• a)Special authorized agent (Apoderado especial): A natural or legal person authorized by the beneficiary, through a legal document, to carry out on their behalf the application, processing, and withdrawal of the fuel purchase order at a competitive international price.
• b)Victualling (Avituallamiento): Action and effect of providing oneself with provisions and other necessary supplies to carry out the fishing operation (faena de pesca).
• c)Competent authority: The Regulatory Authority of Public Services (Autoridad Reguladora de los Servicios Públicos, ARESEP), the General Directorate of Transportation and Fuel Commercialization of the Ministry of Environment, Energy, and Telecommunications (MINAET), FISCAL POLICE, Costa Rican Petroleum Refinery (RECOPE), Costa Rican Tourism Institute (ICT), National Coast Guard Service, Delegates of the Public Force (Fuerza Pública), Port Authorities of the General Directorate of Maritime Transportation of the Ministry of Public Works and Transportation, SCAC, Directorates, Regional Offices and Sub-Regional Offices of INCOPESCA.
• d)Base of operations (Base de operación): The beneficiary's preferred location for carrying out the procedures to obtain fuel at a competitive price.
• e)Beneficiary (Beneficiario): A natural or legal person with a valid commercial fishing license, who requests, personally or through duly authorized third parties, fuel at a competitive price, as established in this Regulation.
• f)Catch (Captura): Amount of hydrobiological resources landed in their entirety within the national territory.
• g)Taxed fuel (Combustible gravado): Refers to regular gasoline and diesel.
• h)Fuel at a competitive international price (Combustible a precio competitivo a nivel internacional): The gasoline, regular and diesel fuel used in vessels with a valid fishing license, for the execution of tourist or non-sport commercial fishing activities.
• i)Fuel Committee (Comité de Combustible): Working group created to implement the control and administration system for fuel at a competitive price, as well as for the supervision and stipulation of necessary changes to the fuel regulation, and to draft the manuals and instructions for its correct application.
• j)Reconciliation (Conciliación): Comparing balances of liters of fuel authorized at a competitive price by INCOPESCA through purchase orders, with those liters sold by RECOPE for the same period.
• k)Agreements (Convenios): Documents which record the different clauses expressing the conditions that the beneficiaries, the Fishing Organizations (Organizaciones Pesqueras), the special authorized agents (apoderados especiales), and INCOPESCA must comply with, regarding the fuel granted at a competitive price.

• l)Days of absence (Días de ausencia): Period of time dedicated to the fishing trip from the departure of the vessel from any port, until its arrival at the same or another port after completing its fishing trip.
• m)Conversion factor (Factor de conversión): Corresponds to the value required to convert the horsepower (Hp) of the vessel's engines to kilowatts (Kw). Which is equal to 0.7457.
• n)Multiplier factor (Factor de multiplicación): The established numerical value by which the defined power range must be multiplied.
• o)National fishing fleet (Flota pesquera nacional): The set of national vessels registered in the Public Property Registry (Registro Público de la Propiedad) and with a valid fishing license.
• p)Gulf of Nicoya (Golfo de Nicoya): For the purposes of this Regulation, it is defined as:

Internal Zone: Area comprised between the imaginary straight line extending from the westernmost point of the city of Puntarenas, to the easternmost point of Punta Gigante on the Nicoya Peninsula (Península de Nicoya) and from this line, inward waters bordering the coast on both sides of the gulf, up to the imaginary straight line extending between Puerto Níspero and Puerto Moreno at the mouth of the Tempisque River.

External Zone: Area comprised between the imaginary straight line extending from the westernmost point of the city of Puntarenas, to the easternmost point of Punta Gigante on the Nicoya Peninsula (Península de Nicoya) and from this line, outward waters bordering the coast on both sides of the gulf, up to the imaginary straight line extending between Cabo Blanco and Punta Herradura.

• q)INCOPESCA: Costa Rican Institute of Fisheries and Aquaculture.
• r)Fishing Organization (Organización Pesquera): Those groups of fishers legally organized for scientific purposes, for the promotion of fishing activity, for environmental protection, for charitable, recreational purposes, and any other lawful purposes whose sole and exclusive objective is not profit or gain. It also includes, in addition to the specific Associations determined by the Law of Associations, trade unions, mutual aid associations, provident and employer associations, and cooperative associations with limited liability. Which possess legal status and identification. This concept excludes the commercial companies determined by the Commercial Code.
• s)Fishing master or captain (Patrón de pesca o capitán): Person on board the vessel responsible for directing the fishing operations (faenas de pesca) and navigation.
• t)Artisanal fishing (Pesca artesanal): Fishing activity carried out in an artisanal manner by natural persons or legal entities when they are associations, cooperatives, or others of a similar nature, using a vessel, in inland waters or in the coastal zone, and with an autonomy to operate in accordance with current legislation.
• u)Commercial fishing (Pesca comercial): Commercial fishing is carried out to obtain economic benefits and is classified as:

u.1. Small-scale: Fishing carried out personally by natural persons, without the use of a vessel, in inland waters or in the coastal zone, or that practiced on board a vessel with an autonomy to operate up to a maximum of three nautical miles of the Costa Rican territorial sea.

u.2. Medium-scale: Fishing carried out by natural or legal persons, on board a vessel with autonomy to operate up to a maximum of forty miles.

u.3. Advanced: Fishing carried out, by mechanical means, by natural or legal persons, on board a vessel with autonomy to operate exceeding forty nautical miles, oriented towards the catch of pelagic species with longline and other species of commercial importance.

u.4. Semi-industrial: Fishing carried out by natural or legal persons, on board vessels oriented towards the extraction of shrimp with a trawl net, sardine and tuna with a seine net.

u.5. Industrial: Fishing and industrialization carried out by natural or legal persons, with vessels capable of carrying out fishing, freezing, packing, and industrialization of their catches on board.

u.6. Tourist: Fishing activity carried out by national or foreign natural persons, with the aim of catching, with a personal fishing tackle appropriate for the purpose, aquatic fishery resources in inland, jurisdictional waters or in the Exclusive Economic Zone, for commercial purposes and exclusively tourist purposes, carried out permanently.

• v)Special power of attorney (Poder especial): Notarized document, by which the beneficiary authorizes a natural or legal person to carry out on their behalf the application, processing, and withdrawal of the fuel purchase order at a competitive price.
• w)Port (Puerto): Place of departure or arrival of fishing vessels within the national sphere.
• x)RECOPE: Costa Rican Petroleum Refinery S.A.
• y)Signature registry (Registro de firmas): Suitable document where the signatures of the beneficiary, natural or legal person, and the special authorized agents (apoderados especiales) are recorded in accordance with the special powers of attorney granted.
• z)Fuel Control and Administration Section (Sección de Control y Administración de Combustible) (SCAC): Dependency of INCOPESCA in charge of the Administration, Supervision, and Control of the efficient use of recommended fuel at a competitive price.

Powers, obligations and responsibilities of the Fuel Control and Administration Section (SCAC)

• a)Authorize purchase orders for fuel at a competitive price with the international price and the authorizations for consolidated fuel orders.
• b)Execute the agreements issued by the Board of Directors (Junta Directiva) of INCOPESCA on this matter, any other established legal provision, or the regulations derived from the Agreements (Convenios) signed for these effects.

