VOTO N° 260-F-17 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours and thirty-six minutes on the twenty-third of March, two thousand seventeen.- POSSESSORY TITLE PROCEEDING instituted by [Nombre1] , of legal age, married once, farmer, resident of Santa Juana de Aguirre, Puntarenas, identity card number CED1 - - . The PROCURADURÍA GENERAL DE LA REPÚBLICA participates in the proceeding, represented by Lydiana Rodríguez Paniagua, of legal age, single, attorney, resident of Alajuela, identity card number CED2 - - , in her capacity as deputy government attorney; and the INSTITUTO DE DESARROLLO RURAL , legal entity identification number CED3 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, identity card number CED4 - - , resident of Escazú, in her capacity as executive president, with the powers of an unlimited general attorney-in-fact. 3 .- Judge Yendri Patricia Rojas Pérez of the Juzgado Civil y Agrario de Puntarenas , by judgment number 71-2016 at eight hours on the eighteenth of July of the year two thousand sixteen , ruled: “ THEREFORE: In view of the foregoing, pursuant to the LEY DE INFORMACIONES POSESORIAS N° 139 of 14 de julio de 1941, as amended, these POSSESSORY TITLE PROCEEDINGS instituted by [Nombre1] , of legal age, married, farmer, resident of Santa Juana de Aguirre, [Dirección4] , identity card number CED5 , ARE APPROVED. The REGISTRO PUBLICO DE LA PROPIEDAD, Real Property Section, shall register in his name, without prejudice to third parties having superior rights and subject to the statutory limitations stated herein, the property described below: land consisting of pasture, secondary scrub, farmland, and forest, with a house and a sugar mill. Located in the third DISTRICT, Naranjito, sixth CANTON: Aguirre, in the province of Puntarenas.- BOUNDED: to the NORTH: [Nombre2] ; to the SOUTH: [Nombre3] and [Nombre4] , WEST: [Dirección2] ; and EAST: by Río Cotos.- AREA: one hundred thirty-six hectares, two thousand nine hundred thirty-nine square meters and sixty-three square decimeters , as shown on cadastral survey plan number six-uno uno dos dos tres seis tres-dos mil siete.- The property was appraised at the sum of FIFTY MILLION COLONES, as all requirements established for that purpose by the Ley de Informaciones Posesorias have been fulfilled.
A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad. Such registration shall be made with notice to the titleholder that the area adjoining Río Cotos and [Dirección5] or any other watercourses that exist or may exist along the boundaries of or within the property of Mr. [Nombre1] and that are specified in Article 33 of Ley Forestal Nº 7575 constitute protected areas (áreas de protección), and the cutting or removal of trees is prohibited. It shall likewise be placed on record that the beds and waters of those watercourses are in the public domain, as established by the Ley de Aguas, Article 1, subsection IV, and 3, subsection III. Also applicable are Articles 1, 2, 3, 4, 5, 6, 7 of the Ley de Informaciones Posesorias and 1, 2, 7 and 25 of the Ley de Jurisdicción Agraria, as well as the Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre and Ley Orgánica del Ambiente.
The recommendations issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria must also be followed. Once this decision becomes final, the corresponding certified final judgment (ejecutoria) shall be issued and this matter shall be closed" (folios 250 through 253 and reverse).-
5 .- Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Government Attorney, filed an appeal, expressly stating the reasons for challenging the trial court’s position (folios 281 through 295) . - 6 . - The statutory requirements have been observed in the conduct of the proceeding, and the judgment contains no apparent errors or omissions capable of rendering it null and void. - Drafted by Judge Castro García; and,
CONSIDERING:
II.The appeal was filed by Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Government Attorney, within the statutory period (folio 267). She disagrees with approving judgment N. 171- 2016 issued at 08:00 hours on 18 de julio del 2016 (folio 250 ). She states the following grounds for appeal:
III- Regarding the ground for appeal concerning the perpetual designation of forests as public-domain property. With respect to whether private parties may register forest-covered property located on untitled land, this Court finds that untitled land with forest cover (cobertura forestal), whether inside or outside protected wildlife areas, may be titled, provided that the legal requirements established in the various applicable bodies of law have been met. (In this regard, see Nº 51 issued at 15 hours 15 minutes on 26 de mayo de 1995 by the Sala Primera de la Corte Suprema de Justicia). Article seven of the Ley de Informaciones Posesorias, which was amended upon the enactment of the current Ley Forestal 7575, expressly authorized the titling of forested real property through this proceeding. This Court has ruled on the matter as follows: “With respect to forested properties located outside protected wildlife areas, that provision states: "...
