For the purposes of this Regulation, the following terms mean:
Subscriber (Abonado): The natural or legal person who is the owner of the farm (finca), lot, or building of any nature, to which the drinking water service is provided.
Water connection (Acometida de agua): Length of pipe and accessories installed from the distribution network to the point of installation of the service connection; it reaches up to the property boundary.
Aqueduct (Acueducto): The set of sources, potabilization plants, storage tanks, conduction networks, distribution, and other elements necessary for supplying water to a population.
Drinking water (Agua potable): Treated water that complies with the provisions of recommended values or maximum admissible aesthetic, organoleptic, physical, chemical, biological, and microbiological values, established in the current Reglamento de Calidad de Agua Potable.
Billing adjustment (Ajuste a la facturación): Modification to billed amounts after a study and approval of an analyst when a formal claim is presented by the interested party.
High Consumption (Alto Consumo): Monthly consumption that exceeds the average consumption by 100%.
Payment arrangement (Arreglo de pago): Agreement between parties in which both agree that the debt be covered in installments. Every payment arrangement must follow the provisions of the current Reglamento de Cobro Administrativo y Judicial de la Municipalidad de La Unión.
Street or public road (Calle o vía pública): Any access owned by the community for the free transit of persons and/or vehicles.
Hydraulic capacity (Capacidad hidráulica): Corresponds to the condition of the installed infrastructure of the supply and sanitation systems for conveying flows for the provision of services.
Water resource capacity (Capacidad hídrica): Existing condition of technical and administrative feasibility for the production and Condominium (Condominio): Real estate susceptible to independent use by different owners, with common elements of an indivisible character. Condominiums may be of the lot, horizontal, vertical, combined, mixed, or other types.
Certificate of services (Constancia de servicios): Document issued by the Dirección de Recurso Hídrico for the purpose of certifying to the interested party the actual existence, on a property, of one or more drinking water and/or sanitation services installed and in operation.
Certificate of water resource capacity (Constancia de capacidad hídrica): Document issued by the Dirección de Recurso Hídrico in the event of a denial of service availability, which certifies that the aqueduct has actual water resource capacity and the potential availability of the water supply service to the property; subject to the construction by the interested party of the infrastructure indicated in this document.
Connection (Conexión): Union of the public drinking water supply or sanitary sewer system with the private system.
Cross connections (Conexiones cruzadas): Interconnection of systems (water, wastewater, storm drainage water, non-potable industrial water, or others) that risk contaminating the water system, the integrity of the sanitation system, and the stormwater system.
Fraudulent connection (Conexión fraudulenta): Connection that, having been suspended, is connected to the water systems without the authorization of the system operator; or that, being active, is detected to be using a means that allows the actual consumption of the service not to be accounted for.
Unauthorized or illicit connection (Conexión no autorizada o ilícita): Connection made by third parties to the water systems, without the due authorization of the Municipality.
Consumption (Consumo): The monthly consumption recorded by the water meter where there is no evidence of impact from non-visible leaks (fugas no visibles) in the internal or pre-installed connections.
Average consumption (Consumo promedio): The average of the normal consumptions recorded in the last 6 months.
Service continuity (Continuidad del servicio): A quality of the service that indicates the time of uninterrupted service during a specific period.
Connection right (Derecho de conexión): Amount or sum that the interested party must pay in advance to the Municipality for the installation of the new water service to be carried out.
Reconnection right (Derecho de reconexión): Term by which the value or sum that the subscriber (abonado) must pay in advance to the Municipality for the reconnection of the drinking water service that was suspended for reasons attributable to the subscriber or user is qualified.
Dirección de Recurso Hídrico: Municipal Operator of Drinking Water, Fire Hydrant (Hidrantes), and Sanitation Services.
Availability of water service (Disponibilidad de servicio de agua): Document issued by the Dirección de Recurso Hídrico for the purpose of certifying to the interested party the actual existence, on a property, of the water resource capacity and the hydraulic capacity, as well as collection and treatment, that allows the eventual request for drinking water supply, collection, and treatment of wastewater services; without causing detriment to the rights of existing users.
Branch extension (Extensión de ramal): Increase in length of a segment of the aqueduct network up to a specific point; carried out on a public road or on an easement (servidumbre) in the name of the Municipality of La Unión.
Technical feasibility (Factibilidad técnica): Study, evaluation, and approval or denial of the request for water availability, based on existing conditions.
Bill (Factura): Printed or digital document issued periodically by the Municipality, which shows the items, consumption, due date, and amounts to be charged for the services provided. It constitutes a means of notification to the interested party.
Billing (Facturación): Process by which the items, volumes, and amounts to be paid by the user are determined.
Farm (Finca): Land or plot, with or without its respective building, duly individualized in the Public Registry of Property.
