as the Institute’s highest-ranking authority, authorized the settlement. (See the certification issued by the Secretariat of the Board of Directors at page 1284). FIFTH FACT.- I.C.T. AUTHORIZATION.

Through Resolution N° SJD-245-2012, adopted at Ordinary Session 5749, Article 5, Subsection X, of veintinueve de mayo del dos mil doce, the Board of Directors of Instituto Costarricense de Turismo, acting as the Institute’s highest-ranking authority, authorized the settlement. (See the certification issued by the Secretariat of the Board of Directors concerning the authorization at pages 1272 through 1283 of the Case File). SIXTH FACT.- CONSULTATION UNDER LEY DE PLANIFICACIÓN URBANA. Through publication in La Gaceta N°147 of treinta y uno de julio del dos mil doce, Municipalidad de Aguirre complied with the public hearing procedure (procedimiento de audiencia pública) established in Article 17 of Ley de Planificación Urbana. (See the publication, photographs, background documents, and copy of the signed original minutes at pages 1315 through 1319, recto and verso, of the Judicial Case File).

SEVENTH FACT.- NO OBJECTIONS WERE FILED. Following publication in La Gaceta and the holding of the public hearing, no objections were filed under the Article 17 procedure of Ley de Planificación Urbana, as evidenced by the minutes. (See pages 1315 verso and 1319 verso of the Judicial Case File).

SECOND.- UNPROVEN FACTS (HECHOS NO PROBADOS): The following is relevant to resolving this Application for Judicial Approval: SOLE FACT.- There is no indication of any omission or absence of legal opinions, studies, or technical opinions, nor of any deficiency in legal reasoning, procedures, grounds (motivo), or content, or of any impairment of the settling parties’ right to due process (debido proceso); nor were any objections raised at the public hearing. (See the records and case files of the proceedings).

THIRD.- INFORMATION ON THE DUTIES, RIGHTS, AND PRINCIPLES UNDERLYING ALL JUDICIAL CONCILIATION. From the time of the first notice to attend conciliation, and with its application reiterated for all potential separate and joint hearings, all participating parties have been informed of the purpose and nature of conciliation and of the rights and duties vested in them, based on the principles governing the Institution of Conciliation (Instituto de la Conciliación) and its application in judicial venues (Sedes Jurisdiccionales), in accordance with the principles governing conciliation contained in the Alternative Dispute Resolution and Promotion of Social Peace Act (Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social), including, specifically: a) Principle of Freedom: this begins with recognition of the right of parties to a dispute to adopt conciliation as an alternative means of resolving their disputes, as a discretionary power.

It applies and extends both to the statutory and constitutional right to be summoned to conciliation in order to participate freely in a process of seeking solutions to the dispute, and to the jurisdictional obligation to respect that right and issue the summons in a timely manner, so as not to unlawfully remove the dispute from conciliation or impair due process. This necessarily means that, if the requirements applicable to each subject matter are met, subject to statutory exceptions, a summons to conciliation must be issued. This principle also supports the right to waive conciliation. Because this is a statutory, constitutional right integral to due process, it may be deemed waived only in those cases in which the formalities comply with those expressly prescribed by the legal system: either expressly, orally or in writing, or tacitly through failure to attend after being summoned. If the law does not provide for waiver based on a failure expressly to state an interest in conciliating, it would never be valid to infer a deemed waiver.

Thus, for example, in criminal matters, the Legislature granted and regulated this right for accused persons and victims in Articles 36 and 317 of the Code of Criminal Procedure (Código Procesal Penal), by establishing that conciliation may proceed at any time before the commencement of trial is ordered. As a safeguard of due process and access to self-restorative justice (justicia autorestaurativa), this entails a genuine opportunity to propose an agreement and submit it for judicial approval (homologación) at any time before the commencement of trial is ordered. The parties may not validly be deprived of this right on the basis of either a prior failure to express willingness to conciliate or a prior refusal, if their wishes subsequently changed, subject only to the exceptions already provided by law. Likewise, in Articles 70.2, 72, and following of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo), the Legislature guarantees claimants and respondents access to self-restorative justice through the right to conciliation.

In this Jurisdiction, the Legislature made it mandatory to summon the parties to conciliation before the preliminary hearing in every case in which none of the parties has expressly waived it. Consequently, the only circumstance established by law as constituting tacit waiver is a party’s unjustified failure to attend after having previously been summoned. b) Principle of Confidentiality: this applies to the content of preparatory activities, conversations, and arrangements preceding a potential agreement, as well as to actions undertaken during the conciliation process, including information received in separate meetings with the parties. It requires that all such information be kept reserved and private, and both the Judge and the parties have a duty to maintain absolute secrecy concerning everything stated and occurring therein, all of which is strictly confidential. For participating attorneys, this entails application of the duty of professional secrecy with respect to confidences disclosed by the client to the professional.

This guarantee allows persons who submit their differences to an impartial third party to discuss the dispute with sufficient breadth, extending to matters that might lack procedural relevance, such as emotional harm or family conflicts. The parties must therefore be certain that nothing they say there may ever be used against them. For this reason, the ideal of self-restorative justice undoubtedly requires the mediator or conciliator to be someone other than the judge handling the case, as occurs with the Conciliation Units (Unidades de Conciliación) of the various judicial circuits. This separation approach was also adopted in the Contentious-Administrative Procedure Code when the Legislature created the position of Contentious-Administrative Conciliation Judge (Juez Conciliador de lo Contencioso Administrativo), who, with all the independence and constitutional guarantees attaching to that office, must ensure the continued application of confidentiality. c) Principle of Information: this applies at different stages of the conciliation proceeding.

Initially, the Conciliation Judge has a duty to explain clearly the rights, principles, and duties applicable to all participants in the conciliation, the negotiation model and details of the work to be performed during the process, the judge’s role with respect both to conciliation and to any subsequent judicial approval, the role and commitments of the participating parties, and the various stages comprising conciliation. Subsequently, and without prejudice to the ability to adjust the course of the negotiations at any time to safeguard this principle of information, the principle also underlies the so-called “principle of informed decision-making,” which requires the parties to be aware of each and every consequence and implication of agreements resulting from conciliation, the provisions of the legal system affecting what has been agreed, the nature of the judgment granting judicial approval (sentencia de homologación), its effects, potential challenges, and eventual enforcement.

Thus, by imposing on the Judge an obligation to inform the parties (Art 11 Ley Rac), the Legislature requires that, in order to conduct proceedings with due process, this guarantee of information for all participants be implemented at the outset of every conciliation. d) Right to Education: the foregoing obligation of the Judge to provide accurate and ethical information, in turn, gives effect to the right to be educated and trained in alternative dispute resolution and the promotion of social peace (Art 1° de Ley Rac). All users of judicial conciliation will therefore receive at least the implicit benefit of being able to learn about and better understand the operation of the Institution of Conciliation, explained from the perspective of each jurisdiction and its particular features. e) Principle of Nonviolence.- This applies in two basic respects: first, as a timely means of avoiding and preventing future situations of violence by seeking to prevent further escalation of the dispute; and second, the absence of violence is a condition for amenability to conciliation (conciabilidad).

Accordingly, all treatment of and interactions among the parties must at all times be peaceful, without insults, abuse, or shouting; otherwise, conciliation cannot occur and must be declared unsuccessful. Thus, for example, if legal counsel were to insult opposing counsel during the conciliation hearing, this could not be made the subject of disciplinary proceedings before the Professional Association (Colegio Profesional), nor of a criminal complaint (Querella) for insult or defamation before the Criminal Court (Tribunal Penal), because confidentiality covers everything occurring at the hearing. It would, however, constitute sufficient grounds for determining and declaring the hearing unsuccessful. f) Principle of Equality, with Constitutional Foundation: this principle also informs the right to Nonviolence, as equally respectful treatment of the rights of all parties is intrinsic to it.

This guarantee of equal and impartial treatment encompasses both nondiscrimination on grounds of religion, education, or political affiliation and the prohibition of preferential treatment due to the involvement of a public or institutional authority, significant economic or political power, de facto groups, or other active sectors of society. g) Principle of Impartiality: also understood to be related to the two preceding principles, it consists of the guarantee afforded to the parties to a dispute that they will be accompanied throughout the process by an Independent Judge who will provide and ensure impartial treatment and will not favor any party. h) Conflict of Interest: as stated in the preceding point, this guarantee of impartiality, which allows the dispute to be submitted broadly and comprehensively, has enabled the recognition and establishment of appropriate mechanisms to prevent participation in cases in which it is considered that a conflict of interest could arise.

This could occur even with full observance of the foregoing principles—for example, if there were a relationship by affinity or if the parties were the Judge’s neighbors living across the street. i) The Principles of Participation and Self-Resolution (Autocomposición) underpin the essential leading role that the parties must assume during conciliation. They are expected to take an active role in generating ideas and developing potential solutions, while the decision to adopt the agreed terms is theirs alone. The Judge’s role is to facilitate and provide guidance concerning the potential limitations and requirements imposed by the legal system. j) Principle of Voluntariness: all participation in conciliation and execution of any resulting agreement is voluntary, not only because of the foregoing principles and the active role the parties are expected to assume, but also because they may express their wishes both during negotiations and in the agreement.

It is very important that the Judge succeed in explaining the limits imposed by the legal system, defining the scope within which conciliation may proceed, requiring conduct governed by good faith, and ensuring that rules of public policy, morality, and accepted standards of conduct are not contravened. k) Orality: this is indispensable and essential to the conciliation process. Although provisions expressly incorporating it are not commonly found, its application is implicit in the personal, direct interaction (inmediación personal) of the parties or their representatives, who are summoned to meet jointly or separately. In addition, the Consejo Superior del Poder Judicial has officially adopted the promotion of the Staged Negotiation Model (Modelo de Negociación por Etapas), in which oral communication is the appropriate means through which the parties may express themselves freely and confidentially, while seeking to create the conditions necessary for a joint search for solutions.

In the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa Administrativa), the innovative procedural transformation incorporates a series of guarantees reaffirming the role of persons in proceedings, broadening both standing to bring proceedings (legitimación activa) and other forms of participation. Article 85 of the Contentious-Administrative Procedure Code even specifically establishes the Court’s duty to ensure full observance of the principles of orality during hearings, it being understood in this instance that the Conciliation Judge acts under the jurisdiction of the Tribunal Contencioso Administrativo, in this case sitting as a single-member body or court.

  • l)Principle of Contextuality (Principio de Contextualidad): in general terms, this means that everything that occurs must relate to and take into account the context of the parties to the conflict—their own circumstances, rather than those of the mediator or other parties involved. Thus, during the agreement-building process, the parties consider their needs, perceptions, and emotions. Compliance with this principle ensures the viability of the agreement, consistency between the solutions and the parties’ circumstances, greater commitment to and satisfaction with the agreement, and the agreement’s continued effectiveness over time. For example, we can directly observe a circumstance common to the various entities and bodies subject to the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa): all the specific requirements that must be met in order to reach a settlement (conciliar) when carrying out an activity that is public or in the public interest, including technical and legal criteria, among others, sufficient in each case to support any eventual authorization by the Highest Superior Authority (Superior Jerarca Supremo).

In turn, the administrative conduct embodied therein must be subject to analysis regarding its legality and general compliance with the legal system, while also demonstrating that the public interest is not adversely affected. Consequently, the circumstances of the conflict for all private individuals or legal entities, whether plaintiffs or defendants, are also shaped by the underlying relationship. Thus, the circumstances would differ when users allege deficient service, when a company demands payment of outstanding invoices, or when an employee challenges a disciplinary measure; nevertheless, all such claims could be brought against the same institution, but would arise from different administrative relationships.

FOURTH.- THE ROLE OF THE CONCILIATOR AND INDEPENDENCE AS AN ADMINISTRATIVE-LITIGATION JUDGE. REVIEW OF CONVENTIONALITY AND THE LEGAL SYSTEM. As the first safeguard afforded to the parties involved in judicial proceedings, there is the so-called Human Right to an Independent Judge, grounded in the principle of judicial autonomy and independence. In the case of the Constitution of Costa Rica, “…Article 154 emphasizes the matter by underscoring that the Judiciary, its judges, and its officials are subject only to the Constitution and the law. This fundamental provision constitutes a dual guarantee for the administration of justice: on the one hand, it enshrines its independence from any de facto or legal power, subjecting it solely to the Constitution and the law, in that order...” (Commission of Justices, Full Court Session 16-99, cited by Dr. Gilberth Armijo in “The Independence of the Constitutional Judge, His Removal, and the Inter-American Court of Human Rights”).

This principle has also been addressed by the Constitutional Chamber of the Supreme Court of Justice, which stated: “Within democratic political systems, the principle of the independence of judges in particular, and of the Judiciary in general, is of fundamental importance because the legitimacy of judges and the impartiality of judicial decisions rest upon it.” (Constitutional Court Decision N° 9495-2008, also N° 6632-01 and N° 7227-05). These rights are also recognized in numerous instruments of international law in force in Costa Rica, specifically the Pacto de San José, Articles 1°, 8 and 24, as well as the Universal Declaration of Human Rights, the Charter of the United Nations, the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights. The United Nations Basic Principles on the Independence of the Judiciary provide, as an objective guarantee for the public at large, compliance with a series of essential elements, such as integrity, competence, training, and appropriate legal qualifications; at the same time, they constitute a subjective guarantee for judges that they will have a proper appointment process, security of tenure, and protection against external pressure.

This was further developed by the Inter-American Court of Human Rights in the cases of Constitutional Court v. Republic of Peru and First Court of Administrative Litigation v. Bolivarian Republic of Venezuela. Finally, the statement made in Nombre25533 v. Costa Rica is highly significant: “...judges, unlike other public officials, enjoy enhanced guarantees because of the necessary independence of the Judiciary, which the Court has understood to be ‘essential to the exercise of the judicial function.’” Accordingly, from the moment the role of Conciliator is entrusted to a Judge of the Republic, there must be certainty that this role is undertaken not only with all the integrity and training that an authorized conciliator must possess in order to perform it, but also with judicial independence and impartiality from any public authority, de facto group, or private individual as a special guarantee both for the public at large and for the parties, during the negotiation stage, in the agreement and any eventual judgment granting judicial approval (homologación), and even in the event that conciliation fails.

As a second guarantee for both the public at large and the parties, there is review of the legal system and the public interest, which is imposed not only upon the Administrative-Litigation Judiciary but upon all judges in the country. This includes both the country’s domestic legislation and a review of conventionality (control de convencionalidad) concerning rights recognized in international treaties and ratified in our country through legislation. On this matter, the UNAM legal researcher and current member of the Inter-American Court of Human Rights, Judge Eduardo Ferrer Mac-Gregor, has stated that review of conventionality “consists of the compatibility assessment that must always be conducted between domestic acts and provisions, on the one hand, and the American Convention on Human Rights (ACHR), its Additional Protocols, and the case law of the Inter-American Court of Human Rights (IACtHR), on the other.

The latter is the sole judicial body of the Inter-American Human Rights Protection System that interprets the Pacto de San José in an ‘ultimate’ and ‘definitive’ manner. It is a ‘minimum’ standard created by that international Court so that the inter-American corpus juris and its case law are applied in every case... as well as the reports, recommendations, general comments, and other decisions of international bodies and courts.” (Works cited in Treatise on Constitutional Procedural Law, by Professor Dr. Nombre160962 , 2011; see also case law at http://www.corteidh.or.cr and legal scholarship at http://www.juridicas.unam.mx) FIFTH.- NATURE OF THE LEGAL INSTITUTION OF CONCILIATION AND JUDICIAL APPROVAL IN THE ADMINISTRATIVE-LITIGATION JURISDICTION. As a legal institution (instituto), it refers to the body of legal rules and principles governing the conduct of the proceedings, the agreement, and any eventual judicial approval, as well as their possible failure.

