For the purposes of these Regulations, the following terms mean:
Subscriber or taxpayer: The individual or legal entity that owns the property, lot, or building of any nature, to which the drinking water service is provided.
Water service connection: Length of pipe and accessories that are installed from the distribution network to the point of installation of the service connection; it reaches the property limit.
Aqueduct: It is the set of sources, water treatment plants, storage tanks, conduction, distribution networks, and other elements necessary for the supply of water to a population.
Drinking water: Treated water that complies with the provisions of recommendable or maximum admissible aesthetic, organoleptic, physical, chemical, biological, and microbiological values, established in the current Drinking Water Quality Regulations.
Billing adjustment: Modification to the invoiced amounts after study and approval by an analyst when a formal claim is presented by the subscriber or whoever they authorize.
High Consumption: Monthly consumption that exceeds the average consumption by 100%.
Approval of works: Action resulting from validating a water work or infrastructure, built by a private individual, once technical and legal compliance with the requested requirements has been verified.
Payment arrangement: Agreement between parties in which both agree that the debt be covered in installments. Every payment arrangement must follow the provisions of the current Regulations for Administrative and Judicial Collection of the Municipality of La Unión.
Street or public road: Any access belonging to the community for the free transit of people and/or vehicles.
Hydraulic capacity: Corresponds to the condition of the installed infrastructure of the supply and sanitation systems to convey the flows for the provision of services.
Water resource capacity: Existing condition of technical and administrative feasibility for the production and exploitation of drinking water for supply by the Municipality.
Causes not attributable to the operator: Those circumstances that cannot be controlled by the Dirección de Recurso Hídrico and that cause a variation in the normal administration and operation conditions of the supply systems.
Condominium: Property susceptible to independent use by different owners, with common elements of an indivisible nature. Condominiums may be of the lot, horizontal, vertical, combined, mixed, or other types.
Social Interest Condominium: Any condominium that is to be financed totally or partially with funds from the National Financial System for Housing and that has been expressly declared as such by the Mortgage Housing Bank; according to the Regulatory Law of Condominium Property No. 7933 and its regulations.
Proof of services: Document issued by the Dirección de Recurso Hídrico with the purpose of certifying to the subscriber, the actual existence on a property, of one or more drinking water and/or sanitation services installed and in operation.
Proof of water resource capacity: Document issued by the Dirección de Recurso Hídrico upon a denial of service availability, in which it is certified that the aqueduct has real water resource capacity and the potential availability of the water supply service to the property; subject to the construction by the subscriber, of the primary infrastructure or primary works indicated in this document.
Connection: Union of the public drinking water supply or sanitary sanitation system with the private system.
Cross connections: Interconnection of systems (water, wastewater, storm drainage water, non-potable industrial water, or others) that put the water system, the integrity of the sanitation system, and the stormwater system at risk of contamination.
Fraudulent connection: Connection, that having been suspended; is connected to the water systems without the authorization of the system operator; or that being active, it is detected that it uses a means to not record the actual consumption of the service.
Unauthorized or illicit connection: Connection made by third parties to the water systems, without the due authorization of the Municipality.
Consumption: It is the volume of water recorded by the water meter within a determined period of time.
Equivalent consumption for services in conflict zones: corresponds to the average consumption volume of metered subscribers. For the purposes of these regulations, the equivalent is established at 20m3 per month. This will be applicable only to the domiciliary rate.
Average consumption: It is the average of the consumptions recorded in the last 6 months in the reading database and that have not been modified by the application of any of the articles of these regulations. When the subscriber has a record of less than 6 months, the average consumption will be estimated with the existing data. For duly justified cases, the consumption projection with subsequent reading will be applied.
Continuity of service: It is a quality of the service that indicates the time of uninterrupted service during a determined period.
Connection fee: Amount or sum that the interested party must pay previously to the Municipality for the installation of the new water service to be carried out. See current tariff schedule at the following link: https://launion.go.cr/departamentos/direccion-de-recurso-hidrico/ Reconnection fee: Term with which the value or sum is qualified that the subscriber must pay previously to the Municipality for the reconnection of the drinking water service that was suspended for causes attributable to the subscriber or user. Site design: Technical document that describes the planning for building an urban development, in which the strategy to be followed is reflected with its action programs and validity.
