CONSIDERING
I- Proven Facts. Proven facts numbered one through four and ten in the judgment under appeal are adopted because they are consistent with the evidence in the record. Facts numbered five, six, seven, eight, nine, and eleven are not adopted because they instead constitute an assessment of the testimonial and documentary evidence or a description of that evidence, rather than facts in the technical sense. Proven fact number twelve is likewise not adopted because it is not a fact but rather a description of the value assigned to the property. The following facts relevant at this stage are deemed established in this matter:
II- Unproven Facts. The unproven facts contained in the judgment under appeal are not adopted because evidence exists establishing a different factual basis.
III- Appeal. The petitioner appeals (digital case file/submissions/date 04/10/2016, time 10:18:04) judgment N. 2016000133, issued at sixteen hours and zero minutes on veintisiete de setiembre del año dos mil dieciséis. (digital case file/submissions/date 27/09/16, time 04:00:57 p.m.). Her principal contention is that she clearly proved the chain of possession (cadena posesoria) and is entitled to rely on the possession exercised by the previous transferors, having submitted the deed by which [Nombre7] donated the property to his son [Nombre2] and the deed by which the latter sold it to [Nombre1], who instituted this proceeding. She invokes the application of Article 4 of Ley N. 139, which provides: “When the applicant for title (titulante) demonstrates lawful acquisition through a public document that is not eligible for registration in the Registro Público, testimonial evidence shall not be required if 10 years or more have elapsed since the acquisition.
In such case, it shall be sufficient to submit the compliant survey plan of the property and for the visual inspection (inspección ocular) to establish that it is properly demarcated, is possessed, and is at that time subject to rational use. If the property is smaller than 30 hectares, testimonial evidence may be submitted instead of the visual inspection” (underlining not in the original). She states that everything submitted consists of public documents introduced under Article 1 of the Ley de Informaciones Posesorias, whose authenticity has not been challenged and which collectively establish a total of 64 years of possession, exceeding the 10 years preceding the decree that created the protected zone. She challenges the judgment by arguing that the petitioner did not acquire the property by donation, as stated therein, and that the chain of title is clear and indisputable. She asserts that the testimonial evidence is consistent and mutually corroborative in describing possession suitable for obtaining title (posesión idónea para titular) that dates from a period far longer than the ten years preceding 1994.
She partially transcribes the testimony given by each witness in this regard. She alleges an erroneous assessment of the nature of the property, because there is no contradiction between what was observed during the judicial inspection and the land-use study. It was stated that the property is demarcated and consists of 90% fallow land (weeds very similar to grass) combined with natural pasture. It also contains secondary scrub growth along the [Dirección4] boundary, where the small shrubs that do not grow taller because of the strong winds are protected and conserved. She adds that it is a relatively small lot and that the acts exercised consist of maintaining the fences and the grass in the covered area, which also contains some weeds. She alleges a violation of due process and the right of defense due to failure to observe the principles of reasoned evaluation of evidence (sana crítica racional).
IV - These proceedings were instituted for the purpose of recording in the Registro Público de la Propiedad a property classified as fallow land, secondary scrub growth, natural pasture, and shrubs. Located at [Dirección1], [Dirección5] Valverde Vega, Province of Alajuela. It is bounded to the north by [Dirección6], with twenty-eight meters and thirty-one centimeters of frontage; to the south by [Nombre2]; to the east by [Nombre2]; and to the west by [Nombre3]. Area: six hundred fourteen square meters. Cadastral survey plan number A-1806219- 2015. The foregoing is consistent with the initial filing and clarification, as well as with the submitted survey plan and land-use study. (initial filing/digital case file/documents/date: 22/07/2015 11:36:53 a.m., submission in digital case file/submissions/date 06/08/2015 08:54:11, testimony of [Nombre4] and [Nombre5] in digital case file/documents/date: 17/11/2015 11:42:10, testimony of [Nombre2] in digital case file/documents/date: 14/12/2015 9:00:26, land-use study in submissions folder/date 18/11/2015 05:03:07 p.m., judicial inspection in electronic case file/documents/date 17/11/15).
This property forms part of the protected wilderness area (área silvestre protegida) Zona Protectora Río Toro, created in 1994 by executive decree 22838-MIRENEM of 9 de febrero de 1994. This is stated in the certificate issued by the Sistema Nacional de Áreas de Conservación that was submitted into evidence. (certificate in digital case file/documents/date: 22/07/2015 11:36:53 a.m., Image 22). The property is located outside land or properties administered by the Instituto de Desarrollo Rural (Evidence/submission in digital case file/submissions/date 17/11/2015 11:55:29 a.m., Image 12). In addition, the petitioner has not registered any properties under the Ley de Informaciones Posesorias, according to the certificate issued by the Registro Nacional. (certificate in submissions/date, digital case file/submissions/date:22/07/2015 11:36:53 a.m., image 12 of digital case file). It is verified that the notice required by law (edicto de ley) was published in the Diario Oficial.
The adjoining landowners (colindantes) acknowledged service and indicated their agreement through filed notices of appearance authenticated by attorney Karlos VIllalobos Ugalde (submissions in images 14 and 15/submissions/date:22/07/2015 11:36:53a.m.).
V- Having reviewed the grounds for appeal against the challenged decision, this Court notes that, in accordance with the rules of section 54 of the Ley de Jurisdicción Agraria, the system of free assessment of evidence (libre valoración probatoria) applies to agrarian proceedings (procesos agrarios). This system requires the court to examine and select the sources of evidence obtained in order to determine their effectiveness in resolving the dispute submitted for its consideration, through perception, representation or reconstruction, and deductive or inductive reasoning. The court must set forth the principles of equity or law on which it bases its decision. In this regard, the Constitutional Chamber of the Supreme Court of Justice has ruled: “..., the conscientious assessment of evidence (apreciación de la prueba en conciencia) does not entail ruling arbitrarily, because every judge—as the public official that he or she is—is subject to the principle of legality, which constitutes an imperative that public action conform not only to the specific rules governing a particular matter, but also to the entire body of law; therefore, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial discretion (sana crítica) and the principles of reasonableness, which, when properly applied, bring judicial assessment into harmony with the Political Constitution, as this Chamber held in judgment 3484-94, at twelve hours on eight July nineteen ninety-four, in which it determined that judges’ authority to assess evidence conscientiously is not contrary to their obligation to state the grounds for their decisions, a constitutional principle forming part of due process...
() the authority granted to an agrarian judge to assess evidence conscientiously and evaluate it without strict adherence to the rules of ordinary law, as provided in the second paragraph of the challenged article 54, is not unconstitutional, provided that the judge issues a reasoned decision, that is, analyzes the result of the evidence gathered in the proceedings and states the principles of equity or law on which the judge’s determination is based, thereby respecting the minimum requirements of the right of defense” (vote 3657 of 7 May 2003. See, to the same effect, votes N° 398 of 6 June 2001 of the First Chamber. Likewise, see votes No. 206 of 26 March 1999, N°46 of 26 April 1995; Nª66 of 6 February 2009 and 364 of 28 May 2009 of the Agrarian Court). The adjudicator is likewise required to conduct a comprehensive assessment of the evidence contained in the case file. Having clarified the foregoing and reviewed the appealed judgment, this Court finds that the evidence was analyzed erroneously, without comprehensively assessing the statements of the witnesses and the transfer documents submitted in order to tack the possession exercised.
VI- With respect to the appealed matter, it should be noted that judgment on appeal N. 2016000133, issued at 16:00 hours on 27 September 2016, denies the acquisitive-possession proceeding (proceso de información posesoria) because it did not find that a clear chain of transfer of the ten-year possession preceding the creation of the protected wildlife area (área silvestre protegida), which affected the land in 1994, had been proven. Nor was the nature of the property established. At the final hearing, in a pleading submitted on 20 September 2016, the State Attorney argued that the property is located within Zona Protectora Río Toro, created by decree 22838-MIRENEM, and that, according to the CED5 deeds, [Nombre7] donated it to [Nombre2] in 1991, who in turn sold it to the petitioner in 2015. She added that witness [Nombre4] stated that, when he first became acquainted with the property in 1970, it already belonged to [Nombre2], and that none of the witnesses mentioned the date on which it had been transferred to that gentleman.
