3091 of February 18, 1963, is hereby reformed, and shall henceforth read as follows:

"Organic Law of the Board of Port Administration and Economic Development of the Atlantic Slope

CONSTITUTION AND NATURE Purposes: Legal Status, Domicile, and Duration

It shall likewise be responsible for administering the Atlantic canalization and the lands and assets granted to it by this same law. It shall administer the State's railway transport enterprises that provide services to and from the ports of the Atlantic Slope specifically contemplated by the Executive Branch in the national development plans.

JAPDEVA may lease, sell, award, or exploit the lands conferred upon it by this law, for the purpose of promoting the ends for which it was created, but it must first consult the opinion of the Institute of Lands and Colonization (Instituto de Tierras y Colonización), an opinion from which it may not deviate except by the affirmative vote of five of the members of the Board of Directors (Consejo de Administración). Within the current port area and its extension to Cieneguita and in that of new ports on the Atlantic Slope, an adjacent zone shall be determined for the installation of industries or commercial services related to port operations, which in no case may be alienated, but may be leased for determined terms. The respective contracts shall contain a clause expressly stating that JAPDEVA may unilaterally terminate them when it needs the land for works and installations of general interest, at its discretion and without any liability.

It shall be governed by the decisions of its Board of Directors, whose members shall act in accordance with the Political Constitution, the pertinent laws and regulations, being totally and unavoidably responsible for their management. Relations between the Executive Branch and JAPDEVA shall be maintained through the Ministry of Public Works and Transport.

Its duration as a public law entity shall be indefinite.

It may also agree with the Executive Branch on the construction or provision of related port works.

• a)Carrying out the specific planning of the port works and installations required by the country on the Atlantic coastline, in accordance with the general planning and port development policy determined by the Executive Branch; b) In accordance with the preceding subsection, constructing the works required for efficient port service, as well as improving, maintaining, operating, and administering the services and installations under its charge; c) Directly receiving and controlling vessels entering or leaving the ports of the Atlantic coastline, issuing the clearance (zarpe) and other required documents; d) Receiving, transferring, storing, safeguarding, and delivering within the port zone, when processed, the cargo, goods, or property embarked or disembarked through the ports of the Atlantic Slope. In no case shall it deliver disembarked cargo to the consignees or their agents, nor permit the embarkation of cargo, without prior customs clearance and in accordance with what the laws and regulations determine in this respect, with the exception of luggage, the reception, custody, and delivery of which shall correspond to Customs; e) Granting cooperation to the fiscal, immigration, and health authorities for the performance of their respective functions; f) Organizing its own guard and security service in the port zone, to watch over the installations, assets, equipment, and cargo in custody. This body shall be vested with sufficient authority to prevent and pursue those who commit infractions, misdemeanors, or crimes within the port zone and to enforce compliance with the service regulations. It shall collaborate, insofar as it is able, with the other authorities of the country; g) Coordinating port activities and the transport activities connected to them; and h) Processing concession (concesión) applications, within the three months following their submission, for the establishment of private port and transport services on the Atlantic Slope, forwarding them with the pertinent recommendations to the Executive Branch, which must resolve within a period of no more than three months. It should be understood that the lack of resolution by the Executive Branch implies acceptance of the application.

DIRECTION AND ADMINISTRATION

General Definition

Of the Board of Directors

• a)The Minister of Public Works and Transport or their delegate; and b) Six Costa Rican persons, of recognized honorability, with broad knowledge and experience in the field of JAPDEVA's activities, or with a professional degree recognized by the State, whose appointment shall correspond to the Government Council.

Both officials shall be elected by the Board of Directors from its own members, for periods of four years starting from the first of June of the year in which the presidential term referred to in Article 134 of the Political Constitution begins, and may be re-elected.

The appointments shall be made in the last fifteen days of the month of May of the same year.

The renewal of the board members shall be done by halves, so that after each change of Government, three of the board members shall be appointed, in accordance with Article 5 and Transitory Provision I of Law No. 4646. The members of the Board of Directors may be re-elected indefinitely.

Once the appointment of board members is made and they have assumed their functions, the Government Council may not revoke said appointments, except on the basis of information gathered by the Office of the Comptroller General of the Republic (Contraloría General de la República), showing that there is cause for it, in accordance with the corresponding legal or regulatory provisions.