Properties located outside those areas and containing forests may be titled only if the petitioner proves that he or she holds lawful rights arising from ten-year possession, exercised for at least ten years, and has protected that natural resource, on the understanding that the property must be properly demarcated and enclosed by fences or cleared boundary paths." The constitutionality of that provision and of the interpretation once adopted by this Court was challenged, resulting in the issuance of Constitutional Chamber decision 4587-97, which is precisely the decision cited by the appellant. In that decision, the Chamber declared the provision constitutional, thereby maintaining it in force. Under these circumstances, the appropriate disposition in this case is to affirm the trial court’s ruling, because the petitioner proved compliance with the requirements established in that Article, namely: ten-year possession, protection of the natural resource, and demarcation of the property by fences or cleared boundary paths”.

Likewise, the Constitutional Chamber again rejected the constitutional challenge to Article seven of the Ley de Informaciones Posesorias submitted by this Court under expediente EXPN1, leaving that provision and its effects in force, a fact that the judicial authorities cannot disregard.
IV.Regarding the objection concerning the inalienability (inalienabilidad) of the forest and the witnesses’ testimony. These proceedings are brought for the purpose of registering in the Public Property Registry a property consisting of forests, pastures, and fallow land, as indicated by the land-use study (folio 82) and the judicial inspection (reconocimiento judicial) (folio 108). Said property is not part of a protected wildlife area (área silvestre protegida), as indicated in the certification issued by the Sistema Nacional de Áreas de Conservación and submitted at folio 15. The land-use study contained in the record (82) states that the property has been used in accordance with its land-use classification and that it consists mostly of forest areas (primary and secondary), with fallow land in a small area. It was noted under observations that the property is devoted to the conservation of forest resources, without commercial exploitation, for their absolute protection, and that the portion of the property that was formerly pastureland has been allowed to regenerate and is currently covered by secondary forest, with some fallow areas.
There is no productive agricultural or forestry use. The streams at [Dirección6] and the river along the entire boundary have an adequate natural-forest protection zone (zona de protección). The recommendations included leaving Sector A, which is fallow, unused for agricultural activities, as it has been to date, and refraining from clearing brush or cleaning it, so as to allow natural regeneration and forest succession. It noted that, if agricultural activities are undertaken, forestry production or permanent crops such as fruit trees are advisable and should be established on planting terraces, with drainage works and vegetative ground cover. It further noted that the portion of land covered by fallow vegetation may occasionally be used for pasture or permanent or annual crops, with intensive soil-conservation practices. A judicial inspection (folio 108) was conducted on 08 de noviembre del 2011, during which it was recorded, insofar as relevant, that the property is bordered to the east by the Río Cotos and to the west by Quebrada El Sitio, which meet to the south.
To the north, the cleared boundary lines (carriles) adjoining the property’s sole neighboring landowner were observed. No evidence of logging was seen. All river and stream protection areas are covered by abundant forest cover (cobertura boscosa). It was noted that only one small pasture area was found and that the springs (nacientes) were observed to have vegetative cover. It was stated that the findings in the land-use study were consistent with what the court below observed. Regarding the springs, the Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados issued a report stating that no water withdrawals (aprovechamientos) exist and that the springs are not included in future plans (folio 126). As to the witnesses, their testimony demonstrates that, personally and prior to the date on which these proceedings were filed, the petitioner exercised possession of the land for a period far exceeding ten years.

Witness [Nombre5] stated that he was 51 years old, a native of Paso Real, which is located at [Dirección7] from the property, and had been a resident of Santa Juana for 16 years. He stated that he had known [Nombre1] since 1975 and that he purchased from [Nombre1], who lives on the property. When he was 10 years old, he knew [Nombre1], the former owner, and later learned that the property had been sold to [Nombre1]. He testified that the boundary lines had always been kept clear and that ownership of the property had always been commonly known. The property is maintained, and productive activities have been carried out there. It has springs and borders the Rio Coto. Trees have never been cut within the protection areas. Those areas are protected by the forest. No disputes involving persons asserting claims to that property have ever been known in the community.
Witness [Nombre6] testified that he had lived in Santa Juana for 30 years and was 83 years old. He stated that he knew the owner who preceded [Nombre1], who held the property for several years and then sold it to [Nombre1] approximately 35 years ago. He knows the property and has known its boundary lines since [Nombre7] was there. It has springs and a river in areas that are entirely forested, and [Nombre1] has preserved them. There is a “small pasture” area. No disputes arising from possession have ever been known in the community. For his part, [Nombre8] testified that he was 66 years old, had lived in the area for 45 years, and had known the property for thirty-five years. Since that time, it had been held by [Nombre1], who purchased it from [Nombre1], whom he also knew. He knew that when the first owner had the property surveyed, it measured 200 hectares, but that there have since been new survey plans and owners.