She contends that the documentary and testimonial evidence must be consistent in order to establish possession. In addition, the property to which title is sought was described as pastureland in the judicial inspection record (acta de reconocimiento judicial), which does not demonstrate the exercise of possessory acts aimed at protecting natural resources, as required within protected wildlife areas. She therefore requested that the proceeding be denied. As stated, the property to which title is sought is located within Zona Protectora Río Toro, created by the executive decree establishing Zona Protectora Río Toro, decree 22838-MIRENEM of 9 February 1994. Accordingly, pursuant to section 7 of the Ley de Informaciones Posesorias, the petitioner must establish that she exercised possession as owner, within the meaning of article 856 of the Código Civil, for at least 10 years before the land became subject to that management category (categoría de manejo); that is, before 1984.
To establish possession, three witnesses must be presented pursuant to section 6 of the Ley de Informaciones Posesorias. Furthermore, because she seeks to tack the possession transferred to her, she was required to submit the instrument by which she acquired the property, as prescribed by article 1 of the Ley de Informaciones Posesorias.
VII- Regarding the land-tenure regime (régimen de tenencia de la tierra) in protected wildlife areas, it should be noted that, irrespective of their management category, they must be understood as areas subject to a particular and specific administrative and regulatory regime and governed by management plans (planes de manejo) that ensure the protection, conservation, and rational use of natural resources. Their administration, management, and protection are vested in MINAET, unless a special law provides otherwise. Article 58 of the Ley de Biodiversidad defines them as geographically delimited areas consisting of lands, wetlands, and portions of the sea, declared as such because they have special significance and because their environment and ecosystems, as well as their historical and cultural features, warrant protection and conservation. This provision expressly refers to the Ley Orgánica del Ambiente regarding the regulation of the requirements and mechanisms for establishing or reducing these areas.
By law, their administration is vested exclusively in the Ministerio de Ambiente, Energía y Telecomunicaciones, except for Natural Monuments. For its part, the Ley Forestal provides that when a state-owned protected wildlife area is declared, it must immediately become part of the State’s natural heritage (patrimonio natural del Estado), governed by article 13 of that law, which expressly provides that its administration corresponds to MINAET. That body of law must be interpreted in conjunction with article 58 in fine of the Ley de Biodiversidad, which recognizes the acquired rights of indigenous and peasant populations and natural or legal persons over lands declared to be protected wildlife areas and their management categories. This is supplemented by article 7 of the Ley de Informaciones Posesorias, which states: “When the property to which the acquisitive-possession proceeding relates is located within a protected wildlife area, regardless of its management category, the applicant for title must prove that he or she holds the legal rights to ten-year possession, exercised for at least ten years before the effective date of the law or decree creating that protected wildlife area.” In this case, it must be determined whether the chain of possession (cadena posesoria) from 1984 or earlier through the present has been established—that is, for a period exceeding the ten years preceding the designation of the area under the Zona Protectora management category in 1994—in order to conclude that the petitioner’s acquired rights to seek recognition of her ownership right over the property must be recognized.
In this regard, the Constitutional Chamber of the Supreme Court of Justice, in vote vote 144-96- at 16:51 hours on 9 January 1996, ruled: “In the case of establishing forest reserves, protective zones, and national wildlife refuges, the owner is given the option of retaining the land because, by following the management plan, the owner may continue to derive economic benefit from it; that is, the restrictions imposed are not so extensive as to prevent the owner from exploiting the property and therefore do not render the owner’s right ineffective” (underlining not in the original). In addition to the foregoing, this Court must analyze whether the requirement to exercise ecological possession (posesión ecológica) has been satisfied, in light of the soil study, the judicial inspection conducted for that purpose by the adjudicator, and the testimony.
VIII- Given the claim of error in this specific case, and having assessed the three statements in light of sections 54 and 61 of the Ley de Jurisdicción Agraria, together with all the other evidence gathered, this Court finds it established that the title applicant (titulante) exercised qualifying possession (posesión idónea) in a manner respectful of natural resources for more than ten years prior to 1994, relying for that purpose on the possession exercised by her transferor (transmitente), [Nombre2], who was her father, and submitting a public deed (escritura pública) of acquisition pursuant to Article 1 of the Ley de Informaciones Posesorias. The record shows (expediente digital/documentos/fecha 17/11/2015 11:42:10) that the witness testimony (prueba testimonial) was given on 17 de noviembre del 2015. In that regard, [Nombre4] testified that he was a resident of Sarchí Norte and 61 years of age.
He had known the applicant (promovente) for 20 or 25 years and the property for more than 45 years, because he owned a parcel near hers. He stated that when he first knew it, it belonged to [Nombre2], adding that many properties in that area belonged to him. He mentioned that [Nombre1] purchased it from [Nombre2], which he believed had occurred less than two years earlier. He stated that [Nombre2] and [Nombre1] had always used the property as pastureland. He testified that the properties had belonged to [Nombre2]’s father before they belonged to him. He described the title applicant’s parcel as somewhat steep and stated that it had always been fenced. There are no springs (nacientes) or structures, and no streams cross it. He identified the adjoining landowners and stated that possession had been exercised openly, peacefully, and without disputes with anyone, and that the property measured approximately 600 meters “and the remainder,” or less.
This testimony establishes knowledge of the property dating back to 1970, because in his deposition he stated that he had known the property for approximately 45 years before giving his testimony in 2015. He identified [Nombre2] as the transferor to [Nombre8], who is his daughter. He further attested that pastureland had always existed from the time he first became acquainted with the lot, that it was fenced, and that possession had been uninterrupted and free of disputes. The witness [Nombre5] (expediente digital/documentos/fecha 17/11/2015 11:42:10) testified on the same date as the preceding witness that he was a resident of San Juan de Sarchí and 50 years of age. He had known the applicant for approximately twenty years and the parcel for 50 years, at which time it belonged to [Nombre2]’s father, named [Nombre7]. He later transferred it to his son, who, he asserted, sold it to doña [Nombre1], although he did not know the exact date.
He stated that every person who had owned the parcel had used it as pastureland and that it had been kept cleared, maintained, and enclosed by barbed wire and posts. He identified the adjoining landowners and added that there were no structures, springs, or streams; that the topography was steep; and that it had always been possessed openly, peacefully, and without disputes. This Court notes that this witness’s knowledge of the property extends further back than that of the first witness. He stated that fifty years earlier it had belonged to [Nombre1]’s grandfather, [Nombre7], who transferred it to his son [Nombre2], and that the latter transferred it to his daughter, the applicant herein. The substance of this statement is consistent with that given by the preceding witness regarding the chain of possession (cadena posesoria) over the property, insofar as he referred to [Nombre2] and [Nombre8].
He also identified the previous owner, and his testimony establishes that the property had been possessed by the same family group since the 1970s. This Chamber finds his testimony useful in establishing possession and the chain of possession, in addition to being consistent with the preceding witness’s statement. Subsequently, on 14 de diciembre del 2015, the witness [Nombre2] testified (expediente digital/documentos/fecha 14/12/2015 9:00:26). He stated that he was a resident of Sarchí and 52 years of age. He testified that he had known [Nombre1] for more than ten years and had known the property all his life, because it belonged to his father, who was named [Nombre2], who had held it for as long as he could remember and transferred it by sale to [Nombre1] around the middle of the year in which he gave his testimony, in junio or julio. He explained that his father had kept the land as pasture and that [Nombre1] now maintained it in the same condition by clearing and cutting the brush.
It is enclosed by posts and wire; there are no structures, streams, or springs; it has steep topography; and it measures approximately five hundred meters. It had always been possessed openly, peacefully, and without problems with anyone. He added that the property had belonged to his grandfather, [Nombre9], since before he was born, and subsequently passed to his father by inheritance. He added that the fence on the [Nombre10] side consisted of shrubs or plants native to the area. This person’s testimony establishes his knowledge of the exercise of possession and the chain of transfers, as well as the fact that the property remained under the control of the same family group. He consistently described the chain of possession referred to by the three witnesses regarding the possession exercised by [Nombre2] and [Nombre8]. As to the previous possessor—the title applicant’s father and grandfather, [Nombre9]—the witness [Nombre11] did not refer to him, instead identifying his son [Nombre2] as the owner.