It includes constitutional principles, principles recognized in treaties, general laws, and special regulations—in general, all provisions that must be integrated into the specific application applicable to each type of dispute. It is an alternative dispute-resolution mechanism (mecanismo de resolución alterna) that is non-adversarial and based on self-determination (autocompositivo) and, like any legal transaction (negocio jurídico), entails a meeting of wills, in this case an agreement between two or more persons who are parties to the legal-procedural relationship (relación jurídico procesal) underlying the judicial action. Although partial agreements may also be reached, both with respect to the matters agreed upon and the participants, its primary purpose is to bring the litigation fully and completely to an end through an agreement by which legal relationships are created, recognized, modified, or extinguished, with judicial approval of the settlement agreement (acuerdo conciliatorio) being vested with the force of res judicata (cosa juzgada).

This replaces the adjudicative and adversarial mechanism that would result in a judgment on the merits (sentencia de fondo), which the court of natural jurisdiction would ordinarily issue by applying the law to the specific case. Instead, the parties submit to the conciliating judge for judicial approval the agreement reached within the proceedings through judicial conciliation (conciliación judicial). Judicial approval, in turn, is granted through a judicial decision that is substantively devoted to analyzing and verifying, in a reasoned and duly substantiated manner, that the terms of the agreement are not contrary to the legal system and do not harm the public interest. Because it confers the force of substantive res judicata (cosa juzgada material) and brings the proceedings to an end, judicial approval is in the nature of an interlocutory order having the force of a judgment (Auto con carácter de Sentencia).

(See Articles 57, 76, 77, 134 and 153 of the CPCA.) The statement of reasons (motivación) must clearly set out the reasoning that led to the decision adopted in the operative portion of the judgment, explaining the grounds for the ruling. Furthermore, it must not be incomplete, unclear, or contradictory in its development and must clearly set forth the considerations that led to the determination made or, in this case, to judicial approval of the settlement agreement. It must explain why the agreement is not contrary to the legal system and why it does not adversely affect the public interest. (See, among others, First Chamber decisions 126-2009 and 318-2011.) As a legal transaction, conciliation requires, for its validity and effectiveness, not only that the parties possess sufficient legal capacity but also that it have a definite or possible subject matter and a lawful cause; it must also establish the manner, time, and place for performance of the obligations undertaken (Articles 36, 627, 628, 629, 630 and 631 of the Civil Code).

Express Authorization (Autorización Expresa) was established as a requirement for the participation of the Public Administration. For the Central Government, it must be issued by the Attorney General or her Deputies; in all other cases, it must be granted by the Supreme Hierarchical Authority or by the body to which that authority has been delegated, as provided in Article 73, subsections 2 and 3, of the Code of Administrative Litigation Procedure. Review of legality, the legal system, and the absence of harm to the public interest is subject to heightened scrutiny because it arises from and is contained both in the General Law of Public Administration, Article 14.3, and in the Alternative Dispute Resolution Law, Articles 3, 5 and 13.b, and especially in Article 76 of the Code of Administrative Litigation Procedure. Accordingly, in the case of the Public Administration, for example, its negotiations are also subject to this review.

As administrative conduct, the commitments undertaken must also conform to science and technical standards and must not contravene fundamental principles of justice, logic, and expediency. Compliance with the constitutional principles of reasonableness and proportionality, and with any other principle applicable to the case, must be ensured. It is essential that the grounds, content, and purpose of the administrative conduct be clearly stated, because that conduct will be subject to judicial review (control jurisdiccional). In the case of private individuals or legal entities, the identity of the person—whether the right holder or the holder’s representative—must be established, as must the scope of any mandates and powers granted, the ability to dispose of the rights at issue, and the absence of any adverse effect on non-waivable rights or third-party rights. Everything set forth above, together with any matters arising specifically from the particular case, must be analyzed in the considerations supporting judicial approval, without overlooking the substantive requirement to explain why the conciliation is or is not contrary to the legal system and why it would or would not harm the public interest.

SIXTH.- PROTECTION OF THE ENVIRONMENT AND OF THE HIGHLY SPECIALIZED ECOSYSTEMS KNOWN AS WETLANDS. As part of the protection of the environment, a series of international instruments aimed at protecting these important ecosystems have been incorporated into the Costa Rican legal system (Ordenamiento Jurídico): “wetlands (humedales) constitute one of the habitat types subject to the greatest pressure, due to drainage for urban development or conversion into cropland or grazing land” (Richard Primack et al., Fundamentals of Conservation Biology, first edition 2001). In the case of Costa Rica, within the field of environmental legal research, consultant and Professor Mario Peña Chacón has conceptualized them as follows: “Wetlands are extremely fragile ecological units that carry out a large number of natural processes of importance to humanity and to the ecological system itself; they constitute important feeding, shelter, and breeding sites for a wide variety of wildlife species, making their protection and conservation particularly significant.

They are complex and fragile ecosystems composed of a series of physical, chemical, and biological components corresponding to soils, waters, animal and plant species, and nutrients, which, together with the fluctuating or intermittent presence of water flows, determine the biodiversity of the environment. The benefits provided by wetlands include: the supply of water both for direct use and for aquifer recharge through infiltration; regulation of flows of vital importance for flood control; prevention and protection against the intrusion of salt water affecting groundwater and surface freshwater; protection against natural forces such as storms, hurricanes, etc.; retention of sediments, nutrients, and toxins; a source of natural products such as timber, wildlife products, and aquatic products such as mollusks, crustaceans, and fish; energy production; transportation; conservation, recreation, and tourism; research and education; biodiversity and cultural heritage; landscape and scenic beauty; and maintenance of essential ecological processes” (Legal Protection of Wetland Ecosystems, Revista Jurídica N°99, Marzo del 2011).

The international legal protection of wetlands may be found directly in the Convention on Wetlands of International Importance Especially as Waterfowl Habitat, better known as the Ramsar Convention, which entered into force on 21 de diciembre de 1975 and which Costa Rica would ratify through Ley N° 7224 del 09 de abril de 1991; additionally, their protection is derived indirectly from the Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere, signed in the city of Washington on 12 de octubre de 1940; and also from the Convention on International Trade in Endangered Species of Wild Fauna and Flora, known as the CITES Convention. Thus, we can even see how the International Court of Justice, in the case brought by Costa Rica against Nicaragua concerning the dredging of the Río San Juan and the possible impact on wetlands, on 8 de marzo del 2011, included among its provisional measures (medidas cautelares) the possibility for Nombre21605 to enter the area, which, according to public international law expert Professor Nicolas Boeglin, reflected the concern that irreversible damage not be allowed to occur in the Isla Calero area, while making any action or initiative by Nombre21605 subject to coordination between Nombre21605 and the Secretariat of the Ramsar Convention (derechointernacionalcr.blogspot.com).

Our High Constitutional Court has also addressed the importance of and obligation to protect wetlands, stating, in a decision drafted by Justice Nombre368, judgment number 6246-2007: “Biological diversity and the degree of ecological complexity are not distributed uniformly throughout the planet, since they tend to be concentrated at key sites that possess enormous importance and are therefore highly significant from socioeconomic, cultural, educational, and aesthetic perspectives. Few key sites possess as much value as wetlands, which are considered among the most productive ecosystems in the world...” “It is the responsibility of every inhabitant of this planet to develop a global environmental awareness, taking personal measures that promote the restoration of harmony among living beings in order to achieve a better quality of life for all, considering not only the present but also the future.

Consequently, it is also the duty of this Court to ensure the protection of wetlands in accordance with the right to a healthy and ecologically balanced environment enshrined in Article 50 of the Constitución Política, and even with the right to quality of life itself...” As regards potential judicial protection (tutela jurisdiccional), wetlands are protected not only by the laws ratifying international instruments, since national legislation also covers them as bodies of water (cuerpos de aguas) under the definitions in Article 1°, subsections I and II, of Ley de Aguas N° 276 de 1942. Subsequently, beginning in 1992, the legislature adopted in Article 2° of the Ley de Conservación Silvestre the definition already contained in the Ramsar Convention. Additionally, as is true of every ecosystem and by reason of its importance to life on the planet, their protection may also be derived indirectly from other provisions, such as La Ley de Biodiversidad and Ley Orgánica del Ambiente, or even through the safeguarding of the fundamental principles of science, technology, justice, logic, or expediency contained in the Ley General de la Administración Pública, as held in Judgment 1476-2010 of the Tribunal Contencioso Administrativo, which granted a provisional measure against exploitation of the Mina Crucitas.

That provisional judgment was subsequently affirmed by the Tribunal de Apelaciones, the proceedings on the merits were decided in favor of the claim, and the judgment was subsequently affirmed by the Sala Primera; it is now final, and domestic remedies under Costa Rican law have been exhausted. Within the contentious-administrative jurisdiction (Jurisdicción Contencioso Administrativa), the issue of wetlands and impacts upon them has also been addressed from the perspective of conduct both by the Administration and by private parties in cases affecting wetland areas. Thus, for example, the Sala Primera de la Corte Suprema de Justicia, in Voto 119-F-2005, ruling on two appeals in cassation on the merits (recursos de casación por el fondo) against Judgment N°55-2002 of the Tribunal Contencioso Administrativo, drafted by Judge José Paulino Hernández Gutiérrez of Sección I, stated: “As the Ad quem correctly noted, human intervention alone will affect the existing ecosystems in the wetlands, which consist of the mangroves where the project is intended to be developed.

It will take advantage of their natural conditions, which, according to recital (considerando) number 4 of Decreto Ejecutivo número 22550-MIRENEM de 14 de setiembre de 1993, published in La Gaceta número 193 del 8 de octubre de 1993, whereby the mangrove areas adjacent to the country’s mainland and island coastlines, regardless of their extent, were declared wetlands, ‘... consist of a small number of plant species, thereby constituting a highly fragile system in which ecological alterations have consequences extending beyond the nearby and immediate regions.’ Pursuant to sections 5, 6, and 7 thereof, the interest in their protection lies in the following: ‘5o - Due to their high productivity, estuarine wetlands contain concentrations of post-larval stages of a large number of commercial species on which coastal artisanal and semi-industrial fishing is based, activities that provide the economic livelihood of many Costa Rican families. 6o- The trophic structure of estuarine wetlands not only ensures the survival of species native to estuarine waters but also has indirect implications for the trophic structure of commercial species in more distant waters. 7o- Estuarine wetlands physically constitute the habitat of wildlife and plant species, some of which are endangered or have reduced populations’...

(and) ‘Consequently, the grounds (objective element of the administrative act) on which the decision is based are unlawful,’ (Sala Primera, drafted by Justice Román Solís Zelaya) SEVENTH.- CITIZEN PARTICIPATION IN ENVIRONMENTAL MATTERS AND URBAN PLANNING. Principle 10 of the Rio Declaration states: “Environmental issues are best handled with the participation of all concerned citizens. At the national level, each individual shall have appropriate access to information held by public authorities concerning the environment, including information on hazardous materials and activities in their communities, as well as the opportunity to participate in decision-making processes. States shall facilitate and encourage public awareness and participation by making information widely available. Effective access shall be provided to administrative and judicial proceedings, including review and redress.

Participation by society in the conservation of the national environment, as well as appropriate access to information held by public authorities, emphasizing its participation in decision-making processes.” Thus, given that proper environmental assessment (valoración ambiental) entails a cross-cutting projection concerning both administrative conduct and the conduct of private parties, requiring due consideration of environmental conditions and potential environmental impacts, it is unsurprising that, in accordance with the commitments undertaken by Costa Rica to promote citizen participation, a guarantee for the general public was incorporated into the Ley de Planificación Urbana, requiring compliance with the public hearing (audiencia pública) provided for in its Article 17. This hearing has its immediate legal basis in the law, but has likewise recently been incorporated across international treaties addressing various matters, such as Indigenous Peoples, Minors, Environmental Protection, Gender-Based Violence, Consumer Rights, and others.

Moreover, each country has sought domestic mechanisms to promote citizen participation, as established and guaranteed through the application of the respective procedures and proceedings involving public hearings recognized by our legal system, including judicial proceedings, as provided by the Legislature in Articles 13 and 14 of the Ley de Notificaciones, where group, diffuse, or collective rights and interests are involved. The Sala Constitucional has repeatedly ruled on the constitutionality of regulatory plans (planes reguladores) and their relationship with the environment. In Judgment 17388-2007, authored by Justice Gilberth Armijo Salas, it stated: “Furthermore, failures to fulfill the duty to protect the environment and to comply with environmental regulations are constitutionally relevant because, as a consequence of the Administration’s inaction in this area, harm may be caused to the environment and natural resources, sometimes with consequences similar to or greater than those arising from actions by the Administration.

Examples include the authorization of regulatory plans or construction projects without approval of the environmental impact study (estudio de impacto ambiental) by Secretaría Técnica Nacional Ambiental; the failure of Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía to control and oversee the implementation of management plans (planes de manejo) for protected areas; allowing companies to operate without health permits regarding the treatment of sewage or wastewater (Acueductos y Alcantarillados and Ministerio de Salud); or failing to verify noise-level controls in bars, karaoke venues, and discotheques (municipalities and Ministerio de Salud), etc.” Subsequently, in Judgment 19747-2010, authored by Justice Rosa María Abdelnour Granados, it stated: “According to legal scholarship, the environmental impact study was associated from its inception with the Anglo-Saxon tradition of public inquiries and hearings.

Accordingly, it must be emphasized that, throughout the assessment and at its various stages, those affected by the final decision must be heard; these may include not only the communities or persons directly involved, but also groups defending diffuse interests, such as the timely protection of the environment.” (To similar effect, judgments 8667-2010 and 7962-2011 of that same chamber.) This had also been recognized by Procuraduría General de la República in opinion C-094-2005, in which Procurador Julio Jurado Fernández concluded that “the public hearing provided for in Article 17 of the Ley de Planificación Urbana is intended to promote and foster citizen participation in decision-making and is a mandatory legal requirement for municipalities seeking to implement a local regulatory plan in their canton.” EIGHTH.- ANALYSIS OF THE PARTICULAR REQUIREMENTS, ELEMENTS, CONDITIONS, AND CHARACTERISTICS OF THIS SETTLEMENT.

Standing of the Signatories (legitimación de los suscribientes). With respect to the settlement agreement (acuerdo conciliatorio) addressed in this approval judgment (sentencia de homologación), the agreement was signed on behalf of the Contraloría General de la República by its attorney and legal representative (Apoderado), Licenciado Esteban Villalobos Fernández; on behalf of the Municipalidad de Aguirre, by Mayor María Isabel León Mora and its attorney, Licenciado Josue Salas Montenegro; on behalf of the Instituto Nacional de Vivienda y Urbanismo, by its attorney and general legal representative (Apoderada General), Licenciada María Cecilia Robles Martínez; on behalf of the Instituto Costarricense de Turismo, by its attorney and legal representative, Licenciado Jimy Álvarez García; and also by Alexander Castillo Aguilar, as Settlement Judge for Administrative Litigation (Juez Conciliador de lo Contencioso Administrativo).