That owner held it for a considerable time. He described the neighboring landowners. [Nombre1] maintains his boundary lines. The property consists of primary and secondary forest, as well as small parcels of pasture. He knows that protected springs and rivers exist on the property and are preserved by the forest. When [Nombre1] purchased the forested land, it was preserved, which is why forest remains there today. He has two oxen and formerly had a sugar mill. There is no logging; the forest is preserved. There have been no disputes arising from possession of the property, and possession has been public for 35 years. The appellant’s contention that the witnesses failed to establish the requisite period of possession is not accepted because, since the property lies outside a protected wildlife area, the period of possession that must be shown is at least ten years prior to the filing of these proceedings, that is, 19 de setiembre del 2008 (filing stamp on the front of folio 10).
Accordingly, the objection that the witnesses failed to establish ten years of possession sufficient for the petitioner to acquire ownership by adverse possession (usucapión) is rejected, particularly because the appellant does not specifically state the grounds for that objection. The appellant raises claims asserting that, as shown by the record, the property contains forest and therefore forms part of the Patrimonio Natural del Estado; this Court rejects that assertion for the reasons set forth in the third recital (considerando). Furthermore, contrary to her contention, the judicial inspection, the land-use study, and the witnesses’ testimony show that possession of the property has been exercised in a manner respectful of natural resources, including the forest, which has been preserved and whose regeneration is being promoted, as well as water resources and the soil. This Court does not agree with the government representative’s assertion that the land is in the public domain (dominio público) because it is forested, for the reasons already stated above.
This Court’s rejection of the appellant’s objection is legally grounded in Article 856 of the Código Civil and Article 7 of the Ley de Informaciones Posesorias currently in force. The land for which title is sought constitutes property eligible for acquisition by adverse possession pursuant to the aforementioned Article 7.
V.The appellant’s objections concerning the continued applicability of repealed law to govern legal situations arising under it, and concerning the protection afforded by prior legislation to public ownership of forests against retroactive application to its detriment, are without merit. As explained in the third recital of this decision, this Court considers that Article 7 of the Ley de Informaciones Posesorias removed such property from the public domain (desafectó tal demanialidad) and expressly authorized private parties to obtain title to land with forest cover, provided that all legal requirements are satisfied; that provision remains fully in force.
VI- For the reasons stated and pursuant to Articles 7 and 11 of the Ley de Informaciones Posesorias and Articles 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria, the appealed decision must be affirmed.
VII—DISSENTING OPINION OF JUDGE [Nombre9]. I disagree with the majority opinion approving the possessory information proceeding (información posesoria) concerning forested land, because such land forms part of the State’s natural heritage (patrimonio natural del Estado), and ten-year possession (posesión decenal) exercised before the property was designated as public-domain property (bien demanial) was not established.— The Public Domain (Dominio Público)—for purposes of the case at hand—is the set of publicly owned property belonging to the State, lato sensu, designated for the direct or indirect public use of the inhabitants and subject to a special public-law regime that therefore exceeds the bounds of private law. The public domain comprises four elements: subjective, objective, normative, and teleological. The subjective element concerns the holder of the right—the State; the objective element concerns or consists of the property or properties subject to the public domain—in this case, the real property at issue in the litigation; the normative element determines when property meets the statutory requirements for it to be considered public-domain property and consists of the body of rules governing it—the set of rules discussed below; and the teleological element concerns the purpose pursued by including particular property within the public domain, that is, the public purpose assigned to the property—in this case, the protection of natural resources.
Public-domain property (bienes de dominio público) is subject to a special legal regime and to police power, and is essentially characterized by its inalienability and immunity from acquisitive prescription (imprescriptibilidad). By its nature, such property is intended to meet public needs, which precludes private individuals or entities from holding or possessing it; it lies outside private-law commerce. Article 121, subsection 14), of our Political Constitution refers to public-domain status (Demanialidad), identifying the property eligible for that public-ownership regime and even establishing different degrees of dedication to public use (afectación pública), ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, while harmonizing the rights of private parties subject to the Administration (administrados) with the powers of the Administration.
Our current Civil Code, dating from April 1886, sets forth the most important rules governing public-domain property, specifically in Articles 261 through 263. Article 262 of the aforementioned Civil Code refers to two important characteristics of public-domain property: (a) public things are outside commerce; and (b) withdrawal from public use (desafectación) is established by providing that such property may not enter private commerce unless legally authorized to do so. As may be seen, dedication to the public-domain regime does not depend on the nature of the property but on the legislature’s intent. In decision number 447-91, issued at fifteen hours thirty minutes on 21 February 1991, the Constitutional Chamber states that a property’s designation as public domain is established by law; that designation does not constitute a restriction on property under Article 45 of the Constitution, because that article concerns private property, and public-domain property is not subject to private ownership.
