JUDGMENT NO. 0 555 -F-1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eleven hours and one minute on eight June two thousand eleven.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA), instituted by [Nombre1], of legal age, married once, farmer, identity card number CED1 - - , resident of Horquetas, Sarapiquí. Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal particulars are not recorded in the case file, in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín, Escazú, identity card CED3 - - , in her capacity as general judicial attorney-in-fact (apoderada general judicial). WHEREAS:
5. The statutory requirements have been observed in the conduct of the proceeding, and the judgment contains no errors or omissions capable of rendering it null and void.

CONSIDERING:
I.The facts found to have been proven in the judgment under appeal are adopted because they are consistent with the evidence in the case file, except that, in the first fact, the portion stating that the nature of the property is “pastureland,” since the evidence establishes that the property is used as wooded grazing land, overgrown pasture, and forest; and the third fact, which is supplemented to state that the acts of possession (actos posesorios) also included protection of the forest resource. The foregoing is established by the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, the record of the judicial inspection (reconocimiento judicial) at folio 64, and the testimony of witnesses [Nombre4], [Nombre5], and [Nombre6] (folios 29 and 64 to 68).-
II.Attorney Lydiana Rodríguez Paniagua, Deputy Attorney General of the Procuraduría General de la República, filed an appeal against the judgment in a submission sent by fax on 25 April 2011 (folio 92). In essence, she expressed disagreement because she believes that the record of the judicial inspection, the witness testimony received, the plan, and the land-use certificate (certificado de uso de suelos) establish that the property for which title is sought is forested. She therefore considers applicable in this case the statutory provisions under which forestlands and the forests within national reserves are subject to the public domain, specifically the Patrimonio Natural del Estado, at least since Ley Forestal 4465 de 1969, Article 33, as amended by Ley Forestal 7174 de 1990, Articles 32 and 33, which establish a public-domain status (carácter demanial) maintained by Ley Forestal 7575, Articles 13 and 14.
She adds that, although forestry legislation permits title to be granted to properties outside protected wild areas (áreas silvestres protegidas) if the petitioner proves a legitimate right arising from ten years of possession under the conditions required for that purpose, proves that the petitioner protected the resource, and shows that the property has defined boundaries, the aforementioned declaration of the forestland as public domain must be taken into account. In her view, a harmonious interpretation of those provisions leads to the conclusion that forestlands may be titled only if acquisitive prescription (usucapión) had vested before they entered the Patrimonio Natural del Estado by operation of law; and, in this case, the statements of the persons who testified do not establish the ten years of possession required for acquisitive prescription. In support of her arguments, the appellant cites and partially transcribes decisions issued by the Sala Constitucional Nº 4587-97, 15753-2005, [Telf1], 738-2003, 12239-2006, 12240-2006, 12241-2006, 11190-1990, as well as opinions of the Procuraduría General de la República C-321-2003 and 146-2008, from which, in her view, follow the continued applicability of repealed law to govern legal situations that arose “under its protection,” the impossibility of acquiring public-domain property by acquisitive prescription, the principle of inalienability (principio de inalienabilidad), the inability to acquire such property through possession, and its immunity from prescription (imprescriptibilidad).-
III.By instituting this proceeding, the petitioner [Nombre1] requests that title to a property located in Horquetas de Sarapiquí de Heredia, measuring 6 hectares 22.39 square meters, be registered in his name in the National Registry. The property is located outside any protected wildlife area (área silvestre protegida), regardless of its management category, administered by the Ministry of Environment, Energy and Telecommunications, as shown by cadastral plan H-781439-2002 at folio 1 and the certification at folio 5. According to the topographic survey, the property is used as “woodland and pasture”; however, the transfer document and the initial petition, submitted as a sworn statement (declaración jurada), described it as “grassland” (folios 9, 11, and 12). These inconsistencies are clarified by the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, which referred to areas of “wooded pasture, brush-covered grazing land, and forest” (folio 29).