Accordingly, pursuant to the terms contained in the respective appearances, certifications of legal capacity (personerías), and powers of attorney entered in the court record, the matters stated in the fifth recital (resultando quinto), the authorizations documented in the first whereas clause (considerando primero), and the actions undertaken during the settlement proceedings (conciliación), it is deemed that all parties and their interests were validly and properly represented throughout those proceedings. (See, respectively, folios 120, 1263, 207, 138 of the Court Record) Express authorization (autorización expresa): in addition to the required valid representation, when the legislature recognized the right to settlement, it established, as an additional oversight requirement in subsections 2 and 3 of Article 73 of the Código Procesal Contencioso Administrativo (CPCA), the need to obtain express authorization from the respective supreme hierarchical authority (Jerárquico Superior Supremo); that is, the same requirement that had already applied to acquiescence (allanamiento) or withdrawal (desistimiento) before the administrative-litigation reform.

As established in the first whereas clause of this ruling, all participating parties do have their respective authorizations. Subject Matter of the Settlement (objeto de la conciliación): In this specific case, the settlement concerns acknowledgment of the defects resulting in absolute nullity (vicios de nulidad absoluta) contained in the regulatory plan (plan regulador), its expansion, the declarations of public streets (declaratorias de calle pública), and, consequently, related and derivative acts such as concessions; as well as the establishment of, and commitment to, a series of actions aimed at restoring the affected natural heritage through the implementation of a jointly and technically assessed work plan. Lawful Cause (causa justa): as explained, the basis of the agreement is the pursuit of compliance with the obligation to protect and environmentally restore the wetland identified as Estero Hatillo Viejo N° 549, an obligation undertaken by Costa Rica and applicable to the three Branches of the Republic, as well as their bodies, entities, officials, and judges throughout the country, through ratification of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat, ratified by Ley N° 7224 and known as the Convención Ramsar; and its consequent relationship with the right to a healthy and ecologically balanced environment set forth in Article 50 of the Constitución Política de la República de Costa Rica, as well as the obligations arising from the Ley Orgánica del Ambiente and the Ley de Biodiversidad, among others.

Conditions of manner, time, and place (condiciones de modo, tiempo y lugar), which were specifically assessed legally and technically before the agreement was signed, are indeed established in the agreed terms, with sufficient elements being understood to exist so that compliance, or any eventual matter requiring consideration, may be assessed during the enforcement phase (fase de ejecución). Legal System (ordenamiento jurídico): A central point of the settlement is deemed to be that the administrative conduct (conducta administrativa) subject to judicial review (control jurisdiccional) in this case is already contemplated within the scope of Art 17 of the Ley de Planificación Urbana, which governs the powers of approval, suspension, partial amendment, total repeal, and others. Moreover, the Legislature vested these powers while providing for interinstitutional proceedings and granting authority to the respective supreme hierarchical superiors, which are more representative and collegial bodies.

This legislative approach is consistent with Article 73.3 of the Código Procesal Contencioso Administrativo, and these are therefore the same competent authorities that were required to authorize this judicial settlement. Concerning the Public Interest in Citizen Participation and the Special Environmental Protection of Wetlands. Sustainable Tourism Development. As explained and developed throughout the judgment, particularly in the sixth and seventh whereas clauses, the public interests whose highest-ranking legal foundations are found in Articles 9 and 50 of the Constitución Política de la República de Costa Rica, Principle 10 of the Rio Declaration, and Ley 7224 concerning the Convención Ramsar are highly relevant to regulatory plans. Thus, on the one hand, the public interest in the Special Environmental Protection of Wetlands must first be assessed as arising from the right to a healthy environment and from recognition of their fragility and special importance among all ecosystems.

Then, no less importantly, another public interest requiring protection is the guarantee of Citizen Participation through a public hearing (audiencia pública), which is likewise of special public interest, as it is one of the ways in which the people exercise governmental functions participatively (Constitución Política de la República de Costa Rica: Art 9 “The Government of the Republic is popular, representative, participatory, alternating, and responsible. It is exercised by the people and three distinct and mutually independent Branches...). Having distinguished the two interests to be weighed, it is appropriate to note where they coincide, because all environmental protection is implicitly strengthened by citizen-participation mechanisms, which make it possible not only to monitor and report environmental problems, but also to raise any factual and legal considerations deemed appropriate, including those related to stakeholder groups, social investment, minority sectors, minors and older adults, the gender gap, etc. Accordingly, the Legislature elected to incorporate citizen participation into the regulatory-plan procedure as an indispensable requirement, making it part of due process (debido proceso) and the general public’s right of defense (derecho de defensa).

Because these principles must be respected in settlement proceedings, the procedures had to be adapted to guarantee that public interest. The foregoing is the result of properly weighing and harmonizing the interests involved, because where the procedure exists, environmental protection could not be eliminated on the grounds that no objections were raised at the public hearing, just as citizen participation could not be impaired in the interest of pursuing environmental protection. There is a public interest in Sustainable Tourism Development, which would not be adversely affected because support for and development of the tourism sector—as a generator of employment and a source of the country’s and national industry’s principal revenues—continues to be promoted as the significant public interest that it represents. Nevertheless, this development must occur in compliance with the environmental commitments that Costa Rica has made to the international community.

This is precisely what allows construction investment to occur in places where it does not cause major environmental harm, while such investment is, in turn, strengthened by the tourism drawn by the flora, fauna, and natural beauty found in the country’s various protected areas, the extent of protected territory being one of its primary strengths in attracting tourism. Consequently, no adverse effect whatsoever on the Public Interest is deemed to exist. In view of everything stated in the foregoing considerations, and upon analysis of the mandates and their scope, this agreement is deemed neither contrary to the legal system nor harmful to the public interest, within the meaning of Articles 76 and 77 of the Código Procesal Contencioso Administrativo CPCA. Accordingly, once it becomes final, this approval judgment shall have the force of substantive res judicata (cosa juzgada material).

NINTH.- OTHER PARTICIPANTS, RIGHT OF DEFENSE, AND DUE PROCESS FOR THE GENERAL PUBLIC. During the Settlement Phase, all parties participated. In the case of the State and the Sistema Nacional de Áreas de Conservación, the plaintiff had already reached another settlement agreement (the agreement and its approval are contained in the court record), while settlement efforts with the other participants had already been declared unsuccessful, as occurred with the company Playa Matapalo Sociedad Anónima. In that regard, although the company had previously filed a motion seeking information about settlement negotiations to which it was not a party, the motion was not granted because it was deemed clearly contrary to Articles 13.d and 14 of the Ley de Resolución Alterna de Conflictos, as doing so would violate the required confidentiality. Nevertheless, both the company and the other parties participating in the proceedings are guaranteed their right of defense and due process through service of the judgment at the designated address and the possibility of challenging it by an appeal in cassation (recurso de casación), under both the terms and circumstances provided for in Article 134 and those in Article 153 of the Código Procesal Contencioso Administrativo.

Additionally, as a safeguard for the participation of the general public and to promote transparency, pursuant to Articles 152 and 153 of the Ley General de Administración Pública, the Board of Directors of the Instituto Costarricense de Turismo agreed that the approval judgment would be published once issued and served (Folio 1282 of the Court Record). This publication also satisfies the scope of Articles 13 and 14 of the Ley de Notificaciones, and, from the date of publication until fifteen days thereafter, all interested persons, whether natural or legal persons, may appear in the proceedings to submit any factual and legal considerations they deem appropriate. Serve notice through the designated means and publish.

TENTH.- ATTORNEY FEES AND LITIGATION COSTS (COSTAS PERSONALES Y PROCESALES). Articles 193 and 197 of the Código Procesal Contencioso Administrativo provide that judgments and orders having the force of a judgment must include a ruling on costs, even sua sponte, except in cases arising before the preliminary hearing where: “Unless the parties agree otherwise, no award of costs shall be entered where withdrawal, acquiescence, or extrajudicial satisfaction of the claim occurs before or during the preliminary hearing”; this means that, in this specific case, because the parties expressly agreed that each would bear its own costs, it is appropriate to issue this judgment without any specific award of costs, understood as those incurred proportionally up to this stage of the proceedings.

POR TANTO

The application for judicial approval (homologación) of the settlement agreement (acuerdo conciliatorio) whereby the Playa Guápil Land-Use Plan (Plan Regulador) is repealed—annulled—in accordance with the considerations set forth and pursuant to the Political Constitution of Costa Rica, Articles 11, 24, 27, 33, 41, 43, 45, 49, 169, 170, 183 and 184; Articles 8.1, 24, 25 and 26 of the Pacto de San José; the Human Right to a Healthy Environment and its effective protection and restoration; the Ramsar Convention, Ley N° 7224; Citizen Participation, Principle 10 of the Rio Declaration; Articles 57, 72, 73, 76, 77, 113, 134 and 153 of the Código Procesal Contencioso Administrativo; Articles 2, 3, 4, 17 and related provisions of the Ley Orgánica del Ambiente; Articles 1, 3, 58 and related provisions of the Ley de Biodiversidad; Articles 1, 2, 7 and related provisions of the Ley de Conservación de Vida Silvestre; Articles 2, 3, 4, 5, 6, 7, 12, 13 and 15 of the Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social; Articles 1 through 20, 190 et seq., and related provisions of the Ley General de la Administración Pública; Articles 13 and 14 of the Ley de Notificaciones; Articles 1, 8 and 38 of the Ley Orgánica de La Contraloría General de la República; Articles 10 and 14 of the Ley Orgánica del Instituto Costarricense de Turismo; Articles 1, 4, 5 and 13 of the Ley Orgánica del Instituto Nacional de Vivienda y Urbanismo; and also pursuant to the grounds and the respective institutional technical and legal opinions, and finding that all parties have been duly represented and that the settlement is neither contrary to the legal system nor detrimental to the public interest, the SETTLEMENT AGREEMENT IS HEREBY JUDICIALLY APPROVED in its entirety.

This judgment shall be served upon all parties to the case file, whereupon the period for appeal shall begin to run; it shall also be published, and any interested party may enter an appearance in the judicial proceeding no later than fifteen business days after publication. No award of costs is made in view of the agreement reached. Once final, this judgment shall have the effect of substantive res judicata (cosa juzgada material); after the agreement has been duly performed, the case shall be closed and archived.

SE RESUELVE SOLICITUD DE HOMOLOGACIÓN DE ACUERDO CONCILIATORIO PARCIAL DENTRO DE PROCESO DE CONOCIMIENTO DE TRÁMITE PREFERENTE, ESTABLECIDO POR CONTRALORÍA GENERAL DE LA REPÚBLICA ACCIONANDO A LA MUNICIPALIDAD DE AGUIRRE Y OTROS.

RESULTANDOS

ANTECEDENTES PROCESALES PRIMERO.- OBJETO DEL CONFLICTO. En fecha 13 de octubre de 2009, La Contraloría General de la República (C.G.R.) interpuso la presente demanda, buscando declarar que partir de la existencia de Humedal de Manglar conocido como Estero Hatillo Viejo N° 549), habría una consecuente afectación como zona pública, generando que en las conductas relacionadas haya nulidad absoluta en la aprobación y ampliación del PLAN REGULADOR DE PLAYA GUAPIL en el Cantón de Aguirre; también impugna la validez de la constitución de calle pública, el otorgamiento de concesiones, actos de aprobación relacionados y conexos, ventas, traspasos e inscripciones registrales, entre otros también relacionados a los predios del lugar, así como también la responsabilidad patrimonial objetiva por la presunta afectación del humedal. (Ver folios 1 al 121 del Expediente Judicial N° 09-002554-1027-CA, en adelante expediente judicial).

SEGUNDO.- PARTES INTERVINIENTES.- Los actos contra los cuales se dirige inicialmente la acción judicial y el objeto del proceso judicial, implicó la intervención como parte pasiva de la Municipalidad de Aguirre, el Instituto Nacional de Vivienda y Urbanismo (I.N.V.U.), el Instituto Costarricense de Turismo (I.C.T.) y Playa Matapalo S.A., interviniendo también El Estado, Sistema Nacional de Áreas de Conservación (SINAC) y la Junta Administradora del Registro Nacional (Ver demanda entre folios 1 al 121 del expediente judicial).

TERCERO.- ESTIMACIÓN DE TRÁMITE PREFERENTE. Mediante resolución de la siete horas treinta y cinco minutos del catorce de octubre del dos mil nueve, el Juez Baltodano Gómez, que conoció inicialmente del expediente, procedió a estimarlo como de Trámite Preferente, de conformidad con el Artículo 60 del Código Procesal Contencioso Administrativo (CPCA), al considerar "que el presente asunto es de gran trascendencia para el interés público, no sólo porque en principio se está afectando el ambiente, sino por cuanto la afectación lo es a un ecosistema vital, no solo para el país sino para el planeta. (ver folios 122 y siguientes del Expediente Judicial) CUARTO.- DETERMINACIÓN DE TRÁMITE PREFERENTE. Procediendo sin más trámite a remitirlo ante la Sección Sexta de este Tribunal, le correspondió conocer a la Jueza Álvarez Molina junto con los Jueces Garita Navarro y González Vílchez, quienes mediante resolución de la diez horas del veintinueve de octubre del año dos mil nueve y "...considerando las alegaciones de transgresión al patrimonio natural del Estado, supuestamente a consecuencia de la construcción de la vía en medio de un humedal, la que con posterioridad fue declarada calle pública, exigen una pronta atención, por ser un tema en el que se encuentra presente un marcado interés público..." y de conformidad con el artículo 60.1 CPCA, se ordenó darle trámite preferente a este proceso judicial.

(Ver folios 124 y siguientes del Expediente Judicial) FASE DE CONCILIACIÓN QUINTO.- CONVOCATORIA A CONCILIACIÓN Y DIRECCIÓN DE AUDIENCIA. Durante la tramitación preferente,estimando la procedencia de la convocatoria a fase de conciliación, la Sección Sexta previa coordinación, mediante resolución de las ocho horas treinta minutos del diecisiete de agosto del dos mil once, convocó a todas las partes para la primera audiencia de conciliación, señalada el día treinta de agosto del dos mil once. (Artículos 59 y 70 del Código Procesal Contencioso Administrativo) Conociendo de la solicitud de homologación y dirigiendo la conciliación en todas sus audiencias, interviene el Juez Conciliador de lo Contencioso Administrativo Alexander Castillo Aguilar, actuando bajo titularidad y legitimación del Acuerdo de Nombramiento Concursado del Consejo Superior del Poder Judicial, N° 54-08 del veinticuatro de junio del año dos mil ocho, con pago vigente de la póliza dos mil doce y con la respectiva colegiatura profesional al día.

(Arts 7, 11, y 12 Ley 7727 y Arts 59, 80.2 y 102 del CPCA) SEXTO.- INFORMACIÓN SOBRE LOS DEBERES, DERECHOS Y PRINCIPIOS QUE APLICAN A TODA CONCILIACIÓN JUDICIAL. Desde el inició de la primera convocatoria a conciliación y reiterándose su aplicación en todas las posteriores audiencias separadas y conjuntas, se ha informado a todas las partes intervinientes sobre el objeto, la naturaleza, los derechos y deberes que les asisten, sustentados en los principios que rigen el Instituto de la Conciliación y su aplicación en las Sedes Jurisdiccionales, de conformidad con los principios contenidos en la Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social, entre otros puntualmente sobre los Principios de Libertad, Confidencialidad, Información y Formación, No Violencia e Igualdad, Participación Autocompositiva, Contextualidad, Imparcialidad, Anticipación del conflicto de intereses y Oralidad entre otros; también se ha informado sobre la especial garantía judicial que recae en la tutela y respeto a esos derechos y principios, mediante la intervención y Rol que debe asumir el Juez Conciliador, guiando a las partes en el proceso y acuerdo con total Independencia e Imparcialidad.

