In the event that the latter does not object to the tariffs within a period of sixty days, counted from their receipt, the regulations shall be considered approved.
The Atlantic Coast Port Administration and Economic Development Board (Japdeva) must present ordinarily, at least once a year, the formal request for the setting or modifications of tariffs, as well as extraordinarily on the occasions when necessary.
Extraordinary requests shall be considered those that contemplate significant variations in the economic environment, whether due to fortuitous events, force majeure, or when the conditions of the automatic adjustment models and currency exchange variations are met.
The public official who, having to carry out the necessary steps for the updating, presentation, review, and approval of tariffs under the terms of this law, does not do so, shall be sanctioned with administrative, civil, and criminal liabilities.
