Arenal Tempisque Conservation Area. At nine hours twenty-six minutes on September 17, 2020.

1. 1That by Executive Decree No. 11541-A of May 30, 1980, published in La Gaceta No. 112 of June 13, 1980, and ratified by Law No. 6794 of August 25, 1982, Palo Verde National Park was created, whose current boundary was redefined by Executive Decree 31591-MINAE.
2. 2That in recognition of the ecological value of the wetland system protected by Palo Verde National Park, this site was included on the List of Wetlands of International Importance on December 27, 1991, in accordance with the provisions of Article 2 of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat ("Ramsar Convention").
3. 3That in 1993, at the request of Costa Rica, the Palo Verde Ramsar site was included in the Montreux Record, a record in which it still remains included.
4. 4That by means of Executive Decrees No. 27345-MINAE and 39786-MINAE, the regulation for the execution of active management actions within Palo Verde National Park is established, specifically in the wetlands and in the areas of jaragua grass (Hyparrhenia rufa) mixed with remnants of secondary forest.
5. 5That following the provisions of Article 6) subsection b) of the Regulation for the Active Management of the Ecosystems of Palo Verde National Park, Executive Decree 39786-MINAE, the Administration of Palo Verde National Park conducted the annual technical analysis to determine possible sites within the protected area that required active management through grazing actions, issuing the respective recommendations under reports SINAC-ACAT-DASP-058 and ACAT-DASP-035-2018 once the corresponding technical sheets that are on file in the administrative file were applied.
6. 6That the Advisory Committee of Palo Verde National Park, through agreements No. 07, 08, 09, and 10 of the session of August 7, 2020, approved the recommendation given by the Administration of Palo Verde National Park.

1º-Institutional competence. That in accordance with the provisions of Articles 28 and 28 of the Biodiversity Law number 7788 and numerals 21 and 23 of Executive Decree number 34433-MINAE, called the Regulation to the Biodiversity Law, the Arenal Tempisque Conservation Area, through Palo Verde National Park, is the body responsible for the management and administration of said protected area.

1. 2That it is the function of the Arenal Tempisque Conservation Area to exercise adequate management of the protected wild area Palo Verde National Park, including the management of habitats for the purpose of recovering, restoring, and rehabilitating altered ecosystems, maintaining them according to their characteristics at the time of the declaration and in fulfillment of the objectives that gave rise to the National Park. This in accordance with the provisions of Articles 22, 49, 53, and 58 of the Biodiversity Law No. 7788, and 35, 40, and 46 of the Organic Law of the Environment No. 7554.
2. 2That Executive Decrees 27345-MINAE and 39786-MINAE, which establish the specific rules for the active management of the ecosystems of Palo Verde National Park, are in force; which empower and order this administration, as contemplated in numeral two and three subsection f) of Executive Decree 39786-MINAE, to carry out the necessary in situ management in order to rehabilitate or maintain the ecological integrity of the ecosystems present in the protected area, seeking recovery, rehabilitation, and ecological recovery in the terms defined by Article 3 subsections i), j), and k) of the "Regulation for the Active Management of the Ecosystems of Palo Verde National Park" issued by Article one of Executive Decree 39786-MINAE.
3. 3That grazing constitutes one of the active management tools expressly authorized by the national legal system to be applied in Palo Verde National Park, as dictated by Articles 2 and 3 of Executive Decree 27345-MINAE.
4. 4That following the provisions of the cited article; 6) subsection b) of the Regulation for the Active Management of the Ecosystems of Palo Verde National Park, Executive Decree 39786-MINAE, it is incumbent upon the Regional Directorate of ACAT to issue the administrative resolution approving the need to authorize grazing in new areas.
5. 5That the Administration has verified that the requirements set forth in numeral 6 subsection b) of the Regulation for the Active Management of the Ecosystems of Palo Verde National Park, issued by numeral one of Executive Decree 39786-MINAE, have been met to issue this administrative act.
6. 6That the cited article; 6) subsection g) of the Regulation for the Active Management of the Ecosystems of Palo Verde National Park, Executive Decree 39786-MINAE, dictates the criteria for the granting of use permits for grazing in identified new areas. Therefore,

THE DIRECTORATE OF THE ARENAL TEMPISQUE CONSERVATION AREA In accordance with Article 22 et seq. of the Biodiversity Law No. 7788, Articles 11, 16, and 154 and Executive Decree No. 27345-MINAE of August 18, 1998, Executive Decree 39786-MINAE of April 22, 201[6];

1º-To authorize and communicate the availability of the following new sites for the granting of Use Permits for cattle grazing within Palo Verde National Park for ecosystem restoration purposes:

- Site known as Poza Verde with an effective area of 650 hectares.

