en la totalidad del texto - Complete Text of Regulation 39786 Approves the Regulation for Active Management of Ecosystems of Palo Verde National Park and reforms Decree N° 27345 "Establishes for Palo Verde National Park Active Management in its Wetlands and Pasture Areas and Creates Advisory Committee" Verde Complete Text acta: 10EBC6 Nº 39786-MINAE THE PRESIDENT OF THE REPUBLIC AND THE ACTING MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 140 subsections 3) and 18), and 146 of the Political Constitution; articles 25, 27 subsection 1 ), 28 subsection 2) b of the General Law of Public Administration, Nº 6227 of May 2, 1978; article 46 of the Organic Law of the Environment, Nº 7554 of October 4, 1995; articles 49 and 53 of the Biodiversity Law, Nº 7788 of April 30, 1998; article 8, subsections c), d) and f), of the Convention on Biological Diversity, ratified by Law Nº 7416 of June 30, 1994, articles 3 and 4 of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat ("Ramsar Convention"), ratified by Law Nº 7224 of April 9, 1991 and article 11 of the Regulation to the Forestry Law, Executive Decree Nº 25721 -MINAE of October 17, 1996, published in La Gaceta N º 16 of January 23, 1997.
I°- That article 8 of the Convention on Biological Diversity, ratified by Law N° 7416 of June 30, 1994, published in La Gaceta N° 143 of July 28, 1994, establishes that each Contracting Party shall, as far as possible and as appropriate: c) Regulate or manage biological resources important for the conservation of biological diversity, whether within or outside protected areas, to guarantee their conservation and sustainable use; d) Promote the protection of ecosystems and natural habitats and the maintenance of viable populations of species in natural surroundings; f) Rehabilitate and restore degraded ecosystems and promote the recovery of threatened species, inter alia through the development and implementation of plans or other management strategies.
II°- That articles 3 and 4 of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat ("Ramsar Convention"), ratified by Law N° 7224 of April 9, 1991, published in La Gaceta N° 86 of May 8, 1991, establishes that the Contracting Parties shall formulate and implement their management plans so as to promote the conservation of wetlands included in the List of Wetlands of International Importance and promote the conservation of wetlands and waterfowl by establishing nature reserves in wetlands, whether or not they are included in the List of Wetlands of International Importance, and provide adequately for their management and care.
III°- That in accordance with article 46 of the Organic Law of the Environment, Law N° 7554 of October 4, 1995, published in La Gaceta N°215 of November 13, 1995, the State shall exercise sovereignty over biological diversity, as part of its natural heritage. That furthermore, activities aimed at conserving, improving and, to the extent possible, recovering the biological diversity of the national territory are of public interest, for whose execution the parameters defined by the Executive Branch shall be taken into account, as well as the following criteria: a) The protection and conservation of natural ecosystems, species diversity, genetic diversity in the national territory and the monitoring of reproduction zones; b) The management of biological diversity integrated into the planning of any activity related to the elements of the environment.
IV°- That according to articles 49 and 53 of the Biodiversity Law, Law N° 7788 of April 30, 1998, published in La Gaceta N° 101 of May 27, 1998, the maintenance of ecological processes is a duty of the State and citizens. For this purpose, the Ministry of Environment and Energy and other relevant public entities, taking into account the specific legislation in force, shall issue the appropriate technical standards and use mechanisms for their conservation. Furthermore, the restoration, recovery and rehabilitation of ecosystems, species and the environmental services they provide, must be promoted by the Ministry of Environment and Energy and other public entities.
V°- That based on the provisions of article 154 of the General Law of Public Administration, Law N°6227 of May 2, 1978, published in Alcance N°90 to La Gaceta N° 102 of May 30, 1978, in article 39, subsection i), of the Forestry Law, Law N°7575 of February 13, 1996, published in La Gaceta N°72 of April 16, 1996 and in article 11 of the Regulation to the Forestry Law, Executive Decree N° 25721-MINAE of October 17, 1996, published in La Gaceta N° 16 of January 23, 1997; the Ministry of Environment and Energy is empowered to grant public domain use permits in any of the management categories of the wilderness areas protected by the State, this being a unilateral act of the Administration, on a precarious title basis, which may be revoked for reasons of opportunity or convenience, without liability for the Administration, but the revocation shall not be untimely or arbitrary and a reasonable period shall be given in all cases for compliance with the act of revocation. The validity of the use permit shall be subject to the payment of the corresponding fee, as pecuniary consideration made by the permit holder for the special use and enjoyment of a public domain asset and for the differential benefits obtained.
VI°- That according to the provisions of article 161 of Executive Decree N° 33411-H of September 27, 2006, Regulation to the Law on Administrative Contracting, published in La Gaceta N°210 of November 2, 2006, and in articles 2 subsection r) and 11 of Executive Decree N° 25721-MINAE of October 17, 1996, Regulation to the Forestry Law, published in La Gaceta N° 16 of January 23, 1997, the granting of use permits on lands of the State's Natural Heritage must be based on reasons of opportunity or convenience for the general interest and must not imply forest harvesting nor affect ecosystems, wildlife, soils, wetlands and aquifer systems.