• c)Keep an additional file of the originals of the fuel contract.
• d)Keep an additional file of the original signature registries of the beneficiaries, as well as a file of the authorizations for consolidation of fuel purchase orders at a competitive price by authorized client for RECOPE.

• e)Keep a manual physical file (expediente) for each beneficiary vessel, in which all documents or requirements established in this Regulation shall be recorded according to the instruction manual.
• f)Conduct reconciliations (conciliaciones) quarterly between the purchase orders issued by INCOPESCA and the orders contained in the authorizations for the consolidation of fuel purchase orders. To support these internal reconciliations, reconciliations shall be carried out between the authorizations for the consolidation of purchase orders issued by INCOPESCA and those made effective at RECOPE distribution plants nationwide, through a commission formed by the head of the Fuel Control and Administration Section (Sección de Control y Administración del Combustible) or their representative, the head of IT or their representative, and one of the heads of the Regional Offices or Directorates as a representative of this party.
• g)Conduct annual reconciliations (conciliaciones) between the quantity of liters authorized by INCOPESCA and those effectively delivered to fishers through organizations, service stations, and other duly authorized storage and distribution centers.
• h)Receive and resolve in the first instance, claims regarding the correct application of this Regulation and other provisions established for the rational enjoyment of the benefits created by Law, with appeal to the General Technical Directorate (Dirección General Técnica) and in the last instance before the Board of Directors (Junta Directiva) of INCOPESCA.
• i)Carry out, by reason of their office, at the places and times they deem appropriate, the necessary inspections and studies to all those subjects who enjoy the benefit of purchasing fuel at a competitive price, to verify the normative provisions of this Regulation and thus guarantee the correct and efficient use of this benefit.
• j)Annul purchase orders for fuel at a competitive price or authorizations for the consolidation of fuel purchase orders at a competitive price when applicable, an action for which their head or substitute shall be responsible.

• k)Those conferred upon it by the Board of Directors (Junta Directiva) of INCOPESCA through an express agreement.

Fuel control and administration

• a)Evaluate and monitor fuel control and administration actions periodically.
• b)Draft and recommend to the Board of Directors (Junta Directiva) modifications to the regulation and to the procedures that may be required over time.
• c)Draft and recommend to the Board of Directors (Junta Directiva) the procedure manuals for the control and administration of fuel at a competitive price and their modifications.
• d)Standardize forms or any other document related to fuel at a competitive price.

Powers, obligations, and responsibilities of the beneficiaries and the Fishing Organizations (Organizaciones Pesqueras) for carrying out the fuel at a competitive price procedure

In addition, they must register their identity card signature according to the procedure established by INCOPESCA.

Natural Persons:

• a)Present the original of the identity card or residence card free of conditions and in force, and provide a photocopy.

Legal Persons:

• a)Provide a Certification of Legal Status (Personería Jurídica) in force, issued no more than one month prior, containing the following information:

1. Details of the Legal Representative 2. Company name (Razón social) 3. Legal identification number (Número de cédula jurídica) 4. Division of shares 5. Corporate life (Plazo Social) 6. Corporate purpose (Objeto Social) b) Provide the original and a photocopy of the current Legal Entity Identification Card (Cédula de Persona Jurídica).

• c)Present the original of the identity card or residence card free of conditions and in force of the Legal Representative, and provide a photocopy.

In addition, their Legal Representative must register their identity card signature according to the procedure established by INCOPESCA.

In those cases where the Association does not require a resolution from MINAET because it involves situations that do not require the use of fuel storage tanks, the agreement (convenio) shall have a validity period of three years, starting from the moment it is duly signed by the parties.

• a)Provide a Certification of Legal Status (Personería Jurídica) in force, issued no more than one month prior, containing the following information:

1. Details of the Legal Representative 2. Company Name (Razón Social) 3. Legal Identification Number (Número de Cédula Jurídica) 4. Corporate Life (Plazo Social) 5. Corporate Purpose (Objeto Social) b) Present the original of the identity card or residence card free of conditions and in force of the legal representative, and provide a photocopy.

• c)Present the original and a photocopy of the Administrative Resolution granted by MINAET for the operation of their own fuel tanks or the Service Stations where the fuels will be stored.
• d)Present the original and a photocopy of the contract signed with the Service Stations.

In the case of fishing organizations (organizaciones pesqueras) that do not use tanks for the storage of diesel type fuels, because they make the purchase directly from RECOPE and the acquired fuel is deposited directly into the fishing boats using authorized tanker trucks, the requirements noted under subsections c) and d) of this article shall not be mandatory. In their place, the presentation of a notarized sworn statement (declaración jurada protocolizada) by the Association will be necessary, where it renders its declaration that it adheres to this exception. This declaration must be presented at the time of signing or renewing the agreement (convenio) with INCOPESCA.

• a)Due to the expiration of the term, without a legal request for an extension, b) The impossibility of realizing the purpose, or c) The express renunciation or abandonment made by the interested parties.
• d)Violation of regulatory or contractual regulations, duly verified.

For one month when:

• a)They deny access to information concerning the fuel matter; b) They prevent the inspection or boarding of their vessels, or c) They prevent the inspection of the engines or their vessels.

For two months when:

• a)They incur in falsification of the documentation provided to process the fuel at a competitive price, in fuel invoices, product purchase invoices, balance control card, among others.
• b)They fail to comply, without justified cause, with the general technical conditions indicated by INCOPESCA on this matter.
• c)They request fuel for days on which they did not execute fishing operations (faenas de pesca).
• d)They use the fuel at a competitive price during closed seasons (veda) established by INCOPESCA, or in unauthorized fishing zones, or use illegal fishing gear (artes de pesca).

For three months when:

• a)They use the fuel at a competitive price in a vessel or engine different from that authorized in the fishing license.
• b)They change the destination of the fuel at a competitive price for activities different from the type of fishing authorized by INCOPESCA.
• c)Anyone who repeatedly fails to comply with behaviors typified in the previous provisions.

For one month when:

• a)They deny access to information concerning the fuel at a competitive price matter.
• b)They deny the inspection or review of their own fuel storage tanks or those leased to service stations.
• c)Their own fuel storage tanks or those leased to service stations are not properly gauged (cubicados) or calibrated.
• d)The dispensing machines (including the register printers) of their own fuel storage tanks or those leased to service stations are not in proper working order.

For two months when:

• a)They incur in falsification of the documentation provided to process the fuel at a competitive price, in fuel invoices, product purchase invoice, balance control card, among others.
• b)They fail to comply, without justified cause, with the general technical conditions indicated by INCOPESCA on this matter.

For three months when:

• a)They permit or facilitate the fuel at a competitive price in a vessel or engine different from that authorized in the fishing license, or to carry out activities different from the authorized type of fishing.
• b)They request fuel for days on which the permit holder did not execute fishing operations (faenas de pesca).
• c)They incur in irregularities or anomalies, such as lack of internal controls, control over fuel balances in their own tanks or at service stations, signature registry, among others.
• d)They fail to comply with the guidelines issued by INCOPESCA.
• e)Anyone who repeatedly fails to comply with behaviors typified in the previous provisions.

