in the entirety of the text - Complete Text of Standard 040 Reform of Land-Use Restrictions in the Surroundings of Arenal Volcano Complete Text of record: 10C4EB NATIONAL COMMISSION FOR RISK PREVENTION AND EMERGENCY RESPONSE MODIFICATION OF THE BINDING RESOLUTION ON RESTRICTIONS FOR LAND USE IN THE SURROUNDINGS OF THE ARENAL VOLCANO (LA GACETA OF JANUARY 11, 2001, PAGES 41-47) Board of Directors of the National Commission for Risk Prevention and Emergency Response. Ordinary session No. 04-03-16, held on Wednesday, March 2, 2016.
Considering that:
I.—Since July 29, 1968, the Arenal Volcano began its last eruptive stage, which lasted for more than 42 years, until October 2010, with frequent explosions, and emissions of gases, block lavas, and pyroclastic flows (flujos piroclásticos).
II.—During this eruptive period, on August 23, 2000, a succession of pyroclastic flows (flujos de piroclástos) occurred, which affected the northern flank, resulting in the death of two people and leaving one more seriously injured, which evidenced the need to establish concrete and strict regulations, both for visitor access, and to guide infrastructure growth with criteria for volcanic risk management.
III.—In 2001, the document LAND-USE RESTRICTIONS IN THE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL) was published in the Official Gazette La Gaceta (La Gaceta No. 8 of January 11, 2001), which was developed as a joint proposal of the Costa Rica Volcanological and Seismological Observatory (OVSICORI), the National Seismological Network of the UCR and ICE (RSN: UCR-ICE), in coordination with the National Emergency Commission (CNE).
IV.—This document, as of that date, became an instrument that regulated land use in the influence area of possible eruptions of the Arenal Volcano, through the mechanism of a Binding Resolution (Resolución Vinculante), as established by the National Emergency Law No. 7914 of September 28, 1999.
V.—The document in question compiled information from research conducted by different specialists, and integrated a management proposal for the use of the different areas, utilizing criteria of volcanic hazard (amenaza volcánica) and historical land uses in the volcanic influence area of Arenal, and which are consistent with potential short-term hazard scenarios.
VI.—In 2003, as part of previously acquired commitments, the visit of an international expert was finalized, which took place between November 12 and 21 of that year, when Dr. Robert Tilling, of the United States Geological Survey (USGS). Dr. Tilling conducted the evaluation of the established zoning (zonificación), through the report titled "Appraisal of the Land-Use Restriction Map and Associated Presidential Decree (2001) for Volcán Arenal, Costa Rica, 2003", submitted in December of that same year.
VII.—In December 2004, the document "Preparation of the Volcanic Hazards Map of Arenal Volcano and the Implementation of Recommendations to the Land-Use Restriction Map on Arenal Volcano" ("Preparación del Mapa de Peligros Volcánicos del Volcán Arenal y la Implementación de las Recomendaciones al Mapa de Restricción del Uso del Suelo en el volcán Arenal") was prepared, which reinforced the need to maintain the zoning (zonificación), but also pointed out, in accordance with what was proposed by Dr. Tilling (2003), among others, that volcanic risk assessments are dynamic documents, so they must be periodically updated and improved in accordance with the dynamics of the volcano's own behavior and the generation of new information.
VIII.—The existing scenarios of volcanic hazards (peligros volcánicos) of Arenal indicate that this volcano has a volcanic hazard (peligro volcánico) rating of 14 according to the method of Yokohama et al. (1994), which is maintained at present, placing it in a very dangerous category.
IX.—In accordance with the research conducted, the following hazards (peligros) were identified in the surroundings of the Arenal Volcano, which have different degrees of probability depending on short- and long-term scenarios.
a. Emission and dispersion of gases.
b. Fall of ballistics (balística) of blocks.
c. Fall of pyroclasts (piroclastos) from:
i. Small or strong strombolian eruptions.
ii. Vulcanian eruptions.
iii. Subplinian/plinian eruptions.
d. Pyroclastic flows (flujos de piroclastos).
e. Opening of new lateral eruptive vents.
f. Lava flows (coladas de lava).
g. Lahars (lahares).
h. Landslides and debris avalanches.
i. Seiches (seiches).
j. Volcanic earthquakes.
k. Large landslides.
X.—This binding resolution (resolución vinculante), in force to date, has successfully achieved a relative change in the growth trends of tourist infrastructure in the environment of the Arenal Volcano, directing the Municipality and other control and permitting entities to take into account the volcanic risk criteria.