- Site known as Varillal with an effective area of 250 hectares.

- Site known as La Bocana 1 with an effective area of 50 hectares - Site known as La Bocana 2 with an effective area of 200 hectares The information on the exact location of the areas is on file and may be consulted by any interested party with the Administrator of Palo Verde National Park at the email address ulises.chavarrí[email protected] or [email protected] 2º-To notify interested parties that they may submit the application for a grazing use permit before the Directorate of the Arenal Tempisque Conservation Area at the offices located in Tilarán, 275 meters south of the Public Force facilities, adjacent to the Fire Station; within a period of one month from the publication of this act; complying with the requirements stipulated in numeral 6 subsection d) of the Regulation for the Active Management of the Ecosystems of Palo Verde National Park, Executive Decree 39786-MINAE.

3º-The applications for the granting of use permits for grazing in identified new areas listed in the first provision of this resolution shall be resolved according to the following criteria to be applied in the order established herein: 1) Priority shall be given to persons domiciled in the zones of influence of the National Park 2) Priority shall be given to persons who do not hold other valid grazing use permits within the Park 3) first in time of submission, first in right of granting.

4º-Publish in the Official Gazette La Gaceta.

Área de Conservación Arenal Tempisque. Al ser las nueve horas veintiséis minutos del 17 de setiembre del 2020.

1. 1Que mediante el Decreto Ejecutivo N° 11541-A del 30 de mayo de 1980, publicado en La Gaceta N° 112 del 13 de junio de 1980 y ratificado mediante Ley N° 6794 del 25 de agosto de 1982, se creó el Parque Nacional Palo Verde cuyo límite actual fueron redefinidos mediante Decreto Ejecutivo 31591-MINAE.
2. 2Que en reconocimiento al valor ecológico del sistema de humedales que protege el Parque Nacional Palo Verde, este sitio fue incluido en la Lista de Humedales de Importancia Internacional el 27 de diciembre de 1991, de conformidad con lo que establece el artículo 2 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas ("Convención de Ramsar").
3. 3Que en el año 1993 a solicitud de Costa Rica se incluyó el sitio Ramsar Palo Verde en el Registro de Montreaux, registro en el que se mantiene aún incluido.
4. 4Que mediante Decretos Ejecutivos N° 27345-MINAE y 39786-MINAE se encuentra establecida la regulación para la ejecución de acciones de manejo activo dentro del Parque Nacional Palo Verde, específicamente en los humedales y en las áreas de pasto jaragua (Hyparrhenia rufa) mezcladas con remanentes de bosque secundario.
5. 5Que siguiendo lo dispuesto en el artículo 6) inciso b) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde Decreto Ejecutivo 39786-MINAE, la Administración del Parque Nacional Palo Verde realizó el análisis técnico anual para determinar posibles sitios dentro del área protegida que requirieran el manejo activo mediante acciones de pastoreo emitiendo las respectivas recomendaciones bajo informes SINAC-ACAT-DASP-058 y ACAT-DASP-035-2018 una vez aplicadas las fichas técnicas correspondientes que constan en el expediente administrativo.
6. 6Que el Comité Asesor del Parque Nacional Palo Verde, mediante acuerdos N° 07, 08, 09 y 10 de la sesión del 07 de agosto del 2020 aprobó la recomendación dada por la Administración del Parque Nacional Palo Verde.

1º-Competencia institucional. Que de conformidad con lo dispuesto en los artículos y 28 28 de la Ley de Biodiversidad número 7788 y los numerales 21 y 23 del Decreto Ejecutivo número 34433-MINAE denominado Reglamento a la Ley de Biodiversidad el Área de Conservación Arenal Tempisque a través del Parque Nacional Palo Verde es la instancia responsable de la gestión y administración de dicha área protegida.