In any case, substitution and appointment due to resignation, justified removal, or any other cause, shall be made within the term of fifteen days and for the remainder of the legal period, following the rules established in this article.

In the event that the Government Council deviates from this rule, the appointments it makes of new board members are null, and those who may have been separated from their positions without prior information shall remain in their posts for the remainder of the legal period or until the Office of the Comptroller General of the Republic finds grounds for their separation.

• a)Members and employees of the Supreme Powers, with the exception of the Minister of Public Works and Transport and the officials who substitute him in his temporary absences; b) Officials and employees of JAPDEVA itself, except the Executive President and the Executive Vice President; c) Presidents, Managers, Representatives, or employees of any autonomous institution; d) Persons who, during the year prior to their appointment, have been sued in executive proceedings for the collection of their own unsatisfied credits or who have been declared in a state of bankruptcy or insolvency; e) Two or more persons who are officials or members of the Board of Directors of the same commercial company; f) Those who are related to each other by consanguinity or affinity up to the third degree inclusive; g) Persons holding positions of popular election, while they are in the exercise of their office; and h) Those who are linked by employment or legal position to enterprises or activities that contract or subcontract with JAPDEVA, directly or indirectly.

• a)If they lose their capacity for the office; if they are convicted of a crime against property, or should they fall under any of the prohibitions or incompatibilities indicated in this law; b) If they are absent from the country for more than three consecutive months without authorization from the Board of Directors; c) If they infringe any of the provisions contained in the laws, decrees, or regulations applicable to the Board of Directors, or consent to their infringement; d) If, due to physical incapacity, they have not performed the office for more than one year; and e) If they resign from their office.

The Executive President and Vice President shall receive the salary set for them by the Board of Directors.

In this sense, it shall have, among others, the following powers:

• a)Approve the internal regulations required for the institution's functioning; b) Approve contracts and agreements related to the purposes of JAPDEVA; c) Approve JAPDEVA's budget annually; d) Decide all matters related to the administration of the assets belonging to JAPDEVA; e) Approve sales, enter into loans (empréstitos), issue bonds, and constitute liens for the development of port infrastructure and equipment, up to fifty percent (50%) of the value of its assets. If the operation exceeds the result of applying said percentage, the approval of the Legislative Assembly must be obtained.

(As amended by the sole article of Law No. 8966 of July 7, 2011) f) Delegate powers to administrative committees or commissions from within its body, or to the Executive President, indicating their powers; g) Approve purchases up to the sum of fifty thousand colones and contracts for goods and services, up to the sum of one hundred fifty thousand colones, through the private bidding (licitación privada) procedure; h) Establish tariffs, canons, or charges for the public services it provides, subject to prior approval by the Executive Branch and in accordance with this law; i) Grant permits for uses and service provisions, subject to canons, over specific port spaces and port activities, provided they are intended for the intrinsic functions of shipping, customs, or transport companies; j) Submit to the Executive Branch, for processing, the draft laws necessary for the fulfillment of its purposes; k) Appoint the auditor, sub-auditor, and General Secretary; and l) Set the remuneration of the officials mentioned in the preceding subsection and appoint those who will replace them in their temporary absences.

• a)Represent JAPDEVA judicially and extrajudicially with the powers of a generalissimo agent (apoderado generalísimo) according to Article 1253 of the Civil Code and with the limitations stated below. They may also partially or totally delegate their mandate for a defined or indefinite term, revoke the delegations they have made, and make new ones, always retaining their powers in full.

Subject to prior agreement from the Board of Directors, they may: grant generalissimo, general, and special powers; alienate or encumber real property, personal property, securities, or rights of JAPDEVA; acquire all kinds of property, whether real property, personal property, securities, or rights. In the absence of the Executive President, the Executive Vice President shall have exactly the same faculties as the former, their word being sufficient for their actions to be considered valid; b) Exercise the functions inherent to their condition as general administrator of JAPDEVA, concluding agreements and executing the acts required for its ordinary operation; c) Submit to the Board of Directors, for its knowledge and approval, the budgets of JAPDEVA, as well as its financial statements; d) Execute the resolutions of the Board of Directors; e) Authorize with their signature, jointly with the Executive Vice President, the certificates and securities issued by JAPDEVA; f) Organize, with the approval of the Board of Directors, the departments and sections necessary to fulfill the functions entrusted to JAPDEVA by this law; g) Appoint and remove the staff of JAPDEVA; AND h) Exercise the other functions and powers that correspond to them in accordance with the law and the regulations of JAPDEVA.

