The total net profit of the Junta de Protección Social shall be distributed as follows:
- a)From thirteen percent (13%) to fourteen percent (14%) to the Junta de Protección Social, destined to finance capital and institutional development expenses, as well as expenses not directly related to the sale and operation of lotteries, games, and other gambling products.
- b)The Board (Junta) must include, in the annual budget settlements it sends to the Office of the Comptroller General of the Republic (Contraloría General de la República), a detail regarding the use of those resources.
- c)From three percent (3%) to three point ten percent (3.10%) to the Technical Council for Medical-Social Assistance (Consejo Técnico de Asistencia Médico Social), destined exclusively to finance public preventive health programs.
Likewise, from the resources received by the Technical Council for Medical-Social Assistance (Consejo Técnico de Asistencia Médico Social), according to the preceding paragraph, ten percent (10%) shall be allocated to the financing of mental health promotion and prevention programs and activities. Salary payments are excluded from the foregoing percentage.
(Thus added the preceding paragraph by Article 5 of Law No. 9213 of March 4, 2014, "Creation of the Technical Secretariat for Mental Health (Secretaría Técnica de Salud Mental)") d) From eight percent (8%) to nine percent (9%) shall be distributed among associations, foundations, or other organizations whose purposes are directed at the well-being and strengthening of public medical assistance institutions.
Its distribution shall be carried out according to the medical-social importance and according to the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
For these purposes, the following items shall be eligible for financing:
- 1)Specialized medical equipment.
- 2)Remodeling necessary for the installation of medical equipment.
- 3)Specific projects directed at the prevention, diagnosis, and treatment of rare diseases in populations at all stages, as well as programs for comprehensive and multidisciplinary care for individuals affected by Rare Diseases (Enfermedades Raras, ER). Its distribution shall be carried out according to the Manual of Criteria for the Distribution of Resources (Manual de Criterios para la Distribución de recursos) of the Junta de Protección Social.
From the total amount to be distributed among associations, foundations, or other organizations, in accordance with this subsection, five percent (5%) shall be allocated to the development and sustainability of the Rare Disease Registry Center (Centro de Registro de Enfermedades Raras, CRER) at the Costa Rican Institute for Research and Education in Nutrition and Health (Instituto Costarricense de Investigación y Enseñanza en Nutrición y Salud, Inciensa); said resources shall be considered as donations and therefore must be used in accordance with what is indicated in subsection m) of Article 6 of Title IV "Fiscal Responsibility of the Republic", chapter 1, "General Provisions Object, Scope of Application, Definitions and Principles", of Law 9635, Strengthening of Public Finances, of December 3, 2018.
(Thus amended the preceding subsection d) by Article 15 of the Law for Prevention and Comprehensive Health Care for Persons with Rare Diseases to Improve Their Quality of Life and That of Their Families, No. 10550 of October 9, 2024) e) From one percent (1%) to two percent (2%) to the Costa Rican Red Cross Association (Asociación Cruz Roja Costarricense).
- f)From five percent (5%) to six percent (6%) for programs destined for the prevention and care of cancer, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- g)From nine percent (9%) to nine point five percent (9.5%) to the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social), to be exclusively destined to finance the pensions of the non-contributory regime administered by that Institution.
- h)From two percent (2%) to two point five percent (2.5%) to the administrative boards (juntas administrativas) of schools that have care programs for the population with disabilities, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- i)From one percent (1%) to one point five percent (1.5%) among non-governmental organizations dedicated to the prevention and fight against sexually transmitted diseases and the research, treatment, prevention, and care of HIV-AIDS, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- j)From seven percent (7%) to eight percent (8%) for programs destined for the inclusion, as well as full and effective participation in society, of persons with physical, mental, psychosocial, intellectual, or sensory disabilities, giving priority to young persons with disabilities and contemplating access to required support products and services, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de Criterios para la Distribución de Recursos) of the Junta de Protección Social.
Persons with disabilities who become part of the programs indicated in this subsection must have the certification issued by the Disability Certification Service (Servicio de Certificación de la Discapacidad, Secdis), of the National Council for Persons with Disabilities (Consejo Nacional de Personas con Discapacidad, Conapdis).
Any excess funds or undisbursed funds, according to this subsection, shall be redistributed in favor of non-profit programs or organizations authorized by the National Council for Persons with Disabilities (Consejo Nacional de Personas con Discapacidad, Conapdis).