1. 2Que es función del Área de Conservación Arenal Tempisque ejercer la adecuada gestión del Área silvestre protegida Parque Nacional Palo Verde, incluyendo el manejo de los hábitats con el objeto de recuperar, restaurar y rehabilitar los ecosistemas alterados manteniéndolos según sus características al momento de la declaratoria y en cumplimiento de los objetivos que dieron origen al Parque Nacional. Ello de conformidad con lo establecido en los artículos 22, 49, 53 y 58 de la Ley de Biodiversidad N° 7788, 35, 40 y 46 de la Ley Orgánica del Ambiente N° 7554.
2. 2Que se encuentran vigentes los Decretos Ejecutivos 27345-MINAE y 39786-MINAE que establecen las normas específicas para el manejo activo de los ecosistemas del Parque Nacional Palo Verde; las cuales facultan y ordenan a esta administración según se contempla en el numeral segundo y tercero inciso f) del Decreto Ejecutivo 39786-MINAE a realizar la gestión in situ necesaria en aras de rehabilitar o mantener la integridad ecológica de los ecosistemas presentes en el área protegida en busca de la recuperación, rehabilitación y recuperación ecológica en los términos definidos por el artículo 3 incisos i), j) y k) del "Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde" dictado mediante al artículo primero del Decreto Ejecutivo 39786-MINAE.
3. 3Que el pastoreo constituye una de las herramientas de manejo activo

aplicada en el Parque Nacional Palo Verde según lo dictan los artículos 2 y 3 del Decreto Ejecutivo 27345-MINAE.

1. 4Que siguiendo lo dispuesto en el artículo citado; 6) inciso b) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde Decreto Ejecutivo 39786-MINAE, corresponde a la Dirección Regional del ACAT emitir la resolución administrativa que apruebe la necesidad de autorizar pastoreo en áreas nuevas.
2. 5Que la Administración ha verificado que se han cumplido los requisitos previstos en el numeral 6 inciso b) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde dictado por el numeral primero del Decreto Ejecutivo 39786-MINAE para emitir el presente acto administrativo.
3. 6Que el artículo citado; 6) inciso g) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde Decreto Ejecutivo 39786-MINAE dicta los criterios para el otorgamiento de permisos de uso para pastoreo en áreas nuevas identificadas. Por tanto,

LA DIRECCION DEL ÁREA DE CONSERVACIÓN ARENAL TEMPISQUE De conformidad con el artículo 22 y siguientes de la Ley de Biodiversidad N° 7788, artículos 11, 16 y 154 y Decreto Ejecutivo Nº 27345-MINAE del 18 de agosto de 1998, el Decreto Ejecutivo 39786-MINAE del 22 de abril del 201;

1º-Autoriza y comunicar la disponibilidad de los siguientes sitios nuevos para el otorgamiento de Permiso de Uso para pastoreo con ganado vacuno dentro del Parque Nacional Palo Verde con fines de restauración ecosistémica:

- Sitio Conocido como Poza Verde con un área efectiva de 650 hectáreas.

- Sitio conocido como Varillal con un área efectiva de 250 hectáreas.

- Sitio conocido como La Bocana 1 con un área efectiva de 50 hectáreas - Sitio conocido como La Bocana 2 con un área efectiva de 200 hectáreas La información sobre la localización exacta de las áreas consta en Parque Nacional Palo Verde a la dirección electrónica ulises.chavarrí[email protected] o [email protected] 2º-Comunicar a los interesados que podrán presentar la solicitud de permiso de uso para pastoreo ante la Dirección del Área de Conservación Arenal Tempisque en las oficinas sita en Tilarán, de las instalaciones de la Fuerza Pública 275 metros al Sur, contiguo a la Estación de Bomberos; en el plazo de un mes, a partir de la publicación del presente acto; cumpliendo con los requisitos estipulados en el numeral 6 inciso d) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde, Decreto Ejecutivo 39786-MINAE.

3º-Las solicitudes para el otorgamiento de permisos de uso para pastoreo en áreas nuevas identificadas que constan en la primera disposición de la presente resolución, se resolverán de acuerdo a los siguientes criterios que se aplicarán en el orden aquí establecido: 1) Tendrán prioridad las personas con domicilio en las zonas de influencia al Parque Nacional 2) Tendrán prioridad las personas que no cuenten con otros permisos de uso para pastoreo dentro del Parque que se encuentren vigentes 3) primero en tiempo de presentación primero en derecho de otorgamiento.

4º-Publíquese en el Diario Oficial La Gaceta.