The beneficiaries and the Fishing Organizations (Organizaciones Pesqueras) shall be jointly and severally liable to reimburse in favor of INCOPESCA, the amount of fuel at a competitive price enjoyed by the beneficiary, in which case a certification shall be made of the amount of fuel enjoyed and the amount in colones that it represents.

Said certification shall be brought to the knowledge of the beneficiaries and the Fishing Organizations (Organizaciones Pesqueras), so that within the term of thirty calendar days, they deposit into the INCOPESCA Account the certified sum that will be indicated to them. Once the previous term has elapsed, INCOPESCA shall proceed to collect through judicial channels.

Interested parties shall be granted the guarantee of due process.

Said resolutions shall be communicated to the General Directorate of Transportation and Fuel Commercialization of the Ministry of Environment, Energy, and Telecommunications (MINAET), RECOPE's Commercial Relations Department for the corresponding actions.

When the interested party again requires the total amount of the fuel not requested, as indicated in the previous paragraph, for said amount to be authorized again, it will suffice for them to indicate it in the corresponding fuel application.

In those cases where the beneficiary does not appear registered or is in arrears before the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social), the use and enjoyment of the fuel at a competitive price benefit shall not be authorized, unless they present some document (certification, employer order, certificate) issued by the CCSS indicating that they are registered, active, and up to date.

Procedure for fuel for the National Non-Sport Commercial Fishing Fleet

• a)Fuel request (Annex).
• b)Confronted copy(s) or photocopy(s) of the original Product Sales Invoice(s) issued by the permit holder, duly authorized by the competent entity, for those cases in which there is no fishery product unloading inspection (FIAD).

• c)Confronted copy or photocopy of the original Fuel Purchase Invoice(s) issued by RECOPE or by duly authorized Service Stations (Annex).
• d)Confronted copy(s) or photocopy(s) of the original national sailing permit(s) (zarpe(s) nacional(es)) for vessels belonging to the medium-scale, advanced, and semi-industrial fleet.
• e)Sworn Declaration of the fishing trip for vessels belonging to the small-scale artisanal fleet (Annex).
• f)Photocopy of the Balance Control Slip (Boleta de Control de Saldos) (Annex).

In cases where the first procedure for the authorization of fuel at a competitive price is to be carried out for a beneficiary, whether belonging to any of the Fleets established in this Regulation, the documentation requested under subsection F of this article shall be omitted.

• g)Any other document that the Head of the Fuel Control and Administration Section (Sección de Control y Administración de Combustible) or the Heads of the Regional or Sub-Regional Directorates or Offices of INCOPESCA, consider strictly opportune to better resolve any special or occasional situation, in accordance with what the Law contemplates.

Before issuing a new Purchase Order, INCOPESCA officials must verify that the previous Purchase Order has been made effective at RECOPE, whereas in the case of vessels belonging to the Small-Scale Artisanal Fleet, it will be allowed that the previous Purchase Order has not necessarily been made effective, but under no circumstances two consecutive Purchase Orders.

Authorization and allocation of fuel at a competitive price

• a)Type of Fleet b) Previous fishing days c) Engine power d) Type of fuel e) Fuel purchase invoice (cash or credit) f) Fuel balances from the previous competitive-price fuel order, recorded on the Balance Control Slip (Boleta de Control de Saldos) (Annex) g) Established multiplication factors Thus, the fuel allocation will be given by the multiplication of the following factors:

For diesel:

Total Days of Absence x Engine Kilowatts x Multiplication Factor (according to respective tables) . A day of absence for the medium-scale fleet, advanced fleet, and semi-industrial shrimp or sardine fleet shall be considered that in which a vessel remains 8 or more hours outside any port, from and to the fishing grounds or in fishing operations.

. The maximum engine kilowatts for calculation purposes may not exceed 298.2800 (equivalent to 400 Hp).

For gasoline:

Total Days of Absence x Multiplication Factor (according to respective tables) . A day of absence for the small-scale artisanal fleet shall be considered that in which a vessel remains 4 or more hours outside any port, from and to the fishing grounds or in fishing operations.

For vessels with engines exceeding 298.2801 Kw, fuel will be granted as if their power were 298.2800 Kw (equivalent to 400 Hp).

For vessels with engines exceeding 298.2801 Kw, fuel will be granted as if their power were 298.2800 Kw (equivalent to 400 Hp).

For vessels with engines exceeding 26.0996 Kw, fuel will be granted as if their power were 26.0995 Kw (equivalent to 35 Hp).

For vessels whose base of operation is located outside the Golfo de Nicoya, that is, on the Costa Rican Pacific or Caribbean coastlines, and with engines exceeding 48.4706 Kw, fuel will be granted as if their power were 48.4705 Kw (equivalent to 65 Hp).

Procedure for fuel for the National Tourist Fishing Fleet

• a)Fuel request (Annex) b) Copy of the Customer Service Sales Invoice c) Trip Report(s) Form and Catch Data per fishing trip (Annex) d) Original and copy of the Fuel Purchase Invoice(s) issued by RECOPE or by duly authorized Service Stations (Annex) e) Confronted copy or photocopy of the original Fuel Balance Control Slip (Boleta de Control de Saldos de Combustible) (Annex).

Before issuing a new Purchase Order, INCOPESCA officials must verify for all vessels belonging to the National Tourist Fishing Fleet that the previous Purchase Order has been made effective at RECOPE, except for those using gasoline, for which it will be allowed that the previous Purchase Order has not necessarily been made effective, but under no circumstances two consecutive Purchase Orders.

Authorization and allocation of fuel at a competitive price for tourist fishing

where:

y= quantity of liters to authorize. x= power in kw of the engine(s) h= total number of hours of fishing operations (only a maximum of 9 hours per day will be recognized)

When the use of two engines is recognized, the allocated fuel may not exceed a power of 250 Hp, in the case of gasoline, and 1450 Hp, in the case of diesel.

Supervision for the proper use of fuel at a competitive price

Said documents must be in the custody of the organizations and available for supervision by the competent officials.

Fishery development fishing (pesca de fomento) and educational fishing (pesca didáctica)

Fuel purchase orders at a competitive price

• a)Purchase order number b) Case file number (número de expediente) c) Vessel name d) Fishing license and registration number e) Name of the beneficiary f) Type of fuel g) Quantity in numbers of the authorized liters of fuel h) Quantity in words of the authorized liters of fuel i) Name and signature of the official who prepares the purchase order j) Signature of the official who approves the purchase order k) Signature of the official who delivers the purchase order l) Signature and identity or residency card number of the person receiving the purchase order m) Seal of the INCOPESCA office n) Date of issuance and expiration date of the purchase order

For quantities greater than 15,001 (fifteen thousand one) liters, the signature of the respective head or the person designated by them to authorize the order shall be required.

