SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At eighteen hours and thirty-three minutes on veinticinco de junio de dos mil diecinueve.- POSSESSORY INFORMATION PROCEEDING (PROCESO DE INFORMACIÓN POSESORIA), brought by [Nombre1], married once, biologist, resident of San José, Pavas, identity card CED1 - - . CONSIDERING
I- Proven Facts. Proven facts numbered one through four are adopted because they are supported by evidence contained in the record. The remaining facts are not adopted because they constitute requirements of the proceeding. Of relevance at this stage, the following facts are deemed established in this matter: 8) The property that is the subject of this proceeding has been devoted to grassland, pasture, brushland, conservation, boundary demarcation, and maintenance, with land being used in accordance with its designated use. (Evidence/ initial filing at folios 8 to 11, witness testimony and judicial inspection (reconocimiento judicial) at folios 74 to 78, land-use study (estudio de uso de suelos) at folios 16 to 21). 9) [Nombre1] acquired the property from [Nombre3] by a sale executed in public deed number 47 of 8 de julio de 1993. In turn, on 30 de mayo de 1970, she acquired from [Nombre4], by purchase and sale, possession extending back veintiocho años. (Evidence/ initial filing at folios 8 to 11, witness testimony at folios 74 to 77, deed of sale at folio 5, and contract of sale at folio 6).
II- Unproven Facts. The unproven facts contained in the appealed judgment are not adopted because evidence exists establishing a different factual basis.
III- Appeal.- The petitioner appeals the judgment denying the request to obtain a registrable title (título inscribible), number 201900004, issued at catorce horas cincuenta y cuatro minutos del catorce de enero del dos mil diecinueve (case file/submissions/dates/14/01/2019 14:54:46). The appellant considers that sufficient documentary evidence exists (various deeds) establishing derivative possession (posesión derivada) exercised prior to the year 1975. The appellant explains that [Nombre4] sold the property to [Nombre3] on 30 de mayo de 1970, with the instrument stating that possession of real property located in Zapotal de Montes de Oro, with an area of less than ocho manzanas, was being transferred. [Nombre4] had acquired it from [Nombre5][Nombre6] hacía 28 años. Then, in 1993, by public deed CED6 executed before Notary Jaime Quintana López, [Nombre3] sold the right of possession (derecho de posesión) to the applicant for title, thereby transferring approximately 23 years of possession.
The appellant points out that the exercise of possession since at least 1942 is established by the two deeds submitted.- Regarding the witness testimony, the appellant states that the questions were not properly phrased. It must also be considered that the witnesses were 80 years old and, because of their age, could not specify the length of time. No warning was given that [Nombre3] was not eligible to testify because she was the transferor, and if the court had so concluded, it should have stated as much. In this regard, the appellant argues that she did not testify about her own acts, but rather about the existence of the sale, as well as the fact that no timber was removed, since the property had belonged to her.- The appellant complains that the witness testimony was not evaluated comprehensively in relation to the documentary evidence. Taken together, that evidence supports the conclusion that possession of the property has existed since before 1975. The appellant summarizes the documentary evidence attached to the record, as well as the testimony of the witnesses offered before this Court. - (See appeal in the file dated 17/01/2019 04:15:10).-
IV.These proceedings are brought for the purpose of registering in the Registro Público de la Propiedad a property consisting of pasture, grassland, and forest cover (cobertura boscosa). Located in [Dirección6], fourth canton of Montes de Oro, province of Puntarenas. It is bounded on the north by: [Dirección7], with a linear frontage of siete metros; South: [Dirección7], with a linear frontage of siete metros and, in part, with the stream lying between it and [Nombre2]; East: [Dirección7], with a linear frontage of siete metros; and West: [Nombre2]. Area: Cincuenta y siete mil cuatrocientos cincuenta metros cuadrados. Cadastral plan P-1882418-2016. The property is valued at cinco millones de colones. The foregoing is established by the initial filing and brief (folios 8 to 11 and 26 to 26, 65), soil study (folios 16 to 21), and judicial inspection (folio 781). The property lies entirely within the protected wildlife area (área silvestre protegida) known as Zona Protectora Montes de Oro Río, created in 1994 by executive decree 23142-MIRENEM of 27 de abril de 1994, and 30% of it lies within the Refugio Nacional de Vida Silvestre Peñas Blancas, created by Ley 7018 of 13 de setiembre de 1985.
This is stated in the certification issued by the Sistema Nacional de Áreas de Conservación that was submitted into evidence. (certification at folio 15). The property lies outside lands or properties administered by the Instituto de Desarrollo Rural (Evidence/brief at folio 50). Furthermore, according to the certification issued by the Registro Nacional, the petitioner has not registered any properties under the Ley de Informaciones Posesorias. (certification at folio 4). It is verified that the statutory notice was published in the Diario Oficial (folio 52). The sole adjoining owner across the stream, [Nombre2], acknowledged service and expressed agreement through the appearance filed in the record (submission at folio 24).
V- Having reviewed the grounds of appeal against the challenged judgment, this Court notes that the rules set forth in section 54 of the Ley de Jurisdicción Agraria establish the system of free evaluation of evidence (libre valoración probatoria) for agrarian proceedings. This system requires the court to examine and select the sources of evidence obtained in order to determine their effectiveness in resolving the dispute submitted for its consideration, through perception, representation or reconstruction, and deductive or inductive reasoning. The court must state the principles of equity or law on which its decision is based. In this regard, the Sala Constitucional has ruled: “..., the evaluation of evidence according to conscience does not entail ruling arbitrarily, because every judge—as the public official that he or she is—is subject to the principle of legality, which imposes a duty to conform public action not only to the specific rules governing a particular subject, but to the entire body of law; therefore, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial reasoning (sana crítica) and the principles of reasonableness, which, when properly applied, harmonize judicial evaluation with the Constitución Política, as this Chamber held in judgment 3484-94, issued at doce horas del ocho de julio de mil novecientos noventa y cuatro, in which it determined that judges’ authority to evaluate evidence according to conscience is not contrary to their obligation to provide reasons for their rulings, a constitutional principle forming part of due process...
() the authority granted to an agrarian judge to evaluate evidence according to conscience and to weigh it without strict adherence to the rules of ordinary law, as provided in the second paragraph of challenged article 54, is not unconstitutional, provided that the judge issues a reasoned ruling; that is, analyzes the evidence gathered in the proceeding and states the principles of equity or law underlying the judge’s position, thereby respecting the minimum requirements of the right of defense” (voto 3657 del 7 de mayo de 2003. See, to the same effect, votos N° 398 del 6 de junio del 2001 of the Sala Primera. Likewise, see votos No. 206 del 26 de marzo de 1999, N°46 del 26 de abril de 1995; Nª66 del 6 de febrero de 2009 and 364 de 28 de mayo del 2009 of the Tribunal Agrario). The adjudicator is likewise required to conduct a comprehensive evaluation of the evidence contained in the case file.