The State Forest Heritage (Patrimonio Forestal del Estado) is public-domain property governed by a broad body of rules that, historically and through the present, has prohibited private parties from carrying out any type of activity on properties having that status and has consequently denied them the right of possession, subject to an exception in a specific situation discussed below. Lands constituting National Reserves (Reservas Nacionales) that contain Forests (Bosques) are regarded as State Heritage (Patrimonio Estatal), in their capacity as Public Domain (Demanio Público), which entails the principles of immunity from acquisitive prescription, inalienability, and immunity from attachment (inembargabilidad). The foregoing is developed in the provisions cited below: 1) The Fiscal Code of 1865, which included a chapter concerning forests and was repealed by General Law on Unappropriated Lands Number thirteen of 6 January 1939, which incorporated substantially the same provisions.
For example, its first article stated: “Lands within the boundaries of the Republic that have not been acquired or registered as property by private parties under legitimate title shall be presumed to be unappropriated lands (baldíos) and shall belong to the State.”— In general, that law prohibits the possession and registration, through possessory information proceedings, of National Reserves constituting Forest Heritage; in other words, they may not be appropriated by private parties.— The Land and Colonization Law Number 2825 of 14 October 1961 maintained the same approach and has remained in force since that date. Thus, Article 8 of that Land and Colonization Law provides: “Except in the cases provided for in this law, private parties are prohibited from enclosing lands declared to be National Reserves with fences, cleared boundary strips, or by any other means; clearing woodland; establishing buildings and crops; or extracting firewood, timber, vines, palm, or other products from them for exploitation purposes.
Any act of that kind, unless the legal procedures have first been completed and the corresponding authorization obtained, shall be deemed, as applicable, usurpation of the public domain or trespass, and the authorities shall order the destruction and removal of the fences and prevent the use of such lands, without compensation or claims for the value of improvements and without prejudice to any other liability that may attach to those committing such offenses.”— It should be noted that this article criminally penalizes anyone who enters a National Reserve to carry out any activity on those lands; such activity therefore cannot be regarded as an act of possession because it would be unlawful.— Article 11 of the same Law provides that the following belong to the State as National Reserves: “(a) All lands within the boundaries of the Republic that are not registered as the private property of individuals, Municipalities, or Autonomous Institutions.
(b) Those not protected by ten-year possession.— (c) Those that have not been allocated by special laws to the establishment of agricultural colonies.— (d) In general, all lands that, while not privately owned, are not occupied for public services.”— Article 19 of repealed Ley Forestal number 4465 of twenty-three November 1969 provided: “All forests and forest lands (terrenos forestales) located in the following areas are dedicated to the purposes of this law: ‘(a) Lands regarded as National Reserves....’” Article 25 of the same law stated: “Possession of lands located in the National Reserves and State-owned properties referred to in Article 19 of this Law shall create no rights of any kind, and the State’s action for recovery of possession (acción reivindicatoria) regarding such lands shall not be subject to prescription; the General Forestry Directorate, using the legal means at its disposal, shall evict from such lands persons who occupy them in whole or in part where they are protection zones (zonas protectoras), National Parks, Forest Reserves (Reservas Forestales), or Biological Reserves (Reservas Biológicas).”— These provisions afford the forests mentioned therein dual protection: first, because of their status as a National Reserve, in which any act of possession is prohibited; and second, because they constitute State Forest Heritage, in which no act of possession creates rights of any kind.
This is confirmed by Article 8 of the regulations implementing that law, which states: “National lands located within areas declared to be Forest Reserves are inalienable, meaning that they may not leave the State’s ownership, and possession thereof shall create no rights of any kind, pursuant to Articles 25, 49, and 57 of the Ley Forestal.”— Article 80 of the aforementioned repealed Ley Forestal stated: “The invasion and occupation of lands in National Parks, Forest Reserves, and Protection Zones is prohibited. This prohibition shall extend to National Reserves until their classification and transfer have been determined....” Article 6 of the same law provided: “A term of imprisonment of six months to two years or a fine of fifteen to one hundred days shall be imposed on any person who: (a) Exploits a forest belonging to the forest heritage without the corresponding legal authorization....
(b) Invades a National Park, Biological Reserve, Protection Zone, or Forest Reserve.... If the invasion occurs in National Reserves, it shall be subject to Article 227 of the Criminal Code.—” As may be seen, acts of possession carried out in a forest belonging to the State heritage are unlawful and therefore cannot confer any right of possession.— When Ley Forestal Number 7174 of 28 June 1990 entered into force, this same approach continued. Article 32 of the aforementioned law provides: “The State’s forest heritage consists of all forests and forest lands of the National Reserves....” Article 33 of the same law provides: “The forest lands and forests constituting the State’s Forest Heritage, as detailed in the preceding article, shall be immune from attachment and inalienable; their possession by private parties shall create no rights in their favor, and the State’s action for recovery of those lands shall not be subject to prescription.— Consequently, they may not be registered in the Public Registry through a Possessory Information proceeding, and their invasion and occupation shall be punished in accordance with this Law.”— The current Ley Forestal number 7575 of 5 February 1996, in Title II, contains a single chapter devoted exclusively to the State’s Natural Heritage, maintaining the same approach initiated in 1865 with the Fiscal Code; this new legislation therefore reiterates that the State’s Natural Heritage consists of the forests and forest lands of the national reserves, areas declared inalienable, and properties registered in the name of the Public Administration.
