Regulations for small and big game hunting outside protected areas and fishing in protected areas, 2009Regulaciones para caza menor y mayor fuera de ASP y pesca en ASP, 2009

6084 of August 24, 1977, and subsection c) of article 21 of this Decree", biological reserves, natural monuments, forest reserves, protective zones, indigenous reserves, "except subsistence hunting for resident indigenous people", wildlife refuges, "except when it involves population management programs carried out by the National System of Conservation Areas of the Ministry of Environment, Energy and Telecommunications", and properties subject to the payment for environmental services (Pago de Servicios Ambientales) regime and those that are under the administration of the different Conservation Areas.

Prohibitions

32633 of March 10, 2005, with the exception of what the National System of Conservation Areas (SINAC) technically provides.

• a)"Calentar" (baiting) wild birds in cages with traps or catching cages during days not authorized for hunting.
• b)Hunting wild birds with artificial light during the night, as well as capturing birds with adhesives and mist nets.
• c)Hunting of all species of resident and migratory wild birds throughout the national territory, with the exception of those indicated in this Executive Decree.
• d)Transporting songbirds (birds with striking songs) or plumage birds (birds with strikingly colored plumage) in catching cages, release cages, or with traps, on dates not authorized for hunting. In those cases where the administered person wishes to transport them, they must have a valid possession permit and a transfer permit in accordance with the Wildlife Law and its Regulation and article 27 of this Decree.
• e)Hunting of songbirds and plumage birds in the places indicated below:
• 1)In the districts of Los Ángeles, Piedades Norte and San Rafael of the canton of San Ramón; the zone comprised between Alto Villegas of the district of Volio of the canton of San Ramón, starting at the Highway that connects Zarcero with San Ramón at the junction to Ángeles Norte, continuing along this road to the junction towards El Silencio, continuing along this road to the bridge over the Río Silencio, continuing along the riverbed downstream to the mouth of the Río Espino, continuing along the right bank upstream to the bridge on the road that connects San Luís with Barranca, from this point continuing along the road to Barranca, continuing along the highway that leads to San Ramón to the initial point located at Alto Villegas and the junction to Ángeles Norte; in the zone comprised between the highway that leads from San Ramón to La Fortuna between the rivers La Esperanza and Burro, left bank up to include El Bosque Eterno de los Niños in the districts of La Tigra de San Carlos and San Isidro de Peñas Blancas of the canton of San Ramón.
• 2)In the district of Monterrey de San Carlos and in the zone comprised between the road that goes from the Community of El Tanque to Monterrey de San Carlos, starting at the junction to Montelimar, continuing along this road to the right, passing through the town of San Andrés, to the town of Nieves continuing until meeting the highway that leads to Los Chiles, passing through Santa Rosa and Acapulco until reaching the crossing of the Río Chimurria, at this site continue to the left on the road that leads towards San Jorge until intercepting the highway that joins San Jorge with Chambacú, from this point continue south along the highway towards Chambacú, and Cedros, continuing to Mirador and the junction that leads to Montelimar at the initial point.
• 3)In the cantons of Puriscal, Acosta, Turrubares, Mora, Dota and Tarrazú and Pérez Zeledón of the province of San José.
• 4)In the canton of Aguirre, Parrita, Buenos Aires and Coto Brus of the province of Puntarenas.
• 5)In the canton of Guarco of the province of Cartago.
• 6)One kilometer on both banks of the Río Virilla, in the zone comprised between the bridge on the General Cañas highway and the Puente de Piedras Negras on the road that connects Puriscal with Turrúcares de Alajuela.
• 7)Starting from the bridge over the Río Aranjuez on the Carretera Interamericana Norte, right bank continuing along said highway to the bridge over the Río Lagarto, from this point upstream along the right bank to the confluence of the Quebrada Rodríguez, near Santa Elena, from this point continuing along the right bank upstream to its spring (naciente) in the Cerro Chomogo, continuing south along the watershed divide and the political limits of the province of Alajuela and Puntarenas until intersecting the Cerro Ojo de Agua, continuing south to the spring (naciente) of the Río Aranjuecito, continuing downstream to the initial point at the bridge on the Carretera Interamericana Norte.
• 8)Hunting of the black-faced solitaire (Myadestes melanops) is prohibited indefinitely throughout the national territory.

Songbirds:

• a)Yellow-crowned euphonia, scrub euphonia (Euphonia luteicapilla), from January 1, 2010, to September 30, 2010.
• b)Yellow-throated euphonia (Euphonia hirundinacea) from January 1, 2010, to September 30, 2010.
• c)White-vented euphonia, scrub euphonia (Euphonia minuta) from January 1, 2010, to September 30, 2010.
• d)Black-throated euphonia, scrub euphonia (Euphonia affinis) from January 1, 2010, to September 30, 2010.
• e)Yellow-faced grassquit (Tiaris olivacea) from April 1, 2010, to September 30, 2010.
• f)Cinnamon-rumped seedeater (Sporophila torqueola) from April 1, 2010, to September 30, 2010.
• g)Variable seedeater (Sporophila aurita) from April 1, 2010, to September 30, 2010.

Plumage birds:

• a)Speckled tanager (Tangara guttata) from March 1, 2010, to September 30, 2010.
• b)Silver-throated tanager, emerald tanager (Tangara icterocephata) March 1, 2010, to September 30, 2010.
• c)House sparrow (Passer domesticus) from May 1, 2010, to August 30, 2010.

Small game hunting of birds with a firearm is prohibited, for the following species:

• a)Band-tailed pigeon (Patagioenas fasciata) during the period from February 1, 2010, to August 31, 2010.
• b)White-winged dove (Zenaida asiática), from April 1, 2010, to October 31, 2010.
• c)Crested bobwhite (Colinus leucopogon) from April 1, 2010, to September 30, 2010.
• d)Red-billed pigeon, short-billed pigeon (Patagioenas flavirostris, Patagioenas nigrirostris) from March 1, 2010, to September 30, 2010.
• e)Dendrocygma autumnalis: black-bellied whistling-duck and Anas discor: blue-winged teal, from April 1, 2010, to October 31, 2010.

Authorizations Small game hunting of birds

• a)In authorized time and only with one catching cage per hunter.
• b)One license will be issued per hunter per year which covers the entire national territory.
• c)Only on Saturdays, Sundays, and holidays authorized by Law, with hours from 6:00 a.m. to 5 p.m.
• d)In the case of bird hunting tournaments and the subsequent release of captured birds, these tournaments are for a specific day in an authorized site according to the submitted application, with a maximum of two dates per season for one site.

The sites must be more than 5 kilometers distant from one another and on dates authorized in this article and article 21 of this decree.

• e)Songbirds:

1. Yellow-crowned euphonia, scrub euphonia (Euphonia luteicapilla), hunting of one piece per hunter per year is permitted in the period from October 1, 2010, to December 31, 2010.

2. Yellow-throated euphonia (Euphonia hirundinacea) hunting of one piece per hunter per year is permitted in the period from October 1, 2010, to December 31, 2010.

3. White-vented euphonia, scrub euphonia (Euphonia minuta) hunting of one piece per hunter per year is permitted in the period from October 1, 2010, to December 31, 2010.

4. Black-throated euphonia, scrub euphonia (Euphonia affinis) hunting of one piece per hunter per year is permitted in the period from October 1, 2010, to December 31, 2010.

5. Yellow-faced grassquit (Tiaris olivacea) hunting of two pieces per hunter per year is permitted in the period from October 1, 2010, to March 31, 2011.

6. Cinnamon-rumped seedeater (Sporophila torqueola) hunting of two pieces per hunter per year is permitted in the period from October 1, 2010, to March 31, 2011.

7. Variable seedeater (Sporophila aurita) hunting of two pieces per hunter per year is permitted in the period from October 1, 2010, to March 31, 2011.