XI.—At the end of 2010, the effusive activity of the Arenal Volcano ceased, along with other characteristics typical of an erupting volcano that indicate that this volcano is in a phase of relative calm, in comparison with recent decades.
XII.—However, despite the fact that the Arenal Volcano is in a period of relative calm, there are volcanic hazard maps (mapas de peligro volcánico), in force to date, that indicate the areas of potential affectation by scenarios that may occur in the future (decades and hundreds of years).
XIII.—Based on all of the above, it must be emphasized that this historically active volcano is one of the most dangerous volcanoes in Costa Rica, now at rest, and that it will certainly erupt in the future.
XIV.—That the areas defined in the document LAND-USE RESTRICTIONS IN THE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL) (2001), as R1, R2, R3, and R4, reflect the sectors most directly affectable by the processes indicated in point I. 12, both for short-term and long-term scenarios, that is, for future eruptions.
XV.—Furthermore, also clearly contained within these areas are the sectors directly affected by the 1968 eruption and by other similar ones that could occur in the future.
XVI.—The circle of a 5.5 km radius around the active crater of the Arenal Volcano has presented a series of practical difficulties in its implementation, particularly at the time of granting construction and development permits, due to the generalization of a control measure, without taking into account the different exposure areas that exist within it. This is demonstrated in the document PREPARATION OF THE VOLCANIC HAZARDS MAP OF THE ARENAL VOLCANO AND THE IMPLEMENTATION OF RECOMMENDATIONS TO THE LAND-USE RESTRICTION MAP ON THE ARENAL VOLCANO (PREPARACIÓN DEL MAPA DE PELIGROS VOLCÁNICOS DEL VOLCÁN ARENAL Y LA IMPLEMENTACIÓN DE LAS RECOMENDACIONES AL MAPA DE RESTRICCIÓN DE USO DEL SUELO EN EL VOLCÁN ARENAL) (Soto, G.J., 2004), in point 5.2.2 (page 96), which is why an adaptation of this area to current conditions is urgent.
XVII.—Finally, according to the conclusions of several investigations, despite the fact that the volcano may remain in a period of calm for several years, it is possible that it could reactivate or change its pattern of activity known to date at any time.
Agreement No. 040-03-2016 The Board of Directors acknowledges and approves the modification to the Binding Resolution of the Arenal Volcano (Resolución Vinculante del Volcán Arenal) presented by M.Sc. Lidier Esquivel Valverde, Head of the Risk Research and Analysis Unit:
1.—To update the binding resolution (resolución vinculante) LAND-USE RESTRICTIONS IN THE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL), in force since 2001, because the volcanic dynamics of Arenal have changed substantially since 2010.
2.—To make a proposal in accordance with the knowledge of this volcano to date, and the installed surveillance and monitoring capacity currently.
3.—To take into account as a basis the experience accumulated in this decade and a half of implementation of the restriction, considering the advantages and disadvantages that have existed when putting the indicated restriction into practice.
1.—To maintain the current restriction regarding the following zones:
a. Restriction Zone 1 (R1):
i. Prohibit the construction of tourist activities (lodging, restaurants, spas, trails, camps, canopy, tours, mountaineering, hiking, horseback riding, road construction, complementary facilities for providing tourist services such as warehouses, campsites, etc.) or ii. The establishment of new dwellings within existing farms or their segregations is prohibited, which applies to the entire zone marked for absolute restriction.
iii. The corresponding authorities must take measures so that activities involving concentrations of people are not permitted. This is because said areas have recent historical and prehistoric records of having been affected by pyroclastic flows (flujos piroclásticos) and rock landslides, and that, due to their current use, are in conflict with the level of hazard (amenaza) derived from the occurrence of the mentioned phenomena. Agricultural activities already established in this sector shall be governed by what restriction zone R4 establishes.
b. Restriction Zone 2 (R2):
i. This sector may be used by the Arenal Conservation Area (ACA), allowing the controlled entry of small groups of up to 10 people to the ACA, for a limited time and under strict supervision of ACA officials up to the sector delimited by the 600 m.a.s.l. elevation line, a limit that must be duly marked by ACA officials.
