Based on the provisions of Articles 140 and 240 of Law No. 6227, General Law of Public Administration, dated May 2, 1978; Law No. 59, Law of Creation and Organization of the National Geographic Institute, dated July 4, 1944; Law No. 8905, Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its reforms; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, dated July 4, 1944, and its reforms, dated December 7, 2010; Law No. 6043, Law on the Maritime Terrestrial Zone, dated March 2, 1977, with its respective regulation; and Articles 2 and 3 of Law No. 5695, Law Creating the National Registry, dated May 28, 1975, and its reforms.

1. 1That by means of Law No. 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall enter into the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic Geographic Description of the Republic of Costa Rica and for studies, investigations or tasks, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, for the purpose of supporting planning processes.
2. 2That Law No. 59 permanently constitutes the IGN and, on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of Costa Rica, its authority extending to activities of any kind originating from the tasks entrusted to it.
3. 3That in accordance with Law No. 59 and Article 62 of Executive Decree No. 7841-P, called Regulation to the Law on the Maritime Terrestrial Zone, the IGN’s competence for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, as well as its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P states that the National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime terrestrial zone in which it has demarcated the public zone.
4. 4That Executive Decree No. 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone, dated June 28, 2011, in accordance with Articles 18, 19, and 20, establishes that for the types of delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones); and b) georeferenced digital delimitation, which is a methodology that allows the georeferencing of the ordinary high-water mark (pleamar ordinaria) using coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled Declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for placing boundary markers, in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That Executive Decree No. 33797-MJ-MOPT, which, among other aspects, determines the National Geodetic Network of Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically states in its Article 11 that The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or national or foreign private entity undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to the prevention of public spending and obtaining, on the other hand, reliable, uniform, and comparable geographic information of general utility that supports decision-making at different levels of the State.; while Article 7 states that As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, by appropriate means, that information which has been made official.
6. 6That Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its Article 1 that The official horizontal geodetic reference system for Costa Rica, named CR05 and materialized through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08) for the measurement epoch 2014.59, and henceforth, changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (Sistema de Referencia Geocéntrico para las Américas, SIRGAS), called SIRGAS-CON, while Article 2 establishes that The CRTM05 cartographic projection system shall continue to be the official one for the cartographic representation of the continental national territory, extended, for the purposes of applying this cartographic projection, to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line being defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all jurisdictional marine areas of the Costa Rican State.

In turn, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which work in the continental territory of our country must be referenced, by stating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory, extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) projection, zones 16 and 17, for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for Costa Rica, to which all cartographic and geodetic surveys and activities carried out in the national territory by any public agency, person, or private entity, national or foreign, undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to the prevention of public spending and obtaining, on the other hand, reliable, uniform, and comparable geographic information of general utility that supports decision-making."

1. 7That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone makes possible the correct delimitation of the public zone for the purposes of drafting regulatory plans (planes reguladores), approval of survey plans (planos de agrimensura), granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).
2. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the IGN's Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) on the Maritime Terrestrial Zone.
3. 9That the IGN's GDG on the Maritime Terrestrial Zone is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT; and c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.

10.—That Law No. 7575, called the Forestry Law (Ley Forestal) of 1996, in its Article 16, establishes that the Ministry of Environment and Energy shall delimit, on the ground, the boundaries of the areas that make up the Natural Heritage of the State (Patrimonio Natural del Estado).

11.—That Law No. 6043 establishes in its Article 1, CHAPTER I, General Provisions, that The maritime terrestrial zone constitutes part of the national patrimony, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is the obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.

12.—That according to Article 11 of the aforementioned Law No. 6043, it establishes that the Public Zone is also, whatever its extension, the area occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

13.—That Executive Decree No. 36786-MINAET, titled Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 on November 11, 2011, establishes among its objectives to Identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (suelos Clase VII y VIII), wetlands (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), in order to certify them and incorporate them as part of the Natural Heritage of the State (Patrimonio Natural del Estado, PNE).

14.—That Executive Decree No. 36786-MINAET, in point III.—Competencies for delimitation and certification, establishes that The classification of lands within the Maritime Terrestrial Zone (ZMT) shall be the responsibility of the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (suelos Clase VII y VIII), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC that has territorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, inspection, demarcation (deslinde), and certification of lands of the Natural Heritage of the State and protection zones.

The location and delimitation of the Natural Heritage of the State areas within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all the zones to be concessioned within the ZMT and for its classification at the level of cadastral maps. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to count them in the total area to be concessioned.

15.—That official communication SINAC-ACOSA-PNE-AD-036-2019, dated January 30, 2020, signed by Licda. Ginette Jiménez Soto, head of the Regional PNE Program, and Ing. Roberto Martínez Fernández, Topographic Engineer of the Regional PNE Program of the Osa Conservation Area (Área de Conservación Osa), corresponds to the Report on the topographic survey of estuary and mangrove areas in Playa Preciosa and Platanares, Puerto Jiménez, Golfito, with the technical information of the survey work carried out through the georeferenced digital delimitation of each mangrove and estuary portion.