Having clarified the foregoing and reviewed the appealed judgment, this Court finds that the evidence was analyzed erroneously and in isolation, without comprehensively assessing the witnesses’ statements and comparing them with the transfer documents submitted to tack the possession exercised in the past.
VI- Having reviewed the matter on appeal, it should be noted that the challenged judgment N° 2019000004, issued at catorce horas y cincuenta y cuatro minutos del catorce de enero de dos mil diecinueve, denies approval of the possessory information proceeding because it did not find proven a chain of transfers of ten-year possession predating the creation of the protected wildlife areas that affected the land, namely Zona Protectora de Monte de Oro and Refugio Nacional de Vida Silvestre Peñas Blancas. As stated, these management categories (categorías de manejo) were created by executive decree 23142-MIRENEM of 27 de abril de 1994, while 30% of the property lies within the Refugio Nacional de Vida Silvestre Peñas Blancas, created by Ley 7018 of 13 de setiembre de 1985. Therefore, pursuant to section 7 of the Ley de Informaciones Posesorias, the petitioner must establish that possession was exercised as owner under the terms of article 856 of the Código Civil for at least 10 years before the land became subject to that management category; that is, before 1985.
To substantiate possession, three witnesses must be presented in accordance with section 6 of the Ley de Informaciones Posesorias. Furthermore, because the petitioner seeks to tack the transferred possession, the petitioner was required to attach the instrument by which the property was acquired, as provided in article 1 thereof.
VII- Regarding the land-tenure regime (régimen de tenencia de la tierra) in protected wild areas (áreas silvestres protegidas), it must be noted that, regardless of their management category (categoría de manejo), they must be understood as zones subject to a particular and specific administrative and regulatory regime, governed by management plans (planes de manejo) that ensure the protection, conservation, and rational use of natural resources. Their administration, management, and protection fall to MINAET, unless a special law provides otherwise. Article 58 of the Biodiversity Law defines them as delimited geographical zones comprising lands, wetlands, and portions of the sea, declared as such because they possess special significance and warrant the protection and conservation of the environment and its ecosystems, as well as historical and cultural resources. That provision expressly refers to the Organic Environmental Law for the regulation of the requirements and mechanisms governing the establishment or reduction of these areas.
By law, their administration falls exclusively to the Ministry of Environment and Energy, except for Natural Monuments. For its part, the Ley Forestal provides that when a state-owned protected wild area is declared, it must immediately become part of the natural heritage of the State (patrimonio natural del Estado), governed by Article 13 of that law, which expressly states that its administration corresponds to MINAET. That body of law must be interpreted in conjunction with the final clause of Article 58 of the Biodiversity Law, which recognizes the acquired rights (derechos adquiridos) of Indigenous and peasant populations and natural or legal persons over lands declared to be protected wild areas and their management categories. This is supplemented by Article 7 of the Possessory Title Proceedings Law (Ley de Informaciones Posesorias), which states: “When the property to which the possessory title proceeding (información posesoria) relates is located within a protected wild area, regardless of its management category, the title claimant (titulante) must demonstrate that they hold the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree creating that protected wild area.” In this case, it must be verified whether the chain of possession (cadena posesoria) from 1975 or earlier through the present has been demonstrated—that is, for a period exceeding the ten years preceding the designation of the zone under the management category corresponding to Refugio Nacional de Vida Silvestre Peñas Blancas, which occurred in 1985—in order to find that the applicant has acquired rights allowing the applicant to seek recognition of the right of ownership over the property and issuance of a registrable title.
In this regard, the Constitutional Chamber of the Supreme Court of Justice, in voto voto 144-96- issued at 16:51 on 9 de enero de 1996, held: “When forest reserves, protective zones, and national wildlife refuges are established, the owner is given the option of retaining the land because, by following the management plan, the owner may continue to use it for economic purposes; in other words, the restrictions imposed are not of such magnitude as to prevent the owner from exploiting the property and therefore do not render the right of ownership ineffective.” In addition to the foregoing, this Court must determine whether ecological possession (posesión ecológica) has been exercised, in light of the soil study, the judicial inspection (reconocimiento judicial) conducted for that purpose by the trial judge, and the testimony.
VIII- In view of the grounds for appeal in this specific case, and upon assessing the three statements under sections 54 and 61 of the Agrarian Jurisdiction Law, considered as a whole together with the remaining evidence collected, this Court finds it established that the title claimant exercised legally sufficient possession (posesión idónea) in a manner respectful of natural resources for more than ten years before 1995, relying on the possession exercised by the claimant’s transferor, [Nombre3], who transferred it to the title claimant. For this purpose, the claimant submitted the public deed of acquisition, in accordance with Article 1 of the Ley de Informaciones Posesorias. It appears in the record (folio 5), together with a deed of sale from 1970 by which [Nombre3] acquired the property from [Nombre4], who, according to the document, transferred to her 28 years of possession previously conveyed by [Nombre6] (folio 6).
Testimonial evidence was also received on 29 de junio del 2017. In this regard, [Nombre3] testified (minutes at folio 74) that she was elderly, 82 years old, and a resident of Miramar. She had known the applicant for 20 or 25 years and the property for more than 45 years. She identified herself as the person who sold it to the title claimant and stated that he is the sole owner. She was unaware of any timber having been removed from the property and stated that it had remained in a state of conservation, that the property was fenced, that there were no structures, and that the areas adjoining the stream running along its sides were protected. She had never known of any disputes with others or with adjoining landowners, and the title claimant was recognized as the owner. This testimony establishes her knowledge of the land, since she transferred it by public deed to the title claimant on 8 de julio de 1993.
For his part, witness [Nombre7] (folio 76) testified that he had known the property for thirty years. It was purchased by [Nombre3] from a woman whom he identified as [Nombre8]; it was then transferred to [Nombre3], who sold it to the applicant, who has continued possessing it as owner. Consistently, he stated that there were no structures, that it had always been possessed openly, peacefully, and without disputes, and that no timber had been removed. This Court observes that this witness’s knowledge of the land dates from 1987, given the number of years he had known it, but he recognizes [Nombre3] as the person who acquired it and transferred it to the title claimant. On those points, his testimony is consistent with that of the preceding witness. As to the person whom he stated transferred it to [Nombre3], whom he identified as [Nombre8], although this does not match the person appearing in the public deed as the seller to [Nombre3], namely [Nombre4], this discrepancy does not undermine the information contained in that transfer document.
Furthermore, witness [Nombre9] (folio 77) testified that he had known the property for approximately 20 years, since the applicant purchased it from [Nombre3], whom he recognized as the prior owner. He also stated that possession had been peaceful and free of problems with anyone. This person’s testimony establishes his knowledge of the exercise of possession and the chain of transfer between [Nombre3] and the applicant. This must be supplemented by the information in the documents supporting the 1970 sale in favor of [Nombre3], to whom 28 years of possession were transferred (that is, since 1942). As stated, the three testimonies must be assessed as a whole in relation to the submitted documents, from which it may collectively be inferred that the property has been possessed continuously, with acts of care, clearing, and fencing performed peacefully, uninterruptedly, and peacefully for well over ten years before 1985.