• a)The Certificate of Seaworthiness (Certificado de Navegabilidad) is up to date, or, if said document has expired while the vessel was on the fishing trip intended to be settled b) The annual period is paid up c) The contract is in force d) There is no debt with INCOPESCA

Procedure for authorization of consolidation of fuel purchase orders

For such purposes, once the fuel purchase order is received by the beneficiary, they must go to a natural or legal person authorized by INCOPESCA, who in turn has a purchase code with RECOPE, so that with the prior authorization of the beneficiary, this person, in representation of and on behalf of said beneficiary, may acquire the fuel at a competitive price (*).

- They must previously provide the respective authorization from the beneficiary, by means of an official letter addressed to INCOPESCA, duly authenticated or in the presence of SCAC officials, or through a special power of attorney.

- Present the individual fuel purchase orders at a competitive price (original and copies) in good condition without tears, erasures, alterations, or blotches, which will be the subject of the consolidation. Said orders must be valid.

- Present the fuel purchase request they intend to acquire. Said request must contain the full name and code of the Organization, the quantity and type of product to be withdrawn.

In cases where the Organization incurs a loss due to fuel vouchers (chapas de combustible) and the Organization provides the permit holders with their total fuel in accordance with what is authorized by INCOPESCA, the Organization may consolidate fuel vouchers by presenting the request and the invoices issued by RECOPE and providing photocopies, for the purpose of settling the fuel already granted to the permit holders; in this way, the permit holder will be invoiced for what is authorized by INCOPESCA, without causing losses to the Fishing Organization and the permit holder.

- Verify that the fuel purchase orders provided are in good condition without tears, erasures, alterations, or blotches, and are valid on the day of issuance of the consolidation authorization.

- Once the review and verification of the data is completed, the Purchase Order Consolidation authorization shall be issued, which must contain the following information:

• a)Name of the client at RECOPE authorized to manage the consolidation b) Identity Card number of the natural or legal person c) Fuel purchase code number at RECOPE d) Fuel purchase request number at RECOPE e) Authorization number, the authorization number for the consolidation of Fuel Purchase Orders f) The total quantity of liters of fuel (sum of the liters of fuel from the individual fuel orders presented, which must match that of the fuel purchase request) g) Type of fuel h) Date of issuance i) Expiration date j) Must contain three signatures: that of the issuer, that of the authorizing person, that of the delivering person (there may be only two signatories, but the three signature spaces must be filled out by INCOPESCA) and that of the person authorized to receive said Consolidation - A detail must also be issued with the following information:
• a)Authorization number of each individual order. b) Number of liters of the fuel purchase order at a competitive price (*). (*)(Its name modified by agreement No. AJDIP/317-2013 of August 14, 2013. Previously stated "Combustible a precio preferencial") c) Name of the Beneficiary d) The total or sum of the liters of all exempt fuel orders included in the consolidation - Finally, a report must be issued containing the above information line by line.

In cases of authorizations corresponding to several purchase orders, the revalidation period shall be that of the fuel purchase order that expires last.

When, due to errors attributable to the administration, a consolidation is not made effective at RECOPE, expires, or an individual fuel purchase order at a competitive price (*) expires, its re-issuance shall be at no additional cost and must include within it the individual purchase orders expired for this reason.

General provisions

(The following phrase, "except in those cases where diesel-type fuel is deposited directly from the tanker truck to the vessel," thus added by agreement A.J.D.I.P/307 of June 22, 2012)

For its part, the Organization must notify INCOPESCA, by means of a protocolized special power of attorney, of the person(s) designated as responsible for the processing.

8436, the Ley de Pesca y Acuicultura, or other current fishing regulations, and it shall be the responsibility of the Head of the SCAC and the Heads of the Regional or Sub-Regional Offices to file the complaints before the competent authorities.

A. J. D. I. P./020-2007 published in the Official Gazette La Gaceta No. 24 of February 2, 2007, and Agreement No. A. J. D. I. P./570-2007 published in the Official Gazette La Gaceta No. 35 of February 19, 2008, as well as any other prior provision that contradicts it.

Those who do not comply with this provision will not be able to process fuel at INCOPESCA offices.

Transitory Provision 5-A As of the entry into force of this Regulation, the Head of the SCAC and the Regional Heads shall have six calendar months to conduct a study in Puntarenas, Guanacaste, Limón, Quepos, and Golfito, on the gasoline-type and diesel fuel tables that have been applied to estimate the minimum or maximum quantities to authorize by type and number of engines, fleet type, and fishing zones. It shall be the responsibility of the Technical General Directorate to establish the methodology to be followed to conduct said study and present it to the Board of Directors.

A period of six months is established for the Technical General Directorate of INCOEPSCA, in coordination with a representation of vessel owners of medium and advanced semi-industrial scale, to determine a value for the fuel allocation for the vessels' generator plants and the eventual use of two stationary engines on the vessels.

Transitory Provision 6 In accordance with the provisions of article 24 of this regulation, regarding the requirements that must be submitted by beneficiaries in the fuel procedure, once INCOPESCA puts into operation the Integrated Fisheries Services System (Sistema Integrado de Servicios de Pesca, SISPA) with the RECOPE System, the requirement established in subsection c) of said article shall be rendered void.

Transitory Provision 7 The forms to be used cited in this regulation as "annex" shall be made available to interested parties at the Office of the Department of Protection and Registration, and the Regional Directorates and Offices of INCOPESCA located throughout the country.

Transitory Provision 8 The requirement established in subsection b) of article 24, regarding the registration of collection centers, receiving stations, fish markets (pescaderías), processing plants, docks, or transporters with INCOPESCA in order for the invoices, vouchers, or purchase documents for the landed product that must be presented by permit holders processing fuel to be validly accepted, shall enter into force six(*) calendar months after the publication of this Regulation. Therefore, within the indicated period, the presentation and acceptance for processing of the indicated documents originating from such centers or establishments shall be valid, even if they are not registered with INCOPESCA.