Furthermore, its observations and recommendations stated: “Observations: Sector B was found to have land use consistent with its classification, even though it is Class VI, because it is undergoing a process of natural vegetation regeneration, as it is covered with brush and no evidence was observed that livestock are being grazed on the property. Sectors A and C have land use consistent with the designated management unit. Quebrada Tigre is subject to Ley Forestal 7575, Article 33. Recommendations: continue the management currently being carried out on the farm.” (folio 30). This is consistent with the photographs at folio 32. Because this is a technical study whose results are similar to those recorded in the judicial inspection report (acta de reconocimiento judicial) (folio 64), the Court finds that the true nature of the property has been established and is consistent with the description provided by the State’s representative, rather than that stated in the judgment, which refers only to “grassland,” because what actually exists is wooded pasture, brush-covered grazing land, and forest.
Under these circumstances, given the existence of forest on the property, Article 7 of the Ley de Informaciones Posesorias applies. Under that provision, title may be registered provided that ten years’ possession (posesión decenal), protection of the natural resource, and demarcation of the property are established. The appellant argues that the testimonial evidence failed to establish the first requirement; however, this Court finds that compliance with all the requirements of the provision in question was demonstrated. First, the judicial inspection shows that the property is properly demarcated and that the forest resource (recurso forestal) has been protected, as the report states: “All of its boundaries could be verified, and it was observed that, along the eastern, southern, and western edges, the property is demarcated by three- and four-strand barbed-wire fencing with live and dead posts; in general, these fences appear to be in fair condition.
The entire northern boundary is formed by Quebrada Tigre, and vegetation cover consisting of trees and weeds native to the area can be observed along its bank ...” It further stated that there were no visible “signs that trees had recently been felled or that the natural resource was being improperly used ...” (folio 64). With respect to proof of the exercise of possession, the testimony of witnesses [Nombre4], [Nombre5], and [Nombre6] was received on October 28, 2010. The first stated that he had known the property for more than 15 years and that the petitioner had exercised possession over the landholding (fundo) for 8 to 10 years; before him, it had been possessed by [Nombre7]. During their respective periods of possession, both performed possessory acts (actos posesorios), such as repairing fences and clearing brush, and the petitioner lives in a house located on the landholding (folios 65 and 66).
The second stated that he had known the property for 30 years and that it is currently possessed by the petitioner and was previously possessed by [Nombre7], [Nombre8], and [Nombre9], each of whom, during his respective period of possession, maintained the fences and cleared brush; the title applicant (titulante), moreover, occupied the house located on the landholding (folios 66 and 67). Finally, the last witness stated that he had known the property for approximately 20 years, during which the persons who had exercised possession of it were the petitioner and individuals named [Nombre8] and [Nombre9]. He reiterated the possessory acts mentioned by the preceding witnesses (folios 67 and 68). It follows from the foregoing that the appellant is incorrect in asserting that the witnesses’ testimony failed to establish ten years’ possession; on the contrary, they had known the property for many years before the date required by law.
Moreover, this Court does not agree with the State’s representative that, because the property contains forest, it becomes property in the public domain (bien de dominio público), since Article 7 of the Ley de Informaciones Posesorias authorizes the registration of title to properties containing forest, provided that the requirements established by that provision are met. Those requirements were previously cited, and compliance with them has been verified. It should be noted that the constitutionality and non-retroactivity of that provision were upheld by the Sala Constitucional in decision [Telf2], which removed the property from the public domain (desafectó) by allowing title to it to be registered.-
IV.In view of the foregoing, pursuant to Articles 1, 2, 6, and 11 of the Ley de Informaciones Posesorias and Articles 6, 26, 54, and 79 of the Ley de Informaciones Posesorias, the judgment shall be affirmed insofar as it was appealed.-
THEREFORE:
As to the matters appealed, the judgment is affirmed. At this level of review, it is added that the property for which title is to be registered is used as wooded pasture, brush-covered grazing land, and forest; that the management currently being carried out, consisting of a process of natural vegetation regeneration, must continue because the property is covered with brush and there is no evidence that livestock are being grazed there; and that the area adjacent to [Dirección4] must remain protected.- [Nombre10] [Nombre11] MARÍA ROSA CASTRO GARCÍA NOTE ISSUED BY JUDGE [Nombre11] The public domain (Dominio Público)—for the case with which we are concerned—is the set of publicly owned property belonging to the State, lato sensu, allocated to the direct or indirect public use of the inhabitants and subject to a special regime of public law and, therefore, one that departs from private law.