This Court finds the statements useful and relevant for demonstrating ten-year possession predating 1985, in accordance with Article 7 of the Ley de Informaciones Posesorias, when the property became subject to the 1985 declaration of a protected wild area that created the aforementioned Wildlife Refuge and, subsequently, in 1992, when the aforementioned Protective Zone was created. This Court notes that the chain of possession of the property for which title is sought is clear, as explained above. Witness [Nombre7]’s omission of [Nombre6] as [Nombre3]’s transferor does not undermine his knowledge of the property, because he described plainly and without confusion the exercise of possession by [Nombre3], who, according to the deed by which she acquired the property, purchased it from [Nombre4], who had possessed it for 28 years before 1970. Regarding the precision of dates and the identities of possessors of an unregistered property, the Agrarian Court has held: “Furthermore, it is important to note that witnesses need not be so precise regarding the exact dates of possession by each transferor or know all of them, particularly in cases such as this one, in which the property has had so many owners, because what matters is that there be some reference to the persons connected with the exercise of possession throughout all those years and to the protection being afforded to the forest resource, given the requirements imposed by Article 7 of the Ley de Informaciones Posesorias, as well as to land use consistent with the certification at folio 179, among other legal requirements that the appellant has not challenged.-” (voto N. 874-F-08).
This criterion has been maintained in subsequent decisions and is shared by this Chamber. For purposes of determining whether title may be granted to land located within protected wild areas, what matters is the knowledge of the property that the witnesses are able to establish regarding the sufficient age of the chain of possession and the acts performed on the property; their statements must be supplemented by the documents submitted. This Court notes that the witnesses’ testimony and the 1970 deed of sale establish facts extending back beyond 1975. Therefore, the requirement under section 6 of the Ley de Informaciones Posesorias concerning proof of legally sufficient possession for the legally prescribed period has been satisfied.
IX- Regarding the nature of the property. In accordance with the land-use study (estudio de uso de suelos) and the judicial inspection conducted by the trial court, no act has been established that harmed natural resources in a manner capable of defeating the legally sufficient possession required by Article 7 of the Ley de Informaciones Posesorias with respect to environmental protection. The judicial-inspection report (folio 781) recorded that the land had conservation vegetation cover (cobertura vegetal de conservación) along the banks of the stream and was devoted to pasture and woodland containing trees native to the area and scrubland; no springs (nacientes), evidence of tree cutting, or structures were observed. For its part, the soil study (land-use study, folios 16 to 21) recorded land use consistent with its prescribed use, noting a property devoted to pasture and forest cover (cobertura boscosa).
It further recorded that one hundred percent of the land was being used consistently with its prescribed use. This is in addition to the witness testimony expressly stating that no timber had been removed from the land. All this evidence establishes compliance with the legal requirements for proving legally sufficient possession of the land at issue in these proceedings in the capacity of owner. This Court finds no obstacle preventing it from concluding that the proceeding brought should be approved.
X- For the reasons stated, it is concluded that, in compliance with the requirements of the Ley de Informaciones Posesorias, Código Civil, Ley de Manejo, Uso y Conservación de Suelos and its Reglamento, as well as the Ley Forestal, the applicant has benefited from the possession exercised by his transferor since 1993, who in turn acquired in 1970 a prior possession of 28 years. That is, for a ten-year period predating the creation of Refugio Nacional de Vida Silvestre Peñas Blancas in 1985 and Zona Protectora Montes de Oro in 1994. Such possession was exercised in a manner suitable for acquiring ownership by adverse possession (usucapir), for which he submitted a public instrument recording the transfer of his right; when considered together with the statements of the three witnesses, this clearly established the chain of possession (cadena posesoria) and the qualifying nature of the possession, in accordance with Article 863 of the Código Civil and Article 7 of the Ley de Informaciones Posesorias, as required to acquire the right to be issued a title eligible for registration in the Registro Público for his property.
The possession was exercised with due regard for the natural resources located on the land. Accordingly, the judgment under appeal must be reversed and the possessory title proceeding (proceso de información posesoria) instituted must be approved. The Registro Público must also be ordered to register, free of real-property charges and encumbrances, in the name of [Nombre1] , identification card CED7, married once, resident of San José, the unregistered property classified as pastureland, pasture, and forest cover (cobertura boscosa). Located at [Dirección8] , in the province of Puntarenas. Boundaries: to the north, [Dirección7], with a linear frontage of seven meters; south, [Dirección7], with a linear frontage of seven meters, and in part with an intervening stream, [Nombre2] ; east, [Dirección7], with a linear frontage of seven meters; and west, [Nombre2] . Area: Cincuenta y siete mil cuatrocientos cincuenta square meters.
Cadastral plan P-1882418-2016. The property is valued at cinco millones de colones. It is hereby ordered that land-use change (cambio de uso de suelos) is prohibited in forest areas and that the management plan (plan de manejo) of Zona Protectora and Refugio Nacional de Vida Silvestre must be observed. It is ordered that, because the property borders [Dirección9] to the north, south, and east, the right-of-way (derecho de vía) is catorce metros, pursuant to Article four of the Ley de Caminos Públicos and Article nineteen, subsection a), of the Ley de Informaciones Posesorias, and must be respected. Because that area is in the public domain (dominio público), it does not form part of the parcel to be registered. Furthermore, because the property borders an unnamed stream, it remains subject to the restrictions of the Ley de Aguas and the protection areas (áreas de protección) established by the Ley Forestal.
This property remains subject to the reservations established by the Ley de Aguas, Ley Forestal, and Ley de Caminos Públicos, pursuant to Article nineteen of the Ley de Informaciones Posesorias. The trial court shall issue the corresponding certified judgment for enforcement (ejecutoria) and is authorized to make any corrections necessary to secure registration.
XI- DISSENTING OPINION OF JUDGE [Nombre10] : I do not agree with the majority’s position in this judgment approving the application, because I believe it should have been denied and resolved as follows: Article 6 of the Ley de Informaciones Posesorias provides: “Proof of possession shall be established through the statements of three witnesses who reside in the canton where the property is located…” Compliance with the requirements established in this law for land titling is mandatory, including the necessary proof of ten years’ possession (posesión decenal) through three witnesses; in their absence, the possessory title application must be denied. In the case under review, statements were received from three witnesses; however, in addition to their knowledge of the land, each of them should have addressed specifically the manner in which the previous possessors exercised possession and whether or not they cared for the resource, particularly because 100% of the property lies within the protected wildlife area (área silvestre protegida) Zona Protectora Montes de Oro and 30,02% lies within Refugio Nacional de Vida Silvestre Peñas Blancas, created by Ley 7018 of 13 de diciembre de 1985.
