These areas must fundamentally contemplate:
- a)Terminals and rights-of-way; b) The anchorage sites, anchorages, and beaconing of the roadstead; c) The access channels and maneuvering zone; and d) The berths (atracaderos) and transit spurs, warehouses in general, offices, workshops, railroad yards and spurs, zones for storage of goods, and any other site destined for port and railway operations.
Transitory Provision I.- The Office of the Attorney General of the Republic shall grant JAPDEVA the transfer deeds referred to in subsections 'a' and 'b' of Article 41 of this law, which shall be exempt from the payment of duties, stamps, and expenses for their registration.
Transitory Provision II.- JAPDEVA is authorized to expropriate the lands in Cieneguita necessary for the expansion of the current port, using the funds provided in Laws No. 479 and No. 5170, in accordance with the provisions of Laws No. 1371 of November 10, 1951; No. 1851 of February 18, 1955; and No. 3842 of January 4, 1967.
Transitory Provision III.- The maximum tariff that JAPDEVA must charge for wharfage and embarkation or disembarkation fees and transport to customs warehouses or vice versa shall be equated with those authorized for the National Institute of Pacific Ports (INCOP).
Transitory Provision IV.- The appointments of Executive President and Executive Vice President and all provisions of this law referring to the powers and responsibilities of those officials shall come into effect on the first of June of nineteen seventy-four, once the Board of Directors is renewed in accordance with Law No. 4646. Until that date, the functions of the Executive President and Vice President shall be performed by the persons currently holding the positions of Manager and Assistant Manager of the institution, with voice but without vote before the Board.
Transitory Provision V.- The new grounds for incompatibility and prohibitions for members of the Board of Directors contemplated in Article 12 of this law shall not be applicable to the persons currently performing the role of directors of the institution, for the period for which they were appointed.
Transitory Provision VI.- The Board of Port Administration and Economic Development of the Atlantic Slope (JAPDEVA) is authorized so that, in the case of workers retired from the railway administration who currently receive pensions under the title of donations (donativos) and who are not covered by the Disability, Old Age, and Death Regime of the Costa Rican Social Security Fund, those pensions be increased in the following proportion: up to ¢ 400.00 by 50%; from ¢ 401.00 up to ¢ 500.00 by 40%; from ¢ 501.00 up to ¢ 700.00 by 30%; from ¢ 701.00 up to ¢ 1,000.00 by 15%.
This also becomes effective in case of the death of the beneficiary worker covered by the donation system, for his spouse or partner, provided she maintains her widowhood status, and for his children under 21 years of age, and over 21 if they are higher education students.
The same applies for those workers over 65 years of age and with 10 years of service to the enterprise, who are currently working for the institution and who are not covered by the cited Disability, Old Age, and Death Regime."