16.—That by means of official communication SINAC-ACOSA-D-063-2020, dated February 21, 2020, signed by Licda. Laura Rivera Quintanilla, acting director (directora a.i.) of the Osa Conservation Area, the topographic survey of estuary and mangrove areas located in the sector of Preciosa and Platanares, Puerto Jiménez, Golfito, Puntarenas, is delivered to the IGN, according to the methodology established in Executive Decree No. 35803-MINAET, in order to proceed with the respective officialization of the public zone of the Maritime Terrestrial Zone corresponding to the digital delimitation carried out on the estuary and mangrove.

17.—In reports SINAC-ACOSA-PNE-AD-168-2019, dated July 25, 2019, and SINAC-ACOSA-PNE-AD-192-2019, dated August 12, 2019 (addendum), signed by Licda. Ginette Jiménez Soto, head of the Regional PNE Program, and Ing. Roberto Martínez Fernández, Topographic Engineer of the Regional PNE Program of the Osa Conservation Area, the technical information on the characterization, identification, and delimitation of the estuary and mangrove ecosystems digitally delimited in the sector of Preciosa, Platanares, Puerto Jiménez, Golfito, Puntarenas is described, and which correspond to a correction and modification of the areas to be made official.

18.—By means of certifications SINAC-ACOSA-D-CERT-022-2019, dated August nineteenth, two thousand nineteen, and SINAC-ACOSA-PNE-044-2019, dated August nineteenth, two thousand nineteen, the estuary and mangrove areas of the sector of Preciosa and Platanares in Puerto Jiménez, Golfito, Puntarenas, that form part of the National Patrimony of the State are delimited.

19.—That the georeferenced digital delimitation of the estuary and mangrove portions in the sector of Preciosa and Platanares, Puerto Jiménez, Golfito, Puntarenas, carried out by the Osa Conservation Area, has the technical endorsement according to official communication DIG-TOT-0075-2021, dated February 16, 2021, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the IGN.

20.—That Article 140 of Law No. 6227 states that The administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce its effect from when it is adopted, a provision that must necessarily be related to Article 240 of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that General acts shall be communicated by publication and specific acts by notification.

Communicates:

First.—The IGN publishes, in the sector of Preciosa and Platanares, the estuary and mangrove portions, located in district 02° Puerto Jiménez, canton 07° Golfito, province 06° Puntarenas, by means of the methodology used and validated by the Osa Conservation Area (ACOSA) to delimit the public zone of the Maritime Terrestrial Zone through georeferenced digital delimitation.

Second.—The public zone of the Maritime Terrestrial Zone delimited in the sector of Puerto Jiménez, situated in Preciosa and Platanares, corresponds to the estuary and mangrove portions carried out through georeferenced digital delimitation, in accordance with Executive Decrees No. 35803-MINAET and No. 36786-MINAET.

Third.—The delimitation of the estuary and mangrove in the sector known as Preciosa and Platanares, Puerto Jiménez, Golfito, Puntarenas, corresponding to the Natural Heritage of the State, is published, made official by means of certification SINAC-ACOSA-PNE-044-2019 and SINAC-ACOSA-D-CERT-022-2019, both dated August 19, 2019, in accordance with reports SINAC-ACOSA-PNE-AD-168-2019, SINAC-ACOSA-PNE-AD-192-2019, and SINAC-ACOSA-PNE-AD-036-2019.

Fourth.—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone for the estuary-mangrove sector situated in Preciosa-Platanares, district 02° Puerto Jiménez, canton 07° Golfito, province 06° Puntarenas, have been registered in the IGN's Georeferenced Digital Geodatabase (GDG) on the Maritime Terrestrial Zone (ZMT), in a shape vector format file, under the coding: RN/IGN_GDG-IGN-ZMT digital lines.

Fifth: It shall take effect from its publication.

Given in Curridabat, San José, on the 26th day of August of the year 2021.

Considering:

Con fundamento en lo dispuesto en los artículos 140 y 240 de la ley N° 6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978; ley N° 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944; ley N° 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la ley N° 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1. 1Que mediante ley N° 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley N° 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la ley N° 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, del 28 de junio del 2011, de conformidad con los artículos 18, 19 y 20 establece que los tipos de delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a saber: a) delimitación a través de la colocación de mojones y; b) delimitación digital georreferenciada, que es una metodología que permite la georreferenciación de la pleamar ordinaria, a partir de coordenadas en el sistema de referencia oficial del país, establecido por el Decreto Ejecutivo N° 33797-MJ-MOPT titulado Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, sin que sea necesario la colocación de mojones, con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en su artículo 11 que La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose de esta forma a evitar el gasto público y obteniendo por otra parte información geográfica confiable, uniforme y comparable que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.; mientras que el artículo 7 indica que Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado.
6. 6Que el Decreto Ejecutivo N° 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones."