They were also required to establish the conditions set forth in Article 856 of the Código Civil. Those requirements relate not only to the current possessor but also encompass the manner in which the derivative possession (posesión derivada) sought to be asserted was exercised and the duration of each possessor’s possession. It is very important to identify the previous possessors and the duration of each one’s possession in order to assert derivative possession. Those witness statements are a mandatory requirement under Article 6 cited above and must be consistent with the documentary evidence; that is, in this specific case, with the evidence of the sale agreement between [Nombre4] and [Nombre3] appearing at folio 6. The witnesses should have stated that this [Nombre4] formed part of the chain of possession, yet none of them referred to him. The testimony of Ms. [Nombre3] refers only to the fact that she was the possessor and transferred the property to [Nombre1] , without stating the duration of her possession or identifying the person from whom she acquired it (see the incomplete testimony at folio 74).
For his part, the witness Mr. [Nombre7], at folio 76, who stated that he was the husband of Ms. [Nombre3], testified that the property had been acquired from a woman named [Nombre8] , that they later purchased it and placed it in the name of his wife, [Nombre3], who owned it for approximately cinco años and then sold it to [Nombre1] , that the latter sale occurred approximately veinticinco años ago, and that [Nombre1] has remained its sole owner ever since. The third witness likewise did not provide proof of the applicant’s derivative possession, as he referred only to the fact that [Nombre1] acquired the property from Ms. [Nombre3] and had exercised possession ever since, without addressing the duration of possession transferred to him by Ms. [Nombre3] or her transferor, Mr. [Nombre4], as the appellant seeks to assert.- None of the testimony refers to the prior possessor, [Nombre11] ; only the witness [Nombre7] mentions a former possessor named [Nombre8] and states that they held possession for only 5 años before transferring it to [Nombre1] .
The chain of possession described in the documents is inconsistent with this witness statement, and the other two witnesses likewise do not refer to the transferors who preceded Ms. [Nombre3]. No complete information is provided regarding all those who participated in that chain of possession, the duration of their respective possession, the nature of the acts undertaken, whether those acts involved conserving or caring for the resource, or the manner in which they were performed, so as to verify compliance with Article 7 of the Ley de Informaciones Posesorias, particularly because 100% of the property lies within Zona Protectora Montes de Oro and 30,02% within Refugio de Vida Silvestre Peñas Blancas. In this same regard, see Vote numbers 117 and 118 of this Court, both from dos mil seis.- The appellant states that the witness testimony may be supplemented by the instrument transferring possession.- The fact that a document bearing a legally certain date (fecha cierta) was executed and records the transfer from [Nombre4] to Ms. [Nombre3] and from her to the applicant herein does not constitute conclusive proof of the transferor’s ten years’ possession, because that public instrument does not attest to possession but rather to the legal transaction entered into by the parties at that time, based on the information they themselves provided.
The notary does not certify the years of possession that the parties state they exercised, since the notary merely drafts the corresponding deed on the basis of the representations made by its executing parties. It is therefore necessary to establish that such legal transaction is consistent with the statements made by the three witnesses concerning ten years’ possession, a requirement the applicant has not satisfied. I agree with the appellant that the statement of [Nombre3] should be considered even though she is the transferor. It should be noted that the statement of the aforementioned witness, [Nombre3], concerns the fact that she possessed the property and knows the land that she transferred to the applicant herein. This witness is admissible because she is the person with the most direct knowledge of the existence of the possession required for the claimant to acquire ownership by adverse possession.
Although it is true that this witness is testifying about her own acts—that is, about the existence of possession that once belonged to her—she is not doing so to obtain a personal benefit in this proceeding, since her statement is offered in favor of a third party, namely for the benefit of the current possessor. I therefore do not agree with the argument used by the lower-court judge (a-quo) to deny the titling application; rather, it should have been denied for the reasons stated at the beginning of this recital (considerando).-
POR TANTO:
The evidence offered by the appellant in this instance to assist the Court in reaching its decision (prueba para mejor resolver) is rejected. Judgment number dos mil diecinueve cero cero cero cuatro, issued at catorce horas y cincuenta y cuatro minutos on catorce de enero del dos mil diecinueve, is reversed. In its place, the possessory title application is approved, and the Registro Público is ordered to register, free of real-property charges and encumbrances, in the name of [Nombre1] , of legal age, attorney, identification card CED8- - , married once, resident of San José, the following unregistered property: classified as pastureland, pasture, and forest cover. Located at [Dirección6] , [Dirección10] Montes de Oro, province of Puntarenas. VOTO N° 501-F-19 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciocho horas y treinta y tres minutos del veinticinco de junio de dos mil diecinueve.- PROCESO DE INFORMACIÓN POSESORIA, promovida por [Nombre1] , casada una vez, Biólogo, vecino de San José, Pavas, cédula de identidad CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Susana Fallas Cubero, mayor, casada, abogada, vecina de San José, cédula de identidad CED2 - - , en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica número CED3 - - - , representado Marjorie Mayela Madrigal Muñoz, mayor, divorciada dos veces, abogada, cédula de identidad CED4 - - , vecina de San Ramón de Alajuela, en su condición de apoderada general judicial. Tramitado ante el Juzgado Agrario de Puntarenas.-
RESULTANDO:
Redacta la jueza Castro García; y,
CONSIDERANDO
I- Hechos Probados. Se prohíjan los hechos probados numerados uno a cuatro por estar fundados en elementos probatorios que constan en autos. No asi los restantes por ser requisitos del proceso. De importancia en esta instancia, se tienen por acreditado en este asunto los siguientes hechos: 8) La finca objeto de este proceso se ha dedicado a pastos, potreros ,charral y conservación, delimitación y mantenimiento, ejerciéndose un uso conforme de suelos. (Prb./ escrito inicial en folios 8 a 11, declaraciones testimoniales y reconocimiento judicial de folios 74 a 78, estudio de uso de suelos en folios 16 a 21). 9) [Nombre1] adquirió la finca de [Nombre3] por venta suscrita en escritura pública número 47 del 8 de julio de 1993. Y a su vez ésta adquirió el 30 de mayo de 1970 de [Nombre4] una posesión de veintiocho años, por compra venta. (Prb./ escrito inicial en folios 8 a 11, declaraciones testimoniales en folios 74 a 77, escritura de venta a folio 5 y contrato de venta a folio 6).
II- Hechos no probados. No se prohíjan los hechos no probados contenidos en la sentencia recurrida, por existir prueba que estableces otra base fáctica.