An alarm system must also be in place to order evacuations, duly approved by the CNE. Furthermore, people cannot stay overnight or camp. The only tourist service that can be provided within the zone is that of tourist guide for groups of people, as well as transport to and from the zone. These guides must be duly certified by the ICT.
ii. There must be a duly approved and updated Emergency Plan, trail marking, emergency exits, information about hazards (amenazas) to visitors in several languages (Spanish and English at least). In this sector, no new infrastructure or services for tourists shall be built, unless they are trails, signage, or other open-air facilities.
iii. The extraction of materials by the ACA to cover its own needs is possible, provided it complies with the regulations in force in that field.
c. Restriction Zone 3 (R3):
i. To the west of the road to El Castillo (between the road and the edge of Laguna Arenal and the Arenal River), only the establishment of trails for hiking or horseback riding shall be permitted, as well as fishing in the lake, in accordance with the existing regulations on that matter, or other open-air activities, provided they do not imply the generation of constructions of any type, which must be located outside the delimited restriction area. The establishment of camping facilities or any activity that requires them shall also not be permitted.
ii. Material extraction and agricultural activities shall be governed according to what restriction zone R4 establishes and in accordance with the regulations in force.
d. Restriction Zone 4 (R4):
i. Permitted activities are those of a forestry, agricultural, and established prior to the declaration of the CNE Board of Directors and do not imply concentrations of more than seven (7) persons in sites of high vulnerability. Existing facilities for forestry, agricultural services, and exploitation of materials (provided they have the respective permits), may be repaired.
e. 5.5 km radius around the active crater of the Arenal Volcano.
i. To lift the need to have a vulcanology research study endorsed by one of the research centers for the development that weighs on this sector around the Arenal Volcano (95 km²).
ii. To prohibit the development of institutions vital to the community, such as hospitals, clinics, schools and high schools, power and telephone plants, retirement homes, rest homes, or nursing homes, and others.
iii. To prohibit the development of shopping centers, residential developments, such as condominiums and subdivisions (urbanizaciones).
iv. The exploitation of materials is possible, provided it involves the periodic cleaning of the channel, and complies with all the provisions established by the regulations in force for this type of activity.
v. To maintain in this zone a series of conditions (vi, vii, viii), which must be strictly monitored by the Municipality of San Carlos, because of the probability that in the future, given volcanic risk scenarios, eruptive processes may occur that channel through the main rivers and streams that have their headwaters above 1000 m.a.s.l., on the volcanic cone of Arenal.
vi. Along these channels, what is proposed by the La Fortuna Regulatory Plan (Plan Regulador de la Fortuna) must be extended, which establishes a protection zone (zonificación) of 20 meters on both sides of the channel (section 7.1), regardless of the width of the same. Therefore, houses cannot be built.
vii. Any tourist development that exists or is built as of this date must have a specific emergency plan for the volcanic hazard (amenaza volcánica) of this sector, which must include regular evacuation drills.
viii. It will be mandatory for each of the sites that offer tourist services within this circle to have material in at least the Spanish and English languages, informing about the risk conditions of the area and protection measures in case of an eruption.
ix. Adequate territorial planning and land use within this area shall be under the responsibility of the Municipality of San Carlos, in accordance with what is proposed by the regulations in force on Land-Use Planning (Ordenamiento Territorial) (Forestry Law (Ley Forestal) No. 7575, Urban Planning Law (Ley de Planificación Urbana), No. 4240, Law on the Use, Management, and Conservation of Soils (Ley de Uso, Manejo y Conservación de Suelos), No. 7779, Organic Environmental Law (Ley Orgánica del Ambiente) No. 7554, Water Law (Ley de Aguas) No. 276, and others), considering the different hazards (amenazas) implicit in this territory.
FINAL CONSIDERATIONS i. In the event that there is additional legislation that stipulates a greater restriction than that indicated in this document, it must be adhered to.
ii. This regulation will have effect as long as the Arenal Volcano does not again show symptoms of eruptive reactivation, before which, new restrictive regulations will be issued in accordance with the scenario foreseen or occurring.

Considerando que:
I.-Desde el 29 de julio del año 1968, el volcán Arenal, inició su última etapa eruptiva, la cual perduró por más de 42 años, hasta octubre del 2010, con frecuentes explosiones, y emisiones de gases, lavas en bloques y flujos piroclásticos.
II.-Durante este periodo eruptivo, el 23 de agosto del año 2000, se dio una sucesión de flujos de piroclástos, que afectaron el flanco norte, dando como resultado la muerte de dos personas y dejando gravemente herida a una más, lo que evidenció la necesidad de establecer regulaciones concretas y estrictas, tanto para el acceso a los visitantes, como para orientar un crecimiento de infraestructura con criterios de manejo de la gestión del riesgo volcánico.