In which it includes aspects of the location and spatial distribution; the chronology of actions for each of the stages, phases, or components; as well as the characteristics, the execution period, the development objective, and the water demand by stages; including the segregations or divisions that will require water and/or sanitation services.
Availability of water service: Document issued by the Dirección de Recurso Hídrico with the purpose of certifying to the owner, the actual existence on a property, of the water resource capacity and of the hydraulic capacity, as well as collection and treatment, that allows the eventual request for drinking water supply services, the collection and treatment of wastewater; without causing detriment to the rights of existing users. This document will be issued only if the procedure contemplates all compliant requirements, including compliance with the current Regulating Plan according to the criterion issued by DIDECU. This does not imply the approval of construction permits or any other license issued by the Municipality. The respective procedures must be processed before the pertinent entities.
Building for residential use or housing unit: Dwelling or apartment intended for permanent and continuous residential use, built for the purpose of housing people to exclusively satisfy their housing need. The modality can be single-family or multi-family.
Elimination of service: Action that allows the permanent annulment for reasons inherent to the operation of the service, based on a reasoned technical justification and justified by the Dirección de Recurso Hídrico.
Technical Study: Study that allows proposing and analyzing different technical options for the provision of services.
Socioeconomic Study: Tool used by the Social Work Service through which the living conditions of the user are investigated (interview and home visit) to determine their socioeconomic condition, protective factors, and vulnerability factors. Branch extension: Increase in length of a segment of the aqueduct network up to a determined point; carried out on a public road or on an easement (servidumbre) in the name of the Municipality of La Unión.
Technical feasibility: Study, evaluation, and approval or not of the water availability request, based on existing conditions.
Technological feasibility: Real and current existence of access to information technologies linked to the drinking water service in the Municipality of La Unión. Its operation may be affected by internal or external factors affected by force majeure or acts of God.
Invoice: Printed or digital document issued periodically by the Municipality, which shows the concepts, consumption, due date, amounts to be charged for the services provided.
It constitutes a means of notification to the subscriber.
Billing: Process by which the concepts, volumes, and amounts to be paid by the subscriber and/or user are determined.
Property: Land or lot, with or without its respective building, duly individualized and registered in the Public Registry of Property.
Subsidiary property: Private unit of property within a condominium, which constitutes an autonomous portion conditioned for independent use and enjoyment, communicated directly with the public road or with a determined common space that leads to it.
Parent property: Property that gives origin to the condominium, constituted by two or more subsidiary properties and their corresponding common areas.
Parent subsidiary property: It is any subsidiary property that due to its own characteristics in terms of size, availability of access, and services, allows constituting a new condominium within the initial condominium.
Subdivision (Fraccionamiento): It is the division of any property with the purpose of selling, transferring, negotiating, distributing, exploiting, or using separately the resulting parcels; it includes both judicial or extrajudicial adjudication partitions, localizations of undivided rights, and mere segregations under the same owner, as well as those located in urbanizations or new constructions that concern the control of the formation and urban use of real estate.
Public fountain: Installation of a 12mm diameter drinking water fountain within a maximum radius of 200 meters from the point to be supplied.
Leak: Escape of water in the distribution and/or conduction networks and/or hydraulic infrastructure of the drinking water systems.
Non-visible leak: Leak that cannot be detected with the naked eye. Every non-visible leak must be verified by a Municipal Aqueduct Inspector upon the request of the subscriber.
Internal installation leak: Escape of water in the internal drinking water supply installations.
Separation (Independización): It is the act by which, the Dirección de Recurso Hídrico at the request of the Subscriber, separates the water services of each of the consumption units within a single property.
Existing infrastructure of DRHI: Infrastructure that is under the operation, administration, and maintenance of the Dirección de Recurso Hídrico, such as public networks for water conduction and distribution and the collection and treatment of wastewater, service connections (acometidas), water meters, hydrants, valves, pumping stations, tanks, wells, and any other component necessary for the optimal provision of services, in accordance with the corresponding technical and legal regulations.