III- Apelación.- La parte promovente apela la sentencia que denegó sus solicitud de obtener titulo inscribible, número 201900004 de las catorce horas cincuenta y cuatro minutos del catorce de enero del dos mil diecinueve, (expediente/escritos/fechas/14/01/2019 14:54:46). Estima el recurrente, existe suficiencia probatoria de naturaleza documental (escrituras diversas), de las cuales se acredita la posesión derivada que ha sido ejercida en forma precedente al año 1975. Detalla, se celebra por [Nombre4] la venta a [Nombre3] el 30 de mayo de 1970, mencionándose que se transmitía la posesión sobre un inmueble situado en Zapotal de Montes de Oro. Con cabida de menos de ocho manzanas. Que adquirió de [Nombre5][Nombre6] hacía 28 años. Luego en 1993, por escritura pública CED6 otorgada ante el Notario Jaime Quintana López, [Nombre3] le vende el derecho de posesión al titulante, derivándole aproximadamente 23 años de posesión.
Hacce ver, se acredita el ejercicio de la posesión desde al menos 1942 con ambas escrituras aportadas.- Respecto a las declaraciones testimoniales, reseña que las preguntas no fueron correctamente formuladas. Y debe considerarse son personas de 80 años de edad, que en razón de su edad no precisaban el tiempo. No se advirtió que [Nombre3] no era apta para ser testigo por su condición de transmitente, y de así haberlo estimado debió advertirse. Al respecto aduce, ella no declara sobre hechos propios sino sobre la existencia de la venta. Además de la no extracción de madera; pues el fundo le perteneció.- Reclama la ausencia de valoración integral de la prueba de las declaraciones testificales en relación con la documental. Pues de tales en su conjunto, se concluye que sobre el inmueble existe una posesión desde antes de 1975. Resume la prueba documental adjunta a los autos y así como la de los testigos, que ofrece ante esta instancia. - (Ver recurso de apelación en archivo del 17/01/2019 04:15:10).-
IV.Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad un inmueble con naturaleza de potreros, pasto y cobertura boscosa. Sito en [Dirección6] , cantón cuarto Montes de Oro de la provincia de Puntarenas. Linda al norte: con [Dirección7] conn frente lineal de siete metros; Sur: [Dirección7] con frente lineal de siete metros y en parte quebrada en medio [Nombre2] ; Este: [Dirección7] con frente lineal de siete metros y Oeste: [Nombre2] . Mide: Cincuenta y siete mil cuatrocientos cincuenta metros cuadrados. Plano catastrado P-1882418-2016 Estimado en inmueble en cinco millones de colones. Lo anterior según escrito inicial y memorial (folios 8 a 11 y 26 a 26, 65), Estudio de suelos (folios 16 a 21) y reconocimiento judicial (folio 781). Dicho bien es parte de área silvestre protegida en cien por ciento en Zona Protectora Montes de Oro Río creada en el año de 1994, por decreto ejecutivo 23142-MIRENEM del 27 de abril de 1994 y en un 30% en el Refugio Nacional de Vida Silvestre Peñas Blancas creado por Ley 7018 del 13 de setiembre de 1985.
Conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada. (certificación en folio 15). El fundo se encuentra fuera de terrenos o propiedades administradas por el Instituto de Desarrollo Rural ( Prb./memorial en folio 50). Aunado a lo anterior, el promovente no ha inscrito fincas al amparo de la Ley de Informaciones Posesorias, según certificación emitida por el Registro Nacional. (certificación en folio 4). Se verifica, el edicto de ley fue publicado en el Diario Oficial (folio 52). La unica persona colindante quebrada de por medio [Nombre2] se dio por notificada y se encontró conforme mediante escrito de apersonamiento aportado (escrito en folio 24).
V- Vistos los agravios contra la pieza apelada señala este Tribunal, cabe citar que las reglas del ordinal 54 de la Ley de Jurisdicción Agraria, establece el sistema de la libre valoración probatoria para los procesos agrarios. Sistema que exige al tribunal estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El tribunal deberá exponer los principios de equidad o de derecho sobre los cuales funda su decisión. Al respecto, la Sala Constitucional ha resuelto: "..., la apreciación de la prueba en conciencia no implica resolver en forma arbitraria, por cuanto todo juez -como funcionario público que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derechos constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política, tal y como lo entendió esta Sala en sentencia 3484-94, de las doce horas del ocho de julio de mil novecientos noventa y cuatro, en que determinó que las facultades de los jueces de apreciar la prueba en conciencia no resultan contrarias a la obligación del juez de fundamentar sus fallos, principio constitucional que integra el debido proceso...
() no resulta inconstitucional el poder otorgado al juez agrario para apreciar en conciencia la prueba y valorarla sin sujeción estricta a las normas del derecho común según lo dispuesto en el párrafo segundo del artículo 54 impugnado, siempre y cuando dicte un fallo fundamentado, es decir analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio, respetando de tal modo los contenidos mínimos del derecho de defensa" (voto 3657 del 7 de mayo de 2003. Ver en igual sentido votos N° 398 del 6 de junio del 2001 de la Sala Primera. En igual sentido veáse votos No. 206 del 26 de marzo de 1999, N°46 del 26 de abril de 1995; Nª66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario). De igual forma se impone a la persona juzgadora la obligación de emitir una valoración integral de la prueba que conste en el expediente.
Aclarado lo anterior y estudiada la sentencia recurrida, encuentra esta instancia medió un análisis erróneo y individualizado de los elementos probatorios, sin entrar a valorar de forma integral lo indicado por las personas testigas y su confrontación con documentos de traspaso aportados para aprovechar la posesión ejercida en el pasado.
VI- Visto lo apelado cabe indicar, la sentencia venida en alzada N° 2019000004 las catorce horas y cincuenta y cuatro minutos del catorce de enero de dos mil diecinueve, imprueba el proceso de información posesoria por no tener por demostrada una cadena de transmisión de la posesión decenal anterior a la creación de las áreas silvestres protegidas, que afectaron el terreno, sean la Zona Protectora de Monte de Oro y Refugio Nacional de Vida Silvestre Peñas Blancas. Como se citó, tales categorías de manejo se crean por por decreto ejecutivo 23142-MIRENEM del 27 de abril de 1994 y en un 30% en el Refugio Nacional de Vida Silvestre Peñas Blancas creado por Ley 7018 del 13 de setiembre de 1985.Por ello, de conformidad con el ordinal 7 de la Ley de Informaciones Posesorias, la persona promovente debe acreditar el ejercicio de la posesión en condición de dueña en lo términos del artículo 856 del Código Civil, con al menos 10 años antes de la afectación del terreno a esa categoría de manejo; sea anterior al año 1985. Para justificar la posesión, acorde con el ordinal 6 de la Ley de Informaciones Posesorias se deben aportar tres testigos. Además, al pretender aprovechar la posesión transmitida, debió adjuntar el título por el cual adquirió el fundo, según regula el artículo 1 Ibídem.
