National System of Conservation Areas. Arenal Huetar Norte Conservation Area, Regional Directorate. At four o'clock in the afternoon on October 26, two thousand twenty. The opening of the Caño Negro Mixed National Wildlife Refuge is authorized for tourism purposes within the Public Use zones.

1. 1That in accordance with Article 32 of the Organic Law of the Environment, the Ministry of Environment and Energy is responsible for the administration of the country's Protected Wild Areas.
2. 2That Article 22 of the Biodiversity Law delegates to SINAC the authority to administer the Protected Wild Areas, which establishes that the National System of Conservation Areas (SINAC) is a management and institutional coordination system, decentralized and participatory, with instrumental legal personality that integrates competencies in forestry, wildlife, and protected areas matters, attached to the Ministry of Environment and Energy (MINAE), with the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
3. 3That in accordance with Article 28 of the Biodiversity Law, each conservation area is a territorial unit of the country, administratively delimited, governed by a single development and administration strategy, duly coordinated with the rest of the public sector. In each one, both private and state activities in conservation matters are interrelated without detriment to the protected wild areas.

4º-The Conservation Areas shall be responsible for applying the legislation in force regarding natural resources within their geographical demarcation. They shall execute the policies, strategies, and programs approved by the National Council of Conservation Areas in matters of protected areas; likewise, they shall be in charge of applying other laws governing their subject matter, such as the Wildlife Conservation Law, No. 7317, of October 30, 1992, and its amendments, and the Forest Law (Ley Forestal), No. 7575, of February 13, 1996, the Organic Law, No. 7554, of October 4, 1995, and the Law for the Creation of the National Parks Service, No. 6084, of August 24, 1977.

1. 4That Executive Decree 34164-MINAE, of January 2, 2008, published in La Gaceta No. 7, exists, which in its first article empowers SINAC-MINAE to charge, in the protected wild areas under its administration, differentiated fees for the concept of entry to each one of them, in addition to the use of some services that the State can provide, as established in the cited Executive Decree. For which, the Caño Negro Mixed National Wildlife Refuge has the conditions for the establishment of an entry ticket sales point and personnel responsible for carrying out said activity, as well as the surveillance of the refuge.
2. 1That the Caño Negro Mixed Refuge was created by executive decree (No. 15120-MAG) on January 4, 1984. The Refuge politically and administratively is located in Los Chiles canton and in Guatuso canton. Furthermore, it forms part of the Los Maleku - Medio Queso Route Biological Corridor and is also considered the core zone of the Agua y Paz Biosphere Reserve, declared worldwide by UNESCO, in the year 2007, under the administration of the Arenal Huetar Norte Conservation Area ACAHN.
3. 2That the Caño Negro Refuge is classified as a Mixed Property Refuge, as it possesses lands that partly belong to the State (56%) and the rest are privately owned (44%). Formed by a complex system of lagoons that in turn receive flows mainly from the Frío River and Mónico River, where wetland ecosystems predominate, with great diversity of resident and migratory birds that use the wetland for feeding, as a refuge, and also as a nesting site; therefore, in the month of December 1991, it was declared a Wetland of International Importance especially as a habitat for aquatic birds, thus becoming part of the RAMSAR sites.
4. 3That the Caño Negro Mixed National Wildlife Refuge has a General Management Plan (Plan General de Manejo), published in La Gaceta No. 226 of September 9, 2020; which establishes in its zoning the following: Extensive Public Use (ZUPE), Intensive Public Use Zone (ZUPI), Combined Public Use Zone (ZUPC), as well as the Absolute Protection Zones (ZPA) and Sustainable Use of Natural Resources Zones (ZUSRN), which allows the administration to define and clearly regulate the visitation zones within the refuge, without putting natural resources at risk and providing adequate attention to visitors.
5. 4That since 2017, SINAC invested a significant amount of resources obtained through financing from the Inter-American Development Bank to strengthen the tourism and administrative infrastructure within the National Wildlife Refuge, for which the administrative offices were remodeled and adapted for tourist attention, and three docks were built for the anchoring of small boats on the bank of the Frío River, an observation tower, and elevated trails, which, coupled with the scenic beauty and the abundance of wildlife, makes it an important tourist attraction in the northern sector of Costa Rica.
6. 5That the Caño Negro Mixed National Wildlife Refuge is a protected area that presents tourist demand during most of the year and has significant investment, as well as appropriate conditions for visitation, for the use and enjoyment of visitors entering the refuge.
7. 6That one of the goals proposed by the State Administration is the promotion of programs for biodiversity conservation and achieving sustainable development.
8. 7That the opening to tourism in this important Protected Wild Area will undoubtedly allow the economic reactivation of the community of Caño Negro, one of the communities with low social development indices, as extracted from the reports of MIDEPLAN, and particularly after the crisis generated by the sanitary measures imposed following the impact of COVID-19 in the country. Therefore,

The director of the Arenal Huetar Norte Conservation Area, based on the content of Article 32 of the Organic Law of the Environment, Articles 22, 28, and 29 of the Biodiversity Law, Executive Decree number 34164 - MINAE, of January 2, 2008, published in La Gaceta No. 7, and the technical basis contained in the Management Plan of the Caño Negro Mixed National Wildlife Refuge.