Se ha informado sobre los derechos en juego, se ha indicado que un acuerdo conciliatorio podría no satisfacer todos los intereses, así como también del derecho que asiste a consultar el contenido del acuerdo con un abogado antes de firmarlo. También se ha informado que la documentación técnica, el acuerdo y la sentencia, serán documentos públicos una vez homologado el acuerdo. (Ley de Resolución Alterna de Conflictos, Artículos 11 y 15).

SÉTIMO.- IMPLICACIONES DEL ORDENAMIENTO JURÍDICO, NORMAS Y PRINCIPIOS APLICABLES. De manera particular a la conciliación dentro de esta Jurisdicción Contenciosa, también desde el inició de la primera convocatoria, teniendo intervención todas las partes accionadas y reiterándose su aplicación en todas las posteriores audiencias separadas y conjuntas, se ha informado a todas las partes intervinientes sobre las implicaciones del respeto al Ordenamiento Jurídico, la especial sujeción derivada del artículo 129 de la Constitución Política, donde expresamente establece la nulidad para los actos y los convenios contrarios a las leyes (incluyendo tanto los posibles acuerdos conciliatorios, como también aquellos actos de alcance general como los planes reguladores). Entendido que lo anterior también implica, de conformidad con el artículo 7 constitucional, que la obligación y control del juez para garantizar el respeto al ordenamiento jurídico y su jerarquía, se despliega en primer término garantizando los principios y derechos constitucionales, como también aquellos derechos humanos reconocidos e incorporados en instrumentos internacionales debidamente ratificados; posteriormente se controla garantizar los derechos reconocidos en las leyes y tratados internacionales con jerarquía de ley; y finalmente aquellos contenidos y desarrollados en los actos del ejecutivo, ya sean de carácter general o individual.

Siendo que en el caso particular y por el objeto del proceso, tienen relevancia para la determinación de los límites al posible acuerdo, la transversalidad de los derechos reconocidos tanto en la Constitución como en los tratados internacionales, en materia de Protección al Medio Ambiente y de Participación Ciudadana (Principio 10 de la Declaración de Río), incorporado para la Municipalidades y los Planes Reguladores, en el artículo 17 de la Ley de Planificación Urbana.

OCTAVO.- INCORPORACIÓN MATERIAL. En fecha treinta de noviembre del dos mil doce, se ordenó la incorporación material al expediente y foliatura de toda documentación cuya confidencialidad se reservaba y custodiaba en los archivos del Despacho. (Toda la documentación es pública ya se encuentra agregada al expediente) NOVENO.- OBJETO DEL ACUERDO CONCILIATORIO A VALORAR EN ESTA HOMOLOGACIÓN. Contenido en el acta de audiencia y acuerdo conciliatorio, suscrito en el Tribunal Contencioso Administrativo y Civil de Hacienda, Segundo Circuito Judicial de San José, Anexo Contencioso.

La Contraloría General de la República, la Municipalidad de Aguirre, el Instituto Nacional de Vivienda y Urbanismo, y el Instituto Costarricense de Turismo, han acordado "CONSIDERANDO 1. La demanda ordinaria que el 13 de octubre de 2009 la Contraloría General de la República presentó ante ese Tribunal contra la Municipalidad de Aguirre y otros (folio 1 del expediente judicial).

2. La resolución de las 10:00 horas del 19 de octubre de 2009, en donde la sección sexta de ese Tribunal, bajo trámite preferente, dio curso a la demanda y emplazó a las partes para su contestación (folio 125 del expediente judicial).

3. Que en este proceso, la Municipalidad de Aguirre, el ICT y el INVU figuran como partes demandadas, contra los que se pide nulidad de conductas administrativas, determinación de responsabilidades y el consecuente cobro de daños y perjuicios.

4. La prueba que aportó la CGR en la demanda presentada el 13 de octubre del 2009 (ver folios 1, 113, 114, 115 y 116 judiciales).

5. La prueba que han hecho llegar las partes al proceso (entre otra, ver certificaciones y criterios técnicos del SINAC de folios 1092 a 1105, 1106, 1117 judiciales).

6. Que en respuesta al acuerdo del Concejo Municipal de Aguirre tomado en la sesión del 13 de noviembre del 2007, se emitió el oficio ALCM-042-2007, suscrito por el Lic. Randall Marín Orozco, Asesor Legal del Concejo Municipal de Aguirre, el cual consistía en una propuesta de resolución para que el Concejo Municipal declarara la lesividad del Plan Regulador de Playa Guapil, su reglamento de zonificación y el plan de uso del suelo y vialidad, así como las concesiones otorgadas a la empresa concesionaria bajo los expedientes No. 3436-02, 3437-02, 3438-02, 3439-02 y 3440-02 (ver acuerdo N° 4, artículo cuarto, de la sesión ordinaria N° 145 del 20 de noviembre del 2007 que se adjuntó a la demanda de lesividad de la Municipalidad de Aguirre tramitada bajo el expediente 07-001665-0163-CA).

7. Que mediante acuerdo N° 4, artículo cuarto, de la sesión ordinaria N° 145 del 20 de noviembre del 2007 que se adjuntó a la demanda de lesividad de la Municipalidad de Aguirre tramitada bajo el expediente 07-001665-0163-CA, el Concejo Municipal de Aguirre declaró lesivos a los intereses públicos el Plan Regulador de Playa Guapil, su reglamento de zonificación y el plan de uso del suelo y vialidad, así como las concesiones otorgadas a Playa Matapalo S.A. bajo los expedientes No. 3436-02, 3437-02, 3438-02, 3439-02 y 3440-02.

8. Que en el proceso tramitado bajo el expediente 07-001665-0163-CA, se emitió sentencia No. 2868-2011 de las 8:00 horas del 22 de setiembre del 2011, del Juzgado Contencioso Administrativo y Civil de Hacienda, que declaró con lugar en todos sus extremos la demanda de lesividad que presentó la Municipalidad de Aguirre para anular el acto administrativo del Concejo Municipal que en sesión ordinaria N° 310 del 25 de marzo de 2002, aprobó el Plan Regulador Costero Parcial de Playa Guápil y sus reglamentos, los actos administrativos que aprobaron todas las concesiones a favor de Playa Matapalo S.A., cédula de persona jurídica No. CED31690, según acuerdo del Concejo Municipal de la Sesión Ordinaria N° 127, artículo V) del 13 de enero del 2004 y los actos administrativos del ICT que aprobaron las concesiones otorgadas a Playa Matapalo S.A. mediante las resoluciones N° G-319-2004, G-328-2004, G-372-2004, G-373-2004, del 26 y 27 de febrero, 4 de marzo, 4 de febrero, todos del año de 2004, respectivamente y el oficio N° G-2078-2004 del 24 de noviembre de 2004, los cuales corresponden a los expedientes administrativos del ICT No. 3436-02, 3437-02, 3438-02, 3439-02 y 3440-02 respectivamente.

9. Que la Municipalidad de Aguirre no impugnó la sentencia antes indicada.

10. Que las partes firmantes reconocen el contenido y parte dispositiva de esta sentencia No. 2868-2011 de las 8:00 horas del 22 de setiembre del 2011, del Juzgado Contencioso Administrativo y Civil de Hacienda.

11. Que mediante acuerdo N° 09, artículo sétimo adoptado por el Concejo Municipal de Aguirre en la sesión N° 180-2012 del 13 de marzo del 2012, se conoció una propuesta de conciliación que llevó el Departamento Legal de la Corporación, que –entre otras cosas- gira en torno a anular el plan reguladora parcial costero y su ampliación de Playa Guapil, todas las concesiones otorgadas a Playa Matapalo S.A., contratos, inscripciones registrales y demás conductas conexas, la anulación de la escritura en donde se le donaron a la Municipalidad de Aguirre dos terrenos con la condición de que declarara un camino público en ellos, para que a su vez sirviere como único acceso a las posibles zonas concesionables de la zona marítimo terrestre (lo que a su vez habilitaría la existencia de un posible plan regulador costero en Playa Guapil), la anulación de calle pública de dicho camino y llevar a cabo un plan remedial con respecto al daño ambiental generado por la construcción y habilitación de dicho camino público.

En dicha sesión se determinó que sí era viable conciliar la anulación del plan regulador, su ampliación, todas sus concesiones y la declaratoria de calle pública. Se estimó que había dudas sobre anular a través de procedimiento administrativo (consulta) y que se podrían anular las conductas administrativas relativas al camino público siempre y cuando se contare con un criterio técnico.

De ahí que se acordó que si se despejaban las dudas con respecto a los dos puntos anteriores y si la CGR remitía una formal propuesta al Concejo, se estimaba viable conciliar en los términos descritos. Esto en una sesión extraordinaria o en la próxima sesión ordinaria del cuerpo colegiado municipal.

12. Que la CGR analizó el citado acuerdo N° 09, artículo sétimo adoptado por el Concejo Municipal de Aguirre en la sesión N° 180-2012 del 13 de marzo del 2012. A partir del mismo y de los términos perfilados con los representantes de la Municipalidad de Aguirre, el ICT y el INVU luego de varias sesiones de conciliación, la Contraloría General de la República preparó una propuesta de conciliación que valora que satisface razonable y proporcionalmente los requerimientos e intereses de la Municipalidad de Aguirre, el ICT, el INVU y la CGR. Entre otras la propuesta se cimenta en el plan remedial no con base en un criterio ordinario de la Administración, sino que lo hace en estricto apego al criterio técnico especializado del órgano competente de Costa Rica para emitir criterios sobre humedales: el SINAC (ver criterios técnicos citados en el considerando 5 y que consta en el expediente judicial).

ACUERDO CONCILIATORIO PRIMERO. El ICT, el INVU y la Municipalidad de Aguirre, declaran la nulidad absoluta del Plan Regulador Costero parcial de Playa Guapil del cantón Aguirre, Distrito Savegre, el cual se publicó en el Diario Oficial La Gaceta N° 91 del 14 de mayo del 2002 (ver folio 1 del expediente administrativo del reglamento de zonificación del plan regulador de playa Guapil de la Municipalidad que aportó la CGR en su demanda y prueba 9 del legajo-pruebas-CGR), de la ampliación de este plan regulador, la cual fue discutida y aprobada en el acuerdo N° 2 de la sesión ordinaria N° 69 del 01 de abril del 2003, artículo quinto, concretamente, en las zonas entre las coordenadas lambert 358.200 N-475.100 E,358.350 N-475.150 E, 388.350 N-475.250 E NIE146 E,358.210 N-475.350 E358.270 N-475-370 E (ver folios 71 y 73 del expediente administrativo del plan regulador costero de Playa Guapil del INVU), su reglamento de zonificación, las láminas correspondientes con sus respectivos visados, todas las concesiones otorgadas, aprobadas e inscritas en el Registro Nacional a favor de Playa Matapalo S.A. y todos los actos y actuaciones conexas, anteriores y posteriores a la aprobación de dicho plan regulador parcial, su ampliación y todas las concesiones otorgadas a Playa Matapalo S.A.

Al efecto, por conexidad, se tienen identificadas –al menos- y se anulan las siguientes conductas administrativas de estas personas públicas que participaron en la emisión de dicho plan regulador y su ampliación:

PLAN REGULADOR COSTERO Y SU AMPLIACIÓN .

-Los proyectos de plan regulador parcial elaborado por la empresa Deppat S.A. en junio de 1995 y su ampliación descrita en el oficio del INVU PU-C-D-1026-2006 del 7 de noviembre del 2006 -concretamente en las zonas entre las coordenadas lambert sur 358-356N 475.062 E NIE125 E que comprende el sector delimitado por los mojones del Instituto Geográfico Nacional del 37 al 32- y en el acuerdo adoptado por el ICT en sesión ordinaria N° 5310, artículo 5, inciso XII del 15 de junio del 2004 -concretamente en las zonas entre las coordenadas lambert sur 358-356N 475.062 E NIE125 E que comprende el sector delimitado por los mojones del Instituto Geográfico Nacional del 37 al 32 en orden consecutivo, sector entre mojones 131 al 128 frente a la playa, sector entre mojones que delimitan el humedal del 294 al 300 en orden consecutivo de acuerdo con la lámina 20 a escala 1:2000 elaborada por Deppat y firmada por el profesional responsable, Arq. Alfredo Bermúdez, código A-4043-.

-El acto de la Junta Directiva del ICT que aprobó el Plan Regulador parcial de Playa Guapil de Aguirre, en sesión ordinaria No. 4652 del 24 de junio de 1996, artículo 5, inciso 10 (hecho 13 de la demanda. Ver folio 139 del tomo I y folio 123 del tomo II, ambos del expediente administrativo del ICT al plan regulador parcial aportado por la CGR).

-Acto de fecha 14 de junio del 2001, mediante el cual la Dirección de Urbanismo el INVU comunicó la aprobación del Plan Regulador parcial (ver folios 42 al 49 del expediente administrativo del plan regulador costero de Playa Guapil del INVU y prueba 8 del legajo-pruebas-CGR) –ver hecho 33 de la demanda-.

-Acto del 25 de marzo del 2002, mediante el cual el Concejo Municipal de Aguirre, aprobó en la sesión ordinaria N° 310, el Plan Regulador parcial de Playa Guápil, el cual se publicó en el Diario Oficial La Gaceta N° 91 del 14 de mayo del 2002 (ver folio 1 del expediente administrativo del reglamento de zonificación del plan regulador de playa Guapil de la Municipalidad aportado por la CGR y prueba 9 del legajo-pruebas-CGR) –ver hecho 35 de la demanda-.

-Acto de la sesión ordinaria N° 69 del 01 de abril del 2003, artículo quinto, mediante el cual la Municipalidad de Aguirre tomó el acuerdo N° 2 para autorizar la elaboración de un plan regulador parcial -ampliación- de una parcela ubicada en Playa Guapil, concretamente, en las zonas entre las coordenadas lambert 358.200 N-475.100 E,358.350 N-475.150 E, 388.350 N-475.250 E NIE146 E,358.210 N-475.350 E358.270 N-475-370 E (ver folios 71 y 73 del expediente administrativo del plan regulador costero de Playa Guapil del INVU aportado por la CGR) –ver hecho 47 de la demanda-.

-Acto de sesión ordinaria N° 5310, artículo 5, inciso XII, del 15 de junio del 2004, mediante el cual el ICT aprobó la ampliación del Plan Regulador parcial de Playa Guapil, concretamente, en las zonas entre las coordenadas lambert sur 358-356N 475.062 E NIE125 E que comprende el sector delimitado por los mojones del Instituto Geográfico Nacional del 37 al 32 en orden consecutivo, sector entre mojones 131 al 128 frente a la playa, sector entre mojones que delimitan el humedal del 294 al 300 en orden consecutivo de acuerdo con la lámina 20 a escala 1:2000, elaborada por Deppat y firmada por el profesional responsable, Arq. Alfredo Bermúdez, código A-4043 (ver folio 108 del expediente administrativo del plan regulador costero de Playa Guapil del INVU aportado por la CGR) -ver hecho 57 de la demanda-.

-Oficio DPD-ZMT-215-2004 del 25 de junio del 2004 (ver certificación y folios 1 y 14 de la certificación del expediente administrativo de la ampliación del plan regulador parcial de Playa Guapil de la Municipalidad de Aguirre que aportó la CGR) mediante el cual el ICT comunica al Concejo Municipal de Aguirre la autorización de esta ampliación al Plan Regulador parcial de Playa Guápil -ver hecho 49 de la demanda-.