Filial farm (Finca filial): Private unit of property within a condominium, which constitutes an autonomous portion conditioned for independent use and enjoyment, communicated directly with the public road or with a specific common space that leads to it.
Parent farm (Finca matriz): Real estate that gives rise to the condominium, consisting of two or more filial farms and their corresponding common areas.
Parent filial farm (Finca filial matriz): Any filial farm that, due to its own characteristics in terms of size, availability of access, and services, allows a new condominium to be constituted within the initial condominium.
Subdivision (Fraccionamiento): The division of any real estate for the purpose of selling, transferring, negotiating, distributing, exploiting, or using the resulting parcels separately; it includes both partitions of judicial or extrajudicial adjudication, localizations of undivided rights, and mere segregations under the same owner, as well as those located in urbanizations or new constructions that concern the control of the formation and urban use of real estate.
Public standpipe (Fuente pública): Installation of a drinking water standpipe of 12mm in diameter within a maximum radius of 200 meters from the point to be supplied.
Special public standpipe (Fuente pública especial): Installation of a public standpipe in front of the dwelling whose water service was suspended for lack of payment, linked to the corresponding payment designated as Special Public Standpipe, according to the current tariff schedule.
Leak (Fuga): Escape of water in the distribution and/or conduction networks and/or hydraulic infrastructure of the drinking water systems.
Non-visible leak (Fuga no visible): Leak that cannot be detected with the naked eye. Every non-visible leak must be verified by an Inspector of the Municipal Aqueduct upon the request of the interested party.
Internal installation leak (Fuga de instalación interna): Escape of water in the internal drinking water supply installations.
Individuation (Independización): The act by which the Dirección de Recurso Hídrico, at the request of the Subscriber (Abonado), separates the water services of each of the consumption units within a single property.
Property (Inmueble): Duly individualized land that lists one or several owners. A Property may or may not contain one or more infrastructure works. Water meter inspection: Review performed by an official of the Dirección de Recurso Hídrico on the water meter installed for the user, to detect anomalies and/or obtain technical information about the instrument. If the water meter inspection is requested by the subscriber, this inspection is associated with an additional cost on the bill according to the current tariff schedule.
Leak detection inspection (Inspección para detección de fugas): Review inside the property performed by an official of the Dirección de Recurso Hídrico, with the consent of the subscriber and/or interested party, to detect possible leaks in the internal installations. This inspection is associated with the prior payment of an additional cost on the bill according to the current tariff schedule. This service may be provided outside the jurisdiction of the canton upon prior payment of the respective cost into a municipal account (Taxpayer No.) created for that purpose.
Technical inspection (Inspección técnica): Specialized review performed by the Dirección de Recurso Hídrico regarding the operation and use of the water, sanitation, and metering systems, located on public roads, in easements (servidumbres), or on private farms and buildings.
Technical inspections for supplies (Inspecciones técnicas por abastecimientos): Review that the Dirección de Recurso Hídrico performs, at the request of the user or ex officio, to verify the use of the service and its basic data.
Connection installation (Instalación de conexión): Action that is executed when the connection located on a private property is physically integrated into the operator's system.
Internal installations (Instalaciones internas): Mechanical water supply and sanitation installations located within the property.
Interconnection (Interconexión): Connection of new systems, infrastructure, and urban developments that comply with the current technical regulations, to the distribution and collection systems operated by the Dirección de Recurso Hídrico for the enabling of water and sanitation services.
Property boundary for water service: Corresponds to the part of the boundary of the property or the access easement to this property, in front of the point where the water meter providing the service is located. In the case of properties located facing a public road or a passage and pipeline easement (servidumbre de paso y tubería) constituted in favor of the Municipality of La Unión, it corresponds to the boundary of the property or the filial farm. In the case of properties located facing access easements, it corresponds to the front of this easement with the public road.
Manual of Technical Requirements (Manual de requisitos técnicos): Technical document issued by the Dirección de Recurso Hídrico of the Municipality of La Unión that contemplates the technical specifications of materials, controls, and hydraulic elements, infrastructure, and installation methodology.
Water Meter (Medidor de Agua): Device or instrument intended to measure and record the volume of water.
Municipality (Municipalidad): Municipality of La Unión.
Fine (Multa): Monetary sanction for infractions committed in accordance with this Regulation and the laws in force.
Water connection (Paja): A water connection (Acometida de Agua).
Possessor (Poseedor): Person who performs acts of stable and effective possession, in a peaceful, public, and uninterrupted manner, as owner for more than 10 years on properties not registered with the Public Registry.
Pre-installed water connection (Prevista agua): Length of pipe and accessories installed from the distribution network to the point for the service connection; it reaches up to the property boundary, that has not been connected to the internal installations of the property.
Owner (Propietario): Natural or legal person who exercises dominion over real estate through a public deed, duly registered in the Public Registry.