• a)Apoderado especial: persona física o jurídica autorizada por el beneficiario, mediante documento jurídico para realizar en su nombre la solicitud, trámite y retiro de la orden de compra de combustible a precio competitivo a nivel Internacional.
• b)Avituallamiento: Acción y efecto de proveerse de víveres y demás insumos necesarios para realizar la faena de pesca.
• c)Autoridad competente: Autoridad Reguladora de los Servicios Públicos (ARESEP), Dirección General de Transporte y Comercialización de Combustibles del Ministerio del Ambiente, Energía y Telecomunicaciones (MINAET), POLICÍA FISCAL, Refinadora Costarricense de Petróleo (RECOPE), Instituto Costarricense de Turismo (ICT), Servicio Nacional de Guardacostas, Delegados de la Fuerza Pública, Capitanías de Puerto de la Dirección General de Transporte Marítimo del Ministerio de Obras Públicas y Transporte, SCAC, Direcciones, Oficinas Regionales y Oficinas Sub Regionales del INCOPESCA.
• d)Base de operación: Lugar de preferencia del beneficiario para realizar los trámites de obtención de combustible a precio competitivo.
• e)Beneficiario: Persona física o jurídica con licencia de pesca comercial vigente, que solicite en forma personal o a través de terceras personas debidamente autorizadas, combustible a precio competitivo, según lo establece el presente Reglamento.
• f)Captura: Cantidad de recursos hidrobiológicos desembarcados en su totalidad en el territorio nacional.
• g)Combustible gravado: Refiérase a la gasolina regular y diesel.
• h)Combustible a precio competitivo a nivel internacional: Es el combustible gasolina, regular y diesel que se utilice en las embarcaciones con licencia de pesca vigente, para la ejecución de labores de pesca turística o comercial no deportiva.
• i)Comité de Combustible: Grupo de trabajo creado para implementar el sistema de control y administración de combustible a precio competitivo, así como para supervisión y estipulación de los cambios necesarios en el reglamento de combustible, y elaborar los manuales e instructivos para la correcta aplicación del mismo.
• j)Conciliación: Confrontar saldos de los litros de combustible autorizados a precio competitivo por el INCOPESCA mediante órdenes de compra, con aquellos litros vendidos por RECOPE para un mismo período.
• k)Convenios: Documentos en los cuales constan las diferentes cláusulas en donde se expresan las condiciones a las que los beneficiarios, las Organizaciones Pesqueras, los apoderados especiales y el INCOPESCA deben cumplir, con relación al combustible que se otorga a precio competitivo.

• l)Días de ausencia: Período de tiempo destinado a la jornada de pesca desde la partida de la embarcación de cualquier puerto, hasta su arribo al mismo o a otro puerto después de terminar su viaje de pesca.
• m)Factor de conversión: Corresponde al valor requerido para convertir los caballos de fuerza (Hp) a kilowatios (Kw), de los motores de las embarcaciones. El cual es igual a 0.7457.
• n)Factor de multiplicación: Es el valor numérico establecido por el cual ha de ser multiplicado el rango de potencia definido.
• o)Flota pesquera nacional: Conjunto de embarcaciones nacionales inscritas en el Registro Público de la Propiedad y con licencia de pesca vigente.
• p)Golfo de Nicoya: Para efectos del presente Reglamento se define como:

Zona Interna: Área comprendida entre la línea recta imaginaria que se extiende desde el extremo más occidental de la ciudad de Puntarenas, hasta el extremo más oriental de Punta Gigante en la Península de Nicoya y de esta línea, aguas adentro bordeando la costa a ambos lados del golfo, hasta llegar a la línea recta imaginaria que se extiende entre Puerto Níspero y Puerto Moreno en la desembocadura del Río Tempisque.

Zona Externa: Área comprendida entre la línea recta imaginaria que se extiende desde el extremo más occidental de la ciudad de Puntarenas, hasta el extremo más oriental de Punta Gigante en la Península de Nicoya y de esta línea, aguas afuera bordeando la costa a ambos lados del golfo, hasta llegar a la línea recta imaginaria que se extiende entre Cabo Blanco y Punta Herradura.

• q)INCOPESCA: Instituto Costarricense de Pesca y Acuicultura.
• r)Organización Pesquera: Son aquellos grupos de pescadores legalmente organizados con fines científicos, de fomento de la actividad pesquera, de protección del medio ambiente, benéficos, de recreo y cualesquiera otros lícitos que no tengan por único y exclusivo objeto el lucro o la ganancia. Incluye además de las Asociaciones específicas que determina la Ley de Asociaciones, las gremiales, las asociaciones de socorros mutuos, de previsión y de patronato y las asociaciones cooperativas de responsabilidad limitada. Las cuales poseen personería y cédula jurídica. Se excluyen de este concepto las sociedades mercantiles que determina el Código de Comercio.
• s)Patrón de pesca o capitán: Persona a bordo de la embarcación responsable de dirigir las faenas de pesca y la navegación.
• t)Pesca artesanal: Actividad de pesca realizada en forma artesanal por personas físicas o jurídicas cuando se trate de asociaciones, cooperativas u otras de similar índole, con uso de embarcación, en las aguas continentales o en la zona costera y con una autonomía para faenar de acuerdo con la legislación vigente.
• u)Pesca comercial: La pesca comercial se realiza para obtener beneficios económicos y se clasifica en:

u.1. Pequeña escala: Pesca realizada en forma personal por personas físicas, sin mediar el uso de embarcación, en las aguas continentales o en la zona costera, o la practicada a bordo de una embarcación con una autonomía para faenar hasta un máximo de tres millas náuticas del mar territorial costarricense.

u.2.Mediana escala: Pesca realizada por personas físicas o jurídicas, a bordo de una embarcación con autonomía para faenar hasta un máximo de cuarenta millas.

u.3. Avanzada: Pesca que realizan, por medios mecánicos, personas físicas o jurídicas, a bordo de una embarcación con autonomía para faenar superior a las cuarenta millas náuticas, orientada a la captura de especies pelágicas con palangre y de otras especies de importancia comercial.

u.4. Semi-industrial: Pesca realizada por personas físicas o jurídicas, a bordo de embarcaciones orientadas a la extracción del camarón con red de arrastre, de la sardina y del atún con red de cerco.

u.5. Industrial: Pesca e industrialización efectuadas por personas físicas o jurídicas, con embarcaciones capacitadas para efectuar a bordo labores de pesca, congelamiento, empaque e industrialización de sus capturas.

u.6. Turística: Actividad pesquera que realizan personas físicas nacionales o extranjeras, con el fin de capturar, con un aparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas continentales, jurisdiccionales o en la Zona Económica Exclusiva, con fines comerciales y propósitos exclusivamente turísticos, llevados a cabo en forma permanente.

• v)Poder especial: Documento protocolizado, mediante el cual el beneficiario autoriza a una persona física o jurídica para realizar en su nombre la solicitud, trámite y retiro de la orden de compra de combustible a precio competitivo.
• w)Puerto: Lugar de partida o arribo de las embarcaciones pesqueras en el ámbito nacional.
• x)RECOPE: Refinadora Costarricense de Petróleo S. A.
• y)Registro de firmas: Documento idóneo donde se consignan las firmas del beneficiario persona física o jurídica y de los apoderados especiales de conformidad con los poderes especiales otorgados.
• z)Sección de Control y Administración de Combustible (SCAC): Dependencia del INCOPESCA encargada de la Administración, Fiscalización y Control del uso eficiente del combustible recomendado a precio competitivo.

De las atribuciones, obligaciones y responsabilidades de la Sección de Control y Administración de Combustible (SCAC)

• a)Autorizar las órdenes de compra para combustible a precio competitivo con el precio internacional y las autorizaciones de consolidados de órdenes de combustible.
• b)Ejecutar los acuerdos emanados por la Junta Directiva del INCOPESCA en esta materia, cualquier otra disposición legal establecida o las regulaciones derivadas de los Convenios suscritos para estos efectos.

(Así reformado por acuerdo A.J.D.I.P./151-2010 del 11 de mayo de 2010) c) Llevar un archivo adicional de los originales del contrato de combustible.

• d)Llevar un archivo adicional de los registros originales de firma de los beneficiarios, así como un archivo de las autorizaciones de consolidación de órdenes de compra combustible a precio competitivo (*) por cliente autorizado por RECOPE.