• f)Plumage birds:

1. Speckled tanager (Tangara guttata) hunting of one piece per hunter per year is permitted in the period from October 1, 2010, to February 28, 2011.

2. Silver-throated tanager, emerald tanager (Tangara icterocephata) hunting of two pieces per hunter per year is permitted in the period from October 1, 2010, to February 28, 2011.

3. House sparrow (Passer domesticus) hunting of five pieces per hunter per year is permitted in the period from September 1, 2010, to April 30, 2011.

4. Tricolored munia (Lonchura malaca) hunting is permitted, without limit of pieces throughout the national territory, throughout the year.

• a)Crested bobwhite (Colinus leucopogon), 10 pieces per day, per hunter, throughout the national territory in the period from October 1, 2010, to March 31, 2011.
• b)Dendrocygma autumnalis: black-bellied whistling-duck and Anas discor: blue-winged teal, 15 pieces per day throughout the national territory, except in Protected Areas, in the period from November 1, 2009, to March 31, 2010; and from November 1, 2010, to March 31, 2011.
• c)White-winged dove (Zenaida asiática), 20 pieces per day, per hunter, throughout the national territory, in the period from November 1, 2010, to March 31, 2011.
• d)Red-billed pigeon, short-billed pigeon (Patagioenas flavirostris, Patagioenas nigrirostris), 10 pieces per day, per hunter, throughout the national territory, except the zones delimited in articles 10, 11, 12 and 13 of this decree, when the distribution of these species corresponds, in the period from October 1, 2010, to February 29, 2011.
• e)Band-tailed pigeon (Patagioenas fasciata), 10 pieces per day, per hunter, in the period from September 1, 2010, to January 31, 2011, in the following places:
• 1)On private farms, on both sides of the Carretera Interamericana Sur, between Kilometer 34 to kilometer 39, between kilometer 41 and kilometer 47, between kilometer 52 and kilometer 55, between kilometer 57 and kilometer 64 (site known as Madreselva). Only at more than 50 meters from the edge of the highway and outside the limits of the Los Santos Forest Reserve (Reserva Forestal Los Santos) and the Tapantí Macizo de la Muerte National Park (Parque Nacional Tapantí Macizo de la Muerte). In unauthorized zones (between kilometer 39 to kilometer 40, between kilometer 41 to kilometer 46, between kilometer 52 to kilometer 54, and between kilometer 55 to kilometer 56) which include towns on the edge of the highway, hunting will only be permitted on private farms outside the Los Santos Forest Reserve and the Tapantí Macizo de la Muerte National Park in sites located 1 kilometer or more from the highway.
• 2)On private farms, on both sides of the highway between Carrizal de Alajuela and Poasito, at more than 50 meters from the highway edges.
• 3)On private farms on both sides of the highways between Tarbaca and Vuelta de Jorco, at more than 50 meters from the highway edges.
• f)Rock dove (Columba livia), without limit of pieces, throughout the national territory, throughout the year.
• g)Great-tailed grackle (Quiscalus mexicanus), without limit of pieces, throughout the national territory, throughout the year.
• h)Non-resident foreigners may only hunt in Guanacaste and only the white-winged dove (Zenaida asiática).

Zones authorized for hunting

Zone 1. Province of Guanacaste Zone 2. Provinces of Alajuela and Heredia Zone 3. Provinces of Puntarenas and San José Zone 4. Provinces of Cartago and Limón Hunting is permitted only during the hours between 6:00 a.m. and 6:00 p.m., on authorized days.

On small game hunting and big game hunting with authorized weapons and methods of hunting in the Regulation to the Wildlife Conservation Law

(Guanacaste). Big game and small game hunting is prohibited, with the exception of the following days: July 3, 4, 17 and 18, 2010; August 2, 7, 21, 22, 2010; September 4, 5, 15, 18 and 19, 2010; October 2, 3, 16, 17 and 18, 2010; and November 6, 7, 20 and 21, 2010.

Furthermore, big game and small game hunting is prohibited in the following sites:

• a)In the zone comprised between the following points on the Tilarán topographic sheet: Starting from the town of Santa Elena de Monteverde, at the bridge over the Quebrada Rodríguez, on the road that leads to Las Nubes de Río Chiquito, right bank to the point known as La Esperanza, from this place following the road that leads to San Pedro until intersecting the Río Chiquito, following this riverbed on the right bank to its mouth in the Laguna Arenal, continuing along the right bank of the road that leads to El Castillo, to the mouth of the Río Caño Negro, following upstream to its spring (naciente), from this point following north along the watershed divide and the political limits of the province of Guanacaste and Alajuela to the Cerro Amigos.
• b)In the area delimited by the highway and comprised between the following towns: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo, Portegolpe, Huacas and Brasilito; following the coastline heading north to Playa El Coco.
• c)In the zone comprised between the point at coordinates 364,500 and 315,500 of the Murciélago topographic sheet No. 3048 1 on the Carretera Interamericana Norte, following this highway to the city of Liberia, then following highway 21 of the Ministry of Public Works and Transport (MOPT) to the junction between the town of Paso Tempisque and the town of San Blas, comprised at the point of coordinates 364,699 and 274,509 of the Belén topographic sheet 3047 II, then following the road towards the town of San Blas to the town of Sardinal, following highway 151, heading west to its end at Playas del Coco, this area comprises the zone of the Golfo Papagayo Tourist Hub as well as its immediate area of influence, continuing along the coast to the point at coordinates 354,500 and 302; Ahogados Topographic Sheet No. 3048 2, at Cerro Carbonal, limit of the Santa Rosa National Park (Parque Nacional Santa Rosa), continuing along the southern limit of said park to the initial site at coordinates 364,500 and 315,500 on the Interamericana Highway.
• d)In the area comprised between the following points: from Punta Coyote, at coordinates 193950 N 396400 E, continuing northeast to the road that begins at Caletas, at coordinates 193950 N 397150 E. Continue northeast along this same road to San Francisco de Coyote, at coordinates 198650 N 399900 E. Continue Northeast along the road to Javillo, at coordinates 205925 N 401725 E. Continue Northwest along that road to the junction that goes towards Quebrada Grande, at coordinates 207375 N 396425 E, then continues Northwest along the road to the junction that goes towards Los Ángeles, at coordinates 209525 N 395675 E, from this junction continue Northwest along that road to the junction with the road to San Ramón (Río Ora), at coordinates 213150 N 393650 E, continue Northwest along the road to San Ramón to the intersection that goes from Cangrejal to San Ramón at coordinates 214275 N 389850 E. Continue Northeast along the road to San Ramón to its intersection with the río Chiles at coordinates 214300 N 389875 E, continue Southwest downstream of the Río Chiles to its confluence with the Río Ora, at coordinates 213950 N 389600 E, continue southwest downstream of the Río Ora to its mouth at coordinates 205300 N 376950 E, then continue Southeast along the shoreline to the initial point at Punta Coyote coordinates 193950 N 396400 E.
• e)In the zone comprised in the cerros Caballito and Quebrada Honda, area delimited by the road that leads from Quebrada Honda, Caballito and Corralillo to find the road between Puerto Humo and Nicoya, following this route to the Santa Ana junction, continuing along this road passing through the towns of Santa Ana and Barra Honda to the highway towards Puerto Moreno, continuing to the town of Quebrada Honda, original starting point. Said area is located on the Talolinga and Matambú topographic sheets, Province of Guanacaste.
• f)In the Indigenous Reserves (except subsistence hunting carried out by indigenous people with permission from SINAC).
• g)The coyote (Canis latrans) is excepted from this prohibition.

(Alajuela, Heredia) Big game and small game hunting is prohibited, with the exception of the following days: January 1, 2, 3, 16 and 17, 2010; February 6, 7, 20 and 21, 2010; March 6, 7, 20 and 21, 2010; April 3, 4, 17 and 18, 2010; May 1, 2, 15 and 16, 2010.

