in the entirety of the text - Complete Text of Norm 30918 Reform Determines the necessary documents for the transportation of timber on public land routes in the national territory Complete Text of act: 5F547 DECREES No. 30918-MINAE-MOPT-SP THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF THE ENVIRONMENT AND ENERGY, AND OF PUBLIC WORKS AND TRANSPORTATION AND OF PUBLIC SECURITY Based on the principles and objectives established in articles 50, 140, subsections 3) and 18) and 146 of the Political Constitution, the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996; the provisions of the Organic Environmental Law No. 7554 of October 4, 1995; the Biodiversity Law No. 7788 of April 30, 1998; the provisions of articles 100, 101 and related articles of the Law of Transit on Public Land Routes No. 7331; and the provisions of the General Public Administration Law No. 6227 of May 2, 1978.
1.-That it is an essential and priority function of the State to ensure the conservation, protection and administration of natural forests and the production, harvesting, industrialization and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
2.-That technical studies indicate that 34% of the timber commercialized in the country comes from illegal logging. ("Illegal Logging in Costa Rica, an analysis for discussion", prepared by the Tropical Agricultural Research and Higher Education Center, CATIE).
3.-That the doctrine of public law recognizes that the use of a public road, as with the use of other public goods, must be regulated based on requirements derived from public safety and health, as well as for reasons concerning the good management of public property or its conservation.
4.-That the Administration has the general power to regulate the use of public roads.
5.-That a prudent period of time is required for the State Forestry Administration (Administración Forestal del Estado), faced with the serious problem of illegal logging, documented by the aforementioned CATIE study, to design and establish an institutional system for the control of illegal logging.
6.-That the current forestry legal regulations recognize that timber from plantations, due to its cultivation characteristics, does not require authorization for its transportation except with regard to the Certificate of Origin (Certificado de Origen) or distinctive marks granted by the Ministry of Environment and Energy through the National System of Conservation Areas.
7.-That there is trade in sawn timber between supply centers and sites of use, for different purposes such as constructions, repairs and remodels, which require that timber can be in transit throughout the week.
8.-That through Executive Decree No. 30494-MINAE-MOPT-SP published in La Gaceta No. 119 of June 21, 2002, the Executive Branch has regulated the transportation of forest products on public land routes; however, the need to partially modify its content has been determined, in order to provide greater clarity in the application of this norm. For this end, they shall form control brigades at the central and regional levels. These brigades shall have the support of all State institutions for the fulfillment of the purposes established in this norm.
The means of transport used shall also be seized. Both shall be placed at the disposal of the authorities of the Ministry of Environment and Energy, who shall have a period of up to three days to carry out the respective investigation and, if applicable, place them at the disposal of the competent judicial authority.
Said guides may not be renewed, which shall entail making a new request, with this being duly justified by the regent and by the reasoned criterion resulting from an on-site inspection by officials of the State Forestry Administration. The regents must provide a copy of the documents authorizing or issuing them before the corresponding subregional office of the State Forestry Administration.
R-SINAC-DG-010-2000 of the Ministry of Environment and Energy, Sistema Nacional de Áreas de Conservación, published in the Official Newspaper La Gaceta No. 143 of Wednesday, July 26, 2000, shall continue to be applied in what is not regulated in this decree for the transportation of timber, regardless of its origin.

Para ese fin formará brigadas de control a nivel central y regional. Éstas brigadas contarán con el apoyo de todas las instituciones del Estado para el cumplimiento de los fines previstos en esta norma.
También se decomisará el medio de transporte usado. Ambos serán puestos a la orden de las autoridades del Ministerio del Ambiente y Energía, quienes contarán con un plazo de hasta tres días para realizar la respectiva investigación y si es del caso, ponerlos a la orden de la autoridad judicial competente.
Dichas guías no podrán ser renovadas, lo cual implicará realizar una nueva solicitud, siendo esta debidamente justificada por parte del regente y del criterio razonado producto de una inspección al lugar, por parte de los funcionarios de la Administración Forestal del Estado. Los regentes deberán aportar copia de los documentos que autoricen o expidan ante la correspondiente oficina subregional de la Administración Forestal del Estado.