III.-En el año 2001 se publicó en el Diario Oficial La Gaceta el documento RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL (La Gaceta Nº 8 del 11 de enero del 2001), el cual fue desarrollado como un propuesta conjunta del Observatorio Vulcanológico y Sismológico de Costa Rica (OVSICORI), la Red Sismológica Nacional de la UCR y el ICE (RSN: UCR-ICE), en coordinación con la Comisión Nacional de Emergencias (CNE).
IV.-Este documento, a partir de esa fecha, se convirtió en un instrumento que reguló el uso de la tierra en el entorno de influencia de posibles erupciones del volcán Arenal, por medio del mecanismo de Resolución Vinculante, según lo que estableció la Ley Nacional de Emergencia N° 7914 del 28 de setiembre de 1999.
V.-El documento en mención recopiló la información de investigaciones hechas por distintos especialistas, e integró una propuesta de manejo del uso de las diferentes áreas, utilizando criterios de amenaza volcánica y usos históricos de la tierra en el entorno de influencia volcánica del Arenal, y que son conformes con escenarios potenciales de amenaza a corto plazo.
VI.-En el año 2003, como parte de los compromisos previamente adquiridos, se concretó la visita de un experto internacional, la cual se dio entre el 12 y 21 de noviembre de ese año, cuando el Dr. Robert Tilling, del United States Geological Survey (USGS). El Dr. Tilling realizó la evaluación de la zonificación establecida, por medio del informe titulado "Appraisal of the Land-Use Restriction Map and Associated Presidential Decree (2001) for Volcán Arenal, Costa Rica, 2003", entregado en diciembre de ese mismo año.
VII.-En diciembre del año 2004, se elaboró el documento "Preparación del Mapa de Peligros Volcánicos del Volcán Arenal y la Implementación de las Recomendaciones al Mapa de Restricción del Uso del Suelo en el volcán Arenal", el cual reforzó la necesidad de mantener la zonificación, pero también apuntó acorde con lo planteado entre otros por el Dr. Tilling (2003), que las valoraciones de riesgo volcánico son documentos dinámicos, por lo que deben ponerse al día y mejorarse periódicamente de acuerdo con la dinámica propia del comportamiento del volcán y la generación de nueva información.
VIII.-Los escenarios que existen de peligros volcánicos del Arenal señalan que este volcán tiene una evaluación de peligro volcánico de 14 según el método de Yokohama et al. (1994), la cual se mantiene en la actualidad, encontrándose en una categoría de muy peligroso.
IX.-De acuerdo con las investigaciones realizadas, se identificaron los siguientes peligros en los alrededores del volcán Arenal, los cuales tienen diferentes grados de probabilidad dependiendo de los escenarios de corto y largo plazo.
a. Salida y dispersión de gases.
b. Caída de balística de bloques.
c. Caída de piroclastos por:
i. Erupciones estrombolianas pequeñas o fuertes.
ii. Erupciones vulcanianas.
iii. Erupciones subplinianas/plinianas.
d. Flujos de piroclastos.
e. Apertura de nuevas bocas eruptivas laterales.
f. Coladas de lava.
g. Lahares.
h. Deslizamientos y avalanchas de detritos.
i. Seiches.
j. Sismos volcánicos.
k. Grandes deslizamientos.
X.-Esta resolución vinculante vigente hasta la fecha, ha logrado con buen suceso un cambio relativo en las tendencias del crecimiento de infraestructura turística en el entorno del Volcán Arenal, encaminando a la Municipalidad y otros entes de control y permiso, a tomar en cuenta los criterios de riesgo volcánico.
XI.-A finales del año 2010, la actividad efusiva del volcán Arenal ceso, junto con otras características propias de un volcán en erupción que indican que este volcán se encuentre en una fase de relativa calma, en comparación con las últimas décadas.
XII.-No obstante, a pesar de que el volcán Arenal se encuentra en un periodo de calma relativa, existen mapas de peligro volcánico, vigentes a la fecha, que señalan las áreas de potencial afectación por escenarios que pueden presentarse en un futuro (décadas y cientos de años).
XIII.-Con base en todo lo anterior, se debe recalcar que este volcán históricamente activo, es uno de los volcanes más peligrosos de Costa Rica, ahora en reposo, y que con seguridad hará erupción en un futuro.