Of the General Audit Office

The sub-auditor, in addition to substituting for the auditor in their temporary absences and exercising the powers delegated to them by the former, shall exercise the functions that correspond to them in accordance with the laws, regulations, and other pertinent provisions.

Internal Organization

These administrations shall be divided into departments, and these into sections. Each of the administrations shall be under the charge of a manager, of recognized technical capacity, with academic preparation or equivalent experience in the corresponding branch. The Railway administration shall be called: 'National Atlantic Railway' (Ferrocarril Nacional al Atlántico).

Therefore, each administration shall keep its own accounting and present separate balance sheets, as well as its profit and loss account. The institution, as a whole, must present consolidated balance sheets and profit and loss statements.

Financial Provisions

• a)All current expenditures; and b) All expenditures demanded by investments based on development plans.

If said body does not object to them within a period of sixty days, from the date of their receipt, the regulations shall be considered approved.

The other three colones shall be allocated to finance the development plans of the Atlantic canalization zone.

GENERAL PROVISIONS

Liability of Representatives and Other Provisions

Budgets shall be prepared and approved in accordance with the constitutional and legal provisions governing the matter regarding the autonomous institutions of the State.

• a)Non-compliance by the user or contractor with the work, order, security, or surveillance regulations issued by JAPDEVA; b) Unmanifested cargo; c) Causes originating in force majeure (fuerza mayor) or fortuitous event (caso fortuito); d) Decomposition, decrease, deterioration, or demerit arising from the natural action of time, from the damaging action of containers, vice, or nature of the goods; e) Goods received 'broken-breached'; and f) In case of war or civil commotion (conmoción civil).

Nor shall it be liable for damages that ships and other vessels may sustain, or that they may cause to others, due to war and/or civil commotion.

Patrimony of JAPDEVA

• a)The lands, buildings, equipment, and in general all personal and real property destined for the activities inherent to JAPDEVA, with the exception of those State assets which by Political Constitution cannot leave its patrimony and the assets of the National Atlantic Railway.

Also, its future expansions, which by mutual agreement between JAPDEVA and the Executive Branch it is decided to transfer, for which both entities are authorized to formalize the respective deeds before the State Notary's Office. The assets that as of the date are the property of the institution shall not be subject to the transfer referred to in this article; and b) All State lands situated in the area enabled by navigable canals, comprised in an area of ten kilometers inland from the sea, parallel to the coast, and a strip three kilometers wide, parallel to both sides of the rivers and canals administered by the Board.

These areas must fundamentally contemplate:

• a)Terminals and rights-of-way; b) The anchorage sites, anchorages, and beaconing of the roadstead; c) The access channels and maneuvering zone; and d) The berths (atracaderos) and transit spurs, warehouses in general, offices, workshops, railroad yards and spurs, zones for storage of goods, and any other site destined for port and railway operations.

Transitory Provision I.- The Office of the Attorney General of the Republic shall grant JAPDEVA the transfer deeds referred to in subsections 'a' and 'b' of Article 41 of this law, which shall be exempt from the payment of duties, stamps, and expenses for their registration.

Transitory Provision II.- JAPDEVA is authorized to expropriate the lands in Cieneguita necessary for the expansion of the current port, using the funds provided in Laws No. 479 and No. 5170, in accordance with the provisions of Laws No. 1371 of November 10, 1951; No. 1851 of February 18, 1955; and No. 3842 of January 4, 1967.

Transitory Provision III.- The maximum tariff that JAPDEVA must charge for wharfage and embarkation or disembarkation fees and transport to customs warehouses or vice versa shall be equated with those authorized for the National Institute of Pacific Ports (INCOP).

Transitory Provision IV.- The appointments of Executive President and Executive Vice President and all provisions of this law referring to the powers and responsibilities of those officials shall come into effect on the first of June of nineteen seventy-four, once the Board of Directors is renewed in accordance with Law No. 4646. Until that date, the functions of the Executive President and Vice President shall be performed by the persons currently holding the positions of Manager and Assistant Manager of the institution, with voice but without vote before the Board.