VII°- That by Executive Decree N° 11541-A of May 30, 1980, published in La Gaceta N' 112 of June 13, 1980 and ratified by Law N° 6794 of August 25, 1982, Palo Verde National Park was created, located in the province of Guanacaste, with the purpose of protecting one of the last remnants of tropical dry forest in the country, including several particular ecosystems such as forests on limestone deposits, herbaceous lagoons, mixed lowland forests and Palo Verde forests on vertisols. Furthermore, the site protects a system of wetlands that constitute places of particular importance for the conservation of migratory and resident birds.
VIII°- That in recognition of the ecological value of the wetland system protected by Palo Verde National Park, this site was included in the List of Wetlands of International Importance on December 27, 1991, in accordance with the provisions of article 2 of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat ("Ramsar Convention").
IX°- That in the last three decades the ecosystems of Palo Verde National Park have experienced dramatic changes in their structure and composition, due to biotic factors such as the advance of natural succession and colonization by invasive or opportunistic plant species, and to abiotic factors of anthropogenic origin such as the effect of fire and permanent flooding with water from the Arenal Tempisque Irrigation District. All of which is recorded in report N° 39 issued by the Ramsar Advisory Mission for the Management of Palo Verde National Park, carried out between March 24 and April 4, 1998, according to which most of the Park's wetlands have been considerably reduced by removing the cattle that, prior to its declaration as a National Park, contributed to maintaining the ecological characteristics for which the area was included in the List of Wetlands of International Importance. Furthermore, for these same reasons the Park has been included in the Montreux Record since 1993, which groups those wetlands of international importance where urgent attention is necessary to guarantee their conservation.
X°- That by Executive Decree N° 27345-MINAE of August 18, 1998, published in La Gaceta N° 199 of October 14, 1998, it was defined that the active management actions to be carried out within Palo Verde National Park, specifically in the wetlands and in the jaragua pasture (Hyparrhenia rufa) areas mixed with remnants of secondary forest, must be based on: a) the General Management Plan for said national park and its zoning, b) the commitments assumed by the country before the Ramsar Convention, and c) the advice and monitoring provided by the Park Advisory Committee, created ex profeso by the same Executive Decree.
XI°- That the National Strategy for Conservation and Sustainable Use of Biodiversity established within the strategic actions for the country the development of active management experiences with in situ conservation purposes.
XII°- That the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), a deconcentrated body of the Ministry of Environment and Energy, in accordance with its competencies in matters of protected wilderness areas, according to article 22 of the Biodiversity Law N° 7788, has defined as a priority action, through the Agenda for Protected Wilderness Areas Administered by SINAC, the development of capacities for active management, for conservation purposes, within the protected wilderness areas, including the identification of natural resources that require active management and the implementation of pilot experiences.
XIII°- That in accordance with articles 9 and 21 of the Regulation to the Law of Biodiversity, Executive Decree N° 34433-MINAE of March 11, 2008, published in La Gaceta N° 68 of April 8, 2008, the Arenal Tempisque Conservation Area (Área de Conservación Arenal Tempisque, ACAT) is one of the conservation areas that constitute the SINAC and therefore is under its administration.
XIV°- That according to available scientific information, the active management actions carried out to date in the ecosystems of Palo Verde National Park, for ecological rehabilitation purposes, have resulted in the recovery of the water surface in 500 hectares of wetlands and the natural regeneration of at least 100 hectares of tropical dry forest.
XV°- That by virtue of the foregoing and with the aim of standardizing the ecological rehabilitation practices that have been carried out in the ecosystems of Palo Verde National Park, for in situ conservation purposes, it is necessary to regulate the active management actions defined in Executive Decree N° 27345-MINAE of August 18, 1998.
XVI°- That the National Council of Conservation Areas, by Agreement N° 11 of Extraordinary Session N° 09-2009 of September 25, 2009, approved the present Executive Decree.
XVII°- That in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree N° 37045-MPMEIC and its reforms, the present proposal complies with the principles of regulatory improvement according to the positive report DMRRT-AR-INF-072-2016 of June 1, 2016, issued by the Department of Regulatory Analysis of the Directorate of Regulatory Improvement and Technical Regulation of MEIC. Therefore, THEY DECREE:
"Regulation for the Active Management of the Ecosystems of Palo Verde National Park; modify articles 2, 3 and 5 of Executive Decree N° 27345-MINAE of August 18, 1998 and Declare of public interest the active management activities for the conservation and rehabilitation of the ecosystems of Palo Verde National Park."

9"- Que en las últimas tres décadas los ecosistemas del Parque Nacional Palo Verde han experimentado dramáticos cambios en su estructura y en su composición, debido a factores bióticos como el avance de la sucesión natural y la colonización por especies vegetales invasoras u oportunistas, y a factores abióticos de origen antrópico como el efecto del fuego y la inundación permanente con agua procedente del Distrito de Riego Arenal Tempisque. Todo lo cual consta en el informe N° 39 emitido por la Misión Ramsar de Asesoramiento para la Gestión del Parque Nacional Palo Verde, efectuada entre el 24 de marzo y el 4 de abril de 1998, según el cual la mayor parte de los humedales del Parque se han reducido considerablemente al retirar el ganado que antes de su declaratoria como Parque Nacional contribuía a que se mantuvieran las características ecológicas por las cuales el área fue incluida en la Lista de Humedales de Importancia Internacional. Además, por estas mismas razones el Parque ha sido incluido en el Registro de Montreaux desde 1993, el cual agrupa aquellos humedales de importancia internacional donde es necesaria una atención urgente para garantizar su conservación.