• e)Llevar un expediente físico manual por cada embarcación beneficiaria, en el que constarán todos los documentos o requisitos establecidos en el presente Reglamento conforme al instructivo.
• f)Efectuar trimestralmente conciliaciones entre las órdenes de compra emitidas por el INCOPESCA y de las órdenes contenidas en las autorizaciones de consolidación de órdenes de compra de combustible. Para sustentar dichas conciliaciones internas se realizaran conciliaciones entre las autorizaciones de consolidación de órdenes de compra emitidas por el INCOPESCA y las hechas efectivas en los planteles de distribución de RECOPE a nivel nacional, a través de una comisión conformada por la jefatura del Sección de Control y Administración del Combustible o su representante, la jefatura de Informática o su representante y uno de las jefaturas de las Oficinas o Direcciones Regionales como representante de esta parte.
• g)Efectuar conciliaciones anuales entre la cantidad de litros autorizados por INCOPESCA y los efectivamente entregados a los pescadores a través de organizaciones, estaciones de servicio y otros centros de almacenamiento y distribución debidamente autorizados.
• h)Recibir y resolver en primera instancia, los reclamos sobre la correcta aplicación de este Reglamento y demás disposiciones que se establezcan para el racional disfrute de los beneficios creados por Ley, con apelación ante la Dirección General Técnica y en última instancia ante la Junta Directiva del INCOPESCA.
• i)Efectuar en razón de su investidura en los lugares y tiempo que consideren procedentes, las inspecciones y los estudios necesarios a todos aquellos sujetos que disfrutan del beneficio de compra de combustible a precio competitivo, para verificar las disposiciones normativas del presente Reglamento y así garantizar el uso correcto y eficiente de este beneficio.
• j)Anular órdenes de compra de combustible a precio competitivo o autorizaciones de consolidación de órdenes de compra de combustible a precio competitivo (*) cuando corresponda, cuya acción será responsabilidad de su jefatura o su sustituto.

• k)Las que le confiera la Junta Directiva del INCOPESCA mediante acuerdo expreso.

Del control y administración del combustible

• a)Valorar y monitorear las acciones de control y administración de combustible de forma periódica.
• b)Elaborar y recomendar a la Junta Directiva modificaciones al reglamento y a los procedimientos que en el tiempo se requieran.
• c)Elaborar y recomendar a la Junta Directiva los instructivos de procedimientos para el control y administración del combustible a precio competitivo y sus modificaciones.
• d)Estandarizar los formularios o cualquier otro documento afín con el combustible a precio competitivo.

De las atribuciones, obligaciones y responsabilidades de los beneficiarios y de las Organizaciones Pesqueras para realizar el trámite de combustible a precio competitivo

Además deberá registrar su firma cedular según el procedimiento establecido por el INCOPESCA.

Personas Físicas:

• a)Presentar original de la cédula de identidad o de residencia libre de condición vigente y aportar fotocopia.

Personas Jurídicas:

• a)Aportar Certificación de Personería Jurídica vigente con no más de un mes de haber sido emitida, que contenga la siguiente información:

1. Calidades del Representante Legal 2. Razón social 3. Número de cédula jurídica 4. División de acciones 5. Plazo Social 6. Objeto Social b) Aportar original y fotocopia de la Cédula de Persona Jurídica vigente.

• c)Presentar original de cédula de identidad o de residencia libre de condición vigente del Representante Legal y aportar fotocopia.

Además su Representante Legal, deberá registrar su firma cedular según el procedimiento establecido por el INCOPESCA.

En aquellos casos que la Asociación no requiera resolución del MINAET por tratarse de situaciones que no requieren la utilización de tanques de almacenamiento de combustible, el convenio tendrá un plazo de vigencia de tres años, a partir del momento en que sea debidamente suscrito por las partes.

• a)Aportar Certificación de Personería Jurídica vigente con no más de un mes de haber sido emitida, que contenga la siguiente información:

1. Calidades del Representante Legal 2. Razón Social 3. Número de Cédula Jurídica 4. Plazo Social 5. Objeto Social b) Presentar original de cédula de identidad o de residencia libre de condición vigente del representante legal y aportar fotocopia.

• c)Presentar original y fotocopia de la Resolución Administrativa otorgada por el MINAET, para el funcionamiento de los tanques de combustible propios o de las Estaciones de Servicio en las que se almacenarán los combustibles.
• d)Presentar original y fotocopia del contrato suscrito con las Estaciones de Servicio Tratándose de organizaciones pesqueras que no utilicen tanques para el almacenamiento de combustibles tipo diesel, en razón de que hacen la compra directa a RECOPE y el combustible adquirido se deposita directamente a los barcos pesqueros utilizando los cisternas autorizados, los requisitos anotados bajo los incisos c) y d) del presente artículo no serán obligatorios. En su lugar será necesaria la presentación de una declaración jurada protocolizada por parte de la Asociación, donde deje rendida su declaración de que se adhiere a esta excepción. Esta declaración deberá presentarse al momento de suscribir o renovar el convenio con INCOPESCA.

• a)Por el vencimiento del plazo, sin que medie solicitud de prórroga en forma legal, b) La imposibilidad de realización del objeto o c) La renuncia expresa o el abandono que realicen los interesados.
• d)Violación a las regulaciones normativas o contractuales, debidamente comprobadas.

(Así reformado el párrafo anterior por acuerdo A.J.D.I.P./151-2010 del 11 de mayo de 2010)

Por un mes cuando:

• a)Nieguen el acceso a la información concerniente al tema de combustible; b) Impidan la inspección o el abordaje de sus embarcaciones, o c) Impidan la revisión de los motores o de sus embarcaciones.

Por dos meses cuando:

• a)Incurran en falsedad en la documentación aportada para tramitar el combustible a precio competitivo, en facturas de combustible, facturas de compra de producto, tarjeta de control de saldos, entre otros.
• b)Incumplan, sin causa justificada, las condiciones generales de orden técnico que indique el INCOPESCA en esta materia.
• c)Soliciten combustible para días en los cuales no ejecutó faenas de pesca.
• d)Utilicen el combustible a precio competitivo durante períodos de veda establecidos por el INCOPESCA o en zonas de pesca no autorizadas o utilicen artes de pesca ilegales.

Por tres meses cuando:

• a)Utilicen el combustible a precio competitivo en una embarcación o motor diferente al autorizado en la licencia de pesca.
• b)Varíen el destino del combustible a precio competitivo para actividades diferentes al tipo de pesca autorizada por el INCOPESCA.
• c)Quien incumpla de manera reiterada con conductas tipificadas en las disposiciones anteriores.

Por un mes cuando:

• a)Nieguen el acceso a la información concerniente al tema de combustible a precio competitivo.
• b)Nieguen la revisión o inspección de los tanques de almacenamiento de combustibles propios o arrendados a las estaciones de servicio.
• c)No tengan debidamente cubicados o calibrados, los taques de almacenamiento de combustible propios o arrendados a las estaciones de servicio.
• d)No tengan en debido funcionamiento las máquinas combustibles propios o arrendados a las estaciones de servicio.