Transitory Provision V.- The new grounds for incompatibility and prohibitions for members of the Board of Directors contemplated in Article 12 of this law shall not be applicable to the persons currently performing the role of directors of the institution, for the period for which they were appointed.

Transitory Provision VI.- The Board of Port Administration and Economic Development of the Atlantic Slope (JAPDEVA) is authorized so that, in the case of workers retired from the railway administration who currently receive pensions under the title of donations (donativos) and who are not covered by the Disability, Old Age, and Death Regime of the Costa Rican Social Security Fund, those pensions be increased in the following proportion: up to ¢ 400.00 by 50%; from ¢ 401.00 up to ¢ 500.00 by 40%; from ¢ 501.00 up to ¢ 700.00 by 30%; from ¢ 701.00 up to ¢ 1,000.00 by 15%.

This also becomes effective in case of the death of the beneficiary worker covered by the donation system, for his spouse or partner, provided she maintains her widowhood status, and for his children under 21 years of age, and over 21 if they are higher education students.

The same applies for those workers over 65 years of age and with 10 years of service to the enterprise, who are currently working for the institution and who are not covered by the cited Disability, Old Age, and Death Regime."

Presidential House.- San José, on the twenty-seventh day of the month of August of nineteen seventy-three.

"Ley Orgánica de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica

CONSTITUCION Y NATURALEZA Fines: Personería, Domicilio y Duración

Se encargará asimismo de administrar la canalización del Atlántico y las tierras y bienes que esta misma ley le otorga. Administrará las empresas de transporte ferroviario del Estado que presten servicios de y hacia los puertos de la Vertiente Atlántica que específicamente contemple el Poder Ejecutivo en los planes nacionales de desarrollo.

JAPDEVA podrá arrendar, vender, adjudicar o explotar las tierras que le confiere esta ley, con el propósito de promover los fines para los que ha sido creada, pero deberá consultar previamente el criterio del Instituto de Tierras y Colonización, criterio del que no se podrá apartar, si no es con el voto afirmativo de cinco de los miembros del Consejo de Administración. Dentro del área portuaria actual y su extensión a Cieneguita y en la de nuevos puertos de la Vertiente Atlántica, se determinará una zona adyacente para la instalación de industrias o servicios comerciales relacionados con la operación portuaria, que en ningún caso podrá ser enajenada, pero sí dad en arriendo por plazos determinados. Los respectivos contratos llevarán una cláusula en la que expresamente conste que unilateralmente JAPDEVA puede darlos por terminados cuando necesitare el terreno para obras e instalaciones de interés general, a su juicio y sin responsabilidad alguna.

Se regirá por las decisiones de su Consejo de Administración, cuyos miembros actuarán con apego a la Constitución Política, a las leyes y reglamentos pertinentes, siendo responsables de su gestión en forma total e ineludible. Las relaciones entre el Poder Ejecutivo y JAPDEVA se mantendrán a través del Ministerio de Obras Públicas y transportes.

Su duración como organismo de derecho público será indefinida.

Asimismo podrá convenir con el Poder Ejecutivo, la construcción o provisión de obras portuarias conexas.

