Decreto 30494 — Control of Timber Transport on Public Roads

in the entirety of the text - Full Text of Norm 30494 Determines the necessary documents for the transport of timber on public land roads in the national territory No. 30494-MINAE-MOPT-SP THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF ENVIRONMENT AND ENERGY, OF PUBLIC WORKS AND TRANSPORT AND OF PUBLIC SECURITY Based on the powers conferred upon them by articles 50, 140, subsections 3) and 18) and 146 of the Political Constitution, the Forest Law (Ley Forestal) No. 7575 of March 6, 1996; the provisions of the Organic Environmental Law (Ley Orgánica del Ambiente) No. 7554 of October 4, 1995; the Biodiversity Law (Ley de Biodiversidad) No. 7788 of April 30, 1998; the provisions of articles 100, 101 and related articles of Law No. 7331, on Transit on Public Land Roads, and the provisions of the General Public Administration Law (Ley General de la Administración Pública) No. 6227 of May 2, 1978.

1That it is an essential and priority function of the state to ensure the conservation, protection and administration of natural forests and the production, utilization (aprovechamiento), industrialization and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
2That technical studies indicate that 34% of the timber commercialized in the country comes from illegal logging. ("Illegal logging in Costa Rica, an analysis for discussion" ("La tala ilegal en Costa Rica, un análisis para la discusión"), prepared by the Tropical Agricultural Research and Higher Education Center, CATIE).
3That the doctrine of public law recognizes that the use of a public road, as with the use of other public assets, must be regulated based on requirements derived from public safety and health, as well as for reasons concerning the good governance of public property or its conservation.
4That the Administration has the general power to regulate the use of public roads; and
5That a prudential period is required for the State Forest Administration (Administración Forestal del Estado), given the serious problem of illegal logging, documented by the aforementioned CATIE study, to design and establish an institutional system for controlling legal logging. Therefore,

For this purpose, they will form control brigades at the central and regional levels. These brigades shall have the support of all State institutions for the fulfillment of the purposes set forth in this norm.

The means of transport used shall also be seized. Both shall be placed at the order of the authorities of the Ministry of Environment and Energy, who shall have a period of up to three days to carry out the respective investigation and, if applicable, place them at the order of the competent judicial authority.

Said guides may not be renewed, which shall imply making a new request, this being duly justified by the regent and the reasoned criteria resulting from an on-site inspection by officials of the State Forest Administration. Regents must provide copies of the documents they authorize or issue to the corresponding subregional office of the State Forest Administration.

R-SINAC-DG-010-2000 of the Ministry of Environment and Energy, National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), published in the Official Gazette La Gaceta No. 143 of Wednesday, July 26, 2000, shall continue to apply insofar as it is not regulated in this decree for timber transport, regardless of its origin.

1Que es función esencial y prioritaria del estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país, destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.
2Que estudios técnicos señalan que un 34% de la madera que se comercializa en el país previene de la tala ilegal. ("La tala ilegal en Costa Rica, un análisis para la discusión", elaborado por el Centro Agroeconómico Tropical de Investigación y Enseñanza, CATIE).
3Que la doctrina del derecho público, reconoce que el uso de una vía pública, al igual que sucede con el uso de los demás bienes públicos, debe ser regulado sobre la base de requisitos derivados de la seguridad y sanidades públicas, así como por razones que conciernen al buen régimen de la cosa pública o a su conservación.
4Que la Administración tiene la facultad general de reglamentación del uso de la vías públicas; y
5Que se requiere un tiempo prudencial para la que la Administración Forestal del Estado, ante el grave problema de la tala ilegal, documentado por el estudio del CATIE antes referido, diseñe y establezca un sistema institucional de control de tala legal. Por lo tanto,

Para ese fin formará brigadas de control a nivel central y regional. Éstas brigadas contarán con el apoyo de todas las instituciones del Estado para el cumplimiento de los fines previstos en esta norma.

También se decomisará el medio de transporte usado. Ambos serán puestos a la orden de las autoridades del Ministerio del Ambiente y Energía, quienes contarán con un plazo de hasta tres días para realizar la respectiva investigación y si es del caso, ponerlos a la orden de la autoridad judicial competente.

Dichas guías no podrán ser renovadas, lo cual implicará realizar una nueva solicitud, siendo esta debidamente justificada por parte del regente y del criterio razonado producto de una inspección al lugar, por parte de los funcionarios de la Administración Forestal del Estado. Los regentes deberán aportar copia de los documentos que autoricen o expidan ante la correspondiente oficina subregional de la Administración Forestal del Estado.

Control of Timber Transport on Public RoadsControl del Transporte de Madera por Vías Terrestres

Artículo 1 — The following shall be the necessary documents for the transport of timber on public land roads in the national territory:

Artículo 3 — The MINAE, through the State Forest Administration, and the Ministry of Public Security, shall establish fixed and mobile control posts on roads they deem appropriate in order to control illegal logging.

Artículo 5 — Timber that does not have the respective documentation shall be seized (decomisada) by the corresponding authorities.

Artículo 6 — The transport guides issued by the State Forest Administration for the transport of log or sawn timber may not be valid for more than three months.

Artículo 8 — The Ministry of Environment and Energy shall evaluate the problem of illegal logging in the national territory and shall establish administrative measures to reduce it, as well as recommend changes to current legislation.

Artículo 10 — It shall be effective upon its publication.

Artículo 1 — Los siguientes, serán los documentos necesarios para el transporte de la madera por vías públicas terrestres en el territorio nacional:

Artículo 3 — El MINAE a través de la Administración Forestal del Estado, y el Ministerio de Seguridad Publica, establecerán los puestos de control fijos y móviles, en las vías que estime conveniente con el fin de controlar la tala ilegal.

Artículo 5 — La madera que no cuente con la respectiva documentación será decomisada por las autoridades correspondientes.

Artículo 6 — Las guías de transporte que emita la Administración Forestal del Estado para el transporte de madera en troza o aserrada, no podrán tener una vigencia mayor de tres meses.

Artículo 8 — El Ministerio del Ministerio del Ambiente y Energía evaluará el problema de la tala ilegal, en el territorio nacional y establecerá las medidas administrativas para reducirla, así como recomendar los cambios en la legislación vigente.

Artículo 10 — Rige a partir de su publicación.