However, this circumstance does not, in this Chamber’s view, have the effect attributed to it in the appealed decision, because a comprehensive assessment of the three testimonies shows that the property had been continuously possessed, with acts of maintenance, clearing, and fencing carried out peacefully and without interruption, for considerably more than ten years prior to 1984 by members of the same family. This Court finds the statements useful and relevant for establishing ten-year possession predating 1984, in accordance with Article 7 of the Ley de Informaciones Posesorias, when the property became subject to the declaration of a protected wilderness area (área silvestre protegida) through decreto 22838- MIRENEM del 9 de febrero de 1994, which created the Zona Protectora Río Toro. With respect to the arguments of the Office of the Attorney General (Procuraduría) and the ruling in the judgment under appeal, this Court considers that the chain of possession of the property for which title is sought is indeed clear, as explained above.
This Court notes that the witness [Nombre4]’s omission of any reference to [Nombre9] does not undermine his knowledge of the property, because he described plainly and without confusion to whom the land had belonged, consistently with the testimony of the other two witnesses, as well as the type of possessory acts (actos posesorios) exercised and the circumstances under which they were exercised. Regarding the precision of the dates and names of the possessors of an unregistered parcel (fundo sin inscribir), the Tribunal Agrario has held: “Furthermore, it is important to note that witnesses need not be so precise regarding the exact dates of possession by each transferor, or know all of them, particularly in cases such as this one, in which the parcel has had so many owners, because what matters is that there be some reference to the persons associated with the exercise of possession throughout all those years, to the protection being afforded to the forest resource in view of the requirements established by Article 7 of the Ley de Informaciones Posesorias, and to the compliant use of the land in accordance with the certification appearing at folio 179, among other legal requirements that have not been challenged by the appellant.-” ( voto N. 874-F-08).
This standard has been upheld in subsequent decisions and is shared by this Chamber. For purposes of determining whether title may be granted to land located within protected wilderness areas, what matters is the witnesses’ demonstrable knowledge of the parcel, the sufficient duration of the chain of possession, and the acts carried out on the property. This Court notes that the witnesses’ testimony establishes facts extending back beyond 1984, as they described the persons connected with the parcel as its owners. In addition, it is established that, by deed number 48 del 15 de enero de 1991, [Nombre9] donated to [Nombre2] an unregistered property measuring thirty hectares, which, according to the public instrument, he had possessed for more than 40 years and which consisted mostly of pastureland. (expediente digital/ escritos/ fecha: 22/07/2015 11:36:53 Imagen 18). Likewise, by deed number 291-25 del 16 de julio del 2015 (expediente digital/ escritos/ fecha: 22/07/2015 11:36:53-Imagen 15 y 16), [Nombre2] sold [Nombre1] a lot measuring 614 square meters, and the seller stated that possession had been exercised for more than 63 years.
The statements in that public instrument are consistent with the testimony of the witnesses already discussed in this recital (considerando). Accordingly, the objection raised by the Procuraduría cannot be sustained because, upon comprehensive consideration of those documents together with the testimony given, this Court assigns evidentiary value to the statements contained in those public deeds. They are useful and relevant in establishing the transfer of possession by [Nombre2], and previously by [Nombre12], culminating in the possession of [Nombre1], who may rely on the possession exercised since before 1984 over the 614-meter lot for which she seeks title. The foregoing is based on Article 1 of the Ley de Informaciones Posesorias. In the case under consideration, pursuant to Article 7 of the Ley de Informaciones Posesorias, witness testimony must establish possession exercised for at least ten years prior to 1994, when the Zona Protectora Río Toro was created and the existing properties within its boundaries became subject to that designation.
As analyzed above, the witnesses established that possession as dating back even to the 1970s. Their statements are consistent regarding the chain of possession and its origin and manner, and they are sufficient to establish such possession for a ten-year period preceding 1994. The testimony describes a clear chain of possession consistent with the public deed submitted to the record by the applicant, without contradictions. Therefore, the requirement set forth in section 6 of the Ley de Informaciones Posesorias concerning proof of qualifying possession for the legally required period is deemed satisfied.
IX- On the nature of the property (fundo). According to the land-use study (estudio de uso de suelos) and the judicial inspection (reconocimiento judicial) conducted by the trial court, no act that harms natural resources and could defeat the qualifying possession (posesión idónea) required by Article 7 of the Ley de Informaciones Posesorias with respect to the environment has been proven. The record of the judicial inspection of 8 de noviembre del 2016 (judicial inspection in digital case file/documents/date 17/11/2015 11:42:10) stated that the land was found to consist of well-maintained pasture, without structures, springs (nacientes), or streams, fenced along the slope at [Dirección7] and bounded by natural trees at [Dirección8]. For its part, the land-use study (land-use study in filings folder/date 18/11/2015 05:03:07 p.m.) recorded compliant land use (uso conforme de suelos), observing a property devoted to fallow land (barbecho), secondary scrubland (tacotal), and natural pasture, with evidence of natural regeneration processes, protection of forest species, boundary demarcation, and maintenance.
This Court notes that the description indicated a mixture of fallow land combining natural pasture, shrubs, and smaller woody plants. It is also undergoing natural regeneration. This does not contradict what was observed during the judicial inspection. The nature of that vegetation, technically identified by the forestry engineer as fallow land, provides the technical explanation for what the court below was only able to identify as pasture. According to the witnesses, that area has always had such vegetation, including before the protected zone was created. There is no evidence that this land use violates the management plan (plan de ordenamiento) for that protected wilderness area (área silvestre protegida), that any warning was issued by any competent environmental authority, that any environmental damage was caused, or that there is a danger of such damage occurring. The observations noted that there was no degradation of the soil resource or contamination of the water resource.
The photographs accompanying the study show the presence of fallow land, which resembles pasture, and secondary scrubland in the northwestern sector. That sector was described during the judicial inspection as an area bounded by natural trees. All this evidence establishes compliance with the legal requirements for proving qualifying possession of the land at issue in these proceedings under a claim of ownership. This Court finds no obstacle preventing it from concluding that the proceeding should be approved.
X- For the reasons stated, it is concluded that, in compliance with the requirements of the Ley de Informaciones Posesorias, Código Civil, Ley de Manejo, Uso y Conservación de Suelos and its Reglamento, as well as the Ley Forestal, the petitioner company has benefited from the possession exercised by its transferor since the 1970s, for a period exceeding ten years before the creation of the Zona Protectora Río Toro. That possession was exercised in a manner sufficient to acquire title by adverse possession (usucapir), for which the company submitted a public instrument recording the transfer of its right and, through the three witnesses, clearly established the chain of possession (cadena posesoria) and the status of the possession as legally sufficient, pursuant to Article 863 of the Código Civil and Article 7 of the Ley de Informaciones Posesorias, as required to acquire the right to be issued a title eligible for registration (título inscribible) in the Registro Público for its property.
The possession was exercised with due regard for the natural resources contained on the land. Accordingly, the appealed judgment must be reversed and the possessory-information proceeding (proceso de información posesoria) brought herein must be approved. The Registro Público shall also be ordered to register, free of real encumbrances and liens (cargas reales y gravámenes), in the name of [Nombre1], the unregistered property described as consisting of fallow land, pasture, and secondary scrubland. Located in [Dirección1], canton of Valverde Vega, province of Alajuela. It is bounded to the north by [Dirección9][Dirección10], with a linear frontage of twenty-eight meters and thirty-one centimeters; to the south by [Nombre2]; to the east by [Nombre2]; and to the west by [Nombre3]. Area: six hundred fourteen square meters. Survey plan number A-1806219- 2015. Property valued at one hundred thousand colones.
It is hereby ordered that land-use change (cambio de uso de suelos) is prohibited in forested areas and that the management plan (plan de manejo) of the Zona Protectora Río Toro must be observed. It is further ordered that, because the property borders a public road on its northern side, the right-of-way (derecho de vía) is fourteen meters, pursuant to Article four of the Ley de Caminos Públicos and Article nineteen, subsection a), of the Ley de Informaciones Posesorias, and must be respected. Because that area is part of the public domain (dominio público), it does not form part of the property to be registered. This property shall remain subject to the statutory reservations (reservas de Ley) under the Ley de Aguas, Ley Forestal, and Ley de Caminos Públicos, pursuant to Article nineteen of the Ley de Informaciones Posesorias. The trial court shall issue the corresponding certified judgment for enforcement and registration (ejecutoria), and it is authorized to make any corrections necessary to secure registration in the property registry.