XIV.-Que las áreas definidas en el documento RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL (2001), como R1, R2, R3 Y R4, reflejan los sectores más afectables de manera directa, por los procesos señalados en el punto I. 12, tanto para los escenarios de corto plazo, como de largo plazo, esto es, para futuras erupciones.
XV.-Además, también están contenidas en estas áreas, claramente los sectores de afectación directos por la erupción del año 1968 y por otras similares que podrían ocurrir en el futuro.
XVI.-El círculo de 5,5 km de radio alrededor del cráter activo del Volcán Arenal ha planteado una serie de dificultades prácticas en su implementación, particularmente en el momento de otorgar permisos de construcción y desarrollo, debido a la generalización de una medida de control, sin tomar en cuenta diferentes áreas de exposición que existen dentro de él. Esto se demuestra en el documento PREPARACIÓN DEL MAPA DE PELIGROS VOLCÁNICOS DEL VOLCÁN ARENAL Y LA IMPLEMENTACIÓN DE LAS RECOMENDACIONES AL MAPA DE RESTRICCIÓN DE USO DEL SUELO EN EL VOLCÁN ARENAL (Soto, G.J., 2004), en el punto 5.2.2 (página 96), por lo que urge una adaptación de esta área a las condiciones actuales.
XVII.-Finalmente, de acuerdo con las conclusiones de varias investigaciones, a pesar de que el volcán pueda permanecer en un periodo de calma por varios años, cabe la posibilidad de que se reactive o bien cambie su patrón de actividad conocida a la fecha en cualquier momento.
Acuerdo N° 040-03-2016 La Junta Directiva da por conocida y aprueba la modificación a la Resolución Vinculante del Volcán Arenal presentada por el M.Sc. Lidier Esquivel Valverde, Jefe de la Unidad de Investigación y Análisis del Riesgo:
1º-Actualizar la resolución vinculante RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL, vigente desde el año 2001, en razón que la dinámica volcánica del Arenal ha cambiado sustancialmente a partir del año 2010.
2º-Hacer una propuesta acorde con el conocimiento de este volcán a la fecha, la capacidad de vigilancia y seguimiento instalada actualmente.
3º-Tomar en cuenta como base la experiencia acumulada en esta década y media de implementación de la restricción, considerando las ventajas y desventajas que han existido a la hora de llevar a la práctica la restricción señalada.
1º-Mantener la restricción actual en lo referente a las siguientes zonas:
a. Zona de restricción 1 (R1):
i. Prohibir la construcción de actividades turísticas (alojamientos, restaurantes, balnearios, senderos, campamentos, canopy, tours, montañismo, senderismo, cabalgatas, construcción de caminos, instalaciones complementarias para prestar servicios turísticos como bodegas, sitios para acampar, etc.) o bien ampliaciones de las ya existentes.
ii. Se prohíbe el establecimiento de nuevas viviendas dentro de fincas existentes o en sus segregaciones, que aplica para toda la zona marcada de restricción absoluta.
iii. Las autoridades correspondientes deben tomar medidas para que, no se permitan actividades que impliquen concentraciones de personas. Esto debido a que dichas áreas tienen antecedentes históricos y prehistóricos recientes, de haber sido afectadas por flujos piroclásticos y deslizamientos de rocas, y que por su uso actual están en conflicto con el nivel de amenaza que se desprende de la ocurrencia de los fenómenos mencionados. Las actividades agropecuarias ya establecidas en este sector se regirán por lo que establece la zona de restricción R4.
b. Zona de restricción 2 (R2):
i. Este sector podrá ser utilizado por el Área de Conservación de Arenal (ACA), permitiendo el ingreso controlado de pequeños grupos de hasta 10 personas al ACA, por tiempo limitado y bajo estricta supervisión de los funcionarios del ACA hasta el sector delimitado por la cota de 600 m.s.n.m., límite que deberá ser debidamente señalado por funcionarios de la ACA.