HEREBY RESOLVES 1º-To order the opening to tourism for the visitation of public use zones starting November 7, 2020. The regular visitation hours shall be from 8:00 a.m. to 4:00 p.m. In accordance with the following provisions.

• a)For the specific activity of bird watching, a schedule is established from 5:30 a.m. to 7:30 a.m. and from 4:00 p.m. to 6:00 p.m., this only through guides accredited and authorized by the administration of the Protected Wild Area (ASP).
• b)For the sport fishing activity, a schedule is established from 5:30 a.m. to 7:30 a.m. and from 4:00 p.m. to 6:00 p.m., this only through guides accredited and authorized by the administration of the ASP, and duly registered at the administrative office.
• c)For the night tour of the elevated trail (Los Chocuacos), a schedule is established until 9:00 p.m., with prior authorization from the administration and accompanied by a guide accredited and authorized by the administration of the ASP.

2º-To order the opening of the ticket office, which will operate in accordance with the regulations contained in Executive Decree number 34164-MINAE, of January 2, 2008, published in La Gaceta No. 7, and will be located in the administrative offices of the Refuge, conditioned for this purpose.

3º-Captains of vessels must respect the maximum permitted capacity of persons per vessel and take the corresponding precautions under their responsibility, respecting the maximum capacities including the captain and the guide according to the type of vessel.

4º-Individuals who wish to enter the refuge may purchase their ticket directly at the ticket office of the refuge or through a third person.

5º-Tourists must enter only through the authorized sector corresponding to the administrative offices (El Sitio).

6º-The Administration of the Caño Negro Mixed National Wildlife Refuge shall establish the control measures it deems appropriate to guarantee that access to the protected area is made once the corresponding admission fees have been paid. It is very important that all visitors or tourists carry their identification document or passport at the time of visiting the Refuge.

7º-The Administration of the Caño Negro Mixed National Wildlife Refuge is fully authorized, upon the recommendation of the Technical entities, to effect temporary closures due to changes in the conditions of the protected wild area or emergency situations.

8º-General Provisions.

• a)The right of admission is for strictly personal use and under no circumstances is it transferable to another person.
• b)The amount paid to SINAC for the right of admission covers only the daily entry fee for each person to the Caño Negro Mixed National Wildlife Refuge in accordance with the provisions of the current fee decree.
• c)No tourist may enter the RNVSMCN after the established hours.
• d)The exemption from payment of admission fees may be granted only based on the provisions of the executive decree that regulates entry fees to protected wild areas. Anyone interested in entering the Refuge without paying a fee shall be subject to the availability of space that the administration establishes for the day of the visit.
• e)Every visitor who remains within the Caño Negro Mixed National Wildlife Refuge must demonstrate the legitimacy of their stay during their visit, presenting an identification document.
• f)Anyone who does not comply with the aforementioned provisions may not enter or remain within the RNVSMCN. Likewise, those visitors whose actions go against the provisions of this resolution shall also be expelled from the protected area.

11º-Against this resolution, the ordinary remedies of revocation and/or appeal are available, in accordance with Articles 343 and following of the General Law of Public Administration, which shall be resolved, the revocation by the same body that issued it and the appeal by the National Council of Conservation Areas. The remedies must be filed before the body issuing this resolution within three days following its publication.

Sistema Nacional de Áreas de Conservación. Área de Conservación Arenal Huetar Norte, Dirección Regional. A las dieciséis horas del 26 de octubre del dos mil veinte. Se autoriza la apertura del Refugio Nacional de Vida Silvestre Mixto Caño Negro, para fines turísticos dentro de las zonas de Uso Público.

1. 1Que de conformidad con el artículo 32 de la Ley Orgánica del Ambiente, al Ministerio del Ambiente y Energía, le compete la administración de las Áreas Silvestres Protegidas del país.
2. 2Que el artículo 22 de la Ley de Biodiversidad, delega en el SINAC la competencia de administrar las Áreas Silvestres Protegidas, el cual establece que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, con personería jurídica instrumental que integra las competencias en materia forestal, vida silvestre, áreas protegidas, adscrito al Ministerio del Ambiente y Energía (MINAE), con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
3. 3Que de conformidad con la ley de Biodiversidad artículo 28 cada área de conservación es una unidad territorial del país, delimitada administrativamente, regida por una misma estrategia de desarrollo y administración, debidamente coordinada con el resto del sector público. En cada uno se interrelacionan actividades tanto privadas como estatales en materia de conservación sin menoscabo de las áreas silvestres protegidas.