XI—DISSENTING OPINION OF JUDGE ALVARADO PANIAGUA. The public domain (Dominio Público)—for purposes of the matter before us—is the set of publicly owned assets belonging to the State, lato sensu, dedicated to the direct or indirect public use of the inhabitants and subject to a special public-law regime that therefore goes beyond private law. The public domain consists of four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right—the State; the objective element refers to, or consists of, the asset or assets over which the public domain extends—in this case, the real property at issue in the litigation; the normative element determines when an asset meets the statutory requirements for classification as public-domain property (demanial); it comprises the body of rules governing it—the body of rules set forth below; and the teleological element refers to the purpose pursued by including a particular asset within the public domain, that is, the public purpose assigned to the asset—in this case, the protection of natural resources.
Public-domain assets (bienes de dominio público) are subject to a special legal regime, are subject to police powers (poder de policía), and are characterized essentially by their inalienability (inalienabilidad) and immunity from acquisitive prescription (imprescriptibilidad). By their nature, they are intended to meet public needs; this prevents private individuals or private persons from holding or possessing them, and they are outside private-law commerce. Article 121, subsection 14), of our Political Constitution refers to public-domain status (Demanialidad), specifying which assets may be subject to that public-ownership regime. That article even establishes different degrees of dedication to public use (afectación pública), ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, thereby harmonizing the rights of private parties subject to the Administration (administrados) with the powers of the Administration.
Our current Civil Code, which dates from April eighteen eighty-six, sets forth the most important foundations governing public-domain assets, specifically in Articles 261 through 263. Article 262 of that Civil Code refers to two important characteristics of public-domain assets: a—public things are outside commerce; and b—withdrawal from public use (desafectación) is established by stating that such assets may not enter private commerce unless the law so provides. As may be seen, dedication to the public-domain regime (afectación al régimen de dominio público) depends not on the nature of the asset but on the will of the legislature. In ruling number 447-91, issued at fifteen hours thirty minutes on February 21, 1991, the Constitutional Chamber states that an asset is declared to be in the public domain by law; that declaration does not constitute a limitation on property under Article 45 of the Constitution, because that article concerns private property, and public-domain assets are not subject to private ownership.
The State Forest Estate (Patrimonio Forestal del Estado) is public-domain property governed by an extensive body of rules that, historically and through the present day, has prohibited private parties from performing any kind of activity within real properties having that status and, consequently, has denied them possessory rights (derecho de posesión), subject to an exception in a specific situation described below. Lands constituting National Reserves (Reservas Nacionales) that contain Forests are deemed part of the State Estate (Patrimonio Estatal)—in its capacity as Public Domain (Demanio Público), which entails the principles of immunity from acquisitive prescription, inalienability, and immunity from attachment (inembargabilidad). The foregoing is developed in the provisions cited below: 1) The Tax Code of 1865, which contained a chapter concerning forests and was repealed by the General Law on Unappropriated Lands (Ley General de Terrenos Baldíos), Number thirteen of January 6, 1939, which incorporated practically the same provisions.
For example, Article One stated: “Lands located within the boundaries of the Republic that have not been acquired or registered as property by private parties under lawful title are presumed to be unappropriated lands (baldíos) and to belong to the State.”—In general, that law prohibits the possession and registration, through possessory title proceedings (informaciones posesorias), of National Reserves forming part of the Forest Estate; in other words, they are not susceptible to appropriation by private parties.—The Land and Colonization Law (Ley de Tierras y Colonización), Number 2825 of October 14, 1961, maintained the same approach and has remained in force since that date. Thus, Article 8 of that Ley de Tierras y Colonización provides: “Except in the cases provided for in this law, private parties are prohibited from enclosing lands declared to be National Reserves with fences, boundary lines, or by any other means; clearing woodlands; erecting buildings; planting crops; or extracting firewood, timber, vines, palm, or other products from them for commercial exploitation.
Any act of that kind, unless the legal procedures have first been completed and the corresponding authorization obtained, shall be deemed, as applicable, usurpation of the public domain (usurpación de dominio público) or trespass (merodeo); the authorities shall order the destruction and removal of the fences and prevent the use of such lands, without compensation or claims for the value of improvements, and without prejudice to any other liability that may attach to those committing such violations.”—It should be noted that this article criminally punishes anyone who enters a National Reserve to conduct any activity on those lands; therefore, such activity cannot be deemed an act of possession because it would be unlawful.—Article 11 of that same Law provides that the following belong to the State as National Reserves: “a) All lands within the boundaries of the Republic that are not registered as the private property of individuals, Municipalities, or Autonomous Institutions. b) Lands not protected by ten-year possession (posesión decenal).—c) Lands that have not been designated by special laws for the establishment of agricultural colonies.—d) In general, all lands that, while not privately owned, are not occupied for public services.”—Article 19 of the repealed Ley Forestal, Number 4465 of November twenty-third, nineteen sixty-nine, provided: “All forests and forest lands located in the following areas are hereby dedicated to the purposes of this law: ‘a) Lands deemed National Reserves...’” Article 25 of that same law stated: “Possession of lands situated in the National Reserves and State properties referred to in Article 19 of this Law shall create no rights of any kind, and the State’s action for recovery of ownership (acción reivindicatoria) with respect to such lands shall not be subject to prescription; the General Forestry Directorate, using the legal means at its disposal, shall evict from such lands any persons occupying them wholly or in part when they are Protective Zones, National Parks, Forest Reserves, or Biological Reserves.”—These provisions afford the forests mentioned therein twofold protection: first, by virtue of their status as National Reserves, in which any possessory act (acto posesorio) is prohibited; and second, because they constitute the State Forest Estate, in which no act of possession creates any right whatsoever.
This is confirmed by Article 8 of the regulations implementing that law, which states: “National lands within areas declared to be Forest Reserves are inalienable; that is, they may not leave the ownership of the State, and possession thereof shall create no rights of any kind, pursuant to Articles 25, 49, and 57 of the Ley Forestal.”—Article 80 of the cited repealed Ley Forestal stated: “The invasion and occupation of lands in National Parks, Forest Reserves, and Protective Zones are prohibited. This prohibition extends to National Reserves until their classification and transfer have been determined...” Article 6 of that same law provided: “A person shall be punished by imprisonment for six months to two years or by a fine of fifteen to one hundred days if that person: a) Exploits a forest belonging to the Forest Estate without the corresponding legal authorization... b) Invades a National Park, Biological Reserve, Protective Zone, or Forest Reserve...
If the invasion occurs in National Reserves, it shall be subject to Article 227 of the Criminal Code.”—As may be seen, possessory acts carried out in a forest belonging to the State Estate are unlawful and therefore cannot confer any possessory right.—Upon the entry into force of Ley Forestal Number 7174 of June 28, 1990, this same approach continued. Article 32 of the cited law provides: “The State Forest Estate consists of all forests and forest lands within the National Reserves...” Article 33 of that same law provides: “The forest lands and forests constituting the State Forest Estate described in the preceding article shall be immune from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action for recovery of those lands shall not be subject to prescription.—Consequently, they may not be registered in the Public Registry through Possessory Title Proceedings, and their invasion and occupation shall be punished in accordance with this Law.”—The currently effective Ley Forestal, Ley 7575 of February 5, 1996, regulates, in Title II, a single chapter devoted exclusively to the State Natural Estate (Patrimonio Natural del Estado), following the same approach initiated in 1865 with the Tax Code; accordingly, this new legislation reiterates that the State Natural Estate shall consist of the forests and forest lands within the national reserves, areas declared inalienable, and properties registered in the name of the Public Administration.