The public domain comprises four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right—the State—; the objective element refers to or consists of the property or properties over which the public domain extends—in this case, the real property at issue in the litigation—; the normative element determines when property meets the requirements established by law for it to be considered public-domain property (demanial), and consists of the body of rules governing it—the set of rules discussed below—; and the teleological element refers to the purpose pursued by including a particular property within the public domain, that is, the public purpose assigned to the property—in this case, the protection of natural resources—. Public-domain property is subject to a special legal regime, is subject to police power, and is characterized essentially by its inalienability and immunity from acquisitive prescription (imprescriptibilidad).
By its nature, such property is intended to meet public needs; this precludes private individuals or entities from holding or possessing it, and it lies outside the stream of private commerce. In Article 121, subsection 14), our Constitución Política refers to public-domain status (Demanialidad), identifying which property may be subject to that public-ownership regime; that article even establishes different degrees of dedication to public use (afectación pública), ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, while harmonizing the rights of private parties subject to the Administration (administrados) with the powers of the Administration. Our current Código Civil, dating from abril de mil ochocientos ochenta y seis, establishes the most important foundations governing public-domain property, specifically in Articles 261 through 263.
Article 262 of the aforementioned Código Civil refers to two important characteristics of public-domain property: a—public things lie outside the stream of commerce; and b—withdrawal from public use (desafectación) is established by stating that such property may not enter private commerce unless so provided by law. As can be seen, dedication to the public-domain regime does not depend on the nature of the property, but on the will of the legislature. In voto número 447-91, issued at fifteen hours thirty minutes on 21 de febrero de 1991, the Sala Constitucional states that the declaration of property as public domain is established by law; this declaration does not constitute a restriction on property under Article 45 of the Carta Magna, because that article refers to private property, and public-domain property is not subject to private ownership. The State Forest Estate (Patrimonio Forestal del Estado) is public-domain property governed by a broad body of rules that, historically and through the present day, prohibits private parties from performing any type of work within properties having that status and, consequently, denies them any right of possession, subject to an exception in a specific situation discussed below.
Lands constituting Reservas Nacionales that contain forests are regarded as State Estate (Patrimonio Estatal)—in their capacity as public-domain property (Demanio Público), which entails the principles of immunity from acquisitive prescription, inalienability, and immunity from attachment (inembargabilidad)—. The foregoing is developed in the provisions cited below: 1) The Código Fiscal of 1865, which contains a chapter concerning forests and was repealed by the Ley General de Terrenos Baldíos Número trece of 6 de enero de 1939, which incorporated substantially the same provisions. For example, Article One stated: “Lands located within the boundaries of the Republic that have not been acquired or registered as property by private parties under legitimate title are presumed to be unappropriated public lands (baldíos) and belong to the State.”—This law generally regulates the prohibition against possessing and registering Reservas Nacionales that constitute Patrimonio Forestal through possessory-information proceedings (informaciones posesorias); in other words, they cannot be appropriated by private parties.—The Ley de Tierras y Colonización Número 2825 of 14 de octubre de 1961 maintained the same approach and has remained in force since that date.