Primary infrastructure or primary works: Infrastructure of drinking water and sanitation systems, as well as complementary works, that are necessary and must be built with the objective of being able to grant the Proof of Availability of the Supply and/or Collection services to an urban development project or properties. This infrastructure would be located on public lands or property of the Municipality, streets or public roads, and/or permanent pipeline and access easement (servidumbre) registered in favor of the Municipality of La Unión.
Property: Land, duly individualized that designates one or several owners. A Property may or may not contain one or several infrastructure works.
Water meter inspection: Review that an official of the Dirección de Recurso Hídrico makes on the water meter that the user has installed, to detect anomalies and/or obtain technical information about the instrument. If the Water meter inspection is requested by the subscriber, this inspection is associated with an additional cost on the invoice according to the current tariff schedule. See current tariff schedule at the following link: https://launion.go.cr/departamentos/direccion-de-recurso-hidrico/ Leak detection inspection: Review inside the property carried out by an official of the Dirección de Recurso Hídrico, with the consent of the subscriber to detect possible leaks in the internal installations. This inspection is associated with the prior payment of an additional cost on the invoice according to the current tariff schedule. This service may be provided outside the jurisdiction of the canton upon prior payment of the respective cost into a municipal account (Taxpayer No.) created for that purpose. See current tariff schedule at the following link: https://launion.go.cr/departamentos/direccion-de-recurso-hidrico/ Technical inspection: Specialized review carried out by the Dirección de Recurso Hídrico regarding the operation and use of the water, sanitation, and metering systems, located on public roads, in easements (servidumbres), or on private properties and buildings (with the due consent of the owner). It also corresponds to the inspections that the Municipality of La Unión carries out as part of its oversight duty, in the different stages of the construction of the primary infrastructure and/or primary works, in charge of a developer.
Technical inspections for supplies: Review that the Dirección de Recurso Hídrico carries out, at the user's request or ex officio, to verify the use of the service and its basic data.
Connection installation: Action that is completed when the connection located on a private property is physically integrated into the operator's system.
Internal installations: Mechanical installations for water supply and sanitation located inside the property and that are under the responsibility of the subscriber.
Interconnection: Connection of new systems, infrastructure, and urban developments that comply with current technical regulations, to the distribution and collection systems operated by the Dirección de Recurso Hídrico for the enabling of water and sanitation services.
Property limit for water service: Corresponds to the part of the boundary of the property or the access easement (servidumbre) to this property, in front of the point where the water meter with which the water service is provided is located. In the case of properties located facing a public road or an access and pipeline easement (servidumbre), constituted in favor of the Municipality of La Unión, it corresponds to the boundary of the property or the subsidiary property. In the case of properties located facing access easements (servidumbres), it corresponds to the frontage of this easement with the public road.
Manual of technical requirements: Technical document issued by the Dirección de Recurso Hídrico of the Municipality of La Unión that contemplates the technical specifications of material, controls and hydraulic elements, infrastructure, and installation methodology.
Water Meter: Device or instrument intended to measure and register the volume of water, also known as a hydrometer.
Calculation report for service allocation: Technical document containing the water consumption estimate, to determine, in accordance with the projected average allocation, the correct sizing of the water meter that will be assigned to the service, considering the use (domestic, commercial, industrial, or any other authorized purpose), the description of the consumption units, and the number of people who will enjoy the service.
The calculation must be presented both in liters per second contemplating consumption peaks, as well as the projected consumption per month.
Municipality: Municipality of La Unión.
Fine: Monetary penalty for offenses committed in accordance with these Regulations and current laws.
Connection line: Water service connection.
Unauthorized alternate water bypass (bypass): Unauthorized mechanism for water connection, used to avoid the registration of the water meter.
Cadastral plan: Survey plan, physical or in electronic format, that has been registered in the National Cadastre and its effects are defined in the Regulations to the National Cadastre Law Executive Decree No. 34331- J, and its reforms or the regulations that replace it.