• a)Realizar la planificación específica de las obras e instalaciones portuarias que requiera el país en el litoral del Atlántico, de conformidad con la planificación general y la política de desarrollo portuario que determine el Poder Ejecutivo; b) De conformidad con el inciso anterior, construir las obras que se requieran para un eficiente servicio portuario, así como mejorar, mantener, operar y administrar los servicios e instalaciones que estén a su cargo; c) Recibir y controlar directamente, las naves que entren o salgan de los puertos del litoral atlántico, extendiendo el zarpe y los demás documentos de rigor; d) Recibir, trasladar, almacenar, custodiar y entregar dentro de la zona portuaria, cuando procesa, la carga, mercancías o bienes que se embarquen o desembarquen por los puertos de la Vertiente Atlántica. En ningún caso hará entrega de la carga desembarcada a los consignatarios o a sus agentes, ni permitirá el embarque de carga, sin el previo trámite aduanal y de conformidad con lo que al respecto determinen las leyes y reglamentos, con excepción de los equipajes cuya recepción, custodia y entrega corresponderán a la Aduana; e) Otorgan a las autoridades fiscales, de migración y sanidad, cooperación para el desempeño de sus respectivas funciones; f) Organizar servicio propio de resguardo y seguridad en la zona portuaria, para vigilar las instalaciones, bienes, equipos y carga en custodia. Este cuerpo estará investido de suficiente autoridad para prevenir y perseguir a quienes cometan contraverciones, faltas o delitos dentro de la zona portuaria e imponer el cumplimiento de los reglamentos de servicio. Colaborará en cuanto esté a su alcance con los demás autoridades del país; g) Coordinar las actividades portuarias y de transporte que le son conexas; y h) Tramitar las solicitudes de concesión, dentro de los tres meses siguientes aa la presentación de las mismas, para el establecimiento de servicios portuarios y de transporte privados en la Vertiente Atlántica, trasladándolas con las recomendaciones pertinentes al Poder Ejecutivo, quien deberá resolver en un plazo no mayor de tres meses. Debe entenderse que la falta de resolución de parte del Poder Ejecutivo, implica aceptación de la solicitud.

DIRECCION Y ADMINISTRACION

Definición General

Del Consejo de Administración

• a)El Ministro de Obras Públicas y Transporte o su delegado; y b) Seis personas costarricenses, de reconocida honorabilidad, de amplios conocimientos y Estado, cuyo nombramiento le corresponderá al Consejo de Gobierno.

Ambos funcionarios serán elegidos por el Consejo de Administración de su propio seno, para períodos de cuatro años a partir del primero de junio del año en que se inicie el período presidencial al que se refiere el artículo 134 de la Constitución Política, pudiendo ser reelectos.

Los nombramientos se efectuarán en los últimos quince dáis del mes de mayo del mismo años.

La renovación de los consejeros, se hará por mitades, de modo que después de cada cambio de Gobierno, se procederá a nombrar a tres de los consejeros, de conformidad con el artículo 5º y el transitorio I de la Ley Nº 4646. Los miembros del Consejo de Administración pueden ser reelectos indefinidamente.

Hecho el nombramiento de consejeros y asumidas por éstos sus funciones, el Consejo de Gobierno no podrá revocar dichos nombramientos, si no es con base en información levantada por la Contraloría General de la República, en la que se ponga de manifiesto que hay causa para ello, conforme a las disposiciones legales o reglamentos correspondientes.

En todo caso, la sustitución y nombramiento por renuncia, remoción justificada o por cualquier otra causa, se hará dentro del término de quince días y para el resto del período legal, siguiendo las normas establecidas en este artículo.

En el caso de que el Consejo de Gobierno se separe de esta norma, los nombramientos que haga de nuevos consejeros son nulos y los que hubieren sido separados de sus cargos sin previa información, se mantendrán en sus puestos por el resto del período legal o hasta que la Contraloría General de la República encuentre que hay lugar a su separación.

• a)Los miembros y empleados de los Supremos Poderes, con excepción del Ministro de Obras Públicas y Transporte y los funcionarios que lo sustituyan en sus ausencias temporales; b) Los funcionarios y empleados de la propia JAPDEVA, excepto el Presidente y el Vicepresidente Ejecutivos; c) Los Presidentes, Gerentes, Personeros o empleados de cualquier institución autónoma; d) Las personas que durante el año anterior a su nombramiento hayan sido demandadas en la vía ejecutiva en cobro de créditos propios no satisfechos o que hayan sido declarados en estado de quiebra o insolvencia; e) dos o más personas que sean funcionarios o miembros de la Junta Directiva de una misma sociedad mercantil; f) Los que estén ligados entre sí por parentesco de Consanguinidad o afinidad hasta el tercer grado inclusive; g) Las personas que ocupen puestos de elección popular, mientras estén en el ejercicio de su cargo; y h) Los que estén ligados por empleo o posición legal a empresas o actividades que contraten o subcontraten con JAPDEVA, directa o indirectamente.