Thus, Article 8 of that Ley de Tierras y Colonización provides: “Except in the cases provided for in this law, private parties are prohibited from enclosing lands declared Reservas Nacionales with fences, cleared boundary lines, or by any other means; clearing woodland; establishing structures and crops; or extracting firewood, timber, vines, palm, or other products from them for purposes of exploitation. Any act of this kind, unless the legal procedures have first been completed and the corresponding authorization obtained, shall be deemed, as applicable, usurpation of the public domain or unlawful entry (merodeo), and the authorities shall order the destruction and removal of the fences and prevent the use of such lands, without compensation or claims for the value of improvements and without prejudice to any other liabilities that may apply to those committing such violations.”—It should be noted that this article criminally punishes anyone who enters a Reserva Nacional to conduct any activity on such lands; accordingly, such activity cannot be regarded as an act of possession because it would be unlawful.—Article 11 of that same Law establishes that the following belong to the State as Reservas Nacionales: “a) All lands within the boundaries of the Republic that are not registered as the private property of individuals, Municipalidades, or Instituciones Autonómas. b—Those not protected by ten-year possession (posesión decenal).—c—Those that have not been allocated by special laws to the establishment of agricultural colonies.—d—Generally, all lands that, while not privately owned, are not occupied for public services.”—For its part, Article 19 of the repealed Ley Forestal número 4465 of veintitrés de noviembre de mil novecientos sesenta y nueve provided: “All forests and forest lands located in the following are dedicated to the purposes of this law: ‘a—Lands regarded as Reservas Nacionales....’” And Article 25 of that same law stated: “Possession of the lands situated in the Reservas Nacionales and State-owned properties referred to in Article 19 of this Law shall confer no rights of any kind, and the State’s action for recovery of ownership (acción reivindicatoria) concerning them shall not be subject to prescription; the Dirección General Forestal, using the legal means at its disposal, shall proceed to evict from such lands persons who occupy them wholly or partially, when they are protection zones (zonas protectoras), Parques Nacionales, Reservas Forestales, or Reservas Biológicas.”—These provisions grant the forests mentioned therein twofold protection: first, because they are Reservas Nacionales, in which any act of possession is prohibited; and second, because they constitute Patrimonio Forestal del Estado, in which no act of possession shall confer any right of any kind.
This is confirmed by Article 8 of the regulations implementing that law, which states: “National lands located within areas declared Reservas Forestales are inalienable; that is, they may not leave State ownership, and possession thereof shall confer no right of any kind, in accordance with Articles 25, 49, and 57 of the Ley Forestal.”—Article 80 of the aforementioned repealed Ley Forestal stated: “The invasion and occupation of lands in Parques Nacionales, Reservas Forestales, and Zonas Protectoras is prohibited. This prohibition extends to the Reservas Nacionales until their classification and transfer have been determined....” Article 6 of that same law provided: “A person who: a—Exploits a forest forming part of the forest estate without the corresponding legal authorization... b—Invades a Parque Nacional, Reserva Biológica, Zona Protectora, or Reserva Forestal... shall be punished by imprisonment for six months to two years or a fine of fifteen to one hundred days.
If the invasion occurs in Reservas Nacionales, it shall be subject to Article 227 of the Código Penal.—” As can be seen, acts of possession carried out in a forest belonging to the State estate are unlawful and therefore cannot confer any right of possession.—Upon the entry into force of Ley Forestal Número 7174 of 28 de junio de 1990, this same approach continued. Article 32 of the aforementioned law provides: “The State forest estate consists of all forests and forest lands within the Reservas Nacionales....” Article 33 of that same law provides: “The forest lands and forests constituting the Patrimonio Forestal del Estado, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall confer no right in their favor, and the State’s action for recovery of those lands shall not be subject to prescription.—Consequently, they may not be registered in the Registro Público through Información Posesoria, and their invasion and occupation shall be punished as provided in this Law.”—Under the current Ley Forestal vigente número 7575 of 5 de febrero de 1996, Title II contains a single chapter devoted exclusively to the State Natural Estate (Patrimonio Natural del Estado), following the same approach that began in 1865 with the Código Fiscal; accordingly, these new provisions reiterate that the Patrimonio Natural del Estado shall consist of the forests and forest lands of the reservas nacionales, areas declared inalienable, and properties registered in the name of the Administración Pública.