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.
3. 9Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P; b) el Decreto Ejecutivo N° 33797-MJ-MOPT y; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, todos previamente citados.

10.-Que la ley N° 7575 denominada Ley Forestal de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que la ley N° 6043 establece en su artículo 1 del CAPÍTULO I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.

12.-Que según el artículo 11 de la referida ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

14.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

15.-Que el oficio SINAC-ACOSA-PNE-AD-036-2019 de fecha 30 de enero del 2020 suscrito por la Licda. Ginette Jiménez Soto, encargada Programa Regional de PNE, y el Ing. Roberto Martínez Fernández, Ingeniero Topógrafo del Programa Regional de PNE del Área de Conservación Osa, corresponde al Informe de levantamiento topográfico de áreas de estero y manglar en Playa Preciosa y Platanares, Puerto Jiménez, Golfito, con la información técnica del trabajo de levantamiento realizado mediante la delimitación digital georreferenciado de cada porción de manglar y estero.

16.-Que mediante el oficio SINAC-ACOSA-D-063-2020 de fecha 21 de febrero del 2020 suscrito por la Licda. Laura Rivera Quintanilla, directora a.i., del Área de Conservación Osa se hace entrega al IGN el levantamiento topográfico de áreas estero y manglar ubicadas en el sector de Preciosa y Platanares, Puerto Jiménez, Golfito, Puntarenas, según la metodología establecida en el Decreto Ejecutivo N° 35803-MINAET para proceder a realizar la respectiva oficialización de la zona pública de la Zona Marítimo Terrestre correspondiente a la delimitación digital realizada del estero y manglar.

17.-En los informes SINAC-ACOSA-PNE-AD-168-2019 de fecha 25 de julio de 2019 y el SINAC-ACOSA-PNE- AD-192-2019 de fecha 12 de agosto de 2019 (adendum), suscrito por la Licda. Ginette Jiménez Soto, encargada Programa Regional de PNE, y el Ing. Roberto Martínez Fernández, Ingeniero Topógrafo del Programa Regional de PNE del Área de Conservación Osa, se describe la información técnica sobre la caracterización, identificación y delimitación de los ecosistemas de estero y manglar delimitados digitalmente en el sector de Preciosa, Platanares, Puerto Jiménez, Golfito, Puntarenas y que corresponden a una corrección y modificación de las áreas a oficializar.

18.-Mediante las certificaciones SINAC-ACOSA-D-CERT-022-2019 del diecinueve de agosto del 2019 y SINAC-ACOSA-PNE-044-2019 del diecinueve de agosto del 2019 se delimita las áreas de estero y manglar del sector de Preciosa y Platanares en Puerto Jiménez de Golfito, Puntarenas, que forman parte del Patrimonio Nacional del Estado.

19.-Que la delimitación digital georreferenciada de las porciones de estero y manglar en el sector de Preciosa y Platanares, Puerto Jiménez, Golfito, Puntarenas, realizada por el Área de Conservación Osa, cuenta con aval técnico conforme al oficio DIG-TOT-0075-2021 del 16 de febrero de 2021, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN.

20.-Que el artículo 140 de la ley N° 6227 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.

Comunica:

Primero.-El IGN publica en el sector de Preciosa y Platanares las porciones de estero y manglar, ubicados en el distrito 02° de Puerto Jiménez del cantón 07° de Golfito de la provincia 06° de Puntarenas, por medio de la metodología usada y validada por el Área de Conservación Osa (ACOSA) para delimitar la zona pública de la Zona Marítimo Terrestre mediante la delimitación digital georreferenciada.

Segundo.-La zona pública de la Zona Marítimo Terrestre delimitada en el sector de Puerto Jiménez, situado en Preciosa y Platanares, corresponde a las porciones de estero y manglar realizada mediante la delimitación digital georreferenciada, de acuerdo a los decretos ejecutivos N° 35803-MINAET y N° 36786-MINAET.

Tercero.-Se publica la delimitación del estero y manglar en el sector conocido como Preciosa y Platanares, Puerto Jiménez, Golfito de Puntarenas correspondiente al Patrimonio Natural de Estado oficializado mediante la certificación SINAC-ACOSA-PNE-044-2019 y SINAC-ACOSA-D-CERT-022-2019 ambas del 19 de agosto del 2019, de conformidad con los informes SINAC-ACOSA-PNE-AD-168-2019, SINAC-ACOSA-PNE-AD-192-2019 y SINAC-ACOSA-PNE-AD-036-2019.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del sector estero-manglar situado en Preciosa- Platanares, distrito 02° Puerto Jiménez, cantón 07° Golfito, provincia 06° Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT líneas digitales.

Quinto: Rige a partir de su publicación.