(Thus amended the preceding subsection j) by Article 1 of Law No. 9773 of November 5, 2019) k) From one point seventy-five percent (1.75%) to two point seventy-five percent (2.75%) for drug dependency (farmacodependencia) and alcoholism prevention and treatment programs, as well as for programs that provide care to persons living on the street, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de Criterios para la Distribución de Recursos) of the Junta de Protección Social.
(Thus amended the preceding subsection by the sole article of Law No. 10536 of September 18, 2024) l) From one percent (1%) to two percent (2%) for programs destined for neonatal screening. Said resources shall be transferred to the Costa Rican Association for Screening and Prevention of Disabilities in Children (Asociación Costarricense para el Tamizaje y la Prevención de Discapacidades en el Niño, ACTA).
- m)From four percent (4%) to five percent (5%) for programs destined for the care of minors in a state of abandonment, as well as to care for the minor population in conditions of vulnerability, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- n)From two percent (2%) to three percent (3%) for programs destined for the care of minors deprived of liberty or for minors whose father, mother, or both, are deprived of liberty, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- ñ)From twenty-four point eight percent (24.8%) to twenty-five point seven percent (25.7%) for entities dedicated to the care and protection of older adults and for non-profit programs directed at the care of older adults, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- o)Zero point thirty percent (0.30%) for entities dedicated to the training, organization, and direction of associations, foundations, and groups of individuals dedicated to the care and protection of older adults, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- p)From seven percent (7%) to seven point five percent (7.5%) for non-profit day centers (centros diurnos) for older adults, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- q)From one percent (1%) to two percent (2%) for prevention and care programs for persons who are or have been victims of commercial sexual exploitation and comprehensive care for women who have been victims of violence, in its distinct manifestations; includes the construction and equipping of shelters. This in accordance with the Manual of Criteria for the Distribution of Resources (Manual de Criterios para la Distribución de Recursos) of the Junta de Protección Social.
(Thus amended the preceding subsection by the sole article of Law No. 9930 of December 18, 2020, "Reform Authorization for the Change of Name of the Junta de Protección Social and Establishment of the Distribution of Revenues from National Lotteries, to Strengthen Comprehensive Care and Training for Women Victims of Violence") r) From one percent (1%) to two percent (2%) to the Costa Rican Institute of Sport and Recreation (Instituto Costarricense del Deporte y la Recreación), to be exclusively destined for repairs, improvements, and construction of sports facilities, for the practice of sport and recreation, as well as for the representation of athletes, coaches, and managers, so that they may attend, participate, and compete in international events, in the field of sport, physical education, recreation, and sports training.
- s)Zero point twenty-five percent (0.25%) for the drug dependency (farmacodependencia) care programs carried out by Hogares Crea.
- t)One point five percent (1.5%) to the Costa Rican Gerontological Association (Asociación Gerontológica Costarricense), for programs oriented toward the promotion of a dignified, active, and participatory old age, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social.
- u)One percent (1%) to the National Council for Persons with Disabilities (Consejo Nacional de las Personas con Discapacidad, Conapdis) to develop the program destined for the promotion of autonomy of persons with disabilities. One percent (1%) for the promotion of autonomy of older adults.
(Thus amended the preceding subsection by Article 43 of the Law for the Promotion of Personal Autonomy of Persons with Disabilities, No. 9379 of August 18, 2016) v) From one percent (1%) to two percent (2%) for the acquisition of land, as well as for the construction, equipping, and operation of a penitentiary psychiatric center.
(Corrected the preceding subsection by way of Errata and published in La Gaceta No. 237 of December 7, 2010) When an institution, organization, or other entity not cited in this article exists with the suitability to receive funds, it may be included as a beneficiary of resources in the corresponding sector, in accordance with the Manual of Criteria for the Distribution of Resources (Manual de criterios para la distribución de recursos) of the Junta de Protección Social. Likewise, excess funds or undisbursed funds to a specific sector may be redistributed in favor of the priority sectors defined in the National Development Plan (Plan nacional de desarrollo).
The Board (Junta) must include, in the annual budget settlements it sends to the Office of the Comptroller General of the Republic (Contraloría General de la República), a detail regarding the use of those resources.