Furthermore, big game and small game hunting is prohibited in the following sites:

• a)In the canton of Grecia and in the districts of Piedades Norte, Los Ángeles, San Isidro de Peñas Blancas, Santiago, Piedades Sur, San Rafael and Zapotal of the canton of San Ramón; the district of Monterrey of the canton of San Carlos, in the zone comprised in the districts of Los Ángeles and Volio of the canton of San Ramón; the zone comprised between Alto Villegas of the district of Volio of the canton of San Ramón, starting at the highway that connects Zarcero with San Ramón at the junction to Ángeles Norte, continuing along this road to the bridge over the Quebrada Plata continuing along the riverbed downstream to the mouth of the Río Espino, continuing along the right bank upstream to the bridge on the road that connects San Luís with Barranca, from this point continuing along the road to Barranca, continuing along the highway that leads to San Ramón to the initial point located at Alto Villegas and the junction to Ángeles Norte; in the zone comprised between the highway that leads from San Ramón to La Fortuna between the rivers La Esperanza and Burro, left bank up to include El Bosque Eterno de los Niños in the districts of La Tigra de San Carlos and San Isidro de Peñas Blancas of the canton of San Ramón.
• b)In the zone comprised between the highway that leads from San Ramón to La Fortuna between the rivers La Esperanza and Burro, left bank up to bordering El Bosque Eterno de los Niños in the districts of La Tigra de San Carlos and San Isidro de Peñas Blancas of the Canton of San Ramón.
• c)100 meters on both banks of the Río San Rafael in Muelle de San Carlos, between the bridge on the highway that connects the community of Muelle with Pital and the mouth of the Río San Rafael in the Río San Carlos.
• d)In the zone comprised between the road that goes from the community of El Tanque to Monterrey de San Carlos, starting at the junction to Montelimar, continuing along this road to the right, passing through the town of San Andrés, to the town of Nieves continuing until meeting the highway that leads to Los Chiles, passing through Santa Rosa and Acapulco until reaching the crossing of the Río Chimurria, at this site continue to the left on the road that leads towards San Jorge until intercepting the highway that joins San Jorge with Chambacú, from this point continue south along the highway towards Chambacú, and Cedros, continuing to Mirador and the junction that leads to Montelimar at the initial point.
• e)One kilometer on the right bank downstream of the Río Virilla, in the zone comprised between the bridge on the General Cañas highway and the Puente de Piedras Negras on the highway that connects Puriscal with Turrúcares de Alajuela.
• f)In the Indigenous Reserves, except subsistence hunting carried out by indigenous people with permission from SINAC.
• g)The coyote (Canis latrans) is excepted from this prohibition.

(Puntarenas, San José). Big game and small game hunting is prohibited, except on the following days: July 3, 4, 17 and 18, 2010; August 2, 7, 21, 22, 2010; September 4, 5, 15, 18 and 19, 2010; October 2, 3, 16, 17 and 18, 2010; and November 6, 7, 20 and 21, 2010.

Furthermore, big game and small game hunting is prohibited in the following sites:

• a)On Isla San Lucas, including its marine area.
• b)In the zone comprised between the following points on the Las Juntas topographic sheet: Starting from the bridge over the Río Aranjuez on the Carretera Interamericana Norte, right bank continuing along said highway to the bridge over the Río Lagarto, from this point upstream along the right bank to the confluence of the Quebrada Rodríguez, near Santa Elena, from this point continuing along the right bank upstream to its spring (naciente) in the Cerro Chomogo, continuing south along the watershed divide and the political limits of the province of Alajuela and Puntarenas until intersecting the Cerro Ojo de Agua, continuing south to the spring (naciente) of the Río Aranjuecito, continuing downstream to the initial point at the bridge on the Carretera Interamericana Norte.
• c)In the zone comprised between Golfito of the province of Puntarenas, continuing along the highway that leads to Río Claro, continuing along the left bank of the Carretera Interamericana Sur to the bridge over the Río Térraba, in Palmar Sur, from this point continues along the right bank of the river to Boca Coronado, to finally close at Golfito, original point, the hunting of ducks and doves carried out in lagoons and rice-planted areas located outside protected areas is excepted from this prohibition.
• d)One kilometer on both banks of the Río María Aguilar, in the zone comprised between the Puente Los Anonos on the old road that connects San José with Escazú and the mouth of the Río Virilla.
• e)One kilometer on the left bank of the Río Virilla, downstream, in the zone comprised between the Bridge on the General Cañas highway and the Puente de Piedras Negras on the road that connects Puriscal with Turrúcares de Alajuela.
• f)The hunting of the band-tailed pigeon on the road that runs between Vuelta de Jorco and Palmichal de Acosta, on both banks and in the Cerro El Guabal located at coordinates 205,500 North latitude and 51,800 West longitude, Lambert North, Caraigres Sheet.
• g)In the Indigenous Reserves, except subsistence hunting carried out by indigenous people with permission from SINAC.
• h)In the cantons of Pérez Zeledón, Mora, Santa Ana, León Cortes, Tarrazú, Dota, Puriscal, Turrubares and Acosta of the Province of San José; in the cantons of Parrita, Aguirre, Buenos Aires and Coto Brus of the province of Puntarenas, except what is established in subsection e) of article 6 of this decree, where hunting may take place within the 50 meters measured from the edge of the highway and up to the limits of the protected zone, with exception to what is established in article 20 of this Decree.
• i)The coyote (Canis latrans) is excepted from this prohibition.

(Cartago, Limón). Big game and small game hunting is prohibited, except on the following days: January 1, 2, 3, 16 and 17, 2010; February 6, 7, 20 and 21, 2010; March 6, 7, 20 and 21, 2010; April 3, 4, 17 and 18, 2010; May 1, 2, 15 and 16, 2010.

Furthermore, big game and small game hunting is prohibited in the following sites:

• a)The cantons of Jiménez and Turrialba, of the province of Cartago.
• b)In the district of Orosí of the canton of Paraíso and the district of Tobosi, San Isidro and Patio de Agua of the canton of El Guarco, except the sites established in subsection e of article 6 of this decree, in this zone hunting may take place after the 50 meters measured from the edge of the highway and up to the limits of the protected zone.
• c)Of wild rabbits in the cantons: Cartago, Paraíso, La Unión, Jiménez, Alvarado and Oreamuno all of the province of Cartago, with the exception of the dates October 2, 3, 12, 16 and 17, 2010; and November 6, 7, 20 and 21, 2010.
• d)The coyote (Canis latrans) is excepted from this prohibition.
• e)In the Indigenous Reserves, except subsistence hunting carried out by indigenous people with permission from SINAC.

• a)Odocoileus virginianus: White-tailed deer; 2 males per year.
• b)Canis latrans: coyote; 4 animals per year, subject to authorized hunting season by zone.

• a)Didelphis marsupialis: common opossum; 5 pieces per year, per hunter.
• b)Didelphis virginiana: Virginia opossum; 3 pieces per year, per hunter.
• c)Sylvilagus brasilensis: forest rabbit; 5 pieces per year, per hunter, on the following dates October 2, 3, 12, 16 and 17, 2010; and November 6, 7, 20 and 21, 2010.
• d)Sylvilagus floridanus: cottontail rabbit (conejo de monte); 5 pieces per year, per hunter, on the following dates: October 2, 3, 12, 16, and 17, 2010; and November 6, 7, 20, and 21, 2010.
• e)Sciurus variegatoides: common squirrel (ardilla común); 10 pieces per year, per hunter.
• f)Agouti paca: paca (tepezcuintle); 1 piece per year, per hunter.
• g)Dasyprocta punctata: agouti (guatuza); 2 pieces per year, per hunter.
• h)Ctenosaura similis: spiny-tailed iguana (garrobo); 4 pieces per year, per hunter.

General provisions on big and small game

Therefore, all those users who have wild species captured with licenses from previous years shall have a peremptory period of 3 months for their proper registration, starting from the date of publication of this decree.