4º-Las Áreas de Conservación se encargarán de aplicar la legislación vigente en materia de recursos naturales, dentro de su demarcación geográfica. Deberán ejecutar las políticas, las estrategias y los programas aprobados por el Consejo Nacional de Áreas de Conservación, en materia de áreas protegidas; asimismo, tendrá a su cargo la aplicación de otras leyes que rigen su materia, tales como la Ley de conservación de la vida silvestre, Nº 7317, de 30 de octubre de 1992 y sus reformas, y la Ley Forestal, Nº 7575, de 13 de febrero de 1996, Ley Orgánica, Nº 7554, de 4 de octubre de 1995, y la Ley de Creación del Servicio de Parques Nacionales, Nº 6084, de 24 de agosto de 1977.

1. 4Que existe el Decreto Ejecutivo 34164-MINAE, del 2 de enero del 2008, publicado en La Gaceta N° 7, mismo que en su artículo primero, faculta al SINAC-MINAE, a cobrar en las áreas silvestres protegidas bajo su administración, tarifas diferenciadas por concepto de ingreso en cada una de ellas, además por el uso de algunos servicios que el Estado puede brindar, según lo establecido en el citado Decreto Ejecutivo. Para lo cual se cuenta en el Refugio Nacional de Vida Silvestre Mixto Caño Negro con las condiciones para el establecimiento del puesto de venta de boletos de ingreso y personal encargado de realizar dicha actividad, así como la vigilancia del refugio.
2. 1Que el Refugio Mixto Caño Negro fue creado por decreto ejecutivo (Nº 15120-MAG) el 4 de enero de 1984. El Refugio político administrativamente se ubica el cantón Los Chiles y en el cantón Guatuso. Además, forma parte del Corredor Biológico ruta Los Maleku - Medio Queso y se le considera además zona núcleo de la Reserva de la Biósfera Agua y Paz, declarada a nivel mundial por la UNESCO, en el año 2007, bajo la administración del Conservación Arenal Huetar Norte ACAHN.
3. 2Que el Refugio Caño Negro se clasifica como un Refugio de Propiedad Mixta, por poseer terrenos que en parte pertenecen al Estado (56%) y el resto son de propiedad privada (44%). Conformado por un sistema complejo de lagunas que a su vez reciben caudales principalmente del río Frío y río Mónico, donde predominan ecosistemas de humedal, con gran diversidad de aves residentes y migratorias que utilizan el humedal para alimentarse, como refugio y también como sitio de anidación; por lo que en el mes de diciembre del año 1991 fue declarado Humedal de importancia Internacional especialmente como hábitat de aves acuáticas, pasando así a formar parte de los sitios RAMSAR.
4. 3Que el Refugio Nacional de Vida Silvestre Mixto Caño Negro cuenta con un Plan General de Manejo, publicado en La Gaceta Nº 226 del 09 de setiembre del 2020; que establece en su zonificación, las siguientes: Uso Público Extensivo (ZUPE), Zona Uso Público Intensivo (ZUPI), Zona de uso Público Combinado (ZUPC), así como las zonas de Zonas de Protección Absoluta (ZPA) y Zonas de Uso sostenible de los Recursos Naturales (ZUSRN), lo que permite a la administración definir y regular con claridad las zonas de visitación dentro del refugio, sin poner en riesgo los recursos naturales y brindar la atención adecuada a los visitantes.
5. 4Que desde el año 2017 el SINAC invirtió una importante cantidad de recursos obtenidos a través de financiamiento del Banco Interamericano de Desarrollo para fortalecer la infraestructura turística y administrativa dentro del Refugio Nacional de Vida Silvestre para lo cual se remodelaron y adecuaron las oficinas administrativas para la atención al turista y se construyeron tres muelles, para el anclaje de embarcaciones pequeñas en el margen del Río Frío, una torre de observación y senderos elevados, lo que aunado a la belleza paisajística y la abundancia de vida silvestre lo convierte en un importante atractivo turístico en el sector norte de Costa Rica.
6. 5Que el Refugio Nacional de Vida Silvestre Mixto Caño negro, es un área protegida que presenta una demanda turística durante la mayor parte del año y cuenta con una importante inversión, así como condiciones apropiadas para la visitación, para el uso y disfrute de los visitantes que ingresen al refugio.
7. 6Que uno de los fines que se ha propuesto la Administración del Estado, es el impulso de los programas para la conservación de la biodiversidad y el lograr un desarrollo sostenible.
8. 7Que la apertura al turismo en esta importante Área Silvestre Protegida, sin duda alguna permitirá reactivar económicamente, la comunidad de Caño Negro, una de las comunidades con bajos índices de desarrollo social, según se extrae de los informes de MIDEPLAN y particularmente tras la crisis generada por las medidas sanitarias impuestas tras la afectación del COVID-19 en el país. Por tanto,

La directora del Área de Conservación Arenal Huetar Norte, con fundamento en el contenido del artículo 32 de la ley Orgánica del Ambiente, artículos 22 y 28 y 29 de la ley de Biodiversidad, el decreto ejecutivo número 34164 - MINAE, del 2 de enero del 2008, publicado en La Gaceta N° 7, la fundamentación técnica contenida en el Plan de manejo del Refugio Nacional de Vida Silvestre Mixto Caño Negro.

