40548-MINAE, Regulation to the Wildlife Conservation Law, establishes the requirements for processing requests for the export of wildlife specimens, their parts or derivatives for commercial purposes, however, it is very important to take advantage of the automation processes of the export and import platforms carried out in the country.
Due to the automation process of the export permits to be granted, SINAC develops this guideline to take advantage of the benefits of the Single Window System for Foreign Trade (VUCE) of PROCOMER. SINAC will use, as of the publication of this resolution, the system in force according to the version and officialization thereof by PROCOMER. For this, the exporter must have the corresponding digital signature, whether at a personal level or from the authorized legal representative, so that they can carry out the relevant procedure.
In accordance with Articles 14, 112, 116, 181, 182, 169 and 202 of Executive Decree No. 40548-MINAE, SINAC will receive as a technical document for the same decree. For its presentation in the VUCE, said certificate will be received as valid by SINAC in digital format, with the respective digital signature issued by a registered certification authority, for which purpose, the authorized regent must have a personal digital signature.
III.-General guidelines for the export procedure for commercial purposes of wildlife specimens originating from management sites authorized by SINAC.
The interested party must submit:
1. Application form duly completed and digitally signed in the current VUCE System. According to Annex 1 of this resolution.
2. In the event that the applicant is a foreigner without national identification, they must provide in the VUCE System a certified copy of their current passport. For these purposes, the certified copy will be received with a digital signature.
3. In the event that the applicant is a legal entity, they must provide in the VUCE System a certification of legal standing issued no more than three months prior. For these purposes, the certification will be received with a digital signature.
4. In the case of recognized occupants of lands under the administration of INDER, who are going to export wildlife specimens, their parts or derivatives, the application must include the final agreement of the Institute's Board of Directors, in which the applicant is authorized to carry out the activity intended to be developed. Said digitally signed authorization must be provided in the VUCE System.
5. When the export is intended to be carried out by a person other than the property owner, a legally valid document must be submitted demonstrating that the applicant has the express authorization of the owner or sufficient powers to carry out the intended activity. Said digitally signed authorization must be provided in the VUCE System.
6. Be up to date with their obligations as an employer or have a certification of non-employer status issued by the CCSS in accordance with Article 74 of the Constitutive Law of the CCSS, No. 17. The SINAC official will generate the SICERE Certification and provide it to the VUCE for the digital file.
7. Technical document, which in the case of exports will be the certificate of origin indicated in Article 202, subsection K of Executive Decree No. 40548-MINAE. For its presentation in the VUCE, said certificate will be received as valid by SINAC in digital format, with the respective digital signature issued by a registered certification authority, for which purpose, the authorized regent must have a personal digital signature. For the presentation in the VUCE, the certificate of origin form that must be used is the one established in Annex 2 of the present resolution.
8. Commercialization authorization for the specimens of interest, products, or subproducts issued by the Conservation Area, for when it concerns species declared in danger of extinction, with reduced populations, or included in Appendices I and II of CITES. As established in Article 112 of Executive Decree No. 40548-MINAE.
9. Approval (Visto Bueno) of the Conservation Area for the export of wildlife fauna specimens declared as wild by their country of origin and not included in the CITES appendices. When applicable.