Article 14 of that same currently effective Ley Forestal emphatically states that the forest lands and forests constituting the State Natural Estate are immune from acquisitive prescription, immune from attachment, and inalienable, and that possession thereof by private parties shall create no right in their favor. The Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), Number 7317 of October 21, 1972, in Articles 3 and 4, in addition to declaring wild fauna and flora, respectively, to be in the public domain and of public interest, states that wild flora and fauna form part of the National Estate (Patrimonio Nacional). In the same vein, Article 6 of the Biodiversity Law (Ley de Biodiversidad), Number 7788 of April 30, 1998, declares the elements of biodiversity to be in the public domain, while Article 46 of the Organic Environmental Law (Ley Orgánica del Ambiente) establishes State sovereignty over biological diversity.
In light of the foregoing, the law requires that possessory rights be denied to persons conducting any activity on lands not subject to private ownership and consisting of forests within National Reserves.—As an exception to that mandatory prohibition, Ley Forestal Number 7575 of 1996, which amends Article 7 of the Possessory Title Proceedings Law (Ley de Informaciones Posesorias), permits title to forests when what is understood as ecological possession (posesión ecológica) has been exercised within them. The land that is the subject of these possessory title proceedings is part of the State Natural Estate because it is located within Zona Protectora Río Toro; plainly, that territory has formed part of the State Natural Estate since before it was created by Decree, as explained in the legislative history supra. When possession of public-domain property is disputed, such a dispute is permissible only when the right was acquired before the asset was declared to be in the public domain.
Likewise, the right of ownership in such cases may be acquired only when the titleholder has demonstrated ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law declaring the property to be part of the State’s Natural Heritage (Patrimonio Natural del Estado). As the legal chronology protecting the State’s Natural Heritage has already been set forth, the law that must be considered in calculating private parties’ ten-year possession is Land and Colonization Law No. 2825 of October 14, 1961, which remains in force. The 1865 Fiscal Code and the 1939 Vacant Lands Law should not be considered, because those provisions referred to the subject only in general terms and, moreover, are no longer in force; it was not until the current Land and Colonization Law that State Natural Property or Heritage (Propiedad o Patrimonio Natural del Estado) was clearly defined and regulated.
Subsequent laws, such as Ley Forestal and others cited in this recital (considerando), supplement the aforementioned Land and Colonization Law. In this particular case, the testimonial evidence (prueba testimonial) gathered does not establish ten-year possession under the provisions set forth herein. This dissenting opinion (voto salvado) is therefore entered to state that the petitioner (promovente) was required to demonstrate ten years of possession before the Land and Colonization Law, rather than before the Decree that created the aforementioned Zona Protectora Río Toro, as asserted in the preceding opinion. The testimony in the record indicates that the witnesses have known the property for the past 45 years; nor do they indicate that any measures were taken to conserve the resource. On the contrary, the land has been converted into pastureland, meaning that the forest resource has been logged—the very resource intended to be protected by its designation as a protected zone (zona protectora).-
POR TANTO:
Judgment number two thousand sixteen zero zero zero one hundred thirty-three, issued at sixteen hours zero minutes on the twenty-seventh of September of two thousand sixteen, is reversed. It is bounded to the north by [Dirección9][Dirección10], with a linear frontage of twenty-eight meters and thirty-one centimeters; to the south by [Nombre2]; to the east by [Nombre2]; and to the west by [Nombre3].

Que a su vez adquirió por donación de parte de finca a su favor, otorgada en escritura el 15 de enero de 1991 de [Nombre6] , quién había ejercido una posesión de más de 40 años para la fecha de la donación, sea desde el año 1950 aproximadamente. La promovente y anteriores poseedores mantuvieron la posesión en condición de personas dueñas del terreno desde el año 1950, de forma continua, pública y pacífica. La promovente recurre (expediente digital/ escritos/fecha 04/10/2016 hora 10:18:04) la sentencia N. 2016000133 de las dieciséis horas y cero minutos del veintisiete de setiembre del año dos mil dieciséis. (expediente digital/escritos/fecha 27/09/16 hora 04:00:57 p.m.). Su reproche central lo es en cuanto demostró de forma diáfana la cadena posesoria y aprovecha la ejercida por los anteriores transmitentes, aportando la escritura de donación de [Nombre7] a su hijo [Nombre2] y la venta de éste último a [Nombre1] que promueve este proceso. Invoca la aplicación del artículo 4 de la Ley N. 139 que reza: " Cuando el titulante demostrare su legítima adquisición por medio de documento público que no fuere apto para su inscripción en el Registro Público, no será necesario que ofrezca prueba testimonial, si hubieren transcurrido 10 años o más de la respectiva adquisición. En tal caso, bastará que presente el plano conforme de la finca y que en la inspección ocular se constate que esta debidamente deslindada, que es objeto de posesión y que en ese momento está sometida a explotación racional.
Si la finca es menor de 30 hectáreas, podrá presentar la prueba testimonial en vez de la inspección ocular " (lo subrayado no corresponde a su original). Cita, todo lo aportado son documentos públicos introducidos al amparo del artículo 1 de la Ley de Informaciones Posesorias, cuya legitimidad no se ha cuestionado y con los que se acumula un total de 64 años de posesión. Superando los 10 años previos al decreto que creó la zona protectora. Combate la sentencia refutando, la promovente no adquirió por donación como ahí se consigna y la cadena de transmisión es clara e indubitable. Aduce, la prueba testimonial resulta coincidente y congruente en cuanto se describe una posesión idónea para titular que data de un período mucho mayor al decenal anterior al año 1994. Transcribe parcialmente lo que depuso cada uno de los testigos al respecto. Acusa una errónea apreciación de la naturaleza del fundo, pues no existe contradicción entre lo observado en el reconocimiento judicial y el estudio de uso de suelos.
Pues se indicó se trata de un fundo delimitado y en un 90% de barbecho (mala hierba muy similar a pastos) en combinación con pastos naturales. Además del tacotal en el lindero [Dirección4] donde se protegen y conservan los pequeños arbustos que por los fuertes vientos no crecen a mayor altura. Acota, es un lote selectivamente pequeño y los actos que se ejercen son de mantenimiento de cercas y el pasto en el área cubierta, más algunas malezas es lo que contiene. Acusa la violación del debido proceso y derecho de defensa por inobservancia de los principios de la sana crítica racional.
IV - Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad un inmueble con n aturaleza de barbecho, tacotal, pastos naturales y arbustos. Sito en el [Dirección1] , [Dirección5] Valverde Vega, de la provincia de Alajuela. Linda al norte con [Dirección6] con un frente lineal de veintiocho metros con treinta y un centímetros; al sur con [Nombre2] ; al este con [Nombre2] y al oeste con [Nombre3] . Cabida seiscientos catorce metros cuadrados. Plano catastrado número A-1806219- 2015. Lo anterior acorde con lo mencionado en el escrito inicial y aclaración, así como el plano aportado y estudio de uso de suelos. (escrito inicial/expediente digital /documentos/fecha: 22/07/2015 11:36:53 a.m., memorial expediente digital/escritos/ fecha 06/08/2015 08:54:11 declaraciones testimoniales de [Nombre4] y [Nombre5] en expediente digital/documentos /fecha: 17/11/2015 11:42:10 , declaraci ón testimonial de [Nombre2] en expediente digital/documentos /fecha: 14/12/2015 9:00:26, estudio de uso de suelos en carpeta escritos/ fecha 18/11/2015 05:03:07 p.m., reconocimiento judicial en expediente electrónico/documentos/fecha 17/11/15).
Dicho bien es parte de área silvestre protegida Zona Protectora Río Toro creada en el año de 1994 , por decreto ejecutivo 22838-MIRENEM del 9 de febrero de 1994. C onforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada. (certificación en expediente digital /documentos/fecha: 22/07/2015 11:36:53 a.m. Imagen 22). El fundo se encuentra fuera de terrenos o propiedades administradas por el Instituto de Desarrollo Rural ( Prb./memorial en expediente digital/escritos /fecha 17/11/2015 11:55:29 a.m Imagen 12). Aunado a lo anterior, la promovente no ha inscrito fincas al amparo de la Ley de Informaciones Posesorias , según certificación emitida por el Registro Nacional. (certificación en escritos/fecha expediente digital /escritos/ fecha:22/07/2015 11:36:53 a.m. en imagen 12 de expediente digital). Se verifica , el edicto de ley fue publicado en el Diario Oficial .
