In accordance with the powers granted to them by Articles 50, 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution; Articles 25, 27.1, 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 7554 of October 4, 1995, Organic Law of the Environment; Law No. 7152 of June 5, 1990, Organic Law of the Ministry of Environment, Energy and Telecommunications; Law No. 449 of April 8, 1949, Decree-Law Creating the Costa Rican Institute of Electricity; Executive Decree No. 34582-MP-PLAN of June 4, 2008, Organic Regulation of the Executive Branch; National Planning Law, Law No. 5525 of May 2, 1974; and Executive Decree No. 35991-MINAET of January 19, 2010, Regulation for the Organization of the Energy Subsector.
1st- That energy is a fundamental good for the economic and social development of any country. Having it available in the required quantities, in a timely manner, and at the lowest possible price, is decisive for guaranteeing sustainable development.
2nd- That by mandate of Article 50 of the Political Constitution, the State must guarantee and preserve the right of individuals to a healthy and ecologically balanced environment, in protection of the right to human health, derived from the fundamental right to life, whereby the primary objective of the use and protection of the environment is to obtain a development and evolution favorable to human beings in harmony with it, in which environmental quality and economic means prove to be one of the fundamental parameters for the quality of life of individuals.
3rd- That the Organic Law of the Environment, Law No. 7554, establishes that energy resources constitute essential factors for the country's sustainable development, over which the State shall maintain a preponderant role, being able to dictate general and particular measures, based on the provisions of the National Development Plan 2010-2014. In this sense, energy is a basic and strategic input for the subsistence and socioeconomic development of the country, making it indispensable to ensure timely and efficient supply, where the supply of electric energy plays an important role in attracting investments and generating employment, elements necessary for the State to fulfill the constitutional guarantee of organizing and stimulating production and the most adequate distribution of wealth in the country.
4th- That through resolution No. A/RES/65/151 of February 16, 2011, issued by the General Assembly of the United Nations declaring 2012 as the "International Year of Sustainable Energy for All", it recognizes that access to modern and affordable energy services in developing countries is essential for achieving the objectives of internationally agreed development, including the Millennium Development Goals, and sustainable development, which would help reduce poverty and improve the conditions and standard of living of the majority of the world's population. The foregoing, given that around one billion five hundred million people lack electricity and millions of poor people cannot afford these modern energy services, even if they are available.
5th- That in the cited resolution, the United Nations highlights the importance of investing in access to less polluting energy technology options, and a future with climate change adaptation capacity for all, as well as the need to improve access to resources and energy services for sustainable development that are reliable, reasonably priced, economically viable, socially acceptable, and environmentally sound, and taking into consideration the diversity of situations, national policies, and the specific needs of countries, in particular developing countries.
6th-That in the Organic Law of the Ministry of Environment, Energy and Telecommunications, Law No. 7152 of June 5, 1990, it is stipulated that said ministerial portfolio is the governing body of the Environment and Energy Sector, and pursuant to its second article, it has broad competencies to formulate and execute policies for the development of energy resources, as well as to promote and administer legislation on the conservation and rational use of energy.
7th- That the National Planning Law, Law No. 5525, established the National Planning System and based on this, the Organic Regulation of the Executive Branch integrates and classifies the State institutions into twelve activity sectors and establishes the Sectoral Councils directed by the Governing Ministers of the respective sector and composed of the heads of the decentralized institutions that form part of it, among which is the Environment, Energy and Telecommunications Sector.
8th- That as provided in Articles 5 and 9 of Executive Decree No. 34582-MP-PLAN of June 04, 2008, Organic Regulation of the Executive Branch, the Minister of Environment, Energy and Telecommunications is the Governing Authority of Environment, Energy and Telecommunications, establishing that "all bodies attached to each ministry, whether deconcentrated or not, shall be subject to the strategies and sectoral policies under the responsibility of the respective Governing Minister, who shall order their activity in accordance with the powers granted to him by the legal provisions that create those attachments." 9th- That in Article 24 of Executive Decree No. 34582-MP-PLAN cited, it is established that the Environment, Energy and Telecommunications Sector shall be composed of the following centralized and decentralized institutions: Ministry of Environment, Energy and Telecommunications (MINAET), National Commission of Emergencies (CNE), Costa Rican Institute of Electricity (ICE), Costa Rican Oil Refinery S.A. (RECOPE), Costa Rican Radiographic S.A. (RACSA), National Power and Light Company S.A. (CNFL), Costa Rican Institute of Aqueducts and Sewers (ICAA), Public Services Company of Heredia S.A. (ESPH), and Administrative Board of the Municipal Electrical Service of Cartago (JASEC).
10th-That the Regulation for the Organization of the Energy Subsector, Executive Decree No. 35991-MINAET, regulates the composition and establishes the tasks and functions of the Subsector, with the aim of guaranteeing an integrated and coordinated long-term sectoral planning; being that it is composed of the Ministry of Environment, Energy and Telecommunications, the Regulatory Authority of Public Services, the Costa Rican Institute of Electricity, the National Power and Light Company, the Public Services Company of Heredia S.A., and the Administrative Board of the Municipal Electrical Service of Cartago.
11th-That the National Development Plan 2010-2014, in the strategic axes of Environment and Territorial Planning, establishes within its strategic objectives "Renewable Energies", postulating the need to increase the participation of renewable energies in the energy matrix, to ensure sustainability and competitiveness, for addressing the country's present and future electricity needs.
12th-That in the VI National Energy Plan, a pricing policy and strategy of the Electrical Subsector is established, aimed at seeking efficient economic development, encouraging investment and generating employment through the satisfaction of the requirements of the electricity demand under conditions of efficient costs, competitive prices, high quality, reliability, and sustainability of the service.
13th-That the Minister of Environment, Energy and Telecommunications, as Governing Authority of the Sector, may issue policies directed to the members of the Energy Subsector to promote new and renewable sources of electric generation and to encourage that the public service be provided efficiently and at the lowest possible cost for the country, in accordance with the provisions of the VI National Energy Plan and the National Development Plan 2010-2014.
14th-That currently the country is facing a fiscal deficit crisis, which demands the commitment of all public entities that make up the State to carry out measures aimed at reducing their operating costs, and at providing public services efficiently, so that citizens, the commercial and productive sector of the country have access to public services at the lowest possible cost.
15th- That since 2007 there has been a sustained increase in electricity rates in Costa Rica, a situation that negatively affects the country's competitiveness as an investment destination, as well as citizens, who have had to bear higher prices for the electricity service.