-Oficio PU-C-D-1026-2006 del 7 de noviembre del 2006, mediante el cual el INVU aprobó la ampliación del Plan Regulador parcial de Playa Guapil, concretamente, en las zonas entre las coordenadas lambert sur 358-356N 475.062 E NIE125 E que comprende el sector delimitado por los mojones del Instituto Geográfico Nacional del 37 al 32 (ver folios 109 a 141 y 71 a 108 del expediente administrativo del plan regulador costero de Playa Guapil del INVU aportado por la CGR) -ver hecho 59 de la demanda-.

CONCESIONES A FAVOR DE PLAYA MATAPALO S.A.

-Acto donde la Municipalidad de Aguirre aprueba las solicitudes de concesión realizadas por Playa Matapalo S.A., emitido en la sesión ordinaria N° 127 del 13 de enero del 2004, donde además se autorizó al Alcalde de ese entonces, señor Nombre65363 , para que firmara los respectivos contratos, lo cual se realizó el 3 de febrero de ese mismo año, en cuanto a cuatro contratos y el quinto, el 9 de septiembre siguiente (ver expedientes administrativos de las concesiones N° 3436-02, N° 3437-02, N° 3438-02, N° 3439-02 y N° 3440-02 de la Municipalidad de Aguirre aportados por la CGR) –ver hecho 55 de la demanda -.

-Resoluciones números G-319-2004, G-328-2004, G-372-2004, G-373-2004, del 26 y 27 de febrero, 4 de marzo, 4 de febrero, todos del año del 2004, respectivamente, y el oficio N° G-2078-2004 del 24 de noviembre de 2004, donde el ICT aprueba esas concesiones (ver la primera hoja de los siguientes expedientes administrativos de concesiones del ICT aportados por la CGR: N° 110-09, N° 111-09, N° 112-09, Placa33002° y Placa33003° ) –ver hecho 56 de la demanda -.

CAMINO PÚBLICO.

SEGUNDO. Que se anule la venta efectuada mediante escritura N° 15 de las 08:40 horas del siete de mayo de 1999 del protocolo del notario público Randall Rubén Sánchez Mora, presentada al Registro Nacional mediante boleta 0540126, en donde de las dos fincas madres ubicadas en Puntarenas, Aguirre, Savegre: la finca Placa27356° inscrita a tomo 2188, folios 147 y 148, asientos 1 y 2; y la finca de folio real con matrícula Placa27359, se segregó un lote de cada una de ellas (el inscrito en el Catastro Nacional con el plano Placa27357° y el inscrito en el Catastro Nacional con el plano Placa33004° ), y se le vendió a la Municipalidad de Aguirre. Que en virtud de lo anterior, las firmantes acordamos la anulación de ese traspaso, la respectiva inscripción registral y las inscripciones de dichos planos catastrados, para que se retrotraigan los efectos al momento de la venta.

TERCERO. Que la Municipalidad de Aguirre y el INVU anulan todo acto administrativo tendiente a declarar, habilitar, permitir o emitir cualquier tipo de declaratoria de camino público que permita el acceso a este plan regulador costero y su ampliación de Playa Guapil -que se anula en la cláusula primera-. Es decir, que permita el acceso por el lugar donde se ubica este camino actualmente según está acreditado en la demanda de la CGR. Al efecto, por conexidad, se tienen identificadas y se anulan las siguientes conductas administrativas de estas personas públicas que participaron en la emisión o habilitación de dicho camino:

-Acto de la sesión ordinaria N° 74 del 10 de mayo de 1999, donde el Concejo Municipal de Aguirre declara público el camino que da acceso a Playa Guapil desde la Costanera Sur, con un área de 570 metros de largo por 12 metros de ancho (ver folio 87 del tomo II del expediente administrativo del ICT al plan regulador aportado por la CGR. Ver folios 14 y 16 del expediente administrativo del plan regulador de Playa Guapil del INVU –ver acuerdo N° 8 de la sesión ordinaria N° 180 del 21 de agosto del 2000 del Concejo Municipal de Aguirre, donde se acuerda ir a inspeccionar la calle pública-) –ver hecho 23 de la demanda-.

-Acto del 25 de mayo del 2001, mediante el cual el INVU aprobó dicho acceso público a Playa Guapil por la Costanera Sur (ver folios 36, 43 y 42 del expediente administrativo del plan regulador del INVU aportado por la CGR) –ver hecho 32 de la demanda -.

-Acto de la sesión ordinaria N° 22 celebrada el 20 de agosto del 2002, donde el Concejo Municipal de Aguirre acordó autorizar a Playa Matapalo S.A. la construcción de la calle que corre detrás de las zonas concesionadas -del mojón 37 a 51- y de una bodega provisional para el almacenamiento de materiales por el tiempo que durara la obra (ver folio 20 del expediente administrativo de la ampliación del plan regulador de la Municipalidad aportado por la CGR) –ver hecho 38 de la demanda-.

DAÑO AMBIENTAL AL ECOSISTEMA DE HUMEDAL . POR LA CONSTRUCCIÓN DEL CAMINO.

CUARTO. Que para iniciar la reparación del daño que la construcción del camino -que va desde la Costanera Sur hasta la zona restringida de la zona marítima terrestre- ha generado al ecosistema de humedal (descrito en las certificaciones y criterios técnicos referenciados en los considerandos 4 y 5 de este acuerdo conciliatorio), en un plazo de 3 meses calendario contados a partir del día hábil siguiente a la comunicación de la resolución del Tribunal que homologue este acuerdo conciliatorio, la Municipalidad de Aguirre se compromete a (con el recurso humano y la logística y maquinaria con que cuenta actualmente) llevar a cabo todos los trabajos suficientes y necesarios para lograr el cierre del trayecto del camino en el lugar indicado, la eliminación del entubamiento, la remoción de la infraestructura tipo brocal y a abrir un boquete en el lugar señalado de este camino. Todo lo anterior en las dimensiones, forma y lugares exactos que son recomendados por el criterio técnico del SINAC, emitido a través del Informe Playa Guapil N° ACOPAC-UV-016-2011, de fecha 27 de octubre del 2011, que consta en el folio 1106 judicial.

Es decir, que la Municipalidad de Aguirre se compromete a realizar todas las recomendaciones, observaciones y sugerencias que el SINAC plasmó a lo largo del informe antes citado. Dicho trabajo deberá ser recibido de conformidad por los funcionarios competentes del SINAC, para lo cual se levantará la respectiva acta, que será suscrita por el apoderado judicial especial de la Municipalidad de Aguirre para este proceso 09-2554-1027-CA, conjuntamente con los responsables del SINAC que inspeccionaron los trabajos. De lo anterior, la Municipalidad de Aguirre deberá preparar un informe –al que se adjuntará la citada acta- con el cual acredite el cumplimiento del acuerdo en los términos descritos. Este informe deberá ser presentado ante el Tribunal Contencioso Administrativo y Civil de Hacienda, haciendo llegar un original al expediente N° 09-2554-1027-CA, y ante la División Jurídica de la CGR. Para presentar el informe se contará con un plazo de 3 días hábiles posteriores al recibido de conformidad de estos trabajos. La firma de este acuerdo no acredita ni supone que la Municipalidad de Aguirre es la única responsable por el daño ambiental descrito en la demanda de la CGR.

QUINTO. El ICT se compromete a presentar un escrito para desistir a la apelación que presentó en el proceso tramitado bajo el expediente N° 07-001665-0163-CA, contra la sentencia N° 2868-2011 de las 8:00 horas del 22 de setiembre del 2011, del Juzgado Contencioso Administrativo y Civil de Hacienda, que declaró con lugar en todos sus extremos la demanda de lesividad que presentó la Municipalidad de Aguirre para anular el acto administrativo del Concejo Municipal que en sesión ordinaria N° 310 del 25 de marzo de 2002, aprobó el Plan Regulador Costero Parcial de Playa Guápil y sus reglamentos, los actos administrativos que aprobaron todas las concesiones a favor de Playa Matapalo S.A., cédula de persona jurídica No. CED31690, según acuerdo del Concejo Municipal de la Sesión Ordinaria N° 127, artículo V) del 13 de enero del 2004 y los actos administrativos del ICT que aprobaron las concesiones otorgadas a Playa Matapalo S.A. mediante las resoluciones N° G-319-2004, G-328-2004, G-372-2004, G-373-2004, del 26 y 27 de febrero, 4 de marzo, 4 de febrero, todos del año de 2004, respectivamente y el oficio N° G-2078-2004 del 24 de noviembre de 2004, los cuales corresponden a los expedientes administrativos del ICT No. 3436-02, 3437-02, 3438-02, 3439-02 y CED126545 respectivamente. El ICT se compromete a dejar sin efecto su apelación el día hábil siguiente en que le sea comunicada la resolución de homologación que se emita como consecuencia del presente acuerdo conciliatorio.

SEXTO. Tomando como base lo indicado en las cláusulas anteriores y supeditado al cumplimiento efectivo de lo propuesto por la Municipalidad de Aguirre, el ICT y el INVU, la Contraloría General de la República acepta conciliar y, en consecuencia, desiste del reclamo de daños y perjuicios en contra de la Municipalidad de Aguirre, el ICT y el INVU en el presente proceso N° 09-2554-1027-CA, en el entendido que cada parte asume sus costas, dando así por terminado este proceso respecto de las partes antes indicadas.

SÉTIMO. Hasta tanto no se encuentre terminada en firme la ejecución de sentencia de este proceso, se conviene mantener las medidas cautelares judiciales y administrativas adoptadas con relación al objeto y causa de este proceso." Firman en representación de la Contraloría General de la República, su abogado y Apoderado, el Licenciado Esteban Villalobos Fernández; en representación de la Municipalidad de Aguirre, la Alcaldesa María Isabel León Mora y su abogado el Licenciado Josue Salas Montenegro; por el Instituto Nacional de Vivienda y Urbanismo, su abogada y Apoderada General, la Licenciada María Cecilia Robles Martínez; por parte del Instituto Costarricense de Turismo, su abogado y Apoderado, el Licenciado Jimy Álvarez García; así como también Alexander Castillo Aguilar, como Juez Conciliador de lo Contencioso Administrativo." DÉCIMO.- AUTORIZACIONES DEL ARTÍCULO 73.3 CPCA. En el caso concreto de este acuerdo, las sendas autorizaciones para conciliar de los respectivos superiores jerarcas supremos se incorporaron, quedando visibles en el expediente judicial, la de La Contraloría General de la República a folio 1262; la de La Municipalidad de Aguirre entre folios 1264 al 1270, la de El Instituto Costarricense de Turismo a folios 1272 a 1283 y El Instituto Nacional de Vivienda y Urbanismo tiene autorización visible a folios 1285 a 1294 del Expediente Judicial.

DÉCIMO PRIMERO.- AUDIENCIA PÚBLICA ARTÍCULO 17 DE LA LEY DE PLANIFICACIÓN URBANA. Mediante gestión presentada por la Alcaldesa, el Concejo Municipal de Aguirre acordó convocar al procedimiento de Audiencia Pública prevista en materia de Planes Reguladores, acuerdo que se acompaña de la respectiva publicación en la Gaceta y fotografías de avisos; documentación que se encontraba en el Tomo I del Expediente, por lo cual se traslada al Tomo II, según correspondería y quedando visible entre los folios 1315 al 1319, frente y vuelto del Expediente Judicial.

DÉCIMO SEGUNDO.- FORMALIDADES DEL PROCESO DE CONCILIACIÓN. Se resuelve esta solicitud de homologación, estimando que durante el procedimiento de conciliación se han cumplido todas las formalidades, garantías, requisitos y principios contemplados tanto por las Leyes N° 7727 y N° 8508, como también con las demás normas aplicables del ordenamiento jurídico nacional e internacional vigente; sin que se noten omisiones, nulidades o errores capaces de invalidar lo actuado.

CONSIDERANDOS

PRIMERO.- HECHOS PROBADOS. De relevancia para la resolver esta solicitud de homologación se tienen los siguientes: HECHO PRIMERO.- ACUERDO CONCILIATORIO. En fecha dieciocho de julio del dos mil doce, se suscribió acuerdo conciliatorio entre la parte actora Contraloría General de la República y tres de las nueve partes intervinientes, propiamente con la Municipalidad de Aguirre, el Instituto Nacional de Vivienda y Urbanismo y el Instituto Costarricense de Turismo, acuerdo que es parcial en cuanto a los intervinientes en el conflicto y total en las intenciones de dar por terminado el proceso. (Ver acuerdo firmado a folios 1303 al 1314 del expediente). HECHO SEGUNDO.- AUTORIZACIÓN C.G.R. La Contralora General de la República, Nombre3879 , como Jerarca Superior y de conformidad con el artículo 73.3 CPCA, en fecha cuatro de junio del dos mil doce, suscribió la autorización para conciliar. (Ver Autorización suscrita a folio 1262 del expediente judicial).

HECHO TERCERO.- AUTORIZACIÓN MUNICIPALIDAD DE AGUIRRE. El Concejo Municipal, mediante Sesión N° 183-2012 del veintisiete de marzo del dos mil doce, Artículo Sétimo, Acuerdo N°9, autorizó la conciliación y delegó su suscripción en la Alcaldesa María Isabel León Mora. (Ver certificación de la Secretaría de ese Concejo Municipal a folios 1264 al 1270 del Expediente Judicial). HECHO CUARTO.- AUTORIZACIÓN I.N.V.U. La Junta Directiva del Instituto Nacional de Vivienda y Urbanismo, mediante Sesión N° cinco mil novecientos treinta y nueve, de fecha tres de mayo del dos mil doce, Articulo II, inciso ocho punto a), autorizó la conciliación como superior jerarca de ese Instituto (Ver certificación de la Secretaría de Junta Directiva a folio 1284). HECHO QUINTO.- AUTORIZACIÓN I.C.T. La Junta Directiva del Instituto Costarricense de Turismo, mediante acuerdo N° SJD-245-2012, de la Sesión Ordinaria 5749, Artículo 5, Inciso X, del veintinueve de mayo del dos mil doce, autorizó la conciliación como jerarca superior del Instituto.

(ver certificación de la Secretaría de Junta Directiva sobre la autorización a folios 1272 al 1283 del Expediente) HECHO SEXTO.- CONSULTA LEY DE PLANIFICACIÓN URBANA. Mediante publicación en la Gaceta N°147 del treinta y uno de julio del dos mil doce, La Municipalidad de Aguirre cumplió con el procedimiento de Audiencia Pública, previsto en el Artículo 17 de la Ley de Planificación Urbana (Ver publicación, fotos, antecedentes y copia del acta original firmada, entre folios 1315 a 1319, frente y vuelto del Expediente Judicial). HECHO SÉTIMO.- NO SE PRESENTARON OPOSICIONES. Publicada en la Gaceta y otorgada la audiencia pública, no se presentaron oposiciones dentro del Procedimiento del Artículo 17 de la Ley de Planificación Urbana, según se acredita con el acta. (Ver folios 1315 vuelto y 1319 vuelto del Expediente Judicial) SEGUNDO.- HECHOS NO PROBADOS: De relevancia para resolver esta Solicitud de Homologación se tienen: ÚNICO.- No se aprecia que haya omisión o faltante de criterios legales, estudios y criterios técnicos, ni tampoco que falten razonamientos jurídicos, procedimientos, motivo, contenido, o alguna afectación al debido proceso de los conciliantes, tampoco hubo oposiciones en la audiencia pública.