Las personas colindantes se di eron por notificad os y se encontr aron conforme s mediante escrito s de apersonamiento aportado s y autenticado s por el Lic enciado Karlos VIllalobos Ugalde (escritos en imagen 14 y 15 /escritos/fecha:22/07/2015 11:36:53a.m ) .
V- Vistos los agravios contra la pieza apelada señala esta Instancia, acorde con las reglas del ordinal 54 de la Ley de Jurisdicción Agraria, se establece el sistema de la libre valoración probatoria para los procesos agrarios. Sistema que exige al tribunal estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El tribunal deberá exponer los principios de equidad o de derecho sobre los cuales funda su decisión. Al respecto, la Sala Constitucional de la Corte Suprema de Justicia ha resuelto: "..., la apreciación de la prueba en conciencia no implica resolver en forma arbitraria, por cuanto todo juez -como funcionario público que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derechos constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política, tal y como lo entendió esta Sala en sentencia 3484-94, de las doce horas del ocho de julio de mil novecientos noventa y cuatro, en que determinó que las facultades de los jueces de apreciar la prueba en conciencia no resultan contrarias a la obligación del juez de fundamentar sus fallos, principio constitucional que integra el debido proceso...
() no resulta inconstitucional el poder otorgado al juez agrario para apreciar en conciencia la prueba y valorarla sin sujeción estricta a las normas del derecho común según lo dispuesto en el párrafo segundo del artículo 54 impugnado, siempre y cuando dicte un fallo fundamentado, es decir analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio, respetando de tal modo los contenidos mínimos del derecho de defensa" (voto 3657 del 7 de mayo de 2003. Ver en igual sentido votos N° 398 del 6 de junio del 2001 de la Sala Primera. En igual sentido veáse votos No. 206 del 26 de marzo de 1999, N°46 del 26 de abril de 1995; Nª66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario). De igual forma se impone a la persona juzgadora la obligación de emitir una valoración integral de la prueba que conste en el expediente.
Aclarado lo anterior y estudiada la sentencia recurrida , encuentra esta instancia medió un análisis erróneo de los elementos probatorios, sin entrar a valorar de forma integral lo indicado por las personas testigas y los documentos de traspaso aportados para aprovechar la posesión ejercida.
VI- Visto lo apelado cabe indicar, la sentencia venida en alzada N. 2016000133 de las 16:00 horas del 27 de setiembre del 2016, imprueba el proceso de información posesoria por no tener por demostrada una cadena diáfana de transmisión de la posesión decenal anterior a la creación del área silvestre protegida, que afectó al terreno en 1994. Ni la naturaleza del fundo. La Procuradora en la audiencia final por memorial aportado el 20 de setiembre del 2016 adujo, el fundo se sitúa dentro de la Zona Protectora Río Toro creada por decreto 22838-MIRENEM y acorde con las escrituras CED5 [Nombre7] donó a [Nombre2] en 1991 y éste vendió a la promovente en el año 2015. Agregó, el testigo [Nombre4] mencionó, cuando conoció el fundo en 1970 ya era de [Nombre2] y ninguno mencionó la fecha en que se transmitió a éste señor. Invoca, debe haber congruencia en la documental y la testimonial para hacer valer la posesión.
Aunado a lo anterior, la naturaleza de pasturas del inmueble a titular descrita en el acta de reconocimiento judicial, no demuestra el ejercicio de actos posesorios tendientes a la protección de los recursos naturales como debe hacerse dentro de las áreas silvestres protegidas. Por lo que solicitó improbar el proceso. Como se citó el fundo a titular se ubica dentro de la Zona Protectora Río Toro, creada por el decreto ejecutivo Zona Protectora Río Toro creada por decreto 22838-MIRENEM del 9 de febrero de 1994. Por ello, de conformidad con el ordinal 7 de la Ley de Informaciones Posesorias, la promovente debe acreditar el ejercicio de la posesión en condición de dueña en lo términos del artículo 856 del Código Civil, con al menos 10 años antes de la afectación del terreno a esa categoría de manejo; sea anterior al año 1984. Para justificar la posesión, acorde con el ordinal 6 de la Ley de Informaciones Posesorias se deben aportar tres testigos. Además, al pretender aprovechar la posesión transmitida debió aportar el título por el cual adquirió el fundo, según regula el artículo 1 de la Ley de Informaciones Posesorias.
VII- Sobre el régimen de tenencia de la tierra en áreas silvestres protegidas, ha de indicarse, independientemente de su categoría de manejo, deben ser entendidas como zonas con un régimen de administración y normativa particular y específica, supeditadas a planes de manejo que aseguran su protección, conservación y uso racional de los recursos naturales. Recae el MINAET su administración, manejo y tutela, salvo ley especial que indique otra situación. El artículo 58 de la Ley de Biodiversidad, las define como zonas geográficas delimitadas, que se forman de terrenos, humedales y porciones de mar, declaradas como tales por representar una significancia especial, un interés de tutela y conservación del ambiente y sus ecosistemas, así como históricos y culturales. Esta norma hace una remisión expresa a la Ley Orgánica del Ambiente sobre la regulación de los requisitos y mecanismos para el establecimiento o reducción de estas áreas.
La administración por Ley recae en forma exclusiva sobre el Ministerio de Ambiente, Energía y Telecomunicaciones, salvo los Monumentos Naturales. Por su parte, la Ley Forestal prevé que cuando se declare un área silvestre protegida de propiedad estatal, ésta debe pasar en forma inmediata a formar parte del patrimonio natural del Estado, regulado por el artículo 13 de la citada norma que expresamente señala que su administración corresponde al MINAET. Ese conjunto normativo debe interpretarse con lo prescrito en el artículo 58 in fine de la Ley de Biodiversidad, que reconoce los derechos adquiridos por poblaciones indígenas, campesinas, personas físicas o jurídicas, sobre los terrenos que sean declarados áreas silvestres protegidas y sus categorías de manejo. Ello se complementa con el artículo 7 de la Ley de Informaciones Posesorias cuando indica : "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." En este caso, debe ser verificado si se demuestra la cadena posesoria desde el año 1984 o antes y hasta la actualidad, sea por un plazo mayor a los diez años anteriores a la afectación de la zona mediante la categoría de manejo Zona Protectora ocurrida en 1994, para entender que los derechos adquiridos de la promovente de solicitar el reconocimiento de su derecho de propiedad sobre el fundo, deben serle reconocidos.
Al respecto, la Sala Constitucional de la Corte Suprema de Justicia en voto voto 144-96- de las 16:51 horas del 9 de enero de 1996, resolvió: " En el caso de establecerse reservas forestales, zonas protectoras y refugios nacionales de vida silvestre, se da la opción de que el propietario conserve su tierra, ya que, siguiendo el plan de manejo puede continuar aprovechándola en términos económicos, es decir, las limitaciones impuestas no son de tal magnitud que le impidan explotar su propiedad, por lo que no hacen nugatorio su derecho" (lo subrayado no corresponde a su original). Ademas de lo anterior, s e debe analizar en esta sede, s i se ha cumplido con el ejercicio de la posesión ecológica, a la luz del estudio de suelos, el reconocimiento judicial que al efecto celebró la juzgadora y los testimonios.
VIII- Dado el agravio en este caso concreto, valoradas las tres declaraciones a la luz del canon 54 y 61 de la Ley de Jurisdicción Agraria de forma integral con la restante prueba recabada, se tiene por demostrada en esta Instancia el ejercicio de una posesión idónea y en respeto a los recursos naturales, mayor a la decenal anterior al año 1994 por parte de la titulante, que aprovechó la posesión ejercida de su transmitente [Nombre2] , que era su padre y para ello aportó escritura pública de adquisición, de conformidad con el artículo 1 de la Ley de Informaciones Posesorias. Consta en autos (expediente digital/documentos/fecha 17/11/2015 11:42:10) se rindió la prueba testimonial el día 17 de noviembre del 2015. Al respecto declaró [Nombre4] , ser vecino de Sarchí Norte, con 61 años de edad. Conoce a la promovente desde hace 20 o 25 años y el terreno desde hace más de 45 años. Pues tenía un fundo cerca del de ella.