Once the period indicated in the preceding paragraph has expired, users may not register licenses from years prior to 2009.

Therefore, interested parties must identify an establishment, be it a veterinary clinic or a pet store, for obtaining said microchip.

Said permit must be authenticated by a lawyer.

Carrying the respective license does not authorize entry onto private properties and/or public lands.

7317 (Ley de Conservación de la Vida Silvestre Nº 7317), the Subregional Offices of the Conservation Areas (Áreas de Conservación) established nationwide, the Administration offices of the National Wildlife Refuges (Refugios Nacionales de Vida Silvestre), and others established for this purpose in the different Conservation Areas that make up the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), shall be responsible for authorizing, issuing, signing, or denying hunting licenses, as well as subsistence licenses when applicable.

The bag limit may be cumulative over hunting days only in the case of ducks (patos), doves (palomas), and quails (codornices). The hunter is obliged to report the number of pieces hunted per day to the respective office of the SINAC Conservation Area or to the nearest Public Force (Fuerza Pública) Delegation to the hunting area visited, which must keep a detailed record of the reports provided by the hunters.

For these purposes, the nearest Conservation Area and its regional headquarters shall maintain close coordination with the Public Force to carry out seizures (decomisos) and complaints when applicable. Likewise, the respective Conservation Area shall carry out periodic visits to areas where hunting occurs most frequently and shall strengthen its annual schedule for random field visits, patrols, and highway checkpoints to inspect and maintain control of the hunted pieces.

In order to improve control regarding the hunting of species by the corresponding regional offices of the National System of Conservation Areas, the administered party, in order to obtain a new license, must present the following:

1- If any specimen is captured, present the original and a copy of the possession permit (permiso de tenencia), according to Article 27 of this decree. In case of non-compliance with this requirement, action shall be taken in accordance with the provisions of Article 108 of the Wildlife Conservation Law, No. 7317 (Ley Nº 7317), amended by Law No. 8689 (Ley Nº 8689) of December 4, 2008.

2- If no capture is made, the expired license must be presented to the nearest Conservation Area so that it can stamp a "no capture" (no captura) or "void" (nulo) seal on it.

3- In cases of loss of the hunting license, a certified sworn statement must be submitted indicating the cause of the loss of the document.

32633 (Decreto Ejecutivo Nº 32633), only when it concerns:

• a)Tracking of prints prepared for the purposes of the tournament on a specific day; for which the harassment, mistreatment, or killing of wild animals is not authorized.
• b)Small game tournaments for songbirds and ornamental birds and their release at the same capture site, with a maximum of two dates per site per authorized period, except in the months of March, April, May, June, July, and August, during which hunting tournaments are prohibited to protect pair bonding, territory establishment, nesting, and chick rearing. Authorize one capture and release tournament for songbirds and ornamental birds in the La Amistad-Pacífico Conservation Area (Área de Conservación La Amistad-Pacífico) during the permitted hunting periods for zone 3.
• c)Tournaments for song or exhibition of songbirds in roofed or enclosed sites conditioned for such purpose. Authorize one song tournament for songbirds in the La Amistad-Pacífico Conservation Area, during the permitted hunting periods for zone 3; the birds must be duly registered.
• d)Authorize one footprint tracking tournament for mammals of the white-tailed deer species (venado, Odocoileus virginianus) and paca (tepezcuintle, Agouti paca) in the La Amistad-Pacífico Conservation Area, during the permitted hunting periods for Zone 3.

For small game tournaments for songbirds and ornamental birds, participants must carry and show, if required, the corresponding valid hunting license. Hunting tournaments must be supervised by SINAC officials through the different Conservation Areas, as applicable. The associations must submit a report on the birds captured and released.

Sport fishing activities in protected areas

8436 (Ley de Pesca, Nº 8436), published in La Gaceta No. 78 of April 25, 2005.

• a)Guapote (Parachromis spp), snook (róbalo, Centropomus undecimalis), tarpon (sábalo, Megalops atlanticus), and other fish species in the lagoons of the Caño Negro Wildlife Refuge (Refugio de Fauna Silvestre de Caño Negro) and the Las Camelias Wildlife Refuge (Refugio de Fauna Silvestre las Camelias), which permit sport fishing in their management plan, between August 1, 2010, and March 31, 2011, inclusive.

Each person may fish a limit of up to 5 pieces per day, with a minimum size of 25 centimeters in length, for a total maximum of 15 pieces, distributed over a minimum of 3 days.

Anyone fishing for this species must demonstrate to the competent authority their presence in the area for at least three consecutive days in order to be able to enjoy the maximum number of pieces established in the preceding paragraph.

• b)Tropical gar (gaspar, Atractosteus tropicus) in the lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, between September 1, 2010, and February 28, 2011, inclusive. Each person may fish a limit of up to 2 fish per day, with a minimum size of 60 cm in length, for a total maximum of 6 pieces.

Anyone fishing for this species must demonstrate to the competent authority their presence in the area for at least three consecutive days in order to be able to distribute the maximum number of pieces indicated in the preceding paragraph.

• c)In Wildlife Refuges and National Parks outside the dates indicated in subsections a and b, when the activity is contemplated in the Management Plan or public use regulations and the fishing is for subsistence or family consumption, provided that the person is registered with the Administration of the Protected Wild Area as a resident of the surrounding villages and requires the use of the fishery resource to feed the family group.

7317 (Ley de Conservación de la Vida Silvestre Nº 7317), the Subregional Offices of the different Conservation Areas, the Administration offices of the National Wildlife Refuges, and others established for this purpose in the different Conservation Areas that make up the National System of Conservation Areas, shall be responsible for authorizing, issuing, signing, or denying fishing licenses, as well as subsistence licenses, within protected wild areas, when the management plan so stipulates.

32633 (Decreto Ejecutivo Nº 32633), in protected wild areas when their management plan permits it, depending on the behavior of the populations.

On the possession of wild animals in captivity

7317 (Ley de Conservación de la Vida Silvestre Nº 7317), administered parties who capture wild animals authorized by this decree and under the protection of the corresponding license must complete and sign an official form listing the species captured or hunted under the coverage of the previous license before the Subregional Office of the respective Conservation Area, within the month following the capture.

In the case of possession of ornamental birds in captivity in aviaries with minimum dimensions of 4 cubic meters, adequately conditioned, a limit of 15 birds in total per aviary per permit holder with the corresponding license is established.

32633 (Decreto Ejecutivo N° 32633).

32633 of March 10, 2005 (Decreto Ejecutivo Nº 32633), regarding "For small game" (Para la caza menor) so that it reads as follows:

"The weapons that may be used for small game are .22 caliber rifles and U-shot bullets, with a minimum muzzle exit pressure of 80 pounds, and other tools such as: catching cages, traps. Excepted from this rule are air-powered weapons, tigrilleras (spring traps), and awls or chusos (spears)."

Given at the Presidency of the Republic.- San José, on the fourteenth day of October of the year two thousand nine.