Article 14 of the same current Ley Forestal emphatically states that the forest lands and forests constituting the State natural estate are not subject to acquisitive prescription, are immune from attachment, and are inalienable, and that possession thereof by private parties shall confer no right in their favor. The Ley de Conservación de la Vida Silvestre Número 7317 of 21 de octubre de 1972, in Articles 3 and 4, in addition to declaring wild fauna and flora, respectively, to be within the public domain and of public interest, states that wild flora and fauna form part of the Patrimonio Nacional. In the same vein, Article 6 of the Ley de Biodiversidad número 7788 of 30 de abril de 1998 declares the components of biodiversity to be within the public domain, as does Article 46 of the Ley Orgánica del Ambiente, which establishes State sovereignty over biological diversity. In light of the foregoing, the law mandates denying any right of possession to persons who carry out any activity on lands that are not privately owned and that consist of forests within Reservas Nacionales.—As an exception to that mandatory prohibition, Ley Forestal Número 7575 of 1996, which amends Article 7 of the Ley de Informaciones Posesorias, permits the titling of forests when what is understood as ecological possession (posesión ecológica) has been exercised within them.

VOTO Nº 0 555 -F-1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las once horas un minuto del ocho de junio de dos mil once .- INFORMACIÓN POSESORIA, promovida por [Nombre1] , mayor, casado una vez, agricultor, cédula de identidad número CED1 - - , vecino de Horquetas, Sarapiquí. Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua , de calidades ignoradas en autos, en su condición de procuradora adjunta, y e l INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED2 - - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín, Escazú, cédula de identidad CED3 - - , en su condición de apoderada general judicial. Actúa como abogado director del titulante, el licenciado Alvis González Garita , de calidades desconocidas en autos . Tramitada ante el Juzgado Agrario de l Segundo Circuito Judicial de la Zona Sur .-
RESULTANDO:
5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.
Redacta la jueza VARGAS VÁSQUEZ; y,
CONSIDERANDO:
I.Se comparten los hechos tenidos por probados en la sentencia recurrida, al ser acordes con las probanzas constantes en autos, salvo en el primero de ellos, la parte que indica la naturaleza del fundo es de "pastos" pues lo acreditado es que el bien está destinado a potrero arbolado, pasturas encharraladas y bosque; y el tercero, el cual se adiciona en cuanto a que los actos posesorios han consistido también en la protección del recurso forestal. Lo anterior se desprende de la certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, el acta de reconocimiento judicial de folio 64 y la declaración de los testigos [Nombre4] , [Nombre5] y [Nombre6] (folios 29 y 64 a 68) .-
II.La licenciada Lydiana Rodríguez Paniagua, Procuradora Adjunta de la Procuraduría General de la República, interpuso recurso de apelación contra la sentencia, en memorial remitido por fax el 25 de abril de 2011 (folio 92). En lo medular, se mostró inconforme pues estima que del acta de reconocimiento judicial, la prueba testimonial recibida, el plano y el certificado de uso de suelos, se desprende que la naturaleza del bien inmueble a titular es boscosa. De ahí considere que resulta aplicable en este caso la normativa conforme a la cual los terrenos forestales y los bosques de las reservas nacionales están afectos a dominio público, concretamente, al Patrimonio Natural del Estado, al menos desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990, artículos 32 y 33, las cuales establecen un carácter demanial que mantuvo la Ley Forestal 7575, artículos 13 y 14.