VII- Sobre el régimen de tenencia de la tierra en áreas silvestres protegidas, ha de indicarse, independientemente de su categoría de manejo, deben ser entendidas como zonas con un régimen de administración y normativa particular y específica, supeditadas a planes de manejo que aseguran su protección, conservación y uso racional de los recursos naturales. Recae el MINAET su administración, manejo y tutela, salvo ley especial que indique otra situación. El artículo 58 de la Ley de Biodiversidad, las define como zonas geográficas delimitadas, que se forman de terrenos, humedales y porciones de mar, declaradas como tales por representar una significancia especial, un interés de tutela y conservación del ambiente y sus ecosistemas, así como históricos y culturales. Esta norma hace una remisión expresa a la Ley Orgánica del Ambiente sobre la regulación de los requisitos y mecanismos para el establecimiento o reducción de estas áreas.
La administración por Ley recae en forma exclusiva sobre el Ministerio de Ambiente, Energía; salvo los Monumentos Naturales. Por su parte, la Ley Forestal prevé que cuando se declare un área silvestre protegida de propiedad estatal, ésta debe pasar en forma inmediata a formar parte del patrimonio natural del Estado, regulado por el artículo 13 de la citada norma que expresamente señala que su administración corresponde al MINAET. Ese conjunto normativo debe interpretarse con lo prescrito en el artículo 58 in fine de la Ley de Biodiversidad, que reconoce los derechos adquiridos por poblaciones indígenas, campesinas, personas físicas o jurídicas, sobre los terrenos que sean declarados áreas silvestres protegidas y sus categorías de manejo. Ello se complementa con el artículo 7 de la Ley de Informaciones Posesorias cuando indica: "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." En este caso, debe ser verificado si se demuestra la cadena posesoria desde el año 1975 o antes y hasta la actualidad, sea por un plazo mayor a los diez años anteriores a la afectación de la zona mediante la categoría de manejo que corresponde al Refugio Nacional de Vida Silvestre Peñas Blancas ocurrida en 1985, para entender que los derechos adquiridos del promovente de solicitar el reconocimiento de su derecho de propiedad sobre el fundo y expedición de título inscribible.
Al respecto, la Sala Constitucional de la Corte Suprema de Justicia en voto voto 144-96- de las 16:51 horas del 9 de enero de 1996, resolvió: " En el caso de establecerse reservas forestales, zonas protectoras y refugios nacionales de vida silvestre, se da la opción de que el propietario conserve su tierra, ya que, siguiendo el plan de manejo puede continuar aprovechándola en términos económicos, es decir, las limitaciones impuestas no son de tal magnitud que le impidan explotar su propiedad, por lo que no hacen nugatorio su derecho." Ademas de lo anterior, se debe analizar en esta sede, si se ha cumplido con el ejercicio de la posesión ecológica, a la luz del estudio de suelos, el reconocimiento judicial que al efecto celebró la juzgadora y los testimonios.
VIII- Dados los agravios en este caso concreto, valoradas las tres declaraciones a la luz del canon 54 y 61 de la Ley de Jurisdicción Agraria de forma integral con la restante prueba recabada, se tiene por demostrada en esta Instancia el ejercicio de una posesión idónea y en respeto a los recursos naturales, mayor a la decenal anterior al año 1995 por parte del titulante, que aprovechó la posesión ejercida de su transmitente [Nombre3] , que le transmite al titulante y para ello aportó escritura pública de adquisición, de conformidad con el artículo 1 de la Ley de Informaciones Posesorias. Consta en autos (folio 5), así como compraventa del año 1970 donde [Nombre3] adquiere de [Nombre4] y le transmite según el documento una posesión de 28 años que le enajenó [Nombre6] (folio 6). Además se rindió la prueba testimonial el día 29 de junio del 2017. Al respecto declara [Nombre3] ( acta en folio 74) que indicó ser mayor, de 82 años, vecina de Miramar.
Conoce a la promovente desde hace 20 o 25 años y el fundo desde hace más de 45 años. Se identifica como la persona que le vende al titulante; que es el único dueño. No saber que se hubiera sacado madera del fundo y mantenerse en estado de conservación, estar cercada la finca, sin construcciones y protegidas las áreas que se ubican aledañas a la quebrada que pasa por los costados. Nunca constarle conflictos con otros o colindantes y reconocerse al titulante como el propietario. Este testimonio acredita el conocimiento del terreno pues la transmitió según la escritura pública al titulante en el 8 de julio de 1993. Por su parte el testigo [Nombre7] (folio 76), declaró conoce el fundo desde hace treinta años. Se le compró por [Nombre3] a una señora que identifica como [Nombre8] , luego se traspasó a [Nombre3], que le vende a el promovente, que se ha mantenido poseyendo como dueño. De forma coincidente cita que no hay construcciones, siempre ha sido poseído de forma pública, pacífica y sin conflictos.No se ha extraído madera.
Observa este Tribunal, el conocimiento del terreno que tiene este testigo es del año 1987 dados los años de conocer el terreno, pero reconoce a [Nombre3] como la persona que adquiere y transmite al titulante. En esos aspectos resulta coincidente con lo declarado por la testiga anterior. Respecto a la persona que indica le transmite a [Nombre3] que identifica como [Nombre8] , si bien no coincide con quien aparece en la escritura pública vendiendo a [Nombre3] que es [Nombre4] , ello no es un obstáculo para desvirtuar lo que se indica en ese documento de transmisión. Por otra parte, el testigo [Nombre9] ( folio 77) declara conocer el fundo hacia 20 años, cuando le compra el promovente a [Nombre3], a quien reconoce como la dueña anterior. Asimismo que la posesion ha sido pacífica y sin problemas con nadie. Lo declarado por esta persona acredita su conocimiento del ejercicio de la posesión y la cadena de transmisión de [Nombre3] y el promovente.
Lo que debe ser complementado con lo indicado en los documentos que soportan las ventas de 1970 a favor de [Nombre3] a quien se le transmite una posesión de 28 años ( sea desde 1942). Como se indicó, la valoración integral de los tres testimonios se debe hacer respecto a los documentos aportados, de los cuales en su conjunto se deduce que la finca ha estado en posesión de forma continua, ejerciendo actos de cuido, limpieza, cercado de forma pacífica, ininterrumpida y pacífica mucho más que diez años antes de 1985. Para esta Instancia las declaraciones resultan útiles y pertinentes a los efectos de demostrar la posesión decenal anterior al año 1985, acorde con el artículo 7 de la Ley de Informaciones Posesorias, cuando la finca resultó afectada por la declaratoria de área silvestre protegida de 1985 que creó el Refugio de Vida Silvestre citado y posteriormente en 1992 cuando se crea la Zona Protectora mencionada.
