Municipalities, in fulfillment of their powers, may issue, upon the granting of commercial patents and licenses, an "open-air commerce authorization" for the use of public spaces such as sidewalks, parks, plazas, public roads, streets, and other public places; provided that the applicant has fulfilled all corresponding obligations. The open-air commerce authorization may not be issued for mobile or stationary patents. Only patent holders or licensees located in commercial establishments situated on private property may be authorized.
To issue the open-air commerce authorization, municipalities must ensure that the use of said spaces does not contravene the right to free transit, pedestrian access and mobility, compliance with Law 7600, Equal Opportunities for Persons with Disabilities Law, of May 2, 1996, Law 9078, Land Public Road Transit and Road Safety Law, of October 4, 2012, and that visual and noise pollution to the surroundings where the commercial activity takes place is adequately controlled. This authorization shall only permit the placement of tables, chairs, and other light support urban furniture (mobiliario liviano de apoyo) for the activity. All urban furniture (mobiliario) must be removed daily at the end of the commercial activity.