Cita, cuando lo conoció era de [Nombre2] ; agregando que muchas fincas de esa área le pertenecían. Menciona, [Nombre1] compró a [Nombre2] , lo que sucedió cree, hacía menos de dos años. Menciona, [Nombre2] y [Nombre1] dedicaron el inmueble a pastos desde siempre. Declaró, las heredades eran del padre de [Nombre2] , antes de ser de él. Describió, el fundo de la titular es un poco quebrado, ha estado siempre cercado. No hay nacientes, construcciones y no le atraviesan quebradas. Indicó quiénes son las personas colindantes y se ha ejercido la posesión de forma pública, pacífica sin conflictos con persona alguna y mide aproximadamente 600 metros "y resto" o menos. Este testimonio acredita el conocimiento del terreno desde 1970, pues mencionó en su deposición sabe de la heredad desde unos 45 años antes de su declaración en el año 2015. Mencionó a [Nombre2] como el transmitente a [Nombre8] . Que es su hija.
Además de constarle siempre ha habido pastos desde las fechas en que tuvo conocimiento de ese lote, estar cercado y consignarse una posesión ininterrumpida y sin conflictos. El testigo [Nombre5] (expediente digital/documentos/fecha 17/11/2015 11:42:10), declaró en la misma fecha que el anterior, ser vecino de San Juan de Sarchí, de 50 años edad. Conocer a la promovente hace unos veinte años y el fundo hace 50 años; momento para el cual pertenecía al padre de [Nombre2] de nombre [Nombre7] . Luego se lo transmitió a su hijo. Quién lo vende a doña [Nombre1], asegura. Sin conocer fecha exacta. Describió, todas las personas que han sido dueñas han dedicado el fundo a pasto, se mantiene limpio, cuidado y cercado con alambre de púas con postes. Reseña a los colindantes y agrega no hay construcciones sin nacientes ni quebradas, de topografía quebrada y siempre ha sido poseído de forma pública, pacífica y sin conflictos.
Observa este Tribunal, el conocimiento del terreno que tiene este testigo es de mayor antigüedad que el primero de los declarantes. Indicó, saber hace cincuenta años le pertenecía al abuelo de [Nombre1] , el señor [Nombre7] , que lo traspasó a su hijo [Nombre2] , y éste a su hija, la aquí promovente. Resulta coincidente el contenido de esta declaración con la rendida por el testigo anterior, en cuanto la cadena posesoria sobre la heredad, en cuanto cita a [Nombre2] y a [Nombre8] . Además de indicar el dueño anterior y concluir de su testimonio, la finca ha sido poseída por el mismo núcleo familiar desde la década de los años 1970. Para esta Cámara su testimonio resulta útil a fin de demostrar la posesión y la cadena posesoria, además de ser congruente con la declaración del testigo anterior. Posteriormente, el 14 de diciembre del 2015 declara el testigo [Nombre2] (expediente digital/documentos/fecha 14/12/2015 9:00:26).
Indicó ser vecino de Sarchí y tener 52 años. Depuso, conocer a [Nombre1] desde hace más de diez años y el terreno de toda su vida, pues era de su padre que se llamaba [Nombre2] , quién lo tuvo desde que recuerda y lo traspasó por venta a [Nombre1] a mediados del año en que rinde su testimonio en junio o julio. Describe, se tenía por su padre el terreno dedicado a potrero y ahora [Nombre1] lo conserva en iguales condiciones, lo limpia y chapea. Se encuentra cercado con postes y alambre, no hay construcciones, sin quebradas o nacientes, de topografía quebrada y de unos quinientos metros. Poseído desde siempre de forma pública, pacífica y sin problemas con nadie. Añade, el inmueble fue de su abuelo [Nombre9] desde antes de que él naciera, luego de su padre por herencia. Agregó, la cerca del lado de [Nombre10] es de arbustos o plantas de la zona. Lo declarado por esta persona acredita su conocimiento del ejercicio de la posesión y la cadena de transmisión, amén de haber permanecido el inmueble bajo dominio del mismo grupo familiar.
Describe de forma coincidente la cadena posesoria citada por los tres testigos en cuanto a la posesión ejercida por [Nombre2] y [Nombre8] . Respecto al anterior poseedor: padre y abuelo de la titulante: [Nombre9] , no refirió el testigo [Nombre11] , quien describe como el dueño a [Nombre2] su hijo. Sin embargo ese aspecto para esta Cámara no tiene el efecto dado en la resolución recurrida, pues de la valoración integral de los tres testimonios se deduce que la finca ha estado en posesión de forma continua, ejerciendo actos de cuido, limpieza, cercado de forma pacífica, ininterrumpida y pacífica mucho más que diez años antes de 1984 por miembros de la misma familia. Para esta Instancia las declaraciones resultan útiles y pertinentes a los efectos de demostrar la posesión decenal anterior al año 1984, acorde con el artículo 7 de la Ley de Informaciones Posesorias, cuando la finca resultó afectada por la declaratoria de área silvestre protegida, mediante el decreto 22838- MIRENEM del 9 de febrero de 1994, que creó la Zona Protectora Río Toro.
Considera este Tribunal, respecto a la argumentación del ente procurador y lo resuelto en la sentencia venida en apelación, si existe claridad en la cadena posesoria del inmueble que se pide titular según se expuso supra. Nota esta Instancia, la omisión de citar a [Nombre9] por el testigo [Nombre4] no desvirtúa el conocimiento del inmueble, al describir de forma llana y sin confusiones de quien ha sido el terreno en forma congruente con lo declarado por los otros dos testigos y que tipo de actos posesorios han sido ejercidos y en que condición. Con respecto a la precisión de fechas de los poseedores de un fundo sin inscribir y sus nombres, el Tribunal Agrario ha resuelto: " Además, es importante señalar que no es preciso que los testigos sean tan puntuales en cuanto a fechas exactas de posesión de cada uno de los transmitentes, o conozcan a todos éstos, menos aún en casos como el presente en el que el fundo ha tenido tantos dueños, pues lo importante es que exista una referencia a las personas vinculadas con el ejercicio de la posesión durante todos esos años y a la protección que se está haciendo del recurso forestal dadas las exigencias que plantea el artículo 7 de la Ley de Informaciones Posesorias y al uso conforme del suelo de acuerdo a la certificación de folio 179, entre otros requisitos legales que no han sido objetados por la apelante.-" ( voto N. 874-F-08).
Criterio que se ha sostenido en votos posteriores y que comparte esta Cámara. Lo importante a fin de determinar si procede o no una titulación de un terreno ubicado dentro de áreas silvestres protegidas, es el conocimiento que se logre acreditar por parte de los testigos del fundo, sobre la antigüedad suficiente de la cadena posesoria y los actos ejercidos en el inmueble. Nota esta Sede, lo declarado los testigos acredita hechos que van más allá del año 1984, cuando describen quiénes estaban vinculados en condición de dueño del fundo. En otro orden, se constata que por escritura número 48 del 15 de enero de 1991, [Nombre9] donó [Nombre2] una finca sin inscribir de treinta hectáreas que ha poseído por más de 40 años, según describe el instrumento público, que es de pastos mayormente. (expediente digital/ escritos/ fecha: 22/07/2015 11:36:53 Imagen 18). En igual sentido, mediante escritura número 291-25 del 16 de julio del 2015 (expediente digital/ escritos/ fecha: 22/07/2015 11:36:53-Imagen 15 y 16) [Nombre2] vende a [Nombre1] un lote de 614 metros cuadrados e indica el vendedor se ha ejercido una posesión de más de 63 años.
Lo indicado en ese instrumento público, concuerda con lo declarado por las personas testigas ya referidas en este considerando. Por lo que no posible acoger el reproche de la Procuraduría, pues analizado esos documentos de forma integral con los testimonios rendidos, encuentra valor probatorio lo indicado en esas escrituras públicas. Que resultan útiles y pertinentes a fin de demostrar la transmisión de la posesión por parte de [Nombre2] , y anteriormente de [Nombre12] , hasta llegar a la posesión de [Nombre1] . Quién puede aprovechar la posesión ejercida desde antes de 1984 en el lote de 614 metros que pide titular. Lo anterior con fundamento en el artículo 1 de la Ley de Informaciones Posesorias. En el caso en estudio, acorde con el artículo 7 de la Ley de Informaciones Posesorias, debe demostrarse mediante prueba testimonial una posesión ejercida al menos diez años antes al año 1994, fecha en que se creó la Zona Protectora Río Toro y se afectaron las fincas existentes dentro de sus límites.