• a)El que perdiere su capacidad para el cargo; el que fuere condenado por delito contra la propiedad, o llegare a encontrarse dentro de las prohibiciones o incompatibilidades indicadas en la presente ley; b) El que se ausentare del país por más de tres meses consecutivos sin autorización del Consejo de Administración; c) El que infringiere alguna de las disposiciones contenidas en las leyes, decretos o reglamentos aplicables al Consejo de Administración, o consintiere su infracción; d) El que por incapacidad física, no haya desempañado el cargo por más de un año; y e) El que renunciare a su cargo.

El Presidente y Vicepresidente Ejecutivos, devengarán el salario que les fije el Consejo de Administración.

En ese sentido, tendrá entre otras, las siguientes atribuciones:

• a)Aprobar los reglamentos internos que requiera el funcionamiento de la institución; b) Aprobar contratos y convenios relacionados con los fines de JAPDEVA; c) Aprobar anualmente el presupuesto de JAPDEVA; d) Decidir todo lo relativo a la administración de los bienes pertenecientes a JAPDEVA; e) Aprobar ventas, celebrar empréstitos, emitir bonos y constituir gravámenes para el desarrollo de infraestructura y equipamiento portuario, hasta por un cincuenta por ciento (50%) del valor de sus activos. Si la operación excede del resultado de la aplicación de dicho porcentaje, deberá obtenerse la aprobación de la Asamblea Legislativa.

(Así reformado por el artículo único de la ley N° 8966 del 7 de julio de 2011) f) Delegar facultades en comités administrativos o en comisiones de su seno o en el Presidente Ejecutivo, señalándole sus atribuciones; g) Aprobar compras hasta por la suma de cincuenta mil colones y contratos por bienes y servicios, hasta por la suma de ciento cincuenta mil colones, por el trámite de licitación privada; h) Establecer tarifas, cánones o cobrar por los servicios públicos que preste, previa aprobación del Poder Ejecutivo y de acuerdo con esta ley; i) Dar permisos de usos y prestación de servicios, sujetos a cánones sobre determinados espacios portuarios y actividades portuarias, siempre que estén destinados a las funciones propias de empresas navieras, aduanales o de transporte; j) Presentar al Poder Ejecutivo, para su trámite, los proyectos de ley necesarios para el cumplimiento de sus fines; k) Nombrar auditor, subauditor y Secretario General; y l) Fijar la remuneración de los funcionarios citados en el aparte anterior y nombrar a quienes los reemplacen en sus ausencias temporales.

• a)Representar judicial y extrajudicialmente a JAPDEVA con las atribuciones de un apoderado generalísimo conforme al artículo 1253 del Código Civil y con las limitaciones que luego se dirán. Además podrá delegar total o parcialmente su mandato por un plazo definido o indefinido, revocar las delegaciones que hiciere y hacer otras de nuevo, conservando siempre sus poderes en toda su extensión.

Previo acuerdo del Consejo de Administración, podrá: otorgar poderesgeneralísimos, generales y especiales, enajenar o gravar los bienes inmuebles, muebles, valores o derechos de JAPDEVA; adquirir toda clase de bienes, sean inmuebles, muebles, valores o derechos. En ausencia del Presidente Ejecutivo, el Vicepresidente Ejecutivo tendrá exactamente las mismas facultades de aquél, bastando su dicho para que se tengan por buenas sus actuaciones; b) Ejercer las funciones inherentes a su condición de administrador general de JAPDEVA, celebrando los convenios y ejecutando los actos que requiera la marcha ordinaria de ésta; c) Presentar al Consejo de Administración, para su conocimiento y aprobación, los presupuestos de JAPDEVA, así como sus estados financieros; d) Ejecutar las resoluciones del Consejo de Administración; e) Autorizar con su firma, conjuntamente con el Vicepresidente Ejecutivo, los títulos y valores que emita JAPDEVA; f) Organizar, con la aprobación del Consejo de Administración, los departamentos y secciones que sean necesarios para cumplir las funciones que por esta ley se le encomienda a JAPDEVA; g) Nombrar y remover el personal de JAPDEVA; Y h) Ejercer las demás funciones y facultades que le correspondan de conformidad con la ley y los reglamentos de JAPDEVA.

De la Auditoría General

El subauditor, además de sustituir al auditor en sus ausencias temporales y de ejercer las atribuciones que aquél le delegue, ejercerá las funciones que le correspondan de acuerdo con las leyes, reglamentos y demás disposiciones pertinentes.