Article 14 of the same current Ley Forestal emphatically states that the forest lands and forests constituting the State’s natural heritage are not subject to prescription, are immune from attachment, and are inalienable, and that their possession by private parties shall create no rights in their favor. The Wildlife Conservation Law Number 7317 of 21 October 1972, in Articles 3 and 4, in addition to declaring wild fauna and flora, respectively, to be in the public domain and of public interest, states that wild flora and fauna form part of the National Heritage. Likewise, Article 6 of the Biodiversity Law number 7788 of 30 April 1998 declares the elements of biodiversity to be in the public domain, while Article 46 of the Organic Environmental Law establishes the State’s sovereignty over biological diversity. In light of the foregoing, the law requires that the right of possession be denied to persons carrying out any activity on lands that are not privately owned and that consist of forests within National Reserves.— Ley Forestal Number 7575 of 1996, which amends Article 7 of the Possessory Information Law, establishes an exception to that mandatory prohibition and to the approach described thus far: it permits forests to be titled when what is understood as ecological possession (posesión ecológica) has been exercised within them.
The land that is the subject of this possessory title proceeding (información posesoria) is part of the State Natural Heritage (Patrimonio Natural del Estado), because it consists mostly of primary forest (bosque primario), as evidenced by the soil study appearing at folios 82 and 83, which indicates that the property contains primary forest, and by the judicial inspection (reconocimiento judicial) at folio 108, which states that it is forested land (terreno boscoso).- It is clear that said land is part of the State Natural Heritage, and although the certification issued by the Ministry of Environment, Energy and Technology indicates that the property lies outside any protected wildlife area (área silvestre protegida), that does not exclude its status as primary forest, to which the public-domain status (demanialidad) established upon the enactment of the aforementioned Ley Forestal applies.- When possession of public-domain property (bien demanial) is disputed, such a dispute may arise only when the right was acquired before the property was declared to be in the public domain (dominio público).
Likewise, the right of ownership in such cases may be obtained only when the holder has demonstrated ten years of possession (posesión decenal), exercised beginning at least ten years before the effective date of the law declaring the property to be part of the State Natural Heritage. As the legal chronology protecting the State Natural Heritage has already been explained, the law that must be taken into consideration in calculating private parties’ ten years of possession is Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, legislation currently in force where the land is significant for aquifer recharge (recarga acuífera), or otherwise the Ley Forestal in the case of forested land that does not have that status, particularly in this specific case, which contains primary forest.- The study by Acueductos y Alcantarillados, appearing at folio 126, shows that said land is not of interest for supplying water to any population; accordingly, the aforementioned Ley de Tierras y Colonización would not apply, but rather the cited Ley Forestal.- In this specific case, the testimonial evidence (prueba testimonial) collected does not establish ten years of possession under the legislation set out herein; this dissenting opinion (voto salvado) is therefore entered to state that the petitioner (promovente) should have demonstrated ten years of possession predating the Ley Forestal.
The possessory title proceeding should consequently have been denied, reversing the judgment under appeal, because the witnesses state that they had known the land for 35 years (their testimony having been given in 2011), which does not establish ten years of possession before 1969, the effective date of the cited Ley Forestal.-
POR TANTO:
The judgment is affirmed insofar as it was appealed. Dissenting opinion of Judge Alvarado Paniagua.

VOTO N° 260-F-17 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y treinta y seis minutos del veintitrés de marzo de dos mil diecisiete.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado una vez, agricultor, vecino de Santa Juana de Aguirre, Puntarenas, cédula de identidad número CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, mayor, soltera, abogada, vecina de Alajuela, cédula de identidad número CED2 - - , en su condición de procuradora adjunta ; y e l INSTITUTO DE DESARROLLO RURAL , cédula jurídica CED3 - - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, cédula de identidad número CED4 - - , vecina de Escazú, en condición de presidenta ejecutiva con facultades de apoderada generalísima sin límite de suma. Actúa como abogada directora del promovente la licenciada Geovanna Vargas Vargas, colegiada cinco mil setecientos setenta y dos. Tramitada ante el Juzgado Civil y Agrario de Puntarenas.-
RESULTANDO:
3 .- La Jueza Yendri Patricia Rojas Pérez, del Juzgado Civil y Agrario de Puntarenas , mediante sentencia número 71-2016 de las ocho horas del dieciocho de julio del año dos mil dieciséis , resolvió: “ POR TANTO: Por lo expuesto, de conformidad con la LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 y sus reformas, SE APRUEBAN estas diligencia de INFORMACIÓN POSESORIA promovidas por [Nombre1] , mayor, casado, agricultor, vecino de Santa Juana de Aguirre, [Dirección4] , con cédula de identidad número CED5 . Proceda el REGISTRO PUBLICO DE LA PROPIEDAD, Sección Bienes Inmuebles, a inscribir a su nombre sin perjuicio de terceros de mejor derecho y con las limitaciones de Ley que se dirá, la finca que a continuación se detalla: terreno de repastos, tacotal, agricultura y montaña con una casa y un trapiche. Situado en el DISTRITO tercero Naranjito, CANTÓN sexto: Aguirre, de la provincia de Puntarenas.- COLINDA: al NORTE: [Nombre2] ; al SUR: [Nombre3] y [Nombre4] , OESTE: [Dirección2] ; y ESTE: con Río Cotos.- MIDE: ciento treinta y seis hectáreas con dos mil novecientos treinta y nueve metros con sesenta y tres decímetros cuadrados , tal como lo indica el plano catastrado número seis-uno uno dos dos tres seis tres-dos mil siete.- Inmueble que fue estimado en la suma de CINCUENTA MILLONES DE COLONES, por cuanto ha cumplido con todos los requisitos que al efecto establece la ley de Informaciones Posesorias.
Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca citada. Dicha inscripción deberá hacerse advirtiendo a su titulante que el área contiguo al Río Cotos y a la [Dirección5] o demás corrientes de agua que existan o puedan existir en las colindancias o en la propiedad del señor [Nombre1] y que señala el artículo 33 de la Ley Forestal Nº 7575, constituyen áreas de protección y queda prohibida la corta o eliminación de árboles. De igual forma se hace constar que el cauce y las aguas de esas corrientes son de dominio público, tal y como lo establece la Ley de Aguas, artículo 1, inciso IV, y 3, inciso III. Además artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria así como la Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. Asimismo, deberá cumplirse con las recomendaciones brindadas por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria. Una vez firme esta resolución, expídase la ejecutoria respectiva y archívese el presente asunto" (folios 250 al 253 y vuelto).-
5 .- La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia (folios 281 al 295) . - 6 . - En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta la jueza Castro García, y;
CONSIDERANDO:
II.La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su carácter de Procuradora Adjunta dentro del plazo legal (folio 267). Se muestra disconforme con la sentencia aprobatoria N. 171- 2016 de las 08:00 horas del 18 de julio del 2016 (folio 250 ). Expone como agravios los siguientes: 1) Se tiene por acreditado en autos que la naturaleza del terreno es boscosa . Los fundos ubicarse en reservas nacionales están afectados a régimen de dominio público, Patrimonio Natural del Estado, desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14). Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si la promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado.
Lo anterior la lleva a concluir, que es posible titular si la usucapión se ha consolidado antes de ingresar por ley a Patrimonio Natural del Estado. Cita voto de la Sala Constitucional voto 4587-97, además esgrime los terrenos de bosques tienen una afectación inmediata por Ley a dominio público. Agravia, la declaración de los testigos no demuestran la posesión decenal apta para usucapir en cabeza de la promovente. Procede a citar precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría General de la República, especificando los siguientes:
III- Sobre el agravio de la afectación al dominio público de bosques a perpetuidad. Respecto al tema de la posibilidad de los particulares de inscribir bienes cubiertos por bosques ubicados en terrenos no titulados, estima esta sede si es posible titular terrenos no inscritos con cobertura forestal dentro o fuera de áreas silvestres protegidas, siempre y cuando se hubieran cumplido los requisitos legales exigidos en los diversos cuerpos normativos aplicables. (al respecto ver Nº 51 de las 15 horas 15 minutos del 26 de mayo de 1995 e la Sala Primera de la Corte Suprema de Justicia). El artículo sétimo de la Ley de Informaciones Posesorias, que fue modificado al emitirse la vigente Ley Forestal 7575, autorizó en forma expresa la titulación de bienes inmuebles boscosos mediante el presente trámite. Este Tribunal ha resuelto al respecto: “Dicha norma, en lo referente a las propiedades con bosque, ubicadas fuera de las áreas silvestres protegidas, señala: "...
Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios." La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional 4587-97, precisamente citado por la recurrente. En dicho voto la Sala declaró la constitucionalidad de la norma, manteniendo su vigencia. Ante tal situación, lo procedente en este caso es confirmar lo resuelto por el Juzgador, al haber acreditado el promovente el cumplimiento de los requisitos que dispone ese artículo, a saber: la posesión decenal, protección del recurso natural y la delimitación del inmueble mediante cercas o carriles limpios”.
(Voto 573-F-09). De igual forma, la Sala Constitucional rechazó nuevamente la consulta de constitucionalidad contra el artículo sétimo de la Ley de Informaciones Posesorias realizada por este Tribunal bajo expediente EXPN1, quedando vigente tal norma y sus efectos, lo cual no puede ser obviado por las autoridades jurisdiccionales.