(Ver los autos y expedientes del proceso) TERCERO.- INFORMACIÓN SOBRE LOS DEBERES, DERECHOS Y PRINCIPIOS QUE SUSTENTAN A TODA CONCILIACIÓN JUDICIAL. Se ha garantizado desde el inició de la primera convocatoria a conciliación y reiterándose su aplicación para todas las eventuales audiencias separadas y conjuntas, e informado a todas las partes intervinientes sobre el objeto, la naturaleza, los derechos y deberes que les asisten, sustentados en los principios que rigen el Instituto de la Conciliación y su aplicación en las Sedes Jurisdiccionales, de conformidad con los principios que rigen la conciliación, contenidos en la Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social, entre otros puntualmente: a) Principio de Libertad: parte del reconocimiento del derecho que tienen las partes en conflicto, para adoptar la conciliación como un medio alternativo para la resolución de sus controversias, como facultad potestativa, corresponde y se proyecta tanto en el derecho legal y constitucional a ser convocados a conciliación, para participar libremente en un proceso de búsqueda de soluciones al conflicto, como también en la obligación jurisdiccional de respetar ese derecho y convocar oportunamente, a efecto de no incurrir en una ilegal sustracción del conflicto y afectación del debido proceso, lo anterior implica necesariamente que si se cumplen los presupuestos de cada materia o salvando excepciones de ley, deberá necesariamente realizar la convocatoria a conciliación.

Por otro lado este principio también sustenta el derecho a renunciar a la conciliación, tratándose de un derecho legal, constitucional e integral al debido proceso, solamente podrá entenderse renunciado en aquellos casos cuyas formalidades respondan a las previstas expresamente por el ordenamiento, sea de forma expresa oralmente o por escrito, o bien tácitamente por ausencia a la convocatoria, siendo que si la ley no prevé la renuncia por falta de manifestar expresamente el interés en conciliar, nunca resultaría válido entender que se aplica una renuncia ficta; así por ejemplo en materia penal el Legislador otorgó y regulo este derecho para las personas imputadas y víctimas, en los artículos 36 y 317 del Código Procesal Penal, al establecer la procedencia de la conciliación en cualquier momento hasta antes de acordarse la apertura a juicio, lo anterior implica como garantía del debido proceso y acceso a la justicia autorestaurativa, la posibilidad real de proponer un acuerdo y someterlo a homologación en cualquier momento antes de ordenarse la apertura a juicio, sin que pueda sustraerse válidamente este derecho a las partes, ni sustentado en la omisión previa de manifestar anuencia a conciliar, ni argumentando la negativa previa, si es que ha mediado posteriormente un cambio en la voluntad, lo anteior solamente con las salvedades ya previstas en la Ley.

Así también en el Código Procesal Contencioso Administrativo, artículos 70.2, 72 y siguientes, el Legislador garantiza a las personas demandantes y demandadas su acceso a la justicia auto restaurativa, mediante el derecho a la conciliación, en esta Jurisdicción el legislador previó obligatoriamente la convocatoria a conciliación antes de la audiencia preliminar, en todos los casos que no se haya manifestado expresamente la renuncia por alguna de las partes, consecuentemente únicamente se estableció como supuesto legal de renuncia tácita, la que se genera ante la ausencia injustificada de la parte a la convocatoria previamente señalada. b) Principio de Confidencialidad: este se proyecta sobre el contenido de las actividades preparatorias, conversaciones y convenios que anteceden el posible acuerdo, así como de las actuaciones que se realicen dentro del proceso conciliatorio, incluyendo la información que se reciba en reuniones separadas con las partes, es el mantenimiento obligatorio de la necesaria reserva y privacidad de toda esa información, teniendo tanto el Juez como las partes, el deber de guardar absoluta reserva de lo manifestado y acontecido, resultando absolutamente confidencial; para los abogados intervinientes, con lleva la aplicación al deber del secreto profesional, en cuanto a las confidencias que exponga el cliente al profesional.

Esta garantía para la personas que someten sus diferencias a un tercero imparcial, les permite ser lo suficientemente amplias en el planteamiento del conflicto, trascendiendo a los aspectos que podrían no tener relevancia procesal, como las afectaciones emocionales o conflictos familiares, así las partes deben tener la certeza de que nada de lo que allí digan podrá ser utilizado en su contra en algún momento, razón por la cual el ideal de justicia autorestaurativa requiere, sin duda, que el mediador o conciliador sea diferente al juez que lleva el caso, como sucede con las Unidades de Conciliación de los diferentes circuitos judiciales, esta tendencia de separación también fue adoptada en el Código Procesal Contencioso Administrativo, al crear el Legislador la figura del Juez Conciliador de lo Contencioso Administrativo, quien con toda la independencia y garantía constitucional que reviste el cargo, debe velar por mantener la aplicación de la confidencialidad. c) Principio de Información: este se proyecta en momentos diferentes dentro del procedimiento de conciliación, inicialmente hay un deber del Juez Conciliador de explicar con claridad los derechos, principios y deberes que cubren a todos los intervinientes en la conciliación, el modelo de negociación y detalles del trabajo que se va a realizar dentro del proceso, explicar el rol del juez tanto en lo relativo a la conciliación como en lo referente a la eventual homologación, el Rol de las partes intervinientes y sus compromisos, así como las diferentes etapas que comprende la conciliación.

Posteriormente y sin perjuicio de que siempre se podría adecuar el curso de la negociación para tutelar ese principio de información, tenemos que a su vez este sustenta el denominado “principio de decisión informada”, que consiste en que las partes conozcan todas y cada una de las consecuencias e implicaciones de los acuerdos producto de la conciliación, las normas del ordenamientos que inciden en lo acordado, el carácter de la sentencia de homologación, sus efectos, posibles impugnaciones y eventual ejecución. De ahí que al imponer el Legislador una obligación al Juez de informar a las partes (Art 11 Ley Rac), implica que para poder sustanciar el debido proceso se requiere materializar al inicio de cada conciliación, esa garantía de información para todas las personas intervinientes. d) Derecho de Formación, la anterior obligación del Juez de informar correcta y probidamente, a su vez permite dar contenido al derecho a educarse y formarse en la resolución alterna de conflictos y la promoción de la paz social (Art 1° de Ley Rac), siendo que todas las personas usuarias de la conciliación judicial, tendrán al menos el benefició implícito de poder conocer y entender mejor el funcionamiento del Instituto de la Conciliación, explicado desde la perspectiva de cada jurisdicción y sus particularidades. e) Principio de No Violencia.- Se proyecta en dos aspectos básicos, primeramente como un medio oportuno para evitar y prevenir situaciones de violencia futura, buscando que no haya una mayor escalada del conflicto; pero también la ausencia de violencia se proyecta como una condición de conciabilidad, de ahí que en todo momento el trato e intervenciones entre todas las partes, deben darse en forma pacífica, sin insultos, ofensas, gritos; en caso contrario no podría haber conciliación, debiendo declararse fracasada, así por ejemplo si un apoderado judicial insultara durante la audiencia de conciliación a su colega contra parte, esto por ejemplo no podría ser objeto de un proceso disciplinario ante el Colegio Profesional, ni tampoco de una Querella por injuria o difamación en el Tribunal Penal, lo anterior en razón de la Confidencialidad que cubre todo de lo acontecido en audiencia; sin embargo sí generaría una condición suficiente para determinar y declarar el fracaso de la audiencia. f) Principio de Igualdad con asidero Constitucional, este principio también informa al derecho de No Violencia, siendo intrínseco un trato igualitariamente respetuoso de los derechos de todas las partes.

Esta garantía de un trato igualitario e imparcial comprende tanto la no discriminación por motivos de religión, escolaridad, afinidad política, como también la imposibilidad de trato preferencial por involucrar a un poder público o institucional, gran poder económico o político o grupos de hecho u otras fuerzas vivas de la sociedad. g) Principio de Imparcialidad Entendiéndose también relacionado a los dos anterior, consiste en la garantía para las partes en conflicto, de ser acompañados en el proceso por un Juez Independiente, que va a brindar y garantizar un trato imparcial, que no va a actuarse con favoritismos para ninguna de ellas. h) Conflicto de Intereses, tal y como se expuso en el punto anterior, esta garantía de imparcialidad que viene permitiendo que el conflicto sea sometido de forma amplia e integral; a permitido reconocer y establecer los mecanismos idóneos para evitar la intervención en aquellos casos en que se estime pueda llegar a surgir un conflicto de intereses, lo cual podría suceder aún con pleno respeto a los anteriores principios, por ejemplo si hubiese parentesco por afinidad, o que las partes sean las vecinas del frente de la casa del Juez. i) Los Principios de Participación y de Autocomposición sustentan el necesario protagonismo que las partes deben asumir durante la conciliación, es de esperar que se adopte un papel activo en la generación de ideas y en la construcción de posibles soluciones, siendo que la decisión de adoptar los términos acordados será tomada únicamente por ellas, siendo rol del Juez el de facilitador y guía sobre las posibles limitaciones y requisitos que exige el ordenamiento. j) Principio de la Voluntariedad, toda la participación en la conciliación y la suscripción del eventual acuerdo es voluntaria, no solamente por lo indicado en los anteriores principios y el papel activo que se espera asuman, al poder manifestar su voluntad tanto durante el proceso de negociación como en el acuerdo; siendo muy importante que el Juez logré dar a entender los límites se imponen por parte del ordenamiento jurídico, delimitar los ámbitos por los cuales puede ir la conciliación, requerir una actuación amparada a la buena fe y no contravenir normas de orden público, la moral y buenas costumbres. k) Oralidad, resulta indispensable e imprescindible dentro del proceso de conciliación, si bien no suelen encontrarse normas que la incorporen expresamente, su aplicación resulta implícita en la inmediación personal de las partes o sus representantes, convocados para reunirse conjunta o separadamente, adicionalmente el Consejo Superior del Poder Judicial, ha adoptado oficialmente la promoción del Modelo de Negociación por Etapas, donde la oralidad es el medio idóneo para que las partes puedan expresarse libremente y en confidencialidad, procurando las condiciones necesarias para lograr una búsqueda conjunta de soluciones.

En el caso de la Jurisdicción Contenciosa Administrativa, se incorporan dentro de la novedosa transformación procesal, una serie de garantías que reivindican el papel de las personas frente al proceso, ampliando tanto la legitimación activa, como también otras formas de participación, incluso señalando puntualmente en el artículo 85 del Código Procesal Contencioso Administrativo, el deber del Tribunal de asegurar el pleno respeto a los principios de la oralidad durante las audiencias, entendido en este caso que la actuación del Juez Conciliador, lo es en función de la competencia del Tribunal Contencioso Administrativo, en este caso como un órgano o tribunal unipersonal. l) Principio de Contextualidad, en términos generales implica que todo lo que suceda deberá estar referido y tomar en cuenta el contexto de las partes en conflicto, a su propia realidad y no a la del mediador u otras partes involucradas, así en el proceso de construcción, las partes del acuerdo toman en cuenta sus necesidades, percepciones y emociones.

El cumplimiento de este principio permite la viabilidad del acuerdo, la coincidencia entre las soluciones y las realidades de las partes, así como un mayor compromiso con el acuerdo, mayor nivel de satisfacción y genera la permanencia del acuerdo en el tiempo. Así por ejemplo de manera directa, podemos ver como una realidad común a los diversos entes y órganos sujetos a la Jurisdicción Contenciosa, todas las necesidades que de manera particular deben cumplirse para conciliar cuando se despliega una actividad pública o de interés público, criterios técnicos, jurídicos, entre otros suficientes para que en cada caso, se pueda sustentar la eventual Autorización del Superior Jerarca Supremo, para que a su vez esa conducta administrativa plasmada, sean el objeto de análisis de la legalidad y apego en general al ordenamiento jurídico, así como también reflejar la no afectación del interés público.

Consecuentemente también la realidad del conflicto para todas las personas particulares físicas o jurídicas, sean demandantes o demandados, queda marcada por la relación subyacente que existe, así que serían diferentes las realidades cuando se trata de un usuarios que reclaman mal funcionamiento del servicio, a cuando sea una empresa que reclama pago de facturas pendientes, o un trabajador que impugna una sanción, y sin embargo todas podrían ser contra una misma institución pero bajo diversas relaciones administrativas.

CUARTO.- LA FUNCIÓN DEL CONCILIADOR Y LA INDEPENDENCIA COMO JUEZ CONTENCIOSO ADMINISTRATIVO. CONTROL DE CONVENCIONALIDAD Y ORDENAMIENTO JURÍDICO. Como primer garantía de las partes intervinientes de un proceso judicial, tenemos el denominado Derecho Humano a un Juez Independiente, sustentado en el principio de autonomía e independencia del juez, siendo que para el caso de la Constitución de Costa Rica tenemos que “… el artículo 154 insiste sobre el tema subrayando que la única sumisión del Poder Judicial, sus jueces y funcionarios, solamente lo es con la Constitución y a la ley. Esta norma fundamental constituye una doble garantía para la justicia: por una parte, consagra su independencia de cualquier poder de hecho o jurídico, sujetándola únicamente a la Constitución y a la ley, en ese orden..." (Comisión de Magistrados, Sesión de Corte Plena 16-99 , citada por Dr. Gilberth Armijo en "La Independencia del Juez Constitucional, su destitución y la Corte Interamericana de Derechos Humanos ).

Este principio también ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia, señalándose que: " Dentro de los regímenes políticos democráticos, el principio de independencia del juez, en particular, y del Poder Judicial, en general, tiene un valor fundamental porque sobre él descansan la legitimidad del juez y la imparcialidad de la decisión judicial." (Tribunal Constitucional Resolución N° 9495-2008, también N° 6632-01 y N° 7227-05) Estos derechos también son reconocidos en gran cantidad de Instrumentos de Derecho Internacional, vigentes en Costa Rica, como lo son puntualmente El Pacto de San José, artículos 1°, 8 y 24 y también encontrados en la Declaración Universal de Derechos Humanos, Carta de Naciones Unidas y en los Pactos Internacionales de Derechos Civiles y Políticos, y en el de Derechos Económicos, Sociales y Culturales. La Declaración de Naciones Unidas de Principios Básicos relativos a la Independencia de la Judicatura, contiene como garantía objetiva para la ciudadanía en general, el cumplimiento de una serie de elementos preponderantes tales como la integridad, la idoneidad y formación o calificaciones jurídicas apropiadas; mientras que a su vez se constituye como una garantía subjetiva para el juez de contar con un adecuado proceso de nombramiento, la inamovilidad en el cargo y la garantía contra presiones externas, siendo de este modo desarrollado por la Corte Interamericana de Derechos Humanos en los casos de Tribunal Constitucional vrs República del Perú y Corte Primera de lo Contencioso Administrativo vrs República Bolivariana de Venezuela.

Finalmente resulta muy importante lo señalado en el Caso de Nombre25533 vrs Costa Rica donde dijo: "...los jueces, a diferencia de los demás funcionarios públicos, cuentan con garantías reforzadas debido a la independencia necesaria del Poder Judicial, lo cual la Corte ha entendido como “esencial para el ejercicio de la función judicial”. Así las cosas desde el momento en que la función de Conciliador recae en la figura de un Juez de la República, se debe tener certeza que ese Rol, no solamente se asume con toda la probidad y capacitación que un conciliador habilitado debe tener para ejercerla, sino que además se impone como una especial garantía tanto para la ciudadanía en general y también para las partes, la Independencia Judicial y la Imparcialidad ante cualquier poder público, grupo de hecho, o particular ; tanto durante la fase de negociación, como en el acuerdo y la eventual sentencia de homologación y hasta ante su posible fracaso.