Urban development project (Proyecto de desarrollo urbanístico): Infrastructure project for urban purposes, built in open spaces (urbanizations, condominiums, shopping centers, housing and/or office towers, among other infrastructures).
Volumetric Test (Prueba Volumétrica): Review performed on the water meter in order to verify the correct recording of water volume.
Reception of works (Recepción de obras): Action that results from approving and receiving or transferring a water or sanitation work or infrastructure; built by a private party and that becomes the property of the Municipality of La Unión, once technical and legal compliance with the requested requirements has been verified.
Networks (Redes): System of pipes for the distribution of water and the collection of wastewater.
Public network (Red pública): System of water pipes or wastewater collection owned by the Municipality of La Unión, ASADAS, and/or AYA.
Municipal Supply Service (Servicio de Abastecimiento Municipal): Corresponds to the supply of water for human consumption provided by the Dirección de Recurso Hídrico, also referred to as the drinking water service.
Drinking Water Service (Servicio de Agua Potable): Municipal supply service.
Sanitation Service (Servicio de Saneamiento): Corresponds to the collection, treatment, and disposal of wastewater.
Fire Hydrant Service (Servicio de Hidrantes): Service linked to the maintenance, operation, and development of the hydraulic systems necessary for firefighting, serving the Cuerpo de Bomberos.
Provisional service (Servicio provisional): Service that, due to the nature of the activity, is provided for a specific period and that will subsequently become a permanent service.
Temporary service (Servicio temporal): Service that, due to the nature of the activity, is provided for a specific period.
Municipal servant (Servidor municipal): That individual who provides services to the Municipality or on behalf of and on account of it, as part of its organization, by virtue of a valid and effective act of investiture.
Public access easement (Servidumbre de acceso público): Real right of entry or transit of pedestrians and/or vehicles in favor of public entities and over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of the property right, without the portion of land thereby losing its condition of private property.
Easement by prescription (Servidumbre de hecho): That established over a property by force of use and custom, tolerated by the owner of the property, without legal imposition or formal act of constitution through a public deed.
Private passage easement (Servidumbre de paso privada): Real right of entry and transit of pedestrians and/or vehicles in benefit of one or several farms, and over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of the property right, without the portion of land thereby losing its condition of private property.
Passage and pipeline easement (Servidumbre de paso y tubería): Real right to install water pipes and/or sanitary sewers over a property owned by another, for operation, administration, and maintenance by the Dirección de Recurso Hídrico. It implies a permanent and continuous utility of the access for the fulfillment of its public purpose, as well as a limit to the exercise of the property right by its owner.
Registered passage and pipeline easement (Servidumbre de paso y tubería inscrita): Passage and pipeline easement that is duly registered over one or several properties in the Property Registry.
Private system (Sistema privado): Set of water and sanitary sewer installations that is not administered by the Dirección de Recurso Hídrico.
Municipal Public System (Sistema Público Municipal): Set of water and sanitary sewer installations administered and operated by the Dirección de Recurso Hídrico.
Connection requests (Solicitudes de conexión): Proceeding conducted by the interested party to obtain the installation of the service, after approval of drinking water availability, complying with the technical requirements requested by the Dirección de Recurso Hídrico according to the Manual of Technical Requirements and the associated payment.
Service suspension (Suspensión del servicio): Action that allows interrupting the provision of the water supply services, due to lack of payment or for reasons inherent to the operation of the service.
Tariff (Tarifa): List or catalog of prices that must be paid for the provision of a service.
Urbanization fee (Tasa de urbanización): Amount that the developer of urbanizations, residential areas, and horizontal or vertical condominiums must pay, for each water connection (paja de agua) or housing or commercial unit processed; the fee shall be established according to a prior study conducted by the Dirección de Recurso Hídrico.
Consumption unit (Unidad de consumo): Each of the housing, commercial, industrial, or other units, that has its own drinking water installations to which the water use referred to in this Regulation will be assigned. Any remodeling, alteration, or Municipality of La Unión for the purpose of determining if it creates a new consumption unit and/or change in the water use.
Urbanization (Urbanización): Subdivision (Fraccionamiento) and enablement of land for urban purposes, through the opening of streets and provision of services.
Water use (Uso de agua): Purpose that the user or the Municipality of La Unión determines for the water service. It is classified as: 1. Domiciliary, 2. Ordinary, 3. Reproductive, 4. Preferential, 5. Special, 6. Differentiated, 7. Provisional, 8. Block water.
User (Usuario): Natural person and/or legal entity that legitimately uses the drinking water service provided by the Dirección de Recurso Hídrico.
Sale of block water (Venta de agua en bloque): Modality of sale of water to another provider operating legally in Costa Rica and sellers of water to third parties operating legally.
Sale of water by prepayment (Venta de agua por pago anticipado): Corresponds to the sale of volumes of water, previously and technically defined and paid for, upon the request of a user.
