Upon expiration, the new application must be submitted with the regent's justification, and the reasoned opinion supporting it from the officials of the State Forest Administration must be based on a site inspection. 4) The seizure of timber from the forest, whether squared, block, or roundwood, and the means of transport in which it is circulating outside the established hours or without the respective documentation, shall be at the order of the competent authority instructed for that purpose (points III.5, III.7, and VI.4.4 of O.J. 005-2003). Consequently, as set forth above, O.J. 005-2003 of January 10, 2003, is sua sponte reconsidered, with the remainder left intact.Por tanto, para adecuarla a las reformas del Decreto 30918-MINAE-MOPT-SP del 4 de diciembre del 2002 (Alcance N° 2 a La Gaceta N° 10 del 15 de enero del 2003), con fundamento en el artículo 3°, inciso b), de nuestra Ley Orgánica, se reconsidera de oficio la Opinión Jurídica O. J.-005-2003, en los siguientes términos: 1) Se suprime lo relativo al color de la guía de transporte de madera en troza originaria del bosque natural. El transporte de madera en troza, escuadrada o aserrada, de plantaciones forestales podrá hacerse con el Certificado de Origen o la Guía extendida por el regente forestal, manteniendo, en lo compatible, la aplicación de los distintivos que indica la Resolución N° R-SINAC-DG-010-2000, de las 15 horas del 31 de agosto del 2000. Gaceta N° 143 del 26 de julio del 2000. 2) El horario para transportar madera en troza, block, escuadrada o aserrada, se extiende al día sábado de 5:00 a.m. a 5:00 p.m., prohibiéndose su transporte desde el sábado, a partir de las 5:00 p.m., hasta el día lunes a las 5:00 a.m. Regulación de la que se exceptúa la madera de depósitos y plantaciones forestales (puntos III.5 y VI.3.6 de la O. J.-005-2003). 3) Se extiende a tres meses la vigencia máxima de las guías emitidas por la Administración Forestal del Estado para transportar madera en troza o aserrada. En la nueva solicitud que deberá hacerse a su vencimiento, con la justificación del regente, el criterio razonado que la respalde por parte de los funcionarios de la Administración Forestal del Estado ha de ser producto de una inspección del lugar. 4) El decomiso de la madera procedente del bosque, sea escuadrada, en block o en troza y los medios de transporte donde circule fuera del horario fijado o sin la respectiva documentación, quedará a la orden de la autoridad competente instruida para ese fin (puntos III.5, III.7 y VI.4.4 de la O. J.-005-2003). En consecuencia, en la forma expuesta, queda reconsiderada de oficio la O.J.-005-2003 de 10 de enero de 2003, quedando incólume en lo demás.