Prohibiciones

• a)"Calentar" aves silvestres en jaulas con trampas o jaulas cogedoras durante los días no autorizados para la caza.
• b)La caza de aves silvestres con luz artificial durante la noche, al igual que la captura de aves con pegamentos y redes de niebla.
• c)La caza de todas las especies de aves silvestres residentes y migratorias en todo el territorio nacional, con excepción de las que se indiquen en el presente Decreto Ejecutivo.
• d)Transportar aves canoras (aves con llamativos cantos) o de plumaje (aves con plumaje de llamativos colores) en jaulas cogedoras, echadoras o con trampas, en fechas no autorizadas para la caza. En aquellos casos, que el administrado desee transportarlas deberá contar con el permiso de tenencia vigente y permiso de traslado de acuerdo a la Ley de Vida Silvestre y su Reglamento y al artículo 27 de este Decreto.
• e)La caza de aves canoras y de plumaje, en los lugares que se indican a continuación:
• 1)En los distritos de Los Ángeles, Piedades Norte y San Rafael del cantón de San Ramón; la zona comprendida entre Alto Villegas del distrito de Volio del cantón de San Ramón, empezando en la Carretera que comunica Zarcero con San Ramón en el cruce a Ángeles Norte, siguiendo por este camino hasta el cruce hacia El Silencio siguiendo por este camino hasta el puente del Río Silencio, continuando por el cauce aguas abajo hasta la desembocadura en el Río Espino, continuando por la margen derecha aguas arriba hasta el puente en el camino que comunica San Luís con Barranca, de este punto continua por el camino hasta Barranca, siguiendo por la carretera que conduce a San Ramón hasta el punto inicial ubicado en Alto Villegas y el cruce a Ángeles Norte; en la zona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre los ríos la Esperanza y Burro, margen izquierda hasta incluir El Bosque Eterno de los Niños en los distritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del cantón de San Ramón.
• 2)En el distrito de Monterrey de San Carlos y en la zona comprendida entre la carretera que lleva de la Comunidad del Tanque a Monterrey de San Carlos, iniciando en el cruce a Montelimar, siguiendo por este camino a la derecha, pasando por el poblado de San Andrés, hasta el poblado de Nieves siguiendo hasta encontrarse con la carretera que conduce a los Chiles, pasando por Santa Rosa y Acapulco hasta llegar al paso del Río Chimurria, en este sitio se sigue a la izquierda sobre el camino que lleva hacia San Jorge hasta interceptar la carretera que une San Jorge con Chambacú, de este punto se sigue al sur por la carretera hacia Chambacú, y Cedros, siguiendo hasta Mirador y el cruce que lleva a Montelimar en el punto inicial.
• 3)En los cantones de Puriscal, Acosta, Turrubares, Mora, Dota y Tarrazú y Pérez Zeledón de la provincia de San José.
• 4)En el cantón de Aguirre, Parrita, Buenos Aires y Coto Brus de la provincia de Puntarenas.
• 5)En el cantón del Guarco de la provincia de Cartago.
• 6)Un kilómetro en ambas márgenes del Río Virilla, en la zona comprendida entre el puente sobre la autopista General Cañas y el puente de Piedras Negras en la carretera que comunica Puriscal con Turrúcares de Alajuela.
• 7)Partiendo del puente sobre el Río Aranjuez en la Carretera Interamericana Norte, margen derecha siguiendo por dicha carretera hasta el punte sobre el Río Lagarto, de este punto aguas arriba por la margen derecha hasta la confluencia de la Quebrada Rodríguez, cerca de Santa Elena, de este punto siguiendo por la margen derecha aguas arriba hasta su nacimiento en el Cerro Chomogo, continuando al sur por la divisoria de aguas y los límites políticos de la provincia de Alajuela y Puntarenas hasta intersecar el Cerro Ojo de Agua, siguiendo al sur hasta el nacimiento del Río Aranjuecito, continuando aguas abajo hasta el punto inicial en el puente sobre la Carretera Interamericana Norte.
• 8)Se prohíbe por tiempo indefinido la caza del jilguero (Myadestes melanops) en todo el territorio nacional.

Aves canoras:

• a)Aguío coroniamarillo, monjito (Euphonia luteicapilla), del 1º de enero del 2010 al 30 de setiembre del 2010.
• b)Aguío gorgiamarillo (Euphonia hirundinacea) del 1º de enero del 2010 al 30 de setiembre del 2010.
• c)Euphonia menuda, canaria (Euphonia minuta) del 1º de enero del 2010 al 30 de setiembre del 2010.
• d)Finito gargantinegra, finito (Euphonia affinis) del 1º de enero del 2010 al 30 de setiembre del 2010.
• e)Gallito, semillerito cariamarillo (Tiaris olivacea) del 1º de abril del 2010 al 30 de setiembre del 2010.
• f)Setillero collarejo (Sporophila torqueola) del 1º de abril del 2010 al 30 de setiembre del 2010.
• g)Setillero garganta negra (Sporophila aurita) del 1º de abril del 2010 al 30 de setiembre del 2010.

Aves de plumaje:

• a)Tangara moteada, zebra (Tangara guttata) del 1º de marzo del 2010 al 30 de setiembre del 2010.
• b)Tangara dorada, Juanita (Tangara icterocephata) 1º de marzo del 2010 al 30 de setiembre del 2010.
• c)Gorrión común, eléctrico (Passer domesticus) del 1º de mayo del 2010 al 30 agosto del 2010.

Se prohíbe la caza menor de aves con arma de fuego, de las siguientes especies:

• a)Paloma collareja (Patagioenas fasciata) durante el período comprendido del 1º de febrero del 2010 al 31 de agosto del 2010.
• b)Paloma alablanca (Zenaida asiática), del 1º de abril del 2010 al 31 de octubre del 2010.
• c)Codorniz común (Colinus leucopogon) del 1º de abril del 2010 al 30 de setiembre del 2010.
• d)Paloma morada (Patagioenas flavirostris, Patagioenas nigrirostris) del 1º de marzo del 2010 al 30 de setiembre del 2010.
• e)Dendrocygma autumnalis: piches alablanca y Anas discor: cerceta aliazul, del 1º de abril del 2010 al 31 de octubre del 2010.

Autorizaciones Caza menor de aves

• a)En tiempo autorizado y únicamente con una jaula cogedora por cazador.
• b)Se emitirá una licencia por cazador por año la cual abarca todo el territorio nacional.
• c)Únicamente durante los días sábados, domingos y feriados autorizados por Ley, con horario de las 6:00 a.m. a las 5 p.m.
• d)En caso de torneos de caza de aves y la posterior liberación de las aves capturadas, estos torneos son para un día específico en un sitio autorizado según la solicitud presentada, con un máximo de dos fechas por temporada para un sitio.

Los sitios deben estar a más de 5 kilómetros de distancia uno de otro y en fechas autorizadas en este artículo y el artículo 21 de este decreto.

• e)Aves canoras:

1. Aguío coroniamarillo, monjito (Euphonia luteicapilla), se permite la caza de una pieza por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de diciembre del 2010.

2. Aguío gorgiamarillo (Euphonia hirundinacea) se permite la caza de una pieza por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de diciembre del 2010.

3. Euphonia menuda, canaria (Euphonia minuta) se permite la caza de una pieza por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de diciembre del 2010.

4. Finito gargantinegra, finito (Euphonia affinis) se permite la caza de una pieza por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de diciembre del 2010.

5. Gallito, semillerito cariamarillo (Tiaris olivacea) se permite la caza de dos piezas por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de marzo del 2011.

6. Setillero collarejo (Sporophila torqueola) se permite la caza de dos piezas por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de marzo del 2011.

7. Setillero garganta negra (Sporophila aurita) se permite la caza de dos piezas por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 31 de marzo del 2011.

• f)Aves de plumaje:

1. Tangara moteada, zebra (Tangara guttata) se permite la caza de una pieza por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 28 de febrero del 2011.

2. Tangara dorada, Juanita (Tangara icterocephata) se permite la caza de dos piezas por cazador por año en el periodo comprendido del 1º de octubre del 2010 al 28 de febrero del 2011.

3. Gorrión común, eléctrico (Passer domesticus) se permite la caza de cinco piezas por cazador por año en el periodo comprendido del 1º de setiembre del 2010 al 30 de abril del 2011.

4. Capuchino bicolor (Lonchura malaca) se permite su caza, sin límite de piezas en todo el territorio nacional, durante todo el año.