Agrega, aún cuando la legislación forestal permite titular inmuebles fuera de las áreas silvestres protegidas si la persona promovente demuestra su legítimo derecho de posesión decenal con las condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble deslindado, ha de tenerse en cuenta la declaratoria de dominio público forestal antes dicha. En su criterio, la interpretación armónica de dichas disposiciones lleva a concluir que los terrenos de bosque sólo podrán titularse si la usucapión se había consolidado antes de ingresar, por ley, al Patrimonio Natural del Estado, y en este caso, las declaraciones de las personas que declararon no demuestran la posesión decenal apta para usucapir. Como fundamento de sus argumentos, la apelante cita y transcribe parcialmente las resoluciones emitidas por la Sala Constitucional Nº 4587-97, 15753-2005, [Telf1], 738-2003, 12239-2006, 12240-2006, 12241-2006, 11190-1990, así como los dictámenes de la Procuraduría General de la República C-321-2003 y 146-2008, de lo cual se desprende, en su criterio, la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron "a su abrigo", la imposibilidad de usucapir bienes de dominio público, el principio de inalienabilidad, la insusceptibilidad de adquirirse por posesión y la imprescriptibilidad.-
III.Con el planteamiento de este proceso, el promovente [Nombre1] , solicita se ordene la titulación a su nombre en el Registro Nacional de un inmueble ubicado en Horquetas de Sarapiquí de Heredia, con una medida de 6 hectáreas 22,39 metros cuadrados, el cual se localiza fuera de cualquier área silvestre protegida, sea cual sea su categoría de manejo, administrada por el Ministerio de Ambiente, Energía y Telecomunicaciones, lo cual se desprende del plano catastrado H-781439-2002 de folio 1º y de la certificación de folio 5. Dicho bien está destinado a "montaña y potrero" según se hizo constar en el levantamiento topográfico; no obstante, en el documento de traspaso y en el escrito inicial con carácter de declaración jurada, se señaló, es de "pastos" (folios 9, 11 y 12). Tales inconsistencias se aclaran con la certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria en la que se hizo referencia a sectores de "potrero arbolado, pasturas encharraladas y bosque" (folio 29) y además, en las observaciones y recomendaciones, se indicó: "Observaciones; al sector B se dio el uso conforme del suelo, aunque sea clase VI, ya que esta en un proceso de regeneración natural de la vegetación, ya que éste se encuentra encharralado y no se observó evidencia de que se estén pastoreando semovientes en el inmueble.
El sector A y el sector C tienen un uso conforme según la unidad de manejo determinada. La quebrada Tigre es afectada por la Ley Forestal 7575, en su artículo 33. Recomendaciones: continuar con manejo que se está llevando a cabo en la finca." (folio 30), lo cual es coherente con las fotografías de folio 32. Al tratarse de un estudio técnico, cuyos resultados son similares a lo consignado en el acta de reconocimiento judicial (folio 64), estima el Tribunal queda en evidencia la naturaleza real del inmueble, la cual es conforme con lo que indica la representante del Estado, y no el señalado en la sentencia en la que sólo se cita "pastos", pues en realidad lo que existe es potrero arbolado, pasturas encharraladas y bosque. Ante tales circunstancias, existiendo bosque en el inmueble, resulta aplicable el artículo 7 de la Ley de Informaciones Posesorias, conforme al cual es posible titular éste siempre que se acredite el ejercicio de la posesión decenal, la protección del recurso y la delimitación del bien.
La recurrente alega que con la prueba testimonial no se logró demostrar el primer requisito; no obstante, éste Tribunal estima sí se cumplió con la comprobación de todos los requerimientos de la norma en referencia. En primer orden, del reconocimiento judicial se deduce que el inmueble está debidamente delimitado y se ha protegido el recurso forestal, al indicarse en el acta: "Se pudo verificar todas sus colindancia (sic) observando que en los extremos este, sur y oeste la propiedad se encuentra delimitada con cerca de alambre de de púa a tres y cuatro hilos con postes vivos y muertos, en general éstos cercados se observan en regulares condiciones. Toda la colindancia norte, la constituye la quebrada tigre (sic), observándose en la rivera de la misma una cobertura vegetal con árboles y malesas propios de la zona ..." y se agregó que no se observaban "rastros de que recientemente se hayan talado árboles o que se le esté dando un uso indebido al recurso natural ..." (folio 64).