1º-Ordenar la apertura al turismo para la visitación de las zonas de uso público a partir del día 07 de noviembre de 2020. En horario ordinario de visitación será de las 8:00 horas a las 16:00 horas. Conforme a las siguientes disposiciones.

• a)Para la actividad específica de observación de aves se establece un horario de 5:30 horas a 7:30 horas y de las 16:00 a 18:00 horas, esto únicamente por medio de guías acreditados y autorizados por la administración del Área Silvestre Protegida (ASP).
• b)Para la actividad de pesca deportiva, se establece un horario de 5:30 horas a 7:30 horas y de las 16:00 a 18:00 horas, esto únicamente por medio de guías acreditados y autorizados por la administración del ASP, y debidamente registrados en la oficina administrativa.
• c)Para tour nocturno del sendero elevado (Los Chocuacos) se establece hasta las 21:00 horas previa autorización de la administración y acompañados de un guía acreditado y autorizado por la administración del ASP.

2º-Ordenar la apertura de la boletería que operará de conformidad con las regulaciones contenidas en el Decreto ejecutivo número 34164-MINAE, del 2 de enero del 2008, publicado en La Gaceta N° 7, se ubicará en las oficinas administrativas del Refugio, acondicionadas para este fin.

3º-Los capitanes de embarcaciones deberán respetar la capacidad máxima de personas por embarcación permitida y tomar bajo su responsabilidad las precauciones correspondientes, respetando las capacidades máximas incluyendo al capitán y al guía según el tipo de embarcación.

4º-Las personas físicas que deseen ingresar al refugio, podrán adquirir su boleto de forma directa en la boletería del refugio o a través de una tercera persona.

5º-Los turistas deberán realizar el ingreso únicamente por el sector autorizado que corresponde a las oficinas administrativas (El Sitio).

6º-La Administración del Refugio Nacional de Vida Silvestre Mixto Caño Negro establecerá los dispositivos de control que considere oportunos para garantizar que el acceso al área protegida se haga una vez cancelados los derechos de admisión correspondientes. Es muy importante que todos los visitantes o turistas porten su documento de identificación o pasaporte al momento de visitar el Refugio.

7º-Queda totalmente autorizada la Administración del Refugio Nacional de Vida Silvestre Mixto Caño Negro bajo la recomendación de los entes Técnicos, a efectuar cierres temporales por cambios en las condiciones del área silvestre protegida o situaciones de emergencia.

8º-Disposiciones Generales.

• a)El derecho de admisión es de uso personalísimo y por ningún motivo el mismo es transferible a otra persona.
• b)El monto cancelado al SINAC por el derecho de admisión cubre únicamente el derecho de ingreso diario para cada persona al Refugio Nacional de Vida Silvestre Mixto Caño Negro conforme a lo establecido en el decreto de tarifas vigente.
• c)Ningún turista podrá ingresar después de los horarios establecidos al RNVSMCN.
• d)La exoneración del pago de derechos de admisión se podrá otorgar únicamente con base en lo establecido por el decreto ejecutivo que regula las tarifas de ingreso a las áreas silvestres protegidas. Todo interesado en ingresar exonerado al Refugio, estará sujeto a la disponibilidad de espacio que la administración establezca para el día de la visita.
• e)Todo visitante que permanezca dentro del Refugio Nacional de Vida Silvestre Mixto Caño Negro, deberá demostrar la legitimidad de su permanencia durante su estadía, presentando un documento de identificación.
• f)Quien no acate las disposiciones antes mencionadas no podrá ingresar ni permanecer dentro del RNVSMCN. De igual manera, aquellos visitantes que con sus acciones vayan en contra de lo establecido en la presente resolución, también serán expulsados del área protegida.

11º-Contra la presente resolución proceden los recursos ordinarios de revocatoria y / o apelación, de conformidad con los artículos 343 y siguientes de la Ley General de la Administración Pública, los cuales serán resueltos, el de revocatoria por el mismo órgano que lo dictó y el de apelación por el Consejo Nacional de Áreas de Conservación. Los recursos deberán interponerse ante el órgano que dicta esta resolución dentro de los tres días posteriores a su publicación.