• a)Codorniz común (Colinus leucopogon), 10 piezas por día, por cazador, en todo el territorio nacional en el período comprendido entre el 1º de octubre del 2010 y el 31 de marzo del 2011.
• b)Dendrocygma autumnalis: piches alablanca y Anas discor: cerceta aliazul, 15 piezas por día en todo el territorio nacional, excepto en Áreas Protegidas, en el período comprendido entre el 1 de noviembre del 2009 al 31 de marzo del 2010; y del 1º de noviembre del 2010 al 31 de marzo del 2011.
• c)Paloma ala blanca (Zenaida asiática), 20 piezas por día, por cazador, en todo el territorio nacional, en el período comprendido entre el 1º de noviembre del 2010 al 31 de marzo del 2011.
• d)Paloma morada (Patagioenas flavirostris, Patagioenas nigrirostris), 10 piezas por día, por cazador, en todo el territorio nacional, excepto las zonas delimitadas en los artículos 10, 11, 12 y 13 de este decreto, cuando por la distribución de estas especies corresponda, en el período comprendido entre el 1º de octubre de 2010 al 29 de febrero de 2011.
• e)Paloma collareja (Patagioenas fasciata), 10 piezas por día, por cazador, en el período comprendido entre el 1º de setiembre del 2010 y el 31 de enero del 2011, en los siguientes lugares:
• 1)En fincas privadas, en ambos márgenes de la Carretera Interamericana Sur, entre el Kilómetro 34 hasta el kilómetro 39, entre el kilómetro 41 y el kilómetro 47, entre el kilómetro 52 y el kilómetro 55, entre el kilómetro 57 y el kilómetro 64 (sitio conocido como Madreselva). Únicamente a más de 50 metros del límite de la carretera y fuera de los límites de la Reserva Forestal Los Santos y el Parque Nacional Tapantí Macizo de la Muerte. En las zonas no autorizadas (entre el kilómetro 39 al kilómetro 40, entre el kilómetro 41 al kilómetro 46, entre el kilómetro 52 al kilómetro 54, y entre el kilómetro 55 al kilómetro 56) que incluye poblados a la orilla de la carretera sólo se permitirá la caza en fincas particulares fuera de la Reserva Forestal Los Santos y el Parque Nacional Tapantí Macizo de la Muerte en sitios que se ubiquen a 1 kilómetro o más de la carretera.
• 2)En fincas privadas, en ambas márgenes de la carretera entre Carrizal de Alajuela y Poasito, a más de 50 metros de los límites de carretera.
• 3)En fincas privadas en ambas márgenes de las carreteras entre Tarbaca y Vuelta de Jorco, a más de 50 metros de los límites de carretera.
• f)Paloma de castilla (Columba livia), sin límite de piezas, en todo el territorio nacional, durante todo el año.
• g)Zanate (Quiscalus mexicanus), sin límite de piezas, en todo el territorio nacional, durante todo el año.
• h)Los extranjeros no residentes sólo podrán cazar en Guanacaste y solamente la paloma alablanca (Zenaida asiática).

Zonas autorizadas para la caza

Zona 1. Provincia de Guanacaste Zona 2. Provincias de Alajuela y Heredia Zona 3. Provincias de Puntarenas y San José Zona 4. Provincias de Cartago y Limón La caza se permite solamente en las horas comprendidas entre las 6:00 a.m. a las 6:00 p.m., en los días autorizados.

De la caza menor y mayor con armas y métodos de caza autorizados en el Reglamento a la Ley de Conservación de la Vida Silvestre

(Guanacaste). Se prohíbe la caza mayor y menor, con excepción de los siguientes días: 3, 4, 17 y 18 de julio del 2010; 2, 7, 21, 22 de agosto del 2010; 4, 5, 15, 18 y 19 de setiembre del 2010; 2, 3, 16, 17 y 18 de octubre del 2010; y 6, 7, 20 y 21 de noviembre del 2010.

Además se prohíbe la caza mayor y menor en los siguientes sitios:

• a)En la zona comprendida entre los siguientes puntos en la hoja cartográfica Tilarán: Partiendo del pueblo de Santa Elena de Monteverde, en el puente sobre la Quebrada Rodríguez, en la carretera que lleva a Las Nubes de Río Chiquito, margen derecha hasta el punto conocido como la Esperanza, de este lugar siguiendo el camino que lleva a San Pedro hasta intersectar el Río Chiquito, siguiendo por este cauce en la margen derecha hasta su desembocadura en la Laguna Arenal continuando por la margen derecha del camino que conduce a el Castillo, hasta la desembocadura del Río Caño Negro, siguiendo aguas arriba hasta su nacimiento, de este punto siguiendo al norte por la divisoria de aguas y los límites políticos de la provincia de Guanacaste y Alajuela hasta el Cerro Amigos.
• b)En el área delimitada por la carretera y comprendida entre las siguientes poblaciones: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo, Portegolpe, Huacas y Brasilito; siguiendo la línea de la costa en dirección norte hasta la Playa El Coco.
• c)En la zona comprendida entre el punto de las coordenadas 364,500 y 315,500 de la hoja cartográfica Murciélago Nº 3048 1 sobre la Carretera Interamericana Norte, siguiendo por esta carretera hasta la ciudad de Liberia, luego siguiendo la carretera 21 del Ministerio de Obras Públicas y Transportes hasta el cruce entre el poblado de Paso Tempisque y el poblado de San Blas, comprendido en el punto de las coordenadas 364,699 y 274,509 de la hoja cartográfica Belén 3047 II, luego siguiendo la carretera hacia el poblado de San Blas hasta el poblado de Sardinal, siguiendo la carretera 151, con sentido oeste hasta su final en Playas del Coco, esta área comprende la zona del Polo Turístico Golfo Papagayo así como el área de influencia inmediata al mismo, continuando por la costa hasta el punto de coordenadas 354,500 y 302; Hoja Cartográfica Ahogados Nº 3048 2, en el Cerro Carbonal, límite del Parque Nacional Santa Rosa, continuando por el límite sur de dicho parque hasta el sitio inicial en coordenadas 364,500 y 315,500 sobre la Carretera Interamericana.
• d)En el área comprendida entre los siguientes puntos: de Punta Coyote, en coordenadas 193950 N 396400 E, siguiendo al noreste al camino que inicia en Caletas, en coordenadas 193950 N 397150 E. Se continúa al noreste por ese mismo camino hasta San Francisco de Coyote, en coordenadas 198650 N 399900 E. Se sigue al Noreste por el camino hasta Javillo, en coordenadas 205925 N 401725 E. Sigue al Noroeste por ese camino hasta el cruce que va hacia Quebrada Grande, en coordenadas 207375 N 396425 E, continúa luego al Noroeste por el camino hasta el cruce que va hacia Los Ángeles, en coordenadas 209525 N 395675 E, de este cruce se continúa al Noroeste por ese camino hasta el cruce con el camino a San Ramón (Río Ora), en coordenadas 213150 N 393650 E, continúa al Noroeste por el camino a San Ramón hasta la intersección que va de Cangrejal a San Ramón en coordenadas 214275 N 389850 E. Sigue al Noreste por el camino a San Ramón hasta la intersección de este con el río Chiles en coordenadas 214300 N 389875 E, continúa al Suroeste aguas abajo del Río Chiles hasta su confluencia con el Río Ora, en coordenadas 213950 N 389600 E, continúa al suroeste aguas abajo del Río Ora hasta su desembocadura en coordenadas 205300 N 376950 E, sigue luego al Sureste por la orilla de la playa hasta el punto inicial en Punta Coyote coordenadas 193950 N 396400 E.
• e)En la zona comprendida en los cerros Caballito y Quebrada Honda, área delimitada por el camino que conduce de Quebrada Honda, Caballito y Corralillo hasta encontrar el camino entre Puerto Humo y Nicoya, siguiendo por esta ruta hasta el cruce de Santa Ana, continuando por este camino pasando por los poblados de Santa Ana y Barra Honda hasta la carretera hacia Puerto Moreno, siguiendo hasta el poblado de Quebrada Honda, punto original de partida. Dicha área se encuentra ubicada en las hojas cartográficas Talolinga y Matambú, Provincia de Guanacaste.
• f)En las Reservas Indígenas (excepto la caza de subsistencia que realicen los indígenas con permiso del SINAC).
• g)Se exceptúa de esta prohibición al Coyote (Canis latrans).