También como una segunda garantía tanto a la ciudadanía en general como a las partes, tenemos en Control del Ordenamiento Jurídico y del Interés Público, el cual no solamente se impone para Judicatura Contencioso Administrativa, sino a todos los jueces del país, siendo que este incluye tanto la legislación interna de país, como también implica un Control de Convencionalidad, sobre los derecho reconocidos en tratados internacionales y que son ratificados en nuestro país mediante leyes; sobre este particular el investigador jurídico de la UNAM y actualmente miembro de la Corte Interamericana de Derechos Humanos, el Juez Eduardo Ferrer Mac-Gregor ha señalado que el control de convencionalidad "consiste en el examen de compatibilidad que siempre debe realizarse entre los actos y normas nacionales, y la Convención Americana sobre Derechos Humanos (CADH), sus Protocolos adicionales, y la jurisprudencia de la Corte Interamericana de Derechos Humanos (Corte IDH), único órgano jurisdiccional del Sistema Interamericano de Protección de los Derechos Humanos, que interpreta de manera “última” y “definitiva” el Pacto de San José.

Se trata de un estándar “mínimo” creado por dicho Tribunal internacional para que en todo caso sea aplicado el corpus iuris interamericano y su jurisprudencia.. así como informes, recomendaciones, observaciones generales y demás resoluciones de los organismos y tribunales internacionales." (Obras citadas en Tratado de Derecho Procesal Constitucional, del Profesor Dr. Nombre160962 , 2011, también jurisprudencia en http://www.corteidh.or.cr y consultar doctrina http://www.juridicas.unam.mx) QUINTO.- NATURALEZA DEL INSTITUTO DE LA CONCILIACIÓN Y DE LA HOMOLOGACIÓN EN LA JURISDICCIÓN CONTENCIOSO ADMINISTRATIVA. Como Instituto se referencia al conjunto de normas y principios jurídicos que informan tanto el desarrollo, acuerdo y eventual homologación, como también el posible fracaso; incluye tanto principios constitucionales como aquellos reconocidos en tratados, como leyes generales y normativa especial, en general todas aquellas que deban integrarse a la aplicación particular de cada tipo de conflicto.

Se trata de un mecanismo de resolución alterna, de carácter no adversarial y autocompositivo, y que como todo negocio jurídico implica una convención de voluntades, en este caso un acuerdo entre dos o más personas componentes de la relación jurídico procesal que sustenta la acción judicial. Aunque también pueden haber acuerdos parciales, tanto en relación a los puntos convenidos como a los intervinientes, su objetivo primordial es finalizar el litigio integral y completamente, mediante un acuerdo por el cual se constituyen, reconocen, modifican o extinguen las relaciones jurídicas, al revestir con carácter de cosa juzgada la homologación del acuerdo conciliatorio. Con este se viene a sustituir el mecanismo heterocompositivo y adversarial correspondiente a la sentencia de fondo, que ordinariamente resolvería el órgano jurisdiccional natural, mediante la aplicación del derecho al caso concreto, y en su lugar las partes someten a homologación ante el juez conciliador, el acuerdo que se ha logrado intraprocesalmente en el seno de la conciliación judicial.

La homologación por su parte se genera a partir de una resolución judicial, la cual sustancialmente se avoca a analizar y verificar de una manera razonada y debidamente motivada, que los términos del acuerdo no sean contrarios al ordenamiento jurídico y que tampoco se produzca una lesión al interés público, siendo que al otorgarle el carácter de cosa juzgada material y obtener la finalización del proceso, la naturaleza de la Homologación correspondería a la de un Auto con carácter de Sentencia. (Ver artículos 57, 76, 77, 134 y 153 del CPCA) La motivación debe tener claridad en cuanto a los razonamientos que derivaron en la decisión adoptada en la parte dispositiva de la sentencia, debiéndose exponer las razones que los llevaron a fallar. Además no debe ser omisa, ni confusa ni contradictoria en su desarrollo, debiendo exponer con claridad las consideraciones que le permitieron llegar a lo resuelto, o en este caso a homologar el acuerdo conciliatorio, debiendo responder por qué lo acordado no es contrario al ordenamiento y por qué no hay afectación del interés público.

(Ver entre otros Sala Primera votos 126-2009 y 318-2011). Como negocio jurídico la conciliación, requiere por validez y eficacia, además de contar las partes con capacidades suficientes, ocupa de un objeto cierto o posible y una causa justa; así como establecer las condiciones de modo, tiempo y lugar para el cumplimiento de las obligaciones contraídas (Artículos 36, 627, 628, 629, 630 y 631 del Código Civil). La Autorización Expresa se estableció como requisito a la participación de la Administración Pública, para el Gobierno Central deberá ser emanada por la Procuradora General o sus Adjuntos, en los otros supuestos deberá ser otorgada por el Superior Jerárquico Supremo o el órgano en que se delegue, según se estableció en el Artículo 73 incisos 2 y 3 del Código Procesal Contencioso Administrativo. El control de la legalidad, del Ordenamiento Jurídico y la no afectación del interés público, se imponen de manera reforzada al derivarse y contenerse tanto en la Ley General de la Administración Publica art 14.3; como también en la Ley de Resolución Alterna de Conflictos arts 3, 5 y 13.b, y especialmente en el artículo 76 del Código Procesal Contencioso Administrativo; así las cosas, tenemos por ejemplo que en el caso de la Administración Pública, su negociación también se encuentra sujeta a ese control, siendo que como conducta de la administración, lo comprometido también deberá estar apegado a la ciencia y la técnica, así como tampoco contrariar los principios elementales de justicia, lógica y conveniencia; imponiéndose garantizar los principios constitucionales de razonabilidad y proporcionalidad y cualquier otro aplicable al caso; siendo indispensable que quede plasmado claramente el motivo, contenido y fin de su conducta, pues es sobre esta es que se ejercerá el control jurisdiccional.

En el caso de las personas particulares, físicas o jurídicas se debe acreditar la identidad de la persona, ya sea el titular o su representante, así como el alcance de sus mandatos y poderes derivados, la disponibilidad de los derechos comprometidos y no afectación de derechos irrenunciables o de terceros. Todo lo que se ha expuesto, junto con aquellos puntos que particularmente se deriven del caso concreto, deben ser analizado en las consideraciones de la homologación, sin olvidar que sustancialmente se debe razonar sobre el por qué es o no contraria la conciliación con ordenamiento jurídico, así como el por qué sería o no lesiva al interés público.

SEXTO.- TUTELA AL MEDIO AMBIENTE Y LA PROTECCIÓN DE LOS ESPECIALÍSIMOS ECOSISTEMAS DENOMINADOS HUMEDALES. Dentro de la tutela al Medio Ambiente, se han adoptado dentro del Ordenamiento Jurídico costarricense una serie de Instrumentos Internacionales tendientes a la protección de estos importantes ecosistemas, "los humedales constituyen uno de los tipos de hábitats sujetos a mayor presión, debido al drenaje para su urbanización o la conversión en tierras de cultivo o ganaderas" (Richard Primack y otros, Fundamentos de Conservación Biológica , primera edición 2001). En el caso de Costa Rica, dentro de la investigación jurídica ambiental, el consultor y Profesor Mario Peña Chacón a conceptualizado que "Los humedales son unidades ecológicas, sumamente frágiles, que llevan a cabo una gran cantidad de procesos naturales de importancia para la humanidad y para el propio sistema ecológico, constituyen un importante sitio de alimentación, refugio y reproducción para una gran variedad de especies silvestres, por lo que reviste especial relevancia su protección y conservación.

Son ecosistemas complejos y frágiles, constituidos por una serie de componentes físicos, químicos y biológicos, que corresponden a suelos, aguas, especies animales y vegetales y nutrientes, los cuales asociadas a la presencia fluctuante o intermitente de flujos de agua, determinan la biodiversidad del medio. Dentro de los beneficios que proporcionan los humedales se encuentran: el suministro de agua tanto para la explotación directa como para la recarga de acuíferos por infiltración; regulación de flujos de suma importancia para el control de inundaciones; prevención y protección contra el ingreso de aguas saladas que afecten aguas subterráneas y aguas dulces superficiales; protección contra las fuerzas de la naturaleza como tormentas, huracanes, etc.; retención de sedimentos, nutrimentos y tóxicos; fuente suplidora de productos naturales como madera, los derivados de la vida silvestre y acuáticos como moluscos, crustáceos y peces; producción de energía; transporte; conservación, recreación y turismo; investigación y educación; biodiversidad y patrimonio cultural; paisaje y belleza escénica; y mantenimiento de los procesos ecológicos esenciales" (Tutela Jurídica de los Ecosistemas de Humedal, Revista Jurídica N°99, Marzo del 2011).

La protección jurídica internacional de los humedales la podemos encontrar de manera directa en la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas, mejor conocida como Convención Ramsar, la cual entró en vigor el 21 de diciembre de 1975 y que Costa Rica ratificaría mediante Ley N° 7224 del 09 de abril de 1991; adicionalmente de manera indirecta se deriva su protección en la Convención para la Protección de la flora, de la fauna y de la bellezas escénicas naturales de los países de América, suscrito en la ciudad de Washington el día 12 de octubre de 1940; también en la Convención sobre el Comercio Internacional de Especies Amenazadas de flora y fauna silvestres, conocida como Convenio CITES; así que incluso podemos ver como La Corte Internacional de Justicia, en el caso de Costa Rica contra Nicaragua por el dragado del Río San Juan y la posible afectación humedales, el 8 de marzo del 2011, concedió dentro de sus medida cautelares, la posibilidad para que Nombre21605 penetrara en la zona, lo que según el experto en derecho internacional público, Profesor Nicolas Boeglin obedece a la preocupación de no permitir que daños irreversibles se cometan en la zona de Isla Calero, pero supeditando cualquier acción o iniciativa de Nombre21605 a una coordinación de Nombre21605 con la Secretaría de la Convención Ramsar (derechointernacionalcr.blogspot.com).

También nuestro Alto Tribunal Constitucional, sobre la importancia y obligación de proteger los humedales, con redacción de la Magistrada Nombre368 en sentencia número 6246-2007, ha señalado " La diversidad biológica y el grado de complejidad ecológica no están distribuidas de forma homogénea en todo el planeta, ya que tiende a concentrarse en puntos claves que poseen una enorme importancia y por lo tanto son altamente significativos, desde una perspectiva socio-económica, cultural, educacional y estética. Existen pocos puntos claves que posean tanto valor como los humedales y son considerados como parte de los ecosistemas más productivos del mundo..." "Es responsabilidad de cada uno de los habitantes de este planeta, asumir una conciencia ambiental global, tomando medidas personales que favorezcan el retorno de la armonía entre los seres vivos, para una mejor calidad de vida para todos, no solo pensando en el presente, sino también en el futuro.

Por consiguiente, también es deber de este Tribunal velar por la protección de los humedales de conformidad con el derecho a un medio ambiente sano y ecológicamente equilibrado consagrado por la Constitución Política en el artículo 50, e incluso por el mismo derecho a una calidad de vida..." Dentro de posible tutela jurisdiccional, los Humedales encuentran protección, no solamente en las leyes que ratifican los instrumentos internacionales, pues también dentro de la Legislación Nacional, han quedado cubiertos como cuerpos de aguas bajo las definiciones del Artículo 1° incisos I y II de la Ley de Aguas N° 276 de 1942, siendo que posteriormente desde el año 1992, en la Ley de Conservación Silvestre, artículo 2°, el legislador adoptó la definición ya contenida en la Convención Ramsar; adicionalmente también como sucede con todo ecosistema y en razón de su importancia para la vida del planeta, puede derivarse indirectamente su tutela en otras normas como La Ley de Biodiversidad, Ley Orgánica del Ambiente, o incluso por medio de la tutela a los principios elementales de la ciencia, técnica, justicia, lógica o conveniencia contenidos en la Ley General de la Administración Pública, tal y como se sustentó en Sentencia 1476-2010 del Tribunal Contencioso Administrativo, en la cual se resolvió medida cautelar en contra de la explotación de la Mina Crucitas, sentencia cautelar que posteriormente sería ratificada por el Tribunal de Apelaciones y cuyo proceso de fondo fue declarado con lugar y posteriormente ratificada la sentencia por la Sala Primera, ya encontrándose en firme y agotada la vía en el derecho interno costarricense.

También dentro de la Jurisdicción Contencioso Administrativa, se ha abordado el tema de Humedales y su afectación, desde la perspectiva tanto de conductas de la Administración como también de particulares, en casos que afectan a Zonas de Humedales, así por ejemplo La Sala Primera de la Corte Suprema de Justicia, en Voto 119-F-2005, conociendo sendos recursos de casación por el fondo contra la Sentencia N°55-2002 del Tribunal Contencioso Administrativo, redactada por el Juez José Paulino Hernández Gutiérrez de la Sección I, indicó "Como bien lo señaló el Ad-quem, la sola intervención del ser humano, afectará los ecosistemas existentes en los humedales, conformados por los manglares, donde se pretende desarrollar dicho proyecto. Se aprovechará sus condiciones naturales, las cuales, según el considerando marcado con el número 4 del Decreto Ejecutivo número 22550-MIRENEM de 14 de setiembre de 1993, publicado en La Gaceta número 193 del 8 de octubre de 1993, mediante el cual se declaró humedales a las áreas de mangles adyacentes a los litorales continentales e insulares del país cualquiera que sea su extensión, “... está constituido por un número reducido de especies vegetales, por lo que se constituye en un sistema de gran fragilidad, en los cuales las alteraciones ecológicas tienen consecuencias que van más allá de las regiones mediatas e inmediatas.” De conformidad con los apartados 5, 6 y 7, ibídem, el interés en su protección estriba en: “5o - Que debido a su alta productividad, en los humedales estuarinos se concentran etapas postlarvales de un elevado número de especies comerciales en las que está basada la pesca artesanal y semi-industrial del litoral, actividades que constituyen el sustento económico de muchas familias costarricenses. 6o- Que la estructura trófica de los humedales estuarinos no solamente garantiza la supervivencia de las especies propias de aguas estuarinas, sino que también tiene implicaciones mediatas sobre la estructura trófica de especies comerciales de aguas más distantes. 7o-Que los humedales estuarinos físicamente constituyen el hábitat de especies de fauna y flora silvestre, algunas de las cuales se encuentran en vías de extinción o con poblaciones reducidas"...

(y) "En consecuencia, el motivo (elemento objetivo del acto administrativo) en el cual se fundamenta la resolución resulta ilegítimo, (Sala Primera, redacción Magistrado Román Solís Zelaya ) SÉTIMO.- P ARTICIPACIÓN CIUDADANA EN MATERIA AMBIENTAL Y PLANIFICACIÓN URBANA. Señala el Principio 10 de la Declaración de Río "Los temas ambientales son manejados de una mejor manera con la participación de todos los ciudadanos involucrados. En el ámbito nacional cada individuo tendrá acceso apropiado a la información que tengan las autoridades públicas, concerniente al medio ambiente, incluyendo la información sobre materiales peligrosos y actividades en sus comunidades así como la oportunidad de participar en los procesos de toma de decisiones. Los estados facilitarán y alentarán la conciencia y participación pública, haciendo ampliamente disponible la información. Se proveerá acceso efectivo a procedimientos administrativos y judiciales incluyendo revisión y reparación.