También se debe poseer un sistema de alarma para ordenar evacuaciones debidamente aprobados por la CNE. Además, las personas no pueden pernoctar o acampar. El único servicio turístico que puede darse dentro de la zona es el de guía turístico de grupos de personas, así como transporte hacia y fuera de la zona. Estos guías deben estar debidamente certificados por el ICT.
ii. Se deberá contar con un Plan de Emergencia debidamente aprobado y actualizado, demarcación de senderos, salidas de emergencia, información sobre la amenazas a los visitantes en varios idiomas (español e inglés al menos). En este sector no se deberá construir nueva infraestructura o servicios a los turistas, a menos que sean senderos, rotulación u otras facilidades al aire libre.
iii. El aprovechamiento de materiales por parte de ACA para cubrir sus propias necesidades, es posible, siempre y cuando cumpla con la normativa vigente en ese campo.
c. Zona de restricción 3 (R3):
i. Al oeste de la carretera a El Castillo (entre la carretera y borde de la Laguna Arenal y el Río Arenal), se permitirá exclusivamente el establecimiento de senderos para la práctica de caminatas o cabalgatas, así como la pesca en la laguna, de conformidad con las regulaciones existentes en esa materia, o bien otras actividades al aire libre, siempre y cuando no impliquen la generación de construcciones de ningún tipo, las cuales deben estar ubicadas fuera del área de restricción delimitada. Tampoco se permitirá el establecimiento de facilidades para acampar o cualquier actividad que requiera de ello.
ii. Actividades de extracción de materiales y agropecuarias, se regirán de acuerdo con lo que establece la zona de restricción R4 y concordante con la normativa vigente.
d. Zona de restricción 4 (R4):
i. Son actividades permitidas las de índole forestal, agropecuaria, y establecidos con anterioridad a la declaratoria de la Junta Directiva de la CNE y no impliquen concentración superior a las siete (7) personas en sitios de alta vulnerabilidad. Las instalaciones para servicios forestales, agropecuarios y explotación de materiales existentes (siempre que cuenten con los permisos respectivos), podrán ser reparadas.
e. Radio de 5,5 km alrededor del cráter activo del volcán Arenal.
i. Levantar la necesidad de contar con un estudio de investigación de vulcanología avalado por alguno de los centros de investigación, para el desarrollo que pesa sobre este sector alrededor del volcán Arenal (95 km²).
ii. Prohibir el desarrollo de instituciones vitales para la comunidad, como hospitales, clínicas, escuelas y colegios, centrales eléctricas y telefónicas, casas de retiro, casas de descanso u hogares ancianos y otras.
iii. Prohibir el desarrollo de centros comerciales, desarrollos residenciales, tales como condominios y urbanizaciones iv. Es posible la explotación de materiales, siempre y cuando impliquen la limpieza periódica del cauce, y cumplan con todas las disposiciones que establezca la normativa vigente para este tipo de actividad.
v. Mantener en esta zona una serie de condicionantes (vi, vii, viii), que deben ser vigilados estrictamente por la Municipalidad de San Carlos, en razón de la probabilidad de que en el futuro, ante escenarios de riesgo volcánico, puedan presentarse procesos eruptivos que se encaucen por los principales ríos y quebradas que tienen sus nacientes por encima de los 1000 m.s.n.m., en el cono volcánico del Arenal.
vi. A lo largo de estos cauces, deberá ampliarse lo propuesto por el Plan Regulador de la Fortuna, que establece una zonificación de protección de 20 metros a ambos lados del cauce (apartado 7.1), independientemente del ancho del mismo. Por ello no se puede construir casas.
vii. Todo desarrollo turístico que exista o se construya a partir de esta fecha, deberá contar con un plan de emergencia particular para la amenaza volcánica de este sector, el cual debe contemplar regulares ejercicios de evacuación.
viii. Será obligatorio para cada uno de los sitios que ofrecen servicios turísticos dentro de éste círculo, contar con material al menos en los idiomas español e inglés, donde se informe sobre las condiciones de riesgo de la zona y medidas de protección en caso de erupción.
ix. La planificación territorial adecuada y el uso de la tierra dentro de esta área deberá estar bajo la responsabilidad de la Municipalidad de San Carlos, acorde con lo que plantea la normativa vigente en materia de Ordenamiento Territorial (Ley Forestal N° 7575, Ley de Planificación Urbana, N° 4240, Ley de Uso, Manejo y Conservación de Suelos, N° 7779, Ley Orgánica del Ambiente N° 7554, Ley de Aguas N° 276 y otras), considerando las diferentes amenazas implícitas en este territorio.
CONSIDERACIONES FINALES i. En caso de que exista legislación adicional que estipule una restricción mayor a la indicada en este documento, deberán apegarse a ella.
ii. Esta normativa tendrá efecto en tanto el Volcán Arenal no vuelva a mostrar síntomas de reactivación eruptiva, ante lo cual, se emitirán nuevas normativas restrictivas acordes con el escenario previsto o en suceso.