Tariff Schedule: It is the official document that indicates the amounts corresponding to the costs of services, consumption blocks, installation costs, and others, which must be published in the Official Gazette La Gaceta. See current tariff schedule at the following link: https://launion.go.cr/departamentos/direccion-de-recurso-hidrico/ Possessor: Person who performs stable and effective acts of possession, in a peaceful, public, and uninterrupted manner, as owner for more than 10 years on properties not registered before the Public Registry.
Pre-billing: Process by which the Dirección de Recurso Hídrico performs a preliminary verification of the registered consumptions prior to billing.
Optimal service pressure: Dynamic service pressure of at least 1.5 kg/cm2 (15 meters of water column or 21.3 psi) at the point of service delivery or water service connection. Pre-installed water service: Length of pipe and accessories installed from the distribution network to the point for the service connection; it reaches the property limit, which has not been connected to the internal property installations.
Owner: Individual or legal entity that exercises domain over real estate by public deed, duly registered in the Public Registry.
Urban development project: Infrastructure project for urban purposes, built in the opening of spaces (urbanizations, condominiums, shopping centers, housing and/or office towers, among other infrastructures).
Volumetric Test: Review carried out on the water meter in order to verify the correct registration of water volume.
Reception of hydraulic works for drinking water and sanitation: Action resulting from approving and receiving or transferring a drinking water or sanitation work or infrastructure; built by a private individual and which becomes the patrimony of the Municipality of La Unión, once technical and legal compliance with the requested requirements has been verified. The technical corroboration will be the responsibility of the Dirección de Recurso Hídrico.
For the final reception of these works, an agreement by the Municipal Council must mediate.
Networks: System of pipes for the distribution of water and the collection of wastewater.
Public network: System of water pipes or wastewater collection owned by the Municipality of La Unión, ASADAS, and/or AYA.
Rule of three: It is the operation of finding the fourth term of a proportion knowing the other three.
Waiver of service: Action that allows the permanent annulment of the water supply provision, at the request of the owner.
Administrative resolution for suspected leak: Document issued by the Dirección de Recurso Hídrico informing the user or taxpayer that the existence of a leak on their property is presumed.
Administrative resolution for meter obstruction: Document issued by the Dirección de Recurso Hídrico informing the user or taxpayer of the situation that prevented the reading of the water meter from being taken; as well as the corresponding fine.
Administrative resolution for unauthorized connection: Document issued by the Dirección de Recurso Hídrico informing the user or taxpayer that an unauthorized connection has been detected; as well as the corresponding fine.
Administrative resolution for construction process without construction permits: Document issued by the Dirección de Recurso Hídrico informing the user of a an administrative process by the Dirección de Desarrollo y Control Urbano; reason why their water service rate will be modified.
Administrative resolution for construction process with construction permits: Document issued by the Dirección de Recurso Hídrico informing the user or taxpayer that due to the existence of a construction permit, their water service rate will be modified.
Administrative resolution for database cleansing: Document issued by the Dirección de Recurso Hídrico informing the taxpayer that, at their request, the database of improper charges has been cleansed.
General administrative resolution: Document issued by the Dirección de Recurso Hídrico informing the user or taxpayer that a particular condition has been detected that must be addressed to guarantee adequate functioning of the water service.
Municipal Supply Service: Corresponds to the supply of water for human consumption provided by the Dirección de Recurso Hídrico, also referred to as Drinking Water service.
Drinking Water Service: Municipal supply service.
Sanitation Service: Corresponds to the collection, treatment, and disposal of wastewater.
Hydrant Service: Service linked to the maintenance, operation, and development of the hydraulic systems necessary for firefighting, at the service of the Fire Department.
Provisional service: Service that, by the nature of the activity, is provided for a determined period and that subsequently will become a permanent service.
Temporary service: Service that, by the nature of the activity, is supplied for a maximum period of six months.
Permanent Service: Service provided to a duly registered property, which complies with all the requirements of national laws and municipal regulations including the current Regulating Plan, continuously for more than six months.
Municipal servant: That individual who provides services to the Municipality or in the name and on behalf of it, as part of its organization, by virtue of a valid and effective act of investiture.
Public access easement (servidumbre): Right in rem of ingress or transit of pedestrians and/or vehicles in favor of public entities and over another's property. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land thereby losing its condition of private property.