Nota esta Sede, existe claridad en la cadena posesoria del inmueble que se pide titular según se expuso supra. La omisión de citar a [Nombre6] como transmitente de [Nombre3] por el testigo [Nombre7] no desvirtúa el conocimiento del inmueble, al describir de forma llana y sin confusiones el ejercicio de la posesión por [Nombre3], que según la escritura por la que adquiere compra a [Nombre4] , quien poseyó poe 28 años antes de 1970. Con respecto a la precisión de fechas y poseedores de un fundo sin inscribir y sus nombres, el Tribunal Agrario ha resuelto: " Además, es importante señalar que no es preciso que los testigos sean tan puntuales en cuanto a fechas exactas de posesión de cada uno de los transmitentes, o conozcan a todos éstos, menos aún en casos como el presente en el que el fundo ha tenido tantos dueños, pues lo importante es que exista una referencia a las personas vinculadas con el ejercicio de la posesión durante todos esos años y a la protección que se está haciendo del recurso forestal dadas las exigencias que plantea el artículo 7 de la Ley de Informaciones Posesorias y al uso conforme del suelo de acuerdo a la certificación de folio 179, entre otros requisitos legales que no han sido objetados por la apelante.-" ( voto N. 874-F-08).
Criterio que se ha sostenido en votos posteriores y que comparte esta Cámara. Lo importante a fin de determinar si procede o no una titulación de un terreno ubicado dentro de áreas silvestres protegidas, es el conocimiento que se logre acreditar por parte de los testigos del fundo, sobre la antigüedad suficiente de la cadena posesoria y los actos ejercidos en el inmueble, cuyas declaraciones deben complementarse cos los documentos aportados . Nota esta Sede, lo declarado los testigos y la escritura de venta de 1970, acredita hechos que van más allá del año 1975, Por lo tanto, se tiene por cumplido el requisito del ordinal 6 de la Ley de Informaciones Posesorias respecto a la demostración de la posesión idónea por el plazo legal exigido.
IX- Sobre la naturaleza del fundo. Acorde con el estudio de uso de suelos y el reconocimiento judicial realizado por el juzgado de instancia no se tiene por acreditado acto alguno que lesione los recursos naturales capaces de enervar la idoneidad de la posesión exigida por el artículo 7 de la Ley de Informaciones Posesorias en respecto del ambiente. En el acta de reconocimiento judicial (folio 781 , se consignó haberse encontrado un terreno con cobertura vegetal de conservación en las riberas de la quebrada,, dedicado a pastos y montes con árboles propios de la zona, charrales,, noi haber visto nacientes, vestigio de corta de árboles o construcciones. Por su parte, el estudio de suelos (estudio de uso de suelos folios 16 a 21) consignó ejercerse un uso conforme de suelos observando una finca dedicada a pastos y cobertura boscosa. Y ejercerse un uso conforme de suelos en un cien por ciento. Auando a las declaraciones testimoniales que de forma expresa indicaron no haberse extraído madera del terreno. Todas estas probanzas acreditan el cumplimiento de las exigencias legales a fin de acreditar la posesión idónea en condición de dueño del terreno objeto de este proceso. No encontrando obstáculo alguno que impida a este Tribunal considerar que procede aprobar el proceso planteado.
X- Por los motivos expuestos se concluye, en cumplimiento de los requisitos de la Ley de Informaciones Posesorias, Código Civil, Ley de Manejo, Uso y Conservación de Suelos y su Reglamento, así como la Ley Forestal, el promovente ha aprovechado la posesión ejercida por su transmitente, desde la década de 1993, que a su ves adquirió en el año 1970 una psoesión anterior de 28 años. Es decir, en un plazo decenal superior anterior de la creación del Refugio Nacional de Vida Silvestre Peñas Blancas de 1985 y Zona Protectora Montes de Oro de 1994. Posesión ejercida en forma idónea para usucapir de lo cual aportó documento público, donde consta el traspaso de su derechom, que integrada con las declaraciones de los tres testigos, se acreditó claramente la cadena posesoria y la condición de la posesión apta, acorde con el artículo 863 del Código Civil y 7 de la Ley de Informaciones Posesorias, necesaria para adquirir el derecho a que se le expida título inscribible en el Registro Público de su inmueble.
Posesión desarrollado en respecto de los recursos naturales que contiene el terreno. Por ello, se deberá revocar la sentencia recurrida y aprobarse el proceso de información posesoria promovido. Así como ordenarse al Registro Público inscribir libre de cargas reales y gravámenes, a nombre de [Nombre1] , cédula CED7, casado una vez, vecino de San José, el inmueble sin inscribir con naturaleza de potreros, pasto y cobertura boscosa. Sito en [Dirección8] , de la provincia de Puntarenas. Linda al norte: con [Dirección7] conn frente lineal de siete metros; Sur: [Dirección7] con frente lineal de siete metros y en parte quebrada en medio [Nombre2] ; Este: [Dirección7] con frente lineal de siete metros y Oeste: [Nombre2] . Mide: Cincuenta y siete mil cuatrocientos cincuenta metros cuadrados. Plano catastrado P-1882418-2016 Estimado en inmueble en cinco millones de colones. Se decreta, se prohíbe el cambio de uso de suelos en las zonas de bosques y que debe acatarse el plan de manejo de la Zona Protectora y Refugio Nacional de Vida Silvestre.
Se decreta que por colindar la finca al rumbo norte, sur y este con [Dirección9] , el derecho de vía es de catorce metros, de conformidad con el artículo cuatro de la Ley de Caminos Públicos y diecinueve inciso a) de la Ley de Informaciones Posesorias y que debe ser respetado. Area que por ser dominio público, no es parte del fundo a inscribir. Además que por colindar con quebrada sin nombre, queda sujeto a las limitaciones de Ley de Aguas y áreas de protección de Ley Forestal. Queda la presente finca afecta a las reservas de Ley de Aguas, Ley Forestal y Ley de Caminos Públicos, según el artículo diecinueve de la Ley de Informaciones Posesorias. Proceda el Juzgado de instancia a emitir la ejecutoria correspondiente y se le autoriza a hacer las correcciones que sean necesarias a fin de lograr la inscripción registral.
XI- VOTO SALVADO DE LA JUEZA [Nombre10] : No comparto el criterio de mayoría contenido en esta sentencia aprobatoria por cuanto considero la misma debió improbarse y resolverse de la siguiente forma: El artículo 6 de la Ley de Informaciones Posesorias reza: “ La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble…” Los requisitos expuestos en esta ley para la titulación de tierras son de obligatorio cumpliendo, y entre ellos lo es la necesaria demostración de la posesión decenal con tres testigos, al falta de ellos la información posesoria deberá denegarse. En el caso bajo examen, se recibió la declaración de tres testigos, sin embargo cada uno de ellos debió referirse concretamente además del conocimiento del terreno, a la forma de la posesión de los anteriores poseedores, si éstos cuidaron o no el recurso máxime se está dentro del 100% del área silvestre protegida Zona Protectora Montes de Oro, y en un 30,02% dentro del Refugio Nacional de Vida Silvestre Peñas Blancas creado mediante Ley 7018 del 13 de diciembre de 1985.