Organización Interna

Estas administraciones estarán divididas en departamentos y éstos en secciones. Cada una de las administraciones estará a cargo de un gerente, de reconocida capacidad técnica, con preparación académica o experiencia equivalente en la rama correspondiente. La Administración ferroviaria se denominará: "Ferrocarril Nacional al Atlántico".

Por lo tanto, cada administración llevará su propia contabilidad y presentará balances por separado, lo mismo que su cuenta de ganancias y pérdidas. La institución, como un todo, deberá presentar balances y estados de ganancias y pérdidas consolidadas.

• a)Todos los egresos corrientes; y b) Todos los egresos que demanden inversiones basadas en planes de desarrollo.

Si éste no las objeta dentro de un plazo de sesenta días, a partir de su recepción, las regulaciones se considerarán aprobadas.

se manejen por sus puertos, a los siguientes fines: de la referida suma se invertirán dos colones a través de los municipios de la provincia de Limón y se girarán en mensualidades de acuerdo con el plan de desarrollo regional de la misma. Los otros tres colones se destinarán para financiar los planes de desarrollo de la zona de la canalización del Atlántico.

Responsabilidad de los personeros y otras disposiciones

Los presupuestos se confeccionarán y aprobarán conforme a las disposiciones constitucionales y legales que rigen la materia en cuanto a las instituciones autónomas del Estado.

• a)Incumplimiento del usuario o contratista, de los reglamentos de trabajo, orden, seguridad o vigilancia dictadas por JAPDEVA; b) Cargas no manifestadas; c) Causas originales en fuerza mayor o caso fortuito; d) Descomposición, merma, menoscabo, o demérito proveniente de la acción natural del tiempo, de la acción dañina de los envases, vicio o natural de las mercancías; e) Mercancías recibidas "roto-saqueado"; y f) En caso de guerra o conmoción civil.

Tampoco será responsable de los daños que puedan subir los barcos y otras embarcaciones o los que éstos puedan causar a otros por guerra y/o conmoción civil.

Patrimonio de JAPDEVA

• a)Los terrenos, edificios, equipos y en general todos los bienes muebles e inmuebles destinados a las actividades propias de JAPDEVA, con excepción de aquellos bienes del Estado que por Constitución Política no pueden salir de su patrimonio y los bienes del Ferrocarril Nacional al Atlántico.

También las futuras expansiones del mismo, que de común acuerdo entre JAPDEVA y el Poder Ejecutivo se disponga traspasar, para lo cual ambas entidades quedan autorizadas para formalizar las respectivas escrituras ante la Notaría del Estado. Los bienes que a la fecha sean de propiedad la institución, no serán susceptibles del traspaso a que se refiere el presente artículo; y b) Todos los terrenos del Estado situados en el área habilitada por canales navegables, comprendidos en una área de diez kilómetros desde el mar hacia el interior, paralela a la costa y un faja de tres kilómetros de ancho, paralela a ambos lados de los ríos y canales que administre la Junta.

Estas áreas deberán contemplar fundamentalmente:

• a)Terminales y derechos de vía; b) Los sitios de anclaje, de fondeaderos y balizamiento de la rada; c) Los canales de acceso y zona de maniobras; y d) Los atracaderos y espuelas de tránsito, bodegas en general, oficinas, talleres, patios y espuelas de ferrocarril, zonas para almacenamiento de mercancías y cualquier otro sitio destinado a operaciones portuarias y ferroviarias.

Hasta esa fecha, las funciones del Presidente y Vicepresidente Ejecutivos serán desempeñadas por las personas que actualmente ocupan los cargos de Gerente y Asistente de Gerencia de la institución, con voz pero sin voto ante el Consejo.

También se hace efectivo en caso de fallecimiento del trabajador beneficiario, cubierto por el sistema de donativos, a su esposa o compañera, siempre y cuando la misma conserve su condición de viudez y a sus hijos menores de 21 años, y de más de 21 si son estudiantes de educación superior.

Lo mismo se cumple para aquellos trabajadores mayores de 65 años y con 10 años de servicios a la empresa, que estén trabajando actualmente para la institución y que no se encuentren cubiertos para el citado Régimen de Invalidez, Vejez y Muerte".