Ahora bien, en relación con la demostración del ejercicio de la posesión, el 28 de octubre de 2010, se recibió la declaración de los testigos [Nombre4] , [Nombre5] y [Nombre6] . El primero de ellos indicó que conocía el bien desde hacía más de 15 años y que el promovente tenía de 8 a 10 años de ejercer la posesión sobre el fundo y antes de él, quien lo poseía era [Nombre7] , ejerciendo ambos en su tiempo, actos posesorios tales como el arreglo de cercas, hacer chapeas y el primero vive en una casa ubicada en el fundo (folios 65 y 66). El segundo dijo conocer el inmueble desde hace 30 años y que quienes lo han poseído son el promovente actualmente y antes de él, [Nombre7] , [Nombre8] y [Nombre9] , quien se han ocupado, cada uno en su tiempo, de darle mantenimiento a las cercas, hacer chapeas y en el caso del titulante, habitar la casa que está en el fundo (folios 66 y 67). Finalmente, el último testigo señaló que conocía el bien desde hace aproximadamente 20 años, período en el cual quienes se han ocupado de la posesión del bien han sido el promovente, y unas personas llamadas [Nombre8] y [Nombre9], reiterando los actos posesorios mencionados por los anteriores testigos (folios 67 y 68).
De lo anterior se deduce que no lleva razón la recurrente al afirmar que no se logró acreditar la posesión decenal con la declaración de los testigos, pues por el contrario, conocen el bien muchos años antes de la fecha exigida por ley. Aunado a ello, este Tribunal no comparte los argumentos de la representante del Estado en el sentido de que el bien al contener bosque pasa a ser un bien de dominio público, puesto que el artículo 7 de la Ley de Informaciones Posesorias autoriza la titulación de inmuebles con bosque siempre que se cumplan los requisitos establecidos por esa norma, los cuales ya fueron citados con antelación y verificado su cumplimiento. Nótese que la constitucionalidad e irretroactividad de esa norma fue avalada por la Sala Constitucional en voto [Telf2], el cual desafectó dicho bien al permitir su titulación.-
IV.Por lo expuesto, con fundamento en los artículos 1, 2, 6 y 11 de la Ley de Informaciones Posesorias y 6, 26, 54 y 79 de la Ley de Informaciones Posesorias, deberá confirmarse la sentencia en lo que ha sido objeto de apelación.-
POR TANTO:
En lo apelado, se confirma la sentencia. En esta instancia se agrega que el inmueble a titular está destinado a potrero arbolado, pasturas encharraladas y bosque; y debe continuarse con el manejo que se está llevando a cabo, consistente en un proceso de regeneración natural de la vegetación, ya que la propiedad se encuentra encharralada y no hay evidencia de que se estén pastoreando semovientes, y mantenerse protegida el área aledaña a la [Dirección4] .- [Nombre10] [Nombre11] MARÍA ROSA CASTRO GARCÍA NOTA EXPUESTA POR LA JUEZA [Nombre11] El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico.
El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-. Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado.
Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicando qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263. El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así.
Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohíbe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.
Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.
Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a indemnización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en carácter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autonómas. b-) Los que no estén amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reivindicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.
Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalienables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.
En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalienables, su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.
El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.
El terreno objeto de esta información posesoria, al estar compuesto en gran parte por pastos y potrero, y en una mínima parte de bosque, no se trata de un terreno Patrimonio Natural del Estado; además se consigna esta nota para indicar no se comparte lo expuesto en la parte final del Considerando III en cuanto afirma el conteo del plazo decenal lo es tomando como punto de referencia el artículo 7 de la Ley de Informaciones Posesorias, cuando lo correcto a mi criterio lo es tal posesión debe demostrarse antes de la Ley de Tierras y Colonización.- [Nombre11] PROCESO: INFORMACIÓN POSESORIA PROMOVENTE:[Nombre1] D+G+V Constancia de notificación Parte u otros Resultado Fecha Servidor (a) Juan José Solis Parra Fax [Telf3] PGR Fax [Telf4] IDA Fax [Telf5]