(Alajuela, Heredia) Se prohíbe la caza mayor y menor, con excepción de los siguientes días: 1, 2, 3, 16 y 17 del mes de enero del 2010; 6, 7, 20 y 21 de febrero de 2010; 6, 7, 20 y 21 del mes de marzo del 2010; 3, 4, 17 y 18 del mes de abril del 2010; 1, 2, 15 y 16 del mes de mayo del 2010.

Además se prohíbe la caza mayor y menor en los siguientes sitios:

• a)En el cantón de Grecia y en los distritos de Piedades Norte, Los Ángeles, San Isidro de Peñas Blancas, Santiago, Piedades Sur, San Rafael y Zapotal del cantón de San Ramón; el distrito de Monterrey del cantón de San Carlos, en la zona comprendida en los distritos de Los Ángeles y Volio del cantón de San Ramón; la zona comprendida entre Alto Villegas del distrito de Volio del cantón de San Ramón, empezando en la carretera que comunica Zarcero con San Ramón en el cruce a Ángeles Norte, siguiendo por este camino hasta el puente de la Quebrada Plata continuando por el cauce aguas abajo hasta la desembocadura en el Río Espino, continuando por la margen derecha aguas arriba hasta el puente en el camino que comunica San Luís con Barranca, de este punto continua por el camino hasta Barranca, siguiendo por la carretera que conduce a San Ramón hasta el punto inicial ubicado en Alto Villegas y el cruce a Ángeles Norte; en la zona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre los ríos la Esperanza y Burro, margen izquierda hasta incluir El Bosque Eterno de los Niños en los distritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del cantón de San Ramón.
• b)En la zona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre los ríos La Esperanza y Burro, margen izquierda hasta colindar con El Bosque Eterno de los Niños en los distritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del Cantón de San Ramón.
• c)100 metros en ambas márgenes del Río San Rafael en Muelle de San Carlos, entre el puente sobre la carretera que comunica la comunidad de Muelle con Pital y la desembocadura del Río San Rafael en el Río San Carlos.
• d)En la zona comprendida entre la carretera que lleva de la comunidad del Tanque a Monterrey de San Carlos, iniciando en el cruce a Montelimar, siguiendo por este camino a la derecha, pasando por el poblado de San Andrés, hasta el poblado de Nieves siguiendo hasta encontrarse con la carretera que conduce a los Chiles, pasando por Santa Rosa y Acapulco hasta llegar al paso del Río Chimurria, en este sitio se sigue a la izquierda sobre el camino que lleva hacia San Jorge hasta interceptar la carretera que une San Jorge con Chambacú, de este punto se sigue al sur por la carretera hacia Chambacú, y Cedros, siguiendo hasta Mirador y el cruce que lleva a Montelimar en el punto inicial.
• e)Un kilómetro en la margen derecha aguas abajo del Río Virilla, en la zona comprendida entre el puente sobre la autopista General Cañas y el Puente de Piedras Negras en la carretera que comunica Puriscal con Turrúcares de Alajuela.
• f)En las Reservas Indígenas, excepto la caza de subsistencia que realicen los indígenas con permiso del SINAC.
• g)Se exceptúa de esta prohibición al Coyote (Canis latrans).

(Puntarenas, San José). Se prohíbe la caza mayor y menor, excepto los siguientes días: 3, 4, 17 y 18 de julio del 2010; 2, 7, 21, 22 de agosto del 2010; 4, 5, 15, 18 y 19 de setiembre del 2010; 2, 3, 16, 17 y 18,de octubre del 2010; y 6, 7, 20 y 21 de noviembre del 2010.

Además se prohíbe la caza mayor y menor en los siguientes sitios:

• a)En la Isla San Lucas, incluyendo su área marina.
• b)En la zona comprendida entre los siguientes puntos en la hoja cartográfica las Juntas: Partiendo del puente sobre el Río Aranjuez en la Carretera Interamericana Norte, margen derecha siguiendo por dicha carretera hasta el punte sobre el Río Lagarto, de este punto aguas arriba por la margen derecha hasta la confluencia de la Quebrada Rodríguez, cerca de Santa Elena, de este punto siguiendo por la margen derecha aguas arriba hasta su nacimiento en el Cerro Chomogo, continuando al sur por la divisoria de aguas y los límites políticos de la provincia de Alajuela y Puntarenas hasta intersecar el Cerro Ojo de Agua, siguiendo al sur hasta el nacimiento del Río Aranjuecito, continuando aguas abajo hasta el punto inicial en el puente sobre la Carretera Interamericana Norte.
• c)En la zona comprendida entre Golfito de la provincia de Puntarenas, siguiendo por la carretera que conduce hasta Río Claro, continuando por la margen izquierda de la Carretera Interamericana Sur hasta el puente sobre el Río Térraba, en Palmar Sur, de este punto continua por la margen derecha del río hasta la Boca Coronado, para cerrar finalmente en Golfito, punto original, se exceptúa de esta prohibición la caza de patos y palomas que se realice en lagunas y áreas sembradas de arroz ubicadas fuera de áreas protegidas.
• d)Un kilómetro en ambas márgenes del Río María Aguilar, en la zona comprendida entre el puente Los Anonos en la carretera vieja que comunica a San José con Escazú y la desembocadura en el Río Virilla.
• e)Un kilómetro en la margen izquierda del Río Virilla, aguas abajo, en la zona comprendida entre el Puente sobre la autopista General Cañas y el puente de Piedras Negras en la carretera que comunica Puriscal con Turrúcares de Alajuela.
• f)La caza de la paloma collareja en la carretera que conduce entre Vuelta de Jorco y Palmichal de Acosta, en ambas márgenes y en el Cerro El Guabal ubicado en coordenadas 205,500 latitud Norte y 51,800 longitud Oeste, Lambert Norte, Hoja Caraigres.
• g)En las Reservas Indígenas, excepto la caza de subsistencia que realicen los indígenas con permiso del SINAC.
• h)En los cantones de Pérez Zeledón, Mora, Santa Ana, León Cortes, Tarrazú, Dota, Puriscal, Turrubares y Acosta de la Provincia de San José; en los cantones de Parrita, Aguirre, Buenos Aires y Coto Brus de la provincia de Puntarenas, excepto lo establecido en el inciso e) del artículo 6 de este decreto, en donde se podrá cazar en los 50 metros medidos de la margen de la carretera y hasta los límites de la zona protegida, con salvedad a lo establecido en el artículo 20 de este Decreto.
• i)Se exceptúa de esta prohibición al Coyote (Canis latrans).

(Cartago, Limón). Se prohíbe la caza mayor y menor, excepto en los siguientes días: 1, 2, 3, 16 y 17 de enero del 2010; 6, 7, 20 y 21 de febrero del 2010; 6, 7, 20 y 21 de marzo del 2010; 3, 4, 17 y 18 de abril del 2010; 1, 2, 15 y 16 de mayo del 2010.

Además se prohíbe la caza mayor y menor en los siguientes sitios:

• a)Los cantones de Jiménez y Turrialba, de la provincia de Cartago.
• b)En el distrito de Orosí del cantón de Paraíso y el distrito de Tobosi, San Isidro y Patio de Agua del cantón del Guarco, excepto los sitios establecidos en el inciso e del artículo 6 de este decreto, en esta zona se podrá cazar luego de los 50 metros medidos de la margen de la carretera y hasta los límites de la zona protegida.
• c)De conejos silvestres en los cantones: Cartago, Paraíso, La Unión, Jiménez, Alvarado y Oreamuno todos de la provincia de Cartago, con excepción de las fechas 2, 3, 12, 16 y 17 de octubre del 2010; y 6, 7, 20 y 21 de noviembre del 2010.
• d)Se exceptúa de esta prohibición al Coyote (Canis latrans).
• e)En las Reservas Indígenas, excepto la caza de subsistencia que realicen los indígenas con permiso del SINAC.