Por dos meses cuando:

• a)Incurran en falsedad en la documentación aportada para tramitar el combustible a precio competitivo, en facturas de combustible, factura de compra de producto, tarjeta de control de saldos, entre otros.
• b)Incumplan, sin causa justificada, las condiciones generales de orden técnico que indique el INCOPESCA en esta materia.

Por tres meses cuando:

• a)Permitan o faciliten el combustible a precio competitivo en una embarcación o motor diferente al autorizado en la licencia de pesca o para realizar actividades diferentes al tipo de pesca autorizado.
• b)Soliciten combustible para días en los cuales el permisionario no ejecutó faenas de pesca.
• c)Incurran en irregularidades o anomalías, tales como falta de controles internos, control sobre saldos de combustible en tanques propios o en las estaciones de servicio, registro de firmas entre otros.
• d)Incumplan con las directrices emanadas por el INCOPESCA.
• e)Quien incumpla de manera reiterada con conductas tipificadas en las disposiciones anteriores.

Los beneficiarios y las Organizaciones Pesqueras, serán solidariamente responsables de reintegrar a favor del INCOPESCA, la cantidad de combustible a precio competitivo disfrutado por el beneficiario, en cuyo caso se procederá a certificar la cantidad de combustible disfrutado y el monto en colones que ella representa.

Dicha certificación será puesta en conocimiento de los beneficiarios y las Organizaciones Pesqueras, para que en el término de treinta días naturales, depositen en la Cuenta del INCOPESCA la suma certificada que se le indicará. Transcurrido el plazo anterior el INCOPESCA procederá a cobrar en vía judicial.

A los interesados se les otorgará la garantía del debido proceso.

Dichas resoluciones serán comunicadas a la Dirección General de Transporte y Comercialización de Combustibles del Ministerio del Ambiente, Energía y Telecomunicaciones (MINAET), Departamento de Relaciones Comerciales de RECOPE para las acciones correspondientes.

Cuando el interesado requiera nuevamente la totalidad del combustible no solicitado, según lo indicado en el párrafo anterior, para que dicha cantidad le sea nuevamente autorizada, bastará con que lo indique en la solicitud de combustible correspondiente.

En aquellos casos en que no aparezca el beneficiario inscrito o se encuentre moroso, ante la Caja Costarricense de Seguro Social, no se autorizara el uso y disfrute del beneficio del combustible a precio competitivo, salvo que presente algún documento (certificación, orden patronal, constancia) emitido por la CCSS en la que se indique que está inscrito, activo y al día.

Del trámite de combustible para la Flota Nacional Pesquera Comercial No Deportiva

• a)Solicitud de combustible (Anexo).
• b)Copia(s) o Fotocopia(s) confrontada con su original de la(s) Factura(s) de Venta del producto emitida por el permisionario, debidamente autorizada por el ente competente, esto para aquellos casos en los cuales no se cuente con la inspección de descarga de productos pesqueros (FIAD).

(Así reformado el inciso anterior por acuerdo N° AJDIP/317-2013 del 14 de agosto del 2013) c) Copia o Fotocopia confrontada con su original de la(s) Factura(s) de Compra del combustible emitidas por RECOPE o por Estaciones de Servicio debidamente autorizadas (Anexo).

• d)Copia(s) o Fotocopia(s) confrontada con su original del (los) zarpe(s) nacional (es) para las embarcaciones pertenecientes a la flota mediana escala, avanzada y semi-industrial.
• e)Declaración Jurada del viaje de pesca para las embarcaciones pertenecientes a la flota artesanal en pequeña escala (Anexo).
• f)Fotocopia de la Boleta de Control de Saldos (Anexo).

En los casos en que se vaya a realizar el primer trámite para la autorización del combustible a precio competitivo a un beneficiario, sea este perteneciente a cualquiera de las Flotas establecidas en el presente Reglamento, se omitirá la documentación solicitada establecida en el inciso F de este artículo.

• g)Algún otro documento que la Jefatura de la Sección de Control y Administración de Combustible o las Jefaturas de las Direcciones u Oficinas Regionales o Sub Regionales del INCOPESCA, consideren estrictamente oportuno para mejor resolver alguna situación especial u ocasional, de conformidad con lo que la Ley contemple.

Antes de emitir una nueva Orden de Compra, los funcionarios del INCOPESCA, deberán verificar que la Orden de Compra anterior se haya hecho efectiva en RECOPE, mientras que en el caso de las embarcaciones pertenecientes a la Flota Artesanal en Pequeña Escala, se permitirá que la Orden de Compra anterior no necesariamente se haya hecho efectiva, pero de ninguna manera dos Ordenes de Compra consecutivas.

De la autorización y asignación del combustible a precio competitivo

• a)Tipo de Flota b) Días de pesca anteriores c) Potencia de motor d) Tipo de combustible e) Factura de compra de combustible (contado o crédito) f) Saldos de combustible de la orden de combustible a precio competitivo anterior consignados en la Boleta de Control de Saldos (Anexo) g) Factores de multiplicación establecidos De esta forma, la asignación de combustible estará dada por la multiplicación de los siguientes factores:

Para diesel:

Total de Días de Ausencia x Kilowatios del Motor x Factor de Multiplicación (según cuadros respectivos) . Se considerará día de ausencia para la flota mediana escala, flota avanzada y flota semi-industrial camaronera o sardinera, aquel en el cual una embarcación permanezca 8 o más horas fuera de algún puerto, desde y hacia los caladeros de pesca o en labores de pesca.

. El máximo de kilowatios del motor para efecto de cálculo no podrá ser mayor a los 298.2800 (equivalentes a 400 Hp).

Para gasolina:

Total de Días de Ausencia x Factor de Multiplicación (según cuadros respectivos) . Se considerará día de ausencia para la flota artesanal en pequeña escala, aquel en el cual una embarcación permanezca 4 o más horas fuera de algún puerto, desde y hacia los caladeros de pesca o en labores de pesca

A las embarcaciones con motores superiores a los 298.2801 Kw, se les otorgará combustible como si su potencia fuera de 298.2800 Kw (equivalente a 400 Hp).

A las embarcaciones con motores superiores a los 298.2801 Kw, se les otorgará combustible como si su potencia fuera de 298.2800 Kw (equivalente a 400 Hp).

A las embarcaciones con motores superiores a los 26.0996 Kw, se les otorgará combustible como si su potencia fuera de 26.0995 Kw (equivalente a 35 Hp).

A las embarcaciones cuya base de operación se encuentre fuera del Golfo de Nicoya, es decir, en los litorales Pacífico o Caribe costarricenses y con motores superiores a los 48.4706 Kw, se les otorgará combustible como si su potencia fuera de 48.4705 Kw (equivalente a 65 Hp).

Del trámite de combustible para la Flota Pesquera Nacional Turística

• a)Solicitud de combustible (Anexo) b) Copia de la Factura de Venta de Servicio al Cliente c) Formulario de Informe (s) del Viaje (s) y de Datos de Capturas por viaje de pesca (Anexo) d) Original y copia de la (s) Factura (s) de Compra del combustible emitidas por RECOPE o por Estaciones de Servicio debidamente autorizadas (Anexo) e) Copia o Fotocopia confrontada con su original de la Boleta de Control de Saldos de Combustible (Anexo).