De facto easement (servidumbre): That established over a property by force of use and custom, tolerated by the property owner, without legal imposition or a formal act of constitution by public deed.
Easement of way (servidumbre de paso) registered in favor of third parties: Right in rem of ingress and free transit of pedestrians and/or vehicles, constituted and registered in favor of a property whose owner is a natural person or legal entity other than the Municipality of La Unión.
Private easement of way (servidumbre de paso privada): Right in rem of ingress and transit of pedestrians and/or vehicles for the benefit of one or more properties, and over another's property. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land thereby losing its condition of private property.
Pipeline and access easement (servidumbre de paso y tubería): Right in rem of installing water pipe and/or sanitary sewer on another's property, for the operation, administration, and maintenance by the Dirección de Recurso Hídrico. It implies a permanent and continuous utility of the access for the fulfillment of its public purpose, as well as a limit on the exercise of property rights by its owner.
Registered pipeline and access easement (servidumbre de paso y tubería inscrita): Pipeline and access easement that is duly registered over one or several properties in the Property Registry.
Private system: Set of water and sanitary sewer installations that is not administered by the Dirección de Recurso Hídrico.
Municipal Public System: Set of water and sanitary sewer installations administered and operated by the Dirección de Recurso Hídrico.
Connection requests: Procedure carried out by the subscriber in order to obtain the installation of the service, after the approval of drinking water availability, complying with the technical requirements requested by the Dirección de Recurso Hídrico according to the Manual of Technical Requirements and the associated payment.
Bulk water supply between authorized operators: Bulk water supply between authorized service operators, with the objective that the applicant operator that needs to increase the water resource capacity of its systems, can satisfy the demand of its current and potential users, in safeguarding the public interest and in accordance with the technical and legal capacity to provide this supply. The cost will be defined in the corresponding rate study and through agreements allowed by the Municipal Code.
Water supply in volume for conditioned means of transport: Modality of water sale in a determined volume, through authorized means of transport for this purpose. The cost will be defined in the corresponding rate study (if there is no defined rate the cost-recovery rate will be applied) or through the agreements allowed by the Municipal Code. The supply location will be defined by the Municipality of La Unión.
Suspension of service: Action that allows interrupting the provision of water supply services, for lack of payment or for reasons inherent to the operation of the service.
Rate: List or catalog of prices that must be paid for the provision of a service.
Differentiated rate: Subsidy or benefit for which families in a condition of extreme poverty or basic poverty who meet the requirements and conditions established in these regulations may apply.
Urbanization fee: amount that the developer of urbanizations, residential complexes, and horizontal or vertical condominiums must pay, for each water connection line (paja de agua) or housing or commercial unit processed; the fee will be established according to a prior study carried out by the Dirección de Recurso Hídrico.
Consumption unit: Each of the housing, commercial, industrial, or other units, that has its own drinking water installations for which the water use referred to in these Regulations will be assigned. Any remodeling, alteration, or expansion made to an existing structure must be assessed by the Municipality of La Unión for the purpose of determining if it gives rise to a new consumption unit and/or variation in water use.
Urbanization: Subdivision (fraccionamiento) and enabling of land for urban purposes, through opening streets and providing services.
Water use: Destination that the user or the Municipality of La Unión determines is given to the water service. It is classified as: 1. Domiciliary, 2. Ordinary, 3. Cost-recovery, 4. Preferential, 5. Special, 6. Differentiated, 7. Provisional, 8. Bulk water.
User: Individual and/or legal entity that uses legitimately the drinking water service provided by the Dirección de Recurso Hídrico of the Municipality of La Unión.
Bulk water sale: Modality of water sale to another provider that operates legally in Costa Rica and water sellers to third parties that operate legally.
Prepaid water sale: Corresponds to the sale of water volumes, previously and technically defined and paid for, upon the request of a user.
Coverage Zone: Geographic area where there are enabled aqueduct networks, in operation, jurisdiction and administration of a public service provider.
Conflict Zones: Corresponds to sectors that have water and/or sanitary sewer service provided by the Dirección de Recurso Hídrico; where, due to safety conditions, hazardousness or conflict with other institutions, meter reading via water meters (medidores de agua) is limited.