• a)Odocoileus virginianus: Venado cola blanca; 2 machos por año.
• b)Canis latrans: coyote; 4 animales por año, sujeto a temporada de caza autorizada por zona.

• a)Didelphis marsupialis: zorro pelón; 5 piezas por año, por cazador.
• b)Didelphis virginiana: zorro pelón; 3 piezas por año, por cazador.
• c)Sylvilagus brasilensis: conejo de monte; 5 piezas por año, por cazador, en las siguientes fechas 2, 3, 12, 16 y 17 de octubre del 2010; y 6, 7, 20 y 21 de noviembre del 2010.
• d)Sylvilagus floridanus: conejo de monte; 5 piezas por año, por cazador, en las siguientes de las fechas 2, 3, 12, 16 y 17 de octubre del 2010; y 6, 7, 20 y 21 de noviembre del 2010.
• e)Sciurus variegatoides: ardilla común; 10 piezas por año, por cazador.
• f)Agouti paca: tepezcuintle; 1 pieza por año por cazador.
• g)Dasyprocta punctata: guatuza; 2 piezas por año, por cazador.
• h)Ctenosaura similis: garrobo; 4 piezas por año, por cazador.

Generalidades sobre la caza mayor y menor

Por lo tanto, todos aquellos usuarios que tengan especies silvestres capturadas con licencias de años anteriores tendrán un periodo perentorio de 3 meses para su debida inscripción, a partir de la fecha de la publicación de este decreto.

Una vez vencido el plazo indicado en el párrafo anterior, los usuarios no podrán inscribir las licencias de los años anteriores al 2009.

Dicho permiso deberá estar autenticado por un abogado.

Portar la respectiva licencia no autoriza el ingreso a las fincas privadas y / o terrenos públicos.

El límite de piezas podrá ser acumulativo por días de caza únicamente en el caso de los patos, palomas y codornices. El cazador tiene la obligación de reportar el número de piezas cazadas por día, en la oficina respectiva del Área de Conservación del SINAC o a la Delegación de la Fuerza Pública más cercana a la zona de caza visitada, quienes deberán llevar un registro detallado de los reportes proporcionados por los cazadores.

Para tales efectos el Área de Conservación más cercana y sus sedes regionales mantendrán estrecha coordinación con la Fuerza Pública para realizar los decomisos y denuncias cuando así corresponda. Asimismo el Área de Conservación respectiva, realizará visitas periódicas a las áreas donde se da con mayor frecuencia la cacería; y fortalecerá su programación anual para las visitas aleatorias en campo, patrullajes y puestos de control en carretera a fin de fiscalizar y llevar un control de las piezas cazadas.

Con el objetivo de mejorar el control en cuanto a la cacería de las especies por parte de las oficinas regionales correspondientes del Sistema Nacional de Áreas de Conservación, el administrado, para poder obtener una nueva licencia deberá presentar lo siguiente:

1- Si captura algún espécimen presentar original y copia del permiso de tenencia, de acuerdo al artículo 27 de este decreto. En caso de incumplimiento de este requisito, se actuará de conformidad a lo dispuesto en el artículo 108 de la Ley de Conservación de la Vida Silvestre, Nº 7317, modificado por la Ley Nº 8689 del 4 de diciembre del 2008.

2- Si no captura, deberá presentar la licencia vencida ante el Área de Conservación más cercana, para que ésta le estampe un sello de "no captura" o "nulo".

3- En casos de pérdida de la licencia de caza deberá entregar una declaración jurada certificada indicado la causa de la pérdida del documento.

• a)Rastreo de huellas preparadas para los efectos del torneo en un día determinado; para lo cual no se autoriza el acoso, maltrato o muerte de animales silvestres.
• b)Torneos de caza menor de aves canoras y de plumaje y su liberación en el mismo sitio de captura, con un máximo de dos fechas por sitio por el período autorizado, excepto en los meses de marzo, abril, mayo, junio, julio y agosto, en los cuales se prohíben los torneos de caza para proteger la fijación de parejas, territorio, anidaje y cría de polluelos. Autorizar un torneo de captura y liberación de aves canoras y de plumaje en el Área de Conservación La Amistad-Pacífico durante los periodos de caza permitidos para la zona 3.
• c)Torneos de canto o exhibición de aves canoras en sitios bajo techo o cerrados y acondicionados para tal efecto. Autorizar un torneo de canto para las aves canoras en el Área de Conservación La Amistad-Pacífico, durante los períodos de caza permitidos para la zona 3, las mismas deberán encontrarse debidamente inscritas.
• d)Autorizar un torneo de rastreo de huellas de mamíferos de la especie venado (Odocoileus virginianus) y de tepezcuintle (Agouti paca) en el Área de Conservación La Amistad- Pacífico, durante los períodos de caza permitidos para la Zona 3.

Para los torneos de caza menor de aves canoras y de plumaje, los participantes deberán portar y mostrar, si fuera requerido, la correspondiente licencia de caza vigente. Los torneos de caza deberán ser fiscalizados por funcionarios del SINAC a través de las diferentes Áreas de Conservación según corresponda. Las asociaciones deberán presentar un informe sobre las aves capturadas y liberadas.

Actividades de pesca deportiva en áreas protegidas

• a)Guapote (Parachromis spp), róbalo (Centropomus undecimalis), sábalo (Megalops atlanticus) y demás especies de peces, en, lagunas del Refugio de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre las Camelias, que permiten la pesca deportiva en su plan de manejo, entre el 1º de agosto del 2010 y el 31 de marzo del 2011 inclusive.

Cada persona podrá pescar un límite de hasta 5 piezas por día, con un tamaño mínimo de 25 centímetros de longitud, para un total máximo de 15 piezas; distribuidas en un mínimo de 3 días.

Quien realiza pesca de esta especie, deberá demostrar ante la autoridad competente, la presencia en la zona, de al menos tres días consecutivos, a efectos de poder gozar del número máximo de piezas, dispuesto en el párrafo anterior.

• b)Gaspar (Atractosteus tropicus) en las lagunas del Refugio de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre las Camelias, el 1º de setiembre del 2010 y el 28 de febrero del 2011 inclusive. Cada persona podrá pescar un límite de hasta 2 peces por día, con un tamaño mínimo de 60 cm. de longitud, para un total máximo de 6 piezas.

Quien realiza pesca de esta especie, deberá demostrar ante la autoridad competente, la presencia en la zona, de al menos tres días consecutivos, a efectos de poder distribuir el número máximo de piezas, indicado en el párrafo anterior.

• c)En Refugios de Fauna Silvestre y Parques Nacionales fuera de las fechas indicadas en incisos a y b, cuando la actividad esté contemplada en el Plan de Manejo o reglamentos de uso público y la pesca sea de subsistencia o de consumo familiar debiendo estar registrado en la Administración del Área Silvestre Protegida como residente de los poblados aledaños y requerir de la utilización del recurso pesquero para alimentación del grupo familiar.

De la tenencia de animales silvestres en cautiverio

En el caso de tenencia de aves de plumaje en cautiverio en aviarios con dimensiones mínimas de 4 metros cúbicos adecuadamente acondicionados, se establece un límite de 15 aves en total por un aviario por permisionario con licencia correspondiente.

"Las armas que se podrán utilizar para la caza menor son los rifles de calibre 22 y bala U, con una presión mínima de salida en la boca de 80 libras, y otros utensilios tales como: las jaulas cogedoras, las trampas. Se exceptúa de esta norma las armas impulsadas por aire, las tigrilleras y punzones o chusos."