Tal y como fue analizado, esa posesión fue acreditada aún desde la década de los años 70 por los testigos. Cuyas declaraciones resultan contestes en la cadena posesoria, el origen y modo de la misma y resultan idóneos para acreditar dicha posesión en un plazo decenal anterior al año 1994. Los testimonios describen una cadena posesoria diáfana y coincidente con la escritura pública aportada a los autos por el promovente, sin contradicciones-. Por lo tanto, se tiene por cumplido el requisito del ordinal 6 de la Ley de Informaciones Posesorias respecto a la demostración de la posesión idónea por el plazo legal exigido.
IX- Sobre la naturaleza del fundo. Acorde con el estudio de uso de suelos y el reconocimiento judicial realizado por el juzgado de instancia no se tiene por acreditado acto alguno que lesione los recursos naturales capaces de enervar la idoneidad de la posesión exigida por el artículo 7 de la Ley de Informaciones Posesorias en respecto del ambiente. En el acta de reconocimiento judicial del 8 de noviembre del 2016 (reconocimiento judicial en expediente digital/documentos/fecha 17/11/2015 11:42:10), se consignó haberse encontrado un terreno de pastos, bien cuidado, sin construcciones, nacientes o quebradas, cercado en declive al [Dirección7] y por el [Dirección8] delimitado con árboles naturales. Por su parte, el estudio de suelos ( estudio de uso de suelos en carpeta escritos/ fecha 18/11/2015 05:03:07 p.m.), consignó ejercerse un uso conforme de suelos observando una finca dedicad a a barbecho, tacotal, pastos naturales con presencia de procesos de regeneración natural, protección de especies forestales, delimitación y mantenimiento.
Observa esta sede, en esa descripción se indicó hay una mezcla de barbecho donde hay una combinación de pastos naturales, arbustos y leñosas menores. Además de estar en proceso de regeneración natural. Lo que no se contradice con lo observado en el reconocimiento judicial. La naturaleza de esa vegetación denominada técnicamente como barbecho por el ingeniero forestal, corresponde a la explicación técnica de lo que la a quo no pudo determinar como pastos. Consta, según indicaron los testigos esa zona siempre y desde antes de la creación de la zona protectora ha sido de esa vegetación. No existe prueba de que ese uso de suelo transgreda el plan de ordenamiento de esa área silvestre protegida, mediara apercibimiento alguno por parte de alguna de las autoridades ambientales competentes, se hubiere causado daño ambiental alguno o exista peligro de que ocurra. En las observaciones se anotó no existía degradación del recurso suelo, ni contaminación del recurso hídrico.
Las fotografías que acompañan ese estudio demuestran la presencia del barbecho, que asemeja pasto y el sector noroeste con tacotal. Zona que fue la descrita en el reconocimiento judicial como área delimitada con árboles naturales. Todas estas probanzas acreditan el cumplimiento de las exigencias legales a fin de acreditar la posesión idónea en condición de dueño del terreno objeto de este proceso. No encontrando obstáculo alguno que impida a este Tribunal considerar que procede aprobar el proceso planteado.
X - Por los motivos expuestos se concluye , en cumplimiento de los requisitos de la Ley de Informaciones Posesorias, Código Civil, Ley de Manejo, Uso y Conservación de Suelos y su Reglamento, así como la Ley Forestal, la sociedad promovente ha aprovechado la posesión ejercida por su transmitente, desde la década de 1970, en un plazo decenal superior anterior de la creación de la Zona Protectora Río Toro. Posesión ejercida en forma idónea para usucapir de lo cual aportó documento público, donde consta el traspaso de su derecho y mediante los tres testigos, se acreditó claramente la cadena posesoria y la condición de la posesión apta, acorde con el artículo 863 del Código Civil y 7 de la Ley de Informaciones Posesorias , necesaria para adquirir el derecho a que se le expida t í tulo inscribible en el Registro Público de su inmueble. Posesión desarrollado en respecto de los recursos naturales que contiene el terreno.
Por ello, s e deberá revocar la sentencia recurrida y aprobar se el proceso de información posesoria promovid o. Así como ordenarse al Registro Público inscribir libre de cargas reales y gravámenes, a nombre de [Nombre1] , el inmueble sin inscribir con Naturaleza de barbechos, pastos y tacotal. Sito en el [Dirección1] , cantón Valverde Vega de la provincia de Alajuela. Colinda al norte con [Dirección9][Dirección10] con un frente lineal de veintiocho metros con treinta y un centímetros; al sur con [Nombre2] ; al este con [Nombre2] y al oeste con [Nombre3] . Mide: seiscientos catorce metros cuadrados. Plano número A-1806219- 2015. Inmueble estimado en cien mil colones. Se decreta, se prohíbe el cambio de uso de suelos en las zonas de bosques y que debe acatarse el plan de manejo de la Zona Protectora Río Toro. S e decreta que por colindar la finca al rumbo norte con calle pública , el derecho de vía es de catorce metros, de conformidad con el artículo cuatro de la Ley de Caminos Públicos y diecinueve inciso a) de la Ley de Informaciones Posesorias y que debe ser respetado .
Area que por ser dominio público, no es parte del fundo a inscribir. Queda la presente finca afecta a las reservas de Ley de Aguas, Ley Forestal y Ley de Caminos Públicos, según el artículo diecinueve de la Ley de Informaciones Posesorias. Proceda el Juzgado de instancia a emitir la ejecutoria correspondiente y se le autoriza a hacer las correcciones que sean necesarias a fin de lograr la inscripción registral.
XI- VOTO SALVADO POR LA JUEZA ALVARADO PANIAGUA. El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.
Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicando qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.
El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohibe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.
Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.
Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a indemnización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en carácter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no esten inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autonómas. b-) Los que no esten amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reivindicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.
Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalienables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.
En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalienables, su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.
El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.
El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está ubicado dentro de la Zona Protectora Río Toro, lo que es claro dicho territorio es Patrimonio Natural del Estado, desde antes de que fuera creada mediante Decreto como ya se expuso en el historial normativo supra. Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado. Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente.
No debe considerarse el Código Fiscal de 1865 y la Ley de Terrenos Baldíos de 1939, pues fueron normas que hacían referencia al tópico en forma genérica, además que no son disposiciones vigentes en la actualidad, no es sino hasta con la actual Ley de Tierras y Colonización que se viene a definir y regular en forma clara la Propiedad o Patrimonio Natural del Estado. Las leyes posteriores como Ley Forestal y otras que se han citado en este considerando, son complementarias a la referida Ley de Tierras y Colonización. Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna este voto salvado, para indicar el promovente debió demostrar diez años de posesión antes de la Ley de Tierras y Colonización, y no del Decreto que creó la referida Zona Protectora Río Toro, como se afirma en el voto que antecede, pues de la prueba testimonial recibida en autos, los testigos indican conocer el inmueble hace 45 años atrás, y tampoco indican se hayan realizado actos de conservación del recurso, todo lo contrario, el terreno se ha convertido en potreros, lo que implica se ha talado el recurso bosque, mismo que se pretende tutelar con la declaratoria de zona protectora.-
POR TANTO:
Se revoca la sentencia número dos mil dieciséis cero cero cero ciento treinta y tres de las dieciséis horas cero minutos del veintisiete de setiembre del dos mil dieciséis. En su lugar, se aprueba la información posesoria promovid a y se ordena al Registro Público inscribir libre de cargas reales y gravámenes, a nombre de [Nombre1] , mayor, soltera, ama de casa, cédula de identidad CED6 - , vecina de Sarchí Alajuela, el inmueble sin inscribir que se describe: Naturaleza de barbechos, pastos y tacotal. Sito en el [Dirección1] , [Dirección9][Dirección11] Valverde Vega de la provincia de Alajuela. Colinda al norte con [Dirección9][Dirección10] con un frente lineal de veintiocho metros con treinta y un centímetros; al sur con [Nombre2] ; al este con [Nombre2] y al oeste con [Nombre3] . Mide: seiscientos catorce metros cuadrados. Plano número A-1806219- 2015. Inmueble estimado en cien mil colones.