Participación de la sociedad en la conservación del medio ambiente nacional, así como acceso apropiado a la información que tengan las autoridades públicas, resaltando su participación en los procesos de toma de decisiones." De este modo siendo que la debida valoración ambiental supone una proyección transversal, tanto sobre las conductas administrativas como también aquellas de los particulares, que implica una necesaria ponderación de las condiciones y la posible afectación al medio ambiente, no resulta extraño que acorde a los compromisos asumidos por Costa Rica para impulsar la Participación Ciudadana, se haya incorporado dentro de la Ley de Planificación Urbana, una garantía para la ciudadanía en general, de cumplir con la audiencia pública prevista en su Artículo 17, esta audiencia cuyo sustento normativo inmediato es la ley; pero que de igual forma se ha venido incorporando recientemente y de manera transversal a los Tratados Internacionales de diversas materias, como los Pueblos Indígenas, Personas Menores, Protección Ambiental, Violencia de Género, Derechos del Consumidor y otros; siendo que además cada país ha buscado mecanismos internos para promover la participación ciudadana, como se ha establecido y garantizado mediante la aplicación de los sendos procedimientos y procesos con audiencias públicas que reconoce nuestro ordenamiento, incluyendo también la actividad jurisdiccional, según lo ha previsto el Legislador en los Artículo 13 y 14 de la Ley de Notificaciones, para cuando existen derechos e intereses grupales, difusos o colectivos.

Ya la Sala Constitucional de manera reiterada ha conocido sobre la constitucionalidad de los planes reguladores y su relación con el medio ambiente, en Sentencia 17388-2007, con redacción del Magistrado Gilberth Armijo Salas, señaló "Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto a consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias, que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, o el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas negras o residuales (Acueductos y Alcantarillados y Ministerio de Salud), o no verificar los controles sónicos en bares, karaokes y discotheques (municipalidades y Ministerio de Salud), etc...

Luego también en en sentencia 19747-2010, con redacción de la Magistrada Rosa María Abdelnour Granados, señaló que " Según la doctrina, el estudio de impacto ambiental apareció, desde sus orígenes, relacionado con la tradición anglosajona de las encuestas y audiencias públicas, por lo que se debe resaltar la garantía que a lo largo de la evaluación y, en sus distintos momentos, serán oídos los afectados por la decisión final, que pueden ser no sólo las comunidades o sujetos inmediatamente involucrados, sino grupos que defienden intereses difusos, como lo es la oportuna protección al medio ambiente. (En similar sentido de esa misma sala los votos 8667-2010 y 7962-2011). También ya lo habría reconocido la Procuraduría General de la República, mediante el dictamen C-094-2005, donde el Procurador Julio Jurado Fernández concluyó que "la audiencia pública prevista en el artículo 17 de la ley de planificación urbana tiene como propósito promover y fomentar la participación ciudadana en la toma de decisiones, y es un requisito legal de cumplimiento obligatorio por parte de las municipalidades que pretendan implantar un plan regulador local en su cantón." OCTAVO.- ANÁLISIS DE LOS REQUISITOS, ELEMENTOS, CONDICIONES Y CARACTERÍSTICAS PARTICULARES DE ESTA CONCILIACIÓN.

Legitimación de los suscribientes . Tenemos que para el acuerdo conciliatorio que se conoce en esta sentencia de homologación, suscribieron el acuerdo en representación de la Contraloría General de la República, su abogado y Apoderado, el Licenciado Esteban Villalobos Fernández; en representación de la Municipalidad de Aguirre, la Alcaldesa María Isabel León Mora y su abogado el Licenciado Josue Salas Montenegro; por el Instituto Nacional de Vivienda y Urbanismo, su abogada y Apoderada General, la Licenciada María Cecilia Robles Martínez; por parte del Instituto Costarricense de Turismo, su abogado y Apoderado, el Licenciado Jimy Álvarez García; así como también Alexander Castillo Aguilar, como Juez Conciliador de lo Contencioso Administrativo, en ese sentido de conformidad a los términos contenido en los sendos apersonamientos, personerías y poderes acreditados al expediente, lo señalado en el resultando quinto y las autorizaciones acreditadas en el considerando primero y las actuaciones desplegadas durante la conciliación, se estima que todas las partes y sus intereses han estado válida y probidamente representados en durante la conciliación.

(Ver respectivamente folios 120, 1263, 207, 138 del Expediente Judicial) La autorización expresa, de manera adicional a la requerida representación válida, tenemos que el legislador al reconocer el derecho a la conciliación, utilizó como requisito de control adicional, en los incisos 2° y 3° del artículo 73 CPCA, la necesidad de contar con una Autorización Expresa del Jerarquico Superior Supremo respectivo, es decir igual que como ya se exigía para el allanamiento o desistimiento desde antes de la reforma contencioso administrativo, siendo que tal y como ha tenido por acreditado en el considerando primero de esta resolución, todas las partes intervinientes sí cuentan con sus respectivas autorizaciones. Objeto de la conciliación : En el caso concreto, el objeto de la conciliación se centra en el reconocimiento de los vicios de nulidad absoluta que contienen el plan regulador, su ampliación, las declaratorias de calle pública, y consecuentemente actos conexos y derivados como las concesiones; así como el establecimiento y compromiso con una serie de acciones tendientes a la restauración del patrimonio natural afectado, mediante la implementación de un plan de trabajo valorado conjunta y técnicamente.

Causa Justa, según lo expuesto, la causa de lo acordado se sustenta en procurar el cumplimiento de la obligación de protección y restauración ambiental del Humedal identificado como Estero Hatillo Viejo N° 549, obligación adquirida por Costa Rica y de aplicación tanto en los tres Poderes de la República, como sus órganos, entes, funcionarios y jueces de todo el país, mediante la ratificación de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas, ratificada mediante Ley N° 7224, conocida Convención Ramsar; y su consecuente relación con el derecho a un ambiente sano y ecológicamente equilibrado contenido en el artículo 50 constitucional, así como las derivadas en la Ley Orgánica del Ambiente y la Ley de Biodiversidad, entre otras. Condiciones de modo, tiempo y lugar, estas particularmente valoradas jurídica y técnicamente de previo a la suscripción del acuerdo, sí se aprecian establecidas dentro de lo acordado, entendiendo la existencia de suficientes elementos para que en fase de ejecución se pueda valorar sobre su cumplimiento o cualquier eventualidad que fuera necesaria conocer.

Ordenamiento Jurídico , se estima como punto medular de lo conciliado, que la conducta administrativa que en este caso es objeto de control jurisdiccional, se encuentra previamente contemplada dentro de los alcances del Art 17 de la Ley de Planificación Urbana, en la cual se regulan tanto las potestades de aprobación como también de las de suspensión, modificación parcial, derogación total, entre otras; siendo que además también el Legislador depositó estas competencias, previendo una tramitación Interinstitucional y legitimando a los respectivos superiores jerárquicos supremos, más representativas y colegiadas; coincidiendo esta línea legislativa con la del articulo 73.3 del Código Procesal Contencioso Administrativo, siendo así las mismas autoridades competentes que han debido autorizar esta conciliación judicial. Sobre el Interés Público de la Participación Ciudadana y la Especial Protección Ambiental de los Humedales.

Desarrollo Turístico Sostenible. Como ha quedado expuesto y desarrollado durante la sentencia y en particular en los considerandos sexto y sétimo, resultan de gran relevancia en materia de planes reguladores, los intereses públicos cuyo sustento normativo de mayor jerarquía los encontramos en los artículos 9 y 50 de la Constitución Política de la República de Costa Rica, el Principio 10 de la Declaración de Río y la Ley 7224 de la Convención Ramsar. Así por un lado tenemos primero la valoración del interés publico en la Especial Protección Ambiental de los Humedales, como derivación del derecho a un ambiente sano y el reconocimiento de su fragilidad e importancia especial entre todos los ecosistemas. Luego y no menos relevante tenemos como otro interés público a tutelar, la garantía de permitir la Participación Ciudadana mediante la audiencia pública, la cual también reviste de especial interés público, siendo unas de las formas en que el pueblo ejerce funciones de gobierno de forma participativa ( Constitución Política de la República de Costa Rica: Art 9 "El Gobierno de la República es popular, representativo, participativo, alternativo y responsable.

Lo ejercen el pueblo y tres Poderes distintos e independientes entre sí...). Ahora bien teniendo diferenciados ambos intereses a ponderar, resulta oportuno señalar sus coincidencias, pues toda protección ambiental, se verá implícitamente fortalecida, mediante los mecanismos de participación ciudadana, los cuales permiten no solamente controlar y denunciar problemas de índole ambiental, sino también todas aquellas consideraciones de hecho y derecho que se puedan estimar oportunas, como las relacionadas con grupos de interés, la inversión social, sectores minoritarios, personas menores y adultas mayores, en brecha de genero, etc. Así las cosas el Legislador optó por conjugar dentro del procedimiento de los planes reguladores la participación ciudadana como un requisito indispensable, constituyéndose como parte del debido proceso y derecho de defensa de la ciudadanía en general y siendo que en el proceso de conciliación se deben respetar estos principios, han debido adecuarse los procedimientos tendientes a garantizar dicho interés público.

Lo anterior es el resultado de la debida ponderación y conjugación de intereses, pues existiendo el procedimiento, no podría suprimirse la tutela ambiental, aduciendo falta de objeciones en audiencia pública, como tampoco se podría lesionar la participación ciudadana en razón de procurar la tutela ambiental. Existe un interés público al Desarrollo Turístico Sostenible, el cual no se estaría viendo afectado pues el apoyo y desarrollo del sector turístico, como generador de empleo y fuente de los principales ingresos de país y la industria nacional, continua promoviéndose como gran interés público que representa; no obstante lo anterior se ha entendido que este desarrollo debe darse con respeto a los compromisos ambientales que Costa Rica ha asumido ante la comunidad internacional, lo cual permite precisamente que la inversión constructiva que se desarrolle en lugares donde no generen grandes lesiones ambientales, y que esta a su vez se vea fortalecida con la atracción turística que generan la flora, fauna y belleza natural en las distintas las zonas protegidas del país, siendo la cantidad de territorio protegido una de los principales fortalezas de atracción turística.

Consecuentemente no se estima que haya afectación del alguna al Interés Público. En razón de todo lo expuesto en las consideraciones que anteceden, analizando los mandatos y los sus alcances, se estima que este acuerdo no es contrario al ordenamiento jurídico, ni lesivo al interés público, en los términos de los artículos 76 y 77 de Código Procesal Contencioso Administrativo CPCA, razón por la cual una vez que adquiera firmeza, esta homologación, tendrá carácter de cosa juzgada material.

NOVENO.- OTROS INTERVINIENTES, DERECHO DE DEFENSA Y DEBIDO PROCESO PARA LA CIUDADANÍA EN GENERAL. Durante la Fase de Conciliación, se contó con la intervención de todas las partes, siendo que en el caso del Estado y el Sistema Nacional de Áreas de Conservación, ya la actora habría llegado a otro acuerdo conciliatorio (acuerdo y homologación que constan en el expediente), mientras que con los demás intervinientes ya se habría dado por fracasada la conciliación, como ha sucedido con la empresa Playa Matapalo Sociedad Anónima, en ese sentido a pesar de haber existido gestión previa de la empresa, para conocer sobre la conciliación de los negociaciones en las que no es parte, esta no fue resuelta por entenderla abiertamente contraria a lo establecido en los artículos 13.d y 14 de la Ley de Resolución Alterna de Conflictos, pues se atentaría contra la debida confidencialidad. No obstante lo anterior, tanto la empresa como también las demás partes intervinientes en el proceso tienen garantizado su derecho de defensa y debido proceso mediante, mediante la notificación de la sentencia al medio señalado y su posible impugnación mediante el recurso de casación, tanto en los términos y supuestos previstos en el artículo 134, como los del 153, ambos del Código Procesal Contencioso Administrativo.

Adicionalmente como una garantía para la participación de la ciudadanía en general y promover la transparencia, con sustento en los artículos 152 y 153 de la Ley General de Administración Pública, la Junta Directiva del Instituto Costarricense de Turismo acordó la publicación de la sentencia de homologación una vez dictada y notificada (Folio 1282 del Expediente Judicial), esta publicación a su vez cumple con los alcances de los artículos 13 y 14 de la Ley de Notificaciones, con lo cual a a partir de su publicación y hasta quince días después, podrán todas las personas interesadas, sean físicas o jurídicas, apersonarse al proceso para hacer llegar todas las consideraciones de hecho y derecho que estimen oportunas. Notifíquese a los medios señalados y publíquese.

DÉCIMO.- COSTAS PERSONALES Y PROCESALES. Señalan los artículos 193 y 197 del Código Procesal Contencioso Administrativo , que en sentencias y autos con carácter de sentencia, deberá haber aún de oficio pronunciamiento sobre las costas, exceptuando en casos previos a la audiencia preliminar cuando "Salvo acuerdo de las partes en contrario, no habrá condenatoria en costas, en caso de que se produzca desestimiento, allanamiento o satisfacción extraprocesal de la pretensión, antes de la audiencia preliminar o en el transcurso de esta; lo cual implica que para el caso concreto, siendo que el acuerdo expreso de las partes lo fue precisamente para asumir cada una sus costas, sí resulta procedente dictar esta sentencia sin especial condenatoria en costas, entendiéndose como las proporcionales a hasta esta fase del proceso.

POR TANTO

La solicitud de homologación del acuerdo conciliatorio mediante el cual se deroga -anula- el Plan Regulador de Playa Guápil, de conformidad con las consideraciones expuestas y con sustento en la Constitución Política de Costa Rica, artículos 11, 24, 27, 33, 41, 43, 45, 49, 169, 170, 183 y 184; Artículos 8.1, 24, 25 y 26 del Pacto de San José, el Derecho Humano a tener un Ambiente Sano, su efectiva protección y restauración, Convención Ramsar Ley N° 7224; Participación Ciudadana Principio 10 de la Declaración de Río; artículos 57, 72, 73, 76, 77, 113, 134 y 153 del Código Procesal Contencioso Administrativo; artículos 2, 3, 4, 17 y concordantes de Ley Orgánica del Ambiente; artículo 1, 3, 58 y concordante de la Ley de Biodiversidad; artículos 1, 2, 7 y concordantes de la Ley de Conservación de Vida Silvestre; artículos 2, 3, 4, 5, 6, 7, 12, 13 y 15 de la Ley de Resolución Alterna de Conflictos y Promoción de la Paz Social; artículos del 1 al 20, 190 siguientes y concordantes de la Ley General de la Administración Pública; artículos 13 y 14 de la Ley de Notificaciones; artículos 1, 8 y 38 de la Ley Orgánica de La Contraloría General de la República; artículos 10 y 14 de la Ley Orgánica del Instituto Costarricense de Turismo; artículos 1, 4, 5 y 13 de la Ley Orgánica del Instituto Nacional de Vivienda y Urbanismo; así como también en las motivaciones y sendos criterios técnicos y jurídicos institucionales, estimando que todas las partes se han encontrado debidamente representadas, así como también que la conciliación no es contraria al ordenamiento jurídico ni genera lesión al interés público, se procede HOMOLOGAR EL ACUERDO CONCILIATORIO en todos sus extremos.

Notifíquese esta sentencia a todas las partes del expediente, a partir de lo cual correrá el plazo de impugnación, también publíquese y apersónese al proceso judicial cualquier interesado, a más tardar quince días hábiles después de la publicación. Sin condenatoria en costas en razón de lo acordado, esta sentencia tendrá carácter de cosa juzgada material al adquirir firmeza, una vez ejecutado lo convenido en su oportunidad archívese.