Antes de emitir una nueva Orden de Compra los funcionarios del INCOPESCA deberán verificar para todas las embarcaciones pertenecientes a la Flota Pesquera Nacional Turística, que la Orden de Compra anterior se haya hecho efectiva en RECOPE, a excepción de aquellas que utilicen gasolina a las que se les permitirá que la Orden de Compra anterior no necesariamente se haya hecho efectiva, pero de ninguna manera dos Órdenes de Compra consecutivas.

De la autorización y asignación del combustible a precio competitivo a la pesca turística

y= cantidad de litros a autorizar.

x= potencia en kw del (los) motor (es) h= número total de horas de faena de pesca (sólo se reconocerá un máximo de 9 horas por día)

Cuando se reconoce la utilización de dos motores, el combustible asignado no podrá exceder la potencia de 250 Hp, tratándose de gasolina, y de 1450 Hp, tratándose de diesel.

De la fiscalización para el buen uso del combustible a precio competitivo

Dichos documentos deberán estar bajo la custodia de las organizaciones y disponibles para la fiscalización por parte de los funcionarios competentes.

De la pesca de fomento y la pesca didáctica

De las órdenes de compra de combustible a precio competitivo

• a)Número de orden de compra b) Número de expediente c) Nombre de la embarcación d) Número de licencia de pesca y de matrícula e) Nombre del beneficiario f) Tipo de combustible g) Cantidad en número de los litros de combustible autorizados h) Cantidad en letras de los litros de combustible autorizados i) Nombre y firma del funcionario que confecciona la orden de compra j) Firma del funcionario que aprueba la orden de compra k) Firma del funcionario que entrega la orden de compra l) Firma y número de cédula de identidad o residencia de la persona que recibe la orden de compra m) Sello de la oficina del INCOPESCA n) Fecha de emisión y fecha de vencimiento de la orden de compra

Para cantidades mayores a 15,001 (quince mil un) litros, se requerirá la firma de la jefatura respectiva o la persona designada por la misma para autorizar la orden.

• a)El Certificado de Navegabilidad se encontrara al día o bien, que dicho documento se haya vencido estando la embarcación en el viaje de pesca que se pretenda liquidar b) El período anual estuviese cancelado c) El contrato estuviese vigente d) No tuviese alguna deuda con INCOPESCA

Para el trámite de autorización de consolidación de órdenes de compra de combustible

Para tales efectos, una vez recibida la orden de compra de combustible por parte del beneficiario, deberá acudir ante una persona física o jurídica autorizada por el INCOPESCA, que a su vez cuente con código de compra ante RECOPE, a fin de que con la autorización previa del beneficiario, ésta en representación y a favor de dicho beneficiario, pueda adquirir el combustible a precio competitivo (*).

- Debe previamente aportar autorización respectiva por parte del beneficiario, mediante oficio dirigido al INCOPESCA debidamente autenticado o en presencia de los funcionarios de la SCAC o a través de poder especial.

- Presentar las órdenes de compra de combustible a precio competitivo individuales (original y copias) en buenas condiciones sin roturas, tachaduras, alteraciones o borrones, las cuales serán objeto del consolidado. Dichas órdenes deberán estar vigentes.

- Presentar la solicitud de compra de combustible que pretende adquirir. Dicha solicitud debe contener nombre completo y código de la Organización, la cantidad y clase de producto a retirar.

En los casos en que la Organización obtenga perdida por concepto de chapas de combustible y que la misma otorgue a los permisionarios su totalidad de combustible de conformidad con lo autorizado por el INCOPESCA, la Organización podrá consolidar por concepto de chapas de combustible presentando la solicitud y las facturas emitidas por RECOPE y aportar fotocopias, con el propósito de solventar el combustible ya otorgado a los permisionarios de esta forma se facturará al permisionario lo autorizado por el INCOPESCA, sin ocasionar perdidas a la Organización Pesquera y al permisionario.

- Verificar que las órdenes de compra de combustible aportadas se encuentren en buenas condiciones sin roturas, tachaduras, alteraciones o borrones y vigentes al día de la emisión de la autorización de consolidación.

- Una vez realizada la revisión y verificación de los datos se procederá a emitir la autorización de Consolidación de Órdenes de Compra, la cual debe contener la siguiente información:

• a)Nombre del cliente ante RECOPE autorizado para gestionar el consolidado b) Número de Cédula de persona física o jurídica c) Número de Código de compra de combustible ante RECOPE d) Número de la solicitud de compra de combustible ante RECOPE e) Número de autorización, el número de la autorización de consolidación de Órdenes de Compra de combustible f) La cantidad total de litros de combustible (sumatoria de litros de combustible de las órdenes combustible individuales presentadas, que debe coincidir con la de la solicitud de compra de combustible) g) Tipo de combustible h) Fecha de emisión i) Fecha de vencimiento j) Deberá contener tres firmas: la del emisor, la del que autoriza, la del que entrega (pueden ser solo dos firmantes pero deben ser llenados los espacios con tres firmas, por parte de INCOPESCA) y la de la persona autorizada para recibir dicho Consolidado - Deberá emitirse también un detalle con la siguiente información:
• a)Número de autorización de cada orden individual.
• b)Cantidad de litros de la orden de compra de combustible a precio competitivo (*).

• c)Nombre del Beneficiario d) El total o sumatoria de los litros de todas las órdenes de combustible exonerado comprendidas en el consolidado - Por último, se deberá emitir un reporte que contenga por línea la información anterior.

Cuando por errores imputables a la administración un consolidado no se haga efectivo ante RECOPE, se venciere, o se venciere una orden de compra de combustible a precio cpmpetitivo (*) individual, su nueva emisión se hará sin costo adicional y deberá incluirse dentro de la misma, las órdenes de compra individuales vencidas por este concepto.

Por su parte la Organización deberá comunicarle al INCOPESCA mediante poder especial protocolizado la(s) persona(s) que designe(n) como encargada(s) de la tramitación.

J. D. I. P./020-2007 publicado en el Diario Oficial La Gaceta Nº 24 del 2 de febrero del 2007 y el Acuerdo Nº A. J. D. I. P./570-2007 publicado en el Diario Oficial La Gaceta Nº 35 del 19 de febrero del 2008, así como cualquier otra disposición anterior que se le oponga.

Quienes no cumplan con esta disposición no podrán tramitar combustible ante las oficinas del INCOPESCA.

Corresponderá a la Dirección General Técnica, establecer la metodología a seguir para realizar dicho estudio y presentarlo a Junta Directiva.

Se establece un período de seis meses para que la Dirección General Técnica del INCOEPSCA, en coordinación con una representación de armadores de embarcaciones de mediana, avanzada escala semi-industrial, determinen un valor para la asignación de combustible para las plantas generadoras de las embarcaciones y el eventual uso de dos motores estacionarios en las embarcaciones.