Además demostrar las condiciones establecidas en el artículo 856 del Código Civil, siendo tales requisitos no sólo referidos al actual poseedor, sino también comprende a la forma de la posesión derivada que se pretende hacer valer, y el tiempo de posesión de cada uno de ellos. Es de mucha importancia hacer referencia a quienes fueron los anteriores poseedores así como el tiempo de posesión de cada uno de ellos para así hacer valer una posesión derivada. Dichas declaraciones testimoniales son obligado requisito según el artículo 6 citado supra, y deben ser coincidentes con la prueba documental, es decir, en el caso concreto con la prueba de contrato de venta entre [Nombre4] y [Nombre3] visible a folio 6, debieron los testigos referirse a que dentro de la cadena posesoria se encontraba este señor [Nombre4], y ninguno hizo referencia al mismo. El testimonio de doña [Nombre3] hace referencia únicamente a que ella era la poseedora y se lo transmitió a [Nombre1] , sin hacer referencia al tiempo de posesión ejercido por ella, ni tampoco indica la persona de la cual adquirió (ver testimonio omiso a folio 74).
Por su parte, el testigo señor [Nombre7] a folio 76, quien dijo ser el esposo de doña [Nombre3], manifestó esa finca se había adquirido de una señora [Nombre8] , luego se la compraron y se puso a nombre de su esposa [Nombre3], que fue la dueña por unos cinco años, y luego se la vendió a [Nombre1] , siendo esa última venta hace como unos veinticinco años y desde entonces [Nombre1] se ha mantenido como único dueño. El tercer testigo tampoco hace prueba de la posesión derivada del promovente, pues solo hace referencia a que [Nombre1] adquirió de doña [Nombre3] , y desde entonces ejerce la posesión, sin hacer referencia al tiempo de posesión que le traspasó doña [Nombre3], ni tampoco sobre el transmitente a ésta, señor [Nombre4] como lo pretende hacer valer el apelante.- Ninguno de los testimonios hacen referencia al anterior poseedor [Nombre11] , únicamente el testigo [Nombre7] hace mención a una anterior poseedora llamada [Nombre8] e indica tuvieron su posesión solo por 5 años antes de traspasarlo a [Nombre1] .
No hay coincidencia en la cadena posesoria que se indica en los documentos con relación a esta declaración testifical, ni tampoco los otros dos testigos refieren a los transmitentes anteriores a doña [Nombre3]. No se brinda una información completa de todos los participaron en esa cadena posesoria, ni los tiempos de posesión, ni en qué consistirían los actos desarrollados, si fueron de conservación o cuido del recurso, ni la forma que lo realizarían para así verificar el cumplimiento del artículo 7 de Informaciones Posesorias, máxime el inmueble se ubica dentro de Zona Protectora Montes de Oro en un 100% y Refugio de Vida Silvestre Peñas Blancas en un 30,02%. En este mismo sentido véase Voto número 117 y 118 de este Tribunal ambos del año dos mil seis.- La parte recurrente indica que la prueba testimonial se puede complementar con el documento de transmisión de la posesión.- El hecho que se hiciera un documento con fecha cierta, en el que consta el traspaso le hiciera [Nombre4] a doña [Nombre3] y ésta al aquí promovente, ello no hace plena prueba de la posesión decenal ejercida por el transmitente, por cuanto dicho documento público, no da fe de la posesión, sino del negocio jurídico que en ese momento hacen las partes de conformidad con los datos que éstas mismas le suministran, no siendo constancia para el notario los años de posesión que las partes indican han ejercido, pues éste se limita a redactar la escritura correspondiente con base en el dicho de las partes otorgantes de la misma.
De allí sea necesario la demostración y coincidencia del tal negocio jurídico con lo expresado por los tres testigos sobre la posesión decenal, lo que no ha sido cumplido por el promovente. Se comparte el criterio del recurrente sobre que debe considerarse la declaración de [Nombre3] , aún siendo esta la transmitente. Nótese la declaración de la citada testiga [Nombre3], es referido a que fue poseedora del inmueble y manifiesta conocer el terreno el cual traspasó al aquí promovente. Este testiga es admisible por cuanto es la persona a quien mejor le consta sobre la existencia de la posesión para usucapir la parte accionante. Si bien es cierto esta testiga está declarando sobre hechos propios, es decir, sobre la existencia de la posesión que alguna vez fuera de ella, no lo está haciendo para obtener su propio beneficio en este proceso, pues su declaración lo es a favor de un tercero, o sea en beneficio del actual poseedor, por lo que este argumento utilizado por la a-quo para improbar la titulación no es compartido, sino que la improbación debió ser por lo dicho al inicio de este considerando.-
POR TANTO:
Se rechaza la prueba para mejor resolver ofrecida en esta instancia por el recurrente. Se revoca la sentencia número dos mil diecinueve cero cero cero cuatro de las catorce horas y cincuenta y cuatro minutos del catorce de enero del dos mil diecinueve. En su lugar, se aprueba la información posesoria promovida y se ordena al Registro Público inscribir libre de cargas reales y gravámenes, a nombre de [Nombre1] , mayor, abogado, cédula CED8- - , casado una vez, vecino de San José, el inmueble sin inscribir: con naturaleza de potreros, pasto y cobertura boscosa. Sito en [Dirección6] , [Dirección10] Montes de Oro de la provincia de Puntarenas. Linda al norte: con [Dirección7] con [Dirección11] lineal de siete metros; Sur: [Dirección7] con frente lineal de siete metros y en parte quebrada en medio [Nombre2] ; Este: [Dirección7] con frente lineal de siete metros y Oeste: [Nombre2] . Mide: Cincuenta y siete mil cuatrocientos cincuenta metros cuadrados.
Plano catastrado P-uno ocho ocho dos cuatro uno ocho -dos mil dieciséis. Estimado el inmueble en cinco millones de colones. Se decreta, se prohíbe el cambio de uso de suelos en las zonas de bosques y que debe acatarse el plan de manejo de la Zona Protectora Montes de Oro y Refugio Nacional de Vida Silvestre Peñas Blancas. Se decreta que por colindar la finca al rumbo [Dirección12], y este con calle pública, el derecho de vía es de catorce metros, de conformidad con el artículo cuatro de la Ley de Caminos Públicos y diecinueve inciso a) de la Ley de Informaciones Posesorias y que debe ser respetado. Area que por ser dominio público, no es parte del fundo a inscribir. Además que por colindar con quebrada sin nombre, queda sujeto a las limitaciones de Ley de Aguas y áreas de protección de Ley Forestal. Queda la presente finca afecta a las reservas de Ley de Aguas, Ley Forestal y Ley de Caminos Públicos, según el artículo diecinueve de la Ley de Informaciones Posesorias.
Proceda el Juzgado de instancia a emitir la ejecutoria correspondiente y se le autoriza a hacer las correcciones que sean necesarias a fin de lograr la inscripción registral. Voto salvado de la Jueza Alvarado Paniagua.