IV.Sobre agravio de inalienabilidad del bosque y declaración de los testigos. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad un inmueble que es de Naturaleza de bosques, potreros, barbechos, según indica el estudio de uso de suelos ( folio 82) y reconocimiento judicial ( folio 108). Dicho bien no es parte de área silvestre protegida, conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada a folio 15 . El estudio de suelos constante en autos, (82) menciona que en el inmueble se ha ejercido un uso conforme de suelos y que contiene mayormente sector de bosques (primarios y secundarios) con barbechos en un pequeño sector. Se anotó como observaciones, ser un fundo dedicado al la conservación del recurso boscoso, sin explotación comercial para su protección absouta y parte de la fnca que antes era de pastos se ha dejado regenerar estando actualmente en bosques secundarios y algunas áreas en barbechos.
Sin uso agrícola o forestal productivo. Las quebradas en [Dirección6] y río en toda su colindancia con adecuada zona de protección de bosques naturales. Como recomendaciones se señaló, dejar como hasta la fecha inutilizado el sector A que esta en barbecho de actividades agrícolas, no chapear o limpiar para la regeneración natural sucesión de bosques. Anotó, en caso de desarrollar actividades agrícolas, se aconseja la producción forestal o cultivos permanentes como frutales que deben hacerse en las terrazas de siembra, obras de drenaje y el suelo con cobertura vegetal. Acotó, la parte de suelo cubierto con barbecho se puede utilizar con pastos o cultivos permanentes o anuales en forma ocasional y con prácticas intensivas de conservación de suelos . Se celebró un reconocimiento judicial (folio 108) el día 08 de noviembre del 2011 , en el que se consignó en lo de interés, el fundo esta rodeado por el este por el Río Cotos y al oeste con la Quebrada El Sitio, que se unen en el rumbo sur.
En el norte se observaron carriles del único colindantes de la finca. No se visualizó vestigio de tala. Todas las áreas de protección de río y quebrada están cubiertas con abundante cobertura vegetal boscosa. Se anotó, solo haber ubicado un pequeño sector de potrero y las nacientes se observaron con cobertura vegeta. Se indicó, lo mencionado en el estudio de suelos resulta coincidente con lo que observó la a quo. Sobre las nacientes se rindió informe del Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados en donde mencionaron no existen aprovechamientos, ni forma parte de futuros planes (folio 126). Respecto a las personas testigas, sus declaraciones demuestran que el promovente ha ejercido la posesión del terreno por un periodo mucho mayor al decenal en forma personal, anterior a la fecha en que interpuso este proceso. (expediente digital del Tribunal/documentos/fecha 16/03/2017 14:00:50).
Sobre el testigo [Nombre5] afirmó tener 51 años, nativo de Paso Real que esta a [Dirección7] de la finca y vecino de Santa Juana desde hace 16 años. Afirmó conocer a [Nombre1] desde el año 1975, y le compró a [Nombre1] que vive en la finca. Estando él de 10 años, conoció a [Nombre1] dueño anterior y luego supo que se vendió a [Nombre1]. Declara, los carriles siempre han estado limpio y se ha sabido desde siempre de quien es la finca. Se le da mantenimiento a la finca, se han desarrollados actividades productivas. Tiene nacientes y colinda con el Rio Coto. En las áreas de protección nunca se han cortado árboles. Están protegidas por el bosque. En la comunidad nunca se ha sabido de conflictos con personas que reclamen por esa finca. El testigo [Nombre6] depuso, afirmó vivir en Santa Juana desde hace 30 años, tener 83 años. Afirmó conocer al dueño anterior a [Nombre1] , que la tuvo por algunos años y luego se la vendió a [Nombre1], de eso hace unos 35 años.
Conoce la finca, los carriles los conoce desde que estaba [Nombre7]. Tiene nacientes y río donde hay pura montaña y [Nombre1] las ha preservado. Una zona de "potrerito" En la comunidad nunca se ha conocido conflictos en virtud de la posesión. Por su parte, [Nombre8] , declaró tener 66 años. De vivir en la zona 45 años y de conocer el fundo desde hace treinta y cinco años. Desde ese momento la ha tenido [Nombre1], que le compró a [Nombre1] a quien también conoció. Sabía el primer propietario cuando midió tenía 200 hectáreas, pero han habido nuevos planos y propietarios. Quién la tuvo bastante tiempo. Describe a los colindantes. [Nombre1] le da mantenimiento a sus carriles. La finca esta de bosque primario y secundario, así como parcelas pequeñas de pastos. Saber, en la finca existen nacientes y ríos protegidos que se conserva con el bosque. Cuando [Nombre1] compró la montaña se conservó y por eso hay montaña actualmente.
Tiene dos bueyes y antes un trapiche. No se tala, se conserva. No han habido conflictos en virtud de la posesión de la finca y la posesión ha sido pública durante los 35 años. No se comparte el reproche de la apelante, cuando esgrime que los testigos no acreditan el plazo necesario de posesión, pues en este caso, al estar fuera de área silvestre protegida el fundo , el plazo de posesión a demostrar es de un período mínimo diez años antes de la interpo sición de este proceso, sea el 19 de setiembre del 2008 (sello de recibido de escrito inicial a folio 10 frente) . Por lo que se rechaza el agravio referido a que l a s personas testig a s no logran acreditar la posesión decenal apta para usucapir en cabeza del promovente, aunado a que la apelante no menciona los motivos de tal agravio en forma concreta. La apelante expresa reclamos indicando que hay bosque en el inmueble, según se desprende de los autos y por ello forma parte del Patrimonio Natural del Estado, lo cual rechaza esta instancia por los motivos expuestos en el considerando tercero.
Además refuta, del reconocimiento judicial, el estudio de suelos y lo declarado por los testigos se observa ha sido ejercido en el fundo una posesión en respeto de los recursos naturales, en cuenta el bosque que se ha conservado y se impulsa su regeneración, el recurso hídrico y el suelo. E sta instancia no comparte lo señalado por la representante estatal, que alega el terreno al ser boscoso, es de dominio público dado lo ya indicado supra . La disconformidad de este Tribunal con el agravio de la recurrente, encuentra su fundamento legal en el artículo 856 del Código Civil y 7 de la Ley de Informaciones Posesorias vigente . Pues el terreno a titular constituye un fundo apto para adquirir por usucapión, en virtud del artículo sétimo mencionado.
V.No lleva razón la apelante en sus agravios de la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron al amparo, indicando de la protección del derecho de dominio público forestal establecido por la legislación anterior contra aplicaciones retroactivas en su perjuicio. Tal y como se motivó en el considerando tercero de esta resolución, este Tribunal estima que el artículo sétimo de la Ley de Informaciones Posesorias desafectó tal demanialidad y autorizó en forma expresa a particulares la posibilidad de titular terrenos con cobertura boscosa, siempre que sean cumplidos todos los requisitos legales y tal norma se encuentra en plena vigencia.
VI- Por los motivos esgrimidos y con fundamento en los artículos 7 y 11, de la Ley de Informaciones Posesorias y 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, deberá confirmarse la resolución recurrida.
VII- VOTO SALVADO DE LA JUEZA [Nombre9] . No se comparte el Voto de mayoría al aprobar la información posesoria sobre terrenos constituídos por bosques, por cuanto los mismos son parte del patrimonio natural del Estado y no se demostró una posesión decenal ejercida con antelación a la afectación de ese bien como demanial.- El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.
Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicándo qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.
El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohíbe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.
Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.
Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a inmdenización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en caracter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no esten inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autonómas. b-) Los que no esten amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reinvidicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biologícas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.
Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalineables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biologica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.
En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalineables, su posesión por los particulares no causará derecho alguno a su favor y la acción reinvidicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.
El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, establece una salvedad a la filosofía que hasta ahora se ha expuesto, y es que se posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.
El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está compuesto en su mayor parte por bosque primario, según se desprende del estudio de suelos visible a folios 82 y 83 donde indica el inmueble contiene bosque primario,y reconocimiento judicial de folio 108, donde se indica se trata de terreno boscoso.- Es claro dicho terreno es Patrimonio Natural del Estado, y aunque la certificación del del Ministerio del Ambiente y Energía y Tecnología indique el inmueble esta fuera de cualquier área silvestre protegida, ello no excluye la condición de bosque primario al cual le rige la demanialidad constituída desde la creación de la Ley Forestal antes citadas.- Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado.
Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente en caso de que se trate de terrenos que sean de relevancia para la recarga acuífera, o bien desde la Ley Forestal para otro tipo de suelo que no tengan esa condición y que sean boscosos, sobre todo para el caso concreto que contiene bosque primario.- Del estudio de Acueductos y Alcantarillados, visible a folio 126, se desprende dicho terreno no es de interés para abastecimiento de agua a alguna población, por lo que no sería de aplicación la Ley de Tierras y Colonización dicha, sino la Ley Forestal citada.- Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna este voto salvado, para indicar el promovente debió demostrar diez años de posesión antes de la Ley Forestal, por lo que debió declararse sin lugar la información posesoria revocando el fallo venido en apelación, ya que los testigos dicen conocer el terreno hace 35 años (siendo su declaración en año 2011), lo que no demuestran los diez años de posesión con antelación a 1969, fecha de vigencia de la citada Ley Forestal.-
POR TANTO:
Se confirma la sentencia en lo que ha sido objeto de apelación. Voto Salvado de la jueza Alvarado Paniagua.
